Regional rates set aside The High Court decision quashing several years of Northland Regional Council rates in the Kaipara could have implications for local authorities across the country.

The court last week set aside NRC rates for the years 2011/12 to 2015/16 inclusive and any penalties imposed over that same period.

However there was no order for any refund of the rates and penalties involved, despite finding for the plaintiffs, Mangawhai Ratepayers and Residents Association and Richard Bruce Rogan and Heather Elizabeth Rogan, on the legal status of the rates.

Rejecting the plaintiffs’ request for a return of the rates, the judge said an order to that effect “goes beyond the bounds of the present proceeding.”

NRC chair Bill Shepherd said the result has potential implications not just for Northland, but for other councils around the country.

Central to the case was the council’s use of its Kaipara district counterpart to collect rates on its behalf.

“Council takes all its legal responsibilities very seriously and naturally is very concerned to comply with these. There are definitely a number of important issues thrown up by — and lessons to be learned from — this case and council is now very carefully considering both High Court judgements and our options; including whether to appeal.

“Council is already seeking a change to the Rating Act to clarify the rating activities that can be undertaken on its behalf by a district council.”

evidence on what, if any, further relief should be granted.

The final decision noted the regional council had acted in good faith and “may have fallen victim to legislation that was less precise than it needed to be.” ¢

“Stage one will see our crews take ultra-fast fibre to 915 premises — 202 businesses and 713 residential, over the next year,” Mr McLeod said.

“UFB will be a significant boost to the town and we will be working hard to bring the network to life as quickly as possible. The expansion of our fibre network is part of our business strategy to strengthen our electricity and fibre networks in Kaipara and Whangarei.”

The Dargaville West build first connections will be available in August next year and the stage completed in September.

Mr McLeod says stage two in Dargaville East will begin in February 2019. When complete in October 2019 a further 1,018 premises in the area will have access.

In total, Northpower is investing $30 million in the expansion.

“Our UFB2 programme will deliver fibre to more than 9,000 premises in Kaipara and Whangarei. We will pass 5,561 premises in Kaipara by mid2021 which will see us invest almost $18 million in the district by mid-2021.

“The Mangawhai Village network will begin in September 2018, Mangawhai Heads South will receive fibre from March 2019 and Mangawhai Heads North in August 2019.

The Kaiwaka UFB network build will begin in April 2020, Maungaturoto in June 2020 and Ruawai in November 2020.

Work on the Paparoa UFB2 network will start in January 2021 and be completed in May 2021. ¢

It is a real credit to NRC staff that they were successful in their bid to receive co funding from Government for work to improve freshwater quality in Northland. The fund was contested by all Councils in New Zealand and NRC being successful with two projects speaks volumes for the calibre of our NRC staff. Northland is potentially facing real issues in complying with the new Government regulations around swim ability. These projects as well as others will be consulted on in Council’s Long Term Plan.

Review of Economic Development Arrangements in Northland – Report by Martin Jenkins NRC have recently received the above report. Currently there is an annual combined spend by all Northland Councils of approximately $6.5 million on economic development activities.

These are delivered either directly from Councils or Northland Inc. The report says that overall what we have in place is working well. There is an opportunity for all Northland Councils, community groups and Maori to further align with initiatives and marketing of the region as a whole. NRC will be working towards the implementation of the report’s recommendations once the appropriate consultations take place. Big River FM Community Flavour and Variety

In the 2016 Stage One Irrigation study, Kaipara and the Mid North were identified as areas that could benefit from the development of a community scale irrigation scheme. A Stage 2 Scoping Study has recently been completed and shows that there could still be merit in such a scheme. Both stage one and two had a large element of community consultation. The next stage would be a Pre-Feasibility Study, which would give much more detail around environmental and cultural impacts, technical and engineering analysis, how a scheme could be funded and structured, as well as farm level case studies. The stage three study would also have high levels of input from the Kaipara Community. Irrigation in Kaipara is a complex issue and requires some long-term thinking.

Northland National candidate Matt King spoke about Kaipara roads, internet and police at a meeting with Kaipara Grey Power in Dargaville last week.

A Kaipara resident who would like to remain anonymous wishes to congratulate the Dargaville Police on a “absolutely marvellous” job in resolving a burglary.

“I want more opportunities, I want more infrastructure, and I want a better quality of life for Northlanders,” he said.

“We as National have to do better in Northland, and I can tell you that message has been received loud and clear in Wellington.”

“We’ve committed $26 million to double-laning Matakohe bridges — it’s actually a significant road realignment as well — that starts this summer.”

He says the earth works will start in October, as soon as resource consent comes through.

With internet he said that “nearly 99% of all schools and hospitals are now connected. That was stage one. Stage two is all the towns.” The government said earlier this year that six Kaipara town’s will get broadband over the next four years. Matt said that in the interim you can access it if you live close to a school, like locals have already done in Arapohue and Pouto. “It’s going to take years to get it all connected, but I can tell you it’s happening.”

“Were committed to a 10% increase in police numbers across the country but in Northland they recognised that we are a special case and they nearly doubled that to 19% which equates to 66 extra police. This is still not enough in my

view as an ex-cop, but it’s a start.”

He also said that the government has committed to having Dargaville and other Northland police stations open for 24 hours, in the next four years.

Matt also said that he’ll have an office in the Kaipara soon. “We are now being reclassified as a big electorate and that enables funding for one and half offices.” With his main office in Kerikeri, he is looking into Dargaville or Kaiwaka as possible office locations. ¢

On Sunday, July 30, a Huia street home was discovered burgled while the owner was away, by a friend who was checking on the property. Police lifted fingerprints on the Monday and soon received confirmation of one of the offenders. By Thursday most of the property was recovered. One 16-yearold has been charged and investigations are continuing.

“We had good staff knowledge of local offenders and suspects and good prompt work. A really good result,” said Senior Sergeant Dan Cleaver.

“Unfortunately we always get a few burglaries. It’s not what I’d call a significant problem over here.

“The common themes are insecure properties or properties not being checked.”

He advises people to make sure their property is secure when away and if going away for a long period of time, tell neighbours.

Dargaville Work and Income recently held a recruitment seminar to make people aware of jobs and opportunities available within the community.

The Kaipara Basketball Association is expanding and calling out for teams to register for a women’s competition.

“We had a great turn out. It was an opportunity within our community to gather information about potential work or training prospects, that could make a difference for those who attended and their families, said Work Services manager for the Ministry of Social Development, Raewyn Sowter.

MSD regional contracts manager, Alan Tidswell opened the event which included presentations from local employers — Silver Fern Farms, Dunsmore Gardens and North South Multimedia.

Skills training and suppor t organisations, Northtec, Taratahi Agriculture Training Centre and Tokotoko Solutions, also made presentations.

Those attending were encouraged to register their interest in current vacancies and training opportunities.

MSD work brokers were on hand to support participants to connect with providers and employers.

“Already there have been many who have discovered there are opportunities they didn’t even think were available,” said Raewyn. ¢

With six teams registered already, the competition looks set to start before the end of September.

The association already has primary school age and men’s tournaments in Mangawhai, but chose to base its women’s competition in Otamatea as they have had interest further afield.

It’s also part of their overall plan to expand and make basketball a sporting choice for all age groups in Kaipara and eventually other parts of Northland.

They hope to have women’s and men’s basketball in Dargaville by February next year and in a few years have a regional competition.

Regional Development Officer for the

association, Raymond Cameron said: “My vision is to build strong foundation skills and get basketball in this region strong. I believe we can do it and we have such an awesome Kaipara District and the surrounding areas to make it all happen.

“We’re just hoping that people can get behind this in terms of businesses.

We’re not here to make money, we’re here to push basketball and give these kids a pathway. The vision is huge. Its awesome to see the potential that this place has.”

100 Years ago & Now Dargaville Borough: Council Minutes 100 Years Council received from the Hobson Council Council a statement of the cost for one half of erecting the Mangatara Bridge. We have authorised the payment of 66 pounds when finances permit.

An application was received from Mr T Jacksich for permission to lay a 3 inch pipe drain from the yard of the Brittannia Board House (Mrs Faithfull) across the footpath to Poto Street. Permission was granted.

Council recommended that the two horses offered for sale for the sum of 68 pounds be purchases from Mr TH Bozar of Te Kopuru appeared to be quite suitable for the use of the Sanitary Service.

Council had under consideration the condition of Selwyn Park, and have directed that the rushes should be cut and the flag pole removed.

Notes for Drivers on Unsealed Roads

Unsealed roads require regular laying of maintenance aggregate.

If tyres are low, road users can run the risk of punctures on freshly laid metal.

This larger material is particularly prone to puncturing worn tyres, but is a necessary requirement during the winter months to ensure the roads are still safely traversable.

Please take caution when travelling on freshly laid aggregate, and check the condition of your tyres — especially if you live on the unsealed network.

• Culverts — Pukehuia, Curnow, Sandy Beach, Heatley and Te Kowhai Roads • Routine works planned on Council roads throughout the whole District during August include pothole repairs both on unsealed and sealed roadways as they are identified and grading of select roads pending sufficient rainfall.

• We may experience some delays with work programmed during the month of August if weather restricts plant movements and progress; however, the majority of works will continue.

• All routine work is done in cycles across the District.

In endeavouring to provide good roads at the most economic cost, sometimes only spot grading and metalling is done as it is about one-quarter of the price of blanket metalling and grading that has tended to be done in the past.

Calling young farmers

Under the umbrella of the New Zealand Young Farmers, Northern region territory manager, Philip ‘Pip’ Beauchamp, is keen to see if there’s anyone in the Northern Wairoa who wants to start a Young Farmers Club for 15-31-year-olds.

To gauge interest, Pip has organised a pizza night at the Dargaville fire station on Thursday, August 31, at 6pm.

The idea of the night is that everyone brings their own toppings, as pizza bases will be provided.

As well as a chance to mix and mingle, there will be speeches from the fire brigade, and after dinner talks from drystock and dairy farmers about the advantages of collaboration between the two farming methods.

All ages are welcome and there’ll be a chance to sign up to young farmers.

The membership fee is $70 per year.

“Young Farmer Clubs are involved with social activities, fund raising projects, field trips, competitions, international exchanges, learning new skills and community projects,” said Pip.

These stones are painted by local children who have plenty of fun hiding them all over Whangarei. Some of these stone critters are now living in our cages with the birds where they can have a look at them. A German couple visiting us were so taken by them that they have taken a couple of these art works back home!

At the start of the month we had a brown teal brought in. It was in a bad way after being run over by a car.

The teal likes feeding after dark so it would be very hard to see one on a metal road.

It had damage to its wing, eye and was unable to stand but after medication and lots of care I released it back to the location it came from, so it was really good to see it go free again.

With Spring nearing, we will start receiving lots of young birds. If you find a bird in trouble put it in a warm and quiet place and let us know. Don’t give it food or water.

The Northland Classic and Sports Car Club’s annual Daffodil Day car and motorcycle rally is coming to Dargaville on Sunday, August 27.

Anyone, and all vehicles, specialist or not, is invited to join the rally that starts at Kensington Park, Whangarei at 10am. From there they will make their way to Dargaville and stop at Countdown from 11am-12pm, where donation boxes will be available.

After Countdown the vehicles will drive to the Kaipara Vintage Machinery Club for lunch and prizegiving, until around 2pm. For rally participants, themed daffodil

dress-up is encouraged, with ‘best dressed’ vehicle, hat, male, female and child prizes. There will be spot prizes, quizzes and raffles also. Entry is a $15 minimum donation to the Cancer Society per vehicle.

Enviroschools facilitator Jacque Knight organised the donation of the plants through Reconnecting Northland Landcare.

“Students and the community worked together to achieve the first stage of the restoration planting, sending a powerful message that we as a community care about the health of our waterways,” said Ruawai College Enviroschools project teachers, Marsha Finlay and Kirsty Batters.

The teachers say that they have big plans for the future with the Enviroschools programme. “We have been given funding for beehives here at school and have initiated a recycling programme, worm farming, planting

Our students are learning first-hand that their actions can have a positive impact on their environment.”

Year seven student Emma Philips said: “It’s important to improve our waterways because if we don’t fix them, who will? If we don’t start saving the waterways the harbour will be ruined for future generations — I can’t let that happen.”

New student leaders

A walk to remember

Dargaville High School has named Morgan Hutchings and Matai Newman as head girl and boy for 2018, and Kees McCahon and Michaela Jenkins-Stevenson as deputy heads.

Dargaville local Mike Mudford is setting off on a personal mission to walk the length of the North Island starting in Cape Reinga and finishing in Wellington, on a 61-day journey starting September 1.

All four students agreed that they were “pretty stoked and excited” to be selected.

Matai plays for the first fifteen rugby team, and design, technology and materials is his favourite subject. He says he’s looking forward to himself and his peers “being role models to all other students, someone for them to look up to. I think we’ve got a pretty good year group for that.”

Morgan is “sports orientated” and plays netball and sevens rugby. “We

have some really awesome role models to lead the school next year and I’m really looking forward to it.”

Keeys also plays for the first fifteen rugby team and is into art and design technology and materials. He says he’s keen to get more students involved with school activities such as sporting days.

Michaela Jenkins-Stevenson is passionate about public speaking and applied for a leadership role to ‘to give back to the school’. Her favourite subject is English. ¢

Four years ago Mike became seriously ill and was airlifted to Auckland Hospital, believed to only have a week to live, but in his own words: “God had other plans and I’m still here.”

“I decided I would like to do a ‘hikoi of thanksgiving’ and started planning a couple of years back.”

Initially wanting to take on the Camino trail in Spain, Mike ran into trouble when insurance wouldn’t cover costs if he were to get into difficulty.

His new plan is to walk the entire length of the North Island covering 20 kilometres a day over an eight-hour period - he’s been training for the last 18 months.

Assisting him on the walk is his ‘Tokatoka stick’ which was crafted for the trip by master carver Albert Te Pou. Mike and his wife Jean are selffunding the walk and “extremely happy to do so,” says Mike and have hired a campervan that will act as a support vehicle and home while on the road.

The couple also wanted to help raise money along the way for Habitat for Humanity.

“I thought why not walk for a really good cause and putting a roof over

people’s heads is such. I live in a comfortable home and believe it’s the right of all to be housed.”

Mike will be handing out cards as he walks, with information about Habitat for Humanity and details about how direct donations can be made.

Mayor’s Message Vision Councillors have spent time recently considering our Vision. The vision we “inherited” was “Kaipara where it’s easy to live”. Having been in the role some nine months now we decided to consider its appropriateness. As a result the vision we have adopted is “Thriving Communities Working Together”. We believe this reflects our aspirations for our district more appropriately. A vision is very important for any organisation, everything that we do should hang off that aspiration.

Long Term Plan (LTP) We have had many briefing sessions on the LTP covering each activity Council undertakes on your behalf. In Mangawhai last week we had a Councillor only session to agree the priorities as we see them. Once a draft LTP is completed, which will include these priorities, it will go out to you for your input and feedback. Once the process is complete (as required by law) we will have our blueprint for the next 10 years.

So those priorities, in no particular order, are: 1 Deliver an acceptable level of day‑to‑day service to residents.

This includes an ability to answer the telephone on time, turn around consents etcetera in a timely manner.

This may seem very basic but we are not doing this in some areas today. Our people are doing their best but under‑resourced, our telephone system being an example. We also need to have happy engaged staff for any of the above to occur.That is also not our situation today.

2 Roading We now know that 20% of our unsealed network has no/little base metal. Without proper foundations repairs will never work. There is quite a cost here which will need to be approved and shared with the NZ Transport Agency (NZTA). We are very much in catch‑up mode and unfortunately that will take time.

3 Mangawhai Community Plan Deliver the big hit items within the Plan. Work needs to go into validating the priorities here but having the Plan is a great start.

4 Dargaville We are still to identify the detail of what we would like to do here but maybe the word “refresh” sums it up.

Issues also around infrastructure, water, section availability as well.This is a work in progress 5 Smaller towns and communities Most of our smaller areas have groups doing great work very often supported by Council staff. That is planned to continue.

6 Economic Development Our thinking here is an incremental approach, firstly to assist our various communities to be great places to live and do business. Alongside that however we would like a couple of specific initiatives in the planning period, these will be around walking and cycling, the largest being consideration of the “Dargaville to Donnelly’s” cycle trail.

7 District Plan We believe this needs revisiting. Any changes will take time so that work needs to get started.

8 Debt We need to have a targeted level of debt over this planning period. Even with the huge debt reduction that has been achieved over the last five years our debt is still at double the level of our peer group of New Zealand councils. Zero debt is not our aim however debt needs to be at a level that ensures we can fund future infrastructure needs, the interest burden is manageable and our cost of borrowing is at market with only a standard risk premium. Councillors are yet to decide what that number should be.

Pine Forests As I mentioned in an earlier column, Council has been out to Tender some 635 ha of pine forest that we own. Some is at maturity and the rest in various stages of growth. We received a number of tenders and have accepted one. In most instances the land and trees are being sold as a parcel. There are two exceptions. The forest that is an integral part of our water collection north of Dargaville will be retained with only the cutting rights sold. The forest near the land that makes up the Taharoa Domain (Kai Iwi Lakes), the land will be sold however Council will require legal easements to future‑proof access should this area ever be needed for recreation associated with the Taharoa Domain, walking and cycling being obvious examples.

Once the deal is signed I can let you know the price, suffice to say we are talking a number of millions of dollars.

Community Grants Policy Julie Geange has led a sub‑committee of Council to look at this area and put a better process around it.

We allocate circa $100,000 to grants made up of $80,000 and $20,000 as a Mayor’s discretionary fund. I have never felt comfortable with giving away ratepayer money with no/little process so to that end the Mayoral Fund will be scrapped and incorporated into the other sum. Shortly on our website you will see the criteria against which funds will be allocated and on that basis whether it is worth you applying for your organisation.

The overriding criteria aligns with our vision “Thriving Communities Working Together”.

Scientist and inventor of the LifePod Sir Ray Avery, invited schools around the country to support his cause to provide developing countries with the incubators.

“Ruawai College students took up the challenge to raise $2,000, the cost of one LifePod and in doing so it will benefit the lives of hundreds of babies,” said deputy principal Amanda King.

After hearing of the school’s efforts, Sir Ray Avery visited a special assembly

for the occasion to thank the students for their fundraising efforts and explain how the LifePod would make a difference in the lives of others.

The incubator the school has sponsored will be sent to Fiji.

“From the students’ perspective this made their accomplishment seem a whole lot more tangible, especially in the knowledge that they have made a genuine difference for others,” said Amanda. ¢

A busy spring season ahead

There’s no question that Mangawhai is growing, with new people looking north every day to see what the seaside town has to offer. This means more folks moving in for a leisurely lifestyle — but it also means a lot of work for those who are preparing Mangawhai for the new season.

Overwhelmingly, that means preparing the machines which drive the two aspects of a town in transition. Mangawhai is still very much a town nestled amongst farmland, and the local economy still thrives on the back of good harvests and healthy herds.

With calving over and sunshine drying out the mud, farmers turn their attention to pasture maintenance and prep, meaning it’s time to open up the implement shed and assess what needs to be done to get the gears turning smoothly. On a smaller scale, lifestyle block and section owners are also opening up the shed to see what winter disuse has done for their weedeaters, lawnmowers and ride-ons.

Though worlds apart in size and power, these machines all need a bit of attention before they can hit the turf.

On the farming side of things, activity is already ramping up at Agridustrial, where huge tractors can be seen literally pulled in half to service all that diesel horsepower.

Farm utes and trucks are lined up for WOF and COF inspections, while those

who judge that their implements have seen their last spring are busy browsing a selection of balers, rakes, cultivators and other serious tools of the trade. It’s a busy time, but the team are taking it in their stride, with enough technicians on deck to keep the workshop humming and the mobile service van out in the field.

Mangawhai Small Engines is a similar hive of activity, as long-disused mowers roll in for new belts, blades, engine tuneups and general check-ups. Soon the grass will be growing quick, so the local ‘mower doctor’ is seeing plenty of patients, alongside hedge trimmers, brushcutters and other garden tools. For those who have invested in a small block of land, the hot ticket this year is a serious rideon, or even a big Grasshopper zero-turn mower to turn acres into cricket pitchlike perfection.

Both big and small machines are sure to get a workout this season, so book in soon if your arsenal of tools needs a ‘sharpen up’ before nature really gets going for spring.

Mangawhai Volunteer Fire Brigade fire fighters Matt Williams and Dave Paterson were presented with their yellow safety helmets recently after completing the Fire and Emergency New Zealand recruit course.

Brooke Neal, one of New Zealand’s Olympic ambassadors decided to join our school today with the help of our teachers and staff.

The FENZ course encompasses the learnings of theory and weekly station trainings allowing the men now to take full part in fire fighting activities.

Neal rose to fame after making her national debut in 2013 and since then she has been visiting schools across an inspired nation, talking about the three Olympic values: Respect, Friendship and Excellence.

Brooke shared how she completed her 10-year-goal to become a centredefense hockey player for the New Zealand Blacksticks. It wasn’t easy for her to achieve her lifetime goal.

There is relief within the Mangawhai Heads Volunteer Lifesaving club after their ‘outdated’ Sea Rider rescue boat was cleared to continue in action.

After attending Outward Bound earlier this year, 17-year-old Lachlan Ewing from Mangawhai has become part of an initiative to complete a challenge to raise funds to give scholarships to other young people who could not afford the course otherwise.

Issues arose for the club last winter when after 30 years of service, Surf Life Saving New Zealand wanted to exclude the boat as it didn’t fit specific requirements during a “big shift in policy.”

“The boat we’ve been operating for the last 30 years fell out of that specification,” says club public relations officer, Tony Baker.

“This boat is a lifeline — there’s been two major rescues this year involving that boat.

“The next step was to talk to Maritime New Zealand to get an exception.

That’s been a lengthy process to get certification for the boat and operators under SLSNZ policy.”

Through negotiation and completion of incident management courses the surf club was eventually granted an exemption which means the boat can be used for another five years.

“It’s been awesome having an extension and it’s the first of it’s kind

“It has been really stressful. We’re a volunteer club and a lot of our members have been operating the boat — it’s our main asset in terms of search and rescue. For a lot of people it’s an extension of themselves.”

The club had ongoing support from Maritime NZ, local police and the Northern Regional Council Harbourmaster among others throughout the process. ¢

Lachlan attended the course due to a scholarship from the Mangawhai Club. “Not only did the scholarship allow me to go when I otherwise could not have, it made me aware of Outward Bound as I previously had no idea of what it was,” said Lachlan.

“It was the most profound experience of my life, with physical activities such as sailing, hiking, and kayaking, balanced with learning confidence, communication and self-awareness skills. Although it is too soon to tell, I feel I made lifelong friends and left with a much more positive outlook on life.”

“My challenge is to walk along the Te Araroa trail from Queenstown back to the Outward Bound Campus at Anakiwa, Marlborough. I will be walking unaccompanied for about two months and hoping to raise $5,000 — enough to pay the full fees of a future student.”
