Event in Real Producers History publisher’s note On November 17th, DFW Real Producers will be hosting our firstever Black-Tie Awards Gala called The ESPE’s! I am not going to lie; I am wildly excited for this event. I have wanted to do it for a while, and I am so excited that it is finally happening! Being that it is November, the month of Thanksgiving, I suppose a more appropriate and equally accurate word choice would be that I am so THANKFUL for this incredible community that makes it even possible to have this kind of event. If you recall, Real Producers here in DFW as a whole almost didn’t happen. When I moved here from Minnesota in February of 2018 to launch North DFW Real Producers, the OG RP here in DFW, I was very close to failing and almost turned around to go back home to Minnesota. But, thankfully, the community started to grow and take shape. The gratitude I have for the first few agents and businesses that truly supported Real Producers from the beginning is unmatched. If it weren’t for them, Real Producers wouldn’t exist here, and we certainly wouldn’t be having The ESPE Awards in a couple of weeks! The ESPE’s is a first on many fronts. It is not only our first-ever awards gala, but it is also the

first time that we are bringing together all three Real Producers communities – North DFW, Dallas, and Tarrant Real Producers – for an unforgettable combined event. As I write this, anticipation is feverishly growing inside of me! At 7pm, we will be starting the Awards Ceremony, where we will be presenting ten different ESPE Awards. At the time of writing this, we have already had thousands of people vote on these awards. The real estate community is sincerely pouring into this event! I would be remiss if I didn’t give a special thank you to our RP Vetted Business Partners and especially those who are sponsoring this event. As you know, it takes a lot of time, money, and talent to throw an event like this, and it wouldn’t be possible without them. From the bottom of my heart, thank you! Luviano ENERGIZED BY THE EXPERIENCE There’s nothing quite like the feeling you get from helping your clients move from the beginning of the process to the closing table. It’s a feeling that Marlene Luviano cherishes. As a REALTOR® with JP & Associates Realtors, Marlene is truly driven by the experience of serving her clients. “I love solving challenges, negotiating, and being able to give that peace of mind to my clients … to let them know they are taken care of when I’m helping them buy or sell their house,” Marlene says. “Having that interaction with them gives me energy.” Finding New Opportunity

Marlene was born and raised in Mexico and moved to the United States in 2016. Like most young people who come of age and consider their future paths, Marlene had many interests to choose from. “I remember in high school, I was interested in photography and videography and also liked finances and math,” Marlene says. “I ended up choosing Environmental Science … wanting to help the environment and people.” Marlene was an exchange student for six months. “I got a full scholarship to study a semester of my bachelor’s degree at the University of Oregon,” she remembers. “That’s how I met my husband, Kamel, who was also an exchange student but from Egypt.” Crucial Crossroads

As Marlene had worked through earning her degree, she came to an important realization.

“I loved environmental science, but I thought it could involve a lot of computer time,” she recalls. “I needed to find something where I could spend more time working directly with people. That’s how I ended up finding real estate. You get to interact with people, understand them, help them, and have the opportunity to generate wealth through it at the same time. After I saw all the benefits of working in real estate, I instantly knew it was a great choice.”

I like to listen to really understand their needs so that I can provide better guidance and advice for them.” Marlene and Kamel moved to Dallas after their college careers were done. “My husband and I had both graduated and came to Dallas with a backpack and a suitcase. We stayed with Kamel’s mom in her apartment for a time while we worked in a restaurant,” Marlene says. “I was already working towards getting my real estate license but needed somewhere to start.” She did just that in 2017. Like most who begin their real estate career, Marlene’s start in the business was challenging. “I think tough times are necessary. It taught me to appreciate what I have, how to manage money and time, and it makes achievements more rewarding,” she says. “At the time, I had no sphere. The only person I knew was my husband. There was a lot of struggling in the beginning since I was working hard and expected to see more immediate results, but in real estate, I’ve learned that your work takes a little longer to pay off.”

Gaining Ground

Marlene kept pushing forward by learning from others who had found success in the business and following advice. “It took a while to get things going. But one thing that helped was I didn’t have a Plan B. I needed to make this work,” Marlene says. “In the process, my husband was a big help whenever I doubted myself. Through time, things started happening because of the compound effect … doing little things each day that led to bigger results.” Signs of Success

After her first six months in the industry, Marlene completed her first transaction and ended up closing six deals in the next couple of months. In 2018, that number snowballed to 33 transactions. She has continued building since then and ranks among the area’s top REALTORS®. In fact, to this date, she’s helped over 200 families buy and sell their houses. One of her achievements this year was to be nominated as Listing Agent of the Year, Most Transactions Closed, and ended up winning Agent of the Year within the company among more than 4,000 great agents. Rewarding Life

Away from work, Marlene has a deep appreciation for family. She enjoys spending time with Kamel. They’ve been married for six years, and she’s currently seven months pregnant with her first baby. They’re so excited to welcome their baby girl December 2021. Marlene also maintains a close connection with her parents, Martha and Alberto, who still live in Mexico.

“They both run an insurance business there and have always been of huge support,” Marlene says with a smile. “My father is the one who said you will always do well if you are in service with people.” In her free time, Marlene has a big appetite for continuous learning, watching videos, and taking classes to learn more about the business, investing, and managing money. She also likes to go on walks with her dog Mila and exercise at the gym. Making an Impact

Those who have the opportunity to know and work with Marlene appreciate her caring and knowledgeable work and her drive to

continuously grow and enhance her abilities. They know she is always there with a laser focus on their needs. “I like to put my natural empathy to work with my clients,” she says. “I try not to be reactive. It’s natural to want to build things that last. Red Dirt Roofing and Construction, however, goes beyond that to build strong bonds and enduring relationships that stand the test of time.

That commitment begins with Justin Barker, who is the owner of Red Dirt Roofing and Construction. “What we do day-to-day is more about the relationships we build than it is about the numbers. I like to meet and build relationships with every one of our customers, our REALTOR® partners, and others in our industry,” Justin emphasizes. “This isn’t about how much money I can make. At the end of the day, I want clients to be happy and satisfied, and I want to get referrals from every person I come in contact with. That’s what really motivates me.”

Strong Foundations Justin has a long tradition of being an entrepreneur and business owner. In fact, he started his first business when he was just 19 years old. Following their move to Texas, Justin’s wife, Heather, suggested that he, after working with other roofing operations, form his own company. Justin agreed, and Red Dirt Roofing and Construction was born in 2016. In just a few short years, the company’s reputation for results has grown substantially.

“When I think about the success we’ve built, referrals are the primary measure. It means a lot when people feel that we’re doing such a good job that they refer us business over and over again. In turn, we’re building something that keeps growing every year,” Justin smiles. “I moved here not knowing anyone. Now, a lot of large brokers and top-producing agents are working with us. It means a lot to be a preferred roofer with so many brokerages. That makes me feel amazing!” Building for the Future Family is central to who Justin is. His wife, Heather, is also Vice President of the company and adds her experience and expertise as a REALTOR® to the mix. Justin cherishes time spent with Heather; their daughter, Brooklyn; and their sons, Bronx and Beckham.

“I have met an insurance adjustor at 8:30 a.m. before and been able to start the roofing project at 9 a.m. the same day,” he explains. “The reason why we have our own licensed adjustors working with us is that it means a lot to be able to offer that kind of expertise to our clients. Our team members know what they’re looking at.” This is important in a business with deals often hinging on tight turnaround times.

The family enjoys spending time together boating and jet skiing on the lake. They also have a passion for travel, including snow skiing in the mountains of Colorado.

NOT ALL HEROES WEAR CAPES: Who is Saving the Day in Collin County The Collin County Association of REALTORS® (CCAR) knows a superhero is not identified by a cape flowing in the wind but by the people they quietly help. CCAR was honored to support local heroes dedicated to saving the day throughout 2021. Here are some of the headline-worthy rescuers that you might not see in the newspapers.

The North Texas REALTORS® in Action Foundation (NTRIAF) is a non-profit 501(c)(3) organization created by CCAR in 2015 that provides the resources needed to implement outreach programs in our surrounding communities through charitable donations, volunteer work, education, and charitable housing initiatives. “The Foundation exists to supplement the efforts of our REALTORS® in aiding, loving, and caring for our neighbors,” explains Brandon Hern, NTRIAF President and CCAR member. “At NTRIAF, money doesn’t sit in a bank account, it goes out to our clients who can’t eat because all of their food is spoiled,” said Hern. In 2021, NTRIAF distributed $27,750 in winter storm financial assistance to 13 members of our community, $1,000 in sleeping bags to The Salvation Army, $2,000 in donations and gift cards to The Samaritan Inn, $5,000 to the Children’s Advocacy Center of Collin County, and over $17,000 to other North Texas charities. CCAR’s Affiliate Committee hosts the Affiliate Holiday Auction annually, and this year’s event, on November 9, benefits The Samaritan Inn. The Samaritan Inn is a comprehensive homeless program that helps willing people gain dignity and independence. More than just a place to spend the night, The Samaritan Inn helps those experiencing homelessness by meeting their physical needs and teaching life skills to aid their journey back to self-sufficiency. On a typical night, The Samaritan Inn provides a place for 160 people to sleep, of which one out of three are children. “I have worked with The Samaritan Inn for a number of years and one of the reasons I love the organization is because they provide a hand up, not a handout. For a resident to be there, they have to be part of a program to gain their independence realproducersmag.com

back,” said Lee Warren, CCAR member and member of NTRIAF’s Panel of Advisors. “After gaining independence, residents are given an opportunity to move across the street into apartments owned by The Samaritan Inn for six to 18 months at a reduced rate. This provides the resident a chance to create a rental history. When residents move into the apartment, they are completely empty and The Samaritan Inn connects them with sponsors to help fill it with towels, toiletries, food, furniture — all of which is now theirs and moves with them when they move out,” explained Warren. CCAR’s Community Outreach Committee hosts events that are open to and benefit the public. On July 17 and October 2, CCAR joined with Baylor Scott and White The Heart Hospital – Plano’s Living for Zachary Heart Screening program to provide free heart screenings for youth ages 12-22. This free service can help detect heart abnormalities that may lead to sudden cardiac arrest in children. In 2020, when Minnie’s Food Pantry’s shelves went bare as a result of an increased number of families needing assistance and dwindling donations, CCAR’s Community Outreach Committee launched a series of contactless food drives. In 2021 alone, CCAR collected $3,600 dollars, 1,718 lbs. of food, one pallet of bottled water, and 700 lbs. of hand sanitizer. Donations received from the contactless food drives helped Minnie’s continue to provide healthy meals, educational resources, and the red-carpet treatment to every person it serves — just as it has done for the past 12 years. Those interested in supporting local superheroes are encouraged to participate in CCAR’s annual Holiday Breakfast on December 14. All proceeds from the event will go to the Children’s Advocacy Center of Collin County. Each year, more than 4,500 children are reported as abused or neglected in Collin County. And, the pandemic has had an even more drastic effect. Through the services provided at the Children’s Advocacy Center of Collin County, these children are able to find safety, healing, and justice. CALLAHAN Made for This – and Each Other Doing what you enjoy is a gift. Being able to do it with someone you love gives true purpose to life. Matt and Kimberly Callahan are perfect examples of that truth. As partners in life and business at Callahan Realty Group, Matt and Kimberly are clearly made for what they do — and each other. Their path together began in high school. “Kim and I went to high school together. We were good friends and ran in the same group. We went through a lot together, which made it easy for us to remain close friends all the way through our college years. She was my wingman and would introduce me to all the girls I thought were cute. Of course, in return, I would have to buy whatever she was drinking that night,” Matt remembers with a smile. Partners on the Same Path

It didn’t take long for them to realize that they should share the same road in life in all ways. They got married, started a family, and combined their talents all the way around.

They purchased their first home together and worked in their media/photography business, including working with ad agencies on projects. A New Door Opens

With their growing family, they looked at taking a new direction. As Kimberly remembers, “We thought it was good for us to explore other businesses. We were buying a house at that time and met Jason Haugen, a Top-Producing REALTOR® who said, ‘Why don’t you try real estate?’ He is awesome. He paid for Matt to go through real estate school. We became really good friends with he and his wife.” Matt earned his license 11 years ago. About four years ago, Kimberly got hers, as well.

It’s easy to see the passion Matt and Kimberly have for the business. “The people side is what I love the most,” Matt says. “We get to meet a lot of cool people. There are times when we meet someone where we are the student and learn from them. Out of everything I’ve learned in real estate, sometimes the biggest things we learn are from talking with other people.” “Another thing I love about our work is just getting out there,” Kimberly smiles. “I’m such a people person and a total extrovert. I love being out there with others … I can’t sit behind a desk all day.” A Natural Fit

Matt and Kimberly complement each other perfectly. Matt first joined Jason and his wife, Shirley, who had been with Keller Williams before starting their own brokerage, Haugen Properties. In the process, Matt gained outstanding experience on a team that closed around 100 properties a year. After growing and enjoying their time with Jason and Shirley, Matt and Kimberly decided to start their own firm, as well. Building Together

Today, Matt and Kimberly have their own boutique firm with seven agents.

“Matt really keeps me grounded. He is quiet, calm, and collected,” Kim says. “On the other hand, I’m loud and boisterous. In general, I get the business and Matt closes it. We work really well together, with each of us having things that we do really well.” The signs of their success together are plentiful. In fact, in 2020, they recorded $14 million in sales volume together.

“We love what we’re doing, serving our clients and helping our agents build their own careers,” Matt says. “We’ve been blessed by having people who helped us get our start along the way. So, hopefully, we can do the same thing for others. It would be great to see some of our agents have their own companies.”

Family Time

Always being available is important. No matter what we’re doing, we do our best to always answer our phone. There are moving parts, and things change all the time, so you have to be available for them.”

In their free time, the family has a passion for the outdoors, spending time with their dog, Lady, and taking their camper for road-trip getaways. They also like fishing and boating.

Away from work, Matt and Kimberly treasure time with their three children — their 12-year-old son, Pierce, their 9-year-old son, Dean, and their 8-yearold daughter, Vivian.

When it comes to supporting the community, Matt and Kimberly like to support their local schools, along with local organizations such as Mission Moms, as well as groups that support underprivileged children. They also like being part of efforts through the Greater Lewisville Association of REALTORS®, including the group’s Stuff the Bus event, where agents buy backpacks and fill them with school supplies.

CHANGES TO TEXAS REAL ESTATE LAW At Texas Title, our team carefully monitors all updates to Texas real estate law to ensure we are providing the most updated guidance to our clients as we assist with your real estate closings. Here are some of the most important recent legislative changes. Homestead Affidavit as Release of Judgment Lien

Section 52.0012 of the Property Code was amended to revise the procedure for clearing the a cloud on title on a property being claimed as homestead arising from an Abstract of Judgment. Effective September 1, 2021 60 • November 2021

Quitclaim Deed

Fee Cap for Resale Certificates

Section 13.006 has been added to the Property Code to provide that on the fourth anniversary from the date of recording of a Quitclaim deed in the deed records of the county where the real property is situated, it the Quitclaim Deed (1) will no longer affect the good faith/bona fide purchaser status of a subsequent purchaser or transferee or creditor who has no actual notice of unrecorded matters; and (2) is not notice to a subsequent purchaser or creditor of any unrecorded conveyance of, transfer of, or encumbrance on the subject real property. Effective September 1, 2021

Sections 207.003(c) and 207.004(b) of the Property Code were amended to impose a $375 maximum cap on the fee a property owner’s association may charge to deliver a resale certificate and a $75 maximum cap on the fee that can be charged to prepare and deliver an update for the resale certificate. The new rules also provide remedies for noncompliance with the statute. Effective September 1, 2021 Wraparound Loans

Chapter 159 was added to the Finance Code, imposing registration and licensing requirements FOR @realproducers


WHAT? It also includes exemptions and changes with regard to wraparound loans. Texas Title advises that agents call an Underwriting Attorney for assistance on Wraps to determine if the wrap lender is subject to the new law. Effective January 1, 2022

Series LLC

Amendments to the Business Organization Code and the Business and Commerce Code were enacted to introduce “registered series” of Texas limited liability companies, while renaming the existing series concept as a “protected series.” Effective June 1, 2022

Public Improvement Districts

Multiple revisions were made to the Local Government Code and Property Code with regard to public improvement districts (PID). Prior to entering into the contract, sellers of property in a PID must give the prospective purchaser written notice that the property is located in a PID and that purchaser will be obligated to pay any applicable assessments. A separate copy of the notice must be executed by the seller and purchaser at closing and recorded. Effective September 1, 2021 Governing Authority of an LLC

Section 101.251 of the Business Organizations Code was amended to clarify that the governing authority of an LLC consists of managers of the company if the company agreement so provides or the members of the company if the company agreement so provides. Effective September 1, 2021

Mechanic’s, Contractor’s, and Materialmen’s Liens

Chapter 53 of the Property Code was changed to reflect new deadlines for filing an affidavit claiming a lien due to unpaid bills. Other changes include clarifications to the deadlines for sending notices of the claims, revision of the methods of notices, and providing statutory forms for the notice of claim and notice of claim for retainage. Effective January 1, 2022 Amendment of Restrictive Covenants

Section 209.0041 of the Property Code was changed to stop a property owner’s association from attempting to revise the restrictions applicable to “commercial reserves” to prevent the use of the tract’s use as a multifamily or commercial use tract. As a REALTOR® with Ebbie Halliday, Ericka drives forward, following her calling and serving those around her. “It was an interesting turn of events that led me to real estate,” Ericka remembers. “I was a stay-at-home mom with four children, and we were being relocated to Houston. BREAKING NEW GROUND Each of us has our own path in life. It’s a wonderful feeling when you reach new milestones along the way … especially when you’re setting out and creating your own way. That’s the entrepreneurial spirit that drives Robert Meche. As Broker/Owner of SWR Group with Keller Williams, Robert is definitely breaking new ground for those around him. “I remember having the hardest time when I first started in this business 21 years ago, and it was a chip on my shoulder,” Robert remembers. “So when I started my team, I swore I would do whatever I could to help others. I love making sure the agents are taken care of to make sure they have no issues at all.” Early Lessons for a Life of Excellence

Robert was born in a small town in South Louisiana. As he came of age, his parents gave him the tools he would need to make his way through life. “My parents taught me and my brother to work hard, and to be disciplined, and to be loyal at a very early age. Both of us took jobs when we were 15 and have been working ever since. My brother, Michael, started at Papa Johns, and to this day, 30 years later, works on the executive team there.”

Leading the Way

In the meantime, Robert has spent the last 20 years building one of the biggest real estate teams in the country under the brokerage he founded and then strategically aligned his firm with Keller Williams three years ago. Thinking back, Robert says his real estate career came about as what he calls “a complete accident.” “My background is in Accounting and Finance. I became a Field Auditor for a startup athletic company called FootactionUSA and later worked with the executive team as we merged with Just for Feet and Footlocker,” Robert remembers. “As with any merger, there were casualties, and I was one of them. I gained an early hate for the corporate world as I was thrown into the streets.” Stronger than the Challenges

Despite that setback, Robert’s resilience was strong. In fact, he says the chapter definitely turned out to be a blessing in disguise. “Sometimes, your low points become your high points. The job loss almost ruined us financially but created a disciplined motivation to be the best at whatever I did. I swore after that, I would never let anybody control my future or destiny,” Robert emphasizes. “I knew the only way to be free and successful was to work for myself. And that is where real estate came in. The dad of one of my childhood friends was a real estate agent who helped me buy my first house. He told me how much he enjoyed it and encouraged me to start my classes.” Something struck a chord in Robert. He thought he had nothing to lose and dove in. “That carefree decision became one of the biggest turning points in my life and the start of what became a successful real estate career,” he smiles. Today, his team includes about 145 agents statewide, including about 125 in Dallas, along with about 20 others in Austin and San Antonio. “None of this is possible without my Director of Operations, Brent Holdburg,” Robert says. “Point blank, we do not grow as fast without Brent; he is truly irreplaceable.” Robert acknowledges that his team operates in a unique way. “We’re kind of like the Oakland A’s of real estate. We do things very differently,” Robert says. “I love the movie Money Ball. It’s very similar to what we do. We don’t have a traditional team. I believe in part-time real estate. Most brokers won’t have a part-time agent. But going part-time was the only way I got here. The part-time niche is what built our company. And some of those parttime agents became fulltime agents later on.” Each year, Robert and his team average around $100 million in sales volume, representing around 300 transactions. Team Spirit

When you talk with Robert, the pride he has in his team is easy to see. 80 • November 2021

“The growth of the firm surprises me. I never thought we’d have this many people. For me, it’s a matter of the amount of people who utilize our firm to make a living,” Robert explains. “We have a lot of people who make their career off the things that we created. That’s very fulfilling.” Fulfilling Life

Away from work, Robert treasures time with his family, including Deana, his wife of nearly 20 years, and their two sons — 14-year-old Andrew, who is just entering high school, and 12-year-old Mitchell, who is in middle school. In his free time, Robert is a member of a competitive barbecue team, hence the name Smoker Broker. He acknowledges the name gets a lot of fun feedback, and it has become a great marketing co-brand to his SWR Group. In fact, the producer of his weekly national radio show told him to use the name for the title. It is a unique combo with real estate and barbecue, but in Texas, it makes

perfect sense! As Robert considers his career, he offers helpful advice for others in the business who are considering their next step forward. “There are definitely a lot of ways people do business and everyone has their own preferences. Above all, I always emphasize that you have to network,” Robert says. “If you aren’t, you’re wasting your time. I always remind my agents that there are three ways: The first is following formal/professional routes through organizations. The second is by working through your family and friends. And the third is taking advantage of informal ways to meet people.” When you talk with Robert, it’s easy to see that he is a driven, genuine person who has employed his tireless work ethic to create special opportunities for those around him. And that’s what it’s all about. Robert continues moving forward … finding new ways to break new ground and make the road smoother for others. @realproducers
