Notice to all Visitors and Traders Please read and observe the following: • Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival. • All vehicles transporting livestock will be subject to a documentation check before entry to market site. • All visitors and traders must ensure they wear clean clothing and footwear before entering market site. • All visitors and traders using car park areas please use main entrance. • All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office. • Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading. • Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office. • No livestock will be allowed to remain on the premises after a sale. • Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock. • Wash hands thoroughly when leaving livestock pennage areas. • Please observe our staff’s instructions at all times.

All pedigree sheep sold at official society sales to be sold in Guineas

Commissions will be charged at the rate of 5.25% on all pedigree sheep sold together with a 2% Society levy

The Auctioneers will pass from sale any animal not receiving bids to the value of 200 guineas.

All sheep will be identified with tags hung around their necks. Vendors are responsible for taking their sheep to the sale ring and returning them back to the pens after being offered for sale.

Sheep will only be accepted into the Market and penned for sale if they are accompanied by a current SAC Certificate of Official MV status, which has been correctly completed.

There will be no physical examination of individual sheep, but Council members retain the right to examine any animal that in their opinion fails to reach the recognised breed standard. The decision of the Council to carry out this inspection shall be final and binding and they shall be absolved from any liability for any action taken as a consequence of their decision. The Council members can only judge the sheep on the day of the sale and cannot be held responsible for the future development of the sheep.

The use of growth promoters is banned by the Society and they reserve the right to random test any sheep offered for show or sale. The vendor will be responsible for the correctness of identity and all sheep must have official ear tags. The Society reserve the right to scan any animal, provided two Society officers are present and a report submitted. Buyers shall have one hour following the end of the sale to lodge any faults or misrepresentations to the auctioneers.

Any female that has been subjected to abdominal surgery (laparoscopic AI, embryo transfer or Caesarean section) must be so declared in the catalogue and must physically capable of breeding again.

All rams to be warranted stock-getters and prove to be capable of natural service. If the ram is proved to be infertile or incapable of natural service, the purchaser has 14 weeks to submit to the Auction company a claim substantiated by a veterinary surgeon’s certificate. The V.S. certificate shall certify that the rams incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of sale. It shall also certify that the purchasers female breeding stock have been found, on examination, to be in normal breeding condition and that they are not responsible for the ram’s incapacity of ineffectiveness. The purchaser shall have the option of, either, a refund of the purchase price or, accept a replacement of similar quality. If the vendor so wishes he shall be entitled to have access to the ram for a veterinary examination. If a settlement is not reached then an independent arbiter shall be appointed by the Auctioneers and his decision shall be final. The transport costs, veterinary fees etc., involved in returning stock to the vendor must be borne by the purchaser. All male sheep to have two correct testicles. No rigs or chasers to be shown or sold. It must be declared if a vendor has retained semen from a ram before offering it for sale.

10. All sheep must be forward for penning at the times as laid out in the catalogue. Sheep arriving after these times will be disqualified from the sale. 11. Any animals in the sale premises which are sold by private treaty after the auction are subject to the full commission and levy on the price realised and all such transactions must be passed through the auctioneer. 12. The use of hair removing substances is strictly forbidden. Health & Safety guidelines should always be adhered to regarding the use of dips, which should only be used in accordance with the manufacturers instructions. 13. In dedicated Bleu Du Maine classes and sales, sheep should exhibit the breeds distinctive slate blue coloured head, without use of any artificial colouring. Only colourless oil is permitted. 14. No lambs to be born before 1st January. If born before this day they become shearlings on the 1st January and must be registered with the appropriate year letter 15. The purchaser is responsible for their purchases at the fall of the hammer. 16. Transfer Registrations will be dealt with by the Society 17. Substitute sheep will be allowed provided they are clearly identifiable and are shown in accordance with Society rules. 18. A sale can only be described as dispersal where every registered sheep belonging to that flock is offered for sale. Further, the flock name will be thereafter terminated and cannot be resurrected by the present holder or used by any other member or future member. However, the Council retains the right to grant re-use of the flock name on consideration of special circumstances. Reduction and dispersal sale sheep are to be sold at the end of the appropriate sections. A reduction sale may be inspected. 19 ERRORS OR OMISSIONS. Neither the Auctioneers or the Society can accept responsibility for any errors or omissions. 20. The vendor will be responsible for the correctness of the identity of all sheep.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.

We may share the information with other members of our group and may make this information available to relevant media groups and other interested parties on request. We and other members of the group may contact you by telephone, e-mail, post or fax to inform you of products or services available. If you do not want to be contacted for marketing purposes or do not wish your information to be made available to any other parties please notify us in writing.

All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc. All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington.

Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/ sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/ sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity. Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES. The auction ring man escapes and refuges must be kept clear at all times. All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
