Minimizing Taxes on Death – Part II

ast week, we looked at four of the eight top strategies to deal with taxation at the time of death; this week we will examine the remaining four.

capital gain (or loss) resulting from the deemed disposition rules, however, the donations tax credit your estate received will offset that gain.

More recently, changes have been made that now allow for the donation of marketable securities to charity with no capital gains inclusion on your tax return.

T rack Your ACB.

File Multiple Tax R eturns.

At the time of your death, the difference between David Pass, the fair market value of Financial Advisor capital assets and your ACB is your capital gain, which is subject to taxation. If you can justify as high an ACB as possibly, you will help to minimize your estate’s tax bill. The problem is that many people don’t know how to properly calculate their ACB – they simply assume that it is their original purchase price. Although the purchase price is generally a starting point, there are a number of events and transactions that can take place over the years that could alter the ACB. Ensure you keep track of the events and transactions, which will impact your ACB, so that your executor can properly report your capital gains on death (you may need the help of your tax advisor with some of these): - Purchases of the same security over time at different values - 1994 capital gains elections to “bump up” the cost base of certain assets - Inherited or gifted assets - Reinvested distributions from mutual funds or reinvested dividends from stocks.

Give to Charity.

Giving to charity is a great way to help a good cause while receiving a tax break. If you give to charity on your death (usually via your will), your estate will be able to claim a donation tax credit for the fair market value of the gift on your final tax return. If you give assets other than cash, your estate may still have to report a

In the year of death there are four tax returns that can potentially be filed, and filing more than one could save your estate some tax in your year of death. Here are the four potential tax returns: 1. Final or terminal return. This is your regular tax return that reports regular income plus income accrued from January 1 to your date of death.

2. Return for rights or things. This is an optional tax return that includes income earned and receivable at death, but not yet received. Examples of income included on this return are accrued vacation pay or dividends declared but not paid as of the date of death.

3. Return for income from a testamentary trust. This optional return can be filed if the deceased was the beneficiary of a testamentary trust and more than 12 months’ worth of trust income would otherwise have to be reported on the deceased’s final tax return.

4. Return for a partner or sole proprietor. This optional return can be filed to report business income of the deceased if the business has an off-calendar year end and more than 12 months’ worth of business income would otherwise have to be reported on the deceased’s final tax return.

Why would your estate want to file multiple tax returns? Well, for one, a claim can be made for some personal tax credits, such as the basic personal amount, on each of the returns filed on your behalf, effectively multiplying the number of credits claimed in the year. In addition, by

spreading your income out over several tax returns, your estate benefits from the lower graduated tax rates more than once in your year of death.

Usually the help of a tax advisor should be sought to file the terminal and optional returns since the rules can be complex.

The heading probably reminds many of an old song from Show Boat but there is no music to these words! It simply says what many seniors feel as the warm climate of summer begins and it is certainly

Travel for seniors can now mean an afternoon at a craft show or a river cruise for two weeks. The travel can be by car, bus, plane, boat or even helicopter!

There is one aspect of travelling though that every senior has to give more time and attention than other travellers. This important item is never in the brochure, never mentioned by the travel agent or tour guide and yet it can mean the difference between an enjoyable trip or one to try and forget!

It is the health and stamina of the senior traveller. The points are interrelated and the level of each depends on the other. These should be at the top of every travel list and their preparation begun even before the trip is given any thought. All too often does one see a fellow senior traveller stay on the bus because they lack the energy to get off and visit the beautiful garden. Or after a luncheon that was included in the cost of the tour, a certain person had to see the hotel physician for

ver the last few months of writing this monthly column on eldercare the most common question I receive from readers is “What does an agency like Victoria Eldercare do?” I realize that the concept of home care in a nonmedical situation is very new to most people, so today I am sharing a few examples of how our agency has helped in various situations. chest pains. This person had eaten to get ‘their money’s worth’!!!

There is only one person who can help themselves to have the best trip possible… Preparing for the changes in routines takes regular physical exercise such as walking 30 minutes everyday and not having any extreme changes in health habits such as eating. Taking care can mean that the time and money spent (sometimes in the four figures!) will give pleasure and

smiles for years later when the trip is recalled.

Being in our ‘best condition’ also helps when boarding the bus or boat.

There can be a ‘walk’ to get to the gangplank or the steps. Learning to relax and have a catnap en route to the plane is also a plus to conserve energy.

Seniors can do so much to help themselves have an enjoyable and safe trip!!

Case # 1 – Senior with mid-stage Alzheimer’s disease living by herself.

A senior living in her own community style apartment complex, dealing with mid-stage Alzheimer’s, kept forgetting to take her medication. After time, she began wandering around town and being reported lost multiple times, with police having to locate her and bring her back home safely.

Victoria Eldercare provided a phone call medication reminder service initially, which was very successful. Once the client began to wander, the client’s son had asked Victoria Eldercare to help out. Our PSW would take the client out for errands each day by car during poor weather, and by walking on nice days. Once back at the apartment, the two would work on crossword puzzles together and participate in an exercise program. A 3 hour visit allowed enough time to complete errands, and also expend a lot of energy allowing the client to sleep soundly at night and the wandering ceased.

Case # 2 – Senior was living with family who were going away on a 3 week holiday The senior was no longer able to drive for groceries, appointments, pick up medications, and also needed assistance with laundry, and other household chores.

Victoria Eldercare provided a Personal Support Worker for 4 hours a day, 3 times a week. The

PSW was able to drive the senior to the grocery store, drug store, and a doctor’s appointment.

Assisting with laundry, watering the garden, and feeding the cats were all done during the visit. Most importantly, the PSW provided great companionship while the senior’s family was away from home. The family was then able to relax while away knowing that their mother was being looked after.

Case # 3 – Help arriving, during, and departing a function Family was having a wedding and the Grandparents were unable to get ready themselves. The Parents were busy dealing with the wedding itself, and they knew the grandfather also needed assistance in the bathroom and with eating.

Victoria Eldercare provided a Personal Support Worker to assist the grandparents with getting dressed and driving them to the wedding reception, sitting with them, helping with eating, and assistance in the washroom. With the reception running late into the evening, the PSW was able to get both grandparents back home safely and at a time that they wanted to leave.

Courtesy of The Silver Lake Rowing Club The Silver Lake Rowing Club won gold for just the second time since the club was formed in 1999, at the St Catharines’ Invitational Regatta on Saturday.

And it was the first ever Under 23 age category victory for the club (their previous victory was in an under 17 event).

Eryk Taylor and Zac Azzopardi rowed in good conditions to win in the under 23 lightweight men's double event in a hard fought race just beating out a crew and last years champions from Detroit, Michigan for the victory.

Eryk and Zac are commuting to Oakland and doing a lot of indoor training (unusual to summer rowing) to race for Silver Lake

while other SLRC Alumni are living in and racing out of clubs in London, Guelph and St Catharines.

Rowing for St. Catharines at the Invite, Terry Lovegrove made the under 23 men's single final where he placed 2nd.

The St. Catharines Invitational Regatta is the last regatta before the Provincial Championships.

Crews from across southern Ontario, Quebec, New York and Michigan attended this invitational competition.

Zac and Eryk have met the time standards set by the club to compete at the Provincial Championships next Saturday and Sunday in Welland. We expect even stiffer competition and should see some good racing for Eryk and Zac as well as their SLRC alumni.

Colour or highlights when done properly can give hair body and a three dimensional look. No matter what shape, keeping the haircut close to one length maintains a thicker bouncy look. Fine hair responds much better when trimmed regularly. Keeping the ends clean cut, even if only a minimal amount, 1/4 inch every 4 to 6 weeks is all that’s required. Find a volume shampoo and conditioner that works for you, use a cool rinse. Limit your styling products as not to weigh the hair down. On exceptionally fine hair, be sure not to over stretch the hair when styling. Use only your fingers to get out the moisture, Don’t use too high of heat, then shape with the appropriate tools. The result should be healthy, thicker looking hair.

The elusive noise on the deck For two summers now there has been an unusual noise on our deck that I was fairly certain was a Gray Treefrog, but I was never able to locate the frog to verify this belief.

When I returned from vacation last week, I switched the water fountain on again, and as the water gushed out, much to my surprise, so did a small grayish-green frog.

It had been resting in the spout of the pump.

None the worse for wear, it crawled out of the pool of water and I moved it, with some difficulty, to the plants in the garden down below.

The difficulty arose because to get from the deck to the garden, I have to walk through the house.

Just as I reached the basement door that leads to the garden, my little friend decided to jump out of the pail it was being carried in.

My shrieks and laughter as I tried time and again to catch the frog before it got behind the furniture brought my sons running to see what my problem was. The shrieks were because the frog would occasionally jump at me and try to attach itself to my legs, which was a very strange feeling. The laughter was because both the frog and I were jumping around trying to avoid each other. Eventually, the frog was deposited in the garden, but, the next morning, it was back in the pool of water. After the first attempt to transport it, I decided to leave well enough alone.

Gray Treefrogs are one of 13 frogs and toads found in Ontario, which live in a variety of habitats throughout the province. Frogs

A relatively tiny frog, the gray treefrog can change colour as its Latin name, Hyla versicolour, implies. are found worldwide, except for in the Antarctic, and over almost two million years, have adapted to a variety of environments. Their sensitivity to pollution and other changes in those environments make them important indicators of the health of our world.

The Latin name for the Gray Treefrog, Hyla versicolour, describes one of this species’ characteristics.

It has the ability to change colour from greenish-gray to gray-black, depending on the colour of the substrate they are sitting on and becoming darker when the air is cooler. Its skin is mottled, bumpy

Trails

A friend of mine invited me out for a run a few months ago… we hit the trails just outside Normandale and ran one called Dizzy Lizzy… for me it was a workout and I am sure I sweated off a few pounds… meanwhile my friend tackled the trail like a walk in the park. It seems my buddy not only ran the trails but also had been mountain biking them for well over a year. I was impressed with the sheer beauty of the area we were running in. The terrain provided lots of hills, turns, sand, roots and wildlife… but keep your focus on the trail… so you don’t end up… over teakettle, like me.

At that time my buddy mentioned how a club was forming and he himself was going to join.

Last Thursday night, I stopped out at the Normandale Fish Hatchery and met a number of members of the newly formed Turkey Point Mountain Bike Club (TPMBC), which is dedicated to the preservation, maintenance and development of mountain biking in the Turkey Point area.

With over 40km of challenging trails with names like, Bluffs, Fin and Feather, Ridge and Hump Back… it is easy to see how these bikers are anxious to challenge their skills… trust me, from the few trials I ran, these riders are working up a good sweat every time out.

A lot of the credit for developing the trails goes to Kevin Saunders who over the years has created some very unique runs.

Jeff Howe, President of the club, gave me a quick overview of how the club came to be… He told me that folks had been riding the trails for the past twenty years... that now was the right time to organize it, for local riders to get to know one another and for the group to work with the local land mangers (Long Point Region Conservation Authority, Provincial Parks and Saint Williams Nature Preserve in future trail development).

The club has rapidly grown to close to fifty members with the age range going from teenagers up to the wile veterans who are in their 50’s… don’t let the old guys fool you… they have been riding for years and can still crank it up!

Another great thing the club does, is have two groups on its rides… one for the elite riders and one for beginners. The beginner group is a great way to get started and slowly build towards your goals… the beginner group also has a seasoned veteran rider with it to assist the group.

Well it was time to let Jeff ride, I thanked him for his time and watched as the riders headed out onto the trails for another adventure.

TPMBC gets together once a week (Thursdays) to tackle the trails. If you would like to join or want more information check out the website www.tpmbc.ca and to all the riders, “Happy Trails!”

Watching the cyclists wind their way through the village of Port Ryerse on Saturday was very cool to see… well the cyclists looked tired but their multiple coloured jerseys were a parade all in itself. It appeared young and old alike were taking part in the 5th annual Tour de Norfolk.

I decided to stop at one of the cyclist rest stops just at the corner of Radical Road and Port Ryerse Road to grab a few pictures. It was there I met volunteer Paul Krupicz who filled me in on the day’s travel of the Tour.

The Saturday run consisted of 4 different distances all starting at the Delhi arena and ending there.

There was a 40k, 75k, 100k and the biggie 160k ride. Paul figured there

were most likely a few more riders then last year, which saw over 500 cyclists take part.

The rest area was much needed as the temperature soared and the sun beat down on the cyclists.

Everyone I talked to said they loved the Tour. Brian Baxter from Burlington said this is his 4th year coming and he really enjoys it. Another rider from Cambridge said it was his first year and he thought the Tour was excellent.

The 160k ride on Saturday took the cyclists in and out of the communities Norfolk has to offer.

dogs, strawberry ice cream and strawberry lemonade. Also, strawberry face -paintings and tractor rides! The tractor rides took you to the dairy farm where you got to see where the Jersey

dairy cows were milked and also see the calves.

Everything was for an optional donation and we raised $87.76 for calf club! It was a beautiful day and everyone had lots of fun.

You Tough Enough?

Swimmer/Runner Profile

By Dave Scott In the next month we hope to profile the swimmers taking part in the fundraiser, Are You Tough Enough?

This group of folks are currently training to swim 10km from Pottahawk to Turkey Point on September 4th to raise funds for Camp Trillium.

This past Sunday the group swam close to 6km off the beach in Port Dover and afterwards I caught up with a couple of ladies who have been training hard and asked them how things were going.

Kristen Thompson Kristen Thompson moved into Norfolk two and half years ago and started running off and on with the Runners Den group. It was an opportunity to meet folks in the area. She enjoyed running and when she heard about the swim group she thought that would be fun… so she hit the pool with Scot Brockbank from Runners Den. Over the winter she worked on her stroke and became intrigued by the Pottahawk to Turkey Point swim… she always swam… perhaps this was a challenge she could take on… for Kristen the seed was planted…

(Oh, did you know that Kristen has a pretty cool job as well? She helps restore agriculture land back to its natural, native state… get it… the seed was planted).

Anyway in May, Kristen hit the open water and battled seasickness and the cold… she persevered and a few weeks back, after completing a 4km swim and with the encouragement of Scot… she decided to go for it and take part in Are You Tough Enough? Her confidence has grown to the point that she knows she can do the swim… and laughs, saying that it’s the 10km run at the end of the swim makes her nervous.

Kristen says that cancer has been prevalent in her family and wants to do her part to help raise funds for Camp Trillium… and help the kids.

As we wrapped up our interview, Kristen said a comment that explained a lot about her, it was simple but true for all of us… she said, “I am the only person to stop myself…”

Sixteen months ago, Nancy gave birth to her second child Ellsa. At the time, she wanted to get back in shape, so she started walking and soon found herself signing up for the Learn to Run program at the Runners Den. Since that time, she has completed a 10k, a half marathon and a marathon… WOW! Now she has turned her sights on the 10km swim… she swam back in high school and has always enjoyed it. When the opportunity came to train for Are You Tough Enough?... she knew she wanted to do it.

For Nancy the tough part is fitting everything into her schedule with work and her two children (four year old Iyla and as I mentioned earlier, sixteen month Ellsa). Her kids are her world and finding that balance in her life is also what keeps everything moving in the positive direction. The swim and run provide Nancy with her own identity, a healthy lifestyle and an opportunity to challenge herself.

Nancy lost her grandpa to cancer last year. She knows the wrath that the disease can cause. With her background in the education field she understands the importance of raising funds for Camp Trillium and helping children who are facing

challenges far greater than any swim or run that any of us could ever do. Nancy wants her daughters to see and understand the importance of being a positive role model… she credits Scot for always being positive and encouraging her... to run and swim.

Nancy has the confidence to succeed and the drive to help in the community. She knows herself… when you chat with her you get the feeling that she will accomplish whatever she decides to do. For her, the swim is just something she has to do!

It was awesome to talk to these two ladies and have a better understanding of just what drives them… they are setting an example for women all over our community… their strength is their drive to help others and obtain goals. and toad-like and is often referred to as a tree toad. The inner thigh is bright orange or yellow, which is intended to frighten away predators when the Gray Treefrog jumps away from danger. As the name suggests, these frogs spend much of their time in trees or other tall vegetation, descending to the ground only to mate and spawn.

The Gray Treefrog is a relatively tiny frog, only 3 to 6 cm in length.

The long limbs and toes of these frogs result in a superior grasping ability and the large toe discs at the end of each toe aid the frog in climbing up any surface including glass. (I’m not sure how effective it would have been climbing up my leg as both of us were too startled

to find out!)

Treefrogs breed in marshes and other still water in the spring and lay their eggs late in the spring and early summer. After breeding in the spring, the adults move away from the water and into nearby trees. Tadpoles, which have brick red tails, hatch and mature quickly and have usually transformed into the adult stage by late August or early September. Gray Treefrogs hibernate under leaf litter, logs or rocks and survive freezing by increasing the amount of glucose in their organs. While the small amount of water that remains in the frog’s body does freeze, the glucose does not.
