Notice to all Visitors and Traders
Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving livestock pennage areas.
• Please observe our staff’s instructions at all times.

METHOD OF SALE: All sheep will be sold in guineas (105 pence) and a commission of 5.5% will be charged by the Auctioneers on all sales. A society levy of 1% will be charge on all sheep sold.
CONDITIONS OF SALE: All sheep will be sold under the Conditions of Sale of the Livestock Auctioneers Association and the rules and regulations of Dutch Spotted Sheep UK.
Vendors Warranty – The vendor warrants that the sheep being sold as “having been flushed” are sold under the knowledge that there are no medical or physical reasons(s) why the sheep should not naturally get in lamb.
Purchasers Rights – If the purchaser proves a breach of warranty, then a claim must be supported by a veterinary surgeon’s report.

SCHEDULE 2 – SHEEP
36 Definitions
In this Schedule the words or expression: “In Lamb” or “Due to Lamb” means any female sheep carrying a lamb but shall not imply that any lamb due will be born alive and, where the female sheep is stated to be In Lamb or Due to Lamb to a named ram the Vendor shall provide the Auctioneer with details of the ram, his ear tag number and any breed society registration number together with such, if any, further information that may be required of him, such information to be included in any catalogue for the sale and announced at the sale.
37 Female sheep
37.1 Vendor’s warranty
Each female sheep is warranted not to be In Lamb at the time of sale. This warranty is a 14 weeks and 5 Day Warranty.
37.2 Purchaser’s rights
If the Purchaser proves a breach of warranty the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price.
Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughter-house manager’s or other competent person’s certificate confirming the sheep to have been In Lamb for a period of at least 12 weeks on the day of sale.
38 Female sheep not described as In Lamb
38.1 Vendor’s warranty
The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty.
38.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaughterhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb
39.1 Vendor’s warranty
The Vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty.
39.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.
40 Female sheep proving barren
40.1 Vendor’s warranty
The Vendor warrants that any female sheep sold as being In Lamb is In Lamb at the time of sale. This warranty is a 21 Day Warranty.
40.2 Purchaser’s rights
If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.
41 Ewes with lambs at foot
41.1 Vendor’s warranty
The Vendor warrants that, unless stated to the contrary in any catalogue for the sale or at the time of sale, in a Lot in which the ewes are described as with lamb or with lambs at foot every ewe is suckling one or more lambs, and every lamb has a mother in the Lot. This warranty is a 5 Day Warranty.
41.2 Purchaser’s rights
If the Purchaser proves a breach of warranty he may exercise his rights under Schedule 6 in respect of any ewe which does not have a lamb or any motherless lamb.
42 Castrated sheep
42.1 Vendor’s warranty
The Vendor warrants that, unless stated to the contrary in any catalogue for sale or at the time of sale, any male sheep not expressly sold as rams:
a) have been castrated; and b) have not been imperfectly castrated.
The warranty in Condition 42.1 (a) is an After Sale Warranty and the warranty in Condition 42.1 (b) is a 14 + 5 Day Warranty.
42.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either he may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to 33.33 per cent of the purchase price of the sheep concerned. If other sheep had been sold in the Lot the compensation payment shall be calculated on the basis of the average price per head of all animals in the Lot.
43 Stock rams
43.1 Vendor’s warranty
The Vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of the Appendix or more is capable of natural service. This warranty is a 10 Week Warranty.
43.2 Purchaser’s rights
If the Purchaser proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions.
For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty.
Notice of a claim must be supported by a Veterinary Surgeon’s Certificate confirming that:
a) the ram’s inability incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of the sale; and
b) the Purchaser’s breeding stock are not responsible for the ram’s inability incapacity or ineffectiveness.
Sale Conditions of Entry and General Information DSSS
1 ENTRIES – All animals entered must be fully registered and, on the Grassroots Database, with all fees paid at least 7 working days before the date of sale entry. Failing to do this will result in the animal being ineligible to be sold. All sheep must be tagged in accordance with the rules of Dutch Spotted Sheep Society and with the relevant DEFRA regulations. The vendor shall be responsible for the correctness of identity.
2 METHOD OF SALE – All sheep will be sold in guineas (105 pence) and in catalogue order unless alteration is announced by the auctioneer. A market commission at the mart’s rate will be charged on all sheep sold, plus a further 1% sales levy, which will be paid to the DSSS.
Graded animals will always be sold after all the purebred animals in MV and non MV sections.
3 CONDITIONS OF SALE – The sale is held subject to the Livestock Auctioneers Association Conditions of Sale and the Rules of the DSSS.
4 UPSET PRICE – The minimum upset price is set at 300gns (200gns for Graded females). Sheep unsold but passing inspection will be allowed into subsequent Society Sales but not on the same day.
5 MAEDI VISNA - All sheep from MV Accredited flocks will only be accepted into the market and penned for sale if they are accompanied by a current and correctly completed Maedi Visna Accreditation Scheme Certificate.
6 NUMBERING – All entries must be identified by their catalogue number by means of a neck tie or by numbers printed clearly on the animals back in paint and will be sold in catalogue order.
7 SUBSTITUTE ENTRIES – All substitute entries MUST BE NOTIFIED to the Registrations Secretary not less than 7 days before the sale. Substitute entries must be marked with a RED DOT ON THE SHOULDER. Substitutes are limited to 1 per vendor per section. Animals can only be substituted by another animal of same age and class. Animals not notified to the Registrations Secretary in the allotted time will be refused entry into the sale.
8 INSPECTIONS - All sheep will be subject to an official society veterinary inspection before the sale. Society representatives appointed by the society will assist with inspection administration. The inspector is empowered to disbar any animal which in his/her opinion does not meet the necessary standard. The decision of the inspector(s) will be final. Any animal failing inspection on structural or conformational criteria will not be allowed to be sold on the day of the sale, nor any other Society sale in the same year. Neither the Inspectors, the Society nor the Auctioneers will be liable to the owners of such animals or any other person or company for damage or any loss arising from rejection.
Sheep rejected from the sale must be marked with a YELLOW DOT ON THE LOIN and should be moved well away from the sale’s penning area and not further exhibited for sale; no advertising, promotion or sale of such a sheep is allowed on market premises.
Any sheep withdrawn from a sale, passing inspection and gone through the ring, but unsold will be allowed to enter subsequent Society sales but will have to be presented for inspection again.
Inspection Criteria
• Lot Number: The lot number must correspond with the number entered in the catalogue. Animals without the correct identification will be rejected from the sale.
• Disease: the animal is not suffering from any infectious disease.
• Mobility: sheep should be mobile and sound with no feet and/or leg structural issues.
• Teeth to be assessed whereby if any incisor teeth that are felt beyond the pad, as demonstrated by catching on fingers when running from the pad downwards, or when they are so far beyond the pad that they do not catch the finger, will be rejected.
• When males are being sold, testicles should be of even size, move freely and free from abnormalities. Ram lamb’s minimal scrotal circumference is 28cm and Shearling Rams minimal scrotal circumference is 33cm.
• When females are being sold, the udder should be correct and free from abnormalities.
• Note: Animals which do not meet animal welfare standards such as lame animals will be rejected from that sale, however are eligible to be entered for future sales in that year, provided they are inspected and pass inspection at that future sale.
• Important Note: Although the animals have undergone a veterinary inspection according to the DSSS inspection criteria, it remains the responsibility of the party or parties purchasing stock at society sales to ensure they are satisfied with the quality and standard of the animals before engaging with any purchase.
9 SHOWS AT SALES: A show will not be held at a society if there are fewer than 30 purebred animals entered.
Animals bred by the judge cannot be presented for judging.
10 SETTLEMENT AND CLEARING OF STOCK – Settlement in full is due immediately at the close of sale. No animal must leave the sale premises without an official “pass slip” obtainable only from the Auctioneers upon settlement.
11 EXPORT TO NORTHERN IRELAND – As of the 1st January 2021, the rules for exporting sheep from Great Britain to Northern Ireland and the European Union have changed. – No direct export or vendor returns will be available under current animal health rules. It will be the responsibility of the purchaser and/or vendor to make necessary arrangements for the sheep going to Northern Ireland. DISCLAIMER- the responsibility for export of sheep rests with either the purchaser or the vendor and not the Dutch Spotted Sheep Society or Auction Company accommodating the sale.
12 FLUSHED SHEEP – where females have been flushed, with or without, embryos being recovered before the sale must be declared in the catalogue and announced at the time of the sale. Failure to do so will result in the purchaser having the right to return the sheep – costs may occur.
13 SEMEN – rams being sold where semen is being retained, details must be disclosed at the time of sale.
14 FLOCK DISPERSAL – In prior agreement with the society, a full flock dispersal can take place on the same day as a Society sale, but not as part of the main sale and must be catalogued in a separate publication; There can be one dispersal sale only per flock and no further sheep can be registered for the flock once a dispersal sale has taken place.
Dispersal sheep will not be inspected, and will not be eligible for showing. If advertised alongside the society sale, then the levy fee applicable to the main sale will apply.

HEALTH AND SAFETY RULES
HARRISON & HETHERINGTON LIMITED NOTICE TO ALL VISITORS AND TRADERS
PLEASE READ AND OBSERVE THE FOLLOWING
All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc.
All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington.
Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations.
Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling.
When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.
Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge.
Children must not be permitted in any area where they may be at risk from livestock or machinery.
In the case of bulls, during the period when the show/ sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns.
Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.
Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.
The auction ring man escapes and refuges must be kept clear at all times.
All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
AUCTIONEER’S TERMS & CONDITIONS OF SALE
(Incorporating the Auctioneer’s Terms and Conditions as recommended by the NBA)
1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.
2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.
3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.
4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.
5. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.
6. All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.
7. Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.
8. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.
9. Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.
10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.
11. You have a right to know how we will use the information you have provided to us. We may share the information with other members of our group and may make this information available to relevant media groups and other interested parties on request. We and other members of the group may contact you by telephone, e-mail, post or fax to inform you of products or services available. If you do not want to be contacted for marketing purposes or do not wish your information to be made available to any other parties please notify us in writing.
