THE murder case against twomen accused of killingNelson MandelaBay Municipality Ward 27 (ANC) CouncillorSicelo Mleve, was postponed to 15 September at theNew Brighton Magistrate’sCourt onMonday,13 July, to allow police to continue with their investigation.
Before the postponement, the courtdelivered itsrulingonanapplicationbymembers of the media seeking permissionto record courtproceedings.
The application was opposed by both the State and the defence. The State argued that not all witnesses had participated in an identification parade involvingthe accused, whilethe defence argued thatrevealingthe identities of the accusedwouldprejudice their righttoafair trial.
In delivering judgment, the courtfound that there was insufficient evidenceto conclude that recordingcourtproceedings wouldprejudice the matter and grantedthe application, subject to conditions. Photographs of the accused will be published only at astage of the proceedingswhenitisappropriate to do so.
When proceedings resumed, the defence advocate requested access to the statements made by the two accused, aswell as any photographs or video footage depicting them.Hetold the court that the defence was
notseeking access to the entire police docket, but only to material directly relating to the accused.
The defence arguedthat withholding the statements was unconstitutional, submitting that the statements belonged to the individuals who madethem. He further argued that any photographs or video footagedepicting the accusedshould likewise be made available tothem.
The defencealso alleged that the two accusedhad been “tortured” by police followingtheirarrests. Thedefencefurther told the courtthat the accused allegedlyhave marks supporting the allegation and signed documents withoutknowing what they were signing. He said the defence was not bringinga formal applicationbeforethe courtat that stage, but merely wanted the courttobe mindful of the allegations.
In response, the State said the accused would beafforded an opportunity to view the statements they had made at alater stage inthe proceedings, but that the appropriate time to do so had not yet arrived.
The prosecution also told the courtithad no photographs or video footageofthe accused in its possession to disclosetothe defence.
The State furtherindicated that its investigation remained ongoing. Outstanding aspectsincludedobtaining all witness statements, completing identification parades involving all witnesses, analysing the accused’sfinancialand cellphone records, and
awaiting the ballistic report.
Thetwo accused also abandoned their bail applicationsatthat stage.
Thecourt also heardsubmissionsrelating to the detentionconditions of accusednumber one, Lufunolwethu Nyodi.
Thedefencesubmitted thatNyodi was being detained at the Makhanda Correctional Centreafter authorities cited an alleged threat to his life. It further allegedthathe was being held in solitary confinement, had limited access to sunlight andhad been provided with aprivate chef as part of the arrangements at the correctional facility.
The defencesuccessfully appliedfor Nyodi to be transferred to the North EndCorrectional Centre. Thecourt furtherordered that should aprivate chef notalready be availableatthe North End facility, the arrangement previously affordedtoNyodi in Makhandashould continue following his transfer
Nyodi(20) and co-accused AhlumileStofile (21) face charges including, butnot limited to, murder, robbery, and the unlawful possession of afirearm and ammunition.Additional charges are expected to follow.
According to South AfricanPolice Service (SAPS) spokesperson Captain Majola Nkohli, two armed male suspects allegedly stormed the office in an apparentrobbery where ameeting of about 10 people was underway
“One of the suspects fired upon the 45-year-

old councillor, inflicting multiple gunshot wounds, beforefleeing the scene,”Nkohli said.“The victimsustained severalgunshot woundsand was declared deceasedatthe scene.”
Thematter was postponedto15September, andbothaccused remain in custody.

FROM first bites to teenage lunches, avocados are one of those rare foods that truly work for the wholefamily. Creamy, versatileand packed with goodness, avos caneasilybeenjoyed at every stage of life, from babieslearning to eat solids to active teens needing fuel for busy days.
For parents, avosare an easy way to add goodness to everyday meals. Their naturally soft texture makes them ideal for babies from six months onwards, whether mashed smooth for first tastes or cut into cubes for older babies learning to self-feed.
Sourceofgoodness
One of the avo’s greatest benefits for babies and young children, is its rich supply of healthy fats. The brain grows rapidly in the first few years of life, and healthy fats are essential for supporting normal brain growth and function.
Avocados provide monounsaturated fats, making them avaluable food during these important earlyyears.
Toddlers need abalance of carbohydrates, fats, proteins, vitamins and minerals to support healthy growthand development Avocados help providenutrients including potassium, vitamin Eand lutein.
They are asource of fibre andmonounsaturated fatsand are energy dense, making them anutritious option for growing little ones. Avocados contain vitamin K, which plays an important role in healthy bone development, as well as vitamin B6, which supports the developing brain and nervous system.
The lutein naturally found in avocados supports healthy eye development and mayhelp protectchildren’s eyes as screen time increases. Since this nutrient is not made by the body, including avo regularly can help support goodvision.
As childrengrow, avocados continue totickall theright boxes. Theymake excellent sandwich fillers for school lunches, delicioustoppings for wraps and burgers, and an easy addition to breakfastbefore abusy schoolday.
For sportytweens and teens, avocados offer even more benefits. Rich in heart-healthy monounsaturated fats, avos provide slow-release energythat can helpfuel endurance activities like running, cycling and team sports. They contain potassium too, which supports muscle function and recovery after exercise.
Avocados contain prebiotic fibre that supports gut health, along with nutrientssuch as folate, magnesiumand zinc, allof whichcontribute to normal body function and wellbeing.
So, whether it is breakfastbeforeschool, alunchbox favourite or apost-sport snack, thereisalways agood reason to add an avo.
