President’s Message Joe Potillo, Jr., President
As I write this month’s article, it is a pleasure because there are so many exciting things happening with NICA. I will attempt to give the “Readers Digest” version in this article. The NICA Board of Directors (BOD) completed a very successful and productive Spring Workshop April 6-9, which consisted of four days of meetings and strategic planning. With an emphasis on completing the agendas of former administrations, addressing the current state of the organization, and setting a visionary path for the future, the BOD took on a very aggressive workload. To assist in making this happen, facilitators Rey O’Day of Pomona, California and John Leamer of Buffalo, NY worked with the BOD prior to and during the workshop. The following were some of the things accomplished: 1. Review of Partnerships and Future Planning with representatives from Sysco/Source 1 and Fare Foods. 2. Clearly Defining the role of the BOD. 3. Administrative / Office assessment and implementation of a new office structure. 4. Labor Issues Committee appointed.
5. Execution of contract with a new Office Manager. 6. Selection of Rey O’Day as interim Executive Representative / Facilitator for Search Committee. 7. The appointment of Dennis Fraleigh as the chairman of the Executive Representative search committee. 8. Budget Realignment and Review 9. Progress Report of long and short term goals 10. Review of By-Laws and Policies and Procedures There are a few other things that, for the sake of time, I won’t list here but I encourage each of you to stay on the lookout. In closing, as we prepare for the season, the major concern of many of our members is labor. The H2B Visa Program has yet again encountered major road blocks leaving some without the workforce they rely on. While we may think of this as a show-owner’s-only issue, I will say boldly it is NOT. It is an issue that could greatly affect our industry as a whole. Go to the NICA web page at www.nicainc.org for more information on this issue and how you can help make a difference. As Willie Nelson sang, “On the road again...” He sings a line that says the life he loves is “making music with his friends”; change that word “music” to “memories” and it applies to all of us. I would like to really thank our President, Joe Potillo, Jr., who has went far and beyond to help manage the office staff while we were in transition of hiring an Office Manager. I don’t know of too many people who would step in and run an office while their business is in full swing. That’s what I love about NICA; members always helping someone! Joe and Stacia Markowitz, Director, weeded thru many applications for the Office Manager position. Then they picked out some for faceto-face interviews, and with the help of the Executive Board, we are glad to announce we have hired an Office Manager - Yachika Smith! The Board officially met her at the Spring Workshop as we developed relationships and gave guidance for the growth of NICA. Since the 2nd Vice President is always over the Food Show and Business Expo, I am already working to create a fun, informational, and profitable Show for all. Please let me know if you have something new you would like to see at the Business Expo. The Show will be a little different this year, because Florida Week falls during the Florida State Fair. “My philosophy of communications and management of my business, as it relates to Fair business, is based on the one thing we all must have in our industry: the ability to communicate with people. It is important that we stay in communication with management, employees, and each other. If we build or remodel a stand, we must talk to Fair Management, we have to keep them apprised of what we are doing. Can they accomodate our new unit? Do they have enough space, power, water, etc.? We can not expect them to know when we are changing if we do not communicate with them. Are they changing an area, are they moving a gate, are they putting in a stand with similar products? We must communicate with them if we expect them to communicate with us. The same goes for our staff. Again, communication is vital going both ways. It must be restated; we must communicate with the Fairs, our staff, and the public. Our management style is, and always has been, to be the best we can be, to give the best service and the best value, and to always stand behind our product 110%. Scholarship Created to Honor Memory Diane L. Burmeister, age 69, longtime resident of Oak Park, Illinois, passed away March 13, 2015. She was the beloved secretary and historian for the Showmen’s League of America, NICA Associate Member, and she will be missed greatly by the lives she has touched. Our thoughts are with her loved ones at this difficult time. In honor of Diane, SLA President Paul Kasin has established a Memorial Scholarship fund in her name. Dates Announced for 2016 Florida Week It’s Official! Groundwork has been set in place for the planning of next year’s Florida Week, revolving around the NICA Business Expo and 2016 Fare Foods Food Show, scheduled for February 8-10, 2016, and the International Independent Showmen’s Association’s 2016 “Gibtown Extravaganza,” scheduled for February 9-13, 2016. These events coincide with the Florida State Fair’s run, scheduled for February 4-15, 2016, so there’ll be plenty to do! Look forward for more announcements in the coming months! 10

Member’s Voice Continuing where they left off on the last issue, the NICA Office has been recording the responses from their survey of renewing members. Jeff Thornberry, Pristine Systems, Inc. DBA Gadgets and Neat Stuff, stated that his relationship with NICA is good and is getting better as NICA has done much to expand westward. Since he is a Commercial Exhibitor, as opposed to a Food Concessionaire, he only makes use of some of the tangible benefits. However, he really likes the intangible ones such as networking, promoting, professionalism, and extending the communication between Fairs and Festivals. NICA is a volunteer organization and, as such, is doing “an okay job as is.” He looks forward to seeing the NICA News every time it comes out. He thinks it is very well done and prefers the paper copy, as he works on computers a lot and prefers not to read it there. He hopes to get time to apply for the CCE Program soon. Bob Fiste, Fiste Enterprises, LLC, dba Bowman’s Concessions, working in Ohio, said that he has a good relationship with NICA. He makes use of most of the benefits especially those with Pepsi and the “hardware ones.” He makes sure he reads the NICA News every month. The Concessionaire of the Month is of special interest to him because he finds it interesting to learn about how others got started in the business. The information given in the NICA News enables him to stay updated with the happenings affecting our businesses and lets him know about new programs offered by NICA. “It does a great job!” Bob feels that “NICA has our backs and supports us as Concessionaires.” Becky Harmon, Harmons Concessions, out of Kentucky, took time from her house building to say that her relationship with NICA has been very good. She likes the “kick back on the soda especially. Becky enjoys reading the NICA News, her favorite articles being about the concessionaires themselves. She said that she
highly recommends NICA to her friends and other Concessionaires. Don Morgan, Morgan Family Enterprise, LLC, said that he is not like a lot of the Concessionaires since he plays mainly in Indiana, not traveling all over like most. He felt that his relationship with NICA is fine. The benefit that has helped him the most has been the credit cards with First Data. It has been very positive for his business. The most surprising thing to him is the fact that the younger people use credit cards the most, as they do not seem to carry cash any more. He admitted that he only glances at the NICA News, but his wife reads it from cover-to-cover so that he does not miss anything important. They both like to read about other Concessionaires, how they started, and what they do, as this sometimes gives them an idea of something to try. The complaint that he has heard more than any other goes back to the beginning of NICA: the “plastic bottles versus bag-in-box” argument. Robert Monroe, L. T. Concessions, says that he has a pretty good relationship with NICA. He feels that the NICA News is the greatest benefit he gets from NICA. It is very informative and he especially enjoys the articles about other members and how they got started, what they do differently as it can help give him new ideas. NICA seems to be headed in the right direction thanks to the volunteers leading it willing to give their time and dedication. He stated that before he purchased property in Florida that he used the CheckInn Direct benefit the most. Having been in the business for more than 35 years, he commented that “it is a fun job for my family and you can’t ask for more than that!” The NICA Office plans to continue these calls to our renewing members in the new year. We hope that hearing their personal stories will help you make better use of the available NICA Benefits or think of ways you could contribute. Travel Safety Tips U Drive. U Text. U Pay. Campaign Cracks Down on Distracted Driving National Transportation & Highway Safety Administration U.S. Transportation Secretary Anthony Foxx kicked off Distracted Driving Awareness Month in April by announcing the “U Drive. U Text. U Pay.” National Distracted Driving Enforcement Campaign. From April 10-15, state and local law enforcement aggressively ticketed drivers who are texting or using their mobile devices when behind the wheel. The Secretary made the announcement in Washington, D.C., where young drivers demonstrated the dangers of distracted driving on a temporary test track. Secretary Foxx was joined by Mark Rosekind, Administrator of the National Highway Traffic Safety Administration (NHTSA). “Distracted driving kills, there is no excuse for it, and it must stop,” said Secretary Foxx. “Across the country, we’re putting distracted drivers on notice: U Drive. U Text. U Pay. Texting and driving will at least cost you the price of a ticket but it could very well cost you your life or someone else’s.” Based on fatal accident reports, NHTSA data shows that at least 3,154 people were killed in crashes involving all distracted drivers in 2013, including those who were texting and driving. NHTSA estimates that 424,000 Americans were injured in all distraction-affected crashes in 2013. Key statistical findings in NHTSA’s new Distracted Driving Traffic Safety Facts and Teen Distracted Driver fact sheet include: Ten percent of fatal crashes, 18 percent of injury crashes, and 16 percent of all motor vehicle traffic crashes in 2013 were reported as distraction-affected crashes, which are defined as any crash in which a driver was identified as distracted at the time of the crash.

Ten percent of all drivers 15 to 19 years old involved in fatal crashes were reported as distracted at the time of the crashes. This age group has the largest proportion of drivers who were distracted at the time of the crash. 244 Americans aged 15 to 19 were killed in distraction-affected crashes. In 2013, there were 480 non-occupants killed in distraction-affected crashes. “Young people need to understand the dangers of texting and driving before it kills them or someone they love,” said Administrator Rosekind. “It’s up to us as parents to set the right example by never texting and driving ourselves, and by laying down the law for our young drivers: no texting behind the wheel or no keys to the car. These are driving safety lessons that young drivers will carry with them throughout their lives.” Chief David W. Ennis of the United States Naval Academy Police Department also shared his experience of ticketing drivers for distracted driving, and discussed the consequences of distracted driving crashes. Chief Ennis spoke on behalf of thousands of law enforcement personnel nationwide who are using traditional and innovative strategies to crack down on motorists who text and drive. The awareness effort is supported by a $5 million national television, radio and digital advertising campaign, which ran from April 6-15, and reminded the public of the deadly consequences of distracted driving, and the financial penalties for violating state distracted
driving laws. Forty-five states, the District of Columbia, Puerto Rico, Guam and the U.S. Virgin Islands ban text messaging for drivers of all ages; 14 states and territories prohibit drivers of all ages from using hand-held cell phones while driving; and 38 states plus the District of Columbia ban cell phone use by novice drivers. Two states, Oklahoma and Texas, restrict school bus drivers from texting.

Getting Ready for the 2015 Roadcheck by Examining 2014’s Results Between June 3 and June 5, 2014, the annual CVSA International Roadcheck was conducted. This is an annual event where big rigs and other vehicles are randomly inspected across Canada, the United States, and Mexico over the 72-hour period. Last year, 73,475 truck and bus inspections were conducted with 49,656 being North American Level I Inspections. That’s the most thorough roadside inspection possible. Level I inspections include a 37-step procedure that involves an examination of both the driver’s record of duty status and the safety of the vehicle. “The inspections conducted during the threeday International Roadcheck event are the same types of inspections conducted every day by hard-working CVSA-certified inspectors,” said CVSA President Sgt. Thomas Fuller with the New York State Police. “International Roadcheck provides the opportunity to promote safety improvement efforts and accomplishments that enforcement and industry achieve every day.”
Vehicle Inspections This year’s results were pretty similar to last year’s. Out of all the inspections that included vehicles (any level), 18.7% were placed out of service this year compared to 20.6% last year, so there was a decent-sized improvement on that front. Including only Level I inspections, 23% of vehicles were placed out of service, compared to 24.1% last year. The major emphasis of last year’s Roadcheck event was HazMat inspections with HazMat
certified inspectors at many of the 2,500 locations set up across North America. Even with the increased emphasis last year, 16% of vehicles were placed out of service due to HazMat violations (compared to 16.5% last year). Passenger carrying vehicles were the exception to the other rules as there were more placed out of service during Roadcheck 2014 than during Roadcheck 2013. Last year, 9.3% of passenger carrying vehicles were placed out of service compared to 7.1% the previous year. Among out-of-service violations for vehicles, brakes were the biggest culprit with 29.5% of vehicles placed out of service for brake system violations and 16.7% placed out of service due to poor brake adjustment. Tires/wheels, lights and safe loading issues make up the rest of the top five reasons for out of service violations for vehicles.

Rey O’Day, NICA West Executive Manager From April 6 – 9, the NICA Board of Directors (BOD) gathered down by the riverside in Jacksonville, FL for its annual Spring Planning Meeting. As many do, our Board went to the river to think, plan, visit and celebrate. Early on Tuesday, Facilitators John Leamer, Erie County Fair Director, and Rey O’Day, NICA West Executive Manager led a discussion using the booklet “Boards that Lead & Succeed” by Bill Charney. The workshop session focused on defining effective governance and 10 principles for effective board leadership. Each Board member was asked to define their strengths, level of participation, resources, and problem solving styles. That was followed with a look at other BOD models: size, executive committees, working committees, policies and by-laws, revenue streams, and foundations. Realizing there was much work to be done, the BOD voted

to add Jennifer Giordano, two term NICA West Council Member, as an Ex-Officio Member of the Board. Armed with data and the confidence that comes with new insights Jennifer Giordano, and skills, the NICA Board Ex-Officio Board committed to becoming Member a more effective BOD by “achieving appropriate results” for the NICA Membership. The next day was devoted to Staffing: what is the work that needs to be done and who will do it? At the conclusion of this session, the BOD approved the hiring of Yachika Smith as Office Manager and the promoting of Jesse Willard to Communications Coordinator. The BOD also asked Rey O’Day to serve as the Interim Executive while a search for a new Executive Director is conducted. O’Day responded that she is “honored to coordinate the work of NICA with our BOD, Staff, Membership, and Industry Partners during this important transition.” The afternoon was spent evaluating the 2014-2015 long term and short term Strategic Goals and committing to the 2015-2016 Strategic Goals. The new working goals revolve around four areas: 1. Growing and serving membership 2. Being an active voice in the fairs and events industry 3. Creating benefits for our members that make a difference
4. Continuing to be a financially responsible and stable organization. Watch for an article on those in the upcoming NICA News! Throughout the meetings, several people came by to speak with the BOD. Important benefit partners Audrey Poole, Fare Foods and Bob Bassett, Source1 Purchasing shared their 2014 accomplishments and 2015 plans. They also shared tips about how to more effectively work together. These two organizations are committed to making our members’ businesses more profitable, and therefore, more successful. SanDee O’Brien shared her wisdom and knowledge about NICA and Yachika Smith began her journey learning about NICA. Mike Markowitz, Jeff Ross, and Norm Keene shared in the evening fellowship. The BOD closed the last day with a formal board meeting where reports were given, motions were made and plans for the next chapter of effective, functional governance were put into place. Once again, “Together We Can!” was actively at work. Oh yes, and the next time you need to plan, think, visit or celebrate, head down to the riverside near you. Satisfaction guaranteed! ▲

“Travel Safety Tips” continued from page 13 ►► Counting on Level I inspections, though, 4% of drivers were placed out of service this year compared to 4.3% in 2013. There were also more drivers placed out of service for HazMat violation and more passenger carrying drivers placed out of service as well. Among the out of service violations issued for drivers, 46.5% came from Hours-of-Service violations, which is down from over 50% in each of the last three years. False logs and DQ’ed drivers were the second and third biggest reasons respectively for drivers to be placed out of service. Drivers driving with a suspended license and improper endorsement round out the top five reasons drivers were placed out of service.
Roadcheck 2015 Checklist for Drivers From a commercial vehicle safety inspector’s perspective, the point of the Roadcheck inspection is to ensure both your safety and those of others traveling on the highways. The costs associated with being put out of service are insignificant when compared to the costs of having an accident. Be proactive and inspect your vehicle thoroughly before you take your next trip, and especially before this year’s Roadcheck, running from June 2-4, 2015. The following list is adapted from the Roadcheck Checklist available at www.cvsa.org. BRAKES Check for missing, non-functioning, loose, contaminated, or cracked parts on the brake system; check for “S” cam flipover; be alert for audible air leaks around brake components and lines; check that the slack adjusters are the same length (from center of “S” cam to center of clevis pin), and that the air chambers on each axle are the same size. Check brake adjustment; ensure the air system maintains air pressure between 90 and 100 psi; measure pushrod travel; inspect required brake system warning devices, such as ABS malfunction lamps and low air pressure warning devices; inspect tractor protection system, including the bleedback system on the trailer. COUPLING DEVICES Safety devices/full trailers/converter dolly(s): check the safety devices (chains/wire rope) for sufficient number, missing components, improper repairs, and devices that are incapable of secure attachment. On the lower fifth wheel, check for unsecured mounting to the frame or any missing or damaged parts, or any visible space between the upper and lower fifth wheel plates. Verify that the locking jaws are around the shank and not the head of the kingpin, that the release lever is seated properly, and that the safety latch is engaged. Check the upper fifth wheel for any damage to the weight bearing plate (and its supports) such as cracks and loose or missing bolts on the trailer. On the sliding fifth wheel, check for proper engagement of locking mechanism (teeth fully engaged on rail); also check for worn or missing parts and ensure that the position does not allow the tractor frame rails to contact the landing gear during turns. Check for damaged or missing fore and aft stops.

FUEL & EXHAUST SYSTEMS Check your fuel tanks for the following conditions: loose mounting, leaks, or other conditions; loose or missing caps; and signs of leaking fuel Roadcheck below the tanks. For exhaust 2015 systems, check the following: unsecured mounting; leaks beneath the cab; exhaust system components in contact with electrical wiring or brake lines and hoses; and excessive carbon deposits around seams and clamps. FRAME, VAN & OPEN-TOP TRAILERS Inspect for corrosion fatigue, cross member(s) cracked, loose or missing, cracks in frame, missing or defective body parts. Look at the condition of the hoses, check suspension of air hoses of vehicle with sliding tandems. On the frame and frame assembly, check for cracks, bends, sagging, loose fasteners or any defect that may lead to the collapse of the frame; corrosion, fatigue, cross members cracked or missing, cracks in frame, missing or defective body parts. Inspect all axle(s). Inspect for non-manufactured holes (i.e. rust holes, holes created by rubbing or friction, etc.) and for broken springs in the spring brake housing section of the parking brake. For vans and open-top trailer bodies, look at the upper rail and check roof bows and side posts for buckling, cracks, or ineffective fasteners. On the lower rail, check for breaks accompanied by sagging floor, rail, or cross members; or broken with loose or missing fasteners at side post adjacent to the crack. LIGHTING Inspect all required lamps for proper color, operation, mounting, and visibility. SECUREMENT OF CARGO Make sure you are carrying a safe load. Check tail board security. Verify end gates are secured in stake pockets. Check both sides of the trailer to ensure cargo is protected from shifting or falling. Verify that rear doors are securely closed. Where load is visible, check for proper blocking and bracing. It may be necessary to examine inside of the trailer to assure that large objects are properly secured. Check cargo securement devices
for proper number, size and condition. Check tie down anchor points for deformation and cracking. STEERING Check the steering lash by first turning the steering wheel in one direction until the tires begin to pivot. Then, place a mark on the steering wheel at a fixed reference point and turn the wheel in the opposite direction until the tires start to move again. Mark the steering wheel at the same fixed reference point and measure the distance between the two marks. The amount of allowable lash varies with the diameter of the steering wheel. SUSPENSION Inspect the suspension for: indications of misaligned, shifted, cracked, or missing springs; loosened shackles; missing bolts; unsecured spring hangars; and cracked or loose U-bolts. Also, check any unsecured axle positioning parts and for signs of axle misalignment. On the front axle, check for cracks, welds, and obvious misalignment. TIRES, WHEELS, RIMS & HUBS Check tires for proper inflation, cuts, and bulges, regrooved tires on steering axle, tread wear, and major tread groove depth. Inspect sidewalls for defects, improper repairs, exposed fabric or cord, contact with any part of the vehicle, and tire markings excluding it
from use on a steering axle. Inspect wheels and rims for cracks, unseated locking rings, and broken or missing lugs, studs, or clamps. Also check for rims that are cracked or bent, have loose or damaged lug nuts and elongated stud holes, have cracks across spokes or in the web area, and have evidence of slippage in the clamp areas. Check the hubs for lubricant leaks, missing caps, or plugs, misalignment and positioning, and damaged, worn, or missing parts. Regular maintenance and frequent checkups are not only good advice to prepare for Roadcheck 2015; they prevent faults and long-term damage to your vehicle. Plus, they ensure that you, the driver, will benefit the most of all by driving safely for the rest of the year! â–˛
