THIS MATTER having been brought before the Court by way of Frank L. Corrado, Esq. on behalf of Plaintiffs and Brian M. Hak, Esq. and Michael J. Perugini, Esq., on behalf of Defendant; and the Court having considered the moving papers; and the Court having considered oral argument; and the Court having determined to enter this Order; and for good cause shown; and for the reasons set forth in this Court’s sixteen (16) page Memorandum of Decision issued on this same date; IT IS ON THIS 2nd of DECEMBER, 2021, ORDERED AND ADJUDGED AS FOLLOWS: 1. The City of Atlantic City is preliminary enjoined and restrained from enforcing Ordinance No. 32 of 2021, or taking any action to hinder or obstruct the operation of Plaintiff’s syringe access program at 32 Tennessee Avenue, Atlantic City, New Jersey or at any other location in Atlantic City pending the outcome of this litigation; 2. A copy of this Order shall be served upon the Defendant within seven (7) days.
