The Mangawhai Residents and Ratepayers Association wants $991,000 from the Kaipara District Council, as the association seeks also to reverse retrospective legislation that validated irregularities in the setting and assessing of rates for the scheme. The sum sought represents $1,000 for each of the 991 MRRA members, over the council allegedly breaching their right to seek justice for their cause.

The damages claim has been filed in the Court of Appeal ahead of a hearing date on August 25. The association is challenging the High Court ruling that councilimposed rates are legal after the retrospective Validation Act confirmed rates and there has been no breach of the Bill of Rights. The High Court also ruled contracts for building the EcoCare facility were

made and entered into unlawfully and the contracts were unlawful, although the rates due from the 2006-07 financial year to 2011-12 in respect of the Mangawhai EcoCare wastewater treatment scheme, still had to be paid. Association lawyer Matthew Palmer QC said the damages sought in the suit were deliberately set at a level that was ‘modest’ per person and was not ‘derisory’. 
