reason for skepticism Can Chico Scrap Metal be a good neighbor? That’s the million dollar ques-

tion. And based on the business’ track record, there’s reason for skepticism.

Here’s some background: In 2007, the Department of Toxic Substances Control found contamination at the facility, including polychlorinated biphenyl (PCB). The next year, Butte County District Attorney Mike Ramsey filed charges against Chico Scrap Metal’s owners for failing to clean up the environmental pollution, as was ordered by DTSC, resulting in hundreds of thousands of dollars in fines and remediation costs.

In other words, the business polluted its property near the Chapman neighborhood and an elementary school and refused to clean up the site until ordered to do so by a Butte County Superior Court judge. Even then, it appealed the decision. The appeal was denied in 2014.

Now fast forward to January 2015. That’s when the business’ owners came before the council to ask to stay put permanently, and made a convincing argument. Yes, they’d been ordered back in 2008 to relocate by the end of 2011, since their operations are no longer compatible with the neighborhood. But they weren’t given the aid of the city and county, as had been promised, and moving the business was prohibitively expensive. They went on to pledge to beautify the business’ facade on East 20th Street, and to become a collection-location site, rather than a processor.

It seemed reasonable, even to this newspaper, especially considering Chico Scrap Metal’s own attorney stood before the dais, stating the DTSC’s recent “exhaustive” investigation found that not only was there not any hazardous waste at the site, but also that there never had been. So, imagine our surprise the next week when that state agency informed CN&R that the statement was “untrue.” In fact, it had “found elevated levels of PCB ... and the contamination remains.”

So, back to the question. Can Chico Scrap Metal be a good neighbor?

We’re skeptical, but we look forward to more debates. □

have been homeless for just shy of two years.

I don’t drink or do drugs. Even though I am not part of any homeless circle, almost everybody is cool with me, giving me what I feel is an outsider’s perspective with an insider’s knowledge.

The city of Chico seems to be under the impression that homeless people will magically disappear if the city makes our lives miserable enough by criminalizing homelessness. Where are we going to go? Fact is, we’re not going away. No matter how far out of town we go, the by police or sheriff find us and kick Shannon Warren us out. companions. Given that no shelter allows pets, those facilities are not an option for them. There are a few other categories of homeless people who cannot live in shelters: those who are drug addicts, alcoholics, and also people with mental or social disorders.

The bottom line is homeless people are not going anywhere; that is absolute. The sooner everyone realizes that, the better. No matter how much you hate us and torture us, we will always be here.

What Chico faces is two evils. The homeless camping out of town, or us clogging up the local parks and business fronts. The problem with us camping is the associated environmental damage. In this regard, the solution is simple: create new stiff laws not to criminalize homelessness, but to protect the environment. That way only the bad ones among us are punished.

Since we are not going anywhere, a lesser evil has to be chosen until a better option is available.

Push us much further and the lawsuits will be staggering. Criminalizing homelessness is a soft version of ethnic cleansing. The real problem here is the way the city is trying deal with the problem. □

The local group Chico Military Heroes has its heart in the right place with

its mission to support current local military personnel. But we argue once again that its proposal to hang giant banners with individual photographs is misguided. That proposal is coming back to the City Council and the group hopes to hang the banners by December.

We urge the council to consider a few key things while determining the fate of this banner project. First, several military veterans have spoken out against the proposal, noting that there are better ways to honor Chico’s active servicemen and women. We agree. It’s been widely documented that when military personnel return to civilian life, they face great challenges, namely in finding employment and dealing with physical and emotional wounds. We suggest that taking the more than $15,000 the group likely will pay for the banners and putting it toward a housing fund—to help returning servicemembers pay for a home while seeking employment—would be a better use of the funds.

Second, we must look at the plight faced by America’s veterans. Many of them are homeless across the nation and in our own community. They struggle with physical and mental health issues, including post-traumatic stress disorder, which can affect every aspect of their lives. Creating a fund to increase access to critical services like a local veterans clinic or donating to active local nonprofits like Vectors, which provides transitional housing for homeless vets, would be an awesome tribute to their service to our nation.

We salute Chico Military Heroes and their efforts to show support for local military personnel. But a banner, while visibly striking, will not help a single service person in a substantive way. Therefore, we urge the group to use its funding to put something in place to truly aid those who struggle the most upon returning home. □

Life with dogs A few months ago I came really close to spending an unseemly amount of money to buy a German shepherd puppy, an animal whose parents were champions with impeccable breeding, conformation, agility and health.

But the day before my appointment to meet the dog—a step that for me would result in no turning back—I called the Bay Area breeder and canceled our appointment. I instantly felt relief. And that’s mostly because there are so many unwanted dogs, including purebred German shepherds, in need of homes. In fact, according to the ASPCA, 7.6 million animals enter U.S. shelters each year and, sadly, about 2.4 million healthy and otherwise adoptable pets are put down.

For a long time, my heart has been called to rescue a dog.

Another one, actually. My husband and I adopted a furry little Bichon Frisé from Butte Humane Society about three years ago.

Lucy’s been a great addition to our family, but she’s more of my husband’s companion. I’m a large-dog person, and I’ve longed to have a big pal for several years.

It took me quite a while to feel that way after having to euthanize my shepherd, Boaz. I bought 8-week-old Bo from a backyard breeder in Marysville when I was in my second year of college and ignorant of the ills of that kind of operation. Shortly thereafter I got a job at a veterinarian’s office and learned from X-rays that he’d have hip issues his entire life. Keeping Bo lean and healthy allowed him to lead an active and pain-free life in his younger years, and medicine aided him toward the end, when he was nearly 14 years old.

Boaz was much loved and is still missed, and it’s only in the past few years that I’ve started to feel ready to look for a new buddy. And since I now know better than to buy a dog from a disreputable breeder, and because there are so many great homeless dogs in the world, I started poking around the websites of California German shepherd rescue organizations. A few dogs have piqued my interest over the years, but last week something clicked. A Sacramento-based group posted a picture of a young shepherd mix called Syrio who was described as a very chill dog.

My husband, son and I traveled down to Rocklin last weekend and, well, we fell right in love with Syrio, a gangly 7-month-old boy who clearly has some wire-haired parentage. The rescue folks are leaning toward Irish Wolfhound, which would explain his size and adorably bearded face. There were several gorgeous purebred shepherds up for adoption, too, but we could tell Syrio was our guy.

His foster parents, a wonderful couple who are also caring for another rescued shepherd, spent hours with us as we asked questions about Syrio’s temperament. And this Friday, they are heading up to Chico with him. Our foster-to-adopt trial begins then and I’m taking the day off to help him adjust to what I hope will be his forever home.

I’ve learned a lot of lessons during my journey in this world. A big one is that dogs make life better.

About that new law Re “Rookie moves” (Second & Flume, by Melissa Daugherty, Sept. 24): I am saddened by the lack of humanity in arguments supporting the Offenses Against Waterways and Private Property ordinance. Does fear dehumanize those who have no home, no place to put their stuff, no place to move their bowels?

When we privileged folks have a dear one with mental illness or addiction, we give them care, and they are usually able to live with dignity, often as highly contributing citizens.

Research shows that when people are housed and provided services to help them deal with their disabilities, a high percentage become able to care for themselves.

Those who blame the least fortunate while clinging to their lives of privilege are in dangerous denial.

When people with no social support— crippled with mental illness, addiction, extreme poverty—are stranded on the streets with no means to clean themselves, despised by the public and law enforcement, they become less competent, more angry or depressed.

The challenge of self care becomes overwhelming.

Chico City Council, please make it a priority to work with citizens to find solutions, not create criminals.

We must meet the challenge of escalating homelessness with compassion, creativity and generosity. Many citizens will be there to help!

The butthurt conservatives believe this new ordinance will finally give the cops the tools they need to “crack down on those people.”

The butthurt liberals believe that this new ordinance will lamentably give the cops the unilateral power to harass “these people.”

Both are mistaken. This ordinance is a tautology; it states that unlawful misconduct is against the law, and is thus a crime. It doesn’t criminalize homelessness; it criminalizes crime.

It is now incumbent on the council, and the community for whom it deliberates, to address unmet needs and the deficit of adequate services. At a minimum, yes, public toilets (with showers and rudimentary laundry facilities) are the most urgent demand. If this legislation fails (best bet, candidly), then we failed. If services can scale to demand, we all succeed. Your move, conservative council. Consider it strategically.

Re “Faulty Coplogic?” (Newslines,

by Ken Smith, Sept. 24): An addendum to the lack of police follow-through is the response I got a few months back. I was checking Craigslist for motorcycles for sale and saw a listing advertising new Apple computers to trade for motorcycles.

I called Chico PD and told them I bet the computers were stolen and the clerk agreed wholeheartedly but said they had no one to deal with such crimes. I persisted and told her it couldn’t take that much time and might close more than one case. She thanked me for the call and didn’t ask for my name or number.

Myth-bustin’ Re “Only in America” (Letters, by Patricia Pierce, Sept. 24): Folks like Patricia Pierce would rather cling to their pet myths about homelessness than face the actual reality. The truth is that for many Americans, homelessness is just a missed paycheck or medical emergency away. Decades of upward income distribution have brought us widespread poverty, a broken mental health care system and a tattered social safety net.

With such complicated issues to solve, perhaps it’s no wonder some would rather scapegoat the most vulnerable among us.

Pierce asks us to get our facts straight, but she doesn’t bother to cite any, so here are some statistics from the National Runaway Safeline: Over 50 percent of “runaways” reported that their parents told them to leave or knew they were leaving but did not care; 80 percent of runaway and homeless girls reported having been sexually or physically abused; 34 percent of runaway youth reported sexual abuse before leaving home; 43 percent of runaway youth reported physical abuse before leaving home.

The myth that unaccompanied youth are lazy or incorrigible may help us forget about our collective responsibility to take care of them, but it ignores the very real and desperate situation these children are in.

Quite a suggestion Re “Shifting the burden to Oroville” (Guest comment, by Patrick Newman, Sept. 24): I have a suggestion for Patrick Newman, who is always whining about the treatment of the homeless among us. He could invite them to camp on his property.

This would reduce the numbers of them camping in Bidwell Park, under bridges, in City Plaza and along Big Chico Creek and Lindo Channel.

Reaganomics is not responsible in any way for their plight. The majority of citizens prospered living and working under the system. There are some among the homeless who have mental or drug-addiction problems. For those, help is available. Veterans suffering from post-traumatic street disorder can be helped by the Veterans Association.

I knew of two people who lived homeless in Chico during nice weather. They had credit cards and cellphones. When it became cold here, they moved to a warmer state. They returned to Chico when the weather was nice.

I have no problem with providing temporary aid to, for example, a woman with children who has been abandoned or abused, but we should not be encouraging homeless individuals to come here. The only free service the city or county

should provide is a bus ticket back to from wherever they came.

What’s in a banner?

The proposed military banners for East Avenue are inevitably a de facto recruitment tool. What kid doesn’t want his or her face on a banner? And yet, according to the data, if one of our kids joins the military, does a tour and makes it back, he or she is now more than twice as likely to commit suicide, twice as likely to become chronically homeless and more likely to to be unemployed (18- to 24-yearolds). The military might have been a good deal in the past, it might be a better deal in the future, but right now, the data suggest otherwise.

If Chico Military Heroes is really sincere about honoring our veterans, why not join forces with Chico Housing Action Team and line up some of the needed housing for the 50 to 80 homeless veterans in the Chico area? How hollow and hurtful this vinyl banner would appear to the homeless vets, who have unmet needs, who would walk below them? Isn’t it just a little ironic that we have criminalized homeless vets on one day, [the latest City Council action] and would “glorify” them with vinyl banners the next?

Veggie tales Re “What’s your favorite veggie?”

(Streetalk, Sept. 24): I’m glad 60 percent of Chico Natural Foods customers know what a vegetable is. Many don’t know how to tell the difference between it and fruit. I love asking people the question, “Is corn a fruit or a vegetable?” Most respond, “Sounds like a trick question, so I’ll say ‘fruit.’” It’s neither. It’s a grass, or a grain, like wheat.

If you eat the whole plant that comes out of the ground like kale, broccoli and asparagus, then it’s a vegetable. But, if the plant makes a flower that gets pollinated (by a bee, bird, bat, beetle or just the wind) producing the edible part, then it’s a fruit. Sorry, zucchini boy. Zucchini is a fruit in the cucurbitaceae family, which

includes watermelons, cucumbers and pumpkins. Tomatoes, bell peppers and eggplant are all fruit.

So is avocado.

In the olden days, fruit was wrongly classified by our royal forefathers to affect its trade taxation. People were easily misled.

So, too, is mushroom girl and her salad. Iceberg can’t possibly be her favorite vegetable and mushrooms aren’t them at all. They are the fruiting bodies of a fungus. That’s all I know. If you’ve don’t like my explanation, you can go pollinate yourself.

Trumpeting Trump Re “Sphincter says what?”

(Letters, by Pat Johnston, Sept. 24): Pat Johnston opined that women supporting Donald Trump are ignorant and lack self-respect. I disagree. I like that Trump’s aware of America’s problems and has the resolve to discuss the extreme measures needed to solve them.

Johnston likened Trump to Hitler for aspiring to deport 12 million illegal aliens. Trump is like Hitler in his belief that a race of people are selfishly and aggressively displacing a native population’s own race, culture, values and control of the country.

Allowing unchecked immigration and overpopulation won’t enable America to “move forward and prosper.” Rather, such will force everyone to work ever harder for ever-diminishing food, clean air and water, housing, peace and freedom. That is, while simultaneously enduring ever-increasing traffic congestion, unemployment, drugs, crime, and destruction of farmland and wildlife habitat.

Finally, Johnston condemned Trump for professing to be Christian. Trump’s human—just doing the best he can—within the rules of government to succeed and enjoy life in an imperfect world.

What makes Trump different is that, financially at least, he’s a lot better at it than the rest of us.

On Tuesday, Butte County Sheriff’s Deputy Josh Brazzi arrested a man for allegedly stealing property—including a laser—from vehicles in Chico.

At about 3 a.m., Brazzi saw a Honda Civic speeding on Pomona Avenue and gave chase, according to a BCSO press release. The Honda pulled into an apartment complex and a man and a woman ran from the vehicle; Brazzi detained both after briefly chasing them. The passenger, 22-year-old Brittany Bond, was interviewed and released.

However, the driver, 24-year-old Joseph Hammett, was found to be out on bail for vehicle theft and prowling. A search of the car turned up items stolen from two separate vehicles earlier that night, including a surveying laser valued at around $3,500.

Hammett was booked into Butte County Jail on charges of burglary, possession of stolen property and driving on a suspended license.

Marijuana by Mail

Four people accused of sending illegal drugs through the mail were arrested during a four-day operation in Chico earlier this month, according to a press release from the Butte Interagency Narcotics Task Force (BINTF).

BINTF and members of the United States Postal Inspection Service conducted the sting from Sept. 15-18, seizing more than 35 pounds of marijuana bound for multiple Florida communities, the release states.

Jorge Arevalo, of Florida, and Heather Smith, of Anderson, were arrested for transporting and possessing marijuana for sale.

Jose Diaz, of Redding, and Jason Schoeppner, of Sacramento, were arrested for possessing marijuana for sale, and Schoeppner was also charged with possession of psilocybin mushrooms. All four were booked into the Butte County Jail.

FOr a bike-Friendly city

The city is updating the Chico Bicycle Master Plan and is encouraging residents to “share your vision for the future of bicycling in the community” with an online survey and interactive map at chicobikeplan.com. The survey closes Oct. 9.

The plan, last updated in 2012, intends “to build bikeways that appeal to people of all ages and abilities, create a stronger community and help businesses thrive,” according to the website. The survey asks questions such as “Do you think Chico is a safe place to ride a bike?” and which sorts of bike lanes— colored, protected or buffered—respondents prefer the city build.

The interactive map allows users to add points where they believe Chico’s bike infrastructure can be improved using icons for streets in need of maintenance, difficult crossings and no bike parking.

Zoning changes to the area in 2004 prompted a 2006 order from the Chico City Council that the scrap yard move by 2011, and a series of extensions expired at the end of 2014.

“You can’t just approve an operation for putting a dress on a pig, cleaning up the fence a little and painting some buildings,” former Planning Commissioner Jon Luvaas said during one of the evening’s many heated exchanges with Kim Scott, who co-owns the recycling site with her father, George. “It’s the operation that’s the problem.”

The meeting was attended by about two dozen community members, with support and opposition for the scrap yard’s staying

put split roughly down the middle. In addition to zoning issues, citizens expressed concerns about the presence of toxic chemicals at the site, which sits in close proximity to Chapman Elementary School, three day care centers and several homes.

The neighborhood meeting was the latest

in a series of clashes dating back to at least 2004. That year, the city adopted the Chapman-Mulberry Neighborhood Plan, which rezoned the six parcels of land the company sits on from light industrial to neighborhood commercial. Plans were made to turn the property into a mixeduse residential and retail area, in keeping with part of the city’s general plan aimed at including commercial services in neighborhoods to cut back on the need to drive. Chico Scrap Metal is specifically addressed in the plan, which stated the city would work with the county to assist the business’ amortization—or move—to an industrial area. The last stay was granted with the caveat that there be no more extensions, and the business has been operating in violation of zoning codes since the end of last year.

In addition to being in the city’s sights, Chico Scrap Metal also has come under fire from state and county authorities in

the past. A 2007 study by the Department of Toxic Substances Control found contamination in the form of chromium, lead, zinc and polychlorinated biphenyl (PCB) at the site, and in 2008 Butte County District Attorney Mike Ramsey filed charges against George Scott for disposal of waste at an unauthorized facility and knowingly violating environmental safety laws. The owners pleaded no contest, and were ordered to pay $700,000 in fines— with $500,000 toward cleanup costs—and placed on five years probation.

But the Scotts appealed that decision, and it lingered in the courts until the appeal was shot down in January 2014.

The DTSC is currently in charge of overseeing the cleanup.

Kim Scott brought a team to Friday’s meeting to counter current contamination claims, including environmental chemist Barton Simmons, geologist Bryan Gartner and lawyer Therese Cannata. Simmons said testing conducted from 2010 to 2012 determined that contaminants were at background levels that do not cause a significant health risk to people in the area.

Scott said the company has submitted a cleanup plan to the DTSC. “Chico Scrap Metal is contaminated with PCB,” Russ Edmondson, a media information officer at DTSC, said in a recent email response to queries about the site’s current level of contamination and status of cleanup efforts. “All waste is contained (meaning that it is prevented from being released off-site) on the property and we have eliminated all other constituents of concern.

“The remedy that CSM has currently proposed is to leave the waste in place and to construct an impervious cap on the area. They will have a Land Use Covenant on this site property to restrict future uses and to ensure proper controls on any future excavations, as well as to require annual inspections. CSM has submitted a draft Remedial Action Workplan (RAW) embodying their proposal and DTSC is currently reviewing that document. CSM doesn’t have any technical reports due at this moment.”

Scott struggled during the 90-minute meet-

ing to keep the focus on fencing and other facility improvements, which also include resurfacing of two buildings, additional

parking areas and shrubbery planted along the fence’s exterior. She contended the cost of moving to another properly zoned, commercially viable site—which she estimated to be about $1.5 million—is prohibitive without the city’s help. When past City Council orders and decisions were brought up, she repeatedly interjected, “That’s all history.”

And she may be right. On April 21, the City Council agreed to consider allowing the business to stay if it made aesthetic improvements and operational changes, and worked out a development agreement that passes muster. It was ordered to submit an application for the proposed changes within 60 days, and the city issued a citation for violating zoning codes when the application hadn’t been submitted in July.

“The citation was issued because they weren’t moving as quickly as they should be, so it was a reminder of sorts,” Community Development Director Mark Wolfe said Tuesday.

Jake Morley, associate planner for the city, was at Friday’s meeting, and offered clarification on the process later by phone.

The neighborhood meeting was the first step, Morley said, adding that he expects Chico Scrap Metal’s finalized application for a development agreement later this week. The plan could be reviewed by the Planning Commission in November or December, and then will go before the City Council for final approval. Morley said there will be opportunities for public input during the next two stages.

“There’s a lot of history, expert opinions and passion involved in this issue,” he said.

A group of opponents to Chico Scrap Metal’s continued presence in south Chico, collectively known as Move the Junkyard, met Tuesday morning at Butte Environmental Council’s headquarters to try to make sense of Friday’s meeting and plan strategies moving forward. Several in attendance expressed ongoing concerns about pollution and questioned whether the city can legally overturn zoning laws and the past council’s amortization order. The group thinks there’s only one reasonable outcome, which was best voiced by Chico resident and Democratic National Committee member Bob Mulholland.

“The junkyard will eventually move, whether they like it or not, because the citizens of this community require that, state law requires that and the zoning requires that,” Mulholland said. “It will happen, and they’ll be dragged out by an elephant if they have to.” □

System override New grassroots organization seeks to reform the way Chico elects council

W

hen it comes to hot-button topics that have recurrently stirred debate in Chico’s City Council chambers over the years—the Saturday morning farmers’ market, Bidwell Ranch and disc golf in Upper Park—Ken Fleming and Robert Speer are remarkably well-versed. Both have followed local politics for decades.

That some issues simmer unresolved for so long is just one undesirable aspect of a political system Chico has outgrown, Fleming and Speer say.

“We’re still pretending that Chico is a city of 30,000 people, and with a good city manager and a meeting every couple of weeks we can make everything work just fine, thank you,” Fleming said during a recent interview. “That hasn’t been the case for at least two decades. Generally speaking, the track record of city councils is that they haven’t been able to solve problems.”

That would change if council members represented the neighborhoods in which they live, rather than the population at large. At least, that’s the stance of Districts for Chico, a new nonpartisan organization led by Fleming and Speer that intends read up: to reform elections of the mayor and the For more on Districts for chico, other six members of City Council. go to districtsforchico.com.

“They represent everyone, and therefore no one,” Speer said. (Speer worked for CN&R for 30 years, including stints as editor-in-chief.)

Districts for Chico held its first press conference on the morning of Wednesday, Sept. 30, to announce the goal of placing two measures on the November 2016 ballot—one separating Chico into six voting districts represented by one council member each, and another mandating that the mayor be elected at large and serve two- or fouryear terms. (Currently, the mayor is appointed by fellow council members and serves a two-year term.) The proposal wouldn’t change Chico’s so-called weak mayor system, in which the mayor wields only figurative power while the city manager runs day-to-day operations.

On top of holding representatives more accountable, Fleming and Speer touted benefits such as reducing the cost of candidates’ campaigns; addressing harmful partisanship; encouraging more candidates of different races and socioeconomic backgrounds; and protecting the city from potential litigation over the voting rights of minority populations.

SIFT ER New party time It’s no secret that Americans have a low opinion of the job that’s being done by their political leaders. In fact, according to a new Gallup poll, dissatisfaction with both Republicans and Democrats is so high that 60 percent of Americans today believe the country needs a third political party, which probably explains why left-field candidates from both parties—Bernie Sanders from the Democrats and Donald Trump for the Republicans—are getting so much attention as alternatives to the status quo.

he served as editor for Boise Weekly. He saw how voters benefited from having their neighbors on the City Council.

“They knew who to go to,” Speer said. “They knew who their representative was.”

He also saw it was possible to mount a strong district campaign without a lot of money. “With fewer voters to reach, you can really do a shoe-leather campaign by knocking on doors,” he said.

In last year’s election, council candidates raised a total of more than $180,000 in campaign funding. The three candidates who won—Andrew Coolidge, Reanette Fillmer and Mark Sorensen—all raised at least $25,000, and Fillmer alone raised nearly $50,000.

Which leads to another problem: The two major political parties have taken over the elections, Speer argues, because they are the only organizations with the money it takes to win. Therefore, nearly one-third of Chico voters—those who aren’t registered as either Democrats or Republicans—are effectively shut out from the City Council.

“What are ostensibly nonpartisan elections have become very partisan elections, and it’s been that way quite a while,” Speer said. “We think that’s wrong. Having district elections won’t get rid of money in the system, but it will reduce the need to have a lot of money to run an effective campaign.”

There’s also the matter of diversity. With the notable exception of Dan Nguyen-Tan, the son of Vietnamese refugees, the council has overwhelmingly been made up of white people who live in relatively affluent neighborhoods north of Big Chico Creek, according to analysis by Districts for Chico. That isn’t fair representation for minority and working-class neighborhoods, they say.

It also might violate the California Voting Rights Act of 2001, which makes it easier for minority populations to prove their voting rights are diluted in at-large elections. Robert Rubin, a San Francisco-based attorney who’s following Districts for Chico’s efforts, can’t yet definitively say whether Chico is noncompliant. Further analysis would reveal whether minority groups in Chico—about 65 percent of residents are white—are underrepresented in local government.

“If that was the case, we would certainly be looking at potential litigation,” he said.

Helping homeless kids Young woman shares journey to self-sufficiency, thanks to local drop-in center for youth Patterson first left her Chico home when she was 14, Cafterrystal years of abuse in her family.

She spent the next two years crashing at different friend’s houses, but eventually wore out her welcome.

With no couch left to sleep on, she officially became homeless.

Patterson spent her days downtown and around City Plaza and her nights sleeping at Chico State or in Bidwell Park. The hardest part, she said, was the uncertainty she faced every day.

“I didn’t know if I was going to be eating a certain night or where I was going to go,” she said. “During the weekend, some shelters were closed or they had really strict hours and I couldn’t always make it.”

Eventually, through other homeless people she met, Patterson started going to the 6th Street Center for Youth, a local drop-in center catering to young people ages 14-24. It’d take six months, however, for her to be comfortable enough with the staff and environment to take full advantage of the center’s services.

“I was very paranoid,” she said.

“I didn’t know if they would report me or if they were trustworthy. It just didn’t seem real that you were able to get food, shower, brush your teeth, and get clean clothes without something in return.”

Those feelings faded as Patterson started talking to the staff members and saw their dedication and compassion.

“They were so welcoming,” she said. “They ... let me build trust with them without pushing it. Seeing the way the staff interacted with other homeless youth is what convinced me. They genuinely care about what’s happening to the homeless population and want to help.”

Because of the center, Patterson went from spending days at City Plaza and nights at Bidwell Park to working two jobs, going to school full time and having a home she shares with her 3-year-old daughter.

The center’s staff helped to get her into a transitional housing program, gave her guidance and encouragement, and even hired her as an outreach specialist to tell her story to other young people in the

area and let them know that the center is there to support them.

“If it wasn’t for the center, I know for a fact that I would not be in Chico,” said Patterson, who’s now 22. “I would be an alcoholic; I would probably be addicted to some kind of drug because that’s where my life was heading.”

and life skills classes. The program helps more than 300 homeless youths and young adults each year.

Jennifer Barzey, program manager at the center, said the event is an opportunity for the community to see what the center does, meet some of the youth, take a tour, and ask questions.

“We rely so heavily on community support to keep these services going,” Barzey said. “We have hundreds of homeless youth in our community; that’s a community issue. It’s a really powerful thing to see people come out and support what’s going on here. It also means

Success stories like Patterson’s are why the center is holding its second annual Art Under the Awning fundraiser this weekend. It will feature live music, a silent art auction with works by local artists including youth at the center, food and more.

WEST NILE DEATH

This year’s first fatal case of West Nile virus (WNV) in Butte County was recently confirmed by health officials.

The victim, a senior citizen, became ill in late August and in September the infection was diagnosed as WNV neuroinvasive disease, the most serious form of WNV, according to a Butte County Public Health press release.

WNV is transmitted to humans and animals by mosquito bites and can be fatal; symptoms include fever, headache, fatigue, muscle pain and nausea.

As of Sept. 23, the county has recorded 45 cases of WNV—nearly half of which have occurred in people ages 5 to 49, though people over 50 years old are at greater risk of infection.

WNV season typically lasts through October.

Identical medical procedures are generally far more expensive in the North State than in Southern California, a new cost-comparison website shows.

For example, in the Sacramento area, a total hip replacement procedure runs an average of $51,458, compared with $27,748 in east Los Angeles County. The same goes for the average cost of a cesarean section ($28,828 and $17,567, respectively) and knee replacement surgery ($42,488 and $27,276).

Some experts speculate that the difference is due to lack of competition in the North State, where health care is provided mostly through a few large hospital chains, whereas Southern California’s health care system is made up of smaller hospitals and independent practices, according to The Sacramento Bee. The site, cahealthcarecompare.org, is a collaboration of UC San Francisco, Consumer Reports and the California Department of Insurance.

WORKING THROUGH GOLDEN YEARS

Working into retirement age, even part time, may be beneficial for physical and mental health, according to a study recently published in the journal Preventing Chronic Disease.

Researchers at the University of Miami analyzed survey data from 85,000 adults ages 65 and over, finding that people who kept working were nearly three times more likely to report being in good health, according to NPR.org. The researchers acknowledged an obvious caveat—that being in good health might keep people working, not the other way around.

Citing past research that indicates being active and socially engaged helps prevent health problems into old age, study co-author Alberto Caban-Martinez said that, “There’s something about the aging process that if you can stay working, then you stay hardy.”

panic attacks since childhood. But early in Sara Benincasa’s career as a comedian, she felt in control only while on stage.

“You don’t really have control— nobody has control,” she said during a recent phone interview. “A boulder could fall through the ceiling at any moment, you know, theoretically. But being on stage, you have an audience that gives you attention … You have authority in that moment.”

Suffice it to say, she isn’t in a position of authority during a panic attack— an emotional and physical response Benincasa characterizes as “the exact inverse of an orgasm” or “the moment right before you throw up, but extended and combined with the fear that you’re going to die.”

She had her first panic attack at 8 or 9 years old and as a teenager began experiencing bouts of severe depression and crippling agoraphobia—an anxiety disorder with which the sufferer, who often has experienced one or more panic attacks, avoids places and situations where he or she might feel helpless, trapped or embarrassed, according to MayoClinic.org.

On top of her career as a comedian, Benincasa, 34, is an author and mental health advocate. She chronicled her struggles with mental health in her 2012 memoir, Agorafabulous!: Dispatches from my Bedroom, upon which she developed

Benincasa also will draw from Agorafabulous! during her talk at the Bell Memorial Union Auditorium on Thursday (Oct. 8) as part of Chico State’s Suicide Prevention Week (Oct. 5-10). Her goal is to break down the stigmas and stereotypes associated with mental illness, she says, as well as encourage students to make use of the mental health services on and beyond campus.

For Benincasa, such sincere messages are most effectively delivered with a touch of humor.

“Being funny is an invaluable tool in discussing serious issues,” she said. “If you

can get someone to laugh, their defenses go down and they’re more likely to listen to you talk about something they find objectionable or strange or frightening.”

It’s good, then, that much of the student

body at Chico State is open to discussing personal problems and mental health, says Jasmine Buck, events coordinator for UMatter, a student-led program through Chico State’s Counseling and Wellness Center. Buck is overseeing Suicide Prevention Week for the first time this semester.

“The Counseling Center is always slammed, so obviously plenty of students are accessing those resources,” she said.

Another core message UMatter hopes to deliver during Suicide Prevention Week is the importance of intervention from friends and family and recognizing the warning signs of suicide, such as social withdrawal and suicidal ideation.

“Oftentimes it’s a small act from a friend that stops someone from attempting suicide,” Buck said. “Also, just knowing there are reasons for living and that there are people who can help—people who have been there, too. That’s a big message of ours.”

Buck also emphasizes that, while suicide is more prevalent among mentally ill people, even so-called “normal” people are only a personal tragedy away from finding themselves in that same dark place.

“Just because you don’t have mental illness doesn’t mean you can’t get there,” she said.

“Something can happen that makes you consider, ‘What are my reasons for living?’”

As for the keynote speaker, Buck says she recruited Benincasa because she wanted an impactful personality who has personally struggled with mental health.

Benincasa has indeed struggled, but now manages her symptoms through what she calls “complementary medicine.” It’s a broad approach including medication, support from family and friends, cognitive behavioral therapy— which employs techniques such as regulated breathing to slow her heart rate during panic attacks— mindful meditation and “the right diet choices.”

Since she’s known the depths of suicidal depression first-hand, Benincasa recognizes that “suicide is a terrible tragedy, but it’s not an entirely unpreventable one.”

In many cases, she says, such tragedy can be avoided if help is available when people are most vulnerable. That’s why Benincasa recommends seeking out a trustworthy psychiatrist who has experience treating his or her specific condition, but emphasizes that access to mental health services is not equal.

“I’ve been fortunate to work with a lot of great professionals, and some lemons; that happens,” she said. “Generally, I’ve had access to great care, and a lot of people don’t have that. It’s all about money. One of my missions is to make mental health care affordable to anyone.”

Benincasa also hopes that using humor, and her status as “a not particularly famous person,” will prompt discussions of mental health at Chico State.

“If I can just show up, be reasonably charming and amiable and get across the message that people who consider suicide are not losers, cursed or awful—they’re just people who could use some help— then I’ve done my job.” □

Pollinators face an uphill battle amid climate change by

Not all audiences are receptive. She receives push-back from people she calls her “conservative friends” who repeat the same refrain: Why aren’t you as concerned about humans?

The answer: She is. From grasslands to hummingbirds, bees to farmers, nature comprises connections—“and sometimes we don’t understand the complexities of the ecosystems we’re damaging,” Schierenbeck said.

“We depend on the plants and animals, particularly in a place like Chico, where almonds are such a part of our economy and we’re seeing such a catastrophic decline in pollinators, yet we’re not restoring natural habitat in this region.

“I don’t get it. I truly don’t understand.”

Pollinators—bees, butterflies, hummingbirds—are vulnerable to climate change, at least in part because the plants they pollinate tend to be susceptible to climatic impacts.

Less than 1 percent of California’s grasslands remain, Schierenbeck said, “and this is where a lot of wildflowers would have occurred. We don’t have that buffer to be able to recover, so there are no places of refuge for organisms—plant or animal—to be able to survive or wait out the drought.”

Fragile species don’t survive heat and drought; heartier species adjust their flowering, sometimes out of synch with their pollinators. Scarcity and “desynchronization” present “a double whammy” for which it’s difficult to adapt due to the rapidity of climate change.

“Organisms cannot respond evolutionarily,” Schierenbeck continued, “[because] this kind of extinction is not natural.”

Timing strikes at the heart of the interaction

between pollinators and plants. The scientific term is “phenology”: the influence of climate on life events. These include roses Feed the birds (and bugs):

“There seems to be mounting evidence that plant phenology—both leaf phenology and flowering phenologies—is responding to, changing with, climate changes,” said Chris Ivey, a Chico State biology professor whose research includes evolutionary ecology and plant-insect interactions.

“In almost all plants, there’s an acceleration with warming so the phenology is advancing: plants are flowering earlier, leafing out earlier.”

What about pollinators’ habits? Scientists around the world, Northern California included, are tracking the insects and birds.

“It does seem for the most part that phenologies of plants and pollinators are changing at a similar rate,” Ivey said, “but it’s not universal. There are some pairs of plants and pollinators that seem to have responded independently.

“There’s really not that much known about how these shifts are likely to impact the long-term viability, either for plants or pollinators.”

A key consideration is what Neal Williams calls “plasticity.”

Williams, an entomology professor at UC Davis, studies pollination ecology with a focus on bees. By plasticity, he means the degree to which a plant or animal can alter its phenology. (“Bug bursts” represent an example of plasticity, since the insects collectively emerge to coincide with specific conditions.)

“Whether or not they will be able to adapt to ongoing stressors like availability of

moisture … is different than what I’m talking about,” Williams explained, distinguishing these changes from evolution. “There’s a certain ability of the organisms to be able to adjust that will buffer them potentially, but not forever.”

Habitat loss may be just as big a concern.

“Although climate is a big driver, it will be layered on top of land-use changes and [land-]management changes,” Williams said.

“Together these things have really put the squeeze on forage availability for pollinators, whether they’re wild or managed.”

Hummingbirds face their own issues.

Their diets vary—nectar and/or insects—and they have wide migration patterns that are hard for scientists to track.

Jenny Hazlehurst, a hummingbird researcher at Tulane University who lends expertise to UC Davis colleagues, says inquiries abound. Still unanswered are questions as basic as whether backyard feeders help more than hinder, and she’s pursuing opportunities to find out.

“It’s important to look at all restoration efforts on an ecosystem-wide level,” she said. “Just focusing on one group of pollinators without looking at the big picture is not necessarily the right way to do it.” □

Meet their meat Family-owned and -operated Sierra Gold Jerky Co. suffered a setback when the patriarch of the artisanal jerky company, Eugene Buchanan, passed away from cancer last year. Buchanan and his brother, Jerry, started the Oroville-based company seven years ago, after working for 30 years in the meat-cutting business in the Bay Area. Jerry has moved away, and Eugene’s wife, Sandra, son Robert and daughter-in-law Corinna have since take over the operation, selling their products at trade shows and events, including the Thursday Night Market, and online. The CN&R recently sat down with Corinna, the general manager, who has over 20 years of culinary background in Chico, from bakeries to catering. THE BOTTOM LINE

What is artisanal jerky?

It is jerky that has been hand-cut, grinded, marinated or seasoned, and smoked. We make sticks, which are more tender and put into a casing, and jerky, which is chewier.

Our elk that we get is from a meat distributor in New Zealand, and it is all natural, free-range, and nonGMO. Our beef and pork, however, is commodity meat. Whatever spices we use for a particular batch will greatly change the flavor of our jerky.

Why isn’t Sierra Gold Jerky in stores?

Totally a USDA thing. It’s so complicated. We are only California Certified, which means that we are only able to sell our own product.

That is, we can’t sell the jerky to stores or wherever. If we were to be USDA-certified, we would have to pay for a USDA regulator to come and inspect every run of meat we do. It is not worth it for us.

What’s special about your meat?

Well, for one, meat gets graded.

For beef, there is select, choice and prime. The higher the fat content,

the higher the grade. Personally, we want a low grade. Our beef has low fat content, because fat doesn’t cure as well as lean meat, and the more fat in our jerky, the less shelf life it has. We cure our meats using sodium nitrate, which is standard.

Conventionally, meat was cured using salt and drying, but if it’s not cured using sodium nitrate, it is considered “uncured” by the USDA. Also, we aren’t allowed to process wild game and sell it because it isn’t inspected, but we are allowed to process someone else’s wild game and sell it back to them.

Are you successful selling online?

We definitely want to increase our business, which is hopefully going to happen when we get a new website. We do about three shows a month and we usually see a bump in our sales afterward. During Christmas time, there is a huge increase for the jerky as a holiday gift. And, we are expanding our choices from pork, beef and elk to also include turkey jerky, which has been asked for a bunch.

Sitting alone underneath a large green toucan statue last week, with three plates of food piled high in front of me, I felt great compassion for people who have to travel for work. I rarely travel for my day job, but last week I attended a conference in Reno with a client. The conference didn’t offer dinners and my client had plans with his wife, so I ended up at the hotel buffet by myself. In between bites of pork fried rice, a loaded baked potato and seafood salad, I tried to stay engrossed in my phone to look less lonely and quickly hurried through my meal, only to be back in my room by 6:30 p.m. with nothing to do but watch old reality television episodes on Hulu.

Real road warriors must be much less pathetic than I. Or they have the HelloTel app, which in hindsight, might have helped me find a gal pal to eat ridiculous amounts of fried shrimp and soft-serve ice cream with.

HelloTel is billed as the travelers’ social network, and is targeted toward business travelers looking to find out the haps in their hotel and surrounding area. You can meet up with fellow travelers, or just ask for reviews on great places to eat.

The app was founded by Chico company Sochule Inc., a parent company to a handful of Web/mobile development and technology firms, and has had some recent successes. HelloTel was approved last month for the Apple Watch, and the app has secured more than $2 million in funding since June 2014.

I don’t have any travel plans in the near future, but next time I end up alone in Reno, I may just use HelloTel to find a recommendation for a restaurant that doesn’t serve prime rib next to chow mein.

Comings and goings. I was sad to see that The Kitchen Table closed its doors last week. The East Avenue restaurant opened in 2013 and its menu featured local ingredients from places such as Llano Seco Rancho, Orland Farmstead Creamery and Comanche Creek Farms, among others. Chef/ owner Nathan Johnson said he is moving on in the food industry, and will keep fans posted on what’s next Across town, the empty space at the front of the Costco parking lot is slated to become the future home of Ulta, a chain beauty store. There are several Ultas in the Sacramento area, but the future Chico store is unique in that it will be a standalone location, unattached to a mall or shopping center.

Spotify’s biggest global competitor, Deezer, recently bought AT&T’s Muve music-streaming service with its 2 million U.S. subscribers. By year’s end, Google is expected to debut its MusicKey paid service, built around YouTube and paired with its present streaming offering, Google Play.

Meanwhile, Spotify announced in May that it will add video.

Others seem to join the fray each month.

Music mogul Jay Z teamed with other big-name musicians in the artist-friendly Tidal service.

Clear Channel Radio (with its new branding as iHeartRadio) also has its own streaming service.

Even Facebook is working to create a videostreaming platform.

Apple’s absence has been notable, if understandable. (Apple declined to comment for this article.) It feared a streaming service would cannibalize its download business, which controls two-thirds of the world market. Ultimately, it realized this would happen anyway, opening the

door for Apple Music.

Apple arrives not as an innovator set to save music and revitalize itself as a lifestyle product.

It is jumping aboard an emerging industry. Yet the company’s arrival is crucial because it signals that streaming has become a mainstream phenomenon—which probably is what Apple was waiting for. “[Apple has] developed a very mainstream customer base, and mainstream consumers aren’t early adopters. Mainstream consumers do things much more slowly than most people—so they have to innovate at a pace that is appropriate to those users,” says industry analyst Mark Mulligan of MIDiA Research. “What Apple does is make products ready for prime time. They don’t climb in new markets; they make markets by making it elegantly simple for less-savvy consumers.”

With a captive audience of more than 250 million iPhone and 800 million iTunes users, Apple’s reach is unprecedented. When the free, three-month memberships ran out at the end of September, the music industry arrived at a crossroads: Is the product enticing enough to motivate people to pay for what they can get free? And if they won’t, what does this mean for musicians?

“When the CD came out—boom—the digital genie was out of the bottle, and there was no putting it back,” says musician Roger Clyne of the Peacemakers, a Tempe, Ariz.-based Americana rock band. “Streaming is here, and there is no putting it back. It’s just ... how are we going to make this system the fairest it can be?”

From the moment he experi-

enced Rhapsody, the first music-streaming service to debut in late 2001, industry analyst Mark Mulligan was sold. Thirty million tracks available at the push of a button seemed like a killer app to him and his analyst colleagues.

“We were converts and thought the digital music market will be all about streaming by 2007 or 2008,” he says, laughing. “We got it right but were completely wrong in terms of timing.”

Instead, downloads took off and stayed strong, held aloft in part by Apple’s control of the market. When the industry allowed Apple to protect tracks with its own digital rights management protocol, it effectively cordoned off competition.

For years, only Apple devices could decode its DRMs, handcuffing people to the company’s devices and to its iTunes store.

“The download markets were so strong and so hard to break into because the vast majority of people who paid for digital music were—and to some degree still are—Apple customers, and Apple had them all locked behind a huge wall,” Mulligan says. “Then, Apple launched its app store, opening the door into its castle, and suddenly everybody could get in.

“That’s why Spotify was able to build a business,” he says. “Suddenly, other people could sell music products directly to Apple customers. That was the inflection point.”

Several factors also had to coalesce for streaming to fully take off—bandwidth increased and got cheaper, smartphones grew ubiquitous, and consumers became more familiar with streaming and its social aspects.

Spotify came along and gave away music on a free, ad-supported tier in the hope of converting listeners to a paid tier. A little more than a quarter of its free users have upgraded to paid subscriptions.

It made an equity deal with music labels (rumored to be as much as a collective 20 percent stake), buying time for the plan to work. Labels could realize a tidy profit from a strong Spotify IPO, giving the labels an incentive their artists don’t have.

The result is a one-third industry boost in paid streaming subscriptions last year, with the possibility of the increase tripling or even quadrupling (to surpass Sirius/XM Radio’s 28 million users), depending on the success of Apple Music.

albeit at a much slower pace.

It is interesting that some of Spotify’s label contracts are said to be expiring in October, around the time that Apple’s threemonth trials convert to paid subscriptions. It is easy to imagine a strong showing by Apple Music putting increased pressure on Spotify.

Early figures have 11 million users signing up for the trial. Apple’s potential success ultimately will lead, many experts say, to some limits on what is available, for free.

“The amount of value being given away to the consumer at whatever price to Spotify will be extraordinarily pared back if you believe what the CEOs of all the major record labels are saying,” says Ethan Rudin, Rhapsody chief financial officer and head of label relations.

Of course, as shareholders, these CEOs won’t want to do anything rash.

“If they were to pull the rug out from under those rights, [they would be] damaging the value of their investment,” says Rudin, who previously worked on Wall Street. “But you definitely do see some movement away from full, free, on-demand streaming.”

Musicians are doing their part to limit free’s appeal.

Artists such as the Black Keys, Taylor Swift, Bjork and Tool have kept or taken their catalogs off Spotify because they say it devalues musicians’ work. Selling CDs for below cost at Best Buy was one thing, but giving away music to all comers is something entirely different, even if streaming has been an essential step in neutering piracy.

“BitTorrent to free YouTube? I don’t know if that’s an advance. I think it’s maybe a symptom of a bigger problem,” says Tool/Puscifer frontman and Arizona resident Maynard James Keenan. “If things come to you for free, you just inherently don’t have respect for what went into them.

“I remember the days by the tour bus when people would come up to me with a ripped CD and ask me to sign it,” Clyne says. “And I remember the ‘value-added’ conversations.”

Clyne and the Peacemakers decamped to Rocky Point, Mexico, where they broadcast their writing/recording process over eight days and took feedback from fans. This level of engagement was repaid with the kind of steadfast fans who think nothing of funding a band’s Kickstarter campaign or traveling a hundred miles to see a group play.

From an overall perspective, giving away music has worked—more people than ever have become music fans. Now, thanks to streaming and speaker technology, it’s possible to have your music follow you from room to room and right into your car without lifting a finger.

As radio is going the way of the dinosaur and eight-track tape, better forms of listener engagement are emerging to amplify audience interest. Though they have burned down half of the traditional music industry, more personalized possibilities are sprouting—such as curated playlists and computeroffered musical suggestions.

because I love when new music is suggested to me,” Clyne says. “Big Brother is looking over my shoulder, but he recommends the new Rhett Miller album. I didn’t know about it, but he figured out that I should. I can’t say I didn’t enjoy it.”

In 30 years, music consumers have evolved from passively listening to whatever radio gives them to taking some of their music with them (Walkman) to taking their entire collection with them (iPod) to having access to the most readily available recorded music with custom recommendations and curated playlists (smartphone).

“The engagement with music has gone through the roof,” says Tommy Silverman, founder of Tommy Boy Records and the annual New Music Seminar. “People are engaging in music at every level in the live world and in the recorded-music world at [degrees] that are unprecedented. We just hadn’t been able to monetize it.”

Some worry that as long as there is a free option, freeloaders will dominate and subscriptions won’t gain steam. In a speech this year, Universal Music chairman Lucian Grainge said free, ad-supported music isn’t “particularly sustainable in the long term.”

Sony music head Doug Morris shares Grainge’s skepticism about Spotify’s ad-supported free tier, but Morris is bullish on streaming’s overall effect on the music industry—because it’s projected that more than 15 million Americans will spend at least $120 each on streaming subscriptions this year.

In 1999, at the height of the traditional music business, the average music consumer spent $71 a year.

“I do think this change to streaming signifies a tipping point in the music industry. The [recorded-music business] has halved in the last 10 years,” he says. “I think this tipping point will bring it back to where it was before. [Spotify’s home country] Sweden is back to where it was 10 years ago. My guess is that, slowly, Europe and the U.S. will go the same way, and we will have an industry that is healthy, robust and powerful.”

Spotify maintains that it will “stay

the course.” In a May financial statement announcing $180 million in losses for 2014, the company said its subscription-only model had not yet “proven a path to profitability.”

The pioneer streaming firm is geared to always pay about 70 percent of its revenue to rights holders. But it’s presumed that the company’s overhead is relatively fixed, meaning as its subscriber base grows (and, by extension, its number of paid subscriptions), so will the value of the remaining 30 percent.

Similarly, if and when the number of paid subscribers triples/quadruples/quintuples, so will payouts to artists, to some degree alleviating musicians’ worries.

Warner Music Group’s Stephen Cooper sounded hugely upbeat during a May earnings call, which featured news that streaming had surpassed downloading in first-quarter revenue.

“The rate of this growth has made it abundantly clear to us that in years to come, streaming will be the way that most people enjoy music,” he said. “Not only that, we are also confident that streaming’s ongoing expansion will return the industry to sustainable, long-term growth.”

Cooper suggested that this very success is reason for pause before targeting Spotify and YouTube’s free offerings.

“With respect to going to a strictly subscription world, I think that you can find evidence that when music is not generally available, people will seek out sites on the Internet that will offer up that music for no charge,” he says. “Before people conclude that ‘freemium’ should be burnt at the stake, we should think very carefully about the consequences.”

Another point in Spotify’s favor is that it is purely about music. Though that is the case for most firstgeneration streaming companies—including Pandora, Rhapsody, Rdio, and Deezer—the latest entrants are broadcast radio empires, Internet search and retailing giants, and makers of lifestyle devices.

For these latecomers, music is just something else to sell.

It’s because of Apple Music, of course, that so many are talking about what industry insiders call “freemium.”

It’s an enticement that a smaller company like Spotify can offer in lieu of the extensive ad campaigns that accompanied Apple’s iPod and iPad. In April, the firm’s valuation reached $1 trillion, close to 70 times the size of the global music industry’s worth. For Apple, music practically is the lighter sold at the conveniencestore register.

While lots of companies are getting into streaming, their long-term profitability is questionable. Rhapsody has had 14 years to cultivate its user base, but the smaller, newer entrants could have shorter shelf lives because of high up-front costs.

Contracts revealed by this year’s hack of Sony’s computer system show that Spotify paid $42.5 million up front just for access to the label’s music, not counting royalties.

“There’s quite a moat for people to jump to get into this business ... but whether they can swim remains to be seen,” Rhapsody’s Rudin says. “We’re rooting for everyone because we truly believe that a rising tide [will float] all ships.”

That’s easy for Rudin to say, since Spotify’s success and streaming’s sudden popularity have had a positive effect on Rhapsody’s bottom line.

An obstacle—though not an impenetrable one—to Apple again becoming a dominant force in the industry is a Federal Trade Commission probe that began in July.

The FTC is investigating the 30 percent markup Apple charges consumers to download other streaming services’ apps. So those who download Spotify from the iTunes Store pay $12.99 monthly rather than the $9.99 consumers pay if they sign up directly with Spotify.

Plus, the store’s rules deny competitors the right to notify consumers that they could get Spotify cheaper by going straight to the source. Apple has so much of the smartphone market that competitors feel they have little choice but to comply. Now that Apple’s created its own streaming service, the conflict of interest appears even more egregious, which sparked the FTC attention.

It would’ve succeeded, too, if Taylor Swift hadn’t foiled its plans with her public complaints. (Apple eventually agreed to pay a lower-than-usual streaming royalty rate during the trial period.)

A more dramatic transformation

is underway now than even when Napster emerged.

Its peer-to-peer network software operated a lot like the iTunes Store, minus the payment option.

Consumers downloaded tracks and took possession of them.

Streaming forges a fundamentally different relationship.

Rather than retailing replicas, it provides a pass to the museum. The industry is moving from hawking ownership to offering unprecedented access—access that’s far more satisfying than what FM radio and MTV provide.

she told Rolling Stone that free streaming was “just insane” and wondered aloud why the music industry can’t replicate the videostreaming company Netflix: First a movie appears in a theater, and then it goes to Netflix.

Though movies are different (for starters, they engage audiences for far longer periods of time than songs), many have echoed Bjork’s thinking—that it makes sense for music to come out physically at first, shortly thereafter on paid streaming sites, and finally on free sites like Pandora and Spotify’s nocharge tier.

This way, artists could move music behind a subscription wall without limiting the material altogether.

“If you want to have the best music first, you need to pay for it,” Mulligan says. “This, in principle, sounds very straightforward and logical, but it’s actually fraught with complications.”

Perhaps the biggest one is that various facets of the industry have difficulty agreeing on anything, no matter how logical or beneficial it may be to the industry as a whole. For example, until earlier this summer, every new piece of music was released on different days of the week around the world—which may have made sense when music needed to be shipped physi-

cally, but the industry has been in a head-first digital plunge since at least the millennium.

Why should German music lovers, for instance, wait a few more days for new American music? This only encourages piracy, as foreign listeners turn to BitTorrent rather than wait for the official release date.

What is needed now, industry analysts say, is for labels and streaming services to agree at least on how to administer new music with different release windows—like the movie business does with its motion pictures.

But streaming services grumble because they pay dearly for exclusive rights to inventories.

“You would think that the music business would be able to follow the movie business to protect itself,” Rudin says, because when streaming is at full force, a system like the movie business’ would engender more money for everybody.

“There is certainly a case for [release windows], but it won’t exactly be the same as movies because movierelease windows are protected in so many ways that music can’t be, certainly so long as you have [free]YouTube in the equation,” Mulligan says.

Says Tool’s Keenan: “Look, people are going out of their way to pay for the HD version of things. How the fuck does that not translate to music?”

In other words, consumers will pay for getting music first through a convenient and superior system.

One thing is certain: The public’s thirst for music remains unquenched.

To satisfy it and thrive, many experts believe, the music industry must figure out a way to retain the allure of free while securing enough premium content behind pay walls to ensure that free doesn’t become the fact of life that piracy once was.

Ideally, experts say, this is accomplished without letting Apple attain a scope that allows it to dictate terms to a music industry that it could purchase many times over—and with release windows that preserve the value of purchasing music before anyone else hears it.

“We have to do the math to identify how we tune the ecosystem to maximize money for artists and labels,” Tommy Boy Records’ Silverman says. “It’s a work in progress, but it’s moving in the right direction. I think there’s going to be some ecosystem correction that happens toward the second half of next year.”

After that, Silverman sees smooth sailing toward cable-like national penetration.

“With Apple in the game, we could get to 80 million to 100 million subscribers in two years,” he says.

“Then, the pot’s going to be fat, and everybody’s going to be happy.” Ω

The new album focuses on Kile’s coming-of-age story—leaving home, overcoming obstacles and finding her confidence as a musician. Unlike her first record, which Kile describes as “passiveaggressive folk,” her second isn’t as stripped down and features less woe-isme ballads. Instead, she’s added energy with a full band—including guest appearances by Johnson and Miller as well as celebrated multi-instrumentalist Joe Craven—to support her Americana sound, with bits of rock, blues, soul, R&B and jazz sprinkled throughout the songs.

“I’m exploring music and not feeling like I’m trapped in this one box of folk,” she said.

While the songs can stand on their own with just Kile and her guitar, she was happy to enlist a group of musicians who helped her explore other genres, enhance dynamics and work on being a band’s frontwoman.

“Music is really one of the best ways to grow a connection with others,” she said of bringing on more musicians. “And what’s the point of it if you’re not sharing?”

Each song is its own story, but Kile said the overarching themes of the record as a whole can be heard in the lyrics of the

title track: “Little heron on her way, where will she journey, where will she lay/She will flow free, float with sea, soar with the stars.”

“The whole track is basically about coming of age and leaving the nest and allowing myself to grow,” she said.

“Growth is sometimes lonely and sometimes painful and it’s scary but it’s also very necessary and beautiful.”

Listening to her music and watching her perform live, it’s striking to see a performer so young who exudes so much confidence. But that wasn’t easy to come by. Kile developed that throughout the recording process of the latest album, as she faced a power struggle with one of the original producers, who didn’t have her best interests in mind, she says.

“It’s hard to be an artist and put your foot down for what you want,” she said.

“As an artist, you’re extremely sensitive.

You have to stand up for your art and you have to make sacrifices.”

Kile and her team ended up throwing out the entire record halfway through its recording process before parting ways with the former producer, finding a new recording studio and starting again.

“I’m so proud of this record and the journey it took,” she said. “It would’ve been totally different than it if we had finished with this other producer. I would not be proud of it.” Ω

These images are part of The Edge of Night, an exhibition of noir-inspired blackand-white photographs by Jason Tannen that runs through Oct. 22 at the Butte College Art Gallery (with a reception today, Oct. 1, 4 to 6 p.m.). Until his recent retirement, Tannen curated Chico State’s University Art Gallery for 16 years. Before moving to California to teach photography, Tannen earned an MFA from

the School of the Art Institute of Chicago. CN&R caught up with him on the eve of the opening to talk about his new show.

CN&R: What are the biggest challenges of capturing images in black and white, and what inspired you to work in that form?

Tannen: For me, black and white focuses on the essential elements of light and shadow, image and emotion in ways color cannot.

The technical challenge is in capturing essential detail throughout such a wide range of tones. The main inspiration for The Edge of Night images was [the] film genré film noir. These American crime films of the 1940s and 50s were dark in look and tone, with a cynical vision of the world. As a photographer, I was inspired by how they took full advantage of black and white, with bright highlights and deep shadows to evoke a sense of mystery and menace.

How did you find/pick the setting for the images in this show?

I’m always on the lookout for promising locations, and what they look like at night. I’m particularly drawn to settings that relate to human interaction—restaurants, bars, hotels and motels, modes of transportation and communication.

Then I bring a person, or persons, into the scene and photograph the situation.

The emotion of the woman’s reflected profile in “Letter” looks very genuine.

How do you capture that with your subjects?

In the case of “Waiting,” the location is Union Station in San Diego, which has a distinct film noir vibe, and I brought in a character dressed for travel to highlight that feeling. In the case of “Letter,” I asked the subject to imagine a knock on the door. The classic noir actor was essentially impassive, an archetype with a mask-like expression–think Veronica Lake or Robert Mitchum. This underscores the fatalism of their situation, and I’ve sought to capture that element as well.

Are the characters you use people who just happened to be on the scene? Did you stage the “scenes” or capture moments as they occurred?

My work at the Butte Art Gallery combines a candid documentary street photography style— with its focus on composition, form, light and shadow—along with an approach where I involve myself more directly by bringing characters into the scene. The characters are people I know, or introduce myself to and ask for their participation. My interest in cinematic form extends to the basics of film structure. Thus, the images can be organized to suggest any number of dark narratives. □

by Donald Margulies and directed by James Ponsoldt. by Juan-Carlos The “road trip” (the last leg of a Selznick Wallace book tour, actually) is still an integral part of it, but The End of the Tour is only tangentially a road movie.

The core of the story is Lipsky’s attempt to write an extended Rolling Stone interview/feature on Wallace at The End of the height of the latter’s short-lived the Tour literary success. But Ponsoldt and Ends tonight, Margulies treat it, above all, as a kind Oct. 1. Starring of free-floating dual portrait, with Jesse Eisenberg and both of these writers named David Jason Segel. Directed

by James Ponsoldt. entangled, variously, in crises of Pageant Theatre. identity, personal as well as literary.

Rated R. Jason Segel plays Wallace and Jesse Eisenberg plays Lipsky, and both are excellent. Segel fully inhabits the novelist’s hulking brilliance as well as his shambling ambivalence. Eisenberg, himself a published author, delivers a delicately nuanced picture of a writerly intelligence navigating small storms of envy, astonishment, selfhatred and shivery rapture.

Those two performances and the richly ambiguous characterizations that they embody give the film levels of fascination and interest that it might not have otherwise had. Without them, The End of the Tour would still be of real interest, but mainly to more specialized interests— academics, Wallace fans (and mourners), curiosity seekers.

Still, the film does have some nicely resonant touches with those somewhat secondary matters—the inanities and exhilarations of book tours, the seemingly unavoidable discomforts of fame and publicity, the late-

modern quagmire of cultural mash-ups, the queasy intrusiveness of journalistic “profiles.” And some intriguingly intimate glimpses of the all-too-human puzzle that was David Foster Wallace are deftly sketched in as well.

There are also some jibes directed toward Rolling Stone—chiefly through glimpses of a brusquely obnoxious editor (played with dispatch by Ron Livingston) and some wisecracking references to “Yawn” (i.e., publisher and founder Jann Wenner). (As a footnote: Lipsky’s Wallace project never made it into print in Rolling Stone; only after Wallace’s suicide in 2008 did Lipsky return to his notes and audiotapes to produce the memoir that was published in 2010.)

Joan Cusack makes a gently satiric impression as a driver/PR aide for a book-signing event.

Anna Chlumsky is the very picture of lucid insight as Lipsky’s partner. Mickey Sumner and Mamie Gummer make some wry, understated contributions as two female friends of Wallace who accompany both Davids on what turns out to be a long night of binging on junk food, bad movies and late-night TV. □

Steven Knight treat the 1970s saga of chess champions Bobby Fischer and Boris Spassky as a kind of retrospective Cold War parable. The American Fischer (Tobey Maguire) gets the most attention, but the Russian Spassky (Liev Schreiber) is portrayed as similarly obsessive and no less defiant toward political manipulations. Much is made of Fischer as a child prodigy whose upbringing among leftist immigrants in 1950s Brooklyn makes him into an exuberantly

paranoid individualist, but the finetuned performances of Maguire and Schreiber are slanted more toward socio-political issues than to any deep-dish psychology.

Michael Stuhlbarg (as Fischer’s

government minder), Peter Sarsgaard (as a priest and chess master), Lily Rabe (as Fischer’s sister, Joan) and Robin Weigert (as his mother) slide a helpful assortment of emotional complexities into the proceedings. □

Black Mass

Johnny Depp plays the notorious gangster James “Whitey” Bulger and he’s superb.

His character dominates and he performs accordingly, but the film’s multicharacter mixture of crime story and morality play is strongest in its portrayal of John Connolly (Joel Edgerton), an ambitious FBI agent with lifelong ties to south Boston and the Irish neighborhood they both grew up in. Connolly’s moral wager—that he can be loyal to both the FBI and Whitey—is the centerpiece in the film’s gallery of morally compromised warrior types. Cops and robbers alike charge boldly through their respective confusions of high-minded aspirations and lowlife brutalities. Bold, quick-witted decision-making blends more and more into devastating self-deceptions. Director Scott Cooper gives the whole production a shrewd mixture of action-movie fury and socially minded, 1970s-style crime drama. In scenes of appalling violence, Cooper doesn’t hide the gore from us, but more than once he also makes a point of giving us a close view of a silent witness and/or accomplice struggling to maintain moral and emotional neutrality as the horror unfolds. The Visit

M. Night Shyamalan’s “comeback” is mainly brisk, generic entertainment—a comic horror film that’s smartly conventional, amusingly silly and generally mild-mannered.

The story premise has a single mom, long alienated from her parents, sending her children off for a first-ever visit with their grandparents but refusing to go with them herself. The grandparents look “normal” enough at first, but hints of family secrets and other worrisome stuff start edging into view almost immediately. The characters, of course, are little more than pawns in the games that this kind of story tends to play, but you could also say that they are pawns in the games that Shyamalan is playing with those stories here. There are touches of parody and satire in some of it, and the outlandish plotting indulges the wishful thinking of movie audiences while remaining mostly indifferent to murders that, outside the artificial safety of a genre movie, would have left some very large emotional scars. The Planning Commission will consider Zoning Code Amendment ZCA15-0001 to amend Article 42 Glossary, Section 24-304 to add “Well Stimulation Treatment” to the definition of “Oil and Gas Extraction”. The purpose of the proposed amendment is to clarify that well stimulation treatments, as defined in Section 24-304, are included within the definition of Oil and Gas Extraction.

This meeting will be held in the Butte County Board of Supervisors’ Room, County Administration Center, 25 County Center Drive, Oroville, California is open to all members of the public who are encouraged to attend. There will be a time on the agenda to accept public comment at the hearing concerning the Zoning Code Amendment.

And why not?

Don’t we naturally seek comfort in uncomfortable times? Whether the source of our discomfort is the weather, the economy or rightwing politicians spewing inanity, insanity and profanity, we want to feel better, and certain foods and their associations—with friendship, family and better times—can be a huge help.

Confession: Henri’s comfort foods tend to extend the conventional definition a bit and come from a more widely cast net. In fact, Henri can hardly think of a food or drink that wouldn’t bring at least some degree of comfort— including one of my favorite comfort foods, a Bloody Mary, especially one with two crispy strips of bacon for garnish.

That said, Henri has a few standbys that are rather more traditional. The first is mac and cheese, of course. I discovered this delicious variation by Mark Bittman in an issue of Cooking Light magazine.

Steakhouse side mac ’n’ cheese Ingredients: 4 teaspoons olive oil 2 teaspoons salt 8 ounces (uncooked) whole-wheat penne

pasta or macaroni 3 bacon slices 10 ounces mushrooms, quartered 1/4 teaspoon freshly ground black pepper 2 garlic cloves, minced 2 (5-ounce) packages fresh baby spinach 1/4 cup plain 2% Greek yogurt 4 ounces blue cheese, crumbled 1/2 cup whole-wheat panko 2 tablespoons chopped fresh parsley

Preheat oven to 400. Coat 2-quart glass or ceramic baking dish with 1 teaspoon oil. Set aside.

Bring a large saucepan of water to a boil; add salt and pasta. Cook for 6 minutes or until just barely tender. Drain pasta in a colander over a bowl; reserve 1 cup cooking liquid.

Cook bacon in a large skillet over medium heat until crisp.

Remove bacon from pan, reserving 2 tablespoons drippings in pan; crumble bacon. Add mushrooms to drippings in pan; cook for 8 minutes or until browned, stirring occasionally. Add pepper, garlic and spinach (in batches); cook 3 minutes or until spinach wilts, tossing occasionally.

Combine yogurt and cheese in a large bowl, stirring until almost smooth. Add pasta and mushroom mixture; toss to combine. Stir in 1/2 cup reserved cooking liquid (or more if mixture looks dry). Spoon pasta mixture into prepared dish.

Combine crumbled bacon, panko and parsley in a bowl.

Drizzle with remaining 3 teaspoons oil; toss to combine. Sprinkle evenly over top of pasta. Bake for 20 minutes or until golden and bubbly. Excellent with a burgandy

or pinot noir.

Note: For a fun presentation, make individual portions by dividing among ramekins or small ceramic loaf pans.

Henri’s slow-cooked turkey thighs with polenta Ingredients: 2 turkey thighs 2 tablespoons olive oil 4-6 garlic cloves, minced 1 large onion, sliced 2 or 3 large bell peppers (red, green and/or yellow) sliced 3 or 4 large carrots, sliced 3 or 4 celery stalks, sliced 4 cups beef or vegetable broth 1 cup polenta mix (or cornmeal) 1 tablespoon butter

Pour olive oil in large slow cooker, and add turkey thighs. Add vegetables (feel free to experiment with what’s seasonably available), fresh ground salt and pepper and cover with broth. Set cook time at 6 or 8 hours. Check from time to time to make sure vegetables and thighs are still covered with broth.

If not, add water or more broth.

A half hour before the turkey is done, bring four cups of water to boil in sauce pan. Add the butter and a pinch of salt. Pour polenta in slowly, stirring constantly.

Reduce heat, and continue to stir until polenta is done (about a half hour).

Spoon the cooked polenta into large, shallow soup bowls and ladle the turkey thighs and vegetables on top. Also good with a pinot.

Scarlet Skies Midnight North trazmick recordings Often in life, people are lucky enough to get a break by virtue of who they are. But eventually one has to make it on his or her own. In this case, the band Midnight North, co-fronted by lead guitarist and songwriter Grahame Lesh, son of the Grateful Dead’s Phil Lesh, offers plenty of autonomous staying power with its second album, Scarlet Skies. Four years after the 28-year-old Lesh began working with bassist Connor O’Sullivan and classically trained singer, songwriter and multi-instrumentalist Elliott Peck, Midnight North has produced a cohesive, satisfying package. Lesh shows a lot of poise and self-discipline, offering crafty and creative lead passages without overpowering the mix. The band’s feet are firmly planted in 2015, but the album makes a few nods to the past as well. On the anthemic “Wind and Roses,” one can detect some Jerry Garcia guitar influences, and in on the mid-tempo “Turn Around,” a little Jefferson Airplane. “The Cactus Tree,” a take about making a life out in the desert, is my favorite, with Lesh’s twangy, spy-movie-like guitar passages, guest Jason Crosby’s fiddlin’ and Peck’s ethereal voice.

Sharon Van Etten Jag jaguar One of Sharon Van Etten’s greatest artistic traits is capturing life in all its messy splendor with her songwriting, and the songs on her new EP, I Don’t Want to Let You Down, offer further proof. The title refrain is something most of us can relate to, and Van Etten gets even more vulnerable on “I Always Fall Apart,” a song about not handling crises especially well. One of the EP’s cleverest moments comes on “Just Like Blood” when the rock rhythm gradually begins to fade out after she sings, “Shot me up like a gun/ Then you run like blood,” as the life of her relationship slowly bleeds out.

And with an opening line like “It took me years to find true peace” from “Pay My Debts,” she shows in one little line that the arc of her narrative might be on the upswing. The songs here came out of the same sessions as Van Etten’s 2014 album, Are We There, and her downbeat and engaging drawl continue to mix perfectly with an ambient folk and quiet Americana sound to make for a treat of an EP.

Mojo On My Side Rick Vito Delta Groove Music Rick Vito, a much acclaimed Grammynominated sideman, got his first shot at making guitar history in 1974 when he joined John Mayall’s Bluesbreakers for four albums. He then worked with various artists—including Bonnie Raitt—before, in 1987, replacing Lindsey Buckingham in Fleetwood Mac where he spent several years before recording his first solo LP, 1992’s King of Hearts. Mojo On My Side is his newest offering and I was stunned by his singing (!) and playing—a lot of it using his slide with considerable effect. Eleven of the 14 tracks are originals that range from the down-home spiritual “Help Me, Lord” on acoustic guitar to “Femme Fatale,” a slide-infused slinky instrumental as well as my favorite, “House Party,” another raving slide outing with Vito cleverly reworking Clarence “Frogman” Henry’s catchy riff-based “Ain’t Got No Home.” Not all blues here, but one, Magic Sam’s “Easy Baby,” gets an appropriately relaxed treatment. Vito also plays bass and is joined throughout by Charles “Mojo” Johnson—a helluva drummer!

Review I am just about to complete my one-thousandth piece for the newspaper. That’s 458 columns (Arts DEVO and Local Bastard combined) and 542 (mostly arts-related) articles. Crazy.

I’ve been skimming my archives and it brought back a lot of good memories: convincing my editor to let me do full cover story/oral history on my favorite Chico band, 28th day; interviewing aaron Rodgers at the coliseum when he was a star at Cal; traveling to Appalachia in search of my birth father; getting paid to write about beer on many occasions; and hundreds of stories on local artists, musicians and other freaks.

I also went back and reread my very first piece, which was an assignment from then-Arts Editor John young to do a profile on longtime Chico musician Jimmy Fay (“Up all night for 27 years,� June 12, 2003). In it, Fay talks about his long, continuous history of performing—from his days growing up in New Jersey to his 30-or-so-year run with legendary locals spark ’n’ Cinder—which he summed up with: “Once you get into it, you get extended too far to not finish it through.�

It came across as fatalistic to me at the time, like he was saying, “What else am I gonna do?� But as I skim the archives, the idea kind of resonates for me now, both in the fatalistic sense (seriously, what else would I do?), as well as in the sense that I have become deeply invested in the creative community and have this part to play. I’ve always cared about music and the A thousand articles is worth a picture.  arts in Chico, long before my time at the CN&R, and now it’s my work/purpose to tell these stories. I get to celebrate the art being made, shine a light on the hidden gems and keep our city’s wild, arty fun-makers on everyone’s radar and give ’em a little juice from time to time.

For the week oF october 1, 2015 ARIES (March 21-April 19): The next

seven weeks will NOT be a favorable time to fool around with psychic vampires and charismatic jerks. I recommend you avoid the following mistakes, as well: failing to protect the wounded areas of your psyche; demanding perfection from those you care about; and trying to fulfill questionable desires that have led you astray in the past. have seen websites that offer practical tips on how to improve your mastery of life’s little details. They tell you how to declutter your home, or how to keep baked goods from going stale or why you should shop for shoes at night to get the best fit.

I recently come across a humorous site that provides the opposite: bad life tips.

For instance, it suggests that you make job interviews less stressful by only applying for jobs you don’t want. Put your laptop in cold water to prevent overheating. To save time, brush your teeth while you eat.

In the two sets of examples I’ve just given, it’s easy to tell the difference between which tips are trustworthy and which aren’t. But in the coming days, you might find it more challenging to distinguish between the good advice and bad advice you’ll receive. Be very discerning.

GEMINI (May 21-June 20): On a

windy afternoon last spring I was walking through a quiet neighborhood in Berkeley.

In one yard there was a garden plot filled with the young green stems of as-yet unidentifiable plants. Anchored in their midst was a small handwritten sign. Its message seemed to be directed not at passers-by like me but at the sprouts themselves.
