Q:

A: Under a fixed term agreement, the length of the lease is binding. If a tenant makes the decision to vacate prior to the lease end date, they have absconded from the tenancy (commonly referred to as “breaking the lease”). When a tenant breaks the lease, they are held responsible for costs that would be incurred by the landlord or agent in finding a new tenant. These costs include a portion of the reletting fees, pro-rata advertising costs and compensation to the owner for rent until the property is re-let. Formulas set out by SACAT are used to determine the portion of re-letting and advertising owed to the owner.

Can my tenant leave before their lease end date? As a landlord, you are not obligated to start advertising the property until the keys have been returned and you have vacant possession. However, you are obligated to mitigate the tenants’ losses, meaning that you are required to lease the property as soon as practicable. You may have to take further steps, such as reducing the rent, to secure a new tenancy. In such events, you can claim compensation in loss of reduced rent for the remaining lease term. COMMUNITY CONVERSATIONS Cat management A state-wide ban on cats cannot come soon enough. Wandering cats in the northern suburbs are a huge problem. They dig in my garden to use as a toilet, their toilet smell is so bad I cannot open my back door, they torment the dogs in the district causing them to bark, they roam at night and kill wildlife. Cat owners should be ordered to keep their cats on their own properties (just as dog owned must do). David Steenkof Keep the footpaths safe No registration, no identification, no insurance, speeds of up to 25km/h, no mandatory use of warning devices, no firm implementation of regulations. Pedestrians, dog walkers, children, the deaf, blind and disabled cannot be assured of safe passage on footpaths any longer when silent e-scooters and bicycles share the footpaths. Footpaths are for feet. Wheeled vehicles should be out of bounds. Amanda Ciesski, pedestrian Snake alert It’s snake season so be alert as you walk along bush tracks, particularly if you have a dog. Snakes live in watery environments such as creeks, rivers, swamps. Snakes do not go out of their way to attack you but if they are threatened, (eg cornered by your dog) they will fight back. If the snake is on council land contact the council. If is on your land contact a snake catcher. Smelly Lake I sail a model yacht on Mawson Lakes and the odour is awful and the water is filthy. My boat often ends up with an oily black ring around its edge. We see huge carp jumping out of the muddy water. The lake needs a good clean. Allan, Salisbury Plain Rental returns I agree with M Henschke (No Rent Freeze Issue 185). People who do not own investments properties seem to think that rentals provide a goldmine to owners. They don’t. By the time the owner pays council rates, state land tax, emergency services levy, duty on the purchase plus water rates, the monthly income shrinks. The federal government takes income tax on rents received, then there are maintenance costs, insurance costs and agent’s fees. If a tenant leaves, there is a period without rent while the property is re-advertised and re-let and more agent’s fees. If a landlord does not own the property outright, the mortgage has to be paid and if the owner decides to sell, the capital gains tax kicks in. A local love story My mum, Brenda Wilson, turned 80 in December and she and our Dad, Vivian, celebrated their 60th Wedding Anniversary in the same week. They purchased land in Parafield Gardens in 1962 and have lived in the same street ever since. A lot has changed in the area since then. Salisbury Highway had one lane in each direction, there were very few houses, and they could see cows grazing in the distance from their back door! About 25 years ago they looked at upgrading, but could think of no where else they would rather live, so they built their new home right next door to the original house. Mum still plays badminton and goes line dancing every week. She regularly walks their dog around Mawson Lakes and always picks up a copy of Northern Living from the Mawson Centre or Square Cafe at Mawson Central. They are a true local love story. ELECTRIC VEHICLE CHARGING at WORK The global surge in electric vehicle sales has prompted a team of researchers at the Mawson Lakes campus of the University of South Australia to explore how the university could provide free or small-fee charging facilities for electric vehicles to staff and students. Currently, the Mawson Lakes campus has rooftop solar panels on 18 buildings. These are supplemented by ground-mounted solar panels. Researchers argue that by doubling the existing solar power system on campus, free charging could be available to approximately 200 electric vehicles. By charging a fee, the campus could potentially support 800 electric vehicles, the maximum number of parking spaces at Mawson Lakes.

At 25 per cent EV penetration, the UniSA Mawson Lakes campus could reduce its annual electricity costs by more than 9 per cent. By upgrading its existing solar photovoltaic system to optimum capacity, it could provide free electronic vehicle charging during the day. If cars are charging during the day when people are at work it reduces the demand on the power grid during the evening when solar generation dwindles and demand increases.

Australia intends to increase the use of electric vehicles to around 25% by 2030 and more than 80% by 2050. The ACT has officially announced its intention to ban the sale of new fossil fuel-based cars by 2035. DO I HAVE TO HAVE THE X-RAYS? It’s a good question and one often asked of my clients who are understandably concerned about not being unnecessarily exposed to x-rays (and the bill that comes with them). Most x-rays at the dentist are screening x-rays of your back teeth only, performed every 2-3 years, usually one x-ray on each side. These are called ‘bite-wing’ x-rays and their purpose is to screen for cavities that cant be otherwise be seen by looking such as between the teeth or underneath old fillings.

Increasingly the dental profession is incorporating a 3-D x-ray technology called Cone-Beam scans that provide useful information and improve treatment outcomes for many dental procedures. These have a larger dose of radiation (about 150 uSV). Cone Beam scans should not be done routinely but only when justified by a particular treatment outcome and only by trained staff. The Talented Mrs Greenway by Tea Cooper

Francis Greenway was a promising architect, but after an accusation of forgery he was convicted and transported as a convict to the Colony of New South Wales in Terra Australis in 1812. This book is based on a true story about the very beginning, planning and construction of the city now know as Sydney and the rise of Greenway to become the Colonial Architect in 1816. Many of his brilliant buildings still stand today. Greenway's wife, Mary Greenway, was devastated when her husband was sentenced as a convict, so in 1814 she left England and travelled as a free settler on another convict ship to join him. Mary was full of nervous anticipation about living in the new Colony but she could see Sydney Town had potential and her creative husband had a part to play. By chance Mary met Elizabeth Macquarie, wife of Lachlan Macquarie the Governor of New South Wales, but because Francis Greenway was a convict and Mrs Macquarie was the wife of the highest official they had to be careful about the secrets and hopes they shared and their association. Mary was a clever woman, a wife, mother of 7 children and an artist, but most of all she had courage, and she seized opportunities in a diplomatic way to advance her family’s good fortune. Using real facts and fiction the author has written a sparkling novel about fascinating historical times and the people who helped shape Australia.This book, published in 2023, gives a rich insight into the hardships in the early days of English settlement in Australia and days living amid the difficult politics of a convict settlement.
