The Passing of the Gavel Greg Miller, CCE, Outgoing President

might not be the fastest, but I can assure you he will handle the gavel well. Joe and I have spent lots of time together, Remembering back to some good and some bad. When he first came on the days of Junior High the Board, he had some ideas that were way out School, I was on the track there. Russ Harrison, CCE and I would have long team. Incoming President’s message Joe Potillo, Jr., Incoming President Happy New Year! It’s hard to believe that the start of the 2015 season is already underway. For those of us that worked the winter, the Manatee County Fair in Florida, and also the South Florida Fair, all represent the start of the 2015 season. What an exciting time it is for NICA as we approach our annual NICA Business Expo and Fare Foods Food Show, held in Tampa, FL, February 2nd through the 4th. The beautiful Sheraton Hotel is a luxurious hotel and host site for our annual convention and food show. If you have not made plans to attend and are reading this, please make plans to do so.

Fare Foods has been an exceptional partner each year in producing a sold out food show. I would like to give a special thanks to Ron & Laura Porter and Audrey Poole for their hard work and dedication in producing this year’s food show for NICA. It is one of our major fundraisers throughout the year and we couldn’t be where we are without them. I have set the theme for NICA in 2015 as “Get Involved!” I ask that each member take part in NICA wherever they can. As our motto says, “Together We Can!” Certainly, I believe that together we can make a difference to improve an industry that has been a blessing to each of us. Lastly, I would like to thank our Board and the last two presidents, Tom Sattler, CCE and Greg Miller, CCE. Each one made personal sacrifices to lead us. Their example of integrity and commitment to this organization are to be commended and they certainly have left big shoes to fill! The Director’s Voice NICA Benefits: Making Your Bottom Line Better! Submitted by Dominic Palmieri, Director Happy New Year! I hope your Christmas and Holiday Season was memorable and safe. It is always a great time to gather with our family and reflect about what is important to us. After coming out of Vegas from our annual Board meeting, it dawned on me how hard this NICA Board works on behalf of all of its members. Our job as Board Members is to, not only steer and grow the Association, but to also lobby on behalf of the Industry, develop member benefits, and aid our members with the educational tools they need to be successful. Of all the tools we provide in our NICA bag of tricks, some show results to the bottom line quickly and others show over time. It’s the “Quickly” ones that give us more of an instant gratification. While the “Over Time” ones provide us with a strong base to build and grow upon. With all things being equal, every benefit provided by NICA can help you do what you do no matter where you are or how you do it. This, of course, is what makes us all Independent Concessionaires. Let’s get to the meat and potatoes of my point. As we move into the new year, many of you will

be moving down into South Florida. We all know how expensive this can be with fuel costs, driver and employee hotel room nights, equipment repair etc. To help all of you in PLANNING, PLANNING, PLANNING and SAVING, SAVING, SAVING, I wanted to recap all the valuable discounts and benefits you receive as a NICA member. Keep in mind that many of these take just a few minutes to sign up online, or you must call ahead to be sure that you get the most of what NICA has to offer. But you MUST take the time to get it right now, at the beginning of the season, to be sure you that you have everything in place for the rest of the year. Here are the companies that support our association with discounts. Don’t forget to use as many of them as you can-- to keep as much as you can on your bottom line: • Coca-Cola and Pepsi for discounts and National pricing with rebates based on gallonage used when applicable. • First Data Merchant Services for credit card processing. • Fare Foods rebate program. “Since the idea or concept of starting a concession business in 1981, my philosophy fo the managment and communications within L & L Concessions, Inc. has not changed. I have always felt that if you supply a good product by using quality food and providing a safe and good working environment for your employees that you will have a successful concession company. I have surrounded myself with a very efficient management team, consisting of my wife, Shelley, who runs the personnel department of this company while my son, Ryan, has helped me with the set up and running of the shows and making sure the operation runs smoothly and all three of us work on placing orders for product to be used. This all works only if you have good communication, not only within management but with employees too. I have always had an ‘opendoor policy’ for any employee who needs to or wants to discuss anything with regards to working for L & L Concessions. Good management and communications are key elements for a successful business.“ ▲ Did you apply for to be a CCE in 2014? “My philosophy is that I insist that all my products are sold hot and fresh out of the fryers. I do not believe in using a heat lamp. I only want what goes out my window to be the very best and hottest that I can serve, as my reputation is at stake. I have had different people tell me that I am too particular and when customers come back next year they will not remember if your product was good or bad. I do not believe that. We have built our business with repeat customers year after year. I am also very adamant that all of our workers tell all our customers ‘thank you’ for their business. If you walk around any Fairgrounds, big or small, you seldom hear ‘thank you.’ I feel that it is part of our job to make the customer feel like we appreciate their business and are glad that they came. ‘Thanks’ is a little word that goes a long way, doesn’t cost a thing, and earns big rewards. We sell two of the hardest and messiest products on the Fairgrounds (Grater Taters and Blooming Onions), so we have to work especially hard to keep our trailers clean. I am very picky and insist that we clean our tailers top to bottom between each event. We have many customers tell us that one of the reasons they buy from us is the cleanliness of our trailers. When they tell us that, my employees then understand why we do so much cleaning and it makes all of us feel good.” ▲


The Member’s Voice Continuing where they left off last issue, the NICA Office has been recording the responses from their survey of renewing members. Charles Duquette, Crystal Fantasies, has been a NICA Member since 1994. He enjoys the NICA News, as it reminds him of updates to DOT regulations, and the NICA Membership Directory, as it is nice to have a listing of other Concessionaires. He said that he does not make use of the benefits, as most of them do not pertain to his business. He would like to see the development of a “Straight Sales Committee” to improve the relationship that NICA has with straight sales. Roy Miller, Miller’s Food Concessions, is another long time member since 1994. He has continued to renew his membership in order to get the benefits. He said that over the years he has tried some that were not quite what he thought, so he mainly uses the Coca-Cola and Pepsi discounts currently. He continues to support NICA in hopes that the communication can continue to become more open and Fairs can become aware of the situation that Concessionaires cannot be the only source of income. Monica Urick, Urick Concessions, LLC, said that she pays her dues but does not currently make use of the benefits since most of her events already have national pricing. She plans to come to “Florida Week” this year and she enjoys the educational aspects of any meeting. She also likes talking to Concessionaires who have been in the business for a long time, as they can help her with their advice. John Meigs, Meigs Concessions, has been a member from the very beginning. He uses the Pepsi, Arrow Distributing, and Auto Zone benefits the most. He likes that NICA has been a positive organization that helps to keep open communication with many of the Fairs. Communication is important in any business. Due to his schedule, he has been having trouble receiving the NICA News during the summer months, so he now reads it on the NICA website

instead of waiting for it to catch up to him. Ron Withers, Withers Concessions, feels that he has a good relationship with NICA and makes use of food-related and Sherwin Williams discounts. Their daughter has been awarded a NICA Scholarship two different years and the NICA News is something that they like to read each month. They would like to see NICA continue to work on “opening communication between Fair management and Concessionaires.” Daniel Jones, CJ’s Concessions, stated that, as a Food Concessionaire, he mainly uses the soda discounts. He also uses his card to bargain with the car rental companies quite successfully. He commented that there has been a lot of changes in this business: expenses continually go up, but not necessarily the gross, and the competition is much greater. Daniel thinks the NICA News does a great job and covers most of the things of interest to Concessionaires. He hopes to be retiring soon and selling his business, but he expressed that his overall relationship with NICA has been very good. The NICA Office plans to continue these calls to our renewing members in the new year. We hope that hearing their personal stories will help you make better use of the available NICA benefits or think of ways you could contribute. Full Recipicity Plan Under the International Registration Plan (IRP for short), as it is now, a carrier renewing registration declares to its base jurisdiction which states and provinces it plans to travel in during the coming year and pays apportioned fees to those jurisdictions on the basis of where the fleet’s vehicles traveled the preceding year. As well as states the carrier thinks they may travel to and estimated miles were used and the price of the tag was increased over the 100% threshold. Only the declared jurisdictions appear on the registration cab cards. If the carrier’s plans change during the year, and it needs to travel into additional jurisdictions, it must either add those to its registration or buy trip permits. Either one can be expensive, and both can delay vehicle movements. The Full Reciprocity Plan (FRP for short) – (starting January 1, 2015 renewals) would eliminate the complexity by automatically making IRP registration a registration for all IRP member states and provinces. IRP fees would be calculated the same way they are now. A carrier would pay on the basis of where its vehicles traveled in the preceding year. You would pay fees only to the jurisdictions you actually traveled in, but you would be registered everywhere. (The International Fuel Tax Agreement works this way already.)

IRP Updates on Apportionable Vehicle Definition Starting January 1, 2016, charter buses that have two axles and a gross vehicle weight or registered gross vehicle weight in excess of 24

26,000 pounds, or that have three or more axles, will be subject to IRP. These vehicles are already subject to IFTA. Currently under the International Registration Plan (IRP), a charter bus is not included in the definition of an “apportionable vehicle.” That will be changing as of January 1, 2016, however, because the IRP members have overwhelmingly approved a ballot that will subject charter buses to apportionment under the IRP. The idea behind the long-standing charter bus exclusion was that charter bus carriers weren’t able to predict jurisdictions of operation due to the fact that they were used on an ondemand or “chartered” basis. There was no way for charter bus operators to fairly apportion units under IRP. However, with the recent adoption of IRP’s “Full Reciprocity Plan” (FRP), effective for IRP registrations starting on or after January 1, 2015, there will no longer be a need for carriers to predict intended jurisdictions of operation. Under FRP, all states and provinces will be listed on a vehicle’s cab card and the vehicle will be legally registered in all IRP member jurisdictions. Therefore, the original reason for the charter bus exemption is no longer valid with the adoption of FRP.

Final ELD (Electronic Logging Devices) Rule Not Expected Til Late 2015, FMCSA Says The Federal Motor Carrier Safety Administration does not expect to publish its final rule mandating the use of electronic logging devices for carriers until Sept. 30, 2015, the agency said in its November significant rulemakings report.


IFTA Might Replace Decals With an Electronic System The International Fuel Tax Association said it is considering changing the organization’s credentials for commercial vehicles to a digital form and possibly eliminating its longstanding decals.

Insurance Rates and Trucking A Federal Motor Carrier Safety Administration rule proposal that would increase the minimum amount of liability insurance carriers must have has cleared the White House’s Office of Management and Budget, meaning the proposed rule is ready for publication in the Federal Register. It will be published as an Advanced Notice of Proposed Rulemaking, intended to seek trucking industry input before it produces a Notice of Proposed Rulemaking and a Final Rule. It’s unclear whether the ANPR will include the actual number for the new minimum. The current minimum, set in the 1980s, is $750,000, which the agency says would be closer to $2 million if it had kept up with inflation. Trucking industry groups, however, argue that just 1 percent of truck-related crashes exceed $750,000, therefore making the rule — and potential premium increases — unnecessary.

Fuel and Mileage Information for IRP and IFTA This is just a reminder that if you report to IFTA or IRP that you must maintain accurate information for your travels and fuel receipts for 5 years! You are required to have some type of trip sheet that shows where you start, where you go, the general routes that you take and the miles

in each state for each registered vehicle. Fuel receipts must be retained for each vehicle and filed with the trip sheet for that truck. You cannot just batch them all together. If you purchase bulk fuel for your highway vehicles, you are required to have a breakdown of the gallons put into each vehicle with a meter reading or individual receipt. Receipts must have date, vehicle ID# and the location information from the vendor. For an easy method of tracking miles, consider using www.tripsheetsonline.com. Logging The final rule mandating the use of electronic logging devices by drivers and fleets is scheduled to be published Sept. 30, 2015, and enforcement to begin Sept. 30, 2017. For fleets that already have onboard communications systems, the cost to implement an ELD solution for paperless driver logs is incremental, perhaps only $5 to $10 per truck. For fleets that lack a mobile computing platform now, or are considering replacement options before the ELD mandate arrives, the market is filling up with low-cost compliance options that utilize smartphone and tablet devices with plenty of room to add more applications in the future, as needed. A number of ELD compliance applications can be purchased from suppliers using a subscription model that includes the hardware. BigRoad recently announced a CFR 395.15-compliant Automatic On-Board Recording Device option to its paperless driver logging app. Drivers and fleets that already use the app can plug a link into the truck’s data portal that communicates via Bluetooth to the BigRoad app installed on Android- or iOSpowered smartphones or tablets. ►►“IRP” continued on page 28 January / February 2015 NICA News

Drivers Keeping up with drivers is the next big issue in today’s small trucking industry and an even bigger one in specialized industries like this one. You are required to maintain drivers’ files for every driver you hire and it must be kept up to date. You have to retain these files for 3 years after that driver no longer works for you. If you maintain your drivers all year you are still required to do an annual review every year with a new MVR, verify their medical card etc. And this includes yourself if you are driving your own truck! If you let a driver go during your off season, you have to start all over the next time he comes to work for you. Just like he is a new hire! That 28

means MVR’s (driver license checks) Past three (3) years verified employment, Drug Screen, etc. Complete application from A to Z. This is where the DOT can really make it hard on you. The fines can be in the thousands. Many of you keep up with this yourself, and some of you may hire a third party to keep up with it. But in the end it is still your full responsibility! There is also an alternative to this where you maintain the driver file data electronically and that is possible when using TMFS Corporation’s www.driversfilesonline.com. This is an online program that maintains the information on your drivers and automatically informs you when updates are needed and retains the information on past drivers for three years. This program has many features and well worth the few dollars a month to keep up with the regulations. ▲
