THE suspendedNelson MandelaBay Municipality (NMBM)City Manager, Dr Noxolo Nqwazi, has continued to reportedly receive her salary since her suspensioninOctober 2023over fraud allegations linkedtothe irregular procurement of atoilettender, with payments reportedly totallingR5.8 million in taxpayers' money.

The Economic Freedom Fighters(EFF), which has been vocal in calling for accountabilityinthe matter, said it is appalled by what it describes as reckless and wasteful expenditure by the municipality, alleging that Nqwazi has received acumulativeR5.8 million during her suspension.

"In what can only be described as irresponsibleconduct by amunicipality which hasfailed to exercise its due diligence and responsibility, Nqwazi has drawna salary whilst on suspension since20October 2023, owingtothe failure of the municipality to promptly institute the necessary disciplinary processes and procedures,"the statement said

"Thishas resultednot onlyinher being a burdenonthe finances of the municipality, but has meantthere has been arevolving doorofacting City Managers inthe City for two and ahalf years. As aresult, millions have been spent paying these acting City Managers, whilstmillions have beenspent on the suspended CityManager "

The EFF statement added that theBay has allegedlylost R1.6 billion in rollover appli-

cations fromthe National Treasuryover the years, owing to the absence of aCityManager

"The process of rolloversreferstoinstances where, eachfinancial year, approved and unspent funds are reallocatedfor committed projects, which canrangefrominfrastructureand service delivery objectives, rather than returning that money to the National Revenue Fund.

"Thismeansresidentsare being denied funds which couldimprove theirlivesowing to thelack of an activeCityManager to claim these funds.On1 June 2023, theEFF called for the immediateresignation of Nqwazi, on thebasisofthe findings of theSpecial InvestigatingUnit (SIU), which revealedthat she approved aR24.6million tender to procure 2,000 toilets duringthe COVID-19 pandemic, under the guise of emergency procurement, and only 200 toiletswereprocured.

"It wasrevealed that Nqwazisat at thehead of acorrupt patronage network, whereinshe is allegedtohave utilisedthe proceedsof this irregular tender to control ANC and DA councillorsusingbribes, in ordertoshield herselffromaccountability," thestatement said.

After aspecial motion drivenbythe EFF in the Nelson Mandela Bay Municipal Council (NMBMC) wasintroduced, Nqwaziwas placed on aprecautionary suspension on 20 October 2023

"Itistherefore undermining to the good work of the EFF in fighting corruption, and disrespectful to the peopleofNelsonMandelaBay,that money that couldhavebeen

"The EFFwilltherefore bringamotion in the NMBMC to begin andresolve disciplinary proceedings against Nqwazi urgently

"The EFFwishestomake it clear thatwe willinnoshape or form support anysettlement agreement with Nqwazi, whohas alreadybeen accused of defraudingthe municipality using tenders, and hasnow defrauded the municipality by beingremunerated foralmost three years whilst on suspension.

"The R6.5 million settlement, whichshe has reportedly agreed to, is aslap in the face of the residents of Nelson Mandela Baywho suffer indignity on adaily basis,"the EFF concluded.

Speaking to PE Express, Nelson Mandela Bay Municipalityspokesperson, Sithembiso Soyaya, confirmed that the matter relating to the suspended Nqwazi remainsactive and is being processed throughbothinternal disciplinary channels andongoing court proceedings.

"Toclarify, the courtcasearises from a SpecialInvestigating Unit (SIU)investigation into COVID-19-relatedprocurement, which has also been raised beforethe PortfolioCommittee on Cooperative Governance and Traditional Affairs, reflectingthe seriousness of the matter and thelevel of national oversight," he said.

"Thecharges beforethe courtinclude fraud, corruption, and allegedcontraventions of the MunicipalFinance Management Act, all stemmingfromCOVID-19 procurement matters identified through the SIUinvestigation."

Soyaya stated thatgiven this context, the Municipality is legally required to ensure thatits internal disciplinary processesdo notinterfere with, duplicate, orprejudice the judicial proceedings, whilstfully complying with labour law anddue processrequirements

"From agovernanceperspective, the precautionarysuspension remainsalegally prescribed administrative measure, nota sanction, intendedtoprotect the integrity of the institution andthe investigative process," he said

"Weacknowledgepublic concernregardingthe duration of the processand the associatedfinancial implications. However, these matters arecomplex, evidence-driven, andsubjecttostrictlegal frameworks, and must be concludedina manner thatisfair, lawful, anddefensible."

He added thatthe Municipality hasprioritisedthe finalisation of this matter within the confinesofthe law
