OC issues $1,000-a-day fine for church homeless shelter By Bethany Hooper Associate Editor (June 12, 2026) St. Paul’s by-theSea Episcopal Church will seek declaratory judgment in federal court after the Town of Ocean City began issuing citations this week for a homeless shelter operating on church grounds. Last month, the Town of Ocean City sent a notice to St. Paul’s, ordering it to cease operations at its de facto homeless shelter by June 8 or face municipal infractions for operating barracks-style living quarters in a zoning district where it is not permitted. On Monday, the city made good on its promise by issuing its first $1,000 fine. While City Manager Terry McGean says fines will continue for each day the zoning violation occurs, Pastor Jill Williams said the church has no plans to close the shelter’s doors. “Our attorney is filing for federal relief and protection for us, so we can exercise our religious rights,” she said. “We will go through that process, and the city was told by our attorney that’s what we planned to do if they didn’t stop. They wanted the federal fight, so we will go there.” On March 31, St. Paul’s began moving occupants of an outdoor homeless encampment it had allowed on church grounds into its assembly hall. The indoor shelter opened just hours ahead of a city-imposed deadline to have the church remove the tents – which according to city code is a zoning violation – or face a fine of up to $5,000 per day. In the weeks that followed, the church invested in its indoor shelter, rearranging the assembly hall, hiring staff, and purchasing bunk beds, food and other supplies. On average, the low-barrier shelter houses 27 individuals each night and provides them dinner, breakfast, and a place to sleep and store their belongings. However, the city says the barracksstyle living quarters the church has built inside violates zoning regulations,

as it is not a permitted principal use, accessory use or an approved special exception within the R-3 zoning district in which the church is located. A letter issued by city staff last month notified the church of potential municipal infractions. “As I have stated in the past, the Town has a responsibility to ensure that all facilities comply with established zoning, building, occupancy, and safety codes,” McGean said in an email Monday. “In this case, the church converted an assembly hall into an overnight shelter operation without applying for the approvals required for a change in use. Those requirements exist to ensure that facilities intended for overnight occupancy meet appropriate zoning, life safety, sanitation, occupancy, and building standards. In this particular matter we have vulnerable individuals being housed in a facility not originally designed or approved for that purpose.” McGean said despite the 30-day notice, the church has yet to apply for any permit related to a change of use. As a result, the first citation was issued Monday morning. “These standards are not unique to this situation and are applied consistently to all properties in Ocean City in order to protect the health, safety, and welfare of both occupants and the broader community,” he said. In a letter to the city, attorney Robin Cockey made it clear that his client, St. Paul’s, has no intention of closing the homeless shelter or paying any of the fines that are issued. He also argued the church was protected by the “free exercise” clause of the Federal Constitution, as well as the Religious Land Use and Institutionalized Persons Act, which protects houses of worship and other religious institutions from discrimination in zoning laws. “If you disagree, tell me so, and I will initiate suit in Federal Court seeking declaratory and injunctive relief,” Cockey wrote to the city last month.

By Brian Shane Staff Writer (June 12, 2026) A proposed cable landing station in Worcester County has been blocked from moving forward in the normal approval process unless developer Globalinx wins relief from a zoning appeals board. The ruling doesn’t kill the project outright, but it does prevent the developer’s application from advancing through regular channels under its current zoning classification, which is C-2 general commercial. County planning officials in a June 2 letter to Globalinx rejected the developer’s argument that its proposed cable landing station on Route 611 qualifies as a public utility under existing zoning rules. Utility structures that serve the public – including electric, water, sewer and telecommunications facilities – are permitted uses in the property’s C-2 general commercial zoning. But county staff concluded the proposed facility does not qualify because it would not directly serve the general public. Jennifer Keener, the county’s director of development review and permitting, said the Globalinx application never advanced beyond the county’s Technical Review Committee. She said Globalinx cannot proceed to the Planning Commission unless the Board of Zoning Appeals either grants a special exception or overturns her interpretation that the facility – a landing point for undersea fiber-optic cables – is not a public utility. The finding leaves the proposed cable landing station in an unusual position under existing zoning definitions: it is neither a data center, where information is stored and processed, nor a public utility. County to create legislation in response to cable project

But after discussions last month with both Globalinx and its client Amazon Web Services, staff concluded that the project would not directly serve the general public. There was also no guarantee that regulated telecommunications entities like Verizon and AT&T would become clients at the facility. Globalinx first brought its proposal forward in January to the county’s Technical Review Committee. Plans called for a 24,800-squarefoot facility on a five-acre parcel that

would use up to 5 megawatts of power. It would serve as a landing point for Amazon’s transatlantic cables coming from Ireland. Beyond regulatory hurdles, the project faces mounting opposition on the ground. Descendants and community members have expressed concern about the future of the historic Purnell Cemetery, an African American burial ground located on the property. The county’s zoning determination does not address those concerns. District 3 County Commissioner Eric Fiori, who represents the West Ocean City corridor that would be home to the project, has spent months defining the plan as industrial-scale development that doesn't belong on rural Route 611. At last week’s commissioner meeting, Fiori instructed county staff to create legislation that would address cable landing stations, define the zoning code appropriately, and shut the door on any other legal interpretation. His motion carried unanimously. “We would be irresponsible if we don’t make these adjustments,” Fiori said. “Our water and sewer resources are very, very tight. If we have a data center come in here and attempt to use what little resources we have left, the growth of Worcester County will be absolutely zero over the next so many years.” Fiori, in a June 9 post to Facebook, credited a town hall meeting he hosted May 14 at Stephen Decatur High School as playing “a key role” in helping county staff make their determination. During that forum, Globalinx CEO Greg Twitt acknowledged that the company was not itself a public utility, prompting Fiori to spring up and grab the microphone. “And you don’t fit the zoning code. You just said you’re not a public utility?” Fiori said. “Thank you for admitting you’re not a public utility.” “The usage is public utility that we’re working on, and that’s what we do,” Twitt replied. Moving forward, county zoning staff will work on a definition for cable landing stations and data centers.
