An Inside Look at Orange County’s Growing Film Industry B y E t h a n W ebe r “Everyone’s heard of this eccentric guy that’s built a genuine soundstage in the middle of nowhere,” said Jean Lara, Administrative Assistant at Umbra of Newburgh, of Ted Doering who opened Umbra’s soundstages in 2011.

Until recently, Orange County, NY has had little interest in developing a film industry, merely welcoming filmmakers as they came along. That is changing, however.

“They’re just now starting to statistically gather what a movie brings into an area,” Lara continued. “This will be for the next generation,” Doering said of Umbra and the groundwork it has laid for future filming in the county.

The facility in which Umbra’s soundstages are located was originally built by Doering to house an extensive collection of motorcycles, but was later modified to accommodate a passion for film. Since then, a variety of projects including commercials and an independent film, “The Brass Teapot” by Ramaa Mosley, have made use of the soundstages.

Umbra’s presence reflects a new, ongoing effort to bring filmmakers to Orange County— an effort in which the Orange County Arts Council has taken a leading role. Since its establishment in 2007, the Orange County Arts Council has striven to support all arts in

More than 50 executives from non-profit institutions throughout the Hudson Valley recently gathered in Newburgh for the “Not-forProfit Executive Symposium: Managing Compliance for Not-forProfit Organizations.” New laws affecting non-profit governance and limiting state-funded administrative costs and executive compensation were just a few of the items discussed.

Sponsored and presented in part by Drake, Loeb, Heller, Kennedy, Gogerty, Gaba & Rodd, PLLC, the mood among the executives before and after the discussion was subdued. “Many shared with us that they are overwhelmed with the task of aligning their organization’s existing policies with the slew of new regulations – many with troubling consequences for non-compliance,” said Drake Loeb partner and presenter Glen L. Heller, Esq. He added, “Already challenged by diminishing resources, the stress fractures are growing.”

And the stress is not limited to non-profits. In particular, commercial property owners are under increasing pressure to figure out how to stay ahead of defaulting tenants. One strategy Drake Loeb Partner Timothy P. McElduff, Jr. advises his clients to adopt is to prepare for a potential problem with a tenant now, not when it’s already too late. McElduff explained, “Commercial leases create a business relationship that must be treated with mutual respect for its terms.

If a tenant is not living up to those terms, even if rent is only one day late, the landlord should immediately send that tenant written notice.” He continued, “This reinforces to the tenant that you take the Timothy P. arrangement seriously and that you are paying attention. This will, in McElduff, Jr. turn, make them more aware of their obligation to you each month.

If they are starting to experience financial issues and choosing which bills to pay, a landlord who has adopted this approach may be on the top of that pile instead of the bottom.” More important, he said, “Sending written notice documenting late payments makes it much easier for you to enforce your rights later on, especially if an eviction proceeding becomes necessary.”

McElduff also tells his clients to know the lease terms inside and out, including the details of automatic renewal clauses. McElduff stated, “I frequently find that landlords know which tenants have poor track records, but then they allow leases with these tenants to automatically renew. Why? They weren’t paying attention and let the terms renew. It particularly happens in the case of new owners who invest in commercial property subject to existing leases. They must be mindful of the renewal date and take the opportunity to explore their options before it is too late, including reconsidering whether to continue at all. This is also sage advice for the tenants, because they may not want to get caught up in another lease term if they are having issues they don’t see a way out of; they may want to call it a day, too.”

So what more can business owners do? Form a strategic alliance with the right attorney who will get to know your business, as you do, inside and out. An attorney who understands what your business is up against in the legal arena will be the difference between becoming overwhelmed or staying ahead of the issues, and, ultimately, the competition.

Forensic Accountants Offer a Helpful Hand in a Divorce With all of the emotions involved in a typical divorce, it can be difficult to determine if one or both spouses are being completely upfront about their assets, income and the value of their businesses. In these situations, many judges, court commissioners and lawyers turn to certified forensic accountants — who specialize in finding hard-to-locate financial information — to serve as neutral third-party investigators and assist in attaining fair divorce settlements based on the actual assets of both divorcees.

A matrimonial accountant uses a variety of methods to collect and analyze financial information in a divorce case. This is often very scientific in nature, but also requires creativity and the application of various methods. A forensic accountant deals with hard data, but also provides insight into a person’s motivations, past decisions and personality traits.

Services provided by a forensic accountant commonly include reviewing statements of net worth outlining the marital and non-marital assets between divorcing spouses, determining the spouses’ past and present income and analyzing their expenses to ensure they’ve disclosed accurate information prior to the divorce.

Finding hidden assets Sometimes a forensic accountant is needed when one spouse had control over the couple’s finances and the other suspects wrongdoing. During this investigation process, the accountant reviews the expenditures to find any hidden money by ensuring the spouse’s income correlates with expenditures over a certain period of time.

Accountants then conduct a net worth analysis, which involves comparing the net worth of an individual at one point in time to another point later on. Any differences in net worth are crossreferenced with other financial data to determine the likelihood of hidden assets.

A forensic accountant will then closely examine bank deposits to find out if a spouse has suspiciously transferred money from one location to another — perhaps to a previously unknown account.

One of the most common places to hide money is in a closely-held business. In this investigative process, a forensic accountant uses a thorough review process to distinguish between business and personal assets. The accountant might review corporate filings to identify any missing funds, cross checking this data with bank account information, tax returns and other financial documentation.

When searching for a forensic accountant, be sure to look for a professional who has proper credentials, including passing the CPA exam, meeting state licensing requirements and maintaining membership in professional organizations. Your account should also be certified in Financial Forensics (CFF) or a Certified Fraud Examiner (CFE). In addition, make sure the accountant you work with has experience with cases similar to yours.

EAP: A Model of Success B Y E THAN W E B E R Since its establishment in 2010, the Orange County Chamber of Commerce’s Entrepreneurial Assistance Program (EAP) has been a model of success for helping people turn inspiration into reality. Local entrepreneurs who want to get their businesses started or to enhance existing businesses can look to one of the most successful EAP centers in New York State for guidance and take advantage of its workshops, seminars and EAP’s 60-hour Business Course in which students learn to build a solid business plan that can allow them to obtain funding as well as set and achieve attainable goals. In fact, Orange County’s EAP center has a 100% graduation rate, as well as 100% successful submission of business plans.

EAP works to educate its clients in various aspects of small business. Its services include:

o Identifying and accessing capital and credit

Cynthia Marsh-Croll, EAP Manager and a keynote speaker at this year’s New York Business Expo & Conference at the Javits Center in New York City, proudly notes that Orange County’s EAP center is now the only center that provides this option. “People who were previously unable to attend Orange County’s EAP events will now have access to this education by utilizing online tools,” says Marsh-Croll, who also attended this year’s New York State MWBE Forum and participated in its Business Builder Boot Camp as a representative of EAP centers.

Success Stories Abound Graduates of the Orange County EAP Business Course credit the program with their success— and there are many success stories.

After becoming MWBE certified and completing the 60-hour course, Christine Dziegelewski used what she learned through EAP to grow her business, CD Equipment Leasing, Orange County’s only equipment-leasing company that is woman-owned. Thanks to EAP, she saw an

$84,000 increase in sales and received $75,000 in financing. Dziegelewski feels EAP empowered her to achieve success. “The program is helping me break through a fear barrier that prohibits my growth,” she said. “…I feel I’ve cultivated a support network and resource center for all my business needs,” she continues, citing the knowledge EAP gave her of the marketing, legal and insurance aspects of running a business.

Lakeisha Hudson used the EAP Business Course to refine the plan for the bakery she wished to start. After completing the 60 hours, she opened Luscious Cupcakery and saw more than a $20,000 increase in sales within the first few months of business. Hudson said, “Before taking the EAP class, I had an idea, a business plan and a goal, but wasn’t sure on how to implement it. After completing the EAP course, I had the tools necessary to implement my plan and was able to successfully start my business.”

Also available through the Chamber’s EAP center are loan funds. Both a Minority and Women Owned Business loan fund and the Mid-Hudson Valley Loan Fund are offered. The Kiva Zip crowd-funding program is also an option for a select number of course graduates.

Kiva Zip enables investors around the world to make interest-free $5 loans directly to small businesses and entrepreneurial endeavors in the United States and Kenya. Loans are paid back within two years.

The Orange County Chamber’s EAP center continues to look for innovative ways to aid local entrepreneurs.

Butler, Chief Executive Officer of Middletown Community Health Center, describes her vision for the O&W Restoration Project at MCHC’s recent reception launching its Pathway to Health Campaign at the estate of James and Beth Post in Middletown. Over 75 business and political leaders and friends of the center attended the event which raised over $10,000 for the $10 million undertaking is to restore the former New York, Ontario and Western railroad station on Low and Wickham Avenues in Middletown as MCHC’s new headquarters. The generation gap in the business world is something that is always evolving. Those that are older have a tough time relating to those just coming into the business who may be in their early 20s. Those 20-something-year-olds also have a difficult time relating to those who have been in the business arena for 20 years.

We are walking into the office with degrees where the ink is barely dry. Our brand new suits look crisp and barely worn. We are unsure and nervous as we embark on our career. One thing we are sure of is that we are ready for the challenges ahead and are willing to work towards our goals. We are aspiring to be in your shoes one day, but we can’t do it on our own. We need a mentor to show us the way. We are looking up to you.

We may seem intimidating with our twitter accounts and knowledge of pop culture, but we are as scared of you as you are of us. Take us out on a business lunch for some one-on-one time.

Not only will we learn a lot about each other, but we will connect and start to bridge the generation gap. We will no longer be the young Generation Y kid who can’t relate, and you will no longer be our boss who is out of touch with young society.

Other Local Filming: Cymbeline: A film directed by Michael Almereyda and based on the Shakespearean play of the same name. At Callahan & Nannini Quarry in Salisbury Mills, Cymbeline filmed a burial scene in addition to two others with the help of the Orange County NY Film Office. Jen D’Andrea, the Orange County Arts Council’s arts administrator, said these three scenes show “the versatility of Orange County” for filming.

the county be they visual, literary, musical, or performance. Its latest endeavor has been the foundation of the Orange County NY Film Office in April of 2013. The focus of the Film Office is to promote Orange County as “the friendliest place to film in all of New York State.”

“There’s an infusion of cash that comes into the community when a film is here,” said Dawn Ansbro, Executive Director of the Arts Council. With that in mind, the Film Office has set about making it easy for filmmakers to work in the county—so easy that they will want to return for future projects.

Some filmmakers, such as David Wilson and his wife Nan Gill-Wilson of Willy Gilly Productions, are operating in the county rather than being drawn from outside, and they want to see the local industry thrive as well. “There’s no other county that I’ve ever worked in that has the same potential to promote this industry,” Wilson said, citing Orange County’s proximity to New York City, as well as the three interstates connecting it to the rest of the Northeast.

With such promotion will come jobs. Wilson explained that for every $1 million that comes to the area through film, 500-1,000 jobs are created. If 10 percent of the film/television revenue from downstate came to Orange County, Wilson says 5,000 jobs would be created.

“More people are willing to shoot outside [New York City] while taking advantage of what’s in the city,” said Wilson. In order to attract these filmmakers to the area, Willy Gilly Productions trains local actors and technicians through its program, “Acting Anyone?”Wilson explained that the plan is to train area talent so filmmakers will not have to bring people from outside the county. Perhaps one day the film/ television industry in New York City will draw on Orange County as a resource. “We can train them here; we can export the talent,”Wilson said.

Wilson, however, would like to see a greater push to promote Orange County nationally at film festivals. “Everything you could possibly imagine could fit in a film is in the county limits. The problem is people don’t know that,” said Wilson of the county’s actors, technicians, scenery, and diverse communities.

Also, Umbra of Newburgh’s second filming location, Motorcyclepedia Museum, owned and operated by Ted Doering, has accommodated commercials for Autolite Spark Plugs and Ralph Lauren among others. The main soundstages have also been used for commercials such as promos for History’s American Restoration.

However, while there is a long way to go, Wilson also acknowledged the strides that Orange County has made in growing its film industry.“It’s a far cry from what it was when we started four and a half years ago,”Wilson said.

Filming in Orange County is also advantageous for filmmakers. Feature films, television shows, and televised movies shooting in New York State may qualify for the state’s Film Tax Credit Program (http://esd.ny.gov/BusinessPrograms/filmCredit.html) for either production or post-production costs.

Since the program requires at least one day of shooting take place on a qualified film location within the state in order for filmmakers to receive credit for production expenses, the Film Office encourages the use of Umbra of Newburgh.

“Our job is to be a liaison between filmmakers, municipalities and property owners,” said Ansbro, launching into an explanation of the Film Office’s collaboration with Jacobowitz & Gubits, a local law firm, to have towns adopt codes for local filming.

Thus far, the attitude surrounding this fledgling local industry is one of optimism.“A lot of people got a good feeling that there was filming in the area, like ‘hey, they’re filming a movie in my town!’” said Doering.

Lara added, “I think Orange County has a huge amount to offer the film industry.”

Hudson Valley Kitchen Design, a division of Hudson Valley Contracting Group, was one of the very first Orange County Chamber members to sign on as an Orange Advantage merchant. A few

The couple was leaning toward waiting for the spring to start their project, but the fact that they could earn rewards from working with Hudson Valley Kitchen Design that could be applied to another purchase for their remodel prompted the closing of the sale.” Hudson Valley Kitchen Design offers a 5% reward on any amount for cabinet boxes purchased. This customer was able to earn approximately $900 in rewards that they will be spending at other Orange Advantage merchants to complete their kitchen. “But the sale didn’t end there,” Santacruz continued. “Because the customers were so excited for their rewards, they hired Hudson Valley Kitchen Design to design and install their new kitchen. The benefits of Orange Advantage extend well beyond just what the reward is offered on.”

When adding new customers to your email marketing database, include a data field that enables you to send out regular emails to a select group of customers reminding them that they will soon need service on their HVAC system, an oil and filter change on their car, or landscaping.

S pecial Dates In addition to collecting names and home and email addresses, be sure to gather your customers’ birthdays, anniversary and other milestones. Send them a congratulatory email on their special day. Include a discount code or coupon to be used the next time they shop with you. For example, a travel agency can congratulate customers on their anniversary and offer a vacation package to celebrate.

S ervices or P roject U pdates Consistently showcase your work visually through email. If you own a home renovation or automobile customization business, for instance, snap pictures before, during and after a project, then share them with your customers. This will provide ideas for their next project and, perhaps, influence them to select you to do the work.
