From the President Partnership with Habitat for Humanity The 2019 Parade of Homes marked the 19th consecutive year that the North Texas Home Builder’s Association partnered with Habitat for Humanity to raise funds for each of their respective non-profit organizations.

This partnership centers around the concept that local home builders are able to build and display model homes for the viewing pleasure of the general public, for which admission tickets are sold by volunteers supplied by Habitat. The builders are able to show their homes, meet the public and answer questions.

Presumably with the idea of initiating and fostering relationships with viewers that might grow into future business.

Proceeds for the admission tickets are split 50/50 between the two non-profit organizations. Advertising for the event is coordinated by the builders association committee which is chaired by the vice president.

I like working with people from Habitat for Humanity. They are some of the kindest people I’ve ever met in the home building industry. Day in and day out they strive to build and help low income people buy their first home.

As a Developer, Home Builder and former Real Estate Broker I like to see people buy houses. I’ve probably brokered, built, bought and sold literally thousands of houses in my lifetime.

After all the years and all the people I’ve worked with, it’s still thrilling to me to see people move in to their first new house.

Maybe it’s because when I was a little boy my parents couldn’t afford to buy a house, so we rented. I really didn’t know the difference between renting vs owning. As a shoe store manager my dad didn’t make enough money by himself to qualify for a mortgage. He wasn’t a war veteran and FHA was barely getting started so even Government financing wasn’t an option. Even though I was little, I remember how thrilled my parents were when they finally bought that first house. Small as it was, it was theirs.

I genuinely believe that owning your own home really is the “American dream”. Corny as it sounds, I think being vested in your home makes a big difference in how safe and well maintained a house and a community are. I think homeownership promotes and stimulates our economy by providing thousands of jobs. I think the more people that can own their own home, the better it is for our state and our country.

FHA and VA programs are helpful. But they don’t reach everyone and I don’t think our Government can always be relied upon for all the answers when it comes to helping people afford to buy their first home. This is why I like the partnership the North Texas Home Builder’s Association shares with Habitat for Humanity.

They are in the home building and home selling business like I am, except they fill a niche in building affordable houses. And they do it for no profit.

Habitat for Humanity is not your ordinary non-profit charity. It doesn’t come at the expense of our taxpayer dollars and it’s not just giving to the poor. It is a highly structured organization that was founded in 1976. Their goal is to help families build strength, stability, Member FDIC

and self-reliance by providing affordable housing.

They improve the lives of those in need locally and around the world.

Families who are in need of decent, affordable housing can apply to them for the opportunity to own low cost housing. Their ability to repay an affordable, interest free mortgage, as well as their housing need and willingness to partner with Habitat, are among the selection criteria for becoming a Habitat homeowner. Applicants receive financial education and must complete a minimum of 300 hours of “sweat equity� working alongside volunteers to build their own house.

Sweat equity can also take the form of building other Habitat homes or working in the local Habitat resale store.

I like this goal and hope our builders association will continue to support Habitat for Humanity for many years to come.

Dennis Company was begun in Wichita Falls in 1938 by Elmer Dennis. Commercial and oil field construction, along with residential remodeling were the mainstays of the business until the conclusion of World War II. His son, C.W.L. “Dub” Dennis returned from serving as a WWII bombardier navigator and joined his father in partnership in 1946. In the late 1940’s they entered the new home construction market. In 1954 they opened Dennis Lumber Company. In 1957 they added real estate brokerage. In 1960 they developed their first residential lots.

Dennis Company was chosen by Better Homes & Garden Magazine in the 1960’s to build several of their featured “Idea Homes” in Wichita Falls. Dub’s son, Chuck, joined the firm in 1972 after law school and serving as an Army officer. Dennis Company has developed over 800 lots and built over 1,200 homes, plus apartments, townhouses, and light commercial properties.

Dennis Company also helps its customers with selling their present home or trading it. Dennis continued, “We can list the present home of a customer to sell or take their present home in trade.

House trades are done similar to trading cars and really keep you from time delay and moving twice – waiting to sell, then renting for a while, then moving to the new home”.

Experience is important in building a home for a family. A new home is made up of thousands of products and involves many people and different processes. From foundation to home warranty Experience is not listed in the materials list or decorating schedule. But Experience is what brings those thousands of things together – correctly. “We know our experience and the experience of the skilled trades and products we choose is a must. Dennis Company has continually trained personnel and implemented new products and processes so as to build better and better homes.

Dennis Company added its 9th section to Belair Addition this year and is celebrating its 78th anniversary – a celebration of helping to build Wichita Falls. NAHB Sees Success in Current Code Development Cycle

Thanks in large part to NAHB members and their tireless efforts to educate codes officials, none of the 26 high-priority code change proposals opposed by NAHB passed the first stage of International Code Council (ICC) I-Code development.

The ICC recently held its 2019 Group B Committee Action Hearings in Albuquerque, N.M. on proposed changes to the Group B codes for the 2021 edition of the I-codes. Most importantly, Group B includes the International Energy Conservation Code (IECC) and International Residential Code (IRC).

For example, among the 26 proposed changes that NAHB opposed and deemed a top priority, one included a proposal to require an electric vehicle-ready parking space, with charging infrastructure, on all new single-family homes.

The ICC committees considered nearly 1,400 code change proposals. Overall, the committees supported NAHB’s position on 84% of the proposals where a position was taken.

Other major wins included: • Updating the residential footing table where many of the current provisions require oversizing the footers.

• Defeating a proposal that would consider a habitable attic to be a story, subsequently pushing many townhomes out of the Continues on pg 8

residential code.

ICC is accepting public comments on the committee hearing results through July 24. NAHB plans to file at least 36 comments on proposals with unfavorable results. All submitted public comments will be heard at the public comment hearings in October. After the hearings, there will be an online vote open to all ICC governmental voters in November.

NAHB will be asking members to participate in the One & Done campaign to encourage favorable codes voting results. The campaign urges each member to share NAHB’s positions on code changes with at least one code official during a code development cycle.

The Federal Lead Action Plan addresses all

Lead-based Paint Not a Focus of New EPA Compliance Initiatives

1. Increasing compliance with — and

potential sources of lead (e.g., drinking water and consumer products), not just lead-based paint. NAHB recommended to the EPA that the best way to increase compliance with the lead-based

paint

renovation,

repair

and

painting (RRP) rule is to educate home owners and create a demand for certified renovation firms rather than increase enforcement of certified renovation firms.

Based on this recommendation, rather than develop a new enforcement initiative to address lead exposure, the EPA will instead focus on implementing the Federal Lead Action Plan. This includes:

awareness of the importance of — lead-safe renovations under the RRP rule; 2. Developing a mapping tool to identify communities with elevated lead exposures; 3. Conducting targeted geographic initiatives; and 4. Undertaking public awareness campaigns on lead issues.

The U.S. Environmental Protection Agency (EPA) recently

released

new

national

compliance

initiatives that focus on six priority areas. One priority area — lead exposure, including lead-based paint — was originally proposed in February but left off the final list. The final list, however, did include support of the Federal Lead Action Plan to reduce childhood lead exposure.

EPA will not cease enforcement of the RRP rule; in fact, the agency recently launched a targeted lead paint compliance initiative in Vermont.

However, the EPA will not focus additional resources on lead-based paint as a targeted enforcement initiative.

Mechanics Lien Law Lunch & Learn

More than 23 NTHBA builders and associate members attended a lunch & learn on May 21st at the Kemp Center for the Arts sponsored by Builders Agent Network, Jessica Goehring and presenter Donald Shelton of Bush Rudnicki Shelton, P.C. titled Mechanic’s Lien Law for the Texas Don Shelton Contractor & Subcontractor.

After an impressive introduction of Don Shelton, Don humbly took the mic and downplayed the many presentations he has traveled the state of Texas and presented for many of the Texas Home Builders Associations. Don’s company offer’s there service to write the contract C.D. software, sold by the Texas Association of Builders, every two years after each legislative session. Each contract C.D. is designed to protect the builders and includes any new regulation or law passed by legislatures during session and any updates within the two years between sessions based on maturity dates of the legislation. Don said this is one of their company’s best advertising tools. If a builder uses these forms as they are attended and find themselves in litigation, Don is who they will call and he is able to represent them.

Don covered why the topic was important with these three items: •Margins are thinner •Competition is on the rise •It is expensive to prosecute and defend lien claims He is explained there are 6 different lien procedures but was only going to cover 4 along with simple steps to avoid lien liability and get paid.

Lien laws can be found in The Texas Constitution, Art. XVI, Sec. 37 (Original Contractor’s only, self-executing) or in Chapter 53, of the Texas Property Code (All other liens, except for public works projects). He said the following tax laws are relevant.

•Chapter 28, Texas Property Code (Prompt Payment Statute) •Chapter 162, Texas Property Code (Trust Fund Statute) •Title 16, Texas Property Code (Texas Residential Construction Commission Act) With the mechanics lien laws, there are 3 fund pools. They consist of trapped funds, retainage (held and not held), funds paid after notice.

A contractor must follow specific procedures and deadlines in order for a mechanics lien to be valid.

Don said there were two questions that can be asked in order to determine what procedures needed to be followed. Did I contract with the Owner and was the work on a Residence? He mentioned these two questions were important because of timing and notices. If required notices are not given or filed in the time frame that is required, the lien may not be enforceable or you may not have one at all.

2019 Parade of Homes Kickoff Dinner/Casino Night Around 150 NTHBA Members and guest attended the 2019 Parade of Homes Kickoff Dinner/Casino Night. A lot of laughter, smiles and conversation filled Charlie & Jake’s rooms at the Elks Lodge on June 6th to kick of the 67th Annual Parade of Homes. Special guest in attendance where Mike & Nelva White and a host of others from Sheppard Air Force Base 363rd Training Squadron.

We are always grateful to have our 363rd TRS friends join us for our events.

As with most events, it takes a lot of planning and preparation to make things happen.

Kudos to the Parade of Homes Committee, Chairman Barney Brock, Steve Lane, Jeff Boyd, Kerry Wylie, Jeremy Dorzab, Scott Flinn and Rick Belz for the months of planning and procuring sponsors to make this event possible.

With great hospitality, the Elks Lodge served an amazing pork tenderloin, loaded mashed potatoes, green beans, salad, dinner rolls and assorted cobblers for dessert. After dinner and recognition of special guest, NTHBA Partners, special guest, event sponsors and the 2019 Parade home builders it was time for the big event, casino night!

Guest had the opportunity to spend their time playing Slots, Craps, Roulette, Texas Hold Em or Blackjack for 2.5 hours. Everyone had a great time playing, cheering on or just visiting with one another.

When time was called, attendees cashed in their chips for tickets for a chance to win 1 of 6 prizes. Lindsey Russell was the big winner taking home the Grand Prize, a trip for 15 to Remington Park and the IFly package. The Munhollands, Jake & Anne walked away with a gift card for a dinner for 20 from Zeke’s BBQ and a wine tasting package.

Stephanie Johnson won the family fun zone package, Shine won an assorted liquor basket and Mary Ann Dowdy won the top golf package. Door prize drawings for various $25.00 gift cards were drawn throughout the evening.

With a great turn-out, lots of compliments on both the food and event, this one will go down as a huge success!
