The court is hearing submissions from a variety of opponents, including Fight the Tip, which has led the opposition in a four-year battle to block a pollution threat to the entire Kaipara Harbour. Hearing commissioners decided in favour of the company, sparking the current appeal. “It is heartening to see that the court process is revealing some real truths about this project,” says FTT executive member Michelle Carmichael. “Fight the Tip was pleased to hear evidence which shows that the Wayby Valley site was not their first choice. In fact, it had been rejected twice as unsuitable, with many other sites favoured instead. Reports revealed that a site at Woodhill was the highest ranked at 71 per cent compared to Wayby at 55 per cent. “This is certainly not what we got told through consultation. When we specifically asked about alternative sites, Waste Management kept telling us that Wayby was the best site they had looked at,” Michelle said. “The fact that the alternative sites are not perfect either indicates how truly bad this site option is and that we are right to be advocating for a nationwide change to how we deal with waste in New Zealand. Our recycling rates are incredibly behind leaders in the world in this area. “We knew this site did not make sense considering its characteristics, which are named as undesirable or features to avoid in landfill siting criteria that Waste Management representatives helped write.

“A 2014 report revealed in court confirmed our concerns and was the basis for rejecting the site at that time. The main reasons being the nearby river and a range of significant geological and ecological concerns. However, Waste Management still purchased the Springhill portion of the Wayby site in 2017 and went into a purchase agreement for the Matariki Forest portion despite these concerns. “It was also revealed that none of the reports included cultural impacts, which Waste Management was also questioned intensely about. Significant concerns about the lack of consultation

with tangata whenua have also been raised. In summary, the issue is that consultation is meant to be in regards to site selection before a site is purchased. That has not proven to have happened, with consultation offered seemingly to have been limited to conditions around this site only.” The case continues, and is expected to be completed by early December.
