Wonghadbeendrivingon a West Vancouver road (whichoneisnotspecified) whenhe came upon a section thathad recentlybeen repaved after waterlinework, accordingtotheJuly17decision.

Wongallegedthatthe repairedsectionofthe road was not filledtothepreviouslevel, sothere was a one-inch depressionleadingstraightinto a speedbump.Because of theuneven roadsurface, Wong’s frontbumperhitthe speedbump, resulting in a repair billof $1,821, thedecision states.

TribunalmemberPeter Menniequicklydismissed Wong’sclaim againstthe MunicipalInsuranceAssociation, findingtheorganizationneverowedhim a dutyof care.

As forwhetherthedistricthadbeen negligent, Wong didnotprovideany evidence of municipalstaffacting unreasonably.

“OntheevidenceIhave, West Vancouverfollowedits roadmaintenancepolicyby repairing the road promptly afterMr. Wong reportedit asa hazard,” Menniewrote.
