With 2019 already three months in, many of us have started or are starting our season. May we all be blessed with sunny skies and warm weather when it soon turns to Spring. 2018 was my first year on the NICA Board of Directors and it was truly eye opening to see how much time and effort our past and present Boards put into our great organization. With our Industry constantly changing and evolving, I look forward to working with our Board and Councils to tackle whatever lies ahead. We hope everyone enjoyed the NICA Business Expo and Fare Foods 2019 Food Show. It was a great success with a record attendance, especially on Tuesday night’s Food Show. The Workshops and Roundtables were both

inspirational and informative, with a large presence by Concessionaires and Fair Management. A big shoutout to Fare Foods and our Office Staff for making this come together. “Together We Can!” ▲

Involvement & What it Does for You— Give & Get Back! Kevin McGrath, CCE, Director NICA is always trying to get members more involved on an Industry basis. Why should you participate? It isn’t just to help the organization. It is to take an active roll in the Industry that determines your future. I always come away from meetings with new ideas I can share with fellow Concessionaires and my Fairs. I have also learned ways to improve my operation. Attending these meetings have given me a better understanding of what the Fair and Patrons needs are. It has been a great experience—YOU can have the experience also. NICA is looking for volunteers to attend any IAFE State Association or Zone meetings in many different capacities. Start simple—any Concessionaire interested in attending one of these events can get all the information they need from the NICA Office or myself. Board Members attend these meetings frequently and would appreciate connecting with you there. If you are already familiar with your regional meeting, maybe you can increase your involvement by representing NICA. We can show you how you can help. A New Season Brings New Challenges Kim Barr, CCE, Director We are just starting our season for the 2019 year and I am super excited to see what this new season brings for all of us! There are always new adventures, ideas, and challenges to experience for all of us in the new year! With that in mind, NICA continues to help accommodate Fairs, Entertainers, and Commercial Exhibitors to the best of their abilities in the Industry. Our first event was in Indio, CA at the Riverside County Fair and National Date Festival. We opened on February 15th, but the day before, on the 14th, the county experienced their third worst storm since 1943—flooding was everywhere! The Fair had the county out on the grounds trying to drain water, and we still opened on time. We didn’t have the greatest weather for the first eight days, but the last two days were fabulous and sunny! The Fair staff was super and tried their hardest to get the Fair open. Kudos to all the great staff there for making it the best Fair for the conditions they had to deal with! ▲

The H-2B labor issue is not a Carnival problem, it’s not a Concessionaire problem, and it’s not a Fair problem. It is an Industry problem that ultimately effects each sector that defines the Fair Industry. We are all in this together! As of January 29, 2019, nearly 50% of all Fair Industry H-2B applicants will most likely NOT receive their requested 3,000 H-2B foreign skilled labor workers. This includes carnivals, Concessionaires and gaming concessions totaling over 175 Fair Industry Employers nationwide. Recent events out of Washington, including the longest government shutdown in the history of government shutdowns, has stalled efforts to approve language that could have increased the current annual H-2B worker cap of 66,000 to 132,000. Paralleling the shutdown were two separate iCERT crashes on December 31st and January 7th. These government website crashes forced late timestamps on applications that nearly guarantee employers will not receive H-2B workers. “With the Department of Labor stating that they will process via strict first-in, first-out policy, what this means is that due to the demand for visas (three times as many applications as visas that are available) then those that were delayed by the server issue will be capped out for the second half of the fiscal year.”­­– James K. Judkins, JKJ Workforce OABA’s legal obligations to H-2B well exceeds $350,000 annually. Fairs, Concessionaires and Exhibitors will all feel the devastating effects without the necessary labor required to move, set up and operate Carnivals and Concessions. For over a decade, the NICA Board of Directors has successfully voted to support these efforts with financial contributions, lobbying efforts, callsto-action and sharing the message publicly at Industry forums. The primary need for continued support in addition to financial contributions is ACTION! Please heed this call to action and make the call, send the email, write the letter. “Together We Can!”

Call Your Elected Officials: • You can reach your Senators and Representative at (202) 225-3121. Once connected to the office, ask to speak to the staff person who handles H-2B issues. • If your Senator or Representative is a conferee, please ask that the Senator or Representative include H-2B cap relief in future DHS spending bills. • If your Senator or Representative is not a conferee, please ask the staff to have the Senator or Representative speak to encourage his or her party leadership and conferees to include H-2B cap relief in future DHS spending bills.

Email Your Elected Officials: Please email your Senators and Representative asking them to include meaningful H-2B cap relief in a future spending package. Thoughts from a This month’s Statements of Communications & Management Philosophy is from one of our recently inducted group of Certified Concessionaire Executives: Jennifer Giordano, C&C Concessions C&C Concessions is a family operation. Since my father-in-law started the company in 1964, a lot has changed in our Industry! One thing that has not is the need for open and honest communication. This needs to take place with our Fairs, peers, and our employees. In order to achieve true communication, you have to be a great listener, you have to look at issues from others’ perspectives (not only your own) and be willing to make changes when necessary. I believe you must be hands on to be successful. Working side-by-side with our employees and key management helps keep the lines of communication open and allows me to have a better understanding of all aspects of our business. There is no job I am unwilling to do myself that I ask another to do. We strive to have a product we are proud to serve and believe you should never sell anything you would not truly enjoy experiencing yourself. Be a good neighbor by celebrating others’ successes, whether it is a Fair, Carnival, or another Concession, and by sharing your own. Get involved in Communication Committees and always try to be positive and constructive. Open and honest communication benefits everyone and contributes to the success of the Industry and all of us who have the pleasure of making happy memories. ▲

The NICA Business Expo opened on Monday, February 4th with “Soda Parts, Equipment, and Repair,” presented by Mike Curci, Soda Parts Express. The workshop offered a full-suite of information regarding Mike Curci, Soda Parts Express, taking equipment repair, soda questions from the machine maintainance, audience and how it affects a Concessionaire’s bottom line. The next presentation was “Vendor Safety,” by Phil Teague, Hummel Group. He discussed catastrophic loss and the unique needs that the Fair Industry, especially Concessionaires, have Phil Teague, Hummel in regards to safety and Group, speaking regulatory compliance in about compliance terms of their vehicles. “Ask an Insurance Agent,” continued the theme from the previous session with the added knowledge of Steck Johnson, Healthcare Solutions, and Brian Thompson, Hummel Group, who fielded a series of questions from attendees regarding claims, healthcare, property insurance, and more. Next up was “Nutella,” a workshop presented by Ferrero USA’s Andy Larkin and Chef Victor Dell’Aquila. They Andy Larkin and presented several ways Victor Dell’Aquila, to incorpoate Nutella and Ferrero USA related products into “any operator menu” and provided samples of all prepared food. “Payment Processing” followed, presented by Tina Hollis, First Data. Regarding the topics of the session, she states, “we discussed Clover Product updates for 2019. We also reviewed Tina Hollis, First Data, how to read First Data discussing payment options and billing statements and billing,

along with importance of PCI Compliance and how to complete your annual certification.” “New Techniques and Food Items” was the final session of the day, presented by Audrey Poole, Fare Stephen Canale, RoboLabs, Foods. This seminar showcasing their floating highlighted Vendors cotton candy machine that were exhibiting in the Food Show, including Mr. G’s, A to Z, RoboLabs, and RJ Schinner. Poole stated, “We had some great feedback and even after the show we were still getting compliments. “Expo” continued from page 15 ►► Tuesday, February 5th began with “Generation Forward,” hosted by Kathy Ross, CCE, NICA President. This was a roundtable where members of this newly formed Committee discussed their ideas and goals regarding their first year of activity. Rey O’Day, Executive Manager of Councils, moderated the following panel-led workshops, starting with “Communication Committees and the Nationwide Buzz of Having One,” featuring a panel of Tom Hodson CCE, NICA Past President and Southeast Council Member, Kathy Kramer, CFE, OC Fair CEO, and Jessica Underberg, CFE, Erie Country Fair CEO. Hodson reminded us that Communications Committees were NICA’s purpose 26 years ago and they still Tom Hodson, are today: “My opinion of CCE, Past Communication Committees President is simple—it doesn’t matter what size event you have, it can be a benefit.” Kramer told us her Committee gives her a chance to listen and make changes like dropping the collection of pre-Fair deposits because it provided efficiencies to her staff and working capital for the Concessionaries. Kathy Kramer, Underberg pointed out that CFE, OC Fair, working with her Committee sharing her has provided collaboration experiences between her Concessionaires and her agricultural program in significant ways that benefit the young people that enter the livestock competitions. O’Day shared that NICA has a how-to pamphlet with tips on forming a Communications Committee. Harrison shared the key aspects of what it costs to do business as a concession business: rent, labor and cost of goods, all of which are rising at alarming rates. He stressed Russ Harrison, CCE, Past that communication is the President key: Concessionaires need to understand what it is costing Fairs to do business and vice-versa so that each can make decisions to help all parties keep pricing down. Chieko observed as he moves from Fair Management to OABA leadership that all parties have taken the financial numbers for granted: “Let’s find some common ground and save some money together.” Romer reminded Fairs that prices for Fair Guests will stay lower when they do not create exclusives and other restrictions like commissaries James Romer, that limit a Concessionaire’s North Carolina ability to negotiate Fair State Fair pricing on food and beverage groceries. O’Day recapped that “length of stay drives per capita spending and creates value for the Fair Guest.” Affordability for the Fair, for the Vendor, and for the Fair Guest happens when we increase attendance and length of stay. Now is the time to communicate these concerns so “Together We Can” keep pricing down for everyone! “Promotions that Make a Positive Impact” was another workshop, led by a panel of Vicki Chouris, South Florida Fair CEO, Kevin McGrath, II, The Best Around, and Jackie Cammarano, Erie County Fair Concessions Manager. The group focused on promotions


that they use to increase attendance, increase revenue, and increase the quality of life in their communities. Chouris described the success of $2 Vicki Chouris, Tuesdays saying, “It raised South Florida Tuesday food revenues to the Fair level of weekend revenues.” McGrath highlighted the many promotions in the NICA “Promotions That Make a Positive Impact” book (available to view online at www.nicainc.org/voice). He used Sysco’s free Business Review program to develop a lobster corn dog and found that macaroni and cheese placed as the filling in a hamburger patty would outsell his regular hamburger. Together, they made it clear that the Food and Beverage Industry is in flux and we are part of the trend. After the sessions for the day ended, Tuesday night’s Food Show picked up the momentum and was even more packed than the previous night! On a beautiful Florida day with temperatures in the 80’s and sunshine it was a great day for the 4th Annual Fair Partners Shootout. The sky reverberated with the sound of thousands of rounds of ammunition being shot at sporting clays that were coming from every angle and direction! Thanks to the support and cooperation of many people, including NICA, OABA, and the Florida Federation of Fairs, the 4th Annual Fair Partner’s Shootout was a great success! The concept for the Shootout started with the idea that there was a need for a networking event in February when so many of the Fair industry associations were in town for their national meetings. The Florida Federation of Fairs, NICA and OABA joined in with their support and help. All three organizations promoted the event through communication with their Members. A special thanks to Jeff and Kathy Ross, CCEs with Ross Concessions who worked diligently on behalf of NICA to round up silent auction items, promote the event to potential shooters and sponsors, and assisted with all aspects of the event. A special thanks also to Bob Johnson who rounded up the support of OABA and those that participated squeezed it into an already tight schedule of events for that week. The “Best Sport of the Day” and “Fartherest from First Place” shooter was Steve Siever with IAFE— thanks for being such good sport Steve! Getting to Know Your

Regional Council Members Jeff Ames, West Council Member Hi, I am Jeff Ames and I own Ames Concessions and Catering which serves everything from soft serve ice cream to ribbon fries to freshly smoked BBQ throughout Idaho, Washington, Oregon and at the Alameda County Fair in California. After several conversations with Daryl Whicheloe, CCE and Kim Barr, CCE regarding NICA; I ultimately signed up with Rey O’Day during her visit to the Western Idaho Fair in Boise, Idaho. My father was the first in my family to be in the Concession business. At one time, I also had a brother, a sister and her husband also in the business. As it stands now, my wife, Brenda, and I are the only ones left in the Concession business in our family. Our five children have grown up working the business with us as well. I think the most valuable NICA Benefit is the negotiated prices NICA has with Sysco. My savings on napkins alone repays my annual membership fee several times over. When I was asked what inspired me to join the West Regional Council I realized that Daryl really showed me that NICA is the one Organization that gives Concessionaires a Voice in this Industry; amd further, as a member of the West Regional Council, I could help to shape that Voice. For instance, basically my Dad wanted to retire for some time. He didn’t know how each Fair would react and was afraid to move forward. We entered several years where I managed his business, but he retained ownership simply because we were unclear on how to proceed. During the 2018 WFA Convention I attended the NICA West seminar on “Transfer of

Ownership” where the overwhelming message I got was just be open: promote open lines of communication with the Fairs you deal with. I tried to relate the message I had taken away from the seminar to my Dad; but once again, when it came time to actually tell the Fairs our plans, he opted to instead retain ownership and continue with me managing things. I finished last season ready for things to change, so I emailed each of the Fairs and just announced that my Dad was ready to hang up his apron. I—the one who had been dealing with them and managing things for several years now—would be taking over the business. Each Fair reacted without any surprise or problem and simply updated their contact information from my Father’s information to mine. The whole thing ended up being very painless. I hope during my tenure on the West Council we can continue to address the topic of multiyear contracts with the Fair. I also appreciate that Alameda County Fair is lowering its pre-Fair deposits. Furthermore, I understand that if a Fair needs the deposits to open, that should be respected; however, if they don’t need them before Fair, Concessionaires certainly need that money to invest in their equipment and pay bills during the off-season. While I am glad that concerns are being listened to and ideas being tried, I do not want us to abandon these topics too soon. The best way to reach me is at amesconcessions@yahoo.com ▲

2019 NICA Scholarship Applications Available It’s time to think about college scholarships! For those of you heading off to or planning on entering college, the 2019 NICA Scholarship Application is available on the website at www.nicainc.org/scholarship or by request. We invite you to apply as soon as possible; the deadline has been permanently extended to June 1st. In 2019, the NICA Scholarship Program will continue to award multiple scholarships, including the Gene O’Brien, CCE Vocational School Scholarship and one scholarship with a donation from CocaCola in honor of CCE-designated NICA Members. The remaining scholarships will be provided using donations from fundraising and the NICA Membership. Plan for the next chapter in your life today! ▲

New CCE Recipients Announced at Expo Five NICA Members have earned the designations of Certified Concessionaire Executives: and were announced during the Annual General Membership Meeting during the NICA Business Expo. The recipients are Richard George, CCE of George’s Fun Foods, Jennifer Giordano, CCE of C&C Concessions, NICA Director Vincent Nelson, CCE of Vinnie’s Fine Foods, and Jeff Ross, CCE and NICA President Kathy Ross, CCE of Ross Concessions. Their Statements of Communications & Management Philosophy will be featured in current and future NICA News issues. To read the Statement for Jennifer Giordano, CCE, see page 13. The Certified Concessionaire Executive Program was developed to recognize the professionalism of Concessionaires. The title of CCE represents a deep understanding and respect for the Fair and Festival business. This designation is awarded only after a detailed application process has been successfully met. NICA Membership Rates Have Been Updated as of March 1st As the first Concession-founded and led national organization, NICA continues to evolve as a Voice in the Industry for all Independent Concessionaires. To ensure NICA has the resources to support its work, the Board of Directors has decided to increase the annual membership fee by $25 starting March 1, 2019 for each level of membership (excluding Retired Members). For over 25 years, NICA has and still successfully maintains an affordable and valuable annual membership fee. A monthly increase of approximately $2 per month will ensure NICA’s continued success.
