Notice to all Visitors and Traders
Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving pennage areas.
• Please observe our staff’s instructions at all times.
Our on site Biosecurity Officer, will only be too pleased to give you assistance.
LOCATION: This sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave the M6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4 mile of M6.

CONDITIONS OF SALE: Sold under the respective Breed Societies conditions of Sale and the Livestock Auctioneers Terms & Conditions of Sale.
PRE-SALE INSPECTION: All sheep forward for the sale will be subject to a Society and Veterinary Inspection. Any animal which does not reach the Inspection standard will not be eligible for sale. The Inspection decision will be final and any animal failed will be removed from the sale and forfeit the entry fee.
METHOD OF SALE: All sheep will be sold in guineas (105 pence) and strictly in catalogue order, unless any alteration is announced by the Auctioneers.
COMMISSIONS: The auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions.
INSURANCE: A representative of Auctioneers Insurance Brokers will be present at the sale and will be pleased to quote purchasers for transit and other risks.
SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of sale. No animal may leave the sale premises without an offical ‘pass slip’ obtainable only from the Auctioneers upon settlement.

1. Entry is open to MV Accredited Sheep only.
2. Commission will be deducted at a rate of 5.5% on all sheep sold.
3. A Society Levy of 1% will be deducted from the vendor’s account and paid to the Badger Face Texel Sheep Society
4. All sheep will be sold under the Conditions of Sale of the Livestock Auctioneers Association.
5. Transfer Fee- A fee of £5 will be charged to the purchaser is they wish to transfer their purchase to their flock.
6. All sheep to be fully registered with the Badger Face Texel Society . All sheep must have official ear tattoos or tags and also be tagged in accordance with the relevant DEFRA regulations. The Vendor shall be responsible for the correctness of identity.
7. Upset Price An upset price of 300gns is set for all sheep, ie, if no opening bid is received asforementioned, that lot will be passed out of the ring unsold.
8. Pre Sale Inspection- All sheep forward for sale will be subject to a Society inspection. Any animal which does not reach the inspection standard will not be eligible for sale. The inspection decision will be final and any animal failing, must be removed immediately from the sale and forfeit the entry fee. No appeal is permitted.
NUMBERING: ALL SHEEP MUST BE BACK STAMPED.
9. Substitutes – Details of Substitutes must be submitted to the Society Secretary 48 hours prior to sale.
10. The Badger Face Texel Sheep Society Sub-Register allows females registered with the Beltex, Blue Texel & Texel (inc Dutch Texels) Society’s to be used for Badger Face Breeding. All females entered into the Badger Face Sub-Register can only be bred with a Badger Face Ram. These animals entered in the SubRegister are not guaranteed to breed Badger Face Texel Sheep. If resulting offspring are correctly marked with Badger Face Markings they can enter the main registry or female offspring retained in the sub registry to be used for future breeding.

CONDITIONS OF SALE: The show and sale will be held subject to the Rules and Regulations of the Blue Texel Sheep Society, the Conditions of Sale as recommended by the LAA and the Auctioneers Standard Conditions of Sale. Customers should acquaint themselves with points 3.1 and 3.2 relating to ram warranties. (see page 7)

All sheep must have ear tags to comply with current ministry regulations. The vendor shall be responsible for all faults. The buyer has one hour after the end of the sale to complain.

1. All Pedigree Sheep to be sold in guineas.
2. Commission will be deducted at the rate of 5.5% on all pedigree sheep sold, together with a 2% Society Levy.
3. Any animals in the Sale Premises which are sold by private treaty after the Auction are subject to the full commission on the price realised and all such transactions must be passed through the Auctioneers.
4. There will be an Upset Price as follows: all rams 150gns and all females 125gns.
5. All sheep will be identified with tags hung around their necks.
6. Sheep will only be accepted into the market and penned for sale if they are accompanied by an Official MV Status Certificate which has been correctly completed. This Certificate must be handed in when the animal/s arrive at the market.
7. All sheep will be subject to society inspection on Saturday 23rd September between 7.00am and 8.00am. Any sheep being found unfit will be withdrawn from the sale.
8. No sheep to be presented while suffering from any contagious disease. All sheep should be treated against scab.
9. The vendor shall be responsible for the correctness of identity, and all sheep must have official ear tattoos and ministry tags. Buyers shall have one hour following the end of the sale to lodge any faults or misrepresentations to the Auctioneers.
10. The purchaser must satisfy himself as to the soundness and correctness of his purchase within one hour of the conclusion of the sale.
11. All sheep must be forward for penning between the following times:Friday 26th SEPTEMBER between 1pm – 6pm Saturday 27th SEPTEMBER between 7am and 8am

12. Any 2 shear or older female offered for sale must have had lamb(s) registered with the Society during the previous two years, and must be correct in the udder.

14. All Roussin Lambs offered for sale are not to be faked in any way by carding combs, shears etc. except to tidy up cheeks, square tails. All sheep offered for sale at one year old or older to be bare clipped after 1st April, thereafter the same rules as lambs apply. No artificial colouring or staining of fleeces other than that contained in a Wool Board Approved Dip. Faces and legs may not be artificially coloured in any way. The use of hair removing substances is strictly forbidden.
15. All male sheep to have two correct testicles. No Rigs or Chasers to be shown or sold.
16. The vendors are responsible for taking their sheep to the sale ring and returning them to the pens after being offered for sale.
17. The Purchaser will not be entitled to a claim for consequential loss as a result of infertility or any other reason.

SCHEDULE 2 – SHEEP
36 Definitions
In this Schedule the words or expression:
“In Lamb” or “Due to Lamb” means any female sheep carrying a lamb but shall not imply that any lamb due will be born alive and, where the female sheep is stated to be In Lamb or Due to Lamb to a named ram the Vendor shall provide the Auctioneer with details of the ram, his ear tag number and any breed society registration number together with such, if any, further information that may be required of him, such information to be included in any catalogue for the sale and announced at the sale.
37 Female sheep
37.1 Vendor’s warranty
Each female sheep is warranted not to be In Lamb at the time of sale. This warranty is a 14 weeks and 5 Day Warranty.
37.2 Purchaser’s rights
If the Purchaser proves a breach of warranty the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price.
Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughter-house manager’s or other competent person’s certificate confirming the sheep to have been In Lamb for a period of at least 12 weeks on the day of sale.
38 Female sheep not described as In Lamb
38.1 Vendor’s warranty
The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty.
38.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughterhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb
39 Female sheep described as correct
39.1 Vendor’s warranty
The Vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty.
39.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.

41 Ewes with lambs at foot
41.1
Vendor’s warranty
The Vendor warrants that, unless stated to the contrary in any catalogue for the sale or at the time of sale, in a Lot in which the ewes are described as with lamb or with lambs at foot every ewe is suckling one or more lambs, and every lamb has a mother in the Lot. This warranty is a 5 Day Warranty.
41.2
Purchaser’s rights
If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6 in respect of any ewe which does not have a lamb or any motherless lamb.
42 Castrated sheep
42.1
Vendor’s warranty
The Vendor warrants that, unless stated to the contrary in any catalogue for sale or at the time of sale, any male sheep not expressly sold as rams: a) have been castrated; and b) have not been imperfectly castrated.
The warranty in Condition 42.1 (a) is an After Sale Warranty and the warranty in Condition 42.1 (b) is a 14 + 5 Day Warranty.
42.2
Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either he may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price of the sheep concerned. If other sheep had been sold in the Lot the compensation payment shall be calculated on the basis of the average price per head of all animals in the Lot.
43.1
Vendor’s warranty
The Vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of natural service. This warranty is a 10 Week Warranty.
43.2 Purchaser’s rights
If the Purchaser proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions. For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty.
Notice of a claim must be supported by a Veterinary Surgeon’s Certificate confirming that:
a) the ram’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and
b) the Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.
