Court orders NMB to reverse electricity tariff increase NATASHA BEZUIDENHOUT
RELIEF for Nelson Mandela Bay electricity consumers is expected after the Gqeberha High Court ordered the municipality to reverse changes to its domestic tariff structure and reinstate the previous inclining block tariff. Justice Bulelwa Pakati directed the municipality to incorporate the inclining block tariff (IBT) that applied to domestic consumers during the 2025-'26 financial year into its 2026-'27 electricity tariff. As part of the ruling, the munici-
pality must obtain approval from the National Energy Regulator of South Africa (Nersa) for any consequential amendments to its tariff structure within 30 days of the order, unless the court grants an extension. Affected consumers must also receive credits for amounts that may be due to them as a result of the tariff changes, with these credits to reflect on their accounts no later than 30 days after the directives are implemented. In addition, the municipality was ordered to pay the applicants’ costs of Part A of the application, including the costs of counsel on Scale C.
The urgent application followed the removal of the IBT from the municipality’s 2026-’27 electricity tariff structure. The Democratic Alliance (DA) had argued that the change resulted in substantially higher electricity costs for many residents. Speaking outside court after the draft order was granted on Tuesday, 4 August, DA mayoral candidate Retief Odendaal said some residents had experienced increases of between 30% and 60% since 1 July. “We believe it was an unlawful tariff increase because the municipality indicated the average increase was only going to be between 10% and
11%,” he said. Odendaal said the order would result in the previous tariff structure being reinstated and that affected residents would receive credits for additional amounts paid. “This means that there will be more money in the pockets of people almost immediately and I think that was the important part,” he said. He described the outcome as a victory for residents. “This is not a victory for the DA; it is a victory for the people of Nelson Mandela Bay. I want to make it very clear that we will not allow the chaos in council to be passed on to the
people of Nelson Mandela Bay. They cannot be allowed to pay for the dysfunctionality in the municipality.” Odendaal also claimed that the municipality’s electricity department was running at a R1,5 billion loss. “Why must the people of Nelson Mandela Bay pay for those losses?” he asked. He said residents could not afford further increases in electricity costs. Tuesday’s order deals with Part A of the application, which sought urgent relief. Part B, which deals with the remainder of the DA and Odendaal’s application, will be heard on the ordinary court roll next year.
Three face trial over constable’s murder SHANTI JAFTA THE three suspects accused of the murder of Const. Callan Andrews briefly appeared in the Gqeberha High Court on Thursday, 6 August for what was scheduled to be a pre-trial hearing. History The three accused, whose names are known to PE Express but cannot be published because one of the accused was a minor at the time the alleged crime was committed, appeared in the dock with their faces covered to avoid being photographed. PE Express previously reported that Const. Callan Andrews (29), who was attached to Gelvandale Police Station, was fatally shot while on duty on New Year’s Eve in 2024.
According to the Hawks, Andrews had responded to a domestic violence complaint in Voisen Road, Helenvale, when he was attacked and robbed of his service pistol. He was rushed to hospital, where he later succumbed to his injuries. The Hawks launched an investigation, which led to the arrest of the accused in January 2025. According to the court indictment, the State alleges that Andrews and fellow officers had responded to a domestic violence complaint in Helenvale. After the police vehicle failed to start, Andrews got out to help pushstart it. It is alleged that while he was pushing the vehicle along Kobus Road, he was shot at close range and robbed of his service pistol. He was rushed to hospital, where he later died.
The indictment alleges that one of the accused instructed one of his co-accused to rob Andrews of his service pistol. During the alleged robbery, the officer was fatally shot. The State further alleges that the firearm was handed to the instructing accused before he fled the scene. The charge sheet states that the accused face a total of 12 charges linked to alleged organised criminal gang activity. The charges include inciting, aiding and promoting criminal gang activity; incitement to commit robbery; possession of a firearm and ammunition with the intent to commit an offence; two counts of unlawful possession of a semi-automatic firearm; two counts of unlawful possession of ammunition; murder; robbery with aggravating circumstances; and money laundering.
The money laundering charge, alternatively assisting another to benefit from the proceeds of unlawful activities or the acquisition, possession or use of the proceeds of unlawful activities, applies only to accused two. The charges of inciting criminal gang activity and incitement to commit robbery apply only to accused three. The Legal Aid representative standing in for their colleague said they had not had sufficient time to familiarise themselves with the accused’s affidavit and could not consult with management regarding the appointment of Legal Aid representatives for the accused who did not yet have legal representation. The matter was postponed until 20 August for the finalisation of legal representation. All three accused remain in custody.

Van Niekerk to stand trial after rejecting plea deal SHANTI JAFTA THE Nelson Mandela Bay Municipality (NMBM) Deputy Mayor, Gary van Niekerk, appeared in the Gqeberha Regional Court on Tuesday, 29 July, where he declined a plea agreement offered by the State. Accepting the plea agreement would have required him to plead guilty to the charges against him, receive a criminal record and pay a fine of approximately R28 000. Van Niekerk refused the offer, maintaining his innocence. Van Niekerk faces charges of cyber fraud and contravening the Municipal Finance Management Act (MFMA). PE Express previously reported that, according to the charge sheet, Van Niekerk allegedly instructed Boqwana Burns Attorneys (BBA) and McWilliams & Elliott Attorneys (MWE) to render legal services on two separate occasions in June and December 2022 while falsely representing himself as both a councillor and Speaker of council. Speaking to the media after the proceedings, Van Niekerk said he had called the briefing not to litigate his case in the public domain, but to explain what he believed was a broader pattern of events within the NMBM. “Today I am not here to put anyone on trial in the media. That is the responsibility of our courts,” he said. “I am here to explain why I believe the public deserves to understand a sequence of events that, in my opinion, demonstrates how a cabal can operate within govern-
ment.” According to Van Niekerk, a “cabal” does not necessarily operate through a single event, but through what he described as “a series of carefully timed decisions, strategic omissions and coordinated actions”. He urged the public to consider what he believed was a pattern of events rather than isolated incidents. Referring to the arrest of former city manager Dr Noxolo Nqwazi in September 2022, Van Niekerk questioned the timing of her decision to appoint Selwyn Thys as acting city manager on the same day. “Whether it was merely coincidence or something more is a conclusion that each person must draw for themselves. I have drawn my own conclusions,” he said. Van Niekerk also revisited the council meeting of 7 December 2022, arguing that the exclusion of two Defenders of the People councillors, coupled with the absence of two ACDP councillors, resulted in council failing to achieve a quorum. As a result, he said, councillors were unable to consider referring Nqwazi to the Municipal Disciplinary Board. “Instead, the meeting collapsed, and council was unable to consider the referral of Dr Nqwazi to the Municipal Disciplinary Board,” he said. He further claimed that the municipality did not actively oppose Nqwazi’s subsequent High Court application to return to work. “The Municipality did not actively oppose the application, and only an observer attended the proceedings,” Van Niekerk said, adding that
the sequence of events raised what he believed were legitimate questions deserving of answers. Regarding the criminal complaint lodged against him, Van Niekerk questioned why it had only been laid months after the events in question and how information contained in the complaint had been obtained. While stressing that he was not making allegations against any individual, he said: “Those are not accusations. They are questions which, in my opinion, deserve answers.” Addressing the charges against him, Van Niekerk maintained that he had acted lawfully and in good faith while serving as Speaker. He said the case originally related to approximately R550 000 in legal expenses, but claimed the State was now seeking a conviction involving approximately R28 000. He further stated that no money linked to the legal invoices had been paid into his personal bank account or benefited him personally. “From the very beginning, I have maintained that I acted in good faith, in accordance with my responsibilities as Speaker, and in the best interests of the Municipality.” Van Niekerk said he welcomed the opportunity to present his defence in court, insisting that the legal process, rather than public opinion, should determine the outcome. “The courtroom, not the media, is where the evidence must be tested,” he said. “If I am wrong, the Court will say so. If I am right, the truth will emerge.” He added that he remained confident in the justice system and believed the matter would be thoroughly ventilated during the trial,

with justice ultimately prevailing. Concluding his address, Van Niekerk called on the public to examine the full sequence of events surrounding the matter. “Look beyond isolated events. Consider the full chronology. Ask the difficult questions. Demand honest answers,” he said, adding that this was “how accountability is achieved”, “how public confidence is restored”, and “how the rule of law ultimately prevails”. Speaking about the plea agreement, Van Niekerk said the State wanted him to plead guilty to charges relating to approximately R28 000, but he maintained that he was not guilty of those allegations. “What I just explained is that the amount the State wants me to plead guilty to, I want you to understand that I am not guilty of that either. That’s why I chose to go to trial. Now I have to face the full R550 000.” Asked how the matter would affect his campaign ahead of the 4 November local government elections, Van Niekerk said his decision to reject the plea agreement had been influenced by his party leadership and supporters. “Our members called me aside walking into the court today and requested that I not accept the plea. How can I disappoint them and plead to something I did not do?” he said. The matter was postponed to 8, 9 and 10 December for trial. Van Niekerk remains out on bail.

‘An electric wheelchair would change my life’ NATASHA BEZUIDENHOUT FOR most people, going to the shop to buy a loaf of bread is an ordinary part of daily life. But for 38-year-old Motherwell resident Sandile Msizi, it can mean finding someone to push him, negotiating how much he can afford to pay for the help and accepting that a simple trip outside his home is no longer something he can do independently. After 14 years of relying on a second-hand manual wheelchair, Msizi is appealing to the public for help to obtain an electric wheelchair — something he believes could restore some of the independence he is slowly losing. “I really need help,” he said. Born with a permanent disability, Msizi has never walked and has used a wheelchair throughout his life. In 2012, a donor from Walmer gave him a second-hand manual wheelchair. At the time, it provided him with a degree of independence. Fourteen years later, the wheelchair has become worn and re-
quires frequent repairs, while Msizi said his physical condition has also changed. He is experiencing pain and weakness in his right arm and is struggling to propel himself. “I received this chair in 2012. I was born with a disability and I never walked before. I have always used a wheelchair,” he said. “I’m getting older. Now I’m 38 and my chair doesn’t fit me properly. My right side isn’t working properly and I’m struggling to push myself. My body is weak, so I need help wherever I go.” The situation is particularly difficult because Msizi’s wife is also a wheelchair user. “It’s just the two of us. I live with my wife; she is also in a wheelchair,” he said. The couple used to be able to go shopping and travel to town or the taxi rank, but Msizi said he now frequently has to depend on strangers or pay someone to push him. “We used to go shopping, maybe to town or the taxi rank, but now I have to ask someone to push me. I pay someone to push me and I’m really struggling
because I must pay someone again,” he said. Even buying food has become a challenge. “I also need to buy food. It would be better if I had an electric wheelchair because then I can go alone to the shop.” For Msizi, the request is about far more than getting a new piece of equipment. It is about being able to leave his home without first having to find someone willing and able to push him. It is about being able to look for work and regain some control over his daily movements. In a social media appeal, Msizi said his current wheelchair had become increasingly difficult to use and that relying on others was affecting his independence and dignity. “Pushing my manual wheelchair has become a major challenge. I often have to ask people to push me, and I have to pay someone to assist me when I need to go anywhere,” he said. “An electric wheelchair would change my life.” For a man who has spent his

it “Jennifer” gedoop. Bywoning is gratis. Skakel die galery by 041 586 3973 vir meer inligting.

Having previously worked alongside Yokhuselo Haven through community initiatives, this event holds special significance. “Fashion can restore dignity and raise awareness,” says Braemore. “It’s an honour to use my craft to support such vital work in our community.” Guests can expect sophisticated silhouettes and exciting new concepts that celebrate strength, individuality and the transformative power of fashion. Follow @Braemore_Design NDIMBI Clothing & Manufacturing For Sinoxolo Manengela, fashion is about transformation. As founder and creative director of NDIMBI Clothing & Manufacturing, he transforms reclaimed denim and discarded textiles into luxurious contemporary garments that challenge perceptions of sustainability without compromising on style. For the Voice of Courage Fashion Show, guests can expect elegant silhouettes that challenge perceptions of waste and value, proving that sustainability and high fashion are not mutually exclusive. “This event gives creativity a purpose beyond the runway,” says Sinoxolo. “It’s an honour to use fashion to create hope and support vulnerable communities.” NDIMBI’s meticulous in-house craftsmanship redefines rather than simply recycles clothing, making each piece a work of conscious luxury. Carlos Fritz Designs Award-winning designer Carlos Fritz brings his international runway experience home to Gqeberha with a showcase celebrating years of creative excellence. Named “Best Rising Talent” at Italy Fashion Week and having showcased at Runway Dubai, Carlos blends haute couture with bold African-inspired prints and sleek, attitude-driven menswear. For this event, he is curating a special collection representing his work over the years, and every outfit will be available for purchase after the show. Beyond the runway, Carlos is partnering with Yokhuselo Haven and Community Chest to provide sewing skills training and equipment, helping create sustainable income opportunities. “It’s about giving back and using my craft for community upliftment,” he says. For the Voice of Courage Fashion Show, JaSi Studio presents Vulnerability vs Armour – a thought-provoking collection that explores gendered protection and vulnerability through expertly tailored, gender-fluid garments featuring the designer’s signature chevron motif. Jan Hendrik’s approach is pattern-making-led, with cut, structure and seam construction driving the design aesthetic. “I’m honoured to support Yokhuselo Haven and Community Chest of the Eastern Cape,” says Jan Hendrik. “It’s powerful when creativity can help raise funds and awareness for people in crisis.” The collection revisits previous designs alongside new creations, showcasing clean silhouettes and technical excellence. The eight regional teams across the province who were divided into four groups started the provincial play-offs in a round-robin. The semi-finals were played on 2 August, with the winning semi-finalists being promoted to campaign in the ABC Motsepe League during the upcoming season. The teams in Group A were Super Stars FC (Sarah Baartman District Municipality), Young Challengers FC (Alfred Nzo Municipality) and Sundowns FC (Joe Gqabi Municipality), while the Group B teams were United FC (OR Tambo District Municipality), Prides FC (Buffalo City Metropolitan Municipality) and Green Lovers FC (Chris Hani Municipality). Group C included Major Chiefs Sports Club (Nelson Mandela Bay Municipality) and the University of Fort Hare (Amathole District Municipality). Chiefs played against the University of Fort Hare twice in their Group C stage and won both games by 1-0 and 2-1. Chiefs battled United FC in the semi-finals and lost 5-4 on penalties. Super Stars FC went down 2-1 to Prides FC in the semi-finals. Prides FC and United FC were promoted to the ABC Motsepe League. Motherwell High Schools battle in rugby league MOTHERWELL NU 1 Rugby Stadium was packed to the rafters during the Motherwell High Schools Rugby League games on Friday. Coselelani Senior Secondary defeated Douglas Mbopa High School 17-0. Cingani Secondary registered a commanding 38-0 win over Ndyebo Secondary. Mfesane Secondary cruised to an easy 32-0 victory over James Jolobe Secondary. Motherwell High overcame Soqhayisa Secondary 14-8. Sanlam donates rugby kit to Khulile Primary Khulile Primary School got a boost when Sanlam donated a brand-new rugby kit to the under-13 rugby team on Friday. Sanlam financial adviser Sibongile Sifani said that Sanlam decided to lend a helping hand to Khulile Primary School as part of their corporate social responsibility programme. Sifani said, “This is our way of ploughing back into the community. This is also the way
to thank our community in the form of a generous donation, which is the rugby kit for this school. Additionally, we have noticed that Khulile Primary educators and their learners take sport seriously.” Khulile Primary rugby coach Odwa Fanele said that the kit would restore the dignity of his under-13 boys. “This kit means a lot to our boys. Certainly, it is going to boost the morale of our team. This kit is going to help our players represent our school and its community with confidence and pride.” School deputy principal Ntombomzi Mantile said that Khulile Primary “is committed to putting Sanlam’s generosity to the school to effective use.” Khulile Primary principal Linda Nonxuba expressed her gratitude to Sanlam. “On behalf of Khulile Primary, I would like to thank Sanlam for believing in our mission to empower our players and build the school community through sport. Your partnership makes a really significant difference to our school. We are honoured to have people like Sanlam who add value to our school,” said Nonxuba. Teams fight for top 8 spot in ZWIFA Super League As the Zwide Football Association (ZWIFA) Super League is approaching its end, some teams would like to finish in the top eight teams on the log table. The results of the games that were played at Gal City Grounds over the weekend showed that it was the wish of some teams to compete in the ZWIFA Super League top eight competition at the opening of the 2026/27 season. The log leaders, Shining Stars FC B, were on the receiving end after the much-improved Everton FC overcame them 2-1 during their tough game on Saturday. Everton, who showed substandard performances at the start of the league, are in seventh place on the log table. Real Rovers FC kept the hopes of their supporters alive of playing in the top eight teams’ competition as they secured a 2-0 win over Kuyasa United Brothers FC B by default on Saturday as well. Zwide Celtics FC, who struggled at the beginning of the league, saw themselves register a narrow 4-3 triumph over Real Crusaders FC B on Saturday. The eighth-place Young Killers, who were also slow starters, went down 3-1 to Real Crusaders FC B during their one-sided clash on Sunday. Shining Stars FC B restored their dignity in their well-deserved 3-1 win over Black Stars FC on Sunday. Kuyasa United Brothers FC B could not take on the title contenders Mighty Heroes FC owing to the waterlogged field.
Young scientists shine for Kabega Park Primary Congratulations to the learners who represented Kabega Park Primary School as regional finalists at the Nelson Mandela University Eskom Expo for Young Scientists on 31 July. The school management is incredibly proud. The learners received three bronze awards, while Layla Blignaut, a Grade 7 learner, was awarded a gold medal and the Best in Category award.
