2026 Advocacy Recap: Progress & Priorities ALCOHOL: 1. Ready to Drink Cocktails (RTDs) (S6703-B Jackson/A6931-B Tapia)
Description: NYACS is actively supporting
legislation that would allow grocery beer licensees to sell spirit-based ready-to-drink cocktails. The current ban is arbitrary, confuses consumers, and blocks small retailers from competing in a fastgrowing category, despite parity with malt-based RTDs in ABV, packaging, and use. In 2027, NYACS will continue working with industry partners to advance this legislation. NYACS Position: Strong Support. Result: The bill ended session in the Senate Investigations Committee and the Assembly Economic Development Committee.
2. Hemp Beverages (S9220-A Cooney)
Description: Federal action could restrict hemp
products next year, though outcomes remain uncertain. New York has discussed alternative regulatory approaches should federal policy change. Hemp beverages fit the convenience store model. NYACS will closely monitor state and federal developments and act quickly if legal pathways open. A bill sponsored by Senator Cooney would allow certain off-premise retailers to sell low potency cannabis beverages. NYACS Position: Monitor. Result: At of the close of the 2026 session, no action was taken to address manner of sale for hemp beverages. As a result of the recent federal action, it is anticipated that the Legislature may take action to address the issue at the state level.
TOBACCO/NICOTINE: 3. Nicotine Pouch Ban (A141-A Rosenthal; S9954 Bottcher)
Description: A flavored nicotine pouch ban has
been proposed in the last two legislative sessions, however, the issue hit a roadblock this year after the original Senate Sponsor, Sen. Hoylman-Sigal, left the Senate to be Manhattan Borough President. This resulted in a new bill being introduced in the Senate, which does not match the Assembly version. NYACS opposed the measure because it restricted legal adult products. In addition, the Governor and the Legislature took an alternative approach in this year’s budget. In 2027, NYACS will continue outreach to prevent renewed efforts and share updated data demonstrating responsible retail practices. NYACS Position: Oppose. Result: The bills remain in the Senate and Assembly Health Committees.
4. Nicotine Pouch Tax (Part K of Revenue Article VII Bill) Description: Governor Hochul advanced a policy
in her Executive Budget proposal this year to tax nicotine pouch sales at a rate of 75 percent. Given New York’s highest-in-the-nation illicit tobacco market, NYACS worked to advance an alternative approach that would have resulted in a lower per-can tax, without reducing the projected state revenue. NYACS Position: Strong oppose. Result: The Senate and Assembly accepted the Governor’s proposed 75% tax. The law takes effect on September 1, 2026.
5. Illegal Vape Enforcement (S4527-B Comrie/A4619-B Solages)
Description: A growing concern for convenience
store operators is the rise of illegal vape sales. These activities create unfair competition for law-abiding businesses. In 2026, NYACS continued our work from the 2025 session to advocate for enhanced inspections and penalties for violators. Additionally, we continued to push for the establishment of a confidential reporting system that allows retailers
NYACS STOREfronts Quarterly • 3rd Quarter 2026 to anonymously report illegal sales, helping to curb these unlawful practices. NYACS was successful at ensuring that a version of the bill that was more protective to tobacco retailers was advanced, as there was another bill that would’ve completely restricted retailer ability to store product. NYACS Position: Support. Result: The bill passed both Houses of the Legislature this year and awaits action by the Governor. NYACS has remained engaged in the process.
GENERAL BUSINESS: 6. Lottery Commission Increase
Description: In 2027, NYACS will continue
advocating for safeguards that keep brick-andmortar lottery sales strong. We will also continue to advocate for improvements in the handling of lost or stolen tickets and to seek a 1% increase in commission rates for lottery retailers, ensuring that these businesses continue to receive a fair share of revenue. NYACS Position: Support.
7. Swipe Fees (S5587-A Skoufis/A4017-A McDonald)
Description: Legislation proposed in 2025 would have prohibited swipe fees on the sales tax portion of transactions. In 2025, NYACS supported the bill and participated in advocacy efforts, but it stalled in both committees. In 2026, the bill moved to the Senate floor but did not come to a vote before session ended. In 2027, NYACS will continue coalition advocacy and provide lawmakers with retailer cost data. NYACS Position: Support. Result: At the close of session, the bill remained on the Senate floor, and in the Assembly Consumer Affairs Committee.
8. Penny Rounding (S8580-A Skoufis/ A9274-A McDonald)
Description: With the removal of pennies from
U.S mint production last fall, many states looked to address ways to standardize business practices for making change, given the oncoming shortage of pennies. NYACS supported efforts this year to ensure

that there is guidance for businesses, especially those with high rates of cash transactions. This bill would establish protocol that businesses may round down for transactions ending in 1, 2, 6, or 7 cents, and round up for transactions ending in 3, 4, 8, or 9 cents. NYACS Position: Support. Result: The bill passed both houses during the 2026 session and awaits action by the Governor.
9. PROTECT Act (S2282-A Helming/A9684 Cashman) Description: This piece of legislation requires
judges to use a standardized risk assessment tool and allows them to consider both flight risk and public safety when making pretrial decisions for Class A misdemeanors and felonies. It fixes gaps in the current bail law that often prevent judges from imposing meaningful restrictions on highrisk offenders. NYACS strongly supports this bill because it helps protect convenience store workers, customers, and communities from repeat and violent crime. NYACS Position: Support. Result: The bill remains in the Codes Committee in both houses. In the Senate, it was brought to a committee vote and did not pass.
ENVIRONMENTAL: 10. Bottle Bill Expansion (S5684 May/ A6543 Glick)
Description: The 2025 Bottle Bill expansion would have doubled the deposit to 10 cents, expanded covered containers, and imposed stricter pickup schedules. NYACS opposed the bill because it raised costs and presents additional operational burdens. It did not pass either house. In 2026, NYACS continued to educate legislators on the financial strain expanded redemption mandates place on small stores. NYACS Position: Oppose. Result: For a second year in a row, the bill remained in both Environmental Conservation Committees.

PMI US received FDA authorization to market
20 ZYN nicotine pouch products with a specific claim that switching completely from cigarettes lowers the risk of several serious diseases. The five-year modified-risk orders cover 10 varieties in 3- and 6-milligram strengths and require ongoing surveillance. The FDA stressed that ZYN is not risk-free and that people who do not use tobacco should not start.
Stewart’s Shops is
investing $55 million this year to expand, rebuild, and remodel its 400-store network across upstate New York and Vermont. Recent projects include a $3 million replacement store in Watertown, a $3.3 million rebuilt shop in Norwich, and a new $4.3 million location in Sidney. The company is also remodeling at least 15 stores, converting former Jolley locations, and completing a multiyear $30 million expansion of its plant and commercial kitchen.
McLane Comapny promoted Farley Kaiser

for $150 million upfront, with additional payments tied to its performance over three years. Black Buffalo’s team will join Imperial, which plans to use its national sales and retail network to accelerate the brand’s growth.

The article traces the company’s growth from a New York dairy farm to more than 88 locations across New York and Pennsylvania. It also highlights Crosby’s fresh, made-to-order pizzas, affordable prices and popular Western Breakfast Pizza.
National Retail Solutions won two inaugural
2026 CVAI Awards in the AI Agents and AI Business Transformation categories. The awards recognize NRS’s use of AI to help independent retailers automate workflows, improve inventory management, strengthen customer interactions, and increase profitability.
Mirabito Convenience Stores acquired nine
Quicklee’s locations, expanding its presence in Western New York. The stores offer fuel, fresh food, groceries, convenience items, and car washes at select locations. The acquisition supports Mirabito’s broader growth and community investment across the Northeast.
Perfetti Van Melle celebrated Airheads’ 40th
anniversary with $40,000 in donations to four regional nonprofits serving children and families. Its Erlanger, Kentucky, factory produces nearly 6 million Airheads bars daily and employs more than 650 people. The company has invested over $80 million in its Northern Kentucky operations since 2015.
Cumberland Farms plans to rebrand 600 to
700 U.S. stores within five years, refresh about 60 locations annually, and expand Krispy Krunchy Chicken to 500 sites by 2030. The strategy supports its proposed Nasdaq IPO under “CMBY,” though the offering’s size, price, and timing remain undecided.

Altria expanded distribution of its On! Plus
nicotine pouches to 120,000 U.S. stores, while first-half shipment volume rose 5.1% year over year. On!’s retail share reached 8.6% in the second quarter. Altria plans a nationwide rollout of 12-milligram pouches and could introduce Blueberry Mint and Mango Pineapple flavors later in 2026.

Meet the 2026 NYACS Scholarship Recipients The NYACS Scholarship Foundation announced the recipients of the 2026 Emmy Seng Scholarship last month. Our sincere thanks to the Education Committee members - Josh Altman (Mountain/Service Distributors), Rachel Ciotti (Altria), Peter Elliott (Byrne Dairy), and Don Neugebauer (Pompey Mall) - for their thoughtful review and selection.
First Place: Hailey Wilson, Delta Sonic Car Wash Hailey Wilson, who is pursuing a degree in Architecture at the University at Buffalo, has been awarded a $3,000 scholarship. She has maintained an impressive 3.75 GPA while balancing full-time coursework with a job in the convenience industry. She has demonstrated perseverance, leadership, and determination while overcoming personal challenges. Her passion for architecture stems from a desire to combine creativity and problem-solving to design spaces that strengthen communities. Her academic and professional achievements reflect her strong commitment to excellence.
Second Place: Sabri Thabet, Delta Sonic Car Wash Sabri Thabet, who is pursuing a Bachelor of Science in Biology at Le Moyne College, has been awarded a $2,000 scholarship. Sabri has gained valuable healthcare experience as a New York State Certified Emergency Medical Technician and through volunteer service with Le Moyne College EMS and Rahma Clinic. He plans to become a physician who provides compassionate, high-quality care while serving his community.
Third Place: Ian Harris, Delta Sonic Car Wash Ian Harris, who is pursuing a Bachelor of Science in Civil Engineering at the University at Buffalo, has been awarded a $1,000 scholarship. Ian participates in the American Society of Civil Engineers and the University at Buffalo Ski Club while balancing part-time employment and gaining industry experience through a civil engineering internship. He plans to build a career focused on improving infrastructure and energy efficiency.
