Absentee counseling The city made a poor choice when deciding to hire an out-of-towner as city

attorney. Nothing against Vince Ewing; he’s probably a perfectly qualified counselor. Unfortunately, he’s not a Chicoan, nor does he plan on becoming one, and physical presence is an important factor that should have been better considered when hiring a city attorney.

Back in January, when the city was seeking proposals from private law firms, the CN&R warned city leaders that contracting out this important post would be a disservice to the people of Chico. And, after a few months with Ewing filling former City Attorney Lori Barker’s seat, we’ve begun to see evidence that our prediction was correct: He cannot fulfill his duties from a desk in the City of Industry.

Last week’s Internal Affairs Committee meeting was a case in point.

Ewing attended via speakerphone, and several times, committee members had to repeat themselves when asking him questions. At the end of the meeting, after giving Ewing direction to draft an amendment to the city’s alarm code, Councilwoman Tami Ritter joked, “Can you repeat that back to me?” He laughed and she quickly retreated, “You’ve got it.” But did he? We’re not so sure.

To add to the problem, as journalists we at the CN&R rely on city employees—like Ewing—to provide insight into important matters. On at least three occasions, including this week for Howard Hardee’s story about alleged Brown Act violations, phone messages left for Ewing were not returned. That was not the case with Barker, who was regularly available in person or by phone. If the media can’t rely on Ewing to respond to us, can the city and the community rely on him to do what it takes to fill his role?

We think not. Chico needs an in-house city attorney who not only knows the law, but also knows and cares about this town. Ω

A laudable bipartisan effort ast year the president signed the third reauthorization of Lincreased the Violence Against Women Act. The act provides funding to help in the treatment and protection of

rape victims as well as providing funds for rape sensitivity training to police. The desire to end rape culture has become a hallmark of the Obama administration.

Now senators and members of the House of Representatives are contributing to the cause with multiple new bills being constructed and pushed through to help in the treatment and protection of rape victims. A bipartisan effort is being made to finally hold schools responsible for coverby ing up or mishandling rape cases.

The majority of rape cases go unreported and the majority of those reported do not lead to prosecutions. This further inhibits victims from reporting their assaults. Studies show that, despite sensitivity training, police still tend to exhibit biases toward rape victims, believing their stories to be false, overexaggerated or provoked. This leads to further emotional victimization of those who report being sexually violated. Prosecutors often are reluctant to take on rape cases, and rape kits, a valuable tool in the prosecution process, often remain untested.

The collegiate environment encourages rape by lowering the legal and ethical threshold for responding to such cases. A campus’ reputation can be severely damaged by the publication of rape on campus; this can lead to dropping application rates and decreased funding to the school. This gives an incentive for schools to not only ignore allegations of rape, but also to actively cover up suspected rape cases. If all bodes well for the bills, soon schools will have to do more to combat this crime. Hopefully this will begin to curb the trend of rape on college campuses, so that schools can return to being places of learning as opposed to places where women are made to feel unsafe. Ω

Welcome to town, students Downtown was quite a bit busier the week before fall session got underway

at Chico State and Butte College. Parking was a little scarcer, foot traffic on the sidewalks much heavier, and the overall vibe one of youthful enthusiasm.

Yep, the students are back in town. Summer sure has flown by. It’s an exciting time, as Chico’s transient college population returns for another academic year and a chance to make a mark on the campus and the city.

We’re hopeful that this year will be one of productivity, particularly in the area of scholarship, and we’re also hopeful for the health and safety of those who have chosen Chico as the transition between home and the “real world” that lies ahead.

We don’t want to come off overly preachy here, but given some of the recent tragedies in the campus community, mostly due to excessive drinking or drinking and driving, we want to urge students, especially those new to town, to take it easy when it comes to alcohol consumption.

Yes, there are many places to buy booze within a few steps of campus.

And, yes, it’s easy for those under the legal drinking age to get hooked up by their peers. But imbibing doesn’t have to be dangerous. Have fun, but be responsible. Don’t drink yourself into oblivion, and don’t let your friends do it either. The same goes for drinking and driving. Walk home with pals or take a taxi or pedi-cab ride. Like it or not, these are decisions that can mean the difference between life and death.

Make wise decisions and your college years probably will be some of the best and most rewarding of your life. Ω

Where’s Joe? Last spring, after writing about the likely candidates in this year’s elections, the June primary and the upcoming general election, I got wind of an early candidate for Chico City Council named Joe Montes. I checked out his website, but never wrote anything about him, since it would be another eight months until November’s election, and thus several months prior to the start of the campaign season for council contenders.

Montes piqued my interest. He’s the first person in his family to graduate from high school, and he went on to become a federal judge. He put down roots in Chico last year, but has a great affection for the town, having spent summers here while growing up.

A close friend of his made an appointment with me several months ago to sing his praises, and, from the sound of it, Joe Montes could do no wrong. The friend, a local businessman, told me Montes is a conservative, but that he’s a good communicator and mediator. Montes would work to bridge the chasm that’s grown between the council’s current progressive and conservative members, he said.

I told the businessman I’d look forward to seeing Montes in action during the candidates’ forums. But as we now know, that’s not going to happen. He’s not running after all (see page 8 to read about the full cast of candidates). I met up with Montes recently, anyway, and one of the first things I asked him was who talked him out of running. Montes acknowledged that he was indeed urged to back out of the race. He wouldn’t give me the name of the person, or perhaps people, though he basically described an ambush scenario—he was invited to a meeting under false pretenses by someone whose true motive was convincing him to make a quiet exit.

Welcome to politics in Chico, Joe. That’s pretty much what I told him. See, Joe Montes may be a well-qualified candidate. He may be a guy who can rise above the partisanship in our so-called nonpartisan city government.

But he has a number of things working against him. For starters, he’s new to town and thus is not among the chosen ones, in this case the chosen three conservatives (Mark Sorensen, Andrew Coolidge and Reanette Fillmer).

I probably don’t see eye to eye with Joe Montes on a lot of things. I’d say we’re fairly politically divergent.

However, he seemed sincere about wanting to move the city forward.

A while back, Montes pulled down his campaign page, www.joemontes4chico.com, but I did some Internet sleuthing this week and found a backdoor way to view the site. One of the things that impressed me the most was seeing his pledge to not take campaign contributions from any of the city’s unions. He noted that those specialinterest groups often benefit at the expense of the taxpayer. At the very least, taking such donations creates the perception of favoritism.

He’s right, and I’ll be taking a close look at each candidate’s financial disclosures. Any true fiscal conservative would be wise to follow his lead.

Responses to cover package Re “Constant change” (Cover feature, by Tom Gascoyne, Aug. 14): Sebastian Tamarelle, owner of the new oyster bar on Broadway, must have spent some time analyzing the fitness of his location before putting “every available hour” into it. Now he is complaining about the homeless—and wondering why the police don’t “scoot them along.” (Scoot them along to where, Mr. Tamarelle?)

Has Tamarelle compared Chico commercial rent rates with, oh, how about Carmelby-the-Sea? Newsflash: Downtown Chico is not an exclusive commercial district for 1 percenters and rents reflect that reality.

Additionally, indignation directed at people who are broken enough to be seen “digging through garbage cans” is pretty hard to swallow along with gourmet oysters and high-end beverages.

When Campus Bikes owner Budd Schwab says that 50 percent of the people on the street are there because of a “lifestyle choice,” he is repeating a popular lie. This is a popular lie, because it gives us cover; we can imagine that our economy, social services, foster programs and the American family are all working just fine.

Therefore, anyone under 30—and that’s the 50 percent he’s talking about—is on the street because they arbitrarily decided to wander into a grueling, shelterless existence.

Has Schwab ever spent 15 minutes listening to that 50 percent?

Life is a tapestry of choices. Everyone experiencing homelessness has made a choice to do so. The clear majority simply had no other choice. Those with options chose homelessness as the best choice they had. They all had one thing in common— they were poor when they made that choice.

The choice of words by the executive director of the DCBA was refreshing, particularly that the downtown is in much better health than most people think and that simply getting rid of homeless people isn’t the solution. These two choices are joined at the hip.

The reason downtown Chico chooses to do well is the actuation of the view that community is everyone.

No one exuded this better than Mr. Schulman, who relishes his love for downtown as do those who choose to be steady visitors, myself included. Perceptions from afar are often fuzzy and off-kilter. Proximity is a great equalizer. Add downtown to your quilt of places. You’ll be pleased with your choice.

Parking, parking, parking. I’ve lived here for seven years now, and on countless occasions I’ve been to the Saturday morning farmers’ market and to the Thursday Night Market. I’ve been to sold-out concerts at Laxson Auditorium, and not once, not once in seven years, have I been unable to easily find a parking space.

Now I will admit that I am happy to walk two or three blocks from where I park to where I’m going. Perhaps it’s time to embrace the idea of getting a little exercise when we go shopping rather than an expectation of parking right in front of our shopping target.

Tiny houses don’t cut it Re “Adequate shelter needed” (Letters, by Dan Everhart, Aug. 7): The homeless population is very much in need. I hardly see a building that is no more than a small shed without running water, heat or a bathroom as “adequate.”

We treat our animals better.

It can be given any fancy name in the dictionary, but as a country we’ve been here before: shed, shack and even shantytown. What are people supposed to do when temperatures reach 20 degrees as they did this last winter, trot on over to the outhouse? And what about heat? And how about showers, do they reach for the garden hose? It screams poverty and degradation not the least bit to raise up their lives.

Why, why should anyone donate to such a cause?! Homeless people need homes. We have groups putting people in real homes. Granted, they need more funds to house more people, but they have a handle on what to do and how to do it. Let’s support their efforts instead of reinventing the wheel. Winter shelter and day center, yes! Shacks and sheds, no way!

Billboard-buyer speaks out I’ve heard that some are offended by my billboard on The Esplanade south of Cohasset. It says the U.S. supports Israel killing children, and suggests boycott, divestment and sanctions.

The Aug. 13 Wall Street Journal reported that the Pentagon has been quietly transferring munitions to Israel despite the direction of the White House and State Department not to do so. Israelis used U.S. funding to pay for the weapons. For decades, the U.S. has been giving Israel $3 billion a year

for weapons.

It seems the military industrial complex Eisenhower warned against is in control. But Obama is not giving up. The White House has halted a shipment of Hellfire missiles to Israel, and demanded that all requests from Israel for U.S. munitions be routed to the White House and State Department, not Pentagon backdoors.

All U.S. citizens are complicit in Israeli killing. For those of you who do not wish to be complicit, call the White House at 202-4561111 to show your support for Obama in limiting Israeli access to U.S. weaponry.

To better understand the current situation, I recommend an article titled “Israel Provoked This War,” on Politico by Henry Siegman, a former national director of the American Jewish Congress.

Get wise about water Riding through town each day I see some businesses watering their nice green lawns during the hottest part of the afternoon. And those who water at night often have broken sprinklers or irrigation lines that can spew hundreds of gallons per hour straight down the gutter.

This is unfortunate for us all.

Ideally businesses would let their lawns die like so many residents have; or at least water only every few days. At the very minimum, we should stop watering during the hottest part of the day.

Please, have your business’ landscaping company do a thorough check of your irrigation lines.

And if you notice the sprinklers running during the day, ask that they be adjusted. All it takes is a call to your landscaping company.

If your business insists on keeping its lawn, it’s ideal to water in the early morning or during the night.

If we all work together, we can get through this tough drought!

WATER SUIT VICTORY

A federal lawsuit filed June 10 against the U.S. Bureau of Reclamation charging inadequate environmental review of its north-to-south water transfers has “achieved a major goal,” according to AquAlliance, a Chicobased water protection group that partnered with the California Sportsfishing Protection Alliance in filing the suit.

While the agencies’ effort to gain an injunction to halt the yearly transfers failed, the bureau did declare in court that temporary transfers of water from both the North State and the Bay Delta will be included in a plan that discloses how the communities, economy and the environment may be affected.

Considering this concession a victory, AquAlliance said it will drop the lawsuit.

MILITARY BANNER ISSUE PUNTED

The Chico City Council was asked at its Tuesday (Aug. 19) meeting to approve a resolution that would allow a veteran’s group to hang up to 500 banners on street lights lining public roads, including East and First avenues. The flags would honor local activeduty members of the military. A nonprofit group called Chico Military Heroes is behind the effort and said it would pay for all of the expenses related to the banners if the city waived the $2,100 permit fee.

At one point early in the discussion, City Council members Randall Stone, Mary Goloff and Tami Ritter said they should disqualify themselves because they live in areas near where the banners would be displayed.

However, City Attorney Vince Ewing said there was no financial conflict of interest and as such encouraged them to vote. After 18 speakers, about half in favor and the other half opposing—not the soldiers, but rather what they viewed as the glorification of war—the council punted the matter to the Internal Affairs Committee.

Water companies under the umbrella of the California Public Utilities Commission—including Cal Water in Chico—were recently ordered to provide direct notice of mandatory wateruse restrictions and potential fines to their customers.

The mandate comes in response to the California Water Resource Control Board’s emergency water-use regulations, adopted on July 15, which prohibit using drinking water for outdoor landscaping in a manner that causes runoff; to wash a motor vehicle with a hose with no shut-off valve; to wash sidewalks; or in a fountain that doesn’t use a circulating system.

The CN&R checked in with each of the candidates to find out what they believe are the hot-button topics of the season and why they think they’re up to the job. All but one were contacted via email; the other, Rodney Willis, was interviewed by phone.

The most common theme for all the candidates is fixing the city’s financial problems.

With a new city manager, assistant city manager and city attorney, as well as a city in financial crisis mode, the council has a lot on its plate for the new year. Over the coming months, we hope to shed light on each of the candidates. Here’s a quick primer introducing everyone.

Anyone who follows the council has a pretty

good idea of the incumbents’ political positions—Mayor Scott Gruendl is generally considered a progressive and Vice Mayor Mark Sorensen a conservative. Gruendl, however, has disappointed some of his longtime supporters with certain budget-related votes during his third term in office.

Gruendl, who serves as director of the Health and Human Services Agency for Glenn County, said one of the reasons he’s running for re-election is he doesn’t want to abandon the city in these tough fiscal times.

“There was simply no way that I was going to walk away from the city under the circumstances, as my institutional knowledge and experience are needed,” he said. “Yes, I have apologized and taken responsibility for what’s happened, but I am committed to cor-

recting the situation.

“The city failed to pay down deficits and unauthorized internal borrowing ruined our cash position. The council responded appropriately by hiring our first-ever external city manager, who then proceeded to right-size the organization,” he said, referring to the recently departed Brian Nakamura.

Sorensen, who was appointed as city administrator for Biggs two years ago, has been a reliable conservative during his first term. He is running for re-election because of a “desire to continue with guiding the cleanup of the city’s financial issues and return the city to a sound financial footing, including reallocation of financial resources more toward the core city functions of police, fire, roads, infrastructure and parks.”

He said there have been a “variety of long-running fiscal missteps that will take years to recover from, and can only be resolved with years of properly understanding the challenges and the long-term and consistent pursuit of corrections.”

The three women on the ballot, Forough

Molina, Lupe Arim-Law and Reanette Fillmer, all are first-time candidates and longtime Chicoans.

Molina was born and raised in Chico, where she lives with her husband and

four children. For the past 20 years she has taught middle school in Oroville, and, an avid cyclist, she serves on the Chico Velo board of directors.

The major problems facing the city, she said, are public safety, economic growth and sustainability. As such, the council has to work with city staff, the police and fire departments, businesses, nonprofits and unions. “[We] must enhance economic competitiveness and promote clean industry,” she said, and “keep Chico compact to stop urban sprawl.”

Fillmer also grew up in Chico, where she’s worked as a human resources director since graduating from Chico State with a degree in public administration. She said her HR experience in labor relations and bargaining give her a unique perspective as a candidate.

She said she is running for council because of her deep concerns about Chico’s future.

“The council majority has depleted the city’s budget reserves and passed smoke-and-mirror budgets designed to cover up their financial mismanagement,” she charged.

The most pressing problems facing the city are finances, crime and a lack of jobs. She said if elected she will work to “prioritize funding for essential services and reject proposals that will put Chico

She said there is a pressing need to enforce laws that “discourage the damaging transient problem that is driving away commerce and hurting our quality of life.”

Arim-Law moved to Chico 14 years ago. She is the married mother of three.

For the past six years, she’s worked as the youth director for Trinity United Methodist Church and is a recent Chico State graduate with a degree in political science.

She, too, says the city’s finances are its biggest problem.

“Our parks are closed, our kids have limited recreation, flights are decreasing at our airport and our streets are filled with homelessness,” she said. “We need to come together as a community and figure out a sustainable solution to solve our problems and move our city forward.”

Two candidates who are making a reap-

pearance on the council ballot are Rodney Willis, who ran 10 years ago, finishing 12th in a field of 13, and Andrew Coolidge, whose bid for a seat two years ago was unsuccessful.

Willis has worked in the nursing field for the past 23 years, initially as a certified nursing assistant and more recently as an emergency medical technician.

Willis moved here with his family from Phoenix when he was a boy and after graduating from Chico High School, served 15 years in the Navy. He said he decided to run again because the council has acted with a lack of oversight on matters like the budget.

“We would not be in this debacle if Gruendl and the rest of them would have had the foresight to have a rainy-day fund put away,” he said. “I just want to make Chico better because my mom is here, I’m here, my daughter and son live here and now my grandchildren live here.”

Coolidge moved here 20 years ago from the Yuba County town of Loma Rica to attend Chico State. He serves on the Butte County Fair Board and has a public relations firm that puts on, among other events, the Chico Fall Home and Garden Show. His solutions to the city’s financial problems include entering into a contract with Chevron to implement the “Chico Green Growth Program,” which he says could save the city as much as $200,000 annually through energy savings and water conservation.

Coolidge says he is running to secure the future of his two young children.

“I would like them to be able to live and work in a community which will provide opportunities for them,” he said. Ω

Chico looks to Santa Rosa for air-service solutions timing of last week’s announcement by TtheheSkyWest Airlines to discontinue service to Chico Municipal Airport in early Decem-

ber may have come as a surprise, but the bigger decision was no shock, according to city and airport officials who say they’ve been— albeit inadvertently—packing the proverbial parachute for such a bailout for several months.

“The Chico Airport Commission was already working on a plan for expanded passenger service,” Mayor Scott Gruendl said in a press release and “five-point action plan” posted to his Facebook page Monday (Aug. 18). “Although the announcement by SkyWest is terrible news, it was anticipated and the pathway to the future is already being laid.”

“We knew that Chico was probably on a short list when other Valley towns started losing their connections through SkyWest,” Gruendl elaborated in a phone interview, referring to the airline’s April decision to halt service to Modesto. “We made it through the previous round, but it was a good indicator we might be next.”

SkyWest, which contracts with United Airlines to provide United Express service between Chico and San Francisco, cited maintenance and fuel costs, government regulations and the lack of tickets sold in Chico as reasons for stopping service. The airline also is axing services to Humboldt County and Yuma, Ariz., on Dec. 2, according to news reports in the Times-Standard and Yuma Sun. On March 13, city officials, local business people and members of the Airport Commission met with Paul Kelley, a former Sonoma County supervisor-turned-consultant who helped restore commercial air service to the

Kelley’s presentation detailed the steps taken in his county and offered an action plan for Chico that formed the basis for Gruendl’s strategy. Gruendl said he hopes the information gathered and progress already underway could result in a new carrier filling the gap left

by SkyWest by next spring. He also said $200,000 of the city’s 2014-15 budget allotted to hire a new airport manager would be better used to expedite a new airport market study and contract with outside management services to help attract and secure a new carrier.

The city’s foresight can be at least partly credited to travel expert Greg Fischer, a Chico resident who regularly attends Airport Commission meetings and maintains a blog on local transportation issues called Planes, Trains and Automobiles. Fischer also helped organize Kelley’s Chico forum, and on April 17 sent a letter to the Airport Commission asking city staff to make a report detailing the financial consequences of airline service ending and the difficulties of recruiting a new carrier without existing service. The

“Perhaps having a glimpse of the airport’s financial picture in the event of United Airlines pull-out as well as an understanding of the challenges the city would face in restarting air service without an incumbent carrier would be enough to stir Chico’s business community out of its torpor,” Fischer wrote in that letter.

Shortly after Kelley’s appearance, and at

Gruendl’s urging, the Chico Chamber of Commerce formed an Airport Task Force in May to help research new carriers to expand commercial air services in Chico and figure out how local businesses could be more involved with the airport.

“I see the business community playing a vital role in attracting new service,” said Katie Simmons, Chamber president and CEO. “In other cities that have lost their service, I’ve seen chambers really rally the support and resources necessary to a make a significant difference, and I see the same potential here in Chico.”

Through Kelley, Simmons arranged a July 28 field trip for Chamber members and city and county officials to visit the Santa Rosa airport and talk to other players in that facility’s resurgence. Simmons said the task force also has reached out to officials at the Redding Airport.

Although Simmons didn’t mention specific strategies the task force intends to explore, Airport Commission member Karl Ory said one of Redding’s successes was establishing a travel bank, in which the travel budgets of local businesses are tallied and presented as incentives to lure airlines.

The Chamber’s Airport Task Force will meet with city and Chico State officials Thursday morning (Aug. 20) to present the information they’ve collected, and to discuss short-term goals. Ory said the Airport Commission and Chico City Council will hold a joint meeting as early as late September to finalize a strategy to move forward.

desist letter she sent to the city of Chico on Aug. 5.

In the 22-page document, Allen alleges five violations of the Ralph M. Brown Act by the Chico City Council, mostly relating to Mark Orme’s appointment to the city manager post on July 1.

“People think I’m complaining about the appointment of Mark Orme—which was legal in a closed session,” she said during a recent interview with the CN&R. “But the fact that they don’t properly put the items on the agenda and they don’t make the announcements after they [take action] is really the problem.

“The process needs to be sound and follow the Constitution.”

The Brown Act was passed by the California Legislature in 1953, largely in response to government officials using secretive meetings guised as “study sessions” or “workshops” to avoid public scrutiny. The law’s intent was to ensure that members of the public have unrestricted access to meetings of public bodies.

This June, California voters reinforced both the Brown Act and the California Public Records Act by approving Proposition 42, a measure requiring that local governments fully comply with those laws.

Right around the time of that vote, the Chico City Council made some high-profile decisions behind closed doors—namely, hiring Orme for a set salary and producing a series of options for the Chico Certified Farmers’ Market on June 3 regarding its longstanding franchise agreement on city-owned property.

Did the council violate the Brown Act? According to La Verne-based attorney Kelly Aviles, an expert on the law, that depends on the details.

The most egregious alleged violation

outlined in Allen’s letter occurred during closed session on July 1, when the council met to discuss

hiring a permanent city manager. If that’s as far as the conversation went, Aviles said, there would be no issue.

“They can go ahead and talk about the appointment of a city manager [in closed session],” she said. “But they cannot discuss compensation.”

Mayor Scott Gruendl sent out a press release on July 2 announcing that the council had appointed Orme to the city’s top position. The release reads: “[The council] made a statement by reducing the city manager’s pay by $9,500, from the $217,000 the former city manager was paid to $207,500.”

To both Allen and Aviles, that suggests compensation was in fact discussed. “If they didn’t talk about it in closed session that day,” Aviles asked, “when did they do it?”

Further, the council should have announced the action taken during that closed session at the council’s regular meeting, Allen maintains.

Instead, City Attorney Vince Ewing announced that the council had voted 4-3 in closed session on a matter concerning the city manager position; what the council voted on and how each member voted was not explained to the public.

Aviles pointed to California government code, section 54957, which reads: “Action taken to

appoint, employ, dismiss, accept the resignation of, or otherwise affect the employment status of a public employee in closed session … shall be reported at the public meeting during which the closed session is held.”

Allen argues the council was in violation again on July 3, when it held a special meeting to approve Orme’s contract. During that meeting, the council realized its mistake. Gruendl explained they received legal advice that an employee contract cannot be approved at a special meeting. The panel went on to discuss only whether to hire Orme.

Further back, during a closed session held on June 3 under an agenda item labeled “anticipated litigation,” the council produced a series of options for the Saturday farmers’ market, which Allen says contained “content not protected by any exemptions in the Brown Act.” Aviles agreed that the council appeared “to be making policy decisions … in closed session because it happened to relate to a lawsuit.”

On June 5, following that closed session meeting, the city announced via press release that then-Interim City Manager Orme had been authorized by the council to negotiate with farmers’ market representatives.

Starting on Aug. 5, the day Allen submitted her letter, the City Council has 30 days to respond to Allen. After that, she will have 60 days to take the matter to court.

Voice of the ’hoods Residents speak out about plans that affect their environs

eparate issues surrounding some S distinct neighborhoods and their passionate residents dominated a

marathon meeting of the Chico City Council Tuesday evening (Aug. 19). By the end of the gathering that ended just before 11 p.m., the council was able to take substantive action on only one of the controversial agenda items.

First up, the panel tackled an appeal of the city Planning Commission’s decision denying a local recycling company a request for a use permit. That company, Basik Recycling, had for several years been operating out of compliance with the light-manufacturing zone in south Chico’s Barber Neighborhood, creating code enforcement issues related to noise, dust and vibrations. Dylan McFann, the facility’s owner, filed an appeal back in June, following the commission’s decision.

During the public comment portion of the meeting, 15 nearby residents urged the council to deny the appeal. Sienna Orlando Lalaguna, who purchased a home on West 22nd Street a few years ago, detailed the disruptions to her family’s life. She said the neighboring company should take its operations indoors as is called for by its zoning or move to a site where its current activities can be accommodated.

“We’re not asking for them to go out of business,” she said.

“We’re just asking for our neighborhood to be peaceful.”

Jeff Carter, McFann’s attorney, told the panel that the company had already amended its operations so that the only outdoor activities at the property would now involve collecting recyclables from members of the public (as opposed to the commercial processing that required an excavator). He noted that operating as a so-called “clutching facility” is allowed without permitting and that he

believed the property would qualify as such. However, that had yet to be been determined by staff.

As Community Development Director Mark Wolfe explained, the council had two options for denying the use permit. A “standard” denial would call for an immediate halt to nonpermitted operations and prohibit the company from submitting an application for a similar use permit for one year. If the denial comes “without prejudice,” however, Basik could immediately come back with an application.

A motion by Councilman Sean Morgan and seconded by Vice Mayor Mark Sorensen to deny the use permit without prejudice failed on a 2-to-5 vote. Sorensen immediately thereafter made the motion to uphold the Planning Commission’s denial of the use permit. The council then voted 7-0 in support.

The evening’s other neighborhood

controversy involved the Chapman-Mulberry districts, unincorporated “islands” within Chico that the Local Agency Formation Commission has been pressing the city to annex for many years. The issue came to a head last winter, when LAFCo, which oversees annexations, threatened legal action should the city not enter into a binding annexation agreement.

Another issue stems from LAFCo’s position that, under state law, properties that hook up to city sewer should be annexed. According to a staff report, over the years, the city has connected 62 properties to the sewer without annexing them—and without obtaining LAFCo’s authorization or paying its fees.

During Tuesday’s meeting, the council was asked to consider entering into an annexation agreement. According to Wolfe, it would obligate the city to submit an appli-

cation for annexation of the two neighborhoods. It also would resolve the issues surrounding the unauthorized sewer hookups and establish a procedure to handle future extensions.

Here’s the rub: The neighborhoods’ residents, at least the ones who showed up at the meeting, don’t want to be annexed to the city.

Mulberry District resident Donald Cook noted that the city is struggling to pay for police and fire services, and it cannot maintain the roads, so he would rather his property stay in the county. “I can’t really see what I’m going to gain from it,” he said. “I don’t want sidewalks, I don’t want gutters. I like my little island in the county.”

Similar input came from about a dozen others.

Former Butte County Supervisor Jane Dolan, who represented the neighborhoods for more than 30 years and served for many years on LAFCo, also weighed in on the issue. Dolan charged that the residents, “not a bureaucratic selfselected committee,” should be able to decide whether their neighborhood was annexed. “That is an allowed process of LAFCo,” she said. “This annexation disenfranchises the community and ignores their right under due process to learn, discuss and decide.”

After further discussion from the dais, the council voted 7-0 to table the item until such time that the panel could determine the potential impacts of the agreement and all property owners were notified of the potential for annexation.

“We’re really into kind of the community momentum with planting,” Mharia said, noting that a late-spring planting party brought out eight people. Several others, including four teenagers and another couple, regularly help out, cultivating their rows for their own pantries and gaining farming skills. “It isn’t about growing food; it’s about growing life, everything working together to make [life] more complete,” Mharia said.

“It’s not about me,” Baba added. “It’s about the land.” Ω

“This [machete] here is what the older guys use. My grandfather always had this one,” Baba said, explaining that he learned how to farm while growing up in Jamaica.

He pointed to the curled edge that gives the machete its name as he chopped at a purslane. “You can just aerate right around the plant.”

Nearby, his wife and co-farmer, Mharia Ross-Walcott, surveyed the crops, including celery, tomatoes and squash, in the couple’s newly leased 1-acre plot off the Midway in south Chico, adjacent to Butte Creek. This is one of three plots—2.5 acres total—they cultivate as F.R.E.S.H. Farm, which stands for Fine Real Edibles Sow Happiness and is certified organic. They also run a tiny greenhouse, root cellar and kitchen garden in their backyard.

The duo are now in full-harvest mode, delivering bell peppers, melons, eggplant and winter squashes like Kabocha and Blue Hubbard to local stores including Chico Natural Foods Cooperative and S&S Organic Produce and Natural Foods.

While things are looking green these days, they haven’t always been that way.

After five years tilling the soil at a previous location, they were abruptly asked to leave.

F.R.E.S.H. first broke soil on this south Chico plot in March. “We had an acre at the Grace Light Hindu Temple, which was awesome. But then, suddenly, we heard they were in foreclosure, and that there was a fast short sale going on, and then it was sold to a church group who asked us to leave,” said Mharia. Her farming experience started in the late 1970s, when she was a young member of a farming group, living cooperatively on the Trinity River.

“And so, all the investment of five years, in building that soil and everything,” she snapped her fingers, “within 30 days, we were out of there.”

The move disrupted production and funneled their time and energy away from farming their other two plots of leased land, both north of Chico. A caravan of friends and supporters helped move their shed and its contents to their new location. Their fruit orchard was left behind, and has since been leveled, Mharia said. Now, they are starting anew, building up the land and learning about their new plot—its soil, weeds, wildlife. They signed a year-to-year lease to start. “We’re just kind of feeling it out,” Mharia admitted. But, so far, they are “very happy with the soil and the location,” Baba said, nodding his head in the August sun.

another. Both Baba and Mharia hold down full-time jobs in addition to farming; Baba is a custodian and Mharia is a teacher. That’s in line with most of America’s farming families, where 91 percent have at least one member working off the farm, according a 2013 poll by the USDA Economic Research Service. Additionally troublesome for small farmers is the inability to charge enough to make a living wage, as Americans spend the smallest percentage of their income on food in the developed world—just 6.6 percent.

These hurdles, Baba says, are just part of the life of a farmer. In mid-summer, despite their location just feet from Butte Creek, their 80-foot well dried up. Many farming neighbors, mostly fruit and nut growers, had already dug deeper wells in the spring, anticipating the dry season, said Wareke Buroz, who lives adjacent to the plot the RossWalcotts are farming. Their new well, dug at the end of June, is 300 feet deep.

“You know, farming—if it’s not the water, it’s the birds, or the gophers ... there’s always something,” Baba said.

Getting down with Midtown

Is she the It Girl ?

During her study-abroad trip in Spain in 2012, then-Chico State student and Williams native Jennifer Franco began reconsidering the traditional “corporate” world that awaited her after graduation.

Dreaming of working in the entertainment industry instead, she searched online and found America’s It Girl, a new televised modeling competition for women produced by cable channel WEtv. After an application process and interview in Beverly Hills, Jennifer garnered a spot in the competition, among 200 other women from the West Coast.

For the past year, she’s attended It Girl filming events in San Francisco and Los Angeles, while finishing her double major in business administration and health sciences in Chico. Next week, the recent grad will make her way back to L.A. for the final round of competitions, and possible title of “It Girl,” with prizes that include cash, a modeling contract and a scholarship to acting school.

How did you feel going into the audition?

It was exciting. I wasn’t too sure what to expect, so I went in with an open mind. The judges asked me why I wanted to be a part of it and I told them because it was a new experience and opportunity to make a brand for myself.

There will be an interview round, and then modeling our gowns that were designed for us. Then they’ll turn all of that into a 12-episode series that’ll premiere later this fall.

Do you have any performing experience?

I’ve never been on TV, I’ve never done a pageant ... I’ve never really performed for people. It’s all new and exciting, and I’m scared!

[Laughs] There are some girls in the competition who have a lot of experience and connections in L.A. So it’s tough, but I’m not letting it hold me back. The show’s brand new, too, so they’re still figuring it out as they go.

Tell me a little about the format of the show.

Your nickname for the competition is Miss Chico. Did you get to choose that?

I’ve been involved in the competition for a year. Since then, there

represented a business or a hobby or a town. There’s a girl who’s Miss Army, there’s a Miss Hollywoodland. I chose Miss Chico, because I’ve lived here the last five years; it’s where I’ve done most of my community service.

It’s become a big part of me. I like the way that this community is so close-knit and involved.

What do you want to do with the title?

Getting that scholarship to acting school would be great, because becoming an actress is my next goal. Aside from the prizes, I’d hope to use my title to give back and inspire people, especially women, that coming from a small town shouldn’t hold you back.

Going into this competition, the creators said it wasn’t just about beauty, looks and fashion ... they want us to be actively involved in our communities. I was before the competition and want to continue to afterward.

After the revitalization of the block where Nantucket Home and Tin Roof Bakery sit, I heard a few people start referring to that general area as SoPO, as in south of the post office. For me, it never really stuck. It’s cute, but I just can’t commit it to my vocabulary for some reason or another.

Yet, there’s a new landmark designation being coined in Chico, and it’s one that I’m certain will creep its way into my conversations more frequently. Carolyn and Brian Kanabrocki recently opened a new restaurant and coffee shop called Midtown Local in the old Café Flo space on East Sixth Street. The business name is more than a moniker—it’s actually a great description of the neighborhood they moved into, which is why the Kanabrockis chose it.

Brian noted that the eatery isn’t quite downtown and rests in an eclectic neighborhood that he describes as a “melting pot.” There is a tech business across the street, homes next door on one side, The Pageant art-house movie theater on the other, and a general mix of students, renters, homeowners, young professionals and businesses within a stone’s throw of the restaurant. It really is a unique pocket of Chico, and one that deserves a distinctive descriptor. I’m surprised no one has thought of it before (if they have, I’d never heard it used).

The success of the restaurant certainly will help bring popularity to the term, and I think the Kanabrockis have what it takes to get people talking about both Midtown and Midtown Local. The couple run The Handle Bar and are leveraging the success of the east Chico craft brew hotspot for their new venture.

Midtown Local has a broader menu, serving up breakfast, lunch and dinner, in addition to a full offering of coffee and espresso drinks. Pizzas named after prominent Chico places are one of the menu’s highlights, and you can enjoy any entree with beer or wine. The menu includes a vegan pizza, with plans to offer a gluten-free pie in the future. The coffee is roasted in California, by a small San Rafael company called Equator.

The space is clean and bright and pictures of Chico landmarks line the walls, a nod to Carolyn’s deep Chico roots, which go back generations.

After chatting with the couple, I ordered a Midtown Specialty, a Chailike drink that’s made with espresso. It was a tasty mid-morning pickme-up, both functional and flavorful, and will bring me back to try to the rest of the menu.

The couple are “quietly opening,” as Brian described it, and are now open Monday through Saturday from 7 a.m. to a flexible 7 p.m. close and Sundays from 9 a.m. to 7 p.m. A great perk for customers is the free onstreet parking. And you can sit at the front of the restaurant and take in the neighborhood—one that has a character worthy of its new description.

AUDITING THE MEDI-CAL MESS

A state legislative committee recently ordered an audit to gauge whether California is providing Medi-Cal beneficiaries adequate access to care.

About 20 percent of California’s residents— more than 7 million people—are currently on a Medi-Cal managed care plan, and there’s a backlog of 400,000 pending applications, according to California Healthline. However, continual cuts to reimbursement rates for health care providers have limited the number of Medi-Cal patients physicians are able to accept, leading to health care access issues statewide.

State Sen. Ricardo Lara (D-Bell Gardens) requested the audit after his office received “several alarming reports” about Medi-Cal beneficiaries’ difficulty accessing care.

Specifically, the audit will look into whether the program’s managed care directories include a sufficient number of physicians who are accepting new patients.

RURAL AMERICA ON FOOD STAMPS

People who live where most of America’s food is produced—rural areas—rely the most on food stamps, a new report finds.

To compile the report, Jon Bailey of the Center for Rural Affairs examined the use of food stamps, now called SNAP benefits, in the U.S. from 2008 to 2012, according to Public News Service. Bailey found that 14 percent of rural households received food benefits, compared to 11 percent of urban households.

The report also noted that, during the same time period, about 1 in 9 rural households included SNAP recipients who were younger than 18 or older than 60.

“SNAP is providing a way for those people and those households to meet their food needs, which is important,” said Bailey, “because those two population groups are probably most at risk of hunger and food insecurity.”

THE WEIGHT-CANCER LINK

The risk of developing 10 of the most common forms of cancer is greater for overweight or obese individuals, a study finds.

Scientists from the London School of Hygiene & Tropical Medicine gathered information on 5 million residents of the UK, tracking changes in their health over a period of seven years, according to BBC News.

The researchers found that every 28 to 35 pounds of extra weight was linearly linked to increased risk of cancer of the uterus, gallbladder, kidney, cervix and thyroid, as well as leukemia, while four other forms—cancer of the liver, colon and ovaries and post-menopausal breast cancer— also were more likely but were influenced by other factors, such as menopause.

The researchers also noted that a higher body mass index appeared unrelated to some forms of cancer, including prostate.

Emergencies readdressed Enloe prepares to open bigger, better ER by

he Emergency Department at Enloe Tadditional Medical Center has long needed some elbow room. It sees 50,000

patients a year—an average of 137 a day— in a space that’s morphed over time as demand has multiplied.

Curtains, not walls, separate beds.

Quarters can be cramped. And certain fundamental tests, such as X-rays and CT scans, require patients to take gurney rides to other wards.

All of that is set to change Monday (Aug. 25). Upon final regulatory approval, which was pending at CN&R press time, Enloe will open a bigger, better ER and usher in an advanced era of emergency medicine in Chico.

“This is very significant for us,” said Stacy Vincent, nurse manager of the Emergency Department. “Since the Emergency Department started in 1981, we’ve definitely outgrown our precious space, and we’re definitely looking forward to this expansion so we can care for patients in our community in a beautiful, large, comfortable setting.”

That setting encompasses 18,000 square feet, which is 8,000 square feet larger than the existing Emergency Department and more than double the size of the hospital’s first ER. Upgrades include a two-bay trauma room with an overhead digital X-ray

machine; five resuscitation suites; 25 private patient rooms; two behavioral health rooms; decontamination shower room; negative-airflow isolation rooms; a dedicated X-ray machine and 128-slice CT scanner.

The facility will grow even larger next summer after the second phase of the expansion transforms the existing Emergency Department and other hospital space to accommodate 13 more rooms. When complete, the complex will comprise nearly 25,000 square feet.

Dr. Michael Fraters is especially excited. As a boy, he often came to Enloe with his father, Dr. Terrence Fraters, who helped launch emergency medicine in Chico as well as design the hospital’s inaugural ER. Mike Fraters is now a physician there.

The present iteration differs from the original, evolving to handle growth spurts.

Currently, he explained, “the charge nurses really have to act like air-traffic controllers, trying to keep beds open for sick patients who may come in at any time.

“It’s always been a real challenge, juggling all these different patients and where they can go in the department, but with the new department being more uniform [in design], I think that will be less of an issue.

The new department is really going to open things up.”

The new ER’s entrance is a déjà vu of sorts.

HEALTHLINES gency patients to another entry point. The new building fronts Fifth Avenue with a covered entry dedicated to car and foot traffic, separate from the approach for ambulances.

Upon entering the lobby, patients and whoever accompanies them will meet immediately with a health care professional. This marks a major change: In the current ER, a patient-access representative makes the first greeting, but now someone with medical training—such as a medic—will assess the situation.

In addition, department personnel will be able to start visits, where appropriate, and even perform tests such as blood draws or X-rays before the patient sees the doctor.

“It’s really going to improve the flow for the staff to take care of the patients,” said Connie Rowe, Enloe’s vice president of nursing.

Rather than get treated in a confined space encircled by a curtain, each patient will be in a private room, where family members can stay with them. The five resuscitation suites are large enough to accommodate nine medical professionals and the pieces of equipment needed to revive a comatose person. The trauma room is roughly twice the size of a standard operating room and can handle two critical patients at once—neither of whom needs to leave in order for doctors to get X-rays, thanks to the overhead-mounted scanner.

should I go to the ER?” Certain maladies cry out for immediate attention, but the waiting room fills up with emergencies and nonemergencies alike.

“We can see anything from a hangnail to a cardiac arrest,” Fraters said. “The ER in some ways has become less of a place for emergencies and more of a place for, ‘I need this done in a hurry and I want it taken care of,’ regardless if it’s life-threatening or not.”

The shortage of primary-care physicians contributes to the ER burden. Chico and surrounding communities do have urgent care centers that offer same-day care; consider calling or visiting a clinic when the need isn’t dire.

However, Vincent added, “anytime anyone feels like they need immediate attention, and their primary-care doctor isn’t available or a prompt-care-type clinic isn’t open, we want them to come to the Emergency Department and be evaluated.”

Enloe will not—and cannot, by law—turn anyone away from the ER. “Chico’s getting bigger and bigger,” Fraters said, “and we’re seeing more volume from a lot of the outlying areas. I think we still do a pretty good job … but with the new department, it’s only going to be more efficient, and I think it’ll be really good. This has been a long time coming.” Ω

Will the Wildcat Store’s new corporate management prioritize students or profits?

hen students walk into the Chico State Wildcat Store this fall, they’ll see the university’s name in black, white and red adorning crew necks, hoodies and V-necks. They’ll catch sight of Willie the Wildcat snarling between the words “Wildcat Mom” and “Wildcat Dad” on gray T-shirts. Rows of multicolored textbooks will peer from shelves, waiting to be skimmed and highlighted.

Besides a few rearranged displays, the campus bookstore looks just the way students left it last semester. In May, however, the Chico State Associated Students signed a five-year agreement to contract out management of the campus bookstore to Follett Corp., a private educational retail and wholesale company based in Illinois.

“The interest of the store is to provide a resource and support for campus,” Foisy said. “Right now, our big focus is that our books are on the shelves, we’re ready for back to school [and] we’re ready for students and faculty.”

So far, it appears Follett has made only slight changes at the Wildcat Store, things that likely will not concern students. However, some people warn that such a change in management serves as a harbinger for a gradual shift away from a store that prioritizes the students and campus to one that puts profits first.

When that happened, Morrow decided to offer students an alternative bookstore. He left The Bookie and immediately went to work to open and manage the independently operated Crimson & Gray in Pullman, Wash.

“Just like the Chico State bookstore, The Bookie at WSU was all about serving students. Every decision we made was in the best [interest of] the students,” he said.

“Once they turned it over to Barnes & Noble, that wasn’t the priority. And I didn’t want to work for a company whose priority was profit-driven.”

Though Crimson & Gray is owned by the corporation Nebraska Book Co., marketing, pricing and advertising decisions are made in the store, rather than where the corporation’s centralized buying occurs, he said.

When Barnes & Noble came on the scene, many changes occurred that negatively affected the campus, he said. The Bookie went through a large turnover of staff. Some employees were let go while others were

demoted once their positions were eliminated under new management, he said, noting that people who worked in accounting and advertising found themselves at the espresso bar and doing janitorial work.

Retail prices also increased. Though The Bookie maintained a 10 percent textbook discount after the change in management, retail prices of select items, such as textbook bundles and custom-published books, immediately went up by 5 percent to 10 percent, Morrow said. Prices of merchandise also increased. Additionally, local products and services were no longer offered in the store.

This, however, doesn’t appear to be the case at the Wildcat Store. At least not yet.

Follett is offering the campus bookstore a robust rental program: The title count for rentals at the bookstore has doubled, and e-books also will be provided for rental and purchase for certain courses, Foisy said. This is one of the ways Follett can offer students lower textbook prices.

Follett also can pull from its large inventory of new and used textbooks available for

rent or purchase. If a book isn’t in stock at the Wildcat Store, students can order online and have it shipped from one of Follett’s many other college-managed stores, Foisy said.

This also comes in handy when students want to sell back their textbooks—if the Wildcat Store doesn’t need the book, Follett can try to sell it to one of its other campus stores.

Follett also has offered new positions to all of the store’s A.S. management and student employees, said A.S. President Taylor Herren.

Employee retention was an important part of the contract she created with David Buckley, executive director of the A.S. “Everyone will still see their friends working here,” Foisy added.

But Morrow warned that decisions by large companies that contract with universities are driven by the bottom line.

“There are contract-managed stores that run really well. But they will never be able to get a store to the level of excellence that an independent can do it. And the reason is, independents are focused primarily on their campus and their students,” he said. “And

that is not the way that a contract-managed store is run. They put profit ahead of service.”

A Follett insider who spoke with CN&R on the condition of anonymity said that there is nothing unique or different about any of the individual campus bookstores under that corporation’s management, the source said.

“The things they say about innovation— for instance, their websites or their point-ofsale systems, are not state-of-the-art, even if they claim they are,” the insider said, pointing out that merchandise, such as universitybranded products, is the same at other colleges save for a logo and school name.

Morrow warns that the directors of corporately managed stores may not have very much influence over decisions made at headquarters. And students may grow tired of having to choose from the same sweatshirts and merchandise offered at all Follett stores.

student union. It’s supposed to be a service for students,” Herren said.

“We need to make sure that we’re selling [local] products … that we’re selling merchandise that people want, we’re having good relationships with faculty … [and] that student employees are happy.”

Follett is contractually required to sell certain local products at the bookstore, and Foisy said the company is committed to maintaining those ties. The Wildcat Store’s current offerings include products from University Farm, ChicoBag and Klean Kanteen, and students will still be able to grab a doughnut from Helen’s Donut Nook, a sandwich from A.S. Dining or food produced by the College of Agriculture’s Meats Lab at the convenience store within the Wildcat Store.

“Chico seems to be big on local, so it’s definitely something we want to do,” Foisy said. “We want to maintain that.”

The Wildcat Store’s rewards program, in which students received points for making purchases that could later be turned into gift cards for the store, has been discontinued, but the store will offer periodic sales and promotions, Foisy said. Students will notice some new merchandise as well, such as clothing from Columbia Sportswear, and Bliss and Philosophy skincare products.

Students familiar with the campus bookstore before the shift may notice some subtle differences that come with the change in management, the Follett insider said. The changes at the Wildcat Store could be positive or negative.

“Are the lines shorter or longer during the back-to-school parade?

Are the numbers of used books available more or fewer since the transition? Is it easier or more difficult to order online since the transition?” the source asked, rhetorically. “Those are the kind of things [in which] a customer who was a previous customer of the Wildcat Store might see a difference.”

Though these agreements can be surrounded by uncertainty, the organization’s leadership did not have any other options if they wanted to offer students more affordable prices and services, said Herren, the A.S. president.

gling self-operating bookstore because of rising textbook prices and competition from online retailers, Herren noted.

“The Wildcat Store, for the past couple of years, has been losing money,” she said. “We have experienced huge losses in the area of textbook sales, which is our largest revenue generator.”

Buckley, the executive director, said that last semester’s business projections predicted a loss in sales that nearly doubled every subsequent year. In three years, the store would have lost close to $900,000 if it remained self-operated.

received these projections and examined its business model and capabilities, Herren added, the question wasn’t whether to lease, but which company to choose. There was no way that the board would fund the store with student fees, which pay for students to be a part of the A.S. union and do not fund its forprofit businesses, like the Wildcat Store.

Even after decreasing expenses by reducing the number of employees at the store, Buckley said, the business wasn’t able to sustain itself.

When it came time to lease, a committee composed of Herren and other A.S. employees and student representatives, reviewed proposals from two corporate giants: Follett and Barnes & Noble College.

“It was about who was going to be better for us to lease to and who was going to offer a better service to campus,” Herren said. “And it was definitely Follett.”

Follett’s wealth of information and the resources behind it as a corporation that operates so many campus stores will make a huge difference when it comes to being able to offer students lower prices on textbooks, Buckley said.

“One advantage of going with Follett has to do with basically the buying power, in essence, that they have,” he said. “And the investment they already have in the digital marketplace, rentals, online sales, those kinds of things, will definitely benefit students.”

Follett also offered a 16.6 percent commission of store revenue to the A.S. That money can go to supporting programs and activities for all students, Herren said.

Though the Wildcat Store’s change in man-

agement appears to be beneficial, Morrow remains skeptical. He thinks the partnership with Follett is currently in its “honeymoon period.”

“Follett’s going to come in and they’re going to start running things and it’s going to look OK,” Mor-

row said. “But over time, Follett’s going to make changes. They’re going to increase prices and change personnel, and it’s going to be like the frog in boiling water. And the university won’t know what to do.”

It remains to be seen whether that is too strong of an analogy to describe the potential changes that the Wildcat Store could see. Follett’s contract with the A.S. began on July 1.

For now, according to Herren, Foisy and Buckley, all student and most management employees have retained their positions, more textbooks are offered as rentals and e-books to cut costs for students, and local products and familiar brands are still a big part of the store.

“I’ve been very impressed with Follett and the way they’ve come in and wanted to work with us and wanted to maintain the relationships we have with local vendors,” Buckley added. “Honestly, I feel really good about them coming in.”

Change isn’t ever easy; it is frustrating and upsetting that the A.S. wasn’t able to continue managing the Wildcat Store and having direct-control ownership, Herren said. But no matter how unsettling change can be, it wouldn’t do students any good for the A.S. to continue managing the Wildcat Store at a financial detriment to the A.S. and the students, she continued. “[The decision to lease] was really made out of necessity to protect students and their dollars,” Herren said. “I hope and I really believe it’s going to be a substantially better service for students.” Ω

Chico State senior Sulie Garcia knows what happens when you put off buying textbooks: It’s either wait for an online retailer to deliver the books two to four weeks into the semester (good luck on those homework assignments) or fork over an extra $100 to buy a new book because that’s all the campus bookstore has left. That’s how she ended up spending roughly $200 on a business textbook.

Garcia, who’s double majoring in business project management and Asian studies, is just one of many students who have experienced textbook woes. She paid nearly $600 for the required books during one semester alone.

Eric Hassel, a junior studying environmental science, said he is often strapped for cash when the semester begins.

“I would definitely say there’s a little bit of stress related to it,” Hassel said. “It seems like every 4 1/2, five months, when the new semester rolls around, I’m always kind of scrambling to get finances together to fund all of my textbooks.”

And Hassel isn’t alone. Students across the U.S. have experienced steadily climbing prices for over a decade. According to a report released last summer by the Government Accountability Office, new textbook prices rose 82 percent between 2002 and 2013, increasing at an average of 6 percent a year.

As a result of the rising prices, some students are not purchasing required course materials, even if they are worried it will affect class performance. According to a U.S. Public Interest Research Group study published last fall, 65 percent of students have opted to not buy a textbook because it was too expensive, even though 94 percent were concerned it would harm their grade.

Students have become savvier textbook-buyers to combat the markups. Here are a few tips to save money: • Shop early: Garcia suggests searching for course materials as soon as possible to find the best deals. “Once you have availability to find out what books you need for your classes, start checking prices then,” she said. “Don’t put it off, because then there’s only the newbook options, which are more expensive than used.”

• Do a price-check: Garcia and Hassel suggest comparing your campus bookstore’s prices to online retailers like Amazon or Half.com.

“I just search for the best-priced book, whether it be renting and/or buying,” Hassel added. “If it’s in decent condition, but it’s used, as long as I can save money I’m always willing to shop around.”

• Consider renting: This can be a cheaper option for students who can return books on time and won’t end up drenching them in latenight study-sesh coffee—bookstores reserve the right to charge full price if the rental is damaged. Hassel suggests Chegg, a Santa Clara-based company that specializes in rentals (and even sends along a free Red Bull with larger orders).

• Go digital: E-textbooks can be considerably cheaper than physical textbooks and are also available to rent and purchase. The Wildcat Store now features e-books through BryteWave, a digital textbook program created by Follett, which offers nearly 100,000 titles.

Merna said she starts planning the variety show each year in February. Performers this year include hula hoopist Meg Amor, a half-dozen local drag kings, musicians and dance troupes. And, of course, there will be plenty of drag queens on stage at the kickoff—14 to be exact, including several members of the Imperial Sovereign Court of the Czaristic Dynasty (ISCCD) of Chico, the local chapter of a nationwide nonprofit organization focused on equality. (Merna said she got her start dressing and performing with the local ISCCD 13 years ago.) Among the cadre of queens performing will be Jessica Wild, a reality television celebrity from RuPaul’s Drag Race.

A highlight of the annual variety show, Merna said, is a fashion show portion where all of the performers are invited to strut down a catwalk.

Merna is also in charge of organizing entertainment at the weekend’s central event, Saturday’s Pride Festival at the downtown City Plaza. At that event, speeches by city officials, including Chico’s first openly gay mayor, Scott Gruendl, and other LGBTQ activists will be interspersed with dancers (Full Force Dance Company and the Chico Diamond Dancers), DJs and more drag.

In an effort to protect the Merna mystique, she requested her alter-identity not be included in print, but described her stage persona as “everything I was raised not to be.

“The main point of Merna is just to make people smile and laugh, and I know they’re laughing with me and not at me,” she said. “I know there’s some people who don’t smile and laugh at [drag], who don’t enjoy it at all, and that’s OK—to each their own.

“On the other hand, it’s 2014, people, you need to get with it. Fortunately, most people in Chico already have.” Ω

Chef

There’s much else on his film’s menu, but writer/director/star John Favreau is unmistakably the presiding spirit at the heart of this rollicking crowd-pleaser.

Favreau plays Carl Casper, a Florida-based chef and gourmand given to robust tastes and adventurous cuisine. He’s also trying to be more of a father to young Percy (Emjay Anthony), who lives mostly with Carl’s exwife, Inez (Sofía Vergara). Renewed attention to family responsibilities becomes even more complicated when Carl has a falling out with the restaurant owner (Dustin Hoffman) who bankrolls his culinary endeavors. With a little help from a friendly assortment of old pals and former associates, Carl rebounds from these setbacks by setting up business in a refurbished food truck and taking it on the road, heading west from Florida, with Percy and longtime sidekick Martin (John Leguizamo) on board as his crew. There’s an amiable sort of predictability to most of this, and it may be only the prevailing spirit of rambunctious camaraderie that holds the story and its characters together. Pageant Theatre. Guardians of the Galaxy

If someone was gonna make a swell comic-book movie despite the aggressively calculating influence of both Disney and Marvel it would be writer/director James Gunn. And yep, he did it. Gunn was writer of the better-than-the-original remake of Dawn of the Dead and he’s been a filmmaker to keep an eye on since graduating the Troma School of low-budget filmmaking, and writing, producing and starring in The Spe-

cials, one of the first deconstructionist swipes at superheroes. The story here: Charming half-human/half-alien rogue Peter Quill (Chris Pratt) steals a MacGuffin and teams up with a band of misfits—including a foul-tempered talking raccoon and a sentient tree (voiced by Bradley Cooper and Vin Diesel, respectively)—to avert the destruction of the galaxy from some intergalactic dude. It’s kind of shambolic, but in a good way, and easily the most entertaining movie of the year, a delirious romp through the CGI cosmos. Gunn isn’t shy about wearing his influences on his sleeve, evoking the best aspects of the original Star Wars, Joss Whedon’s Firefly and all sorts of other fun stuff.

The Hundred-Foot Journey

The cinematic meal served here is tasty but not very filling. There is some real appeal, however, in the basic setup. A refugee family of Indian restaurateurs, the Kadams, moves into a picturesque French village and opens up Maison Mumbai, a grand-looking Indian restaurant, just across the road from a Michelin-rated French restaurant, Le Saule Pleureur, run by the snooty Mme. Mallory (Helen Mirren). A mildly impassioned rivalry develops between the two establishments, and between the two proprietors, the widowed Papa Kadam (an ebullient Om Puri) and Mme. Mallory, herself a widow. And there are other complications of note. Hassan (Manish Dayal), the eldest of the Kadam sons and a chef of special gifts, gets involved—romantically, professionally and otherwise—with Marguerite (Charlotte Le Bon), a comely sous chef working for Mme. Mallory. But The Hundred-Foot Journey means above all to offer up a pleasant array of good feelings. It does that often enough that the presold audience for which it was made is not going to worry too much about the childish simplicity of the characterizations or the dull predictability of emotional scenes. Jake Johnson and Damon Wayans Jr. (both of New Girl) star in a buddy comedy about two dudes whose lives get out of hand when their bright idea of wearing cop uniforms in public draws them into more dangerous and wacky scenarios than they planned for. Cinemark 14, Feather River Cinemas and Paradise Cinema 7. Rated R.

Lucy

One way to watch this film is as the third section of an unofficial but weirdly beguiling Scarlett Johansson trilogy. She was the seductive voice of an operating system in Her and the fatally attractive human body assumed by a homicidal alien in Under the Skin. And now she’s a mind-blowing super-powered warrior woman in Luc Besson’s latest action fantasy. Besson’s script has Johansson’s Lucy as the unwitting recipient of an experimental drug that endows her with unimagined mental powers.

She becomes the radically dynamic embodiment of the theories of a scientist (Morgan Freeman) who speculates authoritatively about what would happen should human beings start activating more than 10 percent of their brains’ capacity. In Besson’s hands, this becomes a flamboyantly pulpy mixture of trippy special effects, sub-Asian gunplay farce, and some facetiously cinematic pantheism. Oddball humor, some reflections on the future of human emotion, and Johansson’s vivid deadpan performance help ensure some lively entertainment amid the obvious silliness. Cinemark 14. They are quite easily the best of their kind in Chico.

My burrito consumption at the diner has become so habitual over the past couple years, I get the shakes if I go too long without one. OK, it’s not that bad, but when I ★★★★★ EPIC go, I don’t have to look at a menu anymore.

I start with the Basic Burrito ($5.25) and ★★★★ AUTHORITATIVE usually add black olives, bell peppers and ham: total bliss. Each addition—from ★★★ APPEALING tomatoes, jalapeños and mushrooms to sausage, bacon, chorizo and more—is 75 ★★ HAS MOMENTS cents ($1.25 for avocado). You also can ★ order the Buzz Burrito, which comes with FLAWED tomatoes, avocado and sour cream in addi-

tion to everything on the Basic for $6.95.

On Tuesdays, the Buzz offers a two-for-one breakfast burrito deal. Since the prospect of eating two burritos in one sitting is a hefty proposition, you’re left with two options—recruit a friend interested in a half-priced burrito, or stash the extra one for later, like a squirrel with an acorn. (I’ve found storing an entire burrito in my cheek to be uncomfortable, so I put it in the fridge where it keeps much better.) And if that isn’t enough burrito for your dollar, pick up a stamp card. Buy 10 burritos, and No. 11 is free!

For the sake of balancing out my Buzz experience, I broke from tradition on a recent visit and ordered a Denver Omelette ($7.95, with ham, bell peppers, onions and cheese).

With the side of home-fried potatoes that came with it, the meal was more colossal than the burrito. About halfway through, I realized that, with my add-on of black olives (75 cents), I’d basically ordered my favorite burrito combination—minus the tortilla, plus toast.

Who was I kidding? Not my subconscious, apparently.

While I have been devoted to breakfast and the burritos, I must point out that the Buzz does have more options. In addition to breakfast/brunch fare, the restaurant’s menu features lunch versions of the style of diner comfort food offered for breakfast. Also offered are burgers made with 1/3 pound of Angus beef ($6.50) and a selection of hot and cold sandwiches—from the BLT ($6.95) to The Bidwell ($7.95), featuring roast beef, grilled onions, Ortega chili and ranch dressing—all of which include a choice of french fries or pasta, potato or dinner salad.

And even though shouting over a latemorning party isn’t my glass of bubbly, if you’re into listening to coeds loudly discuss the previous night’s hookups, the champagne brunch might be for you. And, at $8.50, it’s a cheap way to treat that lingering hangover. Ω

Mathrole, 42, had initially applied in March to do a couples episode of Wipeout with his wife, Sheila. Minutes after sending his online application, the show’s casting department called him to say they were instead filling slots for an episode featuring teams of co-workers. So, he texted Saldano.

“I thought he was just messing with me,” said the 25-year-old Saldano. “After I realized he was serious, I said, ‘Yeah, I’m down for an adventure.’”

Mathrole and Saldano would seem perfectly suited for Wipeout. As co-workers, the partners rely heavily on each other in a physically and mentally demanding work environment. Plus, they’re really affable and fun guys, often complementing their easy-going personalities with a sort of gallows humor that many in the emergency professions possess.

Before being considered for the show, though, they had to show up at the studio for an in-person interview. After surviving the high-energy meeting—part of which required them to memorize outrageous answers to questions and pretend they were the most amazing questions they’d ever been asked—they were told they’d be notified of their fate in anywhere between seven and 60 days. A month and a half later they were told they were chosen.

They were also told they were on their own for travel expenses. So, the enterprising pair decided to have some fun and do a crowdfunding campaign to help pay for the trip (which ended up being two trips

for two tapings). They chose Booster.com, where the user designs a shirt and gets profits from the sales of it for their cause. Mathrole put together a shirt featuring the silhouette of a man falling off a red cross, with the words “Wipeout Support Team” on the front, and “Go hard!! Get wet!!” on the back.

“A buzz started at Enloe,” Mathrole recalled. “Doctors and nurses in the emergency room, co-workers in the ambulance department, Chico Fire, Chico PD, friends, family.”

Overall, 125 shirts were sold.

“I never expected anyone to help us out,” Saldano said. “But when it comes to getting your butt kicked, everyone wants to see it.”

Per their contracts, they have to keep mum about their episode, which airs Sunday, Aug. 24, at 7 p.m.

They stand to receive up to $50,000 if they win both their episode and the Tournament of Champions.

What they can disclose, however, is how utterly beat up and filthy they got. They were shot at with cannons full of slime, flung through the air like discarded toys and thoroughly coated in the stagnant brown goop that covers the grounds of the course.

“There’s no way to avoid getting blown up. It’s going to happen. And if you want airtime, you have to let it happen,” Saldano said.

“When you watch it at home, you think, ‘You can’t see that?’” Mathrole said about the moving obstacles.

“But your adrenaline’s pumping so fast, and they’re throwing things at you and shooting you with goo— you just want to survive. There’s nothing like it.”

Mathrole and Saldano are throwing a viewing party at The Graduate on Sunday, where their episode will be shown at 6 p.m. (one hour before air time).

They’re also kicking off another fundraising campaign. Those who visit www.booster.com/wipeout fundraiser can purchase one of their Wipeout shirts (or just donate money), and the funds raised will go to both the Ray Head Fund (which provides financial assistance to victims of fires in the Chico area) and the Enloe Foundation.

“Jordan and I have always wanted to raise money,” Mathrole said. “The publicity from Wipeout gives us an opportunity to reach the masses, do something meaningful to us, and help our local community.” Ω

IN THE MIX Our Revolution Rog & Pip Rise Above Records For decades, crate diggers and record labels have uncovered records and artists that’d fallen through the cracks, and rescued them from obscurity. In 2012 British music archeologists Finders Keepers Records (who’ve released many great, lost collections) dug up a load of early1970s, stoned and testosteroned rock from Manchester, England. Earlier this year, Numero Group released the excellent Warfaring Strangers: Darkscorch Canticles, which shed a light into Midwestern garages and their mustachioed, riff-hungry inhabitants. And four decades after “Rog” (Roger Lomas) and “Pip” (Philip Whitcher) released a stack of singles that were heard by next to no one outside of Coventry, England, Rise Above Records has re-released the collection of glammed-out, power-popped, proto-metal nugs under the title Our Revolution. “Rock With Me” shuffles along in the platformed boots of Slade. “Why Do You Treat Me Like That” reeks sweetly of Free.

And the bassline on “Hot Rodder” slithers as sleazily as Gene Simmons’ tongue. If this sounds like your thing, that’s because it is. The feel-good hit of the summer.

Paris: The Novel Edward Rutherfurd Ballantine Books Paris, it’s a riot! This historical novel follows six families in rebellious Paris over the course of 800 years (and more than 800 pages)—from 1261 to 1968. By focusing on the families and their interactions over time (fortunately, there’s a detailed timeline to help keep everyone straight), Edward Rutherfurd presents a very full and perceptive analysis of French society. This, of course, is his modus operandi, with the similarly epic multicharacter works Russka, London, Ireland: Awakening and New York, among others, already under his belt. Paris explores a number of interesting issues over the course of the country’s turbulent history—freedom, rebellion, individualism, family, love, war, art, intrigue and madness—using both real-life and expertly crafted fictional characters together. With so much room to work with, Rutherfurd is able to fully analyze each character and his or her relationships with one another in intimate detail—and not a word strikes false. It’s one of those rare 832-page page turners; so pop open a nice chardonnay, plop a kitty on the lap and settle in.

EllerSoul Records “Long before anyone talked about what’s come to be called roots rock, Americana, indie rock or alt-country,” this fearless foursome were—as their PR puts it—“already playing it.” And now here’s the band, in its fifth decade, still pumping out a mix of those musical forms like there’s no tomorrow. Harp player (and only original member) Mark Wenner shares the vocals with guitarist Paul Bell, bassist Johnny Castle and drummer Mark Stutso, who romp their way through such high-energy roll-up-the-rug-and-dance numbers as “Got a Lot of Livin’” (performed by Elvis Presley in the movie Loving You) and “444 A.M.” They all get down on the Everly Brothers’ “Price of Love” (“it will cost you more when you’re aflame”), especially Bell, whose slide guitar slithers from start to finish and gets solid support from Wenner’s harp and the rhythm section. They have a tradition of doing a Muddy Waters song, although they give his “Louisiana Blues” from 1950 a rather rough ride here. “Livin’ the Blues,” the disc’s other nod to the human condition in 12 bars, tells the story of a disconsolate barfly who’s been burned so bad that he’s still smokin’.

“Crawfish,” from another Elvis movie (King Creole), gets an appropriately swampy treatment that’s enhanced by Wenner’s atmospheric harp. Lotta good music here.

Actually, on second thought, if you’re going to get drunk and do a public performance, there are way more creative things to be done. Couch burning is so 2013, and 2012, and 2008, and ...

What you should do is get drunk and then write a screenplay, and then get drunk again when your screenplay is made into a film. That’s what local theater actress/director Cat Campbell and filmmaker Joshua Siegel did for their soonto-be-premiered short film Dead Drunk.

Inspired by a similarly bent crew of Portlanders who made the 2013 viral short Star Drunk under the same premise, the Chico unit just changed the setting from space to the world of the undead to make the “first zombie movie written and A dead-drunk clown. acted while drunk.”

• The Great Garden Art Weekend, Sept. 6 & 7: A glorious-looking two-day garden party presented at the lovely Magnolia Gift & Garden, where more than 15 local artists will show off their garden art to the sound of local jazz dudes Bogg and the taste of treats (from Mim’s Bakery) and beer and wine for sale.

LOVE’S REAL ESTATE Yard Work You may be able to ignore the knee-high grass in your neighbor’s yard, but a home appraiser probably won’t.

When calculating the value of a property, an appraiser factors in surrounding neighborhood conditions. Neighborhood nuisances like an overgrown yard or a funky smell could bring down the value of adjacent homes by 5 to 10 percent, according to Richard L. Borges II, the president of the Appraisal Institute.

What you call a bad neighbor, the appraisal industry calls “external obsolescence.”

Some problems are not always apparent, like a nasty but quiet neighbor, and they may go unnoticed. But the obvious stuff, like the yard full of rusty cars, or the old motor home parked across the street with weeds growing around its flat tires might be enough to bring down your appraisal value.

The perception of external obsolescence varies by neighborhood. For example, the rusty cars are more likely to be considered a problem in a residential neighborhood than out in the country, where we consider rusty cars part of the natural landscape.

“It’s very much case-by-case,” Borges said. “This is why the appraiser should be geographically competent, with knowledge of how significant the external factors are in that particular market and on that particular property.”

measurable, either. “I’ve never seen a value adjustment because of barking dogs or loud teenagers,” said Borges. An appraiser has to be able to provide some sort of evidence for that adjustment. “The lender requires that we provide them with a comparable property with a similar external obsolescence.”

The external obsolescence that appraisers deal with besides bad neighbors most frequently have to do with proximity to infrastructure— power lines, commuter rails, highways. But often the bad neighbors have tended to be bank foreclosure properties that haven’t been maintained.

Neighborhood nuisances might be solved with help from the local authorities. If those rusty cars aren’t registered, or if chickens and horses are a zoning violation, a phone call might end the problem.

But confrontation can be risky. Some people aren’t worth starting a fight with. If you start it, they’ll never let it die.

An appraiser said, “A customer confided in me how he made peace with his neighbor by buying his neighbor a gift: A year’s worth of yard service.”
