A MAN has received more than $3,000 in fines and lost six demerit points after allegedly travelling more than double the sign-posted speed limit on a Coffs Harbour road.

About 8.20pm last week (Thursday 6 August 2020), officers attached to Coffs/ Clarence Traffic and Highway Patrol were conducting patrols on Jordan Esplanade, Coffs Harbour, when they noticed a Mazda CX5 allegedly travelling at more than 110km/hr in a sign-posted 50km/hr zone.

Charged after not following Covid-19 Notice

JUST after midnight last Sunday (9 August 2020), officers from Coffs/Clarence Highway Patrol stopped an unregistered Toyota Kluger outside a hotel on the Pacific Highway, Coffs Harbour.

Officers spoke to the a 29-year-old female driver who produced a Victorian driver’s licence.

While speaking to her, a 32-year-old man, known to the woman, approached the vehicle.

The pair were arrested and taken to Coffs Harbour Police Station where they were both charged with not complying with a noticed direction, Section 7/8/9 – COVID-19.

They were refused bail and appeared at Port Macquarie Bail Court this week where they were granted conditional bail to appear at Coffs Harbour Local Court also this week.

Charges after fatal cyclist crash

A MAN will face court next month charged over a fatal cyclist crash at Bucca earlier this year.

Just before 6.45am on Wednesday 15 April 2020, emergency services were called to Central Bucca Road at Bucca, about 20km north of Coffs Harbour, after reports two cyclists were struck by a ute turning into a driveway.

The men, both aged 47, were treated on scene for multiple injuries before being taken to John Hunter Hospital and Gold Coast University Hospitals respectively.

One of the men died from his injuries at Gold Coast University Hospital a few days later.

Officers from the Mid North Coast Crash Investigations Unit commenced an investigation into the circumstances surrounding the crash.

Following extensive inquiries, a 63-year-old man was issued a Court Attendance Notice yesterday (Wednesday 12 August 2020), charged with dangerous driving occasioning death, dangerous driving occasioning grievous bodily harm, negligent driving occasioning death, negligent driving occasioning grievous bodily harm, drive vehicle while illicit drug present in blood and not comply conditions of licence.

His licence was also suspended.

He is due to face Coffs Harbour Local Court on Monday 28 September 2020.

King tide washes up old memories

AN ‘UNINTENTIONAL time capsule’ was washed ashore on Jetty Beach during the latest King Tide, starting a search for two people that spans across the world.

Kirra Filewood and her father often go looking for ‘treasure’ - albeit normally seashells - at the Jetty, but when she looked down to find a GoPro wedged in the sand among some seaweed, she had no idea how bizarre things were about to get.

Inspired by one of her favourite YouTube Channels, ‘Man + River’ she decided to try and find the owner.

“I got the GoPro home and managed to get one image off the memory card; it wasn’t an ideal photo as you couldn't really see their faces,” Kirra said.

“I thought it was a long shot but I wanted to give it a

try anyways, so I posted on Facebook to see if anyone could put me in touch with the owners.”

Right away she gained traction with plenty of good samaritans sharing her post.

Just one day later, she was approached by a friend of the woman in the picture - who explained she had lost the GoPro five years earlier while paddleboarding at the Jetty.

“I was so surprised!” Kirra said.

Not more surprised than the owner, Lauren Everett, who now resides in Canada.

She and her boyfriend at the time had been holidaying in Coffs Harbour when they dropped the GoPro into the water.

“I hadn’t thought about it in years, I'm excited to see if it still works,” Lauren said.

“It’s nice to know there’s someone out there that thought to track down the

owner and then be kind enough to send it back to my parents address as I am in Canada.”

Residents stand up to rate rise A PETITION asking Coffs Harbour City Council to justify their recent rate increase is gathering support online.

Kylie Sinclair, a local resident, started the petition on change.org after noticing a discussion had begun on Facebook, with recurring accounts of residents being unhappy or shocked about

their apparent rate increases.

The petition so far has gathered more than 500 signatures.

“It was a spur of the moment decision and I guess the combination of Facebook comments and signatures shows this is a big issue for the community,” Kylie said.

“I’m not saying Council are doing a bad job - I think

a lot of the things they do are done really well, I just want some transparency on why the rates are the way they are.

“One thing is for sure, the rates are at the point where they are placing pressure on household budgets in the Coffs area and it seems at the moment people have had enough with the increases.”

Singh answers Beachstone Action Group questions

By David TUNE THE Beachstone Action Group (BAG) represents members of the North Sapphire Beach community opposed to the proposed redevelopment of the Beachstone café into a child care centre.

The group invited State Member for Coffs Harbour, Mr Gurmesh Singh, to a public meeting in the park adjoining the café on Saturday 8 August to answer questions regarding the redevelopment and other concerns held by residents.

Organisers live streamed the session to residents to comply with current restrictions on public gatherings.

Mr Singh revealed the Coffs Harbour City Council had received more than 325 individual submissions against the proposal, meaning the Development Application would need to go before the Counsellors in session.

“The question of whether the café owner has the right to make this change is a complex legal issue and I am seeking

advice from contract law specialists on behalf of the community,” he said.

Mr Singh advised that changes to State Environmental Planning Policies could take a year or two to process, and that changes are unlikely to be made for individual applications.

In reply to a number of questions relating to the Council’s role in processing the development application, Mr Singh said he

was in communication with Council on this and other matters, and that the high number of submissions had been acknowledged.

Mr Singh advised that the best way to connect with the Council was by residents writing their own letters to each of the councillors themselves, and to do so before the development application goes before Council, which would probably happen in September.

Southern Cross University is among tertiary institutions

offering students a free alternative pathway to study and a second chance at career opportunities they may have

otherwise missed.

These include Transition to Uni and Star Early Offers for Year 12 students.

The newly-modified Transition to Uni program now enables current Year 12 students to study a free sixweek full time or 12-week part-time course online to guarantee their place at Southern Cross, and has intakes this August and in early January ahead of Session 1, 2021.

For Belinda Morris, Transition to Uni was the ticket she needed to study at Australia’s top university for psychology.

The Grafton local, now 18, attended Transition to Uni on campus at Coffs Harbour before deciding to study her Bachelor degree online.

SCHOOLS across the Orara Valley continue to reflect, process and recover from the November bushfire disaster, through a Creative Recovery Project with Coffs Harbour City Council’s Regional Gallery and Museum.

More than 150 students from Coramba Public, Ulong Primary and Nana Glen Public Schools are taking part in outreach programs and workshops through the Regional Gallery as part of ongoing bushfire recovery initiatives.

“Helping the children of the Orara Valley recover from the bushfires is one of the most important aspects of our bushfire recovery work,” said Councillor Denise Knight, Coffs Harbour Mayor.

The current workshops allow students to work with Gumbaynggirr Elder Uncle Mark Flanders and Art Therapist Emma Gentle on classroom-based creative activities to help them work through their experience of the bushfires.

“Schools were closed and communities in the Orara Valley had to deal with

The Regional Museum will also begin to collect and document a selection of the works through its ‘Coffs Collections’ digitisation project to be shared on its public online database.

“In this way, the children’s artworks will be preserved for future generations and will be available as a teaching resource within the classroom,” added Ms Frost.

A COFFS Harbour tourist attraction has turned away almost 50 people from known COVID-19 hotspots in Victoria and Sydney.

Owner of The Butterfly House, Verne Dove, is urging Coffs Coast residents to remain vigilant as people continue to travel to the region despite NSW Health warnings.

“It’s a double-edged sword; we can’t afford to be turning people away but we certainly can’t afford another lockdown either,” Verne said.

“We started turning people away during the school holidays, it was quite a few Victorians then but now it’s more people from Sydney.

“We’re doing this for the greater good and we want people to be aware that people are still travelling here from hotspots.”

She said there have been mixed reactions from the would-be visitors.

“Some are really understanding and are fine; others not so much and we seem to get a negative review online not long after they leave.

“But that’s something we just have to cop on the chin, at the end of the day what we’re doing is for the greater good.”

q Coffs Harbour’s Xanthe Levi took out the recent local Australian Poetry Slam heat.

THE Coffs Harbour Heat of the 2020 Australian Poetry Slam competition was held online on Wednesday 5 July, due to COVID-19.

The annual event, which is usually held in front of a live audience at Harry Bailey Memorial Library, was live streamed on the Australian Poetry Slam’s Facebook site.

Three locals competed, speaking their original literary magic for two minutes each.

Judges on the night were randomly chosen from members of the live Zoom audience, and each competitor was given a score out of ten, adding up to an overall score out of 30.

The competitors were judged on both their poems and their performance when delivering their poetry.

Coffs Harbour’s Xanthe Levi was announced the winner with

an overall score of 26.0 for her poem about information overload and the control others have over our information, while fellow Coffs Harbour resident Jason John was the runner-up with a score of 25.4.

Xanthe also won a $100 gift voucher from The Book Warehouse, and Jason won a $25 Wish Eftpos card.

Xanthe and Jason now continue on to compete at the Regional Finals later this year for a chance to compete in the National Final.

The competition was hosted by three-time Australian Poetry Slam finalist and two-time national runner up, Andi Stewart, and the local heat was organised by Coffs Harbour Libraries.

In 2017, the Coffs Harbour region took out the annual event when local youth Solli Raphael was crowned the youngest ever winner at the Australian Poetry Slam National Final at Sydney Opera House.

Foreshore Committee Park Avenue Pharmacy Robbery to be decided

ON WEDNESDAY 5 August the Park Avenue Pharmacy in central Coffs Harbour was robbed by an armed man.

The man entered the premises at 5:30pm and threatened staff with a knife, demanding money

and drugs.

Staff complied with his demands and he left with cash and a large amount of pharmaceuticals.

“The police arrived within two minutes of us calling them, and were amazing, reassuring everyone. They were total professionals,” said Pharmacy Manager David

Metcalf.

Police apprehended a suspect within hours of the robbery.

While no one was physically injured, pharmacy staff will be provided with counselling and assistance to deal with the impact of the incident.

THE revitalisation of the Coffs Harbour Jetty Foreshore Precinct is another step closer, as the NSW Government deliberates on who will sit on the project steering committee.

The Department of Industry, Planning and Environment is now in Stage Three of six project stages.

“The Department is currently in the process of evaluating all submissions and should be in a position to announce the PSAC membership in the coming weeks,” a spokesperson for

the department said.

They will now recommence stakeholder and community engagement to discuss the feasibility study outcomes and gather feedback to help inform a detailed concept plan for the site.

The National Cartoon Gallery hosts ‘Toons 4 Wildlife’

By David TUNE THE National Cartoon Gallery will open a new exhibition called ‘Toons 4 Wildlife’, generating vital funds to support WIRES in their bushfire recovery work.

The gallery, the only one of its kind in the southern hemisphere, is an ofttimes overlooked gem in the Coffs Coast list of unique attractions.

The exhibition will open with a major function starting at 6pm on 22 August, featuring an opening address by the NSW Commissioner of Resilience, Shane Fitzsimmons.

The night will include some special Australian guests brought along from Reptile World as well as

other surprises.

‘Toons 4 Wildlife’ was created by Australian cartoonist Mark Tippett from TIPPETTURES and features over 90 works from some of Australia’s best cartoon artists.

“Toons is a pictorial response to the horrific bushfires in January across the country: it is a visual diary of a dark page in our recent history. It’s been rewarding to rally the cartoon troops and put together this unique show for WIRES,” said Mr Tippett.

Some of the original works and

signed prints will be auctioned online, with proceeds going to WIRES to support them in aiding our wildlife’s recovery from the bushfire devastation.

The exhibition will be at The National Cartoon Gallery located at 1 John Champion Way, Coffs Harbour from 22 August to 22 November.

Love conquers all A Marathon for Life

IT CERTAINLY wasn’t the way they had always visualised their wedding day, but local couple Andrew & Kiesha Cutugno were not going to let a pandemic get in the way of their union.

The Sapphire Beach pair, like so many other couples planning to tie the knot in 2020, were thrown into a spin as COVID hit.

Their initial thought was to postpone the wedding but as it looked like restrictions would stretch longer than expected, they decided to go ahead.

“Everything was so up and down, we decided that what was important to us was the ceremony and being married, not so much throwing a big party as we could do that any time...so we stuck with our date and rolled with it,” Keisha said.

Guest numbers were culled to adhere with restrictions; wedding favours were hand sanitiser (labelled ‘Spread Love, Not Germs) and the remainder of friends and family who couldn’t travel or attend were virtually there thanks to an online Zoom event.

“We are big believers that everything happens

IN 2019, at the age of fifty-eight, Diana Christian decided to start running in marathons.

Her actions since have led to her becoming an inspiration to many.

Knowing her training regime would be intense, Diana was completely committed to her health and fitness journey.

On a rare off-day from training, Diana decided to go for a motorbike ride in the country.

She was enjoying her time riding, when a four-wheel-drive crossed suddenly over to her side of the road.

Diana lay motionless, in and out of consciousness, lucky to have survived the accident.

Quickly flown to John Hunter Hospital, Diana had a total of five operations and spent three long months lying flat on her back.

Showing incredible resolve, Diana began the journey towards recovery.

“My motivation to gain my independence was strong,” said Diana.

“During rehab I stayed focused, but it was so exhausting and very painful, sometimes often leaving me feeling defeated.

“The day I was told I could finally return home left me terrified, suddenly realizing I would be leaving the safety net of the hospital,” she said.

“We actually got to be present with all guests, we had meaningful conversations and we all know normally at big events it’s normally just ‘hi and bye’ so it was perfect for us.”

The most challenging part was not having family, including Keisha’s mother who lives in Tasmania, physically present.

Thanks to technology, she didn’t miss out and was there virtually online.

“The best thing at the

end of the day it really just reinforced to us what was important and that was our ceremony together; everything else just fell into place.”

Keisha has some advice for any other couples feeling defeated about their wedding plans this year: “Don’t stress and try not to over-plan - I have found you can organise a lot in a month or even a week - and remember what’s important and that’s marrying the one you love.”

“In the first park run that I attempted I used my walker, I did not complete it, but I still felt immensely proud of myself.

I walked without any aid in the next event and I even managed to run the last fifty meters,” she said.

“Another huge accomplishment was when I hopped on the back of my husband’s bike, I was very hesitant & very emotional.

Diana told News of The Area, “This year I completed a 10km running festival by using a walk and run method.”

“I do have permanent injuries and limitations that I sustained from the accident, but I am determined to keep working hard to improve my movement and strength.

“I will stay positive and focused and I certainly do not take life for granted anymore.I am so thankful to still be here.”

Indigenous Art Lovers Be Still Your Hearts

COFFS Harbour Regional Gallery will exhibit a private collection of 27 pieces of Indigenous art received as a generous donation.

The show, being held from 21 August to 17 October, features the work of more than 30 artists from Central Australia, the Kimberley and Arnhem Land.

The exhibition includes paintings by brothers Thomas and Walala Tjapaltjarri, who lived remotely and traditionally until the early 80’s, Nellie Marks Nakamarra, Phyllis Thomas, Tommy Carroll, Gracie Morton Pwerle, June Peters and many others.

The collection, from Robert and Janice Hunter, began in 2007 after Robert visited the Aboriginal Art Gallery in the Queen Victoria Building in Sydney.

He then started browsing and purchasing the artworks online.

The first piece he bought was by Stan Brumby and he was so impressed he bought two more.

Spring garden competition blooms again in 2020

By David TUNE THE Coffs Harbour Garden Club is running its Spring Garden Competition again this year, continuing the annual tradition started in 1989.

As one of the largest of its kind in NSW, the competition encourages people to partake in a healthy hobby, contribute to the beautification of the city and to be conscious of caring for the environment and being ‘water wise’.

Coming off the back of extended COVID-19 restrictions, the club is anticipating a bumper year.

“Entry is free again this year and there are some great prizes to be won thanks to our wonderful local sponsors,” said Garden Club President, Margaret Hunt.

“The competition aims

to provide people with a practical and healthy way of helping keep Coffs Harbour looking beautiful, and we encourage all gardeners to have a go.”

There are nine residential categories, as well as two in the commercial and industrial section, with optional WaterWise categories available as well.

Competition judging is performed by an independent, qualified judge from outside the local area to ensure the integrity of the competition.

Entries for the competition are now open and will close at 5pm on Friday, 4 September.

Judging will take place from 13 to 15 September, with all results posted to the Club’s website no later than 8pm on Friday 18 September 2020.

popular markets since their closure at the end of March.

Mr Timms told News of The Area about the difficulties of the past few months.

“I have a stall at the Sunday Markets and if it wasn’t for those, I would be having a harder time.

“But even then, I had more produce than I could sell. I’m so happy to get started again,” said Mr Timms.

“I will be back in town with all my winter brassicas such as cabbage, kale, silver beet, beetroot, broccoli, cauliflower, potatoes, pumpkins and freerange eggs as well.”

Coffs Harbour Mayor Councillor Denise Knight welcomed the reopening of the popular Thursday market.

“I know the Market has been hugely missed during this pandemic shutdown by locals, visitors, the stallholders and City Centre business-owners,” she said.

“It’s great to have it back and showcasing all the wonderful produce the Coffs Coast is famous for.”

As well as fresh local produce, there will be lovingly hand-made creations from

local growers and makers including Coffs Coast Honey, Raw Food Hub, My Twin Loaves, Bellingen Soap Cakes and more.

All stallholders will be practicing social distancing and will be encouraging cashless payments.

To minimise congestion, customers are being encouraged to ‘shop and go’.

Coffs Harbour City Council’s City Centre Marketing and Activation Coordinator Victoria Harper said that the markets were good for local business.

“Local businesses have told us they see a significant increase in pedestrian traffic when the markets are held in the City Centre so they were very keen to have them back up and running again,” she said.

“The economic and community benefits of having a local Growers Market are very wide-reaching. Before we reopened, we wanted to ensure that we had a COVIDsafe approach firmly in place for the market stallholders, City Square businesses and pedestrians.”

More Prostate Nurses For Coffs LOCAL men with prostate cancer and their families will benefit from an expansion of the 2020-2021 Australian Government’s Prostate Cancer Nurses Program.

Coffs Harbour Health Campus is one of 24 locations across the country to receive more prostate cancer nurses as part of the expansion.

Government is investing $23 million in the program through the Prostate Cancer Foundation of Australia over the next three years to support existing prostate cancer nurses and place specialist nurses.

Prostate cancer is estimated to be the second most common cause of cancer death in Australian men in 2020, with an estimated 3,152 deaths.

Sadly, more than 16,700 Australian men are expected to be diagnosed with prostate cancer this

year.

Since 2013, this program has funded the recruitment, training and placement of prostate cancer nurses in 29 locations across the country.

The Government is committed to improving health outcomes for men with prostate cancer and provides significant investment through provision of specialised nurses, medical services through the Medicare Benefits Scheme and pharmaceuticals through the Pharmaceutical Benefits Scheme.

Since 2013, the Government has also provided over $84 million in support for prostate cancer research through the Australian Prostate Cancer Research Centres, the National Health and Medical Research Council and Cancer Australia.

Proposed to contain 32 units and $9,000,000 cost

By Emma DARBIN COFFS Harbour City Council has readvertised a controversial multi-story development on the corner of Market and Queen Streets at Woolgoolga.

The application has been re-notified because of amended architectural plans submitted to Council by applicant ArkExpress Design.

The residential flat building, proposed to contain

32 units and cost $9,000,000 to build, has caused controversy among Woolgoolga locals due to its unusual design which many deem ill-fitting with the rest of the town centre, and its five-storey height limit.

The development application was originally advertised in March this year, following lodgement of the application with Council in February.

The amended application and accompanying documents

may be viewed at Council’s Customer Service Centre during office hours from now until Tuesday 25 August or on Council’s online application tracking at www.coffsharbour. nsw.gov.au.

Submissions can be made until 25 August by email to coffs.council@chcc.nsw.gov. au.

Any previous submissions will be considered as part of the assessment of the application.

INTERNATIONAL music stars Jimmy Buffett and Jason Mraz have played them for a long time, Sir Paul McCartney played The Beatles’ hit “Something” using one during his Australian tour and ARIA winner Vance Joy has inspired millennials to take it up.

Ukuleles can be played easily with small hands and old hands, so they have a growing popularity in primary schools, such as Naranga Public School, as well as with older Australians.

They are easily portable and, because they have only four strings, can be learned quickly.

Learning to play is almost “instant gratification” because anyone can play a simple song after one lesson.

Groups are increasing in the Coffs Coast area and many people, of all ages, have lessons and take part in group jam sessions.

For those who want more of a challenge, there are innumerable videos on YouTube.

The ABC reported, in March, that ukuleles topped musical instrument imports to Australia with about 200,000 each year, more than

The Coffs Guitar shop sells between 60 to 80 ukuleles each month and ukulele song books are very popular.

first instrument.

As well as providing a creative outlet, there is a social dimension to playing the ukulele, especially in retirement homes where residents enjoy playing in groups.

The ABC report dubbed the ukulele “the happy instrument” because it allows non-professionals to make music and brings joy to players and listeners alike.

Sawtell’s Rosie Smart may need to give a little thank you to her younger brother Creed after she won the under-16 girls division at the Woolworths NSW Junior State Titles held at her home beach on Sunday before doubling up at the NSW School Surfing Titles on Tuesday.

“So I just paddled out and I had a go.”

Rosie’s father Steve said an hour later she was still going in and out and the goofy footer has hardly been away from the beach ever since.

Rosie gained the upper hand in the first final thanks to a nearperfect 9.00 wave score that allowed her to gain the edge on her closest rivals and take the win.

Rosie was able to gain the upper hand in the final on the strength of a 7.83 wave score that allowed her to have an edge over Juniper Harper (Byron Bay High) and Bonnie.

Another Coffs Boardrider, Carly Shanahan, also reached the final in the under-18 girls of the Junior State Titles.

Carly won her semi-final before she finished third in a hotly contested final behind winner Lily Macdonald (Freshwater) and Cedar Leigh-Jones (Avalon).

Running Festival postponed due to COVID DUE to increasing restrictions being placed on the number of people who can gather together, a much-loved annual event on the Coffs Coast has been cancelled.

Next month was going to be the 10th time the Bendigo Bank Coffs Harbour Harbour Running Festival was held.

Event organisers apologised for any inconvenience the decision has caused but said they couldn’t commit to begin receiving registrations only to be forced to cancel the event due to the likely increased government measures.

“A lot of effort has gone into preparation to get it to this point and the decision has not been made lightly,” they posted on social media.

Organisers are looking at running next year’s event on 12 September.

NDIS Masks costs covered

AN important announcement means NDIS participants and staff in NSW will no longer be out of pocket for masks as part of their Personal Protective Equipment.

Minister for the National Disability Insurance Scheme, Stuart Robert, announced temporary changes to funding arrangements to allow NDIS participants in Victoria and New South Wales to claim the cost of personal protective equipment (PPE), including masks.

With community

transmission of coronavirus evident in both states and in line with current health advice, Minister Robert said the Australian Government was acting to ensure participants more at risk are supported to access PPE and continue to receive their disability supports.

‘Unfortunately, we’ve seen in recent weeks that our battle with COVID-19 is far from over,’ Minister Robert said.

‘As a result, we have put in place additional temporary measures so participants living in Victoria and New South Wales,

who have face-to-face assisted daily living supports can flexibly use their existing NDIS funds to cover the cost of the PPE they need to keep themselves safe, including face masks.

‘We know that participants who receive face-to-face supports may be at higher risk of transmission, with daily support from their workers regularly involving close physical contact.’

NDIS participants who rely on face-to-face supports and assistance with their daily living will be able to use an existing support item (Low Cost

Disability-Related Health Consumables) to claim on the cost of PPE for the times their worker is with them.

In Victoria and NSW, the ability to claim for the cost of PPE will be extended to providers allowing workers to continue delivering essential disability supports to NDIS participants.

Participants living in their own home who test positive for COVID-19 and are required to self-isolate or quarantine will also now be able to claim for related cleaning costs.

The value of land between Jordan Esplanade and the railway line is proposed to take a conservative 400 high rise apartments with a suggested land value of $200,000 per apartment which would show a handsome profit of around $120 million to the land owners.

The land in question is State owned. The State Government represents Coffs Harbour (CH) on this issue. Consequently, it is the population of CH who ought to determine what should be

additional car parking space as well as doubling our green area. Once we concede to a three to five story development, we forfeit our inheritance.

Sydney should not determine what is good for Coffs Harbour.

Let us not look at this issue through short term glasses, rather adopt a futuristic dream of our children and grandchildren playing in a safe environment in the years to come. That, to me, is of far greater importance than clogging this pristine area with hundreds of apartments.

Inclement weather causes access to be stopped Dear News Of the Area, MANY locals visiting Coffs Jetty area today left bewildered.

Coffs Harbour Council (CHCC) has closed off both the southern breakwater and the Coffs Harbour Jetty to visitor access with a sign on the Jetty signalling the reason is due to

inclement weather.

Whilst it is the first time I can remember the Jetty being closed for any reason other than maintenance works it is not necessarily the case for the Southern break wall.

One can only speculate as to Councils reasoning and the criteria they use to reach such

a decision.

Incidentally, there is only a relatively gentle breeze blowing in this area at 10.00 am this morning and sea swell and waves are minimal.

Capacity and Undue Influence JENNY has two children, Penny and David.

Jenny owns two houses and makes a will, leaving a house to each of her children.

A couple of years before she passesaway, Jenny changes her will and leaves both of the houses to David, effectively cutting Penny out of her will.

Penny commences action in the Supreme Court of New South Wales alleging that Jenny did not have the testamentary capacity to make her last will. She also alleges that David applied undue influence in causing her to make the last will solely in his favour.

The Court hears evidence that when Jenny made her last will, she did not use her usual solicitor, that David was present during the consultation and that Jenny was 90 years of age at the time.

David alleges that Penny stole personal effects and money from Jenny during her lifetime and this is why she was left out of the will. Penny and her children give contradictory evidence regarding their relationship with Jenny.

There was medical evidence adduced that two years before making her last will, Jenny was suffering from mild cognitive impairment.

The solicitor’s file notes, regarding the drafting of Jenny’s last will, were considered by the court to be unsatisfactory because they did not address Jenny’s testamentary capacity and they did not explore the reasons for the extreme change to her will.

The Court ultimately finds that the circumstances surrounding the making of Jenny’s last will, which included the possibility of “practical coercion”, created a “cloud of suspicion” and where David could not establish that Jenny possessed the requisite capacity to make her last will, it was ruled invalid.

The “penultimate” will was therefore enlivened and Penny received one of the houses.

Dear Virginia, NOW, if you had said your seven-year-old son was doing this to your five-year-old daughter, I would have explained it off as sibling shenanigans, but this is your husband. The man you vowed to love and honour in sickness and in health (until he lost the use of his faculties after two many longnecks), and the man who vowed to love you until death do you part (until your mother-in-law moved into the spare bedroom during the pandemic).

And now we have what feels to me to be the start of a War of the Roses movie.

So, his cold wet hands are innocent enough, but of course it can't stop at that. You have no choice but to retaliate, and so you do, in jest of course, sewing the arms of his shirts together, or, on a rainy day, putting multicoloured blobs of paint on his windscreen wipers to create colourful rainbows when he's in a rush to go to work. You know, those sweet little gestures that let him know you are still fun. The problem is, he will get back at you and take it up a notch, and very soon you'll be locking him in a sauna and turning his beloved dog into pate.

It can't last of course. This oneupmanship. So as much as it may kill you, maybe laugh off his icy hands and then look into his eyes and whisper, 'Game on, and it starts with tonight's dinner.'

I reckon he'll never do it again and your life will go back to its former state of marital bliss.

Real Estate Steady Despite COVID-19

UNLIKE many businesses, local real estate sales have remained steady during the pandemic.

This is partly because many people, who have been working from home, now realise that they do not have to live in a major city.

According to local real estate agents, enquiries from Sydney, Brisbane and Melbourne are steadily increasing.

PRD, said that prospective buyers from Sydney and Melbourne have shown interest in rural property in Coramba, Karangi, Nana Glen and Upper Orara.

“They are seeking privacy and space, and there have been a number of enquiries about properties suitable for horses and livestock,” she said.

UnRealestate’s Chris Hines revealed that many people are uncertain about selling because of the uncertain economic circumstances.

“With less properties on the market, prices stay strong, and, because there are more buyers than sellers, properties sell quickly.”

“As well as local and

Artist Darren Bromell plans to brighten Coffs Harbour

LOCAL artist Darren Bromell has an idea on how to brighten up some of Coffs Harbour’s commercial areas.

Noticing that there are many empty shop fronts with ‘For Lease’ signs in the window, Darren has collected the details of the managing agents and is contacting them offering to put some of his colourful paintings in the windows for free.

Darren began painting some four years ago, having been forced out of work by a major debilitating injury to his back.

“I was alone at home during the day slowly going mad, unable to continue my favourite sports

and hobbies, and finding and developing my artistic skills has saved my sanity,” he said.

Always interested in drawing, he decided to attend a class in painting with watercolors at the local gallery and discovered that he had some talent.

A friend suggested that he should look at using acrylic paint and Darren immediately found that it worked perfectly for his ‘Naive’ style paintings, going on to win first prize in Woolgoolga Rotary’s 30 year anniversary art competition with a work titled ‘Red Sky at Night: Bananaland’ in 2018.

Masterplan amendments open for viewing

By Emma DARBIN WOOLGOOLGA residents are now able to view proposed amendments to the Coffs Harbour Local Environment Plan (LEP) 2013, which includes the Woolgoolga Town Centre Masterplan.

The Woolgoolga Town Centre Masterplan has been an issue of contention recently with many new proposed building developments in the village deemed by locals to be above existing maximum height limits.

The Woolgoolga community has requested that maximum building height controls for the Beach Street Village Precinct and surrounding residential land be reduced from 15.5m to 11m to retain the town’s relaxed

village character.

The proposed LEP amendments seeks to implement the recommendations within the Masterplan, including retaining the existing maximum building height controls of 15.5m (approximately five storeys) for four key corner sites within the Beach Street Precinct, reducing the maximum building height control for the remaining land within the Beach Street Village Precinct from 15.5m to 11m, and reducing the maximum building height for the Woolgoolga Public School site from 15.5m to 8.5m.

The proposed LEP amendments also seek to rezone land along the Clarence and Beach Streets Corridor from R3 Medium Residential to

R1 General Residential.

This change is intended to strengthen and facilitate the development of tourism, including short-stay accommodation, and increase the choice of living options to meet the needs of an aging population requiring smaller household sizes.

The objectives of the proposed LEP amendment are to implement recommendations within the Woolgoolga Town Centre Masterplan, rectify anomalies and resolve a number of matters so that Coffs Harbour LEP 2013 remains up to date and accurate.

More than $20,000 was raised for youth homeslessness on the Coffs Coast.

“It’s probably a good way to be as it won’t taint the thinking about how we want to play,” he said.

Sawtell is at home against the Northern Storm. Boambee is also at home hosting Port United.

The Coffs Coast Tigers face the long road trip to play Taree Wildcats while there’ll be a Kempsey derby between Kempsey Saints and Macleay Valley Rangers.

Lopko in fine form as Lions triumph Tigers

By David WIGLEY THE local derby started at a frenetic pace as the Lions and Tigers exchanged early chances in the Coastal Premier League.

After 15 minutes it was the pace and precision of Caleb Lopko that broke the deadlock as he bolted down the right wing and shot from the edge of the penalty box and watched the ball glide into the top corner of the net.

Caleb was a constant threat and on 24 minutes he sprinted down the right wing and crossed over to Scott Goddard who side footed into the back of the net.

On the half hour mark Caleb struck again as he broke down the right but seemed to run out of pitch as he approached the by-line. An instinctive chip left everyone watching as the ball floated into the air and dropped into back of the net to put the Lions 3-0 up.

The resolute Tigers regrouped and piled the pressure back onto the Lions who were under the pump for extended periods.

It was the man of the match Caleb Lopko who ended the contest on 75 minutes when he popped up on the left hand side. A classy stepover and a drop of the shoulder created enough space for a shot which he fired into the back of the net to seal the points and his first ever hatrick for the Lions.

In the post match interview Caleb was thrilled with his performance and the contribution he made to the team.

Caleb said, "This is my best ever

season and the extra hard work I've put in at training is starting to pay off."

The Lions coach Glen Williams was delighted with the victory and commented, "The first half was the best football I've seen in a long while, everything just clicked."

However Williams was quick to warn against complacency and reiterated the strength in depth of the Coastal Premier League.

"This is the closest league I've ever been part of, there's very little difference between top and bottom of the league and with such a tight comp everything can change quickly. There's only two points between the top four teams so we need to focus on Saturday's match against the Saints," he said.

Port Saints, Macleay Valley Rangers and Boambee all won their matches which means the Lions stay one point ahead with a chasing pack breathing down their necks. All eyes go to Saturday 15th as the Lions travel to second place Port Saints, Boambee host Port United and Macleay Valley Rangers have a home town derby against the Kempsey Saints.

Cup winner’s purchase price no gamble

WITH a stirring victory in the Coffs Harbour Gold Cup, Sikandarabad helped Muswellbrook trainer Sam Kavanagh prove the doubters wrong.

A black-type winner with a third and fourth placing in Group 1 races while part of the David Hayes stable, Kavanagh said buying the Dr Fong gelding had people questioning his judgement.

“I bought him online for a hundred grand and everyone said I was crazy,” Kavanagh said.

“It was because he was seven (years-old) but we needed a horse that could take us to town and win Saturday races.

“He’d run some great races in his career.”

The run in the Gold Cup was another great race.

Battling up the straight with pre-race favourite The Academy, Sikandarabad found something extra to finish two lengths in front of a fast finishing The Kingdom. In a blanket finish for the minor placings, only three-quarters of a length separated The Kingdom, The Academy who

continued to fight near the rail, Saxton Rock and Cogliere.

Kavanagh was confident of victory despite being the top weight, drawing a wide gate and not having the best winning record.

“I said to the owners earlier in the week ‘I’m not one to have my last on a horse that’s had four wins from 32 starts and hasn’t won for eighteen months but I couldn’t have him any better’.

He’s just been flying,” the trainer said.

THE North Coast Open that was set to bring a top field of professionals to the Coffs Harbour Golf Club next month has been postponed.

With COVID-19 transmission evident throughout the community, Golf NSW and the PGA of Australia made the decision to reschedule the NSW Regional Open series which the Coffs Harbour event was a part of.

to have athletes from interstate and metropolitan centres travelling across regional NSW, much of which is predominantly COVID-19 free.

General Manager of Golf at Golf NSW, Graeme Phillipson, said the decision was made to protect both players and the regional communities around the host clubs from any possible COVID-19 transmission.

"We appreciate this decision will be disappointing news to many. However, remain assured we are working closely with all the stakeholders concerned to ensure the tournaments are rescheduled (COVID permitting) as soon as possible."

Coffs Harbour Golf Club

general manager Paul McAra said the tournament, which is going to be a qualifying event for the NSW Open, is still coming to the club.

He predicted the new dates for the event will be some time between November and March.

"The dates will be set once other events have been finalised such as the Australian Open and PGA," McAra said.

"It's definitely a postponement not a cancellation. It will go ahead.

"When they shut the Queensland border it was going to be NSW players only.

By waiting it makes sure it (the North Coast Open) is going to be a better event."

Another win for Knights

THE Harbour Knights maintained their unbeaten record with another win on the road.

The Knights gained a bonus point scoring seven tries in a convincing 39-0 victory over Robb College to continue a strong start in the foray into the New England Rugby competition.

While the scoreline looks onesided, Knights co-coach Brendan Hoy said the final scoreline was a bit flattering.

“It wasn’t until the last 20 or 30 minutes that we were able to

get on top of them,” Hoy said.

“I think we just had a little bit more depth than them. We also had a lot of possession so that tired them out.”

That depth will be tested in the coming weeks with the Knights losing two scrum halves and a pair of flyhalfs already this season.

The positive is the injuries have created opportunities for others with younger players readily stepping up.

Having his first start in the number nine jersey, 18 year-old Max Hartman impressed with

how he controlled the match.

Another eye-catching performance came from the lightning quick Max Shaw who scored two tries from his wing.

The Knights are back at home this weekend to face Barbarians.

The home team will be favoured to continue its unbeaten run but Hoy said the team still has room for improvement.

“We gave away a few too many penalties and had too many turnovers again,” he said.

“That’s something we’ll have to work on again this week.”
