Texel Sheep Society - Special Sale Rules 1 All Pedigree Sheep to be sold in guineas. 2 Commission will be deducted at the rate of 5.2% on all pedigree sheep sold, Also 1% Levy which will be equally divided between the club and the society. 3 An upset price has been set as follows – shearling gimmers and all rams 200gns and ewe lambs 150gns. 4.1 No dressing, trimming, clipping or excessive use of dips on the fleeces of sheep will be permitted. No artificial whitening on any part of the sheep is permitted. If an inspector is present at the sale they have the authority to disqualify any sheep, which in their opinion, are below a minimum standard with regard to breed type or are found to be contravening the Society Byelaws right up to the point of sale. Sheep failing the wool inspection will not be permitted to be registered until 1st November in the following year, nor will any resulting progeny from them be permitted to be birth notified in the following year. Members are reminded it is against the Auctioneers rules and regulations and the Society Byelaws for ANY ejected sheep to then be sold on the Auctioneers premises. The decision of the inspector shall be final and failure to accept the inspector's decision will result in the entire consignment being rejected. 4.2 Adult sheep entered must be bare clipped after 1st April each year. 5 All sheep to be sold singly. 6 All sheep will be identified with tags hung round their necks. 7 All sheep to be from Maedi Accredited Flocks only. 8 Sheep will only be accepted into the market and penned for sale, if they are accompanied by a Ministry Certificate of Official MV Status which has been correctly completed. This certificate must be handed in when the animal/s arrive at the market. 9 All sheep will be subject to a Veterinary Inspection. Any animal which does not reach the Veterinary Inspection standard will not be eligible for sale. This rule will include sheep with Orf. All animals will be inspected by the Club’s Veterinary surgeon prior to the sale. TEETH - The front edge of all incisor teeth must make contact with the dental pad. Any animals with undershot or overshot jaws will be rejected. UDDERS - All udders will be inspected on female sheep, any signs of active mastitis will be rejected. All females must be correct in the udder. LEGS - All Sheep forward will be subjected to a leg inspection, which will form an integral part of the PreSale Inspection procedure. LAMENESS - Any lame sheep will be rejected regardless of the reason. GENERAL HEALTH - Animals with any active infection including orf will be rejected. Minor injuries may be allowed at the discretion of the veterinary surgeon and an announcement will be made at the time of the sale. The decision of the veterinary surgeon appointed by the Society will be final. 10 IDENTIFICATION: Tagging – all sheep must be double tagged with official Texel Sheep Society tags which comply with Government legislation. The vendor shall be responsible for the correctness of identity. Any tags which are tampered with, hand written/bear marks, are faulty or illegible will be rejected form the sale.

7 11 All sheep to be guaranteed for fertility for which the vendor accepts responsibility. Any complaint must be intimated to Auctioneers no later than 3 calendar months from date of sale and accompanied by a VS Certificate. Auctioneers to arbitrate in all disputes. The decision of the Arbitrator shall be final. 12 The purchaser shall have no rights to claim damages from the vendor, in respect of indirect or consequential loss such as (but not limited to) loss of profit or any other loss whatsoever. 13 All sheep must be forward for penning and inspection between the following times: 7Friday 27th September – 3pm - 6.00pm Saturday 28th September – 7.00am – 9.00am

NO SHEEP WILL BE ACCEPTED AFTER THIS TIME 14 Entry fees are non-returnable. 15 Vendors are responsible for taking their sheep to the Sale Ring and returning them back to the pens, after being offered for sale. 16 Prize Rosettes won at the pre-sale judging are the only rosettes to be displayed in the sale pens, all other rosettes are not permitted. 17 Prize Money will be withheld on animals that are unsold. PLEASE NOTE - The Pedigree of all sheep entered in this catalogue has been accepted by the British Texel Sheep Society as birth notification or registration of Pedigrees. ALL EXHIBITORS PLEASE NOTE - Tattoo’s that do not correspond to the catalogue and sheep that are not properly tagged accordingly will be debarred from the sale. 18 Substitute entries will be permitted with one entry per section. All substitutes must be identified by a red dot in the middle of their back and all entries to be notified to the pedigree office no later than Wednesday 25th September. 19. The categories of sheep offered for sale will be as defined on the entry form. 20. If any animal offered for sale has semen or embryos collected from it, or used as a sire, the vendor must declare this on the sales entry form and is solely responsible for checking the sales catalogue entry and reporting any omission to the club prior to the inspection taking place. Failure to do so will exclude the sheep from the sale. 21. The Texel Sheep Society reserves the right to blood ample and/or archive DNA from any sheep and/ or take wool samples for forensic testing. 22. All vendors must sign the declaration. Agreeing to abide by the Society’s conditions or entry and conditions of sale, on the entry form. 23. All female sheep must be fully registered and male sheep to be fully registered or birth notified and thereby eligible for full registration with The Texel Sheep Society. 24 All sheep entries must clearly show whether the animal is single, twin, triplet, quad ETC or ET and this information to be clearly shown in the sale catalogue. 25 Errors and Omissions: The Auctioneers can accept no responsibility for any errors or omissions printed in this catalogue.

CONDITIONS OF SALE

All sheep are sold under the Conditions of Sale as displayed in the market recommended for use by the Livestock Auctioneers’ Association Ltd SCHEDULE 2 – SHEEP 36

Definitions In this Schedule the words or expression: “In Lamb” or “Due to Lamb” means any female sheep carrying a lamb but shall not imply that any lamb due will be born alive and, where the female sheep is stated to be In Lamb or Due to Lamb to a named ram the Vendor shall provide the Auctioneer with details of the ram, his ear tag number and any breed society registration number together with such, if any, further information that may be required of him, such information to be included in any catalogue for the sale and announced at the sale.

37 Female sheep 37.1 Vendor’s warranty Each female sheep is warranted not to be In Lamb at the time of sale. This warranty is a 14 weeks and 5 Day Warranty. 37.2 Purchaser’s rights If the Purchaser proves a breach of warranty the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughter-house manager’s or other competent person’s certificate confirming the sheep to have been In Lamb for a period of at least 12 weeks on the day of sale. 38 Female sheep not described as In Lamb 38.1 Vendor’s warranty The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty. 38.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughterhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb 39 Female sheep described as correct 39.1 Vendor’s warranty The Vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty. 39.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.

40 Female sheep proving barren 9 40.1 Vendor’s warranty The Vendor warrants that any female sheep sold as being In Lamb is In Lamb at the time of sale. This warranty is a 21 Day Warranty. 40.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate. 41 Ewes with lambs at foot 41.1 Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for the sale or at the time of sale, in a Lot in which the ewes are described as with lamb or with lambs at foot every ewe is suckling one or more lambs, and every lamb has a mother in the Lot. This warranty is a 5 Day Warranty. 41.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6 in respect of any ewe which does not have a lamb or any motherless lamb. 42 Castrated sheep 42.1 Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for sale or at the time of sale, any male sheep not expressly sold as rams: a) have been castrated; and b) have not been imperfectly castrated. The warranty in Condition 42.1 (a) is an After Sale Warranty and the warranty in Condition 42.1 (b) is a 14 + 5 Day Warranty. 42.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either he may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price of the sheep concerned. If other sheep had been sold in the Lot the compensation payment shall be calculated on the basis of the average price per head of all animals in the Lot. 43 Stock rams 43.1 Vendor’s warranty The Vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of natural service. This warranty is a 10 Week Warranty. 43.2 Purchaser’s rights If the Purchaser proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions. For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate confirming that: a) the ram’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and b) the Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.

From 1st April 2019 the Texel Sheep Society has been providing performance recording services directly to our membership. AHDB-Signet introduced the new National Terminal Sire (NTS) Evaluation this year for all terminal sires breeds within the UK. The Society has agreed to support this new evaluation by providing Pedigree Texel data and so NTS forms the base evaluation for British Texel flocks. When looking at rams EBVs in the catalogue this year please remember that the introduction of the new evaluation has caused some changes to the indexes and figures from what they have been previously. •

The Terminal Sire Index and Traits have now been rebased EBVs and indexes have been rebased to the average Texel animal in 2010. You will find that all animals index will have ‘fallen’ in number. With Top 10% animals having an index of 210 compared with the 361 it was before the change. Meat traits are now based on a fixed weight rather than age Animals now have their muscle/fat EBVs predicted for a fixed carcass weight rather than at a fixed age.

When buying a ram, buyers should use the breed benchmark to identify where an animals Estimated Breeding Values (EBVs) rank within the breed. The aim of EBVs are to allow buyers to see how much of an animal’s performance is due to its breeding (genetics) and how much has been influenced by the environment that they have been kept in – management, feeding, farm location, housing etc An animal will pass on half of its genetic merit to its offspring. eg, if Ram A has a Scan Weight of +3.33 then his progeny at scanning will be over 1.5kg heavier than average
