The long-running battle over disputed rates in Mangawhai is set to proceed to a higher court with confirmation that the Mangawhai Ratepayers and Residents Association will proceed with its appeal.

The association’s executive last week asked its members for an email vote on whether the appeal it had already lodged with the Court of Appeal should go ahead. Two hours after launching the poll, association chairman Bruce Rogan

said he decided to instruct lawyers to proceed, having receiving 200 responses all in favour, representing 360 members. With the association having more than 1000 members, Mr Rogan agreed the responses were less than a majority. He acknowledged that

some might feel disenfranchised by a decision made before they had a chance to respond. However, Mr Rogan says the responses showed a clear pattern and the association’s lawyers needed to know quickly. continued on page 4 …
