said he decided to instruct lawyers to proceed, having receiving 200 responses all in favour, representing 360 members. With the association having more than 1000 members, Mr Rogan agreed the responses were less than a majority. He acknowledged that

After performing for local schools in the afternoon, the evening concert attracted an audience of more than 200 who were treated to a repertoire that extended from John Philip Sousa to The Village People. Local kumara farmer and musician Warwick Simpson was a special guest performer before heading for the bay of Islands Jazz Festival. The Navy Band finished its Northland tour with a Whangarei concert on Saturday.

Dargaville teen Sam La Hood is a repeat world champion after excelling in championships in Canada

A Dargaville home decorating store has been named the country’s best retailer of Resene paint – for the second time.

Fosters Home Decorating won Resene’s top reseller award for 2009/10. Last week it received the honour for the second time in five years.

Fosters owner Greg Foster says the latest award was a big shock.

“I’m stoked. I didn’t expect it.”

Sam, 17, successfully defended her world street cycling title last week at the UNICON 17 World Unicycling event in Montreal, Canada. She previously won the title at the 2012 championships in Italy.

It was double success for Northland, with Christian Huriwai, 22, winning the world championship for the third time in the men’s event. His first win came when the championships were held in Wellington in 2010 and he repeated that success in Italy two years later.

Before leaving for Canada, Sam told the Kaipara Lifestyler how she got into unicycling.

“I started unicycling about four and half years ago through my involvement with Circus Kumarani. I’d heard about Christian’s success, so I tried it and stuck with it.

“I do it because it’s fun and because I enjoy it, so it’s not so much that I train for the comps, I just keep at it. I always push myself though and see what new things I can bring to the competition.”

Leah says Sam and Christian will return home on August 23. ¢

Mangawhai case heads to Appeal Court “There’s a lot of urgency in getting on with the job. There’s a lot of work to do and the lawyers need instructions.

But we’ve made it clear to the lawyers that if the responses change we’ll ask them to hold off.”

In their advice to members, the association’s executive said it believed there were defects in Justice Heath’s decision.

“The High Court Judgment failed to give a finding on the most important thing affecting all Kaipara ratepayers — namely the power of a council to rate in future for illegal debt.

“We do not contest that the council must repay an illegal debt it has incurred, but we cannot accept that it

can lawfully turn to its ratepayers for the money.”

Mr Rogan says the appeal may not be heard until next year, although he hopes the court will agree the case has public policy implications and therefore schedule a hearing sooner.

Kaipara District Council chief commissioner John Robertson says the association’s decision is regrettable. ”I think it’s very unfortunate and disappointing. I think it will act to add costs for ratepayers.”

Mr Robertson says it is highly likely that it if the council wins in the Court of Appeal it will seek costs from the association. “If we can seek costs we will.” ¢

Kaiwaka Sports Association is holding an evening of nostalgia, remembrance and companionship to mark 100 years since World War I began.

The anniversary evening will include a centennial dinner and Jaques band will perform songs of the war. The RSA, Mangawhai Cadet Unit and Kaiwaka/Mangawhai Scout Troop will also be involved and service groups have been invited to attend.

“Vice-chairperson of the KSA, Mark Ottaway, has arranged for a couple of special guests to speak

and the cadets will read the Kaiwaka Roll of Honour,” said KSA manager Cheryl Anderson.

“We are also going to unveil a plaque in memory of John Keighley, the founder of KSA who died earlier this year.” The dinner will be held at 6.30pm this Saturday, August 16, at Kaiwaka Sports Association. Tickets are for sale at Jaques Four Square.

Librarian Wendy Cocurullo says the toy library has suffered from a decline in business in recent years. “We’re now down to four regular members who are using it.”

The toy library provides toys for a modest rental, thus saving hard-up families the cost of buying toys that their children might soon grow tired of.

Ms Cocurullo says there are still plenty of young families with children in the area. But they seem to be acquiring their toys from other sources.

Apart from a lack of customers, there is also a shortage of volunteers to staff

the library. “We’ve tried everything to keep going. We’ve tried everything under the sun. We’ve tried to combine with playcentres and playgroups. But nothing has worked. It’s a very sad thing to have to close.”

The Dargaville Toy Library opened in 1993 and is a member of the New Zealand Toy Library Federation. After it closes all the toys in the library will be sold.

Ms Cocurullo says once all bills have been paid any surplus will go to local charities. Any unsold toys will be donated to other charities. ¢

A 25-player Northland Roller Mills Rugby squad has been named and it features some up and coming rugby stars from the Kaipara.

which will see Northland play another three games in Wellsford, Northcote and Counties, ahead of the semi-finals in Tauranga.

“We need heaps of publicity, which in turn, will generate a lot of energy — the idea is to create a sea of blue support for our Northland Roller Mills squad,” said Catherine Stewart, comanager of the squad alongside Melanie Harrison. People can keep up to date with the team’s progress by following the Northland Roller Mills 2014 facebook page.

He will talk about post-flood decision making and cover of the key points farmers should take home. Dargaville Vets will discuss animal health and wellbeing, while Northland Seeds will outline suitable cropping and re-grassing options for silted paddocks.

There will also be a speaker from the Rural Support Trust, talking about assistance available and Taskforce Green activity, and — hopefully — a special guest, who has first-hand experience of flood situations.

Both days run from 11am to 2.30pm.

In the wake of the recent floods, Beef + Lamb New Zealand (B+LNZ) is sponsoring information lunches in Dargaville and Whangarei next week.

The events, titled “After the floods have gone”, take place on August 20 at Dargaville’s Northern Wairoa Boating Club and the following day at Whangarei’s Barge Park Conference Centre.

Thai blessing in Dargaville New supermarket ready to open its doors

A Thai restaurant in Dargaville is having a special celebration to commemorate a year in business.

Dargaville’s new Countdown supermarket is set to provide locals with a whole new shopping experience when it opens next week.

That’s the hope of store manager Craig Unsworth.

The new store is three times the size of the old store which will be demolished, says Mr Unsworth. “It’ll mean a huge increase in our product range. There’ll be a lot, lot more lines.”

The store will offer a wide range of bulk foods and international foods — lines that were not stocked in the old store because of a lack of space. “It’s a fantastic store. I’m sure people will be pleasantly surprised when they see our offering.”

Mr Unsworth started as store manager two months ago and says it has been full-on ever since, even though the store has had no customers.

With just a week to opening day the sense of anticipation is growing.

“I’m excited.”

Although there is a lot to do, Mr Unsworth insists everything will be ready when the doors open on Tuesday, August 19.

The official proceedings begin at 7.30am. That will include speeches from a number of dignitaries, including from Kaipara chief commissioner John Robertson.

Then at 8.30am the doors will swing open and locals will be able to experience the new store for themselves.

Mr Unsworth says demolition of the old store will start once all stock has been removed. That is expected to take about two weeks. The demolition is expected to take three months.

During that period shoppers will have to walk around the old store to get into the new one. ¢

Raan Ahaan Thai Aroi Dee — which means restaurant with delicious food — opened on Victoria St in August 2013.

To celebrate the milestone, owner Don Wrigley has arranged for a group of Thai monks — including the abbot — to travel from the Te Atatu temple in Auckland to provide a spiritual blessing of the restaurant on Saturday August 23.

The ceremony is set to start around 10am, depending on when the monks arrive. The formalities will be followed by servings of free samples of Thai food — but only after the monks have been fed.

Mr Wrigley says he opened a Thai restaurant in Dargaville because he was able to find an expert in Thai food.

“I’ve lived here for 12 years and Rose (Koontanoen) is a Thai chef.” Previously Mr Wrigley had a business making

children’s puzzles. But that folded because of cheap Chinese imports.

Then he turned to mowing lawns for a living — something he still does.

While Dargaville may not appear to be a place brimming with lovers of Thai cuisine, Mr Wrigley says the first year has gone well.

“We’ve slowly built up over the year.

People are becoming more familiar with Thai food and different dishes from different parts of Thailand.”

Rose nominates Phat-si-lo, or wide rice noodles with meat and stir-fried vegetables served with soya sauce, as Raan Ahaan’s most popular dish.

Looking forward to his restaurant’s second year, Mr Wrigley believes things are looking good. “We’re going into the tourist season soon.” ¢

Kaipara Community Health Trust is helping to make healthcare more accessible for the local community.

The trust owns and operates a health shuttle that caters to people living in urban and rural areas in the north-west Kaipara, from Ruawai north. A sister service, Linking Hands, operates a shuttle for Kaipara residents who live south and east of Ruawai, including Mangawhai and Paparoa.

KCHT’s health shuttle service was developed out of a need for people with limited mobility and those who live out of town, to be able to access their health appointments.

Are ratepayers the sole target?

The court ruling that the Kaipara District Council, despite historic illegal action, is entitled to have outstanding rates paid will please the commissioners and disappoint the Mangawhai Residents and Ratepayers Association.

But are the ratepayers the sole target for the recovery of council debt, or are there other avenues to explore?

Here, let me just quote the executive director of Audit New Zealand, Stephen Walker: “At Audit New Zealand, we’re committed to doing everything we can to improve the performance of, and the public’s trust in, the public sector. We carry out annual audits of hundreds of public entities on the Auditor-General’s

behalf to give taxpayers and ratepayers assurance that public entities are appropriately reporting on how they spend public money and on the services they have provided.”

The department has since admitted a failure of this duty where Kaipara is concerned.

The court ruled that the loan contract for the Mangawhai sewerage scheme falls under the ‘protected transaction’ regime and therefore is deemed to

be valid and enforceable against the council as debtor at the suit of the creditor. That means that there is a debt that the council must satisfy whether by payment of what is owed in full or under an agreed compromise.

The fact that a debt exists means that the council must consider how to respond to a demand for repayment.

Its ability to raise money through rates to meet that lawful commitment is not affected by any failure to comply with procedural prerequisites.

While the Local Government Act deals with the issue of councillor liability, it also states that a councillor is not liable if the council decision is proven to be reliant on outside advice which could include consultants, lawyers — and the Auditor General.

While MP Mike Sabin’s Bill validates collection of rates from Mangawhai, the ratepayers of Kaipara have been seriously let down by poor governance and a lack of financial monitoring over a prolonged period. The Auditor General apologised unreservedly for letting down Kaipara ratepayers in not monitoring council’s actions but more questions need answering due to the fact it states that the investigation was challenging

I believe this is an indictment on the actions of the previous chief executive whose duty of care included ensuring the council’s financial viability and that the councillors were given the necessary financial and other information to make informed decisions. This, I suggest, with the background support of Audit New Zealand?

My summing up of this sorry saga is that Mangawhai ratepayers and the Kaipara district have been outmanoeuvred by the government’s ability to validate illegal irregularities so that the responsibility falls back into the ratepayers’ lap.

The commissioners must pursue all avenues as to whether the Auditor General, Audit New Zealand, senior council executive and councillors of the time, breached their fiduciary duties, with a view of possible civil action. ¢

The Jaques name is synonymous with Kaiwaka and this August, the Four Square family celebrate 90 years serving their community.

On August 13, 1924 Francis John Jaques — known as Frank — started his grocery business, complete with a massive kauri counter, sledged in by horse. At the time, there was little else in Kaiwaka but Frank brought with him a wealth of experience and a pioneer attitude.

Hakaru and this operated until 1905, when his son Dan built one in Kaiwaka township. Fast forward to 1931, and Frank married Ella Nita Cullen of Maungaturoto — great granddaughter of Kaiwaka’s first shopkeepers, the Bowmars.

The original 1924 store has been replaced and upgraded, and today it is a thoroughly modern supermarket with a rich past, operated by a new generation of Jaques. ¢

New aid to quit smoking

Many smokers bitterly regret lighting up that first cigarette.

There are few addictions harder to break than that of tobacco smoking — some have compared it’s grip on the addict to that of hard drugs such as cocaine and heroin, such are the nasty side-effects of withdrawal.

But a new method of stubbing out the cigarette habit is becoming popular around the world — the e-cigarette or electric inhaler. Opinions are divided among world medical authorities as to whether the electronic replacement for tobacco is a perfect tool for those who wish to quit, or pure ‘transference’ of addiction, but it’s certain that the e-cigarette itself produces a vapour

without the by-products of combustion.

Supporters of e-cigarettes claim that the reduction in harmful ingested chemical by-products is reason enough alone to switch.

The American Association of Public Health Physicians suggest that it’s better to move to such devices than to continue smoking, and a study

by Public Health England agrees.

What is also pertinent is the lack of government taxation (excepting GST) on such devices in New Zealand.

For a variety of reasons — financial, social, and medical — this alternative to tobacco is on the rise. ¢

New Wellness Centre opens

Dargaville has a new hub for healing and promoting better health.

A collaborative effort between health practitioners Jeni Gorrie, Jane Caldwell, Tess Mangin and Paula Powell, the space in McKay’s Arcade came from Jeni’s need for a clinic room adjoining her organics and wellness store.

The four practitioners cover different aspects of natural healing and health improvement. Jeni offers a wide range of therapeutic treatments and knowledge, from homeopathic, herbal and supplement advice to diet and lifestyle planning, and reiki treatments to reduce stress and promote wellness.

Tess specialises in massage to soothe away aches and stresses, with both holistic therapeutic massage and hot stone massage techniques on offer.

This enables her to tailor a relaxing, healing massage program to suit the needs of her customers.

Jane is a practitioner of the Bowen technique, developed by keen osteopathy and acupuncture scholar T. Ambrose Bowen. This respected figure developed his own system on gentle, non invasive therapeutic manipulation which works on a number of bodily systems. It’s a gentle therapy with powerful results.

Paula has over a decade of experience as a life coach, trainer and business consultant. She’s passionate about

Kaihu champs in under-16 rugby u by Colin Patterson

Kaihu’s under-16 rugby team had every reason to celebrate on Friday night as they were crowned Southern Districts age group champions.

On a wet and soggy Toll Stadium, Kaihu outmuscled Mid-Northern 6-3 in front of a large and vocal crowd.

Co-coach Mickey Hannan says the Kaihu boys got a big kick from playing on the home ground of Northland rugby.

There were no tries scored, with Kaihu winning with penalties by Mitchell Miller and Jacob Gorrie, against one penalty kicked by Mid-Northern. “It was a proper rugby final,” says Mr Hannon.

“The whole team dug in. The backs and forwards played well.”

He says the players got extra motivation from the scores of parents and supporters who made the trip to Whangarei for the game.

“We’d like to thank the Kaihu rugby club and the supporters who have been with us for the season,” says Mr Hannon.

The team finished the season unbeaten and won the Challenge Cup. He says it has been a great year for the Kaihu Rugby Club which celebrates its centenary at Labour Weekend. ¢

Any objections to these proposals should be in the hands of the Kaipara District Council no later than 5.00.p.m. on Monday 8th September 2014

The Creative Communities Scheme supports and encourages local communities to create and present diverse opportunities for accessing and participating in art activities. Under the scheme “the arts” are broadly defined as “all forms of creative and interpretative expression.”

Criteria: Projects must meet one or more of the following funding criteria: Broad community involvement – The project will create opportunities for local communities to engage with and participate in arts activities.

Diversity – The project will support the diverse arts and cultural traditions of local communities, enriching and promoting their uniqueness and cultural diversity.

Young people – The project will enable and encourage young people (under 18 years) to engage with and actively participate in the arts.
