From the President Dear Members, It’s been a busy time in the life of our industry. Fees, regulations, add-on’s, you name it, everything points to a higher cost to build homes. While homebuyers are more educated and savvy than ever before.

Wow, how the internet has come of age.

Our NTHBA officers, staff, and volunteers are constantly working on many issues that effect us right here at home.

Vice President, John Harmon, is working with the State Water Board, monitoring the progress of the funds; the state is forthcoming with for water projects, and meeting with members of the Texas Association of Builders in Austin on new codes which are proposed to be adopted.

John, Jose Garcia, Teri, and I will be attending the Sunbelt Builders Show in San Antonio this July. We invite all of you to attend; this should be a great one, along with supporting HOMEPAC. The TAB meetings are held in conjunction with the show. Please contact Teri for all the details.

Our Membership Drive was a great success. We had almost a 10% addition in members. Thanks to all who participated in the "Calling Session". If anyone would like to Mentor a new member please contact Teri or myself.

Without a Mentor the likely hood of that new member to stay and get involved is very low. I can remember Doug McCullough asking me to get involved then always checking in to keep me informed and get me involved.

Without him taking the time to help me along the way, I probably would not be a member. Please consider getting involved as a Mentor, it only takes a few minutes a month.

Remember, the way to change, is not to gripe about the way things are, but to get involved for the sake of making a difference.

Vice President Report The 62nd annual Parade of Homes begins June 7th-15th 2014. This is a showcase of the North Texas Home Builders Association builder members and associates. This year we will again be working with Habitat for Humanity to help benefit their great cause. We have 11 homes in this year’s parade. 2013 was one of our most successful years and we are looking for a great turn out in 2014. Remember to make it to the kickoff lunch at MSU Sikes Lake Center on June the 6th. The lunch will be from 11:30 to 1:00 with a silent auction taking place and the proceeds will go to HOMEPAC. I began to think about this 62nd Annual Parade of Homes and realized that it started way back in 1952. This great event has been going strong due to the hard work of the North Texas Home Builders Association members for generations. They have built a great foundation for the future of NTHBA. These members before us have had to endure politics from 12 different presidents, 62 dry and hot summers, too many droughts to count, 3 major tornados, numerous school bond elections and interest rate fluctuations of 3%-18%. The POH saw all these changes since 1952 including Elvis, rock n' roll, 3 high schools, Lake Arrowhead, Sikes mall, countless wars, Sept.11 and we are still going strong. This is our home and we will continue to fight for our great city. I believe not only NTHBA's POH, but Wichita Falls and the great state of Texas has a bright future.

I am a big fan of Teddy Roosevelt who said "Do what you can, with what you have, where you are."

Stage 5 Water Restrictions

Build PAC The North Texas Home Builders Association has stepped it up considerably contributing to the TAB HomePAC even receiving a star award for reaching our goal 100% but there is another PAC that continues to fight for the home building industry on the National level.

Without both TAB and NAHB spending the countless hours keeping up with what is best for our industry the cost of building could sky rocket to the point many businesses would be closing their doors.

Please read the article below and consider supporting both HomePAC and BuildPAC which in turn helps to keep the home building industry alive.

Why is BUILD-PAC considered so essentially important to NAHB? While the inner workings of Build PAC are complicated and the federal regulations that govern our Build PAC activities must be followed without error, the answer to this question is quite simple. In order for us to gain access to the political process at the level that our organization has come to depend on, we need to appropriately assist our "friends" get elected or to keep their jobs once in office. This assistance is done by correctly contributing to the campaigns of United States Senators and Members of the House of Representatives.

The City of Wichita Falls entered Stage 5 Drought Catastrophe on Saturday, May 17. With this stage in effect, all Stage 1-4 restrictions will remain in place and the following additional restrictions will go into effect: 1. Golf courses will be allowed to use the remaining water from a pond system for irrigation but will not be allowed to refill ponds with City treated water.

2. Commercial car washes will be closed Sunday and Monday, unless they use water from a source other than the City's treated water source.

3. Public and private outdoor swimming pools cannot be filled using City treated water.

4. The watering of home foundations is limited to once a week during the hours of 8:00p to midnight on the designated water day by zone.

5. Water surcharges will double for water use over ten units.

Also during Stage 5, effluent water from the River Road Waste Water Treatment Plant will only be available to commercial contractors who possess a building permit or who are involved in a public works project. Although we have entered Stage 5 Drought Catastrophe the city is optimistic the water reuse project will be coming on line very soon. The City staff does their own water availability calculations based on lake levels and daily usage. However, as our lakes are now at their lowest historic points, we wanted to have a third party expert come in and do a more detailed examination. We contracted with the engineering firm of Freese and Nichols to perform a water availability analysis, sometimes referred to as a Conditional Reliability Assessment, using the most recent volumetric data from our lakes to determine just how long our water would last. Freese and Nichols have been in business for 120 years and is the premier engineering firm for reservoir development and long-range water supply planning. The Conditional Reliability Assessment is a process by which reservoirs are modeled based on the historic hydrologic conditions as well as the current level of demand placed on the water supply. For the purpose of this particular study, demands used in the model were, 10 MGD from the reservoirs and 5 MGD of reuse water. The results of the modeling indicate that under the worst hydraulic conditions ever to be experienced by the Wichita Falls area there would be at least 24 months of water supply remaining. This scenario assumes 2011 climatic conditions (heat, rainfall and evaporation rates) and no inflow into the lakes. No inflow simply means that when we get any rainfall, we assume none of it actually makes its way down the watershed and into the lakes. Keep in mind that these are unprecedented conditions, even worse than the 1930â&#x20AC;&#x2122;s Dust Bowl era and the 1950â&#x20AC;&#x2122;s drought of record. Furthermore, â&#x20AC;&#x153;while lake levels may continue to decline before Continues on page 8

we see a substantial recovery, the models indicate that there is less than a 1% chance that our reservoirs will EVER run dry. In other words, with our continued conservation efforts and the Direct Potable Reuse Supply, it is VERY UNLIKELY that this would ever happen.

This is a living, breathing water model that will need to be updated periodically to ensure its accuracy going forward.

The North Texas Home Builders Association cannot say thank you enough for the great attitude member’s emitted at the May 8, 2014 General Membership Meeting after showing up for lunch and getting roped into a membership drive. Each attendee was given a different color napkin which represented the table they were to sit at. Each table of members then became a team competing to see which team could gain the most new members. Each member of the green team who won with 4 new members was rewarded with a $25.00 gift card to the Road House. In spite of a little confusion everyone began making numerous phone calls. Not everyone was fortunate enough to bring on a new member but the contacts made gives the association a great prospect list to follow up with. Clean Water Act Proposal Skirts Federal Law, Harms Small Businesses May 29, 2014 - A proposed rule by the Environmental Protection Agency and U.S. Army Corps of Engineers (Corps) redefining the scope of waters protected under the Clean Water Act would harm home building firms and evades the intent and the letter of the law to make the regulatory process less costly and more efficient for small businesses, the National Association of Home Builders (NAHB) told Congress today.

Tom Woods, president of Blue Springs, Mo.-based Wood Custom Homes and NAHB’s first vice chairman, said the EPA and Corps overstepped their boundaries by certifying the proposed rule without complying with the Regulatory Flexibility Act (RFA), which requires federal agencies to review regulations for their impact on small businesses and consider less burdensome alternatives.

“By completely bypassing the RFA process, the agencies are not interested in hearing from the regulated community,” Woods testified before the House Small Business Committee. “Their only objective is to move this regulation closer to the finish line. For a rule of this magnitude, the small business voice must be heard and the agencies have failed to provide that platform.”

The claim by the EPA and the Corps that virtually anything could be a “tributary” if it is determined to have a bed, bank and an ordinary high-water mark could erroneously include manmade ditches, pipes, canals, dams, groundwater and isolated wetlands.

The rule also exacerbates the current regulatory confusion by adding new, undefined terms such as “floodplain” and “riparian area” to give regulators automatic federal jurisdiction over properties that contain isolated wetlands, ephemeral streams or any land features covered under the expansive definition of tributary.

“As a small business owner, this unpredictability will make it difficult for my business to comply and grow,” said Woods.

“By falling well short of providing the clarity and certainty the construction industry seeks, the proposal could cause a slowdown in nationwide housing production that would harm state and local economies.”
