Every year The Kauri Museum at Matakohe awards the Mervyn Sterling Memorial Scholarship to an undergraduate student and this year the award goes to Courtney Windsor, an earth sciences student at the University of Waikato

Courtney, who is currently studying for a science degree, plans to major in earth science and to study the sustainable management of energy, water, mineral, soil and coastal resources.

“I’m so happy to be awarded the scholarship and it’s a great help towards my fees. It means I can continue studying what I’m passionate about without worrying too much about finances,” says Windsor.

The scholarship, worth $2,000, is to encourage undergraduate study and applied research in conservation, ecology, natural heritage and history, particularly in the Otamatea region.

Her grandfather was the principal of Matakohe School in the 1960s and her father also attended the school.

Her grandfather also collaborated with Mervyn Sterling, for whom the award is named, to source an Avro Lancaster bomber from the French government, which is now held at MOTAT museum in Auckland.

The saga of the huge debt surrounding the Kaipara District Council has moved into the arena of national public attention with the airing of a news report

by TV3.

On the 3 News programme, host Brook Sabin asked Mayor Neil Tiller how the council had incurred debt of $85m — in part over expenditure on the Mangawhai wastewater scheme, to the extent that it is facing a district-wide ratepayers revolt.

Both the Mangawhai Residents and Ratepayers Association and the Kaipara Citizens and Ratepayers Association are urging members to withhold rates instalments on the grounds that KDC demands have been illegally issued.

Dargaville’s Kea Scouts are doing their bit for the cats and kittens at our local Paws and Claws animal rescue centre, with a drive for pet food bringing in a haul for this worthy cause The boys from our youngest group of Scouts have put into practice the can-do attitude and community ideals of founder Robert Baden-Powell, organizing a ‘pet show’ of stuffed animals and gathering together donations for homeless cats cared for by the Dargaville animal welfare volunteers.

Paws and Claws exists to find homes for abandoned cats, and is staffed entirely by volunteers. They receive no government funding or assistance, and rely entirely on the goodwill of the community to continue their good work in caring for unfortunate animals. It can be a demanding job which highlights the cruelty and neglect of the unenlightened, but sometimes — and the Keas’ generous contribution is one of those times — it’s an insight into the better side of human nature.

Donna Dreadon and Petrina Fischer are proud of the efforts the boys have made to help Dargaville’s most vulnerable ‘citizens’. It’s good works like these which Lord Baden-Powell envisioned when he founded the Scouting movement in the early 1900s, and the Dargaville Keas carry on a long-standing tradition of community service which is very much appreciated.

Kaipara has 12 new kiwis following a citizenship ceremony conducted by Mayor, Neil Tiller.

“It is my pleasure today to turn you into kiwis”, said Mayor Tiller.

“You have been recognised as having the personal qualities that enable you to make a positive contribution to the community. As Mayor I would like to welcome you on behalf of the

government, the people of New Zealand and the Kaipara district.”

The recipients were: the Gardiner family, Carin Hjarne, Mario and Denis Hysenaj, Leah O’Driscoll, Ilia Petro, Eviola Habili, Caroline Riddlestone, Dirk Smyth and Christopher Waring.

The ceremony was followed by afternoon tea.

 John Rowles took his final bow to fans in Dargaville on Friday night, proving he could still put on a fine show, performing crowd-pleasing favourites such as ‘Hush not a word to Mary’ and ‘Cheryl Moana Marie’, along with impersonations of Frank Sinatra, Marlon Brando and Elvis and humorous anecdotes from his life. Rowles ended the show with a blast from the past, a rock song from his first Kawerau band and the old kiwi favourite, ‘Ten Guitars’. Fans are now looking forward to his upcoming movie based on the autobiography, ‘If I only had time’.

National spotlight on KDC debt Also appearing on the programme with Mayor Tiller was Kaipara Citizens and Ratepayers Association chairman, Ron Manderson who told Brook Sabin, “the mayor and deputy must resign. We must have hope and new leadership.”

TV3 also said it had obtained documents under the Official Information Act for its report which it claimed outlined a number of other ‘serious issues’. The report alleged that council had ‘used an unhedged floating rate for its borrowing and that council could have been seriously exposed if interest rates had gone up.’

Mayor Tiller told Brook Sabin that the KDC ‘had got away with it’ because interest rates had stayed low and he admitted that it was a ‘dangerous practice’ for a huge loan.

“I think it was more good luck than anything else. Had interest been going the other way we would have paid for it.

We shouldn’t be running a council on luck, but we took advice on borrowing,” said Mayor Tiller.

The TV3 report also suggested that council was using cash reserves illegally to pay for its day-to-day operating costs.

Mr Tiller insisted that, “up until these issues came to head we had no idea we were not complying with the (Local Government) Act and we’ve done everything in our power to make sure we comply.”

Mr Manderson later responded offair to the TV3 report and Mayor Tiller’s comments and asked: “Is the mayor saying he had no idea of the issues, given that he controls the agenda for council?

to examine relevant documentation. The result was that councillors were forced to rely solely on the word of the previous CEO, the leadership of Mayor Tiller and Deputy Mayor and Finance Portfolio holder, (Julie) Geange.”

He added that, “there should never have been a cost blowout on the Mangawhai EcoCare scheme. The original contract included the financing of the project until completion as well as the design and build.”

“In 2005 council represented the cost of the EcoCare project to ratepayers as a fixed price contract of $35.6 million, but in 2006 the contract was extended to $59 million without ratepayers knowledge, an increase of over $23 million.”

“Council voted to extend the scheme from $35.6 million to $59 million in a public excluded council meeting.”

He claimed that as ratepayers agreed only to the original figure of $35.6 million, they may not be responsible for the $23.4 million differential.

“Previous councillors, Mr (Bruce) Rogan and Mr (Bill) Guest and current councillor (Jonathon) Larsen, along with many others, have all raised concerns that the mayor and other councillors neglected to heed.”

The KDC indebtedness is currently being investigated by the Office of the Auditor General.

This is a series of regular articles keeping you informed of happenings on our harbour today, and from bygone days — truly the ‘Jewel of the Kaipara’.

Fun in the sun far away  by Paul Campbell

From the rainy depths of winter, the thought of summer fun at the beach seems a little remote On the Kaipara harbour, a highlight of the summer is the Pahi Regatta, still going strong after the passing of more than a century.

Over those years, it has had to moderate its activities somewhat.

The greasy pole event for one has disappeared as the thought police lay down more and more rules about what fun we can have out in the sea and sand (or mud) and sun.

But not so elsewhere. As I write this from Devon, in England, I am still surprised about the activities that make up the annual waterside carnival at a small habourside village that is almost a reflection of faraway Pahi.

The hamlet is called Bere Ferrers, up the Tamar River from Plymouth, and it dates back to the 14th century. It overlooks an estuarine river system, with

moored pleasure craft laying against a backdrop of hills that are reminiscent of Wakapirau across the Arapoa River from Pahi on the Kaipara.

Here they stage the annual Village Water Sports, fun on the foreshore that has something of a different dimension to the rather genteel activities of the Pahi Regatta.

It starts off moderately enough, with enthusiastic teams of volley-ballers.

The prop is a giant plastic beach ball and the object is to slam it over the net — pitched in two feet of viscous sticky mud. Needless to say, within minutes it is impossible to say which teams are male or female, with most , at some point in the contest, flattened into the mire by the ball that itself grows weightier with the build up of mud.

competitors to be sloshed clean with buckets of seawater before the major event of the day.

A stout rope has been stretched above the mud some eight feet in the air, held taut between two tractors.

Then individual team members — on this occasion the ‘Mud Monsters’ are competing — have to haul them selves as best they can along the rope, with points granted for the first, second and third way points towards the middle of the rope marked with tape.

Not a problem? Oh yes, it’s a problem!

The opposing team is down below, in the mud, armed with an array of motorised pumps attached to fire hoses.

These are started and the mud, slush and — well, whatever spews out at high pressure, all but obliterating the hapless victims struggling to keep attached to the rope above.

Of course, many rope crawlers end their efforts face down, obliterated in muck.

One or two make it to way-point three. A determined young woman succeeds to the cheers of the spectators.

The afternoon turns to evening, much musical entertainment, some dancing

and many libations, all also enjoyed by some rather exhausted — now cleaned up — competitors.

This Brit version of a harbourside running of the gauntlet would undoubtedly be a great Pahi Regatta attraction. But I suppose OSH would have a major conniption, with even a greasy pole and pillow fights over water off the wharf considered too daring in these ‘enlightened’ days.

Rather a pity though. It was just good dirty fun.

Tangowahine makes national radio  by Kim Munro

In a broadcast beamed out to the rest of New Zealand, Hugh Rose, Les Taylor and Jenny McDermott each gave a glowing portrayal of their home, Tangowahine, on Radio NZ’s ‘afternoons’ show Hosted by Jim Mora, ‘afternoons’ is the most listened to talk radio programme in NZ, and selects one small community to highlight on the show each day.

Tangowahine was introduced by Jim Mora as a small community on the upper reaches of the Kaipara Harbour and first up on the 30 minute show was Hugh Rose, farmstay host and inventor.

‘It was an honour to be selected by radio NZ and a great opportunity to put Kaipara on the map,’ said Mr Rose, who explained what led his wife and himself to choose Tangowahine as their preferred home over other small towns in NZ.

Next up, farmer, horseman, and pig hunter, Les Taylor, shared his local farming knowledge, past and present.

‘When I first arrived in Tangowahine 45 years ago, the average size milking herd was 80 to 100 cows with 28 herds in a 10km radius — now there are five herds in the same area,’ said Mr Taylor.

Well-known historian of the community, Jenny McDermott, rounded off the show with a fascinating account of early settlement, describing how at its peak, Tangowahine was a thriving kauri mill town of 3,000 people with scows travelling up river to collect timber until logging ceased in the 1930s.

Lifestyler jumps to the rescue Circus Kumarani has been feeling the pinch lately and as part of a fundraising initiative will be raffling a tandem jump for the upcoming Kauri Coast Skydiving Carnival The jump has been gifted to the circus by the Kaipara Lifestyler.

“We like to support worthwhile causes and they do so much for our community,” says Kaipara Lifestyler general manager, Deb Wright.

“There is less funding available lately

and more people applying for it so it’s great to receive the donation. We often perform free at events, but we still need to pay for equipment, insurance, rent, power and travelling expenses,” says Circus Kumarani manager, Jenny Huriwai.

The circus has added colour and vibrancy to the Kaipara since it first arrived in Dargaville nine years ago, performing at festivals and passing on skills to the community and schools.

“It is not just about red noses and clowning around. We have partnerships with many community groups and organisations — we are much more than a circus,” says Jenny.

They will also be participating in the carnival, which runs from August 10–12.

The carnival kicks off on Friday with a skydiving display at Selwyn Park and continues on Saturday with an all-day event at the Ruawai airfield with tandem jumps, ‘sporties’ freefalling displays and finishes with a grand finale on Sunday.

Letters to the editor Council bureaucrats judge and jury!

Nationwide as we battle to keep business’s compliant we witness a quiet and subtle picking off of our very powerhouse of primary producers striving to keep our economy sustainable.

Our farmers are hitting headlines for ‘non compliant’ activities be they just or unjust. The infringement notices are being used as a first response instead of a last resort. Notices are threatening, intimidating and in most cases very expensive.

We see noteable large operators being singled out who have built our industry.

We see first farm owners who often with a heavy debt loading are afraid to speak out and hence ‘pay on the day’.

We see sharemilkers whom for whatever reason are entwined into a compromising situation with their farm owners over possible repercussions.

These heavy handed and bullying tactics are crippling our economy and this sector is only one mere example of such.

These often over zealous bureaucrats ‘rock on up’ to dairy farms often unannounced in many councils of New Zealand and scrutinise systems to a level often far in excess of what both necessity and commonsense demand.

I don’t dispute there are a minority of less than desired systems and recognise the need to police such however these are not the subject of this letter.

My concern is the inability to challenge these decisions. Ratepayers are being fought with their own money and that of their industry peers.

Why are these compliance officers so

‘untouchable’? Often migrant officers seeking to prove their worth, and often mentored by an element whose presence on farms may be considered perilous their history given.

I’ve been fortunate in having an excellent compliance officer over the last two years who has worked together with me and put good systems in place, recognising there’s always got to be some degree of movement in ascertaining each situation’s needs.

Let’s band together and challenge our councils with a system where we have the right of appeal. Our organisation is working on this as we know a better result would eventuate in most cases.

Let’s keep our industry the model we can be proud of and not tolerate an abuse of power.

It seems that too frequently people are selling with the label ‘grown organically’ yet there is no evidence of organic certification. What guarantee does the customer have if there is no certification?

Dear Sir, I read with interest the letter to the Editor from a Kaiwaka ratepayer re the Kaipara District Council.

Your correspondent called upon the current Kaipara district councillors to resign.

I repeat this call for mayor Tiller and his council to resign.

The Kaipara district council has total debts of $110 million and this level of DEBT is not able to be serviced by our community.

The Debt is as follows District General Debt $31 million owed to the BNZ Mangawhai Wastewater Project $62 million Illegally Collected rates Mangawhai $17 million.

Add this up to a total of $110 million.

This ruinous for all Kaipara District ratepayers.

Resign Councillors as you may regret not doing so as you may yet be sacked by the Minister for Local Government.

This is where a group of between three to five growers (a pod) will peer review one another. In short — they check you out and you check them out. This use of voluntary time ensures costs are kept to a minimum but also is a mechanism through which individuals can support one another and so improve the quality of their produce.

It is not just a case of ‘let the buyer beware’. When a seller claims to be marketing produce that is ‘grown organically’ they should surely be asked for validation.

Should it also be a case of ‘let the seller beware’?

Kaipara arts funding opportunity Applications are now open for arts funding from Kaipara’s creative communities scheme, a partnership between Creative New Zealand and local councils.

The scheme encourages the community to create diverse opportunities for accessing and participating in arts activities and is open to individuals or groups.

The project must have an arts or creative cultural focus and meet funding criteria.

“The funding is for small projects, averaging $2,000 and is an opportunity for Kaipara rural communities to get involved in the arts. Types of projects funded include workshops, specialist arts training, exhibitions, as well as youth arts events,” says chairperson, Debbie Evans.

Applications are considered by a committee with knowledge and experience of the arts in the region and includes community representatives as well as ward councillors.

Earlier in the week students and staff participated in a number of cultural events and rehearsed an item of cultural significance which was performed on Friday morning as part of a variety concert. Eating doughnuts for a cause Maungaturoto Primary School children agree that eating doughnuts has got to be one of the nicest ways to help in fundraising for next year’s senior camp.

Ordering doughnuts on nominated Fridays and soup on soup days is a novel fundraising initiative by parents and teachers aiming to raise $24,000 for 55 children and adults heading to Rotorua in March.

Another initiative underway is a scrap metal drive with the community being encouraged to donate unwanted items to the cause such as fridges, washing machines, tap ware, bolts, along with the kitchen sink.

Instead of occupying landfills, the items will be sorted into various metals, on-sold and recycled into new materials.

“The scrap metal drive is a perfect way to recycle and raise

A dairy farmer who took the law into his own hands and failed to follow the strict terms of the sharemilking agreement between he and his sharemilker was sentenced to nine months jail and the Court ordered payment of $81,000 to Sharemilkers This week in the District Court at Tauranga, Lance Maxwell Burt, a dairy farmer was sentenced to 9 months jail and an order to pay restitution in the sum of $81,000.00 to sharemilkers, who worked for him 5 years ago.

Burt was charged under the Crimes Act with using a computer to commit a crime. Burt sent a direction to Fonterra instructing Fonterra to divert all proceeds due to his sharemilker into his own account. Mr Burt’s Lawyers in Palmerston North then issued a Notice of Termination of the Sharemilking Agreement. Despite being requested on numerous occasions to confirm that they held the money pursuant to the Sharemilking Agreement in their Trust Account, the NZ Law Society’s Manawatu Branch confirmed that the money was not held in the Solicitors Trust Account. Arbitration followed resulting in a decision in favour of the sharemilker.

Burt had taken the $81,000.00 and dispersed it amongst other commercial operations he was involved in.

The sharemilkers were devastated. It deprived them of their job and access to their money needed to finance the next season’s operations.

The Judge described the offending as malicious and intended to cause harm to the sharemilkers.

The lesson for owners contemplating withholding payments to sharemilkers, is that they must adhere to the strict terms of the sharemilking contract.

Owners that direct their dairy company to pay the money to themselves and then failing to place the deductions in their solicitor’s trust account can expect to find themselves in serious trouble.

In the Lower Order Agreement there are penalties for unjustifiably and procedurally wrongly withholding payments to sharemilkers and these amount to interest rates ranging from 5% per month compounding up to 8% per month compounding.

In the High Court at Whangarei Judge Nicholson in dealing with an appeal against these interest rates commented that the punitive interest rates were justifiable and to be used in discouraging owners from withholding the proceeds due to sharemilkers.

Owners contemplating using the offset provisions in their sharemilking agreements are advised to seek professional advice before commencing such action.

40% of milk produced on New Zealand farms comes from sharemilking agreements between farmers and sharemilkers, known generally as

lower order and 50/50 Sharemilking Agreements.

In 2001 a new Lower Order Sharemilking Agreement was negotiated and enshrined as a statute of law by Parliament. One of the clauses added was a comprehensive dispute resolution procedure. When the 50/50 sharemilking agreements were amended in 2007 and later in 2010, these dispute resolution procedures were written into the 50/50 agreements.

The employer / owner has a right to offset money from a sharemilker’s proceeds subject to the dispute procedures being completed. An owner contemplating withholding proceeds due to the sharemilker must serve notices on the sharemilker setting out the contract breaches and the costs of rectification.

If the parties don’t agree, they may ask an independent third party to assist

them to resolve the dispute and if the dispute is not resolved within 10 working days must then go to conciliation and appoint a conciliator. If the parties fail to agree on a conciliator within five working days of proceeding to conciliation, a conciliator will be appointed from the National Panel of Conciliators who will convene a meeting where the issues are discussed and usually resolved. If not resolved then the owner can instruct the dairy company to withhold the proceeds due to the sharemilker with an upper limit of 75% of any sum due. That money must then be lodged in a Solicitors Trust Account, earning interest until the matter is resolved either by agreement or reference to arbitration.

The Creative Commuities Scheme supports and encourages local communities to create and present diverse opportunities for accessing and participating in art activities. Under the scheme “the arts” are broadly defined as “all forms of creative and interpretative expression” Criteria: Projects must meet one or more of the following funding criteria: Broad community involvement – The project will create opportunities for local communities to engage with and participate in arts activities.

Diversity – The project will support the diverse arts and cultural traditions of local communities, enriching and promoting their uniqueness and cultural diversity.

Young people – The project will enable and encourage young people (under 18 years) to engage with and actively participate in the arts.
