Director’s Voice
Daryl Whicheloe, CCE, 2nd Vice President
Wow! As I sit here writing this month’s article, it is truly unbelievable to have imagined the world today compared to last month. Like all of you, I was excited for the upcoming Fair season. I was getting my trailers ready, planning my schedule, organizing and ordering equipment, and thought this was going to be a good year and then everything came to a screeching halt. COVID-19 sure changed my world and all of yours. Like so many others, I spent about a week or two of the quarantine doing nothing. Then I spent another two frustrating weeks applying for SBA assistance, with little to no success unfortunately. For all of those that were able to get some relief, I am very happy for you and hope this will ease your financial situations for now. I felt frustrated, lost, and I didn’t have a plan.
For thirty years plus, there has always been an event somewhere needing my services. Not always very profitable, but there has always been a way to keep busy, pay bills, and keep my employees working. Last week I had an employee ask why we didn’t set up one of our stands at the shop. My shop is a warehouse where I store all our equipment. It has a big parking area, on a fairly busy road, with power, water, and sewer—everything we need for a food stand. The notion seemed crazy to me at the time because I don’t do that kind of set up. With minimal optimism, I agreed to try it. I went to the Health Department and applied for a yearly permit, something I have never done in 30 years. On Wednesday, I opened with the employee who made the suggestion and my son came along just in case we got busy, which we did. My goal was to keep one to two guys working at least a few hours a day. What I can tell you is that people love Fair food and after being open for one week, I have needed

I sincerely hope we can utilize your talents and skills on the Board. On April 6th, one of our benefit partners, First Data, printed a COVID-19 Resource Guide for businesses and it is available on the NICA website. Be aware you have the ability as a small business to take advantage of either the SBA Paycheck Protection Loan, or the SBA Economic Injury Disaster Loan (EIDL). There is also access to credits for keeping employees on the payroll. Businesses can also defer certain payroll taxes for the remainder of the year. In some states, the government is allowing you to defer paying sales tax, licensing fees and more. These programs and benefits seem to be changing almost daily, so I suggest you check often for changes or updates. To conclude this month, I can only hope a month from now when we are putting the magazine together we have more information and a clear path to resuming business. “Together We Can Get Through This!” ▲ 6

Member’s Voice The greatest part of NICA is the Membership! The Member’s Voice influences where the organization is headed and what it can improve. The NICA Office has been continuing their survey of responses from Renewing Members. Randy Dewitz, CFEE, FanFare Attractions LLC, from Minneapolis, MN, just celebrated his first year as an Associate Member. When asked how he describes his relationship with NICA, he stated, “NICA is a very important organization in the Festivals and Events world. There are a limited number of large events in Minnesota that know about NICA. We at Fanfare have been exposing this wonderful organization to our 100 plus Concessionaires we do business with in Minnesota.” FanFare Attractions has been around for over 27 years, starting up in September 1994. Randy proudly states, “We build Festivals.” They work with city government and non-profit organizations that do Festivals and Special Events, specializing in the creation, production, and coordination of Outdoor Events. Randy goes on, “Between our top seven Events, we do over one million guests each year.” Randy himself has provided management services for the Festivals and Events Industry for over 37 years, receiving his Festival Manager certificate in 1993 and CFEE designation in 2016. He also served as the President of the MNFEA. He relates, “When I first started in the Fair world, I thought, ‘Wow, I am having a great time and getting

paid for it!’ I would not change this experience for the world. It is a tough Industry but very rewarding as well.” He feels that all of his Events are special. He states, “Each has their fun moments and experiences that become wonderful memories. Every key Event that we have been doing the past few years has brought about that ‘Family Reunion’ feel. Reconnecting to Event Staff, Suppliers, Volunteers makes working in this Industry worthwhile.” Since he only recently joined, he admits he is still working on using more of the benefits made available by NICA, but he thinks that exposing NICA to Concessionaires is a very rewarding benefit in and of itself, “especially when they have never heard of the organization.” As for any suggestions, he feels that “Building webinars may be a new program that may help NICA members.” Randy concludes on a motivating note: “Stay focused, keep moving forward. Today with COVID-19 impacting every inch of our world, it is really hard. We are a strong group. We will make it through. Stick together and help each other. This is going to be a long road, but we can make it through this challenging time. One of my events will be doing a virtual show that includes Food Concessions. They will promote them and showcase their products.” Thank you for your responses Randy! ▲ May 2020 NICA News

Winning is Fun!
Rey O’Day, Executive Director
Winning is fun and at NICA we like making opportunities for it to happen. Winning can happen unexpectedly or purposefully. Sometimes it happens when one takes a risk. Sometimes it happens when you are the recipient of another person’s kindness. Often it is random and at times it is very specific. We enjoy it when it is earned and we enjoy it when it is a surprise. And there is almost always a celebration or a high five that goes with it. As I reflected on our NICA events, I realized it is part of our culture. For instance, let’s reflect on three of our conventions: IAFE in November in San Antonio; WFA in January in Reno and NICA Business Expo/Fare Foods Food Show in February in Tampa.

Scholarship Winners • Congratulations to the 14 students who won scholarships in 2019! I meet our young people all across the country, but one of my my goosebump moments during the Annual Gala was to hear Isabella Barona share what her scholarship and education has allowed her to do in her young life. • First timer Scholarships provided the chance to attend Industry Conventions for those who have never attended: Rachael Wolfe, Highlands County Fair, was able to go to the IAFE Convention, and Jan Gary, CCE, West Council, and Karen Gary, Leap of Faith Adventures, were able to attend the NICA Business Expo.

Joining Together to Read & Win! Lori Hart, CFE, Director of Education & Member Services, IAFE The iconic Read and Win ribbon program, a cooperative effort of the International Association of Fairs and Expositions (IAFE) and the National Independent Concessionaires Association (NICA) is designed to UNITE Fairs with local schools, libraries, Concessionaires, Exhibitors, and Mobile Amusement providers. Local elementary students in grades one through eight are encouraged to read books, with the reward being the Read and Win ribbon and a voucher for use at the Fair. Depending on the Fair, these vouchers can be redeemed for complimentary Fair admission, Carnival rides in the Midway, a soft drink from their favorite Concessionaire, or something completely different. “This program continues to serve as a valuable benefit for our members,” said Lori Hart, IAFE Director of Education and Member Services. “Our relationship with NICA allows our Industry to ignite, excel and unite together to serve our local communities and provide an unforgettable experience for Fair guests.” The first 1,000 ribbons are given to IAFE members for no cost. Each Fair that participates in this educational program receives a survey to provide us with their valued feedback. In the past

year, we have received the following comments: “Utilizing this program, we have seen a growing trend with the return on investment from 2018 to 2019; there were 122 more youths and their relatives that took advantage of the admission special opportunity that we offer to those involved in the program!” “This is truly a great program that encourages youth to engage in reading, encourage fun, and also enhance learning through hands-on, face-to-face interaction with the Fair!” “We distributed 2,500 total tickets this year! We look forward to growing this impact and offering into the future—thank you to NICA for all the support and opportunity to keep reading an important aspect in youth development!” “I feel several children increased reading hours because they wanted to receive the ribbon. It was fun watching the children celebrate their achievements with their ribbons. What a great program!” “We will continue this each and every year!” IAFE members may order their Read and Win ribbons online at www.fairsandexpos.com or by contacting receptionist@fairsandexpos.com. ▲ WHEN PROMOTING YOUR BUSINESS WITH US, YOU... • • •

FUTURE BENEFITS MAY HINGE UPON
GOOD BUSINESS PLANNING
Mike Heffron, Minnesota State Fair (Retired) • Introduction by Rey O’Day, Executive Director One of my tasks as Executive Director over the past nine months has been to sort through many years of wonderful, engaging NICA stuff… and in it I have found some treasures. One of them is a document that was prepared for NICA around 2007 by Industry legend, Mike Heffron, the Retired Manager of the Minnesota State Fair. It is called “Future Benefits May Hinge Upon Good Business Planning.” It is a document that describes how to write a business plan for an entrepreneurial business. In this time at home during the pandemic I encourage you to take a fresh look at your business through the eyes of this timeless business practice. And before you do that, please enjoy reading a little bit about Mike… a man who
served this Industry with joy and all his DNA: David Michael “Mike” Heffron passed away at age 84 on Wednesday, March 4, 2020. Mike will be remembered for his love of and devotion to his family, friends, church, alma maters and the Minnesota State Fair. Born on June 15, 1935 and raised in St. Paul, he was proud to be Irish, gifted with the pen, quick-witted and deeply committed to entertaining and educating state Fairgoers. In 1953, as a high school student, Mike began working at the Minnesota State Fair and became General Manager in 1977, retiring after 43 years of loyal service in 1997. He was inducted into the Minnesota State Fair Hall of Fame, served as Past President of the Midwest Fairs Association and IAFE, and was inducted into the IAFE Hall of Fame.
Should certain rights attach to a Concession contract at the time of execution? And if the answer is yes, should those rights include extended term and a provision for the sale or transfer of the contract to a third party? These last two points have been the subject of debate for as long as Independent Concessions have existed... and the question is no closer to resolution today than it was in the beginning. As a practical matter, Industry-wide consensus on these questions cannot be expected in the near term. For many years, Concessionaires paid “privilege” to operate at an event—rather than rent. Typically, no additional rights were provided. Today, designations such as “rental contract” or “license agreement” are most often used to describe the Concession relationship. On occasion, extended term and some flexibility with respect to transfer are allowed. A transition to more elastic contractual forms will not likely become an Industry standard for two reasons:
change is a necessary component in building a successful event. These operators firmly believe that every aspect of the enterprise, including Concessions, must remain open to dynamic modification on a moment’s notice. 2. Management also knows that certain Concession operators will fail to qualify for an extended contract, and cannot be expected to ensure a trustworthy transfer. On these occasions, Event Management recognizes a duty to assess quality and operating integrity.

Let’s stop for a moment to review a few facts about the larger world of business. A successful business enterprise is built from the ground up much like a permanent structure. The process used to develop a business requires architecture to create form, a foundation to support the enterprise and organized building methods to assemble the framework and finish the structure. Operational functions, including personnel, raw material and equipment, are also basic to the development process. These steps are not complicated, but they are necessary. When brought together in written form, sorted and arranged in logical order, these combined steps become... the business plan.
Not every business owner knows that a business plan is required even though he or she might already have one and uses it every day. Like a computer program, it runs through the mind of the business owner as he operates; it is constantly updated as new information arrives in the form of experience; and it is used regularly to guide and adjust the daily operation of the enterprise. There are two basic problems with this informal approach:
associates we mentioned earlier—the ones who cannot read minds—these folks can often jump to conclusions... uninformed, inaccurate conclusions which imply that the Concession business is far too unstable for capital loans (the banker), extended credit (the supplier) or for shared decisions regarding length of contract, sale or transfer of business (the event executive). The job of correcting these inaccuracies rests, not with bankers, suppliers or event executives. It lies with the Concession operator who must create and 1. The human mind is not a computer. • Evidence of professionalism via use of uniforms, staff training on customer service, cash handling, etc. • A written log of efforts by the Concessionaire to give something back to events and to the local community NICA would be remiss if it did not provide this basic disclaimer: a written business plan, no matter how well designed, is no guarantee of success or extended benefits. It grants neither special advantage nor immunity from rules and penalties. A good plan cannot save a bad business nor can it convert an intransigent banker, supplier or event executive. NICA has effectively proven that honest, straightforward communications is far more productive than silence. To that end, Concession operators should learn to communicate the fact that they have a plan and furthermore, express a willingness to share that plan with those who have a need do know. This process will create trust. It is trust that promotes extended rights. We commend you for your efforts to increase the professionalism of your business! ▲
