I recently read an article that discussed how people are flocking to Merrill Creek Reservoir in Warren County, New Jersey, to hopefully spot a Boreal Chickadee. People from New York, New Jersey and Pennsylvania have been lining up for a view since no recorded sightings of this bird have been made since 1987. As I read that article, and with Spring approaching, I got excited about the birds that will soon arrive in our area. If you would like more information, there are several websites showing birds as they migrate north (allaboutbirds.org or aba.org). Also, there are websites with information on how to join in on documenting bird counts or sightings (ebird.org; audubon.org).

One bird whose arrival I look forward to in the Spring is the ruby-throated hummingbird (see my backyard photos). This is the only hummingbird species that lives in the eastern half of the United States. According to the website hummingbirdcentral.com, the first hummingbirds are expected to arrive in Pennsylvania between April 20 and May 1.

We have already collected a good amount of money to help the family. The new owner of Paupack Hills, Vinny Polise, has joined us in our efforts by sponsoring a fund-raising event on Sunday , April 7th, Tickets are now available at the Chalet. I look forward to seeing you there to continue our support for the family. All the monies from the sale of tickets will go directly to the family.

The club house at Paupack Hills continues to see major improvements both in appearance and in the restaurant menu. Now is the time to visit and enjoy.

We are preparing for a very busy spring and summer, Road work, the beach bathhouse, the beauty parlor on 507, just to name a few. As of this writing (February) we have done well with snow - our crew has done a great job of keeping our roads clear.

The first meeting of 2019 for the Board of Directors of Tanglwood Lakes was the occasion for welcoming two new members, Bob Stoveken and Grace Zoccali and the annual presentation to the Board Officers left to right: Elmer Hertz, 1st VP, Jim Clark, President, Ron Board by our community Triani, Treasurer and Mark Ossont, 2nd VP attorney, Christopher Farrell, Esq. Attorney Farrell charged the Board with their Roles and Responsibilities as Directors as detailed in the By-Laws. He stated that the Board members are considered fiduciaries who steer the organization towards a sustainable future by adopting sound, ethical, and legal governance and financial management policies. A fiduciary therefore has a position of authority entrusted with acting on behalf of another in this case the best interest of the members of the Community.

Attorney Farrell stressed the importance of the Chain of Command in effecting the policies and management of the community and reminded the Board Members and the Committee Chairpersons of their particular obligations. He then stated that TLCA’s Governing Documents are comparable to a type of Constitution and Bill of Rights. The primary document is the Restrictive Covenants sometimes referred to as Deed Restrictions. Second are the By-Laws which define and determine many of the specifics of the organization such as officers and the purpose and responsibilities of the standing committees. The By-Law may be amended at a general membership meeting or with a mail ballot by a majority of those voting. Thirdly are the Rules and Regulations and the Building Codes which can be revised under the authority of the Board of Directors. Any updates to these documents are routinely communicated to the membership.

By Ralph Graf I want to offer my sincere gratitude to the Board of Directors, the owner of the Golf Course, TLCA Membership and staff for their outpouring of support for Justin Schantz.

Justin was the head life guard for the community as he continued his college education. In addition, he was a maintenance part-time employee. Justin was recently involved in a serious vehicle accident. As a result of the accident he was trapped in the vehicle and sustained burns over 52% of his body. The burns and injuries resulted in the amputation of his legs.

Justin resides with his family in Tanglwood Lakes.

On April 7, 2019 from 1pm to 5pm, the community in conjunction with the Golf Course is hosting a fundraiser for the Schantz family. Vinny Polise, the owner of the golf course, has offered his facility and will provide the food for the event. We are selling $20.00 tickets at the Chalet and tickets will be available at the door. We will have raffle baskets, prizes and music.

We are in the process of completing the design for the fore- bay at Indian Drive. Once the design is approved, the Environmental Committee will discuss implementation with the Board of Directors.

The contract with our lake manager, Princeton Hydro, has been signed. This contract is for dewatering at Tanglwood Lakes. This process will assess the sediment that the community will be permitted to remove from Lake Tanglwood.

The initial phase is to survey and identify areas where the sediment can be deposited on community property.

I anticipate having the approval for the insert to the large culvert pipe on Tanglwood Drive in mid to late May of this year.

Once we have plan approval the request for bids will be sent out to area contractors. The bid process will be coordinated through the engineers for the community from Kiley Associates. I would anticipate the replacement/ construction to be late summer, early fall. We

will naturally keep the members informed as the process moves forward.

The new cameras at the maintenance complex are now in place. Please remember that only household refuse can be placed in the compactor. The community provides for bulk pick up of non-house hold items. The minimum fee for a bulk pick-up is fifty dollars.

You can contact the Chalet for information relative to bulk pick up.

The new boat bumpers for the docks at the Lake Wallenpaupack Marina have been ordered. We will be using stainless steel bolts to secure the bumpers as recommended by the manufacturer.

Please note that Tanglwood maintenance is the only one authorized to affix the bolts, hooks etc. to the docks.

The new PennDot approved speed limit signs have been ordered and will be in place weather permitting.

The Board recently approved an upgrade to the Community Center. The interior of the facility will be painted. The refrigerator and stove will be replaced, in addition to repairs to the men’s room.

The Public Works Committee supported improvements to the community owned beauty parlor. The bid involved replacing the existing roof, shoring up the front deck and the installation of vinyl siding.

The siding will be a color to match that of the Chalet. The engineer for the community will be assessing the piers at the bathhouse. The thought is to install vinyl siding and complete the renovations to the interior once the engineer’s evaluation is complete.

The funds for the improvements to the amenities will come from the Capital Improvement Fee that is collected by the community. The capital improvement fee is money that is paid on the transfer of a member’s property. The fee for a developed property is the amount equal to the dues for the prior year. The fee for an undeveloped property is one half the amount of the prior year’s dues. The funds must be maintained in a separate account. The funds can be used to improve a common element, which is an amenity.

The Board of Directors at their February 16, 2019 Board meeting voted to rescind a prior board motion regarding lot combinations. The initial motion in October of 2004 permitted the combining of two lots for the purpose of paying only one assessment. During the past two year there have been 31 lots that have been combined resulting in a loss of revenue for the community. The township has been notified as to the decision of the board. The Board of Directors will address this matter further at the next meeting as to possible options.

The staff will be participating in a Community First Aid and CPR Recertification on March 29, 2019.

I have received calls regarding permits for work on a member’s property and requirement for a survey. A reminder the Consolidated Rules for the community in Section [412] state the following. [A survey is required on a member’s property for structural improvements that increase the footprint of the structure including additions, decks, sheds, garages, new driveways etc. The survey will ensure that any new construction conforms

Board Resolution The Board of Directors has received and considered the recommendation of the Legal Committee that the restrictive covenants be modified to make them permanent with no date of expiration and hereby adopts the following resolutions.

Resolved, that the Board of Directors recommends to the members of the community that members of the community all vote in favor of amending the first numbered paragraph of the restrictive covenants that currently reads as follows: A1. These restrictions shall run with the land and shall be in force and effect for a period of Seventy-Five years from April 1, 1968" to be amended to read as follows: A1. These restrictions shall run with the land and shall be in force and effect in perpetuity@; and further Resolved, that the ballots to vote on the amendment to the restrictive covenants be distributed with the notice of meeting for the May 2019 membership meeting and that the votes on the proposed amendment be counted at the meeting of the membership to be scheduled in October 2019.

Modification Of Restrictive Covenants The core governing documents of Tanglwood Lakes Community Association (TLCA) are the restrictive covenants that are incorporated into every TLCA property owner's deed. All of the governing documents by which TLCA operates derives from these restrictions. These restrictions authorize the existence of Tanglwood Lakes Community Association, Inc., the legal entity that operates TLCA, the bylaws and the rules and regulations.

The Legal Committee has been reviewing the restrictive covenants to determine if any changes need to be made. The covenants were created when the Community was formed 51 years ago. After a review of the restrictive covenants, the Legal Committee recommended to the Board that there only be one modification to the restrictive covenants. By their terms, the restrictive covenants expire 75 years after April 1, 1968. The Legal Committee, in consultation with TLCA's attorney, recommended to the Board of Directors that the restrictive covenants be made permanent. The Legal Committee made this recommendation because if the restrictive covenants were to expire, the organizational basis on which the community operates would terminate. This would mean there would be no board of directors, there would be no ability to impose dues to operate the community, there would be no organization by which employees could be employed or paid. TLCA owns millions of dollars of real and personal property. These properties include the roads, the beach on six acres on Lake Wallenpaupack, 30-40 acres in the nature trail, the docks that are put on Lake Wallenpaupack, the dock racks on Lake Tanglwood as well as all the buildings we own, including the Chalet, the Community Center and the maintenance buildings.

In addition, there is all the machinery and equipment. The value of these assets is in the tens of millions of dollars. If the covenants expire, all these assets would devolve to the individual unit owners. How they would be managed under such an ownership structure is unclear. The only available option may be to sell the assets off.

To avoid this uncertainty and potential chaos, the Legal Committee believed it was imperative that the covenants be made permanent now, 24 years before their expiration to avoid property values being adversely impacted. There is a significant possibility that within 20 years of the restrictive covenants= expiration, the impact of the expiration of the restrictive covenants on the of ability of the community to function may show up in title reports. Such reports could adversely affect property values when property is being transferred. The change being proposed simply assures that the community as it currently exists will continue into the future. Below is the text of the relevant restrictive covenant followed by how that text will be changed under this proposal.

Under Pennsylvania law (Title 68 Section 5219), the covenants can only be modified by the affirmative vote of 67% of all members of TLCA entitled to vote. There are currently 850 billable properties entitled to vote. To meet the 67% threshold 570 of those properties must vote in favor of the amendment. We are requesting that all property owners in TLCA vote in favor of this amendment which does nothing more than assure that the community will remain able to govern itself as it does now for all time in the future.

Meet Your Neighbors Bryson Thomas, Rising Motor Sport Star Bryson Thomas has been participating in the motorsport of off-road racing for well over two years and has been advancing in both ability and proficiency during this time.

Bryson is a 1st grade student at Wallenpaupack Elementary and enjoys the challenges and excitement that are part of racing. Bryson, along with his Dad, Dale, travel to different locations in Pennsylvania, New York, and other states on the east coast to participate in this fun and family-oriented sport on many weekends.

Bryson recently placed #1 in the WNYOA (Western New York Off Road Association) which is sanctioned by the AMA (American Motorcycle Association).

The WNYOA has definitive rules and regulations for all levels of participants to ensure safety and fairness in the competition.

Bryson is looking forward to entering more competitions this spring and summer as he advances in the rankings.

The Tanglwood Bookees Spring Selections The Tanglwood Bookees met in February to discuss, The Great Alone by Kristen Hannah at the Greentown Grill. Kristen Hannah is a favorite of The Bookees and this selection proved to be worthy of its acclaim. Set in 1974 Alaska, this sweeping tale follows an ill-prepared family learning to survive the extreme and very harsh conditions on the Kenai Peninsula. The tangled and somewhat toxic relationships in the book provided for a very lively discussion.

The group has selected Where the Crawdads Sing, by Delia Owens, set along the North Carolina Coast for the April choice.

My Brilliant Friend a novel set in Italy post WWII by Elena Ferrante is the May choice. Some other recommendations include: Educated by Tara Westover, Beartown by Fredrick Backman, The Underground Railroad by Colson, and Our Souls at Night by Kent Haruf.

Preparing for Spring Boating Season With over one hundred boat slips at The Tanglwood Marina and a number of residents utilizing spots nearby, it is safe to say that a large majority of our homeowners participate in this pleasurable sport and are now thinking about getting ready for boat season.

Our Maintenance Crew aims for putting the docks in by the end of April into the first week of May. Of course, we always need the weather to cooperate. Getting ready for Spring Launch entails a few details that were found on www.Discoverboating.com.

Launch time is here and it’s time to start preparing for the upcoming boating season. Tasks vary depending on the boat you own as well as the type of boating you may undertake. Below is a “short list” of some important procedures that should be on your complete list of things to do to get ready for spring launch.

Vessel preparation and maintenance: This varies depending on the type of boat you own. Insure that your engine or engines have all oils and lubricants topped off or replaced based on recommended maintenance schedules. Insure that a certified engine mechanic has performed an engine check and tuned the engine(s) to insure best performance and fuel economy. Inspect all engine belts for wear and replace if worn. If your outboard motor lower gear-case oil was not changed when winterized, change it now. Check the water pump impeller. Check other types of equipment on board including bilge pumps to insure they are operating properly. Flush your water system. You can buy products that are added directly to the water holding tank to improve the water’s taste and smell. Make a list of spare parts you should carry in case you have a breakdown. Your mechanic or marine parts manager can give you recommendations.

Looking Forward to Spring Birds (Continued from Page 1) I usually put my hummingbird feeders out about a week prior to the targeted arrival date since in years past I have had them in my backyard sooner than expected. Here are some tips about cleaning, preparing and filling your hummingbird feeders: 1. Cleaning with vinegar is a better method than using dish soap (fill bottle with two-parts water to one-part vinegar and let soak for several hours making sure to rinse thoroughly before refilling with nectar. 2. Making your own nectar is easy – mix one-part sugar with four-parts water, bring to a boil, and cool completely before filling feeder (no red dye should be added). Store any extra nectar in your refrigerator. 3. In hot weather, the feeder should emptied and cleaned twice per week. In cooler weather, cleaning once per week is sufficient.

Finally, remember to take in all bird feeders at night so that you do not attract bears or other wildlife in our community.

Navigation and safety equipment: Absolutely check your navigation lights! Do you have replacement bulbs for running lights, anchor light, etc.? Do you have the right number and type of flares and are they current.

Check your electronic equipment such as VHF radios, radar, and GPS. What is the condition of your PFDs and do you have the right sizes and number and are they Coast Guard approved? Any children under the age of 14 must wear a PFD. Don’t forget to inspect the condition of your docklines, anchor line and running rigging.

Lake Wallenpaupack: It is also important to keep current on the particulars of boating and fishing on Lake Wallenpaupack. The Commonwealth of Pennsylvania and the Fish and Game Commission set up the regulations for boating in this area. Make sure that your boat registration is current and that your fishing license is valid. There is also a boat safety course certification available.

Here are some of the guidelines for boating on Lake Wallenpaupack found on AZCentral.com (USA Today network) site: Motorized Boats There is no limit on how much horsepower your boat can have, but you'll be subject to a 45 mile per hour speed limit between sunrise and sunset on weekends and holidays from Memorial Day through Labor Day. You'll only be able to travel 25 miles per hour after dark during those same days. Before you go, you'll want to make sure your boat is registered and that you have a Boater's Safety Card if you were born after 1981. You'll need to have a life vest on board for each person, with kids under 12 years old wearing theirs at all times when the boat is underway. You'll also be required to wear yours if you are boating on the lake during the months of November through April. Even if your boat is equipped with a marine sanitation device, you may not discharge waste into Lake Wallenpaupack. A pump out station is provided at each of the four marinas.

Personal Watercraft If you're riding a PWC on Lake Wallenpaupack, you'll need to be wearing a life vest on your craft at all times. Kids under 12 years old are not allowed to operate a PWC. Those between 12 and 15 can operate a PWC providing they have a Boater's Safety Education Card and do not have passengers under 15 years of age on the PWC with them. If you are going to tow a skier or tuber on your PWC, you'll be limited to towing one person at a time no matter how much horsepower your vehicle has. PWCs can be rented at Rubber Duckie Boat Rentals (rubberduckieboatrentals.com) on the lake's east shore.

Tow Sports Tow sports such as water-skiing, wakeboarding, wake surfing and tube riding are popular ways to spend summer days at the lake. On Lake Wallenpaupack, you'll only be able to participate in these sports between sunrise and sunset and are prohibited from skiing the west end of the lake near Ledgedale Recreation Area on weekends and holidays during the summer season. Your tow rope should be no shorter than 20 feet or longer than 80 feet to comply with Pennsylvania state law. The state prohibits riding on a ladder or swimming platform attached to the boat unless you are docking. Be sure you have an observer other than the driver whose job it is to watch you in case you should get into trouble. Kite skiing and parasailing are prohibited on weekends and holidays and can only take place during the week at designated locations.

Paddle Craft Paddle craft do not have to be registered or titled in Pennsylvania. You don't need a boater's education card, but you will need to make sure you have state-required safety equipment on board when boating in Lake Wallenpaupack. This includes a PFD, which you'll be required to wear from November through April, a flashlight or other bright white light for signaling after sunset or before sunrise and a mouth whistle or other sound-producing device. You can rent kayaks at Ledgedale Recreation area on the west end of the lake. Its quiet coves and limited motorboat access provide ideal locations to paddle.

There are two opportunities for you to do so if you are lucky enough to live in Tanglwood Lakes. There is a group that plays every Tuesday morning from 9 to noon.

This is an organized group where you commit to play by responding to an email each week. The game that we play is bridge. It is not duplicate bridge since we do not have enough players to run that format. We have only one table or two in the winter months since many ladies choose to leave us for some sunshine and warm weather. You are welcome to come and watch and meet the ladies that are here. You may decide that this is something that you might enjoy. We play at the Community Center. Tables, chairs, cards and fun are available. We are not a serious group—fun and learning the game can be experienced by all. We like men, but we are a group of women. There might be some talking going on besides the game.

The second opportunity for bridge is on Friday from 9:30 until noon at the Community Center. This is not organized in that, you show up, and we play with 4, 5, 6 ,7,etc. Men are welcome as well. Again, if you want to see what is involved with the game, consider coming on Friday. We will be happy to introduce you to our favorite game-BRIDGE.

Otherwise, store all garbage in containers with tight-fitting lids and place them along the inside walls of a garage, or in the basement, a sturdy shed, or other secure area.

• Wash garbage containers frequently with a disinfectant solution to remove odors. Put out garbage on collection day, not the night before.

• Avoid feeding birds when bears are active. If you do choose to feed birds, do so during daylight hours only and bring feeders indoors at night.

Suspend birdfeeders from a free-hanging wire, making sure they are at least 10 feet off the ground. Clean up spilled seeds and shells daily.

• Immediately remove all uneaten food and food bowls used by pets fed outdoors.

• Install electric fencing as an effective way to protect crops, beehives, and livestock.

If you encounter a black bear in your neighborhood or outdoors while hiking, fishing or camping, follow these safety tips: • Remain calm. Never run from a bear. Instead, slowly back

away. Avoid direct eye contact, which may be perceived by a bear as a challenge. Make sure the bear has an escape route.

• To scare the bear away, make loud noises by yelling, using a whistle, banging pots and pans, or sounding an air horn. Make yourself look as big as possible by waving your arms. If you are with someone else, stand close together with your arms raised above your head.

• Make bears aware of your presence by speaking in an assertive voice, singing, clapping your hands, or making other noises. If hiking through bear country, always make your presence known through loud talking or clapping of hands.

• The bear may utter a series of huffs, make popping sounds by snapping its jaws and swatting the ground. These are warning signs that you are too close.

Slowly back away, avoid direct eye contact. Do not run.

• If a bear stands on its hind legs or moves closer, it may be trying to get a better view or detect scents in the air. This is usually not a threatening behavior.

• Black bears will sometimes “bluff charge” when cornered, threatened, or attempting to steal food. Stand your ground, avoid direct eye contact, then slowly back away and do not run.

• If the bear does not leave, move to a secure area such as a vehicle or a building.

• Families who live in areas frequented by black bears should have a “Bear Plan” in place for children, with an escape route and planned use of whistles and air horns.

• Black bear attacks on humans are extremely rare. If a black bear does attack, fight back.

Many groups use the facility on a weekly basis. Please clean-up after your use and leave it ready to go for the next group.

There is a refrigerator where your items can be kept cold before you need them.

It is the assumption that said items belong to you, not to anyone who happens to open the refrigerator door.

Also, there is a coffee pot for general use under certain conditions. You bring your own coffee, clean up when done, and unplug the coffee machine before you leave.

TLCA Building Permit Process This is the time of year where many repairs are being made on homes in the community. A TLCA permit is needed for some of these repairs. Permits are available in the chalet. The permit is to be completed by the homeowner or contractor, submitted to the chalet for review and the approved permit posted while the work is being done.

Here are some guidelines to follow: • Permit is to be submitted well ahead of work being scheduled. A permit submitted one day will not be approved in time for work scheduled for tomorrow.

• If someone other than yourself is going to work on your home, a copy of their PA contractor’s license and certificate of insurance must accompany the permit.

Work that requires a permit:

OFFICE NOTES 1. 2019 car stickers are available at the chalet. Stickers are needed for resident vehicles showing they belong in the community and at amenity areas. If your vehicle information has changed, please bring in a copy of the vehicle registration.

2. Saturday summer hours for the chalet will start on Saturday May 11th. The hours are 9am to 3pm through September 15th. The chalet is open 8am to 4pm Monday – Friday.

3. Boat rack forms and dock leases will be mailed out in mid- April. Stickers will then be available when completed forms are returned.

Beach stickers will also be available.

• Roofing and siding – a small sample of the shingle or siding to be submitted with permit.

• Tree removal – trees are to be marked, $25 fee • Painting of house or deck – color sample attached to permit • Driveway change – to pave or seal • Decks & additions – copies of necessary township permits, plans, plot plan, survey and check for required fee • Landscaping - permit is necessary • New construction, septics – required paperwork Permits are required for most exterior work on a home. Interior work such as painting, bath & kitchen remodeling does not require a Tanglwood permit. We ask that you remember our Building Codes Committee is made up of volunteer Tanglwood residents. They are here to service you but may also have a job or other commitments. They review permits at their convenience. Therefore, allow time between submittal of the permit and scheduling of work.

4. Golf cart owners – new stickers will be available for your carts. Current insurance information will be needed.

5. With spring hopefully upon us, work will start on homes both inside & out. For outside projects such as painting, siding, roofing, tree removal, driveway changes and sheds for example, a TLCA permit is needed. Permits are available in the chalet. Please be familiar with the Rules & Regs as to contractor hours, fees and information to be submitted. If you don’t have a current copy of the Rules & Regs, they are also available in the chalet.

Strategic Planning Committee March, 2019 Update

The Committee has continued to meet through January and has now prepared a draft report for member review. Committee members have provided comments on this first draft and it is hoped we will have a final draft ready for submittal to the Board for review and consideration at their April meeting. The original schedule called for completion of a Board approved report for review with the Community at the May, 2019, Semi-annual general meeting. The format of the report will include a summary of recommendations made in the 2006 strategic plan report that have been completed over the last 12 years. The new report will also identify additional issues that have arisen in that period and been addressed, plus recommendations that were made in 2006 where implementation of solutions are still in progress. Lastly, the report will contain new recommendations for issues that the Committee feels may be considered by the Board for resolution in the coming years. The new and still open “opportunities” the Board, through its various Committees, have been addressing or considering are as follows: Appearance and Maintenance – restoration of the original drainage plan to protect the life of our paved roads, keeping Tanglwood Lake physically and environmentally sound by minimizing sediment inflow and developing a plan for sediment removal.

Security – continuing to address speeding concerns with a plan to install new signage and consider other measures once effectiveness of signage is evaluated.

External Issues – A Task Force, established by the Board, continues to meet with the new owner of the Paupack Hills GC. Potential opportunities are also being evaluating that might provide increased revenue sources for the Community. The Board has continued to monitor the status of activities relating to neighboring properties.

Gorgeous views, historic sights and a 700’ descent will (hopefully) distract you from any muscle aches. On Sunday May 12th, 5K, 10K and team relay races will take place in Tamaqua at the Owl Creek Reservoir.

Keep your walking shoes on because now we’re heading to the Seven Tubs Nature Area in Wilkes-Barre. The park is a 500 acre preserve with the Wheelbarrow Run Stream meandering through a series of deep canyons, or tubs, that have been carved out of bedrock over years and years. Hike through the area and enjoy the sights and sounds of the surrounding waterfalls and wildlife. Be sure to wear sturdy non-slip footwear. Have you heard of the rails-to-trails systems popping up throughout the country? There are a few in our area - here are a couple examples:

The Lackawanna River Heritage Trail is a network of 70 miles of D&H railway tracks connecting New York State and Pennsylvania.

The trail is used by cyclists, hikers, walkers and runners and makes use of public sidewalks, streets, municipal parks and, of course, abandoned railway tracks. In nearby New York State you’ll find the Walkway Over the Hudson. Enjoy gorgeous views of the Hudson River while walking 200’ over the river on a railway-turned-walkway from Highland NY to Poughkeepsie NY. Don’t worry – there are sturdy chest-high safety railings on either side of the bridge as well as ADA compliant entrances and exits, and a smooth, flat walking

surface. Restrooms are located on either side of the bridge, and pets are welcome (on a leash.)

The walkway is open daily from 7 am to sunset, and special events such as Moonlight Walks are scheduled throughout the year, weather permitting. While you’re in the area, check out Poughkeepsie’s Little Italy neighborhood, Franny Reese State Park and other historic areas in Poughkeepsie as well as other picturesque little towns along the Hudson. For road-trippers, the Roebling Delaware Aqueduct (182 Scenic Dr., Lackawaxen PA) may be just the thing. The bridge, designed by the Brooklyn Bridge’s John Roebling, is the oldest existing wire suspension bridge in the United States. It’s located 18 miles from Hawley and spans more than 530’ over the Delaware River from Lackawaxen PA to Minisink Ford NY. Side note: Minisink Ford is an early settlement and has a cemetery and battlefield dating back to the Revolutionary War. In addition, NY’s Route 97 is one of the prettiest roads in NY State, running alongside the river and dotted with cute little towns. If you don’t make it up there this Spring, keep in mind that the Fall foliage is absolutely stunning as you drive or walk along the river.

Back on the other side of the river in Lackawaxen PA, you may want to visit the Zane Grey Museum (135 Scenic Dr., Lackawaxen PA), the former home of Pearl Zane Grey, outdoor enthusiast and author (Riders of the Purple Sage was one of his novels.) One more New York pit stop: Bethel Woods, 200 Hurd Road in Bethel NY. Bethel Woods is the site of 1969’s Woodstock Music Festival, and this year marks the 50th anniversary of the Summer of Peace and Love. There will be an anniversary celebration August 16 – 18, with the performances of many artists, TED talks and a special exhibit at the museum entitled We Are Golden. In April and May, for example, Bethel Woods is offering a photography program for highschoolers and a pop art printmaking workshop for adults. Bethel Woods is about an hour away, but the grounds are quite pretty and the museum really is worth a visit, so even if you don’t plan on attending a concert, a trip to Bethel Woods makes for a great day trip.

All stand for the pledge of allegiance. Roll call was taken, and board members present are Ron Triani, Elmer Hertz, Rose Kucharski, Roger Cote, and Ed Jobst. The new owner of PPH introduces himself to the board, Vinny Polise. His background is in commercial real estate. He intends to make the club private. His interest is in the venue – restaurant, parties & banquets. He has hired a supervisor to manage the golf course and improvements will be made. He will host a cocktail party for Tanglwood sometime in January. He answered questions form the board and audience.

In 2018, charges billed to delinquent accounts for Legal/Collections and Penalty &Interest total $49,100 and collections through October are $11,045, only 23%. More aggressive collection efforts are now underway by determining a property’s value to the community if purchased prior to a sheriff sale. Rather than lose the full amount of $ liens on the account, in some cases it may be cost effective to purchase the property at a low price and resell it.

This process is now underway.

Snow plowing required overtime and more salt & cinders than budgeted along with outside contractors help, gasoline costs are expected to exceed budget and professional fees, legal and collection costs, admin costs for printing and postage (new regs) and maintenance costs for vehicles, the beach and chalet are higher than budgeted. To date, the Board has approved Operating Budget expense variances of $45,421. In total, expense variances will exceed $89,000 based on current projections with Bad Debts accounting for $45,000 of this amount based on low collection rates for Penalties and interest. Tree spraying savings of $40,000 and other savings will offset $56,000 of these unfavorable budget variances resulting in an overall budget shortfall of $23,000.

• Capital Reserve – The 2018 the approved capital spending budget is $309,210. In

addition, the Board approved a variance for the purchase of the Ford 350 truck, for just under $40,000 and repairs to the Safety Car of over $12,000. The road work expected to be completed in 2018 for Timber Ridge and Cloud Crest will cost $110,000, including 62% sharing by Aqua. The remaining 2018 roadwork budget of $90,000 for Cottonwood, Cyprus, Sycamore and Eagle Crest will be moved to 2019.

• Preliminary engineering and construction costs estimates received from Kiley for the Tanglwood Pipe and damaged barrier wall are now in the area of $214,000, after subtracting the $75,000 grant. This is before receiving formal contractor bids. Projects already specifically identified for funding for 2019 through 2023 are estimated to cost the community approximately $1.9 million. To cover these financial needs, annual capital reserve contributions will have to be increased going forward.

• 2019 Operating Budget – the Board approved 2019 Operating Budget includes Revenue of $1,201,528, Operating Expenses $941,528 with a $260,000 Capital Reserve transfer. The Capital Replacement Reserve funding requirements, which include estimated future costs for roads, infrastructure and equipment, will have a major impact on 2019 and later years’ assessments.

• 2019 Capital Budget- approved by the Board, includes total spending expected in 2018 to be $229,349 leaving balance of $561,000 going forward to 2019. With a $260,000 2019 budget contribution and 2019 budget/forecast spending of $575,710, the reserve balance is forecast to be $245,000 at 12/31/19. Paving cost estimates for 2019 are $290,000 and the Tanglwood Dr culvert is projected to be $214,000 after subtracting the $75,000 grant.

• 2019 New Capital Budget – approved by the Board includes total spending in 2018 to be $64,066 leaving a balance of $56,445 going forward to 2019. With CIF Fees estimated to be $35,000 and 2019 budget/forecast spending of $58,000, the balance is forecast to be $33,000 at 12/31/19. The major expense will be the Lake Tanglwood fore-bay construction at a cost of $42,000.

• Policies to be reviewed – In the next few weeks, previous Board approved policies for purchasing, legal review, and contracts will be reviewed and coordinated to clarify the process, to avoid confusion and to improve oversight and control. A routing process showing authorization and approvals will be recommended including related $ limits. When necessary, the final package with appropriate documentation will then go to the Board for approval. The policies being looked at include: Project Management Process, Maintenance Work Order Process, Credit Card Procedure and Approval of Capital Purchases.

• Variance requests – B&F is recommending the Board approve a $425 variance the Welcome Committee is requesting to purchase gift bags for new residents who attend the welcoming meeting. Maintenance is to submit a variance request for a third spreader needed as a backup during winter months snow plowing. B&F was told the cost should be $1,500 to $2,000.

Community Managers Report November 17, 2018 The area Realtors have been notified regarding the new Rental Ordinance. In addition, the 10 members with the exempt properties have been notified. I want to acknowledge the efforts of Richard Gaines regarding his work on the Rental Property Regulation.

The new fee for the annual renewal and weekend rentals will be assessed effective November 3, 2018, the date the new regulation was approved.

The maintenance equipment has been prepped for the winter. The Docks were removed from the lake in late October. The Bathhouse has been closed for the winter. The office will keep the membership informed of weather conditions as the winter season approaches.

Aqua Water is in the final stages of pipe replacement. We have partnered with Aqua to secure the most cost-effective paving methods. I want to acknowledge the efforts of Pete

Bjorkman for his assistance in recommending the specifications for our paving program. I informed Leeward, the paving contractor for Aqua regarding my concern for the condition of the roads as we enter the winter, especially the road cross cuts that could have an impact on our snow plowing efforts.

The maintenance Supervisor and Public Safety Coordinator completed an updated inventory of equipment within their respective departments. The list will be helpful as I will be working on the insurance renewal for the community.

The maintenance staff will continue to clear ditches, weather permitting. We will be working with the golf course maintenance to address the ditch on Eastwood Drive.

I have been informed by TLCA Engineer that minor adjustments may have to be made to the plans for the replacement of the culvert pipe. The engineer informed me that the hope is to bid the project out in 2019.

I am requesting the Board approve a recommendation to increase fees as noted below.

I discussed the possibility of taking a property to Sheriff Sale for unpaid dues. I conferred with POA Collection Council who has researched the property and has reported there is no mortgage on the property. The cost to the community to proceed with the Sheriff Sale would be $3,000.00. There is approximately $1,800.00 in back taxes that are due in addition. I can discuss it in greater detail.

The property is at 112 Butternut. I consulted with the Budget and Finance Committee with respect to recommending this action be taken. I thank Regina for her assistance.

Executive Session The following items are being provided as an update.

• Pinecrest Docks, Rich Gaines prepared follow up questions regarding cost factor for the docks. I have requested that the questions be addressed so that we can have a clear picture on revenue and expenses. Once more information becomes available, I will inform the Board.

• Condo Docks, the scheduled meeting for the resort has not occurred. I have reached out to the manager requesting a proposal for the 60 docks that would be in play for a three-year lease agreement.

I am simply working with Rich Gaines to gather information for discussion at this point.

• Request consideration for exemption regarding the Short-Term Rental Ordinance. The members information is included in your Board Packet.

Based on the collections for the year (subject to final audit), there will be an additional transfer to the Capital Reserve in February of $25,000 resulting from 2018 collections.

This is without having received the $13,000 Tanglwood North payment which was due on December 31.

Funds in excess of the FDIC insurance coverage limit of $250,000 will moved to PNC during February.

Mortgage loan balance $ 274,645 Vanguard balance at December 31, 2018 is $572,571 including interest for the year of $11,902. Funds in the reserve are needed for scheduled future replacement of TLCA’s buildings, vehicles, equipment and roads.

PNC Bank balance is $28,296.

Receipts for the Year total $1,326,104 including $27,492 of collections of prior years’ balances, $61,155 of CIF fees and $199,682 of 2019 prepaids. For the year, 97% of budgeted Home Assessments were collected, 89% of Lot Assessments and 100% of Dock fees. Total amounts of revenues billed in the 2018 budget were $1,112,682 and collections related to these billings totaled $1,031,857, leaving a shortfall of $80,825. Collections of prior years’ balances of $27,492 bring the receipts up to $1,059,349 reducing the shortfall to $53,333.

If $13,000 is collected from Tanglwood North, the revenue shortfall would be about $40,000.

Cash disbursements for the Year total $808,728 with the benefit of $40,000 savings from no tree spraying. With additional 2018 expenses to be paid in 2019 of approximately $24,578, cash disbursements for 2018 will increase to $833,306. Overall, cash receipts of $1,059,349 less cash disbursements of $833,306, leaves $226,043 available to transfer to the capital reserve. In February of 2018, $200,000 was transferred and an additional $25,000 will be transferred in February 2019. The total transfer of $225,000 will be $25,000 below the 2018 budgeted capital obligation of $250,000.

Budget & Finance Committee Report

• 2018 Preliminary Unaudited Operating Results (accrual basis) - Total Revenue billed for the year is $1,143,756 and Expenses $920,589, netting $23,167 after providing $200,000

for a Capital Obligation. Revenue billed in 2018 is $31,074 over the budgeted amounts because of additional charges for Penalties & Interest on delinquent accounts $15,150, Legal/Collection Fees $4,803, License/Permit fees $4,046, Rental Income $3,650 and Citation/Fines $2,399. Expenses are projected to be $920,989, $57,907 over 2018 budgeted amounts. Payroll and related taxes are $30,497 over budget due to additional snow and docks related overtime hours, the manager’s contract extension and year-end Board approved bonuses. Professional fees are $11,119 higher than budget, principally because of more collection fees on delinquent accounts and additional legal fees for Board and regulation matters (rentals). Bad Debts are projected to be $75,000, $45,000 over budget due to higher accumulating charges on delinquent accounts. Admin costs are $7,528 over budget with printing of regulations being a major item. Gasoline is $4,968 over budget due to storm usage and higher prices. Under Cleaning & Maintenance there are major variances in Vehicle Maintenance (repairs) $11,390, Beach Maintenance (bath house/guard/ chair, buoy, etc) $5,056, Docks $2,613 and Chalet heating unit $1,505. These variances are partially offset by nearly $9,500 of savings in Lake Tanglwood Maintenance and Outsourcing. Road Maintenance totals $28,506, $3,506 over budget with additional Salt & Cinders costs of $11,059 offset in part by $7,553 reduced patching. Overall, there are unfavorable expense budget variances totaling $116,519. There are savings in Tree spraying of $40,000, in unanticipated expense of $8,514 and various other budget categories totaling $10,098. These savings, which aggregate $58,612, reduce the $116,519 unfavorable variances to 57,907.

• The Budget & Finance Committee, working with some other Board members, has reviewed TLCA’s purchasing routines and drafted a new Purchasing Policy which will be circulated to committees for review before bringing it to the Board for approval. The intent of the policy is to protect the community’s finances by strengthening internal controls over purchasing with additional management oversight and an improved budgetary process with responsibilities and approvals clearly assigned. To better control spending going forward, the Budget & Finance Committee recommends that the Community Manager take a more active role along with all committee chairs and the accountant in developing the detailed annual budgets. The manager can then control it and be held accountable for performance against budget.

• 2019 New Capital Budget – For 2018, New Capital CIF revenue was $63,494, $38,456 above budget and spending was $42,966, $16,166 below budget, resulting in a December 31, 2018 balance in the account of $96,040. Spending in 2018 included $19,500 New Kubota options, canoe racks $3,670, barricades $3,431, Lot purchase $11,265 new website $3,750 and Forebay $1,350. The 2019 CIF fees are budgeted at $35,000 and 2019 budget/ forecast spending is estimated to be nearly $80,000 leaving a balance of approximately $51,000 at 12/31/19. The major expenses in 2019 will be the Lake Tanglwood fore-bay engineering & construction at a cost of $42,000- $55,000, cameras at the docks $7,500, speed control signs $2,000, radios for safety $4,000, bumpers at docks $2,500 and $7,500 for completion of the new website.

• Other items Butternut property- the Board should determine if it wants to bid on it the sheriff sale for a future profitable disposal. The property should first be appraised.

Lot 450- the current owner wants to donate the property to the community. Before accepting it, a perk test should be performed.

Lot Combinations- as more lots are combined, the community assessment revenue is lost.

This is a legal matter which has financial consequences.

Northern Tool/Blue Tarp Account- this account was ordered closed by the Treasurer because it was originally opened with a very high credit line without the proper approval.

Purchases were being ordered by phone by maintenance personnel who are not authorized to make financial commitments binding TLCA. The Committee does not want the account to be reopened.

Community Managers Report to the Board - January 19, 2019 The PPH Task Force had a second meeting with Mr Vinny Polise the owner of Paupack Hills Golf Course. The Task Force will continue to have monthly discussion with the golf course management to represent the interest of TLCA membership. PPH has started to make improvements both inside and out.

I received a notification from Robin Wildermuth regarding the Gypsy Moth Assessment.

The good news is that the community will not have to be sprayed this year as the caterpillar count is low throughout the community. This is a savings of $40,000.

The collection counsel is moving forward on processing a property for Sheriff Sale. I have been informed the sale is set for March 20, 2019 at 11am at the Pike County Administration Building. I will be attending the sale and will notify the Board as to the results of the sale.

The Board had approved the allocation of funds for the sale, as recommended by TLCA Collection Council.

We will be purchasing and installing 29 new speed limit signs that are the reflective type and Penn DOT approved signs. The recommendation to replace the signs was from the Public Safety Committee.

The Public Safety coordinator is working on improving radio communication between staff upgrading the existing portable radios in inventory.

The deposit for the installation of additional cameras at the maintenance complex has been

made and installation will be scheduled. There will be video surveillance installed at the TLCA Marina next season as a safety measure as approved in the 2019 budget.

The Public Works Committee will be reviewing a proposal to paint and refresh the interior of the Community Center.

I have attached a letter from TLCA Council Attorney Farrell regarding the TLCA beach property and the fee due the community from Tanglwood North. The residents of Tanglwood North benefited in using the facility all summer. The $13,000 fee as indicated in the 1986 agreement was due and payable by December 31, 2018. There is a five percent penalty provided for that has been charged to the account as a result of non- payment.

Kiley Associates are moving forward with the design plans for the Fore -Bay at the canoe storage area.

There are no updates on the insert for the large culvert pipe on Tanglwood Drive. The plans are currently under review by the Army Corp of Engineers.

The Arbitration Committee at their recent meeting assessed a $7,200.00 fine for the unauthorized removal of fourteen trees on a member’s property without a permit. The removal of the trees by the owner was apparently to place soil in an effort to perk the property. The TLCA Regulations state the fine for removal of trees without a permit shall be $500.00 per tree. The additional $200.00 assessed was for failure to secure a permit from TLCA.
