Q. I have rented out my four bedroom home to four single UH students. When they moved in I told them I wanted all the same students to stay for the entire lease. They agreed at that time but now one of the students wants to move out and be replaced by another student who I don’t even know. What can I do at this point? They still have six months left on their lease. A. It is always a good thing when all parties who started on the contract actually remain at the property until the end of the lease term. Of course, life happens and sometimes these circumstances can’t be avoided. Hopefully you have prepared for this possibility by providing certain terms in your rental contract. If you are using the Hawaii Association of Realtors Rental Agreement, there is a term that specifically disallows additional tenants to be added without the consent of the landlord. It states: 4. No Subleasing or Additional Tenants: No additional tenants, subleasing, or assignment of the rental Agreement will be allowed without the prior written consent of the Landlord. This then protects you from having someone join the group without your agreement. If this happens, then the tenants would be in breach of the contract and in jeopardy of having the rental agreement terminated. You could also include a clause in your contract (or in an addendum) whereby you could spell out what would happen if someone were to break the lease. You could be specific about how many days’ notice you would want to receive and whether

there would be an applicable termination fee. Of course since there are still three other tenants in the rental, they are still all obligated to pay the full amount of rent regardless of whether one leaves or not. It should be up to the existing tenants to show the unit in an effort to find a replacement tenant. Once one or more individuals are identified, then you can have them fill out an application and even run a credit report to establish financial worthiness. You would want to know who they are and go through the process to approve them. Regarding the security deposit, I would let the tenants deal with that themselves. The security deposit is held as a cleaning and damage deposit which is addressed when the unit is vacated at the end of a tenancy. I would suggest to the remaining tenants to be sure that the room and common areas are cleaned to their satisfaction since they will be held to the condition of the property when they all first moved in. If there are any damages, then this should be addressed before the new tenant moves in. Once everyone is in agreement that the property is in good repair and condition – minus wear and tear – then the new tenant can reimburse the security deposit to the exiting tenant. This scenario isn’t uncommon when you have singles living together. You as the landlord should just be sure that you have conditions built into the contract to address issues such as this.
