DAlayscriminalchargesagainstmayor overallegedmisleadingofParliament

THEDemocratic Alliance (DA) has laid criminal charges against Nelson Mandela Bay Executive Mayor, Babalwa Lobishe, alleging thatshe misled Parliament during arecent oversight engagement on governancefailures in the Nelson Mandela BayMunicipality.

Thecomplaint was laidatthe Cape Town Central Police Station by DA MP andCOGTA spokesperson Marina van Zyl.

The charges relate to proceedings before Parliament’sPortfolioCommitteeonCooperative Governance and Traditional Affairs (COGTA), where the municipality was called to accountfor serious governance, financial management, and service delivery concerns.

During the engagement, chaired by Zweli Mkhize, MPs questioned the municipality over repeatedfailures to respond to oversightcorrespondence sent between January and March, following an earlier oversight visit in October last year. Committee members also raised concerns about so-called evergreen contracts, conditional grant underspending, and weak administrative coordination within the metro.

Parliamentary criticism overcommunicationfailures

The committee told municipal leadership that most of thefollow-uprequestsfor informationhad eithergone unanswered or were in-

complete, preventing effective oversight.

Mkhize warned during the session thatthe municipality’sexplanationsfor thecommunication breakdownwereinconsistent. He said Parliament had spent asignificant portion of the meetingdealing with the failure toproperly manage correspondencefrom the Office of the Mayor.

He described the situation as aseriousbreakdowninaccountability, stressingthatParliament cannot perform itsconstitutional duties if information is delayed, incomplete, or contradictory MPs also warnedduring the session that providing misleading or false information to Parliament could amounttoacriminaloffence under parliamentary powers and privileges legislation.

Mayor’sresponse In asocial mediapost on 7April, Lobishe responded to the growing political fallout, defending her appearance before Parliament and rejecting claimsofwrongdoing

Shesaid:“In timesofscrutiny, leadership mustleaninto accountability, not retreat fromit. Nelson Mandela Bay Municipality has appearedbefore Parliament in full respect of itsconstitutional obligations and the critical role of oversight institutions. This is not a moment of crisis; it is amoment of accountabilityinaction.”

Lobisheadded that she remains committed to transparency.

“We remain committed to transparency, to answering difficult questions with honesty, and to correcting where improvement is required,”she said. “Our focus is clear:strengthening governance, restoring public trust, and ensuring thatservice delivery to our residents is never compromised.”

DAallegations

Van Zyl said the criminal complaint relates specifically to what she described as false statements made to Parliament regarding the receipt of correspondence.

“I’m at Cape Town CentralPolice Stationtolay acriminalcharge against the mayor of NelsonMandela Baymetro municipality,”she said.

She alleged that the mayor told Parliament she had not received certaincorrespondence, but that internal officials —including the mayor’s chief of staff —had reportedly contradicted this versionand provided documentation suggesting the correspondence had been received and processed

According to Van Zyl, this evidencehas been handed to the police forinvestigation.

She added that the DA believes the matter reflects broader governance failures in the metro and should result in accountability action, including possible removal fromoffice.

Broaderparliamentaryconcernsongoing

The allegations come amid sustained parliamentary scrutiny of Nelson MandelaBay’s governance, including concerns about:

• Approximately22municipal contracts still requiring detailed investigation

• An estimated R1.2billion in unspent conditional grants returned to theNational Treasury

• Weak coordination between political and administrativeleadership

• Vacanciesinseniormanagement positions

• Repeated failuretoprovide complete and timely information to Parliament

The COGTA committeehas alreadydirected themunicipality to submit adetailed turnaround plan and outstanding documentation, warning that failure to cooperate couldresultinformal summonses being issued throughParliament.

SuspendedCityManagercontinuestoreceivesalaryaftertwoyears

SHANTIJAFTA

THE suspended NelsonMandelaBay Municipality (NMBM)City Manager, Dr NoxoloNqwazi, hascontinued to reportedly receive her salary since her suspension in October 2023 over fraud allegationslinkedtothe irregular procurement of atoilet tender, with payments reportedly totalling R5.8 millionintaxpayers’ money

The Economic Freedom Fighters (EFF), whichhas been vocal in callingfor accountability in the matter, said it is appalled by what it describesasreckless and wasteful expenditure by themunicipality, allegingthatNqwazi has received acumulative R5.8 million duringher suspension.

“Inwhatcan only be described as irresponsible conduct by amunicipality whichhas failed to exercise itsdue diligence and responsibility,Nqwazihas drawnasalary whilstonsuspension since 20 October 2023, owing to the failure of the municipalitytopromptlyinstitute thenecessary disciplinary processes andprocedures,” thestatementsaid.

“This hasresulted not only in her being aburden on the finances of themunicipality, but has meantthere has been a revolving door of acting City Managers in theCityfor twoand ahalfyears. As aresult, millions have beenspent paying theseactingCity Managers, whilst millionshavebeenspent on the suspended City Manager.”

The EFF statement addedthatthe Bay

hasallegedlylost R1.6 billion in rollover applications from the National Treasury over the years, owing to the absence of a City Manager.

“The process of rollovers refers to instances where, each financial year, approved andunspent funds arereallocated forcommitted projects, whichcan range from infrastructure and service delivery objectives, rather than returning that money to the National Revenue Fund

“Thismeans residents arebeing denied fundswhich could improve their lives owingtothe lack of an active City Manager to claim these funds.

“On1June2023, the EFFcalled for the immediateresignation of Nqwazi, on the basisof the findings of the Special Investigating Unit (SIU), which revealed that sheapproved aR24.6milliontender to procure 2,000 toilets during the COVID-19 pandemic, under the guise of emergency procurement, and only 200 toilets were procured.

“It was revealed that Nqwazi satatthe headofacorrupt patronagenetwork, wherein she is alleged to haveutilised the proceeds of this irregulartender to control ANC and DA councillors using bribes, in order to shield herself fromaccountability,” the statement said.

Afteraspecialmotion driven by the EFFinthe NelsonMandela BayMunicipal Council (NMBMC) was introduced, Nqwazi was placed on aprecautionary suspension on 20 October 2023.

“It istherefore undermining to the good work of the EFF in fighting corruption, anddisrespectful to the people of Nelson

Mandela Bay, that money that could have been used to deliver basic services such as water, electricity, cleaning of illegal dumping sites and many other critical services, has been used to pay an individualwho is sitting at home doing nothing,” it stated.

“The EFFwill therefore bring amotion in the NMBMC to begin and resolve disciplinary proceedings against Nqwazi urgently.

“The EFFwishes to make it clear that we will in no shape or form support any settlement agreement withNqwazi, who has already been accusedofdefrauding the municipality using tenders, and has now defrauded the municipality by being remunerated foralmost three years whilst on suspension.

“The R6.5 million settlement, which she has reportedly agreed to, is aslap in the face of the residents of Nelson Mandela Bay who suffer indignity on adaily basis,” the EFF concluded.

Speaking to PE Express,Nelson Mandela BayMunicipality spokesperson, Sithembiso Soyaya, confirmed that the matter relating to the suspended Nqwazi remainsactive and is being processed throughboth internaldisciplinary channels and ongoing courtproceedings.

“Toclarify, the courtcase arises from aSpecialInvestigating Unit (SIU) investigationinto COVID-19-related procurement, which has also been raised before the Portfolio Committee on Cooperative Governance and Traditional Affairs, reflecting the seriousness of the matterand the level of national oversight,” he said

“The charges before thecourt include fraud, corruption, and alleged contraventions of theMunicipal Finance Management Act,all stemming from COVID-19 procurement matters identified through theSIU investigation.”

Soyaya stated that given this context, theMunicipality is legally required to ensure that its internal disciplinary processes do not interfere with, duplicate, or prejudice thejudicial proceedings, whilst fully complying with labour law and due process requirements.

“From agovernance perspective, the precautionary suspension remains alegally prescribed administrative measure, not asanction, intended to protect the integrity of theinstitution and theinvestigative process,”hesaid.

“We acknowledge public concern regarding theduration of theprocess and theassociated financial implications. However, these matters are complex,evidence-driven, and subject to strict legal frameworks, and must be concluded in a manner that is fair, lawful, and defensible.”

He added that theMunicipality has prioritised thefinalisation of this matter within theconfines of the law.

“In theinterim, municipal operations and service delivery continue uninterrupted, supported by acting leadership arrangementstoensure continuity, accountability, and administrative stability,” he said.

“Further updates will be provided at an appropriatestage, in line with legal considerations.”

Pandor deliversinaugural addressasNMU Chancellor

DR Naledi Pandor has formally taken up her role as Chancellor of Nelson MandelaUniversity, delivering an address that blended reflection on her academic roots withacall for stronger African-led knowledge systems, institutional excellence, and the protection of academic freedom.

Speaking at her installation on 8April, Pandor expressedgratitude for the appointmentand acknowledgedthe leadership thatpreceded her, including former Chancellor Geraldine Fraser-Moleketi. “Itisawelcome pleasure to return to the academy sector,” she said, describing her appointment as a“homecoming” to academic life after years in publicservice Pandor, who previously lectured and holdsaPhD in Education, noted that the universityhad developed into acomprehensive institution withastrongfocus on teaching, research, community engagement and international collaboration.

Addressing university leadership, staff, students, alumni and stakeholders, she opened her remarks with greetings in multiple languages and thankedthe institution for the honour of her appointment

She reflected on the university’sorigins duringher tenure as Minister of Education between 2004 and 2009, noting its growth since then into one of South Africa’s major comprehensive universities.

“All the reports on theUniversity’s performance point to auniversitycommitted to academicexcellence,”she said, adding that it had built ‘high-quality researchperformance’ and ‘genuine responsiveness to communityengagement and service.’”

Pandor also used her address to highlight the university’snamesake, former President NelsonMandela, describing him as aleader who encouraged what she called “good trouble” in pursuit of social justice.

She said Mandela inspired global solidarity movements rootedinconcern for humanity and opposition to oppression.

Turningtoglobal developments, Pandorwarned of what she described as a “deeply troubled geopolitical environment,” arguing that universities were increasingly exposed to political pressures and threats to academic freedom.

She raised concerns about conflicts and theirimpact on higher education institutions and referenced what she described as growing restrictions on researchfunding and academic autonomy in parts of the world.

“This increasingly worrying threat to academicfreedomand free expression,” she said, “is adevelopment that should cause us… to assertour abiding commitment to freedom, justice and thedevelopment of new knowledge through untrammelled scientific inquiry.”

She further cautioned about what she described as thelimited visibilityof Africa and theGlobal South in shaping global discourse.

According to Pandor, this shouldserve as acall for stronger continental collaboration in research, innovation, trade, and development aligned with Africa’s long-term goals.

“Our commitment must also include sustainably nurturing an institution in which all enjoy respect and dignity,” she said, emphasising theimportance of upholding constitutional values within theuniversityenvironment.

She added that respect for rights should be “rehearsed in practice through respect for women and girls, for every workerand respect for thedignity of all.”

Concluding her address, Pandor called on theuniversitycommunitytouphold excellence and responsibility, stating that thelegacy of Nelson Mandela should be reflected in theactions of staff and students alike.

“Freedom and democracy were never mere slogans for Mandela,” she said, adding that they were“idealstostrive for.”

She said she accepted therole with “hope and trust” that theinstitution would continue to embody those values as it strengthens its academic mission and societal contribution.
