Notice to all Visitors and Traders
Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving livestock pennage areas.
• Please observe our staff’s instructions at all times.

1. All Pedigree Sheep to be sold in guineas.
2. Commission will be deducted at the rate of 5.5% on all pedigree sheep sold. An ‘Upset’ price of 300gns is set, i.e. if no opening bid is received asforementioned, that Lot will be passed out of the ring unsold.
3. Any animals in the Sale Premises which are sold by private treaty after the Auction are subject to the full commission on the price realised and all such transactions must be passed through the Auctioneers.
4. All sheep will be identified with back-stamp Lot numbers.
5. Sheep will only be accepted into the market and penned for Sale if they are accompanied by an official ministry Certificate of Official MV Status which has been correctly completed. This Certificate must be handed in when the animal/s arrive at the market. Please Note - A representative will be on duty to collect and inspect all Maedi Visna Certificates.
6. No sheep to be presented while suffering from any contagious disease.
7. All tags must comply with UK legislation and Society rules on identification. The vendor shall be responsible for the correctness of identity.
8. Substitutes allowance per vendor at any sale is three shearling rams, and two per other section. These must be notified to the Society by the time specified on the entry form/catalogue. No substitutes will be allowed on the day. Any un-notified substitutes must be removed from the vendor’s pen as soon as possible and must not be offered for sale through the ring. All substitutes must be notified to the Society Office no later than 2.00pm Tuesday 11th August and notify the Beltex Society office by email: office@ beltex.co.uk
9. Scrapie genotyping is voluntary. All sheep catalogued with scrapie genotype must have valid certificates (whether NSP or Private test).
10. All sheep entered for Society sales must be inspected by a panel of inspectors appointed by the Society. The inspection decision will be final, and any animal will be identified by a purple shoulder and will need to be removed immediately from the market premises and forfeit the entry fee. Any consignor arriving late may incur a Vets fee for inspection.
11. The inclusion of any animal in the show and/or sale following any inspection is no warranty that the particular animal meets any criteria or criterion in respects of any standards or will do so in the future.
12. Sale Ring Rule – Any sheep which has not passed Society inspection must not be offered for sale, or advertised or promoted, in the ring. No animal to be sold outside of the ring before being entered in the sale ring.
13. Transfers – Any sheep to be sold at Society sales must be registered in the flock from which it is to be sold by 31st May in the year of sale.
14. Semen and Embryos - Any rams with semen retained before sale or females which have been flushed and embryos recovered before sale must be declared in the catalogue and announced at the time of sale. Failure to do so will result in the purchaser having the right to return the sheep. Costs may be incurred.
15 The purchaser must satisfy themselves as to the soundness, correctness misrepresentations of his purchase within one hour of the conclusion of sale to the Auctioneers.
16 The vendors are responsible for taking their sheep to the sale ring and returning them to the pens after being offered for sale.
17 Errors and Omissions. The Auctioneers CAN ACCEPT NO responsibility for any errors or omissions printed in this catalogue.
INSPECTIONS
The Carlisle Premier will be the first of five sales to include the presence of veterinary officers during pre-sale inspections to help improve the breed standard. The team of inspectors and vets will be looking for any testicle abnormalities, animals to be correct in the mouth and for good mobility. It is essential that the vendor is in the pen during inspections to hold the animal and allow for a more thorough inspection, with any issues discussed at the time.
1. Tags which do not comply with UK legislation and Society requirements will result in the sheep being rejected at inspection. All registered lambs must carry tags with the Society logo. Check that tags are correct at time of entry, so that replacement tags can be ordered before the sale.
2. All sheep forward must be back-stamped with the Lot number, failure to do so will result in rejection. It is the responsibility of the vendor or their agent to be present at inspection.
3. Rejected sheep which are to be penned with the rest of the consignment will be identified by a purple shoulder. It is a condition of entry that this rule is strictly adhered to. Vendors are advised to check their animals thoroughly prior to departure from home.
4. Inspection will include the following points:- Teeth and Testicles, Mobility Udder, Muscularity and any other points deemed necessary by Council as they see fit.
Inspection Standards
TEETH –To be inspected and assessed as correct.
MOBILITY – Sheep should be mobile and sound. Rams should be capable of natural service.
TESTICLES - Testicles should be of even size, free of abnormalities and move freely. Minimum testicle size – 27cm for ram lambs and 30 cm for shearling rams and aged rams. Testicles will be measured at the vet/inspector’s discretion.
DOUBLE MUSCLING – Sheep should display double-muscled gigots.
UDDER - Should be correct and free of abnormalities.
FLEECE – Should be tight. A medium fleece may be acceptable. Vendors must be in the pen during insection and hold the sheep for the veterinary officer. Any late inspections will incur a charge to the vendor to cover Vet fees.

IRISH INSPECTIONS
In light of new Brexit-imposed rules and regulations for exporting sheep from the UK to Northern Ireland, the Society is giving Irish exhibitors the opportunity to have their sheep inspected prior to travelling to the Lockerbie Premier Sale. These inspections will be carried out by the same veterinary officer and inspector as at the Premier Sale, and it is hoped this will reduce the number of sheep not being able to travel back across the water.
However, please note that sheep may still pick up testicular infections or go wrong in the mouth between the Irish inspections and Lockerbie Premier Sale, so it is vital buyers still carry out their own inspection of prospective purchases as the Society and Auctioneer accept no liability.
A full list of breeders whose sheep have been inspected in Ireland, and those who have not, will be included in the substitutes list on sale day.

Vendor’s warranty
The Vendor warrants that a female sheep not described in any catalogue for sale or at the time of sale as In Lamb is not In Lamb at the time of sale. This warranty is a 14 Week + 5 Day Warranty.
38.2
Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate or a slaugtherhouse manager’s or other competent person’s certificate confirming that the sheep was In Lamb

39.1
Vendor’s warranty
The Vendor warrants that all female sheep described in the catalogue or at the time of sale as correct are sound in mouth and udder, that is they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5 Day Warranty.
39.2 Purchaser’s rights
If the Purchaser proves a breach of warranty then, at the Purchaser’s option, either the Purchaser may exercise his rights under Schedule 6, or the Vendor shall pay to the Purchaser as Liquidated Damages a sum equal to the amount in paragraph (i) of the Appendix. 40 Female sheep proving barren
40.1 Vendor’s warranty
The Vendor warrants that any female sheep sold as being In Lamb is In Lamb at the time of sale. This warranty is a 21 Day Warranty.
40.2 Purchaser’s rights
If the Purchaser proves a breach of warranty he may exercise his rights under Schedule. Notice of a claim must be supported by a Veterinary Surgeon’s Certificate.
43 Stock rams
43.1 Vendor’s warranty
The Vendor warrants that any ram sold as a stock ram for the amount in paragraph (j) of appendix or more is capable of natural service. This warranty lasts from the day of sale to the 15th December in the year of the sale.
43.2 Purchaser’s rights
If the Purchaser proves a breach of warranty the Purchaser may return the ram to the Vendor who shall, at the Purchaser’s option, either replace the ram with another ram of equal value which is capable of natural service, or refund the purchase price together with such other costs and charges as the Purchaser may be entitled to under these Conditions. For the avoidance of any doubt if the Purchaser is able to obtain viable semen from the ram for use by artificial insemination he shall not be entitled to any claim against the Vendor for breach of warranty

Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations.
Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling.
When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals.
Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge.
Children must not be permitted in any area where they may be at risk from livestock or machinery.
In the case of bulls, during the period when the show/ sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns.
Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity.
Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.
The auction ring man escapes and refuges must be kept clear at all times.
All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.
AUCTIONEER’S TERMS & CONDITIONS OF SALE
(Incorporating the Auctioneer’s Terms and Conditions )
1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.
2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.
3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.
4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.
5. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.
6. All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.
7. Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.
8. No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.
9. Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.
10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.
