All vehicles transporting livestock will be subject to a documentation check before entry to market site.

All visitors and traders must ensure they wear clean clothing and footwear before entering market site.

All visitors and traders using car park areas please use main entrance.

Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.

Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
No livestock will be allowed to remain on the premises after a sale.

Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.

SPECIAL RULES FOR BUYERS TO COVER COVID-19 REGULATIONS This information is correct at the time of printing and is subject to changes in Government Guidelines or Directives regarding the control of the spread of COVID-19 • Potential purchasers MUST REGISTER with Harrison & Hetherington Ltd prior to the sale and again upon entry to the market Tel: 01228 406200 or email: info@borderway.com • Please remember that purchaser spaces will be limited, so only ONE person per business will be allowed entry • No children under 16 years old will be able to attend the sales and this must be strictly adhered to as entry will be refused • Pregnant ladies must not attend the sale • 2m social distancing must be maintained at ALL times • Viewing will be regulated by a one way system throughout the mart and is to be permitted for registered buyers only. Please refer to individual sales for the respective Viewing dates and times • Face coverings are mandatory for all persons entering the mart. These must be worn without exception while in the market including the sales rings and pens • To facilitate the Test and Trace system, all buyers will be required to sign into the market. This process will include a declaration that they have not been in contact with anyone displaying symptoms of COVID-19, nor are displaying symptoms personally • Hand sanitiser stations will be available throughout the mart, however, it is strongly recommended that both consignors and buyers have an adequate personal supply and to use it regularly • Please follow instructions from market staff and security staff. A private security firm will be in attendance to assist H&H in ensuring social distance is maintained at all times • Strictly no private videoing/broadcasting on Social media, or phones etc in the pens or ring • If you are unable or do not wish to attend the mart, but would like to bid on animal(s), then the auctioneers will faithfully execute commission bids for buyers. CONDITIONS OF SALE 1. All stock is sold subject to the Conditions of Sale, dated 1984, recommended for use at Markets by the Scottish Institute of Auctioneers’ Pay Office. Every vendor, bidder and purchaser shall be deemed to have full knowledge of these conditions and agree to be bound by them. These conditions shall apply to the sale of any pedigree stock save in so far as they conflict with any Special Conditions expressly applicable to the sale of such stock, when the latter Conditions shall prevail. 2. All lots are accepted for sale on the terms that the vendor warrants his right to sell the same and undertakes to indemnify the auctioneers against all actions, proceedings, claims, demands, costs, charges and expenses to which they may be exposed or which they may incur by reason of any deflect in the vendor’s title. 3. The auctioneers act in all respects only as agents for the vendor and it shall be deemed than no condition or warranty expressed or implied has in any circumstances been given by the auctioneers or any servant of the auctioneers, whether as to title, description, the quality of any lot sold or otherwise. The auctioneers and their servants shall not incur any liability to the purchaser in respect of any defect of title, error of description or imperfection or in respect of any announcement or statement relating to or affecting any lot offered for sake whether made orally or in writing and whether given before, during or after the auction, nor shall they incur any liability in relation to any dispute between any purchaser and vendor. 4. All animals are at the risk of the vendor before sale and at the risk of the purchaser after the sale. 5. Neither the Vendor(s) nor the Auctioneers will be responsible for any accidents or injury to persons or property, through fire or any other cause whatsoever. 6. The auctioneers reserve the right to refuse to accept bids from a vendor and they reserve on behalf of themselves and of the vendor(s) the following rights: (a) to fix a reserve price (b) to bid on behalf of a vendor (c) to re-arrange, consolidate or withdraw any lots or vary the order of sale (d) without giving any reason therefore, to refuse to accept the bids of any person 7. The person making the highest accepted bid shall be the purchaser. 8. No bid shall be retracted. 9. If a dispute arises as to any bidding, then at the discretion of the auctioneers, either: (a) the lot to which the disputed bid relates shall immediately be put up again, or (b) the auctioneers shall determine the dispute and their decision shall be final and binding on all parties. 10. The purchaser shall, if and when required, give his name and address to the auctioneers, and shall if required, pay to the auctioneers the purchase money for each lot on the fall of the hammer, or so soon thereafter as the auctioneers may require. 11. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference 12. No lot shall be removed from the sale premises until a written delivery order has been given by or on behalf of the auctioneers. 13. Each lot shall, at the purchaser’s expense, be removed from the sale premises within a reasonable time after the close of the day’s sale.

(a) If a purchaser fails to comply with any of the preceding Conditions, the auctioneers may cause the lot in respect of which the failure is made to be re-sold by public or private sale without warranty or reserve and without notice to the purchaser. (b) If upon re-sale as aforesaid a lower price is obtained for any lot than was obtained on the first sale, the difference in price together with all cost and charges attending the re-sale, shall be a debt due from the purchaser in default at the first sale. 15. All other rules as stipulated in the “Conditions of Entry”. 16. All registered sheep entered and forward at any Sale must be inspected to ensure their ear tag numbers tally with the catalogue and that they comply with the Society’s breed standard. Shearlings showing more than two broad teeth can be put forward for sale. Should there be any slight faults with older sheep that the Inspectors wish to pass, the vendor will be informed and the Auctioneer will announce the fault before the sheep is sold. Should the vendor refuse permission for this announcement, the sheep will fail its inspection. The Inspectors’ decision will be final. Any sheep that fails the inspection referred to in 6 above shall be excluded from the Official Sale and will be identified with RED TAPE around its right-hand horn. The vendor will have the opportunity to transfer such entry to the Commercial Sale which will take place following the Official Jacob Breed Sale. REGISTRATION FORMS MUST BE AVAILABLE FOR INSPECTION WITH THE ANIMAL PRIOR TO BEING HANDED TO MARKET. SHEEP WILL NOT BE ACCEPTED UNLESS ACCOMPANIED BY THEIR CERTIFICATE TSC ANOTES THAT AN ANIMAL HAS BEEN TESTED CLEAR OF TAY-SACHS. TAY-SACHS - The Jacob Sheep Society runs a scheme whereby sheep are voluntarily tested for a TaySachs marker gene by LGC Laboratories. Animals which have been DNA tested as Tay Sachs clear, have (TSC) added to their registration numbers. Animals with two (TSC) parents have the annotation (~) added to their registration numbers, indicating that they are ‘bred Tay Sachs Clear.

COMMISSION: The auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instruction. SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of the sale. No animal may leave the sale premises without an official ‘pass slip’ obtainable only from the auctioneers upon settlement.
