thE DIRECtoR’s voICE Stacia Markowitz, treasurer

of being a nICa member, and yes, there are new ones, but it’s best if you read your NICA News Hi everyone! By now and find out about all the things we offer to our most of you are out on the road and busy, busy, busy! members. “Director’s voice” continued from Page 7 ►► We opened that week on time, with a smile knowing it was going to be okay. yes, “Together We Can.” When it was time to go home, the fellow next door (Donny Bryant) said not to worry. He had watched Mike all those years and knew what to do and he got it all ready to travel back to home base. I cannot spend enough time thanking all the people who helped and asked nothing in return, and all the people who offered; all nICa people that I had met at one time or another. I really now know that, “Together We Can” and we do. Have a wonderful season, make a ton of money, and I will see you down that road. ▲

Extending Condolences to the Neck Family Submitted by John Patriarca, Business Manager, ormic Concessions, Inc. We are deeply saddened by the passing of oran neck, Jr., 70, on Wednesday, april 9, 2014. He, along with Mickey, his wife of 51 years, founded Ormic Concessions, Inc. twenty years ago in Brownsville, tX. they joined nICa shortly after that in 1994. oran will be profoundly missed not only by his family and friends but by all those fortunate to have known him. Larry McConnell, CCE honored as Fairman of the Year Larry McConnell, CCe, McConnell Concessions, was announced as the Association of Iowa Fairs’ “2013 Fairman of the year” award recipient. their 2013 president, Joe yedlik, presented the award to Larry for his work as the vice president of Warren County Fair, Indianola, Ia. additionally, his Management Philosophy is featured in this month’s “Thoughts from a CCE” on page 16.

ChANgINg REguLAtIoNs Fred Simcic, truckers Accounting and Permitting service, Inc. (tAPs) UPCOMING SIMPLIFICATION TO IRP! Beginning in 2015, cab-cards will show all jurisdictions! no more “add state or province.” no more “over 100 percent fees” for added jurisdictions. If you have IRP, no more trip permits. this is true IRP-wide. all states and provinces will be implementing this. this has been referred to as Full Reciprocity or the Full Reciprocity Plan, and was adopted by IRP by ballot in october 2013. this will make it better on all classes of truckers. this will benefit the showmen more than anyone; when we have to do estimated miles for someone that only travels about 5,000 miles a year per truck, the state would use normal freight trucks estimates of miles, and that added 50% to 80% to your bill. you can send a full application to the state asking for a reduction based on your route, but you have to prove it and it takes a lot of time. this new system will be good because if you go to a state you normally don’t go to, you will pay the fees based on your travels in appears to the IRP.

tRAvEL sAFEtY tIPs Distracted Driving Laws Increasing Their Reach Through 2014 Driver distraction is a leading factor in many crashes, and cell phone use and texting are two of the most common distractions. Many states and local jurisdictions are passing laws that address these behaviors. Many experts advise not to use cell phones or other electronic devices at all while driving, regardless of the current law in your state or locality. hand-held Cell Phone use: 12 states, D.C., Puerto Rico, Guam, and the U.s. Virgin Islands prohibit all drivers from using hand-held cell phones while driving. Beginning in october 2013, all existing laws were based on primary enforcement—an officer may cite a driver for using a hand-held cell phone without any other traffic offense taking place. All Cell Phone use: no state bans all cell phone use for all drivers, but 37 states and D.C. ban all cell phone use by novice drivers, and 20 states and D.C. prohibit it for school bus drivers. text Messaging: Washington was the first state to pass a texting ban in 2007. Currently, 43 states, D.C., Puerto Rico, Guam and the U.s. Virgin Islands ban text messaging for all drivers. all but 5 have primary enforcement. an additional 4 states prohibit text messaging by novice drivers. 3 states restrict school bus drivers from texting. Commercial vehicle inspectors across north america completed 73,023 truck and bus inspections during 72 hours of Roadcheck 2013. of those inspections, a total of 47,771 were north american standard Level I inspections— the most comprehensive roadside inspection, in which vehicles and drivers are assessed for violations of federal, state or Canadian provincial safety regulations. other inspections conducted were vehicle-only or driver-only inspections. of Level I inspections conducted in Canada and the U.s., 24.1% were found with out-of-service (oos) violations. there were a total of 71,630 driver inspections, including those conducted during Level I inspections, from which 4.3% were found with oos violations. additionally, there were 899 seatbelt violations issued. Roadcheck 2013 included special emphasis on motorcoach safety, including traffic enforcement, as well as securement of cargo. Motorcoaches account for a fraction of the commercial vehicles on the road, but the importance of their safe operation is compounded by the many passengers they must safely deliver to their destinations. Jurisdictions reported a total of 1,471 motorcoaches were inspected during Roadcheck this year. Cargo securement related violations represented 11.7% of all oos violations issued during the event, down slightly from 12.3% in 2012. although this equates to only one out of every 50 vehicles inspected, loss of a load by a commercial truck is always a severe risk to safety. Inspectors always watch for signs of improperly secured loads such as inadequate number of tie downs, damaged webbing or chain, and other load securement violations. 12

Brakes routinely stand out in the mix of oos violations issued during Roadcheck. Last year, 49.6% of vehicle oos violations were related to brake adjustment and other brake system violations. additionally, performance based brake testers or PBBts were used during Roadcheck 2013. of the 287 enforcement inspections conducted with a PBBt, 36 vehicles or 12.5% were found with overall braking efficiency below the minimum required by U.s. regulation and the north american standard oos Criteria. since its inception in 1988, the roadside inspections conducted during Roadcheck have numbered over 1 million, resulting in more than 220 lives saved and 4,045 injuries avoided. It has also provided for the distribution of countless pieces of educational literature and safety events to educate industry and the general public about the importance of safe commercial vehicle operations and the roadside inspection program. Commercial Vehicle Safety Alliance (CVSA) sponsors Roadcheck with participation by the Federal Motor Carrier Safety Administration (FMCSA), Pipeline and Hazardous Materials Safety Administration, Canadian Council of Motor Transport Administrators, Transport Canada, and the Secretariat of Communications and Transportation (Mexico). Roadcheck is one of a series of activities that occur year round whereby CVSA-certified inspectors conduct compliance, enforcement and educational initiatives targeted at various elements of motor carrier, vehicle, driver and cargo safety, and security. The Certified Concessionaire Executive (CCE) program was developed to recognize the professionalism of Concessionaires. the title of CCe represents a deep understanding and respect for the fair and festival business and indicates that the titleholder will perform with the highest level of professionalism. this prestigious designation is awarded only after a detailed application process has been successfully met. In the first year, eleven people earned their CCe designation. to date, there is a total of 51 CCe designations. We would like to introduce these Concessionaires to you by publishing their personal philosophies of communication and management as it relates to the fair industry (one of the requirements for obtaining a CCe). this month, we chose Larry McConnell, CCe & Daryl Whicheloe, CCe.

“good Neighbor” continued from page 18 ►► Two days before the opening of the 2013 San Diego County Fair, I’m connecting power to my “almost new, paid way too much for” 5th wheel. After 30 years of experience, I pulled a rookie mistake and plugged into a 3-phase power source. I can still remember the smell of melting wire today. Well, to say the least, I needed help. I called an old friend, hoping he could recommend an electrician locally since he lived in the area. Gene, Brogdon Concessions, who was very busy setting up his own concession stand as well as supplying ice for the entire fairgrounds, came to my rescue… himself! He spent 3 hours of his pressed time and was able to get everything up and running. Later that day, he even tried to troubleshoot the freezer in my concession stand and said “this one is toast, call the ‘refer’ repair man!” Gene has a huge heart and puts others before himself! He’s truly a good guy!

We are in a competitive business. Many of us have been in this business for decades. Generations are taking over and bringing aggressive tactics to the table. It’s good to know that there is still a strong camaraderie within our industry, and that we can recognize a “Good Neighbor” when we see one. Dale Smith, Owner Family A Fair, Inc. Roadcheck 2014 Checklist for Drivers From a commercial vehicle safety inspector’s perspective, the point of the Roadcheck inspection is to ensure both your safety and those of others traveling on the highways. the costs associated with being put out of service are insignificant when compared to the costs of having an accident. Be proactive and inspect your vehicle thoroughly before you take your next trip, and especially before this year’s Roadcheck in June. the following list is adapted from the Roadcheck Checklist Pamphlet available at www.cvsa.org. BRAKEs Check for missing, non-functioning, loose, contaminated, or cracked parts on the brake system; check for “s” cam flipover; be alert for audible air leaks around brake components and lines; check that the slack adjusters are the same length (from center of “s” cam to center of clevis pin), and that the air chambers on each axle are the same size. Check brake adjustment; ensure the air system maintains air pressure between 90 and 100 psi; measure pushrod travel; inspect required brake system warning devices, such as aBs malfunction lamps and low air pressure warning devices; inspect tractor protection system, including the bleedback system on the trailer. CouPLINg DEvICEs Safety devices/full trailers/converter dolly(s): check the safety devices (chains/wire rope) for sufficient number, missing components, improper repairs, and devices that are incapable of secure attachment. on the lower fifth wheel, check for unsecured mounting to the frame or any missing or damaged parts, or any visible space between the upper and lower fifth wheel plates. Verify that the locking jaws are around the shank and not the head of the kingpin, that the release lever is seated properly, and that the safety latch is engaged. Check the upper fifth wheel for any damage to the weight bearing plate (and its supports) such as cracks and loose or missing bolts on the trailer. on the sliding fifth wheel, check for proper engagement of locking mechanism (teeth fully engaged on rail); also check for worn or missing parts and ensure that the position does not allow the tractor frame rails to contact the landing gear during turns. Check for damaged or missing fore and aft stops. FuEL & ExhAust sYstEMs Check your fuel tanks for the following conditions: loose mounting, leaks, or other conditions; loose or missing caps; and signs of leaking fuel below the tanks. For exhaust systems, check the following: unsecured mounting; leaks beneath the cab; exhaust system components in contact with electrical wiring or brake lines and hoses; and excessive carbon deposits around seams and clamps. FRAME, vAN & oPEN-toP tRAILERs Inspect for corrosion fatigue, cross member(s) cracked, loose or missing, cracks in frame, missing or defective body parts. Look at the condition of the hoses, check suspension of air hoses of vehicle with sliding tandems. on the frame and frame assembly, check for cracks, bends, sagging, loose fasteners or any defect that may lead to the collapse of the frame; corrosion, fatigue, cross members cracked or missing, cracks in frame, missing or defective body parts. Inspect all axle(s). Inspect for non-manufactured holes (i.e. rust holes, holes created by rubbing or friction, etc.) and for broken springs in the spring brake housing section of the parking brake. For vans and opentop trailer bodies, look at the upper rail and check roof bows and side posts for buckling, cracks, or ineffective fasteners. on the lower rail, check for breaks accompanied by sagging floor, rail, or cross members; or broken with loose or missing fasteners at side post adjacent to the crack. LIghtINg Inspect all required lamps for proper color, operation, mounting, and visibility. sECuREMENt oF CARgo Make sure you are carrying a safe load. Check tail board security. Verify end gates are secured in stake pockets. Check both sides of the trailer to ensure cargo is protected from shifting or falling. Verify that rear doors are securely closed. Where load is visible, check for proper blocking and bracing. It may be necessary to examine inside of trailer to assure that large objects are properly secured. Check cargo securement devices for proper number, size and condition. Check tie down anchor points for deformation and cracking. stEERINg Check the steering lash by first turning the steering wheel in one direction until the tires begin to pivot. then, place a mark on the steering wheel at a fixed reference point and turn the wheel in the opposite direction until the

tires start to move again. Mark the steering wheel at the same fixed reference point and measure the distance between the two marks. the amount of allowable lash varies with the diameter of the steering wheel. susPENsIoN Inspect the suspension for: indications of misaligned, shifted, cracked, or missing springs; loosened shackles; missing bolts; unsecured spring hangars; and cracked or loose U-bolts. also, check any unsecured axle positioning parts and for signs of axle misalignment. on the front axle, check for cracks, welds, and obvious misalignment. tIREs, WhEELs, RIMs & huBs Check tires for proper inflation, cuts, and bulges, regrooved tires on steering axle, tread wear, and major tread groove depth. Inspect sidewalls for defects, improper repairs, exposed fabric or cord, contact with any part of the vehicle, and tire markings excluding it from use on a steering axle. Inspect wheels and rims for cracks, unseated locking rings, and broken or missing lugs, studs, or clamps. also check for rims that are cracked or bent, have loose or damaged lug nuts and elongated stud holes, have cracks across spokes or in the web area, and have evidence of slippage in the clamp areas. Check the hubs for lubricant leaks, missing caps, or plugs, misalignment and positioning, and damaged, worn, or missing parts. Regular maintenance and frequent checkups are not only good advice to prepare for Roadcheck 2014; they prevent faults and longterm damage to your vehicle. NICA West’s golf Cart Winner Cliff Munson, Ceo of the Siskiyou Golden Fair, won this nICa West sponsored cart during the NICA Sysco Marketplace in anaheim, Ca. Cliff is pictured in front of nICa West’s “Member-atLarge” Daryl Whicheloe, CCe’s Kurly Fries stand. Daryl transported the golf cart up to Cliff’s Fair on his way home to oregon.
