2017 Lobby Day...A Great Success!

On Tuesday April 25th advocates for physical therapy traveled to Albany to fight on behalf of our profession. First, I would like to offer a sincere “Thank You!” to everyone who took the time out of their busy schedules in order to attend the event. Second, thank you to our legislative liaisons who scheduled appointments and provided logistical support to our members, and finally thank you to NYPTA staff for their planning and onsite efforts to make the day a success.

The morning began with a crescendo of energy as participants began to arrive at the Legislative Office Building, gather with their colleagues, and arm themselves with talking points and support materials for our legislators. By 9:30 am we were off to our meetings where we introduced ourselves as private practitioners, educators, staff therapists, students, and most importantly of all – supporters of physical therapy.

We educated our representatives on the importance of updating the Workers’ Compensation law to recognize the services provided

by Physical Therapist Assistants in a manner consistent with the NYS education law and the policies of all other payors. Participants explained the financial hardships faced by our patients due to disproportionately high physical therapy copayments and emphasized the importance of continued on page 3

Hello my fellow members, I hope that this letter finds everyone well and drying out from our wet springtime. The upside to all the moisture should be a magnificent bloom and a green summer throughout our state with no shortage of water.

Spring is always a very busy time for our chapter and our profession in New York State. We enter into the season working on and anticipating our lobby day, our Spring Board of Directors meeting, and of course our Delegate Assembly. Personally, the Delegate Assembly has always been a personal favorite and an annual highlight for me, even well before being elected president. The Delegate Assembly represents our chapter at its best. Delegations from all 10 districts coming together as one representative body to share ideas, discuss, debate, and to vote on the issues, initiatives, and ultimately the governance of our chapter.

So, this wonderful annual meeting completes us on a local and national level.

As I reflected on this idea of completing the circle, I came back to membership and its benefit to us as individual practitioners and as a profession.

Many months ago, I spoke to you through one of these president letters about how membership in one’s professional organization “completes us” as professionals. Well your membership also completes and sustains our chapter, the APTA, and our profession.

The late immortal football coach, Vince Lombardi stated, “ the achievements of an organization are the result of combined effort of each individual.”

My fellow members coach Lombardi, was right on target. Is it any wonder why he led his famous Green Bay Packers to multiple championships during his career?

The NYPTA currently consists of approximately 6,300 members. This includes PTs, PTAs, and students. Everything we are, everything we do, everything we achieve or fail to achieve, is not possible without the combined effort of each of you.

I have often spoken of my beliefs as to what “active membership” really means. The truth is it means different things to each individual. To someone like myself it means taking on the responsibilities of being your President. To continued on page 8 2 Empire State Physical Therapy • May/June, 2017

protecting the DPT credential for use only by those trained in physical therapy at the doctoral level.

At mid-day we took a break from our legislative meetings in order to attend a speaking event by Senator Tim Kennedy. Senator Kennedy, who represents the Buffalo region, gave a very motivating speech highlighting the importance of our legislative priorities. He also encouraged our continued participation in the legislative process stating that active and persistent participation is one of the best ways to create change. Senator Kennedy has been a co-sponsor of our recent priority bills and is a strong supporter of physical therapy.

As the afternoon progressed we finished our meetings and completed our summary forms detailing the results of our interactions. These forms enable chapter office to know which legislative offices to contact in order to provide additional information or answer questions.

In the coming weeks we will be following our bills, monitoring for any additional cosponsors, and looking for opportunities to help our bills through committee and eventually to a vote. For any members who were unable to attend Lobby Day, now would be an ideal time to schedule an appointment with your legislator to meet within your local district. Reinforcing the messages sent during Lobby Day and engaging them in another conversation can only help our efforts. This is a great opportunity to build a relationship with your elected officials and help those in your community who benefit from physical therapy.

For anyone interested in local legislative visits there are tips for successful meetings, talking points, and legislator materials all posted on the NYPTA website. Please stay tuned for any urgent Legislative Action Alerts issued by chapter office which will request support in contacting your legislators if our priorities need immediate support.

Practice Act Task Force

Recently, the New York Physical Therapy Association (NYPTA) assembled a Practice Act Task Force. This task force is comprised of clinicians, educators, administrators, researchers, and lobbyists, who are charged with the task to research, assess, and make recommendations for the most innovative ways to amend and expand our practice act. This will, hopefully, include unrestricted direct access, as well as the ability to refer for basic imaging techniques as part of the physical therapist’s examination and management skill set. The healthcare system continues to change on a daily basis. As the population continues to age, physical therapists will be at the forefront of primary care intervention for those patients with neuro-musculoskeletal pathologies. Previous research has shown that early access to physical therapy is not only cost effective, but also improves patient outcomes.6 This, along with a recent study that demonstrated that physical therapists provided the majority of rehabilitation services in New York State during the 2012 calendar year,1 strengthens and supports the timely changes to our current practice act.

Over the next 10 years, the landscape of healthcare will change dramatically. Reimbursement for services will most likely transition to a fee for performance model, rather than the traditional fee for service model that has been in existence for many decades. The switch is necessary and inevitable as the healthcare arena strives for value-based performance with cost containment.1 This change is in direct alignment with The Affordable Care Act of 20102 which aims to extend health insurance coverage, foster greater efficiency in health care delivery, and improve patient safety and quality of care. In addition, the law also mandates coverage for essential health benefits, including rehabilitation services.2 An analysis based on a national representative survey finds that three-quarters of physical therapy episodes are among non-elderly adults, while one-fourth are among Medicare beneficiaries.14 On average, each episode of physical therapy consisted of 9.6 visits and cost $1,184.14 As physical therapists, we possess the education, skills, and communication set to be at the forefront of primary care intervention. It is both our professional responsibility and our privilege to be regarded members of the healthcare team. Evidence is showing that as costs for treatment of neuro-musculoskeletal conditions continue to spiral out of control, physical therapy represents a more cost-effective alternative to medicine, injections, imaging, or surgery.3-5 Moreover, a recent systematic review by Ojha et al6 demonstrated that early access to physical therapy can both decrease costs and improve function as part of the nonsurgical management of musculoskeletal conditions.

Physical therapy can be used to restore, maintain, and promote optimal physical function.7 Further evidence suggests that physical therapy can reduce pain, alleviate disabilities, improve physical function, and improve quality of life for individuals with neck pain, low back pain, and osteoarthritis of the hip and knee.8-13 The utilization of physical therapy services remains low despite the presence of strong scientific evidence demonstrating their positive benefits for certain medical conditions.8-13 Low utilization of physical therapy services may be explained by two reasons. First and foremost, access barriers created by physical therapy practice acts and payment policy may be a large contributing factor. In many states, physical therapists are permitted under direct access to evaluate and treat patients without a physician referral.15 However, direct access is often restricted. For example, in the state of New York, access to physical therapy without a physician referral is capped at 10 visits or 30 days15 and many payers may still require a physician referral. A second reason may be that the advantages of physical therapy in comparison with other treatment options have not been well delineated.

For physical therapists to continue to intervene at an early point in the management of neuro-musculoskeletal pathologies, our New York State Physical Therapy Practice Act must provide enough flexibility for physical therapists to provide care to patients with neuro-musculoskeletal pathologies without a physician referral, which is also recognized by insurance payers. While the New York Chapter has enjoyed direct access privileges since 2006, stipulations on the existing direct access law in New York State remain. Over the past 10 years, no further progress has been made in the direct access arena in New York State and patients continue to face access barriers to care. Recent events in Connecticut have granted physical therapists the ability to refer patients for radiographs. Additionally, other states, have been given unlimited direct access (i.e. Massachusetts). Practice Act Task Force continued from physical therapy as our society continues to age. Providing unrestricted direct access to the professionals that are experts in the movement system, seems not only reasonable, but prudent. The time has come to assess and revamp our practice act so that modernization of physical therapy can continue to excel in New York State.

others, it’s a chapter director, others a committee chair, yet others a district position, and to some it’s attending a district or chapter meeting.

The fact is that we all have busy lives filled with career, family, friends, and many other things that determine our ability to “be active.” I have often said to members that I speak with that even if you are a member who is unable to physically participate in NYPTA events, you can still be active by making a call, sending an email, or writing a letter when called to action by me or one of our leaders who may require assistance on a chapter initiative.

We need the combined effort of each of you. You each form the heart and soul and the essence of what the NYPTA is now and will be in the future. Nothing is possible without each of you and your energy.

With this letter, I am calling upon each of you who has access to this letter to join in and be part of the combined effort of the association. If we have 6,300 members who are active in whatever way they can be, we will truly continue to achieve great things together to move us forward.

I am also asking each of you to be the voice of our association and to lead a grassroots effort to recruit at least one non-member PT, PTA, or student that you know to join us and add their effort to our association. Just imagine the combined efforts of a 12,000 member NYPTA. Imagine the power and the energy that could propel us forward as we increase the numbers of talented and dedicated people to the tremendous energy we currently have.

The possibilities are endless.

What is your favorite therapy product or service?

Every therapist has a favorite tool, product, or service that helps them perform their daily job better. No matter what setting you practice in, you have tools that you depend on, on a daily basis, to do your job successfully.

These could be fitness tools, software programs, or specialty rehab equipment. These things are all provided to us by valuable industry partners – companies that provide products or services to make us the best therapists we can be for our patients.

Your fellow association members could benefit from learning about these tools, and the best way to share this value is to help these companies share their product or service. Leadership Development Workshop

The Annual Leadership Development Workshop was held on Friday May 19th prior to the start of the 2017 Delegate Assembly. This is not a workshop by true definition! Rather it’s a dynamic learning experience where participants have multiple opportunities to observe, interact and engage in the NYPTA governance process. Physical Therapists and Physical Therapist Assistants received 4.25 CEUs attending the Leadership Development Workshop in conjunction with staying to represent their local district as a Delegate or attending the Delegate Assembly as a guest observing from the gallery on Saturday.

Our Keynote Speakers, Dr. Matt Hyland presented “Engagement in the Profession: Contributing to the Vision for Physical Therapy” and Dr. Lynn Rivers presented “Governance in the APTA: Tools to be Effective in Contributing to Decision-Making for the Profession”. Both speakers offered insight from their personal experience and key perspectives of issues facing our profession as we move forward.

The participants observed the annual Board of Director’s meeting with the Executive Committee, Chapter Directors, and Committee Chairs immediately followed by the opportunity to personally meet and speak with the various members of the BOD. The afternoon concluded with participants actively engaging in a Mock Delegate Assembly addressing motions that were going to be discussed at the DA the next day.

After the end of this two day leadership opportunity, the PTs, PTAs, and students left the workshop empowered with the knowledge of how individual members can step up, get involved, and have an impact on the growth and direction of their state and national organization!

Activities at the District Level: January-May 2017 Greater New York District 1. On March 28th the Role of the Pelvis in Gait was presented by: Christiana K. Collins at Hunter College.

2. On April 13th Evidence-Based Examination and Management of Shoulder Pathologies, Presented by: Michael Masaracchio at NYU. 3. The District Annual Business Meeting was held in April where elections were held and the district membership was in support of an amendment to our Bylaws which was brought to the May Board of Directors Meeting.

Southern Tier 1. Online Journal Club - January 19, 2017 at 12pm.

John Winslow, PT, DPT, OCS, MTC, ATC, Assistant Professor, Department of Physical Therapy, Ithaca College, moderated the session, discussing the article “ The effectiveness of cupping therapy on relieving chronic neck and shoulder pain: a randomized controlled trial.” The objectives for the Journal Club are to assist members in 1) keeping current with clinical practice 2) learning to evaluate the strength of the evidence 3) promoting implementation of new knowledge into practice and 4) improving clinical outcomes. We broadcasted this on Zoom for people to attend remotely and had 4 attendees.

2. Online Journal Club - April 20th - 7pm.

Robert Rehberger, PT, DPT, Resident at Cayuga Medical Center, moderated the session discussing “The treatment of Non-Traumatic Rotator Cuff Tears.” The objectives for the Journal Club are to assist members in 1) keeping current with clinical practice 2) learning to evaluate the strength of the evidence 3) promoting implementation of new knowledge into practice and 4) improving clinical outcomes. We broadcasted this on Zoom for people to attend remotely and had 11 attendees.

3. Annual Meeting April 25th at 7pm at Broome Community College.

We voted on executive committee positions and Joel VanSlyke gave us an update on lobby day. Then, the physical therapist assistant students from Broome Community College presented “Hippotherapy.” We were able to broadcast this meeting online using Zoom for people who were unable to attend in person. We had approximately 30 attendees.

Western District 1. March 18, 2017 Annual Half Day Continuing Education Course at Daemen College: “Neuroplasticity: Retraining the Brain from Stroke to Concussion and Beyond!” by Dr. Susan Bennett PT, DPT, Ed.D, NCS, MSCS. “The Link Between the Physical Therapist and the Registered Dietician” by Melinda Yoder, Registered Dietician. 25 clinicians in attendance.

2. April 25, 2017, 6 of our clinicians participated in Lobby Day. 3. May 3, 2017 Spring meeting where we held elections, prepped for Delegate Assembly, and had our PAC fundraiser at a local bowling alley. 14 Clinicians were in attendance.
