city of chico shakedown Online rental-booking company Airbnb has been

around since 2008. Another similar service, VRBO (vacation rentals by owner), has existed for more than a decade longer than that. Still, Chico’s City Hall has been in the Stone Ages when it comes to understanding the websites property owners use to list their so-called short-term rentals.

Indeed, last year, when responding to a code enforcement issue, the city attempted to put the kibosh on a Chico family’s operation at its property on the west side of town on the grounds that type of rental wasn’t permitted by existing municipal code. In that case, the family in question faced more than $8,000 in fines, along with citations.

The homeowners ended up hiring an attorney and, ultimately, in August 2017, an administrative law judge ruled in their favor—noting that the city’s code did not explicitly outlaw such rentals.

Since then, the folks at City Hall have changed course. To wit, city code has been amended insofar as to include the aforementioned type of properties in the section calling for the collection of transient occupancy taxes (TOT)—a fee historically paid by hotel, motel and bed and breakfast operators. Here in

Chico, that tax amounts to 10 percent.

That about-face took place this past April. Here’s the rub: The city only recently started calling for payment of the taxes and is attempting to bill retroactively—not back to spring, but back to a year ago.

The justification is that the municipality has always been able to collect taxes on short-term lodging. Sure, that’s technically true. Hotels and the like have been paying the fees for as long as we can remember. They do so by passing on the cost to their customers.

Considering the city argued that rentals like those booked through Airbnb weren’t allowed to operate, collecting back fees seems like nothing more than a money grab. Additionally, the aforementioned code revision is essentially an admission the former language didn’t suffice.

Our take: asking these operators to pony up taxes that they only recently learned about and hadn’t budgeted for is unfair and an undue burden. Indeed, we’d go as far to call the city’s demand a shakedown.

The fix: Properly notify the public of the change and give owners the opportunity to pass the fees on to their customers. That’s the business-friendly and equitable thing to do. Ω

agenda: codify the assault on workers’ rights in favor of unfettered capitalism free from government interference. Those who control the nation’s wealth will control the legislative process, and laws will favor capitalism, not democracy.

The American Legislative Exchange Council (ALEC) is a shadowy back-room arrangement where corporations pay good money to get friendly legislators to by introduce prepackaged bills in state Roger S. Beadle houses across the country. Started in the author, a chico the mid-1970s, it is an organization resident, is a chico State alum dedicated to the advancement of and former free market and limited government small-business principles through a unique “publicowner. private partnership” between state legislators and the corporate sector.

Early funders of ALEC were Charles and David Koch. Hundreds of the organization’s model bills and resolutions bear traces of Koch DNA: raw ideas that

were once at the fringes but have been carved into “mainstream” policy through the wealth and will of Charles and David Koch. Of all the Kochs’ investments in right-wing organizations, ALEC provides some of the best returns: It gives them a way to make their brand of free-market fundamentalism legally binding.

Charles Koch has long sought to have influence in judicial appointments—judges who would rule favorably on behalf of corporations over workers’ rights, environmental damage, pay inequality and gender discrimination. Their money has been instrumental in determining the makeup of today’s judicial courts, especially the Supreme Court, and the placement of Neil Gorsuch and Brett Kavanaugh on its bench.

The Kochs have worked to shape legislation that touches every state. For example: The Furthering Asbestos Transparency Act of 2017 (FACT Act), a bill that, if passed and signed into law, will directly impede support and compensation to asbestos victims and their families.

An ALEC darling, Gorsuch wrote the Supreme Court’s 5-4 opinion in Epic Systems Corp. v. Lewis, requiring employees to surrender their right to pursue class-action litigation as a condition of their employment—a blow to collective bargaining, a slap in the face of 25 million workers. Money well-spent. Ω

credit and incredulous It’s time to give credit where credit is due. On Tuesday evening (Oct. 2), during the Chico City Council’s regular meeting, Councilman Andrew Coolidge (the only incumbent seeking re-election) broke from the conservative ideologues—and Vice Mayor Reanette Fillmer, who has a hard time grasping complex issues and instead simply follows the herd—to support a shelter crisis declaration.

Doing so will allow Chico service providers the opportunity to apply for one-time state funds that will buoy existing programs and help launch new solutions to get people off the streets and into stable housing (see Ashiah Scharaga’s report on page 9).

More good news: Fillmer and Councilman Mark Sorensen have less than a handful of meetings left to represent Chico. Four to be exact— and that includes the first meeting in December, during which they will take their leave as the winners in the Nov. 6 election are sworn in.

That can’t come soon enough for many members of the public and—from the looks of it—Sorensen and Fillmer. Both have become increasingly acerbic—the former regularly launching into smug diatribes and the latter attacking members of the public in her trademark valley girl, run-on-sentence way. They typically do so following public comment—to get the last word.

Their behavior was disappointing generally, but especially so considering what was at stake. We’re talking about potentially millions of dollars’ worth of services that will aid marginalized people and in turn help relieve a community burdened by this epidemic.

Many service providers and public agency representatives talked about how a shelter crisis declaration presents an opportunity for their organizations to better address local homelessness. I’m referring to social workers, the Jesus Center, Chico Housing Action Team, Caminar and a host of others with bona fides.

One representative of the Butte County Office of Education noted that there are at least 1,300 homeless students in the county, including more than 500 in the city of Chico. You may have seen Ashiah Scharaga’s coverage of that topic in our Sept. 13 issue (“For the kids,” Newslines) or watched the Action News Now piece that chased our story.

Each speaker made compelling arguments for the funding.

Still, Sorensen remained incredulous. It was a little jaw-dropping to hear his conjecture that accepting money from the state would result in “more policies that will enable, promote, support and attract all of the bad behaviors that we’ve all been trying to figure out how to get under control.”

What a slap in the face to all of the professionals and volunteers working to better people’s lives. Moreover, it’s clear that the policies he and the conservative majority have put into place over the last four years have done little to nothing to address this crisis.

Nobody billed the money as a panacea. However, members of the public calling for the council to reject a shelter crisis designation kept repeating the mantra that money won’t cure homelessness.

Their opposition seemed to stem from the ill-informed notion that boosting services will attract additional homeless folks.

Faux eco gov Re “Delta Dan” (Greenways, by Scott Thomas Anderson, Sept. 27): I could not agree more with the article about Gov. Jerry Brown being a fake environmentalist. He has taken millions from the oil and gas industry and is in cahoots with big ag and pharma to rape our state’s water on their behalf.

His bullet train from San Francisco to L.A. is nothing more than a way to pay unions for their support of his Democratic party in the elections with billions in taxpayer money. When it is all done, we will have a slash of land, probably fenced entirely, that restricts the movement and interaction of wildlife through half the state.

But, his Sites Reservoir project in the hills west of Willows and the Delta tunnels is a complete environmental catastrophe for our state.

The idea is to suck water out of the Sacramento River during rainfall periods in the winter and transport it to the corporate farms and voters in the L.A. basin. These rains flush

our watershed of pollutants and feed massive nutrients to the near shore fisheries, which are the beginning of the food chain for our entire ocean.

The Sacramento River and Delta will be destroyed. His groundwater sucking plan is also in full gear.

‘National disgrace’ Re “Today, it’s time to make a stand” (Editorial, Sept. 27): After reading your editorial, one thing is clear: you haven’t the first clue what constitutes a “constitutional crisis.” You state that Robert Mueller and Rod Rosenstein have unimpeachable credentials, but Brett Kavanaugh is a serial rapist?

Based on what evidence?

You’re right about one thing, though—Kavanaugh does represent a decisive vote on not just Trump’s unproven collusion charges but every SCOTUS decision. This is why the Democrats have engaged in this disgusting character assassination. It is a national disgrace

and anyone who supports this kind of behavior is complicit in tearing down the fabric of our democracy.

Additionally, if the NYT story on Rosenstein is true (he denies this story), then this is tantamount to “fomenting insurrection.” That, my dear Ms. Daugherty, would be a constitutional crisis. Rosenstein should be fired for withholding evidence in the form of redacted documents that were requested by the institution that makes and reviews the laws of this nation, Congress.

City Plaza was the scene of a protest of Kavanaugh’s nomination with the hashtag #BelieveSurvivors. I prefer the hashtag #IbelieveFactsandEvidence, but facts and evidence apparently are not required when destroying a man’s life, especially when that man has been nominated by a president you don’t like.

Editor’s note: Nowhere in the aforementioned editorial was Brett Kavanaugh referred to as a “serial

rapist.” We did note that the Senate Judiciary Committee last week was to hear testimony on the sexual assault allegations against him.

On that SCOTUS pick If a judicial nominee ever committed a sexual assault or lied under oath, he’s disqualified.

What standard of proof should we use in evaluating these things?

Proof beyond reasonable doubt?

“Beyond reasonable doubt” permits seating a nominee even if it’s probable he is guilty. The “presumption of innocence” and “proof beyond reasonable doubt” apply strictly to criminal cases where liberty is at stake, not a “job interview.”

Should Congress use a “mere probability” standard: Is it more likely right than wrong that Judge Kavanaugh is guilty? About onethird of Americans are unsure if he was telling the truth. Can we take a 50/50 chance—a pure guess—that we might seat a guilty man on our highest court? A 10 percent chance?

We must use a “full confidence” test for Supreme Court nominees.

If there is a “substantial chance” he’s guilty, he should be rejected.

A Supreme Court justice with a lifetime appointment must be beyond reproach. Each justice has absolute power to vote on what is the “Supreme Law of the Land” and the rights of 330 million people. Americans must have “full confidence” in their Supreme Court.

Kavanaugh’s years at Georgetown Prep highlight the problems of male-only organizations. For decades, San Francisco’s Bohemian Club has vetted prospective presidential candidates at its summer “camp” in Sonoma County (except, obviously, Hillary).

How about the Masons? Cops and lawyers are well-represented in that secret society, which has the reputation that a Masonic judge will favor any fellow Mason in the dock.

Boys-only groups are probably a big reason why we have too few elected women, female presidents of universities and corporations, and female judges. Professional women have been too busy with household chores and parenting to set up secret female-only societies.

Although de facto racial prejudice still undercuts justice, blatant bias against people of color is now unacceptable. So why do we still tolerate this notion of male superiority?

No judge in the U.S. would permit witnesses to behave the way Sen. Chuck Grassley permitted Brett Kavanaugh to during his “testimony” before the Senate Judiciary Committee last week.

That a man supposedly steeped in the law since Yale, who spent years as a jurist in the American system, chose to talk back to examiners (apologizing to Sen. Amy Klobuchar, but according the same malign treatment to all Democratic senators), refuse to answer proper questions, argue with examiners (think of the objection, “argumentative, Your Honor,” in every TV courtroom drama you’ve seen), provide narrative responses, question examiners (“Do you like beer, Senator?”), indulge in long diversions into irrelevancies (“The pitcher that night was….?!”), and lie unabashedly demonstrates not only how unfit this candidate for the Supreme Court is but also how unlike a genuine investigation last week’s Noh play—elderly Republicans the perfect indignant 14th-century kyogen—was.

Kavanaugh’s evasive exegesis of obvious adolescent boasts in his high school yearbook entry were as visibly transparent as the playground excuses of a naughty kindergartner—and utterly unworthy of a Supreme Court justice.

If Kavanaugh’s appointment is approved, faith in our judicial system will be undercut so seriously one wonders if that is the Republicans’ objective.

The upsell Re “Let’s consider facts” (Letters,

by Rich Meyers, Sept. 27): Murry offers $10 tire rotations.

But 13 out of 100 are “upsold” an $800 set of tires. That’s $11,400 and the $10 tire rotations bring in $114 per. Murry’s business is selling tires.

Planned Parenthood (PP) performed 321,000 abortions for 2.5 million customers in fiscal year 2016-17. Thirteen out of 100 customers of its low-cost reproductive services were upsold an expensive abortion. One in eight customers bought an abortion.

They’re very good at the upsell.

The right and wrong of abortion is above my pay grade. I find a culture that would force a woman to carry an unwanted pregnancy to term as horrific as late-term and partial-birth abortions.

But my observations of PP’s business model is that it is proabortion because, as Dillinger said, “That’s where the money is.” In my opinion, Planned Parenthood is an abortion agency.

As to your statement, that “one cannot impose their beliefs on others,” civilizations impose one’s beliefs on others via the social contract. Try hiking naked, selfmedicating with an unapproved drug, choosing for yourself when to die, or refusing to pay confiscatory taxes, and you’ll find out very quickly how the will of others, religious or otherwise, is imposed upon you.

An odious letter Re “Council’s mega meeting” (Letters, by Patrick Newman, Sept. 27): Why must you publish selfanointed St. Patrick Newman’s every pontificated thought? His latest, on the day of the Kavanaugh hearing, is even more odious than usual. His response to being called out by Sherri Quammen on his Brock Turner defense—with a comparison of “what if they were lesbians?”—is a new(man) low.

illness, injury or fire. People who have tried to work, have tried to take care of themselves, who contribute something to the community they live in.

Then there are the mentally ill. We see them downtown, wandering the streets with their belongings. These are people who should be helped in whatever ways are necessary.

Then we have the transients and vagrants. These are the people who refuse to look for work, who prefer to beg for money, who hang out downtown day after day, who live creekside in our parks and leave human waste and garbage.

Not to mention the theft, robberies, burglaries, vandalism and murders created by them.

It’s time Chico rolled up the welcome mat to everyone and started taking care of people who deserve it rather than those who have contributed nothing and expect it. I looked at council candidates and am going to vote for the ones who advocate for the citizens of Chico first.

Naming names Wealth has become so concentrated that just a few high-return financial investors are now responsible for virtually all war and climate change—199 to be exact.

These few are also part of the largest public relations companies and account for 80 percent of all corrupting campaign contributions worldwide. They are the owners of corporate media. Fascism is distracting violence while the wealthy rob us all.

Answers required I attended a city of Chico Finance Committee meeting. The topic was a revenue measure for a future ballot. A staff report was ordered by council last spring and then Finance Committee meetings were suspended for the summer, giving the public no chance to get into the conversation.

I expected a discussion of road funding options. When I asked about funding for the recent road improvements around town, I found out $6 million in RDA funding was used to put in streets at the Fogerty subdivision on Highway 32. As I questioned staff about this, committee Chair Mark Sorensen became very angry, and cut me off, saying I’d used four minutes of staff time and that was all I got.

Other attendees were allowed to speak at length, including a rant about how “the liberals” had spent all our money. As I held my hand up, he called on others who’d already spoken, because they all supported his revenue measure.

Sorensen has become increasingly hostile to anybody who questions his intentions. He’s created a hostile environment for citizens who want to participate. Asking questions is not uncivil. More people need to ask questions.

This event is planned for the day before Indigenous People’s Day and CPJC will be making a declaration in support of IPD. For the last 26 years, cities and states around the U.S. have moved to replace Columbus Day with a recognition of indigenous people. The holiday was first instituted in Berkeley in 1992, coinciding with the 500th anniversary of the arrival of Christopher Columbus in the Americas. NEWSLINES DOWNSTROKE CAMPUS RAPES, BURGLARIES TICK UP

Increases in reported rapes and burglaries represent the most conspicuous statistical changes on the Annual Security Report released by Chico State Monday (Oct. 1).

Last year, according to university crime statistics, 12 people were raped within the campus area—up from 10 in 2016 and four the year before. All nine of the rapes on campus occurred in residences. Burglaries increased to 13 from nine in 2016; there also were 13 in 2015.

Robberies have jumped, though in small numbers (four total in 2017, up from two and one, respectively).

SETTLEMENT IN SIGHT

The city of Chico will pursue a settlement with Mindy Losee, who sued the city after her 19-year-old daughter, Breanne Sharpe, was killed inside her car by police officers following a high-speed chase in 2013.

During the City Council’s closed session Tuesday (Oct. 2), City Attorney Vince Ewing was directed to proceed with “settlement authority” on a 6-1 vote, with Councilman Randall Stone against.

This June, the Ninth U.S. Circuit Court of Appeals upheld the district court’s dismissal of four involved officers, but reversed the dismissal of an excessive force claim against former Sgt. Scott Zuschin. “The right not to be shot in a car that poses no immediate danger to police officers or others is clearly established,” the court decision reads.

GRIDLEY-BIGGS CHIEF EXITS

Beating his employers to the punch, Dean Price resigned Monday (Oct. 1) as police chief for the cities of Gridley and Biggs.

Both city councils had meetings Monday night with Price’s job termination on their agendas. A Gridley councilman had told local media that Price’s compensation of $250,000 a year was a factor. The city of Gridley announced his resignation and retirement, effective Oct. 30.

Madieros is the first to admit he’s rough around the edges and doesn’t get along with everybody. He doesn’t care what people think about him, which, in hindsight, hurt more than it helped him in his role at Stairways—a low-barrier Chico shelter. Perhaps he should have played the game better, he says. At the same time, he acknowledges that he is more suited to outreach than directing an organization.

“I shot us in the foot a lot,” he told the CN&R. Now, four years after becoming a Stairways social worker, Madieros is closing the program that houses about 30

people. And the decision is as much personal—he suffered a heart attack a few months ago that scared the heck out of his family—as it is practical.

“This front building needs to be torn down,” he said, pointing to the first of several buildings on a lot near the Chico State campus that make up Stairways. He’d begun planning for a remodel of the place and learned that it had already been remodeled four different times, none of them permitted.

The cost to fix the problems or rebuild are too much, he said.

The costs associated with maintaining a facility like Stairways, which “houses the hardest,” are generally high. It does not require sobriety as most other local shelters do (there are some “wet” beds at the Torres Community Shelter), and people come straight off the streets.

A tour of the property earlier this week illustrated Madieros’ point. The rooms are organized by phase, so those who were sleeping under a bridge or in the park yesterday first move in to phase 1. Walking through that area, it’s not pretty. Mattresses are on the ground—because many homeless folks aren’t used to a proper bed and

aren’t comfortable in one—and many of the rooms are in disarray.

In phase 2, the level of cleanliness was notably improved, as those residents work their way toward independence.

Perhaps the biggest reason Madieros is

closing Stairways—residents will have several months before the actual buildings are shuttered—is the lack of support from the community, he said. Not that Chicoans don’t like Stairways specifically, just that their collective priorities are misplaced, leading to arguments over whose way is the best way rather than working together to help people who truly need it.

“Unless Chico decides it wants to be a community that puts human beings first over winning, we’re going nowhere,” he said.

Madieros would like to see more resources put into mental health care and substance abuse programs that would address a lot of the underlying issues related to homelessness. He also sees a problem with the fostercare system, which leaves many people behind as soon as they turn 18.

“I think our focus has been on feeding people, clothing them and sheltering them without thinking about the overall picture of getting them into permanent housing,” he said.

Reed had partnered with Madieros for Stairways’ harm reduction center, where they held alcohol and substance abuse programs alongside legal assistance to help people clear up warrants. When the lease came up several months ago, Reed chose not to renew it.

“I had funded it and a few months ago I decided to focus on Oroville and the two projects I have there,” Reed said.

Part of Reed’s reasoning for shifting gears was the inhospitable culture in Chico, he said. In Oroville, he found “great people there, they work together,” he said. “There’s a strong faith-based community that really works together. I went there and the city said, ‘Hey, how can we help you?’ There’s a different atmosphere and viewpoint toward helping people.”

The decision to close Stairways was not

an easy one for Madieros. While talking about some of the residents and where they might end up without the program, he started to tear up. He told a story about one man who had attempted suicide several times and one time almost succeeded. Madieros and other staff were able to revive him. That same man returned to Stairways after a period of time back on the streets just last weekend.

“I worry that he’s not going to live without this place,” Madieros said. “I struggle to think about it.”

Reed agreed that the closure is a big deal for Chico’s homeless, but stressed that there’s still hope.

“We’ll miss Stairways, but I think there are alternatives and other ways we can do the same type of thing,” Reed said.

For Madieros’ part, he’s not giving up on helping the homeless community altogether. He’s started a new program called Space Monkey Studio on the north side of town. He and Jeremy Williams— who was homeless when they met and now helps run Stairways—tattoo there, with 50 percent of earnings going toward a youth art program also located at the studio. It’s in the beginning stages, but he hopes to offer counseling as well as other services.

“It’s time to get back to the youth, to make more of a difference when it counts,” Madieros said. “So many of our youth have never had a chance.” Ω

Homeless script flipped Chico declares shelter crisis, with swing vote from ‘sit/lie’ conservative For local homeless service providers, a city-

wide shelter crisis declaration means more than just an acknowledgment that there is a threat to the health and safety of the city’s unsheltered.

For Caminar, it’s a chance to expand housing for mentally ill, chronically homeless people. For Chico Housing Action Team, it means the organization can move forward on Simplicity Village, a tiny home community for seniors. For Chico Unified School District, it’s a possibility to increase assistance for more than 500 homeless students.

In a swing vote that defied party lines, Councilman Andrew Coolidge voted in favor of declaring a citywide shelter crisis on Tuesday (Oct. 2) with his liberal colleagues.

The council also discussed the possibility of fully funding a Chico Police Department Street Crimes Unit year-round.

With the declaration, Chico joined Oroville, Gridley and Butte County, allowing local service providers in these jurisdictions to vie for a $4.9 million one-time infusion from the state to address homelessness through its Homeless Emergency Aid Program (HEAP).

Coolidge, who is the only incumbent conservative council member running for re-election this year, brought the topic forward along with the controversial sit/lie ordinance, which was discussed at the council’s first meeting in September and approved along party lines.

“I really think the solution is all solutions,” he told a full council chambers. “[Along with] requiring criminal transients

to obey the law, it’s helping people who need help with a hand up,” he said, adding that the shelter crisis declaration is a “small step” in the right direction provided that the money is “allocated in the right way.”

Coolidge originally proposed to reserve 33 percent of the funds for the Jesus Center’s relocation project, aka the Renewal Center, but Butte Countywide Continuum of Care coordinator Jennifer Griggs clarified that is not possible. All applications countywide will go through the same vetting process before projects are approved by the CoC board, which is composed of city and county representatives as well as local service providers.

“All I can say is in good faith I will work with you … and maybe we can do something together collaboratively,” Griggs told the panel.

The council debated limiting the declaration to just one year, but Councilwoman Ann Schwab expressed an interest in not limiting the declaration “for consistency’s sake” with the other cities and Butte County. They compromised by adding a one-year review of the declaration. The vote went 4-3, with Councilman Mark Sorensen, Vice Mayor Reanette Fillmer and Mayor Sean Morgan

SIFT ER Death on two wheels The Sunshine State might have the ideal weather conditions for traveling by bike, but according to a recent analysis by The Wall Street Journal, it’s not always sunny in Florida for bicyclists.

According to data gathered from National Highway Traffic Safety Administration records, Florida has the highest bicyclist death rate, by far, of

any state in the country—6.2 per 100,000 people between 2007 and 2016. The next highest rate is Louisiana at 3.9, while out here in California, the rate is 3.1 (fifth worst in the country). Prior to a vote, Morgan said the shelter crisis will do nothing to address the people who are “service-resistant,” saying: “While I want the people doing good work to get money, I don’t know at what cost.”

He and the panel had just heard from 45 public speakers. Most were in favor, seeing it as a positive decision to assist service providers who are working hard on shoestring budgets to help the most needy in the community.

Another topic of particular interest to the

community was the staffing of a permanent Chico Police Department Street Crimes Unit, with about 20 speakers addressing the panel.

The original proposal was to consider using $350,000 from the police overtime budget and $350,000 from waste-hauler franchise agreement funds, previously reserved expressly for roadways. This would staff a four-officer Street Crimes Unit year-round, focusing on theft, burglaries, weapon possession and drug sales. This year, the unit was staffed during the summer months by the officers who work in the south campus neighborhood during the school year.

Most speakers told the council that any money directed toward police needed to go toward prioritizing implicit bias, de-escalation and crisis intervention training, or preventative resources like mental health crisis response teams and social workers.

Rain Scher asked the council to provide more accountability for police when it comes to profiling, excessive force and murder.

Phillips team, an advocacy group that was formed after Phillips, a 25-year-old experiencing a mental health crisis, was shot and killed by Chico Police officers on St. Patrick’s Day 2017.

“The people of Chico deserve to be safe, including safe from aggressive and trigger-happy cops. … A Street Crimes Unit will inherently target people of color and poor, homeless people,” Scher said.

“Officers we have right now need more training. Don’t compromise … just so you can have more officers. Don’t spend limited funding on ineffective, punitive measures.”

Those who advocated for the Street Crimes Unit spoke to the increased safety they believe it provided to the community. “I believe that they do the best they can under very daunting circumstances,” said Nichole Nava. “I feel like these people are well-trained and I think that they follow the standards of the industry and I am proud of that.”

The panel ultimately moved to direct $186,000 in the police department’s overtime budget to send four recruits through the police academy, with a comprehensive discussion about how to fund the Street Crimes Unit to happen during the 2019-20 budget cycle.

For now, the waste-hauler fees will continue to go toward road maintenance. The vote was 5-2, with Coolidge and Fillmer against.

Other meeting topics included a final reading for Stonegate, a 600-plus-unit development planned for south Chico on property that contains sensitive wetlands.

Community members argued that a rushed discussion on the topic at the last council meeting was unfair to the citizens of Chico, who were given only one minute each to speak on the topic between 10-11 p.m.

(See “‘Eleventh hour’ deliberations,” Newslines, Sept. 20.) It was approved on its second reading in a vote along party lines.

Enloe Medical Center’s relocation of its prompt care facilities to a new building on West East Avenue, near its Rehabilitation Center, was approved 4-2, with Schwab and Coolidge against and Councilman Karl Ory recused because his wife works at Enloe Prompt Care.

Jerry Morano, started renting out a studio unit next door to their home in the Barber neighborhood in March 2016. It’s a quaint little place with a front patio framed by a lush perennial garden.

Though the couple originally invested in remodeling the studio to create a tranquil home for Morano’s aging mother, they have found that offering a place of respite to travelers through Airbnb has helped them prepare for the next stage of their lives—Morano is retired, and Parker is preparing for retirement. “Our income is going to drastically drop, and we’re going to need help paying our own mortgage,” Parker said.

That’s why the couple were taken aback recently when they were hit with a notice from the city giving them two weeks to submit records and pay retroactive taxes on all vacation nights within the past year.

Parker expected something was coming down the pike on this issue, she told the CN&R. She called the city a year ago and says she was told staff was in the process of clarifying the law.

“No way did I think I was going to have to start paying retroactively,” she said. “It doesn’t seem fair. … It’s not the tax itself; it’s the way they’ve gone about implementing it that’s discouraging.”

In the spring, the City Council updated the municipal code to include “short-term home-sharing and/or vacation rental unit[s]” of less than 31 days on a list of properties that require a business license and must pay the transient occupancy tax (TOT), like hotels.

That money goes into Chico’s general fund.

The TOT is meant to be levied upon customers. In fiscal year 2017-18, the city took in $2.8 million of such revenue. The vacation rentals will bring an estimated $50,000 to $150,000 per year, according to the April staff report.

Another $2,500 is the estimated take from business licenses. The average listing on Airbnb is $150 per night.

allowed in town. The homeowners sued and a judge ruled that the city had erred. That prompted a revision to the municipal code—and the implementation of the TOT on such rentals.

Administrative Services Director Scott Dowell said the municipal code has always allowed for the collection of TOT from customers booking short-term rentals in Chico, the city just “hasn’t gone out and enforced it.”

“I understand this is a newer concept. I can understand people’s frustration … but the city is actively trying to follow the municipal code and bring about compliance,” Dowell said. The city is aiming for self-compliance and not trying to be hard-nosed about it, he said.

Owners also can appeal.

“The taxpayers of the city want us to be diligent … and part of that is really monitoring and trying to achieve 100 percent compliance citywide,” Dowell said. Given the city’s shaky financial outlook, “every bit counts.”

Consultant HdL Companies, out of Fresno, is collecting the tax and will be paid 15 percent of what is collected.

Wheatley opened up their home in central Chico as a vacation rental last year, they were searching for some financial relief. Booking only two weeks per year, the funds have made a big difference.

They’ve used the extra income to make basic home repairs, like replacing a malfunctioning dishwasher. In addition, the couple have paid for their three kids to start taking soccer classes through the Chico Area Recreation and Park District.

“This has been a really transformative side hustle for us,” Liz said.

Like Parker and Morano, the Thrasher Wheatleys were blindsided by the order to pay retroactive taxes. Both couples also disagree with lumping vacation rentals into the same category as hotels and motels, advocating for a lower tax rate instead.

“It feels so frustrating to be getting this tax that feels like an overreach. If this was a full-time property, I’d have no hesitation,” Liz added. “It feels like the city is trying to get as much money out of this as possible, and not trying to foster a successful commerce com-

munity in town.”

Meanwhile, Butte County is taking a different approach. As it identifies people who have vacation rentals, staff is reaching out to them with an informational letter and getting the tax process started, with no retroactive payments required.

Treasurer-Tax Collector Peggy Moak said her main goal is to inform citizens that short-term rentals are required to pay TOT— she added that she believes many people did not know about this obligation, because it is a new type of business.

“My approach is that once I educate people, then they should understand their obligation and respond, and if they fail to, then penalties and arrears would apply,” she said. “I try to be realistic. You put yourself in their shoes. Where some might say, ‘Ignorance is no excuse,’ I try to be a little gentler and kinder.”

public transportation; family and individual therapy; composting; and a food pantry, in which interns deliver food to participants.

Mary Ostrowski, program manager for College Essentials Plus, says her team currently has 26 students enrolled between Butte College and Chico State.

During a recent visit, she and Natalie Valencia, program manager for 7th Street Centre for the Arts, burst with pride as they shared stories of former and current students. Some have graduated with associate’s degrees. Others have moved into their own apartments and are working. Some are married. Others are now professional, paid artists.

But all of them, the colleagues shared, are following their own dreams.

“They find out who they are, and that’s the important part,” Valencia said. “They are not labeled by what their disability is.”

She had reached a point where she was frustrated and tired of managing it, she said.

This led to poor choices when it came to her diet, causing her blood sugar levels to oscillate dangerously.

She sought out Mains’l as a residential support provider. But the organization, which specializes in providing personalized supportive services for people with developmental disabilities, ended up impacting more than just her physical health.

Right away, Ferguson was welcomed into classes at the organization’s performing arts center, 7th Street Centre for the Arts, where she was encouraged to explore her artistic side.

Theater instructor Zac Yurkovic said he’s noticed a huge change in Ferguson since her arrival. She used to believe she wasn’t a talented artist, he said, but the longtime dancer now enjoys singing and painting, as well, and has even started selling her artwork.

“We’ve noticed a huge self-esteem boost in [Kinley] discovering a new skill,” he said.

“She’s just carrying herself with a lot more pride, and she’s excited to talk about her next project and her next painting.”

Many students at Mains’l follow similar paths of self-discovery, Yurkovic added.

They not only enjoy learning more about themselves, but also sharing their newfound skills with others—teaching their peers how to dance, or how to be better organized.

“They really embrace the thought that

we all have different strengths,” Yurkovic added. “That’s really a big part of the philosophy of Mains’l; embracing your strengths and trying to find new ones.”

It has been a celebratory year for Mains’l, which has been operating for 10 years in Chico, the location of its California branch.

(Its corporate offices, founded in 1989, are in Minnesota.) The name comes from the nautical term for the principal sail on a ship, the main sail, and is grounded in the organization’s mission to be a driving force of support for those it serves.

Anne Silcher, director of Mains’l California, says the organization has grown in terms of the strength of its community partnerships and expansion of services and support.

Back in 2008, Mains’l had 37 employees providing support to 23 people. Today, 172 employees are serving 196 clients.

The nonprofit started locally with two programs: 7th Street Centre for the Arts and Innovations Center for Learning, which provides social and life skills training, as well as learning opportunities in science, technology, arts and health.

CITY OF CHICO CITY COUNCIL

PUBLIC HEARING NOTICE NOTICE IS HEREBY GIVEN that the City of Chico City Council will conduct a public hearing on Tuesday, October 16, 2018, at 6:00 p.m. in the City Council Chambers, located at 421 Main Street, regarding the following project: Chico General Plan Annual Review: Land Absorption Study, Sustainability Indicators Report, and Title 19 Amendments - The City’s General Plan directs that an annual report be prepared on the status of the General Plan and progress on its implementation. In 2017, the City Council considered a more robust Five-Year General Plan Review, which also included an evaluation of development trends, current land supply, market conditions, and the ability of available land to meet future development needs.

The Review concluded that there is an adequate supply of vacant land to meet the community’s needs through the General Plan’s 2030 planning horizon. Council directed staff to prepare a more detailed land absorption analysis to gain greater insight into residential and commercial land use demand and supply, issues affecting affordability, and impediments to opening up land planned to accommodate growth. The City retained BAE Urban Economics to assist in the preparation of a Land Absorption Study. In addition, a Sustainability Indicators Report has been prepared to gauge progress in advancing the General Plan’s sustainability-related goals and policies. Further, a number of amendments to Title 19 of the Chico Municipal Code (Land Use and Development Regulations) are recommended to resolve minor inconsistencies, formalize interpretations made by the Community Development Director, clarify terms and definitions, and gain efficiencies in implementation of the Code as called for by the General Plan.

At a September 6, 2018 meeting, the Planning Commission held a public hearing and considered the Land Absorption Study, Sustainability Indicators Report, and proposed Title 19 amendments, and forwarded comments and recommendations to the City Council.

That day’s session aimed to teach a valuable lesson: how one person’s attitude can influence the attitude of those around them, and that there is power in choosing positivity.

Whether participants have been involved with Mains’l for 10 years or for two, Silcher said it has been phenomenal to see those involved achieve their goals and become young leaders.

“People’s lives are being changed for the better,” she said, instructors, volunteers and those receiving services alike.

Ferguson is a case in point.

“Usually, when I come in on a bad day, people are so full of positivity, I’m like, ‘I don’t want to be a dragger!’” she said.

Part of Silcher’s dream for the organization’s future is integration, bringing folks of all abilities into classes together. She’s hopeful that Mains’l will have success expanding local businesses’ partnerships to generate more job opportunities for those with varying abilities, as well.

Valencia added that for many people with developmental disabilities, there has been a lot of “doing for” rather than “doing with”—they have been told what to do, “without a lot of choice on their own.”

“We [at Mains’l] envision a world where people live with meaning and purpose,” she said. “You’re the captain of your own ship. We should be there to help guide you to where you want to be.” Ω

Why fuss over straws?

Eco-sensitive restaurateurs, advocates explain perils of ‘gateway plastic’ by

two men drinking beer from straws. Up until the late 1880s in America, straws were simply the hollow tubes from rye stalks, and they left a natural grassy flavor in your drink.

As the story goes, that grassy flavor ruined a man’s mint julep, so he figured out how to wrap a strip of paper around a pencil and seal it with wax, and in 1888 the first patent for a paper straw was issued. By the 1960s, with the advent of new materials and manufacturing processes, we began to make straws cheaper and more easily from polypropylene, plastic No. 5—and for 50 years nothing much changed.

That is, until August 2015, when a video surfaced of a team of marine field biologists removing what they thought was a parasitic worm from a sea turtle’s nose. After the first two inches are removed, the lead biologist on the boat, Christine Figgener, sees what looks like familiar black lines from the straws she knows from Germany. The team painstakingly pulls out the remainder of the straw—it takes almost two minutes—as the turtle struggles in pain.

Chico business owner Linda Storey watched that video and says it changed her whole outlook.

“I started by just not using straws anymore myself, but then I realized, wait, I have a business, and I can do it there, too,” she said.

That was last October, and by the next month, Storey had instituted a straws-byrequest-only policy in her Hula’s Chinese Bar-B-Q restaurants, which now offer only

biodegradable paper straws. And she didn’t stop there: She created the Strawless in Chico Facebook page to encourage local folks and businesses to go strawless, as well as raise awareness of the issue.

Storey also began to work with the Sustainability Management Association (SMA), which assigned an intern, Sophia Graves, to collaborate with her on Strawless in Chico. Since her internship, Graves has taken up the fight on her own, as project leader on the Strawless Challenge project through the SMA, further challenging local businesses and residents to go straw-free through the strawlesschallenge.com website, on the Strawless Challenge Facebook page and with the #stopsucking hashtag.

The campaign has been a success. In April, Chico State’s Associated Students went plastic-straw-free. (A.S. doesn’t account for every straw on campus, but does run the dining halls and other eateries.) Since then, Cal State Stanislaus became the only other college campus to do the same.

At least nine local restaurants, and many other businesses, have committed to cutting back on plastic straws through the Strawless Challenge, including Fresh Twisted Cafe, which, among other menu items, sells smoothies. Its owner, Doug Hernandez, said he hasn’t experienced pushback from his customers, telling the CN&R: “We still offer both options—we still have plastic straws available, and I got some real good paper straws, too.”

Starbucks announced over the summer it would phase out single-use straws in its cafes around the country by 2020. Seattle was the

first city in America to ban plastic straws; a few others have followed, such as Fort Myers and Miami Beach in Florida, and Malibu and Berkeley in California. Gov. Jerry Brown just signed a bill that will make plastic straws available by request only at full-service restaurants statewide, starting Jan. 1.

volunteers found 20,155 plastic straws along 1,900 miles of beaches, shorelines and waterways.

Locally, on Sept. 15, BEC held its 31st annual Bidwell Park and Chico Creeks Cleanup. In one 15-minute period, Carter said, volunteers picked up 133 straws among 2,050 pieces of garbage.

“And that’s only the 15 minutes we counted—we’re out there for hours and hours,” she continued. “It adds up, it makes an impact.”

The average straw weighs 0.42 ounces.

Going by the 500 million per day number, then by weight, Americans use about 2.4 million tons’ worth of plastic straws a year.

These days, we can recycle plastic No. 5, but according to Waste Management, we can’t recycle straws because the machine doesn’t exist to handle them. The shape and size of straws gets them stuck in recycling equipment, which can clog up the whole process. They’re difficult to wash out, too.

Storey calls the straw “a gateway plastic,” adding: “My hope is that if people start thinking about whether or not to use a plastic straw, maybe they’ll start thinking about the other plastics they’re using, too.” Ω

Most anti-straw organizations with a pres-

ence on the web offer similar information and resources for going strawless, including links to purchase stainless steel or bamboo straws.

Each seems to use one common statistic: 500 million straws used per day in the United States. That’s about 1.6 straws per person per day.

What those sites tend not to disclose is the source of that statistic—a 9-year-old boy named Milo Cress (now 17), who noticed while out at restaurants that people would just remove straws from their drinks and set them on the table without ever using them.

He wanted to bring awareness to the issue and launched Be Straw Free in 2011 to do so, but he found a dearth of data on straw usage in the U.S., so he decided to do the research himself. That’s when he called the manufacturers and came up with his number. Critics have since used his age and method to rally against the straw movement; proponents say the number may be too small.

Natalie Carter, executive director of the Butte Environmental Council (BEC), says 500 million is probably pretty accurate—it’s on par with the Ocean Conservancy’s figure, 1.5 straws per capita daily.

If you have ever practiced yoga for physical and spiritual health, you likely appreciate its merits. For a twist, some prefer to do it in a room heated to 105 degrees, with a muggy 40 percent humidity. “Hot yoga” became popular in the 1980s, and is something Mandy Whigham says she thought she would never try. But a colleague convinced her to give it a whirl and she loved it so much that in February 2015, she bought the hot yoga studio in Chico at 1140 Mangrove Ave., Chico Hot Yoga, and renamed it Hot Yoga Club. It did so well that she opened a second branch in Granite Bay. When Whigham isn’t sweating it out, she stays busy with her three children, and also runs Dream Home Real Estate Services next to the yoga studio. Contact her at 321-0611, online at HotYogaClub.com.

When Johnnie’s closed inside the Hotel Diamond and reopened as Two Twenty Restaurant, it lost something, a little je ne sais quoi. And when its chef, Michael Iles, left Chico for Portland, well, it never quite felt like it had its own identity. Without missing a beat, though, Two Twenty is now Diamond Steakhouse, a name the owners hope will stick.

I got a chance to sample the appetizer menu on Monday (Oct. 1), a day before the restaurant’s official opening, and I must say it blows Two Twenty out of the water. Everything was good, but my favorites had to be the coconut prawns, charred ahi and teriyaki-glazed beef kabobs, which were incredibly tender.

The bartenders also were on point—John (a Two Twenty holdover) made me his famous vanilla lemon drop, which was a fun twist on a classic.

The dinner menu offers typical steakhouse fare at prices comparable to Fifth Street’s, with a decent variety of seafood items, which is particularly exciting for me. The restaurant is also open for breakfast, though I did not get a glimpse at that menu. I’m hoping for a killer crab cake Benedict.

For this venture, owner Greg Scott partnered with Greg Martin—president of Ray Morgan Co. and former proprietor of Midway Steakhouse in Durham. They hired chef James Rosenbaum, who greeted the crowd and explained he’d spent the last 16 years at Rolling Hills Casino. At Diamond, he said they’ll use all prime beef and as many local ingredients as possible. The thing that sets this restaurant apart from others, really, is its membership program. There weren’t any prices on the flier they handed out, though I’m guessing it’s out of my range. They also hinted at plans for a rooftop bar—intriguing!

How is your yoga studio different from others?

We practice regular yoga, but we do it in an artificially heated and humidified setting. All our classes are at least “warm,” which means they are heated to at least 80 to 90 degrees, if not “hot,” which is 105 degrees.

Do people lose weight sweating so much?

Not really. Some do, but most of the sweating is just water weight, and you drink it right back.

What do people like best about your classes?

They like our competent, caring instructors, and challenging classes that give people a great workout. They also say we have very good, positive energy. Plus, our classes are all beginnerfriendly, and we have showers and lockers.

How did you get into hot yoga?

I grew up in San Diego and loved running but not stretching. Yoga always seemed so slow and I was not flexible at all. Then a coworker took me to a class, and at first my body was so tight it hurt. But the heat gave me a good workout and my muscles became more flexible, so I kept at it. It felt healthier than just running, and I became very attracted to it. I took a month-

long break from running to gain flexibility, and when I restarted running, I felt I had a completely different body! I was much looser and faster.

What are the advantages of hot yoga?

The stretching and postures are challenging. The sweating is good for the skin and detoxifying. It’s also a good cardiovascular exercise because you are working on flexibility, and it keeps your joints healthy.

Plans for the future?

We opened up our Granite Bay branch, and want to expand into a national chain. We want to get the formula dialed in here in Chico and use that as a template to go national.

o one has the exact same definition of the California dream.

Ask the 39 million current Californians about what the dream should be, and aside from most of us agreeing that the daily temperature should dip no lower than the mid-50s, you’ll likely get 39 million very different answers.

But the so-called “Golden Era” of California—that faded Technicolor image of a magical time in the 1960s when, as soon as you crossed the state line, Ronald Reagan would hand deliver you a two-story house and 2.5 children and tiki-themed patio furniture— still seeps into our expectations of life here.

That vintage California dream was primarily lived out by white families. Discrimination in law and practice made it difficult for people of color—who made up a smaller proportion of Californians than they do today—to share in that prosperity. And major swaths of California’s current population arrived here well after that time had passed.

pervasive feeling among those of us who actually live here that the California dream is harder than it used to be. A recent USC Dornsife/ Los Angeles Times poll found that only 17 percent of Californians believe the state’s current generation is doing better than previous ones. More than 50 percent thought younger Californians were doing worse.

They’re not wrong.

Over the past four decades, California middle-class incomes have stagnated: The median California family is making only marginally more now than it was in 1980. More than half of Californians born that year made less than their parents did by age 30.

That’s a problem because, at the same time, the state’s cost of liv-

ing has exploded. A house that 50 years ago cost about three times a younger California household’s salary now costs seven times what a younger household earns.

If the past half-century has been rough for middle-income Californians, it’s been brutal for those lower on the income ladder. Starting in the late 1970s, California’s poverty rate crept higher than the national average.

Now, when cost of living is factored in, we’re the poorest state in the country.

Eulogizing the California dream has developed into its own cottage industry in recent years, with politicians of all stripes promising to restore our glory days. All too often the gloom and doom obscures objective gains the state has made.

The average Californian is much more likely to get a college education and much less likely to be mugged today than 40 years ago.

Those are good things.

But something is changing, and Californians can sense it.

Being—and staying—middle class When was the best time to be a middle-class Californian?

Well, the late 1960s and ’70s were pretty good years. Median family incomes rose steadily in real terms throughout the period, and by 1980 the average household was making 20 percent more than in 1967.

Starting in 1980, incomes for

middle-class Californians essentially stagnated. By 2014, the average California family, after adjusting for inflation, was making only 8 percent more than it made three decades ago. While earnings have ticked up since then, the brutal recessions of the early 1990s and late 2000s essentially wiped out entire decades of modest income gains.

“The starkest comparison is between families at the middle and less than the middle with those at the very top,” says Sarah Bohn, research fellow at the Public Policy Institute of California. “We’ve all experienced booms and busts through economic cycles, but over time the highest-income families in the state have really seen a larger growth in their opportunities rela-

That story is by no means unique to California. But it is worse here than in the rest of the country. Incomes for the median family grew at a faster clip over the past 30 years nationwide than in California. And the gap between rich and middle class is higher here than the vast majority of other states.

Stagnating incomes and rising inequality don’t necessarily mean Californians are having a tougher time making ends meet. But the costs of staying middle class, or jumping up the income ladder, are higher than they used to be.

“When you think about what it took to make ends meet in 1967, it’s very different from what it takes to make ends meet today,”

Outshining parents Part of the allure of California has always been the possibility of making it to the “1 percent,” whether via the Gold Rush or Hollywood or Silicon Valley. And here the topearning households are doing better than just about anywhere else in the country.

But inequality could be linked to another disconcerting trend: the inability of younger households to do better than their parents.

Fewer than half of California children born in 1980 were making more at age 30 than their parents did at their age. That’s the first time that percentage has slipped below 50 percent since the 1940s.

Again, declining income mobility is not just a California story. Younger people across the United States are having a harder time matching their parents’ standard of living.

But younger Californians are doing notably worse than their counterparts in some other states—younger South Dakotans and Arkansans, for instance, are much more likely to be out-earning their parents than are young Californians.

Escaping poverty While middle incomes have stagnated in California over the past four decades, lower-income households have actually seen their earnings drop.

When you factor in the cost of living, California now has the highest poverty rate in the country.

We’re worse than states such as Mississippi and Alabama. Roughly 1 in 5 Californians now struggle to make ends meet.

That wasn’t always the case.

California used to have a lower poverty rate than the national average up until the late 1970s. But poverty in California surged in the 1980s before peaking in the recession of the early 1990s.

The picture would be even bleaker if you eliminated state and federal safety net programs such as food stamps that have expanded significantly in recent years. Without those, nearly 1 in 3 Californians would be poor.

Owning a home Part of the California dream has always been homeownership. But that dream has become increasingly unattainable in recent years.

of its Latino and Asian populations, California is now famously a “majority minority” state, where no ethnic group claims more than 50 percent of residents. The number of white Californians has actually dropped by about 2 million residents since 1990.

An increasingly diverse California, however, has not translated into an increasingly equal one. While the average Asian California household has caught up to whites, both Latino and AfricanAmerican families make significantly less—with that gap only widening in the wake of the Great Recession of the late 2000s.

Housing Yes, California is a more expensive place than it once was. And much of that is due to astronomical increases in housing costs.

In 1960, average California renters saw about 20 percent of their income go to rent. That’s up to nearly 37 percent now. The trend is even steeper for younger Californians, who are seeing nearly half their paychecks go to rent.

When rents are higher, it gets tougher for renters to save money for a down payment on a house. That, combined with rising single-family home prices and the end of easy mortgages, has sent California’s rate of home ownership dipping.

“The bulk of California’s workforce is going to be young Latinos now,” said Sonja Diaz, founding director of the UCLA Latino Policy & Politics Institute. “But Latinos still lag behind in a number of socioeconomic indicators, in terms of home ownership, income gains, educational attainment, access to health care, living wage jobs.”

California has always been a magnet for immigrants. While the rate of international migration has slowed in recent years, the state still boasts the largest concentration of foreign-born residents in the country.

Rising income inequality, spiraling poverty, the struggles of the middle class—beyond being total downers, these trends feel so abstract and intractable. So let’s drill down on some more specific dimensions of the California dream, and compare how things are now versus how they used to be.

In 1969, the median sales price of a California house was about $166,000 in today’s dollars. That was about three times the average income ($55,400) of younger California families at the time who might be in the market for a starter home.

Today, the average California home sells for over $500,000— seven times a younger family’s earnings.

California appears to have lost much of its lure to the rest of the U.S. Over the past two decades, California has lost 1.8 million more residents than it has gained from the rest of the country. And unlike in previous decades, that trend is persisting through good economic times.

Higher education Clark Kerr would have lots to be proud of if he were alive today.

The architect of the state’s 1960 Master Plan for Higher Education, Kerr envisioned a world-class public university system accessible to California high school students. The top one-eighth would be admitted to the University of California, which

dwindling in the early 2000s. At its peak, the state provided more than $26,000 per student to UC. It now provides about half that amount.

Taxes California has a reputation as a high-tax state. Has that always been the case?

Depends on how much money you make and what type of tax you’re talking about.

aimed to be the envy of public higher education nationwide. The top third would have a place on a California State University campus, and anyone who could benefit from higher education could enroll in state-operated community colleges.

Partly due to Kerr’s ambitions, Californians are a lot more educated than they used to be. The percentage of Californians with a bachelor’s degree has nearly tripled since 1960, with particularly strong gains among California women.

Graduation rates at the University of California are some of the highest in recent decades.

But adjusted for inflation, the cost of one year of a University of California education today is seven times more than it was in the mid-1960s. That’s mostly because state support for the UC started

Effective property taxes in California have dipped below the average in most other states since the passage of Proposition 13 in 1978, which limits what local governments can collect from rising property values. California now has one of the lowest effective property tax rates in the country.

But one regressive tax has increased significantly since the 1960s: the sales tax. In 1964, the state sales tax totaled 4 percent.

That rose to over 7 percent by the early 2000s.

The economy The decline of manufacturing and the disappearance of blue-collar jobs with decent pay and good benefits is an economic narrative typically reserved for the Rust

Belt. But in explaining the erosion of California’s middle class, the disappearance of manufacturing—particularly in the defense and aerospace industries that dominated Southern California during the Cold War—plays a central role.

“Silicon Valley does not provide those kind of big manufacturing jobs,” said Dan Mitchell, professor emeritus at the Anderson School of Management at UCLA. “There’s no equivalent of an aircraft assembly plant that you get from that. IT does provide high-paying, whitecollar jobs, but certainly not as many and not in the same location.”

But California has always been a boom-and-bust state, and recessions play out worse here than elsewhere. The recession of the early 1990s, the dot-com bust at the turn of the century, and the Great Recession all hit California harder than in most of the rest of the country.

Public safety One indisputable improvement in California’s quality of life over the past few decades: The state is a lot safer than it used to be.

Rates of violent and property crime have reached lows not seen since the late 1960s.

California’s crime drop is part of a broader national trend enjoyed in most of the rest of the country. And along with most other states, California has seen a major increase in its incarceration rate over the same period.

The California dream is suffering. Yes, in many ways it is harder to live here than it used to be.

But most Californians remain stubbornly loyal to the state.

The same poll that found so many Californians pessimistic about the next generation’s prospects also asked whether they agree with the following statement: “Overall, I’d rather live in California than anywhere else.”

Seventy percent of respondents said yes. Ω

As Corbin puts it in the first chapter of his new memoir, Kiss of the Art Gods, “the creative and destructive forces that came to pass in that room would ultimately join within me and propel me.”

Corbin has had a 20-plus year run of making a living as an artist whose works have shown in galleries all over the country. His sculptures can fetch anywhere from $10,000 to $50,000 and many have landed in the homes of celebrity chefs, NBA stars and even Sir Elton John.

This month, nine of Corbin’s sculptures (plus 14 paintings) will be on display at the Butte College Art Gallery, and in conjunction with the reception on Oct. 18, there will also be a book-signing for Kiss of the Art Gods. The title is, of course, a reference to what Corbin sees as the intervention of outside forces that have guided his artistic life.

In a recent interview in advance of the show/signing, Corbin told the CN&R that his main impetus for writing the book was to try and offer a “complete view of the artist.” The book tells his winding story—childhood, a stint in the Army, college, traveling the world, and returning to the North State—that led to the beginning of his professional art career in the mid-1990s.

It was in Chico in the early 1990s that Corbin developed the style that eventually led to his breakthrough into the art world. His life-size sculptures feature various industrial and natural materials—junkyard metal, twigs, perfume bottles, doll parts, etc.—placed in

exhibits in Sacramento, Redding and New York between 1993 and 1997, Corbin eventually made it onto the radar of the art world and secured representation from various dealers that have kept him busy ever since.

These days, he’s living in orchards again, up in Los Molinos, where he makes art. Corbin has a sprawling group of studios on his property filled with the detritus of his trade, and while he still builds sculptures, he’s also painting more these days, putting in the work to keep the art gods happy and holding out hope that art can make the world a better place.

“I do believe that art is the super epoxy that holds the world together,” Corbin said. “It helps us get over barriers …. Once you feel the humanity of another culture, you let them in.” Ω

Why Haven’t Senior Homeowners Been Told These Facts?

Keep reading if you own a home in the U.S. and were born before 1955.

It’s a well-known fact that for many senior citizens in the U.S. their home is their single biggest asset, often accounting for more than 50% of their total net worth.

A lively guest trio rocks symphony season opener PROJECT Trio joins conductor Scott Seaton and the North State Symphony.

Things kicked off with the Bernstein party, “Three Dance Episodes from On the Town,” the composer’s orchestral arrangement of hand-picked tunes from act one of the musical. It was an alternately playful and sweet welcome to the new season that the symphony and conductor Scott Seaton delivered with focused energy.

After settling the nerves and setting the tone with the beautiful introductory dances, Seaton brought out the evening’s guests, the Brooklyn-based PROJECT Trio, and that’s when the night really took off. The three musicians—double-bassist Peter Seymour, cellist Eric Stephenson and flautist/beatboxer Greg Pattillo—personified the joy of music. The trio’s opening number was an original tune inspired by gypsy guitar legend Django Reinhardt, called “Djangish,” and the super-hot five-minute piece established the trio’s infectious level of emotional commitment to the proceedings, which was absorbed by the orchestra and matched by an eager and engaged Laxson Auditorium audience.

Brahms’ “Hungarian Dance No. 5” is both lively

and a bit devilish (making it a perfect accompaniment for the shenanigans of old Looney Tunes cartoons or Charlie Chaplin bits), but at first glance it seemed a stretch to include a piece by a German composer in a program titled American Made. However, in the context of the four-song pre-intermission lineup that started with the gypsy-inspired “Djangish” and then sandwiched Brahms piece between two originals that PROJECT Trio performed sans orchestra—the hiphop-inspired funky number “Sweet Pea” and the salsaflavored “The Bodega”—the Hungarian folk dance felt like just another rich big-city flavor that the trio had smuggled out to California.

The evening rightly ended with Copland’s famous Appalachian Spring Suite. Originally composed in 1944 as a ballet commission for modern dance pioneer Martha Graham, the orchestral version Copland created the following year earned him a Pulitzer Prize. The symphony’s rendition was a lovely and flawlessly performed bookend that complemented Bernstein’s opening dances with its familiar melodies and pastoral beauty.

The suite was also a well-placed comedown that followed what was, for this reviewer, the most exciting work of the night, Schoenberg’s electro-acoustic “Scatter.” The 37-year-old American composer wrote the 19-minute concerto for PROJECT Trio, plus orchestra and some electronics. The work started with slow piano and a low sustained drone, and took its time making chord changes before Stephenson, playing Pied Piper, led the orchestra out of the fog with a bright flute melody and eventually to an exciting crescendo that dropped back down into a jazzy jam to end the first section.

Each of the piece’s sections began with an ominous drone, with the other two parts continuing on to similarly varied yet distinct dramatic journeys filled with pop melodies, fun and complex jazzy interplay and impressively jarring dynamics. This was not passive music, and active attention was rewarded with a fairly transcendent experience where the audience and musicians escaped to somewhere new. What a trip! Ω

standard-issue knives.

Much of the action takes place in the dark, with flashing strobe lights, shades of red and stock horror sound effects—so, there’s a pretty good reason why none of this is scary. Plus, director Gregory Plotkin and crew filmed it in a way that renders the locales flat, cheap-looking and stagey, just like your average amusement park haunted house. Maybe in real life this stuff would be a little scary, but sitting in a movie theater watching folks enter these themed rooms is not.

Hell Fest has almost zero mystery in that we see the killer before the melee, passing through an entrance gate with his back to the camera as he puts on a mask and picks up a weapon.

Everyone in Natalie’s group is present and accounted for when this happens, so no need to strain trying to determine who among them might be the killer.

Forsyth actually has the makings of an interesting performer, so it’s sort of sad watching her slog through this. Of course, the

group of friends includes a chipper punk-rock girl, Taylor (Bex Taylor-Klaus). She’s “the funny one” who’s more annoying than actually funny. She, along with many of the other players, is just cannon fodder for the killer.

None of them stands out as more than just a stereotype.

A somewhat scary prospect in the film’s premise that is never fully realized is the killer putting the dead folks on display in the horror-themed park. This happens once near the beginning, but otherwise we hear about the killer and his victims only on newscasts after the fact. Another missed opportunity for real frights I hope the revamped Halloween coming later this month packs more of a scary wallop than Hell Fest. This is conveyer-belt horror at its worst, with a lame cliffhanger ending that suggests there will be a lame sequel. If you are looking for a real fright this Halloween, you are probably better off going to the makeshift haunted house in your neighbor’s garage. Ω

Close is excellent in her moment-tomoment portrait of a woman whose entire adult life seems to have been a ferocious swirl of ambition (both personal and literary) wrapped in the guise of a genuinely supportive wife and helpmeet. And Jane Anderson’s screenplay adaptation of Meg Wolitzer’s novel takes special care to indicate that while Joan plainly seems, in some ways, a victim of a male-dominated world, she also thrives in some of the more conventional roles that have been thrust upon her. A road trip to Redding’s new food truck park

In fact, the whole thing felt very Chico indeed.

The gated park we were in with about a hundred other kindred spirits was about the size of two downtown blocks and felt much like the patio at Parkside Tap House or The Commons.

Along the perimeter were food trucks—about half a dozen of them—and a snack shack in the center was serving up a variety of craft beers, wine and flavored margaritas, plus a few food options like nachos. A sprawling lawn offered cornhole and picnic possibilities, while tables and chairs provided ample seating. Where were we, you ask?

In Redding.

That’s right, this lively scene—opening night at The Park—was in the middle of our Nor-Cal neighbor’s downtown. And unlike Chico’s favorite monthly food truck rally, Fork in the Road, this one’s open nearly every day (Wed.-Sat., 5-9 p.m.).

I’d heard about The Park via a Facebook post by one of my favorite food trucks, The Lamb & The Wolf, which got its start in Oroville and now travels the North State. I’d been missing their gyros since the truck was taken out of the Thursday Night Market

rotation a few months ago, so a road trip was in order.

Turns out a couple other local trucks—Crispy Eggroll and Slyderz Grill—are also in the lineup for The Park, though they weren’t there opening night.

Nestled comfortably downtown a couple blocks from the Cascade Theatre, The Park is a nice accompaniment to the permanently placed restaurants and nightlife scene. With a rotating cast of food trucks—those interested can sign up for a time slot online—the ambiance will be ever-changing. Since it was opening night when we went, it was especially busy. By the time we got there (Google had a hard time finding the place!), a few of the trucks were already sold out. Thankfully, The Lamb & The Wolf was not. The line was long, so we split up to maximize our time.

The Holy Crepe truck, whose home base is Redding, handed me a buzzer after ordering so we didn’t have to linger. It was a good thing, too, because it took a full half hour to complete our carne asada fries and pesto chicken crepe. The crepe was pretty awesome; the fries not so much, as the meat was virtually flavorless. From The Lamb & The Wolf, the O.G. Gyro was predictably delicious, overflowing with seasoned, spit-fired beef and lamb. The Chicken Italiano was also good—the chicken was particularly juicy—but nothing beats the gyro.

While ordering a round of drinks, I met the owner/ developer, Todd Franklin. Turns out he has another, similar venture in Anderson dubbed The River Front.

The Redding location was much delayed—due to complications getting a liquor license and then by the Carr Fire—but I’d say it was worth the wait. It was also worth the drive, as it made for a fun evening. If there’d been live music on the stage, it would have been even better. And permanent bathrooms would be nice—nobody likes using a port-a-potty, even the nice ones.

Now if we can just get one of these in Chico ... Ω

Let’s pick up where we left off with last week’s local-release rundown: • Black Magnet – Black Magnet: I have said it before, but it bears repeating: Loud music is so much more powerful if it’s not always loud. The four dudes Black Magnet of Black Magnet get the concept, and I am stoked that they’ve pushed the envelope on their debut EP. Opener “Nightfishing” illustrates the band’s approach beautifully with patient, quiet, dark, menacing passages ripped in half by glitchy feedback bursts that introduce heavy walls of fuzz. This week the email inbox and the text messages box loaded up with communications from people responding to last week’s column titled “Run” in which I quoted “Grandma” who asked me for words of wisdom about home-buying because she was helping her granddaughter buy a house.

Email #1: “Here’s one for Grandma. My husband and I have been trying to buy a house all summer and have lost out on three because of other buyers bidding higher. Mostly buyers with cash. We are buying with an FHA loan, small down payment. We finally got an offer accepted on a cute little house, only to lose it because late in the game the lender required a new roof. The seller wouldn’t fix it.

They kicked us out and took a back-up offer, which, of course, was higher. That’s after we spent over $1,200 on inspections and appraisal. We feel like nobody was looking out for us, only themselves. My dad could have done

the roof, but they wouldn’t give us any more time. It was all greedy and mean. No house for us for a while.”

Ouch.

Email #2: “I’ve bought five houses in my life and this last one took the cake. Between the real estate agent, the loan officer, the escrow officer, the insurance agent, the banker, and my wife (I love her dearly), I heard more ‘blah, blah, blah’ than I did in basic training in the U.S. Army. And the paperwork? Oh my Lord! At least 100,000 words, no joke. I will say I had a good real estate agent who made me shut up and listen. She made sure I understood every word.

“My advice to Grandma is, take it from me, Grandpa.

Tell your granddaughter to close her eyes and listen. And close her eyes and keep signing. If she’s working with good people, it will all work out.”
