Environment Minister Matt Kean said these new legal instruments will fill a gap in conservation measures in NSW by preserving key landscapes that protect a broad range of our natural heritage.

However, AOBV nominations will only be considered with the landholders’ consent, which the Nature Conservation Council consider a significant shortcoming.

“It is great to have clarity on how this scheme will work, but it offers no protection for vital habitat remnants if a landowner has a slash-and-burn approach to land management,” Nature Conservation Council Chief Executive Chris Gambian said.

“The AOBV scheme was a key component of the Coalition’s overhaul of conservation laws in NSW, but for some reason it has taken four years to deliver and is a little underwhelming.

“It was supposed to counterbalance the increased land clearing the Biodiversity Conservation Act was expected to trigger, but the scheme outlined today is too limited to ever do that.

“Latest land-clearing data shows 150 hectares of wildlife habitat is bulldozed or logged every day in NSW, almost twice the average annual rate recorded before the Coalition overhauled nature laws.

“The government’s own data shows 54,500 hectares of native forest were destroyed for farming, forestry and development in 2019.

“The truth is that even with this new scheme, wildlife and critical habitat is still woefully unprotected because the whole system relies on the goodwill of landholders.

“While most landholders do the right

“The AOBV scheme is entirely voluntary, so it actually offers no more protection than landholders are currently prepared to provide, although it does reward them financially for doing so.”

NSW Environment Minister Matt Kean said, “I want to leave our planet in a better state for future generations and this is another tool to ensure areas of irreplaceable biodiversity on private and public lands across NSW can be protected.

“Local communities or private landholders can now conserve areas that would otherwise not be captured or recognised through any other legal instrument, such as in National Parks.”

Once identified, AOBVs are an ‘automatic priority’ for investment by the Biodiversity Conservation Trust (BCT), meaning landholders can access funds to manage the land for conservation.

“The BCT already has a number of mechanisms that provide private landholders across the state a financial incentive to conserve biodiversity on their own properties,” Mr Blair said.

“This new mechanism will help us capture areas and pockets of high value biodiversity that otherwise may have slipped through the net.”

Identified by rigorous scientific assessment, AOBVs are designed to conserve high value conservation sites, threatened species or critical habitats.

This includes climate refugia, migratory pathways or areas with a high variety of biodiversity values.

AOBVs can only be declared with landholders’ consent, with nominated areas assessed against key scientific criteria set out in the Biodiversity Conservation Act 2016.

An Education Department spokesperson provided a response to an enquiry regarding the change.

“Groups of schools work together to manage local student populations.

“The Department of Education periodically reviews enrolment boundaries to ensure that enrolment figures are balanced across schools, accounting for population changes and to maximise the educational offering,” the spokesperson said.

Regarding a question of resourcing, the representative stated that department resources would be deployed according to normal measures.

Local MP Kate Washington has fought Mr Lee’s development for a number of years, expressing anger at the NSW Government for not taking action and now calls for money to be set aside for remediation of the “pristine land near Tea Gardens that has been destroyed”.

“The immense harm inflicted by Mr Lee on environmentally and culturally sensitive land should have seen these assets frozen a long time ago.

“Instead, Mr Lee has left a trail of destruction in Port Stephens.

“Out of this process, money must be set aside to remediate the land he’s ruined,” Ms Washington said.

The Court Orders do not make clear of the nature of the ATO’s claim against the couple however it is understood that Mr Lee has filed a countersuit.

A representative from MidCoast Council spoke regarding locals’ concerns of this freeze stalling remediation work in the local area.

BILLIONAIRE property developer Phillip Dong Fang Lee and his wife Xiaobei Shi have had their assets frozen as the Australian Tax Office pursues them for more than $272 million.

The Chinese-born developer has caused a stir in both the Myall Coast and Port Stephens’ communities in the past due to repeated environmental damage to their properties.

The couple own a 400-hectare property at ‘Fame Cove’, as well as 5569 hectares of land across the area.

The Federal Court’s orders to freeze assets apply to sixteen properties linked to the couple including a $40 million mansion in Point Piper, a large number of luxury cars and the couple’s properties including ‘Fame Cove’, Tea Gardens Pine Plantations, Nerong farmland, Bundabah farmland and land in Pindimar.

For many years, the couple’s Fame Cove property, purchased for $8.8 million in 2006, has been a topic of conversation with many breaches of environmental protection laws dating back to 2009 where fines of almost $200,000 were incurred after a failed excavation of a dam wall.

COVID Safe Return Of International Students To Newcastle University

NOT many sectors have been hit as hard as higher education has by COVID-19.

The industry depends upon thousands of international students for funding.

With borders closed, many universities have struggled.

So too have businesses including the hospitality sector that employ these students part-time while they study.

However, there is light at the end of the tunnel for Newcastle University, which provides study options to the Port Stephens community.

A pilot plan which will see the phased return of fully vaccinated international students to NSW has been given the green light by the Commonwealth Government, with the first flight touching down by the end of this year.

Accommodation provider Scape has been confirmed to house the

returning students for a 14-day quarantine in Redfern, at a building retrofitted to accommodate up to 650 students to COVID Safe standards approved by NSW Health and NSW Police.

Deputy Premier and Minister for Regional New South Wales, Industry and Trade John Barilaro said the staggered return of students was stage one of a pilot that would slowly expand and evolve, as vaccination rates continue to rise in NSW and internationally.

“The international education sector sustains thousands of jobs across NSW, and I’m proud that NSW is leading the way with the return of international students to our shores,” Mr Barilaro said.

“The safety of the people of NSW is paramount and we are taking no risks.

“All participating students will be required to be fully vaccinated with a TGA-recognised COVID-19 vaccine, and strict quarantine protocols will

“Importantly, this plan will not come at the expense of any Australian citizen or resident wishing to return home.”

National Novel Writing Month LOCAL novelists have started prepping for the 2021 National Novel Writing Month (NaNoWriMo).

Each year on November 1, hundreds of thousands of people around the world begin to write, determined to end the month with 50,000 words of a brand-new novel.

NaNoWriMo began in 1999 as a daunting but straightforward challenge: to write 50,000 words of a novel during the thirty days of November.

It was a remedy to a well-known problem: writing a novel alone can be difficult, even for seasoned writers.

NaNoWriMo aimed to help writers

track their progress, set milestones, connect with other writers in a vast community, and participate in events that are designed to make sure they finish their novel.

And it’s all completely free.

PORT Stephens Council has decided on a conceptual design for a 'Gateway Statement' at the new

$1.5 million Tanilba Bay roundabout.

Councillor Steve Tucker said that there were several factors influencing their decision.

Successfully and quickly, the team got the vessel back with water under it and the family were back on their way.

Vehicular Crash

On 23 September, a motor vehicle crashed into the front of the hairdresser’s salon at Lakeside Shopping Village in Raymond Terrace.

The vehicle was occupied by an older lady who needed assistance in getting out of the car, however she was not trapped in the vehicle and had no major injuries.

The Raymond Terrace Fire and Rescue was called to the scene and assessed the structural integrity before deeming it safe for the car to be removed.

House Fire

A house fire on Mount Hall Road was reported to the Raymond Terrace Fire and Rescue on the night of 23 September with a Department of Housing property aflame.

The fire had spread through the floorboards of a room in the house and

the rescue team smashed a window and forced their way through the front door.

Fortunately the property was vacated a week earlier and there were no residents in the house.

The fire was quickly extinguished by the team.

Rural Road Safety

The NSW Government is working on upgrading the safety of rural roads across the state to minimise accidents and deaths.

Works being implemented include flexible barriers, wide centre lines, rumble strips, motorcycle underrun and sealed shoulder widening at curves and on straights as part of the Road Safety Plan 2021.

In the 2020-21 period, 143 people lost their lives on country roads across NSW, over double that of metropolitan areas.

Slow down, take a break when you’re tired, stick to the speed limit and remember to always buckle up.

Major win for users of Motorised Mobility Devices RECENT changes to the NSW Road Rules, which remove outdated weight limits for power wheelchairs and motorised mobility scooters, known as Motorised Mobility Devices (MMDs) used by people with physical disability, are welcomed by the Physical Disability Council of NSW.

PDCN has been advocating for the onerous weight restriction to be lifted for several years, emphasizing the practical problems these rules caused our members.

models of MMDs or in other cases, needing to do as no other suitable option was available, and risking legal action if an incident occurred when they did.

It also effectively cut residents of NSW who use MMDs off from a significant part of the overseas MMD

market that offered major functional and technical improvements.

In highlighting the practical impact of the weight rules, Physical Disability Council of NSW, CEO, Ms. Serena Ovens said, “We literally had situations where people had gone to the cost and effort of purchasing

MMDs, and were told ‘this is too heavy, it’s illegal to use this to get around and you can’t use it in our grounds’.

“At the same time, the weight restrictions were limiting our members’ ability to import newer, more advanced models of MMDs – it was an arbitrary

rule with little to no practical justification and had serious impacts on our members’ independence and capacity to engage in community life.”

The amendments to the Road Rules, introduced on 1 September 2021, remove any references to weight restrictions for people using MMDs as pedestrians, including mobility scooters and power wheelchairs.

Incentives Overhaul a Big Win for Regional Teachers

TEACHERS and students at schools across regional NSW will benefit from a complete overhaul of how the government attracts and retains teachers in the bush.

Deputy Premier John Barilaro said the NSW Government commissioned the Review of Rural and Remote Incentives in NSW Public Schools, which focused on improving the benefits for regional teachers by ensuring they are fair and flexible.

“We are already investing record amounts in school infrastructure and technology in regional parts of the State, so it’s time our incentives program is upgraded to attract top quality teachers to the bush,” Mr Barilaro said.

“At the heart of these investments are our regional kids who deserve the best teachers and best education no matter where they live.”

Minister for Education and Early Childhood Learning Sarah Mitchell said she commissioned the review in response to conversations and feedback from teachers working in regional, rural and remote areas.

“The government is accepting all recommendations put forward by the review, and we will immediately begin implementing reforms to attract and retain teachers in regional NSW,” Ms Mitchell said.

“We have the most generous incentive system in Australia, however over time it

has grown in complexity.

“This is the first time we have inspected all aspects of the system to make it fair and flexible, allowing teachers to create a package that works best for them and their circumstances.

"We will create a smarter transfer point system and an easier-to-understand benefits package for teachers, ranging from additional salary, better professional development opportunities, rent assistance and family support.”

The NSW Government has committed $15 million to action initiatives immediately in response to the Incentives Review, including: ●Increasing the value of targeted recruitment bonuses from $10,000 to up to $20,000, making schools located in the hardest-to-staff parts of the State more attractive for prospective employees; ●Giving more employees the opportunity to experience regional NSW by doubling the number of teach.Rural scholarships to 120 per year, and expanding the investment in the Rural Experience Program to fund up to 50 places from 2022; ●Expanding eligibility so temporary teachers can receive incentives like the Rural Teacher Incentive, Retention Bonus, and Experienced Teacher Bonus, enabling a greater number of employees to be attracted to the regions; and, ●Working alongside the Teacher Housing Authority

NSW to upgrade, repair and build new accommodation for teachers in areas of high demand.

Principals, teachers, key education stakeholders and experts will be consulted with and help co-design longerterm initiatives, including: ● The revamping and simplification of the transfer point system to reduce inequity, better communication on what is available for teachers in the regions, and allowing employees to work on a bespoke package which suits their individual circumstances; ●The creation of a more holistic approach to regional relocation which focuses on ‘families’ rather than just individuals; and, ●The establishment of a centralised team to oversee regional staffing.

“Regional NSW is an incredibly attractive place to live and work.

“I want to see more people experience teaching in Regional NSW and I want to remove barriers for anyone wanting a teaching career in the bush,” Ms Mitchell said.

The review recommendations support the initiatives included in the Teacher Supply Strategy due for release later this year.

During my recent Council roadside pickup preparation, I tried to discard some of my son's belongings that he hasn't touched in over five years.

He wouldn't allow me to do so, saying it would ruin his childhood memories.

I'm sick of storing stuff for no good reason.

What should I do?

Mrs Jodi L. Dear Jodi, The problem here is that we are attached to objects for a range of different reasons, and none of us can really judge the desirability another person puts on something in terms of its sentimental value.

What you may see as a clapped-out tennistable table, is, in your son's eyes, the remnants of his childhood, specifically the day he beat that show-off Johnny Smythe.

It is the same reason I keep a pair of very short shorts with frangipanis on them in my wardrobe. I know I will never wear them again, but it's nice to hold on to the memory of the tanned legs and flat stomach that once accommodated those shorts so perfectly.

As they say, one person's trash is another person's treasure, and this becomes all too apparent when you do put your belongings on the grass strip awaiting collection.

Before long, passers-by will start rifling through your memories, and in some cases load them into the car boot, at which point you will feel a sudden surge of affection for that camping chair with a rip in the fabric and contemplate chasing after them.

There is also an equivalent of buyer's remorse, known as chucker's remorse.

The calculation goes something like this: Item value minus the number of years you have last used it multiplied by the number of hours it sits waiting for collection plus the number of people who stop to look at it equals the likelihood of you running back out to the front of your property and retrieving it before it gets carted away.

The longer you wait, the more likely you are to return your junk back to the mezzanine for another two years where it will gather more dust and rat poo, and the decision-making process will start again.

Maybe suggest to your son that he can have a designated area in the shed, and if his belongings don't fit into that space, they need to go.

Also, once he leaves home, DO NOT under any circumstances let him store those items and the associated memories at your place.

They are his to deal with at that point, and he can then decide how much they really mean to him.

Renewable Energy - The Answer Is Blowing In The Wind

RENEWABLE energy and reducing emissions is now a higher priority for the Australian Government.

Australia’s commitment to reducing emissions has come under the international spotlight and we are seen as a nation that must do better.

The Federal Government has introduced legislation that will pave the way for construction of Australia's first offshore wind farms.

Port Stephens and Newcastle are well placed to host offshore wind farms.

Experts say a renewable energy industry built on largescale offshore wind farms could unlock billions of dollars in investment and create thousands of jobs in the region, offering a sustainable future for the community.

In the wake of this legislation, Weld Australia is calling on the Federal Government to mandate local content in the construction of critical national infrastructure projects such as these wind farms.

The Offshore Energy Infrastructure Bill could permit the construction of the 2.2-gigawatt Star of the South wind farm off the Gippsland coast in Victoria's south-east.

The Bill could also enable construction of windfarms in our region.

According to Geoff Crittenden, Chief Executive Officer, Weld Australia, “The only way to ensure that these massive wind turbines meet Australian Standards for reliability, quality and safety is to award the fabrication contracts to local Australian companies.

“Local fabricators comply with internationally recognised Australian Standards and are certified by the relevant Australian authority.

“The Star of the South and Marinus Link interconnector projects alone are worth $10 billion combined and are expected to create 10,000 jobs.”

If the turbines are built in regional areas it would potentially see thousands of jobs created in areas like

Tomago.

“The importance of our local manufacturing industry cannot be underestimated when it comes to Australia’s post-COVID recovery.

“Australia’s jobs-driven COVID-19 recovery must be manufacturing-led.”

Industry is calling on the government to make manufacturing a national priority.

“Government, at all levels, must support and invest in the manufacturing sector to aid its growth.

“Mandating local content in national infrastructure projects is the only way to ensure product quality and public safety, create new jobs, and strengthen Australia’s economy,” said Crittenden.

Offshore wind farms have been developed globally for almost 30 years as a viable source of renewable energy.

A number of sites around Australia have been identified for possible offshore wind farms, including two potential projects off the coast of Newcastle.

Cr Nelmes believes this

industry has the potential to deliver a host of benefits for the state and our region, but was mindful of the need for measures to be put in place to protect and deliver local jobs.

Dr Simon Bradshaw, Climate Council Research Director, said, “As one of the sunniest and windiest countries on earth, Australia could be a global renewable energy powerhouse.

“Every day of delay is a missed economic opportunity.

Callout for local tradies THE NSW Government is putting out the call for local tradies to install smart LED lights in NSW public schools, improving the quality of classrooms and cutting power bills.

The $157.8 million LED Lighting Upgrade Program was launched last year as a stimulus response to the COVID-19 pandemic and is targeted at replacing old inefficient lights in NSW public schools with smart LED lights.

Now in its third tranche, the program will see more than 800 schools upgraded across the state.

Deputy Premier and Minister for Regional NSW, Industry and Trade John Barilaro said this is an exciting opportunity for local tradies right across NSW. “As a former chippy I appreciate the ongoing impacts of this virus on local businesses, and the NSW Government is committed to supporting jobs and providing

opportunities for tradies throughout the State,” Mr Barilaro Said.

“Under this program, All LED lights will be manufactured here in NSW and installed by NSW tradies and this commitment by the NSW Government has the added benefit of improving facilities at our schools, ensuring our students get the best possible start in life.”

The NSW Government is investing $7.9 billion over the next four years, continuing its program to deliver 215 new and upgraded schools to support communities across NSW.

STOCKTON residents will be able to make a splash at the local swimming pool after it reopened on 27 September.

Stockton is just one of several swimming centres across the region that has welcomed swimmers back following the NSW Government's decision last week that outdoor public pools can reopen.

Tomaree Leisure Centre and Lakeside Leisure Centre have already reopened to swimmers.

WITH team sports heavily impacted by COVID-19 the team at Medowie Little Athletics are keen to see young people excel in individual sport.

With no organised activities there are still young people out training.

However during the hiatus from regular sporting activities the committee have been working on the grounds for the greater good of the Medowie community.

Kindlebark Oval is known as the home of Little Athletics in Medowie.

Unfortunately, the regular season has not started due to current public health orders restricting community sport.

This has not stopped the dedicated committee of

Medowie Little Athletics from their work.

Medowie Little Athletics has continued their volunteer work throughout this time to support the athletes and wider Medowie community by ensuring the track remains in great condition and making infrastructure improvements to the facilities.

The grounds have recently seen some improvements with funding of $6000 from Port Stephens Council and Medowie Sports Council delivering new park seating and improved landscaping that boosts the appeal of Kindlebark Oval to the community for their recreation and exercise time.

Medowie Little Athletics Committee member Jason Wells told News Of The Area, “The funded project has seen the installation of two new park benches overlooking the oval and the establishment of two native gardens.
