General Information & Sale Notes
LOCATION - The Sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6.
METHOD OF SALE – All sheep will be sold in guineas and in catalogue order unless any alteration is announced by the Auctioneers. A commission of 5.5% will be charged on all sheep sold, a further 1% levy will be charged and paid to the Zwartbles Sheep Association.
CONDITIONS OF SALE - The Sale is held subject to the LAA Conditions of Sale in addition to the Auctioneers General Conditions of Sale and the Rules and Regulations of the Zwartbles Sheep Association.
RESERVE PRICES – Vendors shall have the right to refuse to accept the final bid for their animals. Any animal in the Sale Premises which are sold by private treaty after the Auction are subject to the full commission on the price realised and all such transactions must be passed through the Auctioneers.
UPSET PRICE – Ewes and shearling gimmers 150gns and ewe lambs 120gns.
MAEDI VISNA - All sheep from Maedi Visna Accredited flocks will only be accepted into the market and penned for sale if they are accompanied by an official ministry Certificate of official MV status which has been correctly completed. Please note – a representative will be on duty to collect and inspect all Maedi Visna certificates. All sheep must have ear tags to comply with current ministry regulations.
INSPECTION PROCEDURE - All sheep must be presented for inspection. Any sheep that fails inspection will be marked and may be sold in catalogue order, the reason for failing will be given out by the auctioneers in the ring. If the vendor refuses to have the rejected sheep marked then it will be removed from the sale and forfeit the entry fee. All sheep must be marked with their lot number or ticket prior to inspection. Unmarked sheep will not be inspected. The Association expressly forbids the use of OP dips or other noxious substances within the sale area or prior to the sale. Any sheep which is found to have had its fleece coloured artificially, will result in the whole of that vendors run of sheep being barred from that sale, as well as any other disciplinary action Council renders fit upon report by the inspectors. The person responsible for the sheep or vendor should be present. Any sheep that fails inspection will have a red Lot number.
INSPECTION - For all official sales the Association shall appoint inspectors who will consider the points below and are empowered either to disbar the animal from the sale or alternatively any faults found by the inspectors shall be declared by the auctioneer, who shall announce these at the time of sale. The inspectors decision shall be final and binding to all concerned and neither the inspectors, the Association, nor the auctioneers shall be liable to the owners of such animals or any other person or company for damage or any loss arising out of such rejection.
- The lot number must correspond with the ear number as entered for sale. Animals without the correct identification will be rejected from the sale.
- The animal is not suffering from any infectious or contagious disease.
- Ewes shall be sound in udder.
- The animal is of a quality commensurate with that set by the association and is of adequate weight for the age and shows no malformation of structure.
- The teeth of the animal shall be on the plate and in the correct position. Account will be taken of the age of the animal , however all lambs must have correct mouths.
- There is no abnormal deviation in the structure of the feet and/or legs.

SETTLEMENT AND CLEARANCE OF STOCK - Settlement in full is due immediately at the close of Sale. No animal may leave the Sale Premises without an official ‘Pass Slip’, obtainable only from the Auctioneers upon settlement.
PEDIGREE CERTIFICATES – Pedigree certificates and transfers will be dealt with by the Auctioneers and Association following the sale.
NUMBERING – All entries must be identified by their catalogue number by means of a neck card which will be provided. This must stay with the sheep at all times.
SCRAPIE GENOTYPE RESULTS – This catalogue lists Genotype results where official written confirmation has ben provided.
Whilst the Society will make all possible effort to provide purchasers with the correct information, they can in no way be held responsible for any error or omission of information.
SUBSTITUTES – Substitute entries must be notified to the Breed Secretary no later than 7 days before the sale.
GUIDANCE TO BUYERS – Each animal has a unique number which includes a year letter as follows:
2020 - H. 2021 - J. 2022 - K. 2023 - L, 2024 - M, 2025 - N
EXPORT TO NORTHERN IRELAND: As of 1 January 2021, the rules for exporting sheep from the United Kingdom to Nothern Ireland and the European Union have changed for moving breeding stock to Northern Ireland. No Direct Export or Vendor Returns will be available.
It will be the responsibility of the purchaser and/or the vendor to make any necessary arrangements for sheep going to Northern Ireland.

53 Female sheep not described as in lamb
53.1 Vendor’s warranty
The vendor warrants that a female sheep not described in the catalogue or at the time of sale as in lamb is not in lamb at the time of sale. This warranty is a 14 week +5 day warranty.
53.2 Purchaser’s rights
If the purchaser proves a breach of warranty then, at the purchaser’s option, either the purchaser may exercise his rights under Condition 66, or the vendor shall pay to the purchaser as liquidated damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a veterinary surgeon’s certificate or a slaughter-house manager’s or other competent person’s certificate confirming that that the sheep was in lamb.

54.1
Vendor’s warranty
The vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 day warranty.
54.2 Purchaser’s rights
If the purchaser proves a breach of warranty then, at the purchaser’s option, either the purchaser may exercise his rights under Condition 66, or the vendor shall pay to the purchaser as liquidated damages a sum equal to the amount in paragraph (i) of the Appendix. The vendor warrants that any female sheep sold as being in lamb is in lamb at the time of sale. This warranty is a 21 day warranty.
54.2 Purchaser’s rights
If the purchaser proves a breach of warranty he may exercise his rights under Condition 66. Notice of a claim must be supported by a veterinary surgeon’s certificate.
59 Stock Rams
59.1 Vendor’s Warranty
The vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of and effective at natural service. This warranty is a 10 week warranty.
59.2 Purchaser’s rights
If the purchaser proves a breach of warranty then the purchaser may return the ram to the vendor who shall, at the purchaser’s option, either replace the ram with another ram of equal value which is capable of and effective at natural service, or refund the purchase price together with such other costs and charges as the purchaser may be entitled to under these Conditions. Notice of a claim must be supported by a veterinary surgeon’s certificate confirming that:
(a) the ram’s incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and
(b) the purchaser’s breeding stock are not responsible for the ram’s incapacity or ineffectiveness.

Notice to all Visitors and Traders
Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving livestock pennage areas.
• Please observe our staff’s instructions at all times.
Our on site Biosecurity Officer will only be too pleased to give you assistance.

His show record includes 1st RHS 2024, Male Champion & Reserve Overall Champion at Northern Branch show 2024, and placed 2nd aged ram in the large flock Northern Branch flock competition. His breeding goes back to Craigies Dictator and Blacklee Black Diamond. Daughters retained.
Thirnbank Magpie was used lightly and produced strong, well marked lambs. He was shown successfully and won the ram lamb class in the Northern Flock competition.

Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge.
Children must not be permitted in any area where they may be at risk from livestock or machinery.
In the case of bulls, during the period when the show/ sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns.
Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.
Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.
The auction ring man escapes and refuges must be kept clear at all times.
All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
AUCTIONEER’S TERMS & CONDITIONS OF SALE
(Incorporating the Auctioneer’s Terms and Conditions )
1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.
2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.
3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.
4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.
5. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.
6. All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.
7. Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.
8. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.
9. Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.
10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.
