OAK LEAF CITY NEWS e-Bike Safety and the Laws to Protect Our Youth Electric bikes (“e-bikes”) and scooters (“e-scooters”) have gained popularity in recent years as an environmentally friendly and efficient form of “micromobility” for adults, when cars are not efficient or readily available for short commutes. However, many parents have purchased bikes and scooters for children who are now riding throughout the region without a full understanding of the laws, risks, or responsibilities that come with motorized travel. Unsafe/rude riding behavior, lack of helmets, and improper use in pedestrian areas have led to mounting safety concerns among residents. Under California Vehicle Code (“CVC”) Section 312.5, e-bikes are defined as bicycles equipped with a motor of less than 750 watts. They fall into three classes: •

Class 1: E-bikes that assist only while the rider is pedaling, and that cease to assist once the bike reaches 20 mph.

•

Class 2: E-bikes that have a throttle and can propel the bike without pedaling, also with a maximum speed of 20 mph.

•

Class 3: E-bikes that assist while the rider is pedaling, up to 28 mph, and are required to have a speedometer. Riders must be at least 16 years old.

Reports from residents and police officers note that legal use of e-bikes in these classes is not the main issue. A more pressing concern is minors riding motorized bikes capable of reaching 30 mph without the state-required license or training. Parents may be providing what are classified by the state as motorcycles for kids, assuming they are regular e-bikes. Focusing on parental education regarding existing laws is a key focus towards solving some of the issues we experience. Key differences between e-bikes and e-motorcycles:

E-bikes can only reach an assisted max speed of 28 MPH, e-motorcycles exceed 28 MPH and they can often reach freeway speeds.

•

E-bike motors are limited to 750 watts, e-motorcycle motors are measured in kilowatts.

•

E-bikes feature functional pedals, e-motorcycles have pedals that only serve as footrests.


The Oakley Police Department is also noticing an uptick in juveniles riding traditional bicycles in violation of the rules of the road and in hazardous manners. These issues primarily come in the form of: Riding without a helmet: CVC Section 21212(a) A person under 18 years of age shall not operate a bicycle, a nonmotorized scooter, or a skateboard, nor wear in-line or roller skates, nor ride upon a bicycle, a nonmotorized scooter, or a skateboard as a passenger, upon a street, bikeway, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of either the American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC), or standards subsequently established by those entities.

Riding on the wrong side of the road: CVC Section 21202(a) Any person operating a bicycle upon a roadway at a speed less than the normal speed of traffic moving in the same direction at that time shall ride as close as practicable to the right-hand curb or edge of the roadway.

The City of Oakley remains committed to ensuring the safety of all residents and a focus on illegal and rude operation of two-wheeled vehicles. To this end, the Oakley Police Department will address these issues via citations and, in some cases, the two-wheeled vehicles may be seized for a period of time until they can be returned to lawful and responsible owners. Parents should know that if they are purchasing a motorized bicycle/moped or an e-scooter for their child, it requires licensing (CVC 12509.5 and CVC 21235(d)), just like a regular motorcycle or a car, making them illegal to operate if the rider is under age 16 and/or improperly licensed. It should also be known motorized bicycles are substantially faster than e-bikes, and more dangerous. E-scooters cannot go faster than 15 MPH in California and both e-scooters and motorized bikes/mopeds require a bike helmet for riders under 18 years of age.

The California Policy Center (CPC) is an education non-profit focused on education reform, workplace reform, government transparency, and governance. The CPC has a Local Fiscal Health Dashboard (https://californiapolicycenter.org/fiscal-health-dashboard/) that was designed to fill a void in government transparency data left after the California State Auditor’s Office unexpectedly discontinued its popular Local Government High-Risk Dashboard in Continued on next page

CPC’s dashboard uses public data from Annual Comprehensive Financial Reports (ACFRs) that local governments are required to share with the public annually. The methodology used in creating CPC’s dashboard was developed by the Hoover Institution’s State and Local Governance Initiative for its Stanford Municipal Finance Dashboard, which examines state and local municipal data nationwide. The Hoover Institution’s methodology is based on the State Auditor’s methodology, with some changes made to address data availability. The dashboard provides a financial snapshot in time for cities, counties, and school districts across California. The City of Oakley received an overall “A” grade for 2025! The overall fiscal strength score aggregates ten dimensions of financial strength into a single score that ranges from 0 (worst) to 100 (best). It provides a summary of the overall fiscal standing. The ten dimensions are: General Fund Reserves; Debt Burden; Liquidity; Revenue Trends; Pension Costs; Pension Funding; Pension Obligations; OPEB Obligations; OPEB Funding; and Net Worth. The City once again received an Operating Budget Excellence Award for FY 2025/26 from the California Society of Municipal Finance Officers. The Oakley City Council adopted a balanced FY 2026/27 budget on July 9th, providing for high-quality core services while strategizing what the future can hold for our vibrant and evolving community. California Assembly Bill 1332 created a Pre-Approved ADU program requiring that cities maintain an online library of pre-approved ADU plans submitted by designers. Under the law, homeowners can pick a design from this library and work with the designer to submit a complete application with added site-specific documents (for example: a site plan and energy calculations). By streamlining approvals and reducing design costs, AB 1332 aims to make it faster and more affordable for residents to build an ADU on their property.

In addition to accepting pre-approved plans from third party designers, the City of Oakley offers its own pre-approved ADU plans that Oakley homeowners may download at no cost. All plans are updated to meet the 2025 California Building Code. In addition to the four previously available floor plan options, the City has recently added two new options: a 375-square-foot floor plan and a 743-square-foot floor plan. Each floor plan includes three architectural elevation options—Spanish/Mediterranean, California Ranch, and Bungalow/ Craftsman—allowing homeowners to select a design that best fits their property and preferences. Homeowners will work with a qualified professional to adapt the pre-approved plan to their specific site and prepare any required application materials.

East Cypress Road Widening Project Reaches Major Milestones Update Construction continues to make significant progress on the East Cypress Road Widening Project, one of the largest infrastructure investments currently underway in the City of Oakley. The project is being completed in multiple phases and will ultimately improve traffic flow, enhance safety, expand utility infrastructure, and support future growth along the East Cypress Road corridor. The western segment (CIP 247), extending from Knightsen Avenue toward the Contra Costa Water District canal, is nearing completion with the expected completion in October of 2026. Recent work has included reconstruction and paving of key intersections, roadway grading, landscaping infrastructure, and installation of bio-retention facilities. With major roadway improvements now in place, crews are focusing on final drainage and landscaping features. The central segment (CIP 310), located near the Contra Costa Water District canal crossing, has seen substantial progress on underground utility infrastructure. Installation of major water, sewer, gas, communication, and electrical systems is nearing completion. Construction crews are making steady progress on roadway improvements, including curb and gutter installation, and are preparing for the next major phase of work—the undergrounding of the remaining canal segment along the south side of East Cypress Road. Completion of this project is anticipated in Summer of 2027. This segment remains critical to connecting the improvements being completed on either side of the canal. On the eastern segment (CIP 302), between Jersey Island Road and Bethel Island Road, crews continue to make steady progress on new waterline installations, sanitary sewer improvements, and underground electrical infrastructure. These improvements are laying the foundation for future roadway widening and long-term growth in the area. Construction is expected to continue through 2026, with project completion anticipated by the Summer of 2027. As construction progresses, residents and motorists can expect periodic traffic control measures and lane adjustments within active work zones. The City appreciates the community’s patience as these improvements move toward completion. Once finished, the East Cypress Road Widening Project will provide enhanced mobility, improved safety, upgraded utility infrastructure, and increased capacity for future growth throughout the East Cypress corridor.
