Notice to all Visitors and Traders Please read and observe the following: • Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival. • All vehicles transporting livestock will be subject to a documentation check before entry to market site. • All visitors and traders must ensure they wear clean clothing and footwear before entering market site. • All visitors and traders using car park areas please use main entrance. • All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office. • Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading. • Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office. • No livestock will be allowed to remain on the premises after a sale. • Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock. • Wash hands thoroughly when leaving livestock pennage areas. • Please observe our staff’s instructions at all times.

CONDITIONS OF SALE All sheep are sold under the Conditions of Sale as displayed in the market recommended for use by the Livestock Auctioneers’ Association Ltd SCHEDULE 2 – SHEEP 36

Definitions In this Schedule the words or expression: “In Lamb” or “Due to Lamb” means any female sheep carrying a lamb but shall not imply that any lamb due will be born alive and, where the female sheep is stated to be In Lamb or Due to Lamb to a named ram the Vendor shall provide the Auctioneer with details of the ram, his ear tag number and any breed society registration number together with such, if any, further information that may be required of him, such information to be included in any catalogue for the sale and announced at the sale.

Female sheep

37.1

Vendor’s warranty Each female sheep is warranted not to be In Lamb at the time of sale. This warranty is a 14 weeks and 5 Day Warranty.

37.2

Purchaser’s rights If the Purchaser proves a breach of warranty the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughter-house manager’s or other competent person’s certificate confirming the sheep to have been In Lamb for a period of at least 12 weeks on the day of sale.

Female sheep not described as In Lamb

38.1 Vendor’s warranty The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty. 38.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughterhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb

Female sheep described as correct

39.1

Vendor’s warranty The Vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty.

39.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate. 40

Female sheep proving barren

40.1 Vendor’s warranty The Vendor warrants that any female sheep sold as being In Lamb is In Lamb at the time of sale. This warranty is a 21 Day Warranty. 40.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate. 41

Ewes with lambs at foot

41.1

Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for the sale or at the time of sale, in a Lot in which the ewes are described as with lamb or with lambs at foot every ewe is suckling one or more lambs, and every lamb has a mother in the Lot. This warranty is a 5 Day Warranty.

41.2 Purchaser’s rights If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6 in respect of any ewe which does not have a lamb or any motherless lamb. 42

Castrated sheep

42.1 Vendor’s warranty The Vendor warrants that, unless stated to the contrary in any catalogue for sale or at the time of sale, any male sheep not expressly sold as rams: a) have been castrated; and b) have not been imperfectly castrated. The warranty in Condition 42.1 (a) is an After Sale Warranty and the warranty in Condition 42.1 (b) is a 14 + 5 Day Warranty.

42.2 Purchaser’s rights If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either he may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price of the sheep concerned. If other sheep had been sold in the Lot the compensation payment shall be calculated on the basis of the average price per head of all animals in the Lot. 43

Stock rams

43.1 Vendor’s warranty The Vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of natural service. This warranty is a 10 Week Warranty. 43.2 Purchaser’s rights If the Purchaser proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions. For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty. Notice of a claim must be supported Certificate confirming that:

a) the ram’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and b) the Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.

Rouge Society Special Sale Rules TIMETABLE OF EVENTS: Thursday 13th August Friday 14th August

All sheep will be sold under the conditions of sale of the Livestock Auctioneers Association. The sale is governed by the rules and constitution of the British Rouge Sheep Society. These are available on the Society website and in the back of the yearbook.

All Pedigree Sheep to be sold in guineas.

There will be an ‘Upset Price’ as follows - shearling and older rams and females 300gns, lamb rams 250gns, ewe lambs 200gns.

Commission will be deducted at the rate of 5.5% on all pedigree sheep sold.

Any animal in the Sale Premises which are sold by private treaty after the Auction are subject to the full commission on the price realised and all such transactions must be passed through the Auctioneers.

Transfer of registrations will be dealt with by the Society.

All sheep will be identified with tags hung around their necks.

Sheep will only be accepted into the market and penned for sale if they are accompanied by an official Certificate of Official Status which has been correctly completed. This Certificate must be handed in when the animal/s arrive at the market.

All sheep of all ages will be inspected and may be rejected from the sale for any of the reasons listed in the inspection points, or for infringing rules on presentation. Shearlings found to have four adult teeth shall be marked with a yellow dot on shoulder, and this shall be announced by Auctioneer at time of sale. If a sheep fails inspection the owner has the option to pay £20 for an appeal. This will be subject to the Chairperson, the appeal panel (as per society) decision will be final. Any rejected sheep must be removed from the sale premises.

No sheep to be presented while suffering from any contagious disease.

10 The vendor shall be responsible for the correctness of identity, and all sheep must have official ear tattoos or tags and also be tagged in accordance with the relevant ministry regulations. Buyers shall have one hour following the end of the sale to lodge any faults or misrepresentations to the Auctioneers. 11 The purchaser must satisfy himself as to the soundness and correctness of his purchase within one hour of the conclusion of the sale. 12 Please note - A representative will be on duty to collect and inspect all Maedi Visna Certificates. 13 Any 2 Shear or older male offered for sale must have progeny registered with the society during the previous two years 14 All sheep to be sold in the appropriate class and in the owner's flock group. 15 The Classes will be: i) Shearling Rams; ii) Ram Lambs; iii) Shearling Gimmers; iv) Ewe Lambs 16 Sheep represented at Sales at one year old or older must be shorn bare after the 1st

January and before being presented at their first show of the current season. Rouge lambs are not to be faked in any way by carding comb, shears, etc., except to tidy up head, throat and chest, square tails and take long ends off under the belly and around the legs. NO OTHER PART OF THE LAMB MAY BE TOUCHED. Hair on faces and legs may be removed and the faces and legs may be washed and or lightly dressed with colourless oil, but may not be artificially coloured in any way. The use of hair removing substances is strictly forbidden. 17 All male sheep to have two correct testicles. No Rigs or Chasers to be shown or sold. 18 No lambs to be born before 1st January. If born before this day they become shearling reaching the 1st January and must be tattoed with the appropriate letter. 19 One vendor is responsible for taking their sheep to the sale ring and returning them to the pens after being offered for sale. 20 The Purchaser will not be entitled to a claim for consequential loss as a result of infertility or any other reason. 21 Errors and Omissions. The Auctioneers CAN ACCEPT NO responsibility for any errors or omissions printed in this catalogue. 22 Substitute entries will be accepted at this sale, but all information must be with the auctioneers one week prior to the sale day. Substitutions will be restricted. 23 Export to Northern Ireland: As of 1 January 2021, the rules for exporting sheep from the United Kingdom to Northern Ireland and the European Union have changed for moving breeding stock to Northern Ireland – NO Direct Export or Vendor Returns will be available. It will be the responsibility of the purchaser and/or the vendor to make any necessary arrangements for sheep going to Northern Ireland. AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions ) 1.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.

All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.

If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.

The auction ring man escapes and refuges must be kept clear at all times.

We and other members of the group may contact you by telephone, e-mail, post or fax to inform you of products or services available. If you do not want to be contacted for marketing purposes or do not wish your information to be made available to any other parties please notify us in writing.

All visitors and traders on site will be responsible for ensuring that they and their employees or subcontractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc. All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington. Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations.

Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/ sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.

All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
