Toward a better ban The citizen activists in the group Frack-Free Butte County, who toiled for

months to gather sufficient signatures to qualify a measure to ban hydraulic fracturing in Butte County, were understandably angry when, on July 29, the Board of Supervisors chose to delay approval.

Instead the board voted 4-1 to have county staff take 30 days to study the initiative to determine whether it might result in costly litigation, harm property values, have a negative impact on existing businesses or fail to prohibit other unwelcome uses of wells.

The decision meant the board couldn’t place the measure on the November ballot before the Aug. 8 deadline. It will appear instead on a 2016 ballot. Supporters were miffed; to them the decision was anti-democratic. (Chicoarea Supervisor Maureen Kirk voted nay, saying she preferred to let the people vote.)

The supervisors were right to be concerned about the citizen measure, however, especially its vulnerability to litigation.

County Counsel Bruce Alpert noted that the ordinance his staff is preparing would have “no confusion or ambiguity about what would be banned or what would be allowed.”

As the CN&R revealed last week (see “Fractured finances,” by Leslie Layton), deep-pocketed oil and natural-gas companies have spent more than $116,000 locally to block the ban. County officials need to bear this in mind as they prepare the new ordinance.

With the exception of the other Chico-area supervisor, Larry Wahl, the board is committed to drafting a strong and clear ordinance. The success of Frack-Free Butte County’s petition drive should harden that determination.

We fully expect county staff to come up with wording that is clearer and stronger than the citizen measure. And we expect them to do it quickly, so that voters will have plenty of time to decide which of the two they prefer. Ω

compassionate and on top of it (so it seemed), since they took as many preemptive measures as they could to help their son.

Typical interventions for “socially awkward” individuals involve talk … talk to the counselor, talk to the parents, talk to the doctor, talk, talk, talk. Find someone the kid can “trust,” then the isolated youth should feel safe and loved, which should propel awkward folks toward acceptance, popularity and sex appeal.

Does anybody ask the question, “What if a person doesn’t know how to talk to someone?” Or how about, “What if, even if I could talk to a person, I have not the slightest idea how to express what I want to say.”

In my opinion, the young man needed the arts. Sometimes talking just doesn’t cut it. I can show you study after study proving that arts participation increases school attendance, keeps people from returning to jail, helps addicts stay sober, gives seniors meaning, and in general triggers a deeper happiness in most, from preschool to nursing homes, from Yale to jail.

People are getting burned out. We need to express ourselves in creative, nonverbal ways.

Let’s make creativity and self-expression available to those who are tired of empty words but who still want help. Ω

Bombing our own guns Now that ISIS suddenly has become such a huge presence in Iraq and Syria,

America’s recent involvement with those countries seems like a surreal nightmare.

As Max Fisher, writing in the online news magazine Vox, points out, the United States is now bombing hundreds of millions of dollars’ worth of high-tech military equipment America provided to the Iraqi military in the decade following the U.S. invasion of Iraq. The reason we gave the Iraqis all that expensive weaponry was, of course, that we had destroyed the weapons they already had.

But the Iraqi army failed, fleeing from ISIS and leaving all those weapons behind for the jihadists to use. Not only did the weapons fail to make Iraq secure, they now are being used by an offshoot of al-Qaida to terrorize the Iraqis that the U.S. ostensibly liberated 11 years ago.

In Syria, America chose not to give weapons to the moderate rebels, fearing they might fall into the hands of ISIS. As Fisher writes, “that made it easier for ISIS to overpower the underfunded moderate rebels, and now ISIS has seized, in Iraq, much better versions of the weapons that we were so worried they might acquire in Syria. So now we’re bombing the guns that we didn’t mean to give ISIS because we didn’t give guns to their enemies because then ISIS might get guns.

“It’s not just ironic,” Fisher concludes. “It’s a symbol of how disastrous the last 15 years of U.S. Iraq policy have been, how circuitous and self-perpetuating the violence, that we are now bombing our own guns. Welcome to American grand strategy in the Middle East.” Ω

Fences and a tree Last week, a new fence went up along the northern edge of Cal Water’s property at First and Orient streets.

That parcel, home of the two iconic raised water tanks, sits adjacent to the CN&R’s office. It’s a pretty little spot with a lot of mature trees and a grassy knoll, and a place where I would sometimes sit and eat lunch, next to a young magnolia.

Over the years, I’ve seen other people enjoying the space, too, including a young guy who regularly practiced juggling. More recently, homeless folks have been hanging out and bedding down there. Probably due to its location directly across from the entrance to Annie’s Glen, this private property had a park-like quality. Not anymore. I called over to Cal Water this week and spoke with Pete Bonacich, the company’s acting district manager. He confirmed my suspicions. The fence went up because, as Bonacich put it, “We had a tremendous amount of problems with vagrants.”

Turns out some of the folks setting up camp there were stealing chairs from the porches of nearby homes and lounging on them on the property. Bonacich said there appeared to be regular drug-dealing at the site, too. After numerous complaints by the neighbors and no response from the police department, the company tried deterrents, such as turning the sprinklers on at varying hours. That didn’t do the job. So, up went the fence and a number of no-trespassing signs. It’ll take some getting used to.

Curiosity killed the tree: On the subject of changes near CN&R HQ, I noticed a few weeks back some greenery growing in the center of the roundabout at Second and Flume. At first I thought it was a weed, but upon further inspection, turns out it’s a sapling—a redwood, I think.

The little sprout of a tree was still alive this week, so I called City Hall to see what the deal is—whether the city or a rogue tree lover planted it. After talking to someone in the engineering department (not planted by them), I ended up speaking with Dan Efseaff, Chico’s parks and natural resources manager, who also didn’t plant it. He had actually seen the sapling earlier in the day while out on a stroll.

Efseaff said he understands the motivation behind the gesture, but that the tree likely isn’t in the right spot.

Moreover, plans for landscaping and an art feature there are in the early stages, he said. In other words, Efseaff will be yanking the young tree. He said I’m not the only person to bring this to his attention, so don’t blame me for ending the plant’s life. Who knows, maybe it will get replanted elsewhere.

Speaking of demises, you’d think these days that the downtown was going to pot. Sure, the area has issues, but I’m down here every day, and I can tell you first-hand that the problems associated with the region are greatly exaggerated. If you don’t believe me, read this week’s cover story by News Editor Tom Gascoyne, who interviewed numerous downtowners, mostly business owners, about the changing face of the city center.

Punished for principles Re “Catching up with Tim DeChristopher” (Cover feature, by Sarah van Gelder, Aug. 7) Tim DeChristopher stood on principle even though it cost him prison time.

I’m a baby boomer and know I bear some responsibility for out-of-control government.

I’m doing my part now to make up for that; however, I don’t believe “climate change” is the most important issue. It is the “justice” and “legal” system. Tim’s description of the judge’s parameters for allowing people on the jury is telling. Juries are supposed to be “the trier of fact and the trier of law,” though most citizens don’t know that. Juries can, by “jury independence” (aka jury nullification), determine whether a law was broken and, more important, whether the law is righteous. They were given that power by the Founding Fathers.

Our so-called justice/legal system is devoid of principle, as practiced today. People who serve on juries need to be educated.

They don’t know the power they can wield as jurors. It is a shame and a crime to allow our current “injustice” system to continue in this manner. In my opinion, we must focus on this as the primary issue. Until we do, fine young men such as Tim, who are standing on principle, will continue to be sent to prison. I urge citizens to discover the “Fully Informed Jury Association.”

Like alcohol, marijuana precludes us from maintaining intelligent conversation that facilitates our making and maintaining friendships with attractive, responsible, intelligent people. Further, like tobacco, marijuana’s bad for our lungs and immune systems, it’s expensive, it stinks, it makes us fat, and it’s a fire hazard. Moreover, as with alcohol, smoking marijuana encourages others to do it and suffer the same ill effects.

Growing marijuana’s also bad for the environment. It encourages people to lay waste to natural areas and to drain and pollute the air and streams. It’s taxing to law-enforcement, health care and the courts.

People need to stop being lazy and learn to overcome their inhibitions naturally instead of turning to alcohol, marijuana and other drugs. If they really need pain relief, they can get cheap prescription medication over the Internet.

Prohibition’s cost Re “An end to prohibition” (Editorial, July 31) and “A flawed punishment” (Editorial, Aug. 7): One things for sure: They’ll never use marijuana to administer the death penalty. If you use too much you’ll just fall asleep.

The War on Drugs (mainly a war on marijuana) is 43 years old.

That’s longer than the Revolutionary War, Civil War, WWI, WWII and the Korean, Vietnam, Kuwait and Iraq wars combined. The criminalization of marijuana has grown a mountain of dead bodies over the fight for money. There is also a mountain range full of broken families, because daddy or mommy got busted and now cannot get a job. The war has cost over $1 trillion-plus. For all the harm criminalization of marijuana has done and is doing, the plant itself has not killed a single person.

I’m afraid to sign this letter.

Sure, the Declaration of Independence says the “pursuit of happiness” is an “inalienable right.” But today, the justice system has over 500,000 Americans behind bars for marijuana. The last 43 years has chewed up tens of millions of lives and I don’t want to be next.

life. He was a one-of-a-kind person who had a history of mania, depression and the accompanying medications. Robin rejected clinical terms and instead chose to see himself in terms of being sad. We will miss Robin Williams’ laughter; he gave us the best medicine.

I can’t help but think and feel this tragedy could have been avoided. I do not know what Robin’s relationship to cannabis was during his life’s journey, but I do know that cannabis is a powerful medicine for overcoming depression. Living in Tiburon, Robin must have had access to medical cannabis. If Robin never used medical cannabis, we’ll probably never know why.

I know so many closet users of medical cannabis who cannot openly and/or legally use because of their social position, occupation and/or family. We need more understanding and less stigmatization.

Robin Williams will always be a shining light in my soul. I would implore anyone out there suffering from depression to try cannabis.

Don’t wait until your last chance.

I take no joy in writing this letter and am reluctant to do so, but feel compelled because of what I consider to be the importance of the subject.

While in Willows the other day, I took time to bike around town and rode by and through the intermediate school. I was impressed by its deplorable appearance, almost as though it was being abandoned. The shrubbery and trees display a lack of care, grass is intruding upon the sidewalk, especially outside the east side of the main building, and I could go on.

I would think the school board and community would want their children, when going to school, to be greeted by a place to be proud of, rather than one that insults their sensibilities. Surely you can do better. One’s environment does make a difference.

He’s got an idea For the budget and our town needing a facelift, this is what I would do if I were the city manager of Chico: I would let go of three of the top-paid firefighters and police officers, which would add up to about $1.2 million. I would then hire for $20,000 a year 40 Chico State graduates who want to stay in Chico for their master’s degrees but cannot afford it. I would place them on bicycles as nonlethal policing pairs. They would help the homeless to the homeless farm and get to know all of the shopkeepers.

The other 20 would work for the fire department as apprentices as well for two years. Now, that would raise the level of education on both and maybe put a nicer face on Chico while saving $400,000.

NATURE CENTER STRUGGLES TO SURVIVE

The Chico Creek Nature Center has once again launched a crowdfunding campaign, this time to compensate for a loss of city funding that could cause the center’s closure next month.

The “Cover the Cuts Campaign” on GoFundMe.com was launched July 25 by CCNC Executive Director Caitlin Reilly, with a description stating the center needs “$10,000

by August 25th to remain open to the public in September and we must raise $60,000 to be able to survive the coming winter.”

A similar crowdfunding effort last September on FundRazr.com netted $755—a quarter of the center’s goal at the time.

The CCNC received no funding from the city of Chico this fiscal year. In 2013-14, the city’s contribution to the center’s operating costs was $35,000, down from $42,500 in 2012-13 (see “Up the creek,” Newslines, Sept. 26, 2013). Before the city’s financial crisis, its annual contribution to the nonprofit CCNC was $65,000.

At press time, the Internet funding campaign had raised about $5,000.

The Chico Certified Farmers’ Market was especially festive last Saturday (Aug. 9) as vendors, market supporters and city officials celebrated the CCFM’s first annual lease payment to the city of Chico.

As onlookers held colorful letters spelling out “Thank you, Chico,” CCFM members presented Mayor Scott Gruendl with an oversized $5,000 check pasted to a large paper carrot.

The 9:30 a.m. ceremony was partly in observation of National Farmers’ Market Week, but the real cause for celebration was the end of the CCFM’s long battle to stay in its downtown location at the corner of Second and Wall streets. After years of contention sparked by vocal downtown business owners who claimed the market negatively impacts parking and commerce in the area, the council voted unanimously June 17 to sign a six-year lease with the CCFM.

The Chico City Clerk’s Office reports that, facing an Aug. 13 deadline, 10 people have shown varying degrees of commitment toward running for the three City Council seats open this fall.

Those who’ve qualified with the required 20 valid signatures of registered voters are incumbents Mayor Scott Gruendl and Vice Mayor Mark Sorensen; along with Andrew Coolidge, who ran two years ago; Rodney Willis, who ran a decade ago; and first-timers Loretta Torres, Forough Molina and Reanette Fillmer.

City Clerk Debbie Presson said other possible candidates—those who’d taken out papers but had not returned them by the CN&R’s deadline—are Lupe Arim-Law, Dave Donnan and Wes Holt. (Donnan posted a message on Fillmer’s Facebook page saying he was not running.) The third incumbent, Councilwoman Mary Goloff, is not seeking reelection.

The deadline to file paperwork was 5 p.m.

Mohr is most known for her role as animal services manager for the city of Chico, and it probably goes without saying that she has a soft spot for animals. During a recent interview in her office at the shelter, as a nervous Chihuahua she’s socializing sat on her lap, Mohr explained her passion for rescuing larger four-legged companions.

More recently, though, Mohr’s focus has been on a complementary plan to open a sanctuary for wild horses. There’s a great need, as the U.S. Fish and Wildlife Service is currently rounding up the herds at the Sheldon National Wildlife Refuge in the northwest corner of Nevada, near the community of Denio on the border of Oregon. Mohr came up with a plan to contract with the federal agency to take in some 70 or so horses, but she hit a major snag in recent weeks when a local private landowner she was going to lease property from backed out at the eleventh hour.

“It was kind of a shock to everyone,” she said.

It’s an understatement to call the loss of that property a setback. Months of preparations are all for naught, including a few thousand dollars that she sunk into an environmental review at the site. But more important, Fish and Wildlife is already well into its efforts gathering the equines. Mohr’s horses were scheduled to be transported to Butte County midSeptember, and since there’s no stopping the federal agency’s timeline for rounding up the animals, she’s in a desperate situation to find a new place to house them in a short time—just a few weeks.

It’s certainly not an ideal spot to be in,

but Mohr is keeping faith that the nonprofit will find a site. So, too, are other

local horse advocates, including Concow horse owners and mustang admirers Laurel Paulson-Pierce and partner Dennis Walker, both of whom have been to the Sheldon Refuge and seen its horse residents—majestic creatures as they tell it. The couple saw more than 100 horses over a few days driving around the refuge last year.

“When we observed those horses, we got a sense of their family bonds. They have a special dynamic between them; how they work to protect each other,” Paulson-Pierce said.

Both she and Walker are critical of Fish and Wildlife’s removal policy.

Paulson-Pierce noted how the federal agency calls the horses “feral.” She noted, however, that the animals’ lineage goes back to horses that were shipped off and used in wars dating back to the Civil War. Moreover, she said, their presence in the region predates the refuge’s inception.

“They’ve been around and part of the tradition of this nation for many years and helped to build this nation,” she said. “They deserve to be honored and protected.”

They believe the horses should remain at the site, but, since that’s not an option, the next best choice is Mohr’s plan of keeping the animals together, Paulson-Pierce said.

According to Oregon-based Fish and Wildlife spokeswoman Megan Nagel,

A creek in common the agency will honor the existing contract with Mohr so long as she can provide adequate facilities for the horses.

She explained how Fish and Wildlife contracts with what it refers to as “certified adoption agents” around the nation, who find the horses homes. Sheldon Refuge’s entire population of an estimated 450 horses and 100 burros is scheduled to be rounded up. The operation is expected to be completed by Friday, Aug. 15.

Years ago, Nagel said, the agency implemented some sterilization efforts to reduce the 20 percent breeding rate in a population of more than 1,300 horses. To keep the numbers in check, the agency culled the herds through roundups by about 200 animals per year. Nagel said that it’s only now feasible, with the size down to 400 or so horses, that the lot could be removed from the land, which is the long-term plan as outlined in the agency’s comprehensive conservation plan.

Nagel called the animals feral and said that they are the progeny of abandoned domestic horses that were part of a horse- and cattle-ranching outfit that operated on the land prior to the establishment of the refuge in 1931. The equines, she said, compete for resources with the native wildlife, and, as such, are the agency’s No. 1 challenge to preserving one of the last intact Great Basin ecosystems.

“Without the removal of the horses and burros, the service is unable to restore and conserve the native habitat for fish, wildlife and plants, which is the purpose for which the refuge was established,” she said. American pronghorn antelope and the greater sage grouse are two of the native species she mentioned.

Mohr heard about the roundup through

her connections in the mustang community, and she agreed to take in many older horses, those that would be difficult or impossible to adopt out, since they will be too old to gentle enough to be trained.

“The thought is to have a real sanctuary where they could live out their lives in peace,” she said.

It’s a unique situation, since the horses would remain together—in effect, preserving the Sheldon herd for years to come.

Because it may take some time to find an ideal long-term site, Mohr’s open to finding a temporary set-up, preferably a spot that’s previously held horses or other livestock and has a reliable water source and hay storage. She’s putting out feelers in every capacity she can think of.

“This is the Hail Mary pass and we’re hoping there’s somebody on the other end who is going to catch it,” she said. Ω

BEC and eco-firm FISHBIO share interest in health of Big Chico Creek he Butte Environmental Council and local eco-consulting firm Trately, FISHBIO have found common ground—or, perhaps more accucommon water.

That is to say, both organizations are dedicated to protecting the Big Chico Creek ecosystem, though their approaches differ. BEC’s is one of advocacy and community engagement, touting the importance of water conservation through its new watershed program and preparing for the annual Big Chico Creek Cleanup in September.

Meanwhile, FISHBIO’s work is science-based; researchers there are currently in the process of compiling data from their second fish count survey in as many years, intending to keep decision-makers informed on the overall health of the waterway.

By working parallel to one another, it’s natural that BEC and FISHBIO’s paths would cross.

“We reached out—we were really interested in the work FISHBIO was doing,” said Robyn DiFalco, BEC’s executive director, during a joint interview with Gabriel Kopp, director of operations at FISHBIO. “In terms of local scientific research, we realized that these are the guys doing it, and we’re the ones trying to advocate on behalf of the water bodies, the aquatic ecosystems.”

While there is no formal working relationship between BEC and FISHBIO, both DiFalco and Kopp said their respective organizations’ recent efforts to benefit the creek complement each other.

Before FISHBIO researchers snorkeled in the creek last August, it had

been a decade since the fish populations there had been recorded.

They did so again a couple weeks ago and, unlike last year, when the surveyors were limited to Big Chico Creek Ecological Reserve, they were granted permission from private landowners to go about 2 miles farther upstream. In addition to counting fish, the team mapped habitat all the way to the waterfall at Higgins Hole, which represents the uppermost barrier for migratory fish in the stream.

As with last year, researchers were on the lookout for five species of fish during the survey—rainbow trout, brown trout, Sacramento sucker, riffle sculpin and California roach. Though FISHBIO is still processing data, estimated numbers were down for all species except California roach.

“We’re not seeing quite as many rainbow trout, not as many brown trout and we also didn’t see any sculpin at all this year,” Kopp said.

But Kopp cautioned against jumping to conclusions about the condition of Big Chico Creek based on a two-year sample.

“You see lower or higher fish population estimates, and all you

can do is guess at what’s affecting them,” he said. “Some people will point to the drought year, but there are larger trends. That’s what monitoring gives you—better insight as to whether we’re in a downward or upward trend.”

The researchers did note that water temperatures were a touch higher than last year, which can alter the fish count—species that prefer cold water may stay closer to the bottom of the creek, where they’re more difficult to spot by researchers snorkeling on the surface.

Kopp said the research team expects to post the official survey results online within two months; the company hopes the numbers will be used by the California Department of Fish & Wildlife and the city of Chico when decisions are made regarding management of the waterway.

While BEC has long concerned itself with the health of Butte County’s

watersheds, it only recently launched a program specific to Big Chico Creek, and the data gathered by FISHBIO will serve as important markers moving forward.

“We felt we should find out more about the work they’re doing and how we might be able to do our work based on their knowledge,” DiFalco said.

In February, BEC adopted the Big Chico Creek Watershed Alliance, a coalition that suffered financially after state funding for such programs dried up. The alliance’s outreach and advocacy efforts fell neatly in line with BEC’s overarching goals.

As part of the watershed program, BEC has held workshops on things like gray-water conversion and rainwater catchment, and will host a series of informational sessions in the coming weeks on how state groundwater regulations will affect locals, water bonds and Gov. Jerry Brown’s controversial “twin tunnels” project.

DiFalco and Nani Teves, coordinator of the watershed program, said they hope California’s drought will serve as a wake-up call of sorts that will put the community on a path of conservation.

“The only way to get there,” Teves said, “is to have an engaged community with a strong environmental ethic.”

FISHBIO seems to agree with that philosophy.

“We’re always excited about getting the community to build relationships with the stream,” Kopp said. “It’s about establishing that greater connection between the community, the environment and the fish.”

the county’s grading ordinance. The action is the result of a number of unpermitted grading operations by marijuana farmers discovered in the foothills over the past few years.

In March, the board tentatively approved amendments to the county grading code that would require a permit for any project calling for the grading of more than 50 cubic yards of soil. That is equivalent to a 30-by-15 foot swimming pool dug 3 feet deep.

Supervisor Bill Connelly was the lone dissenting vote at that meeting. When it came back to the board in April for final adoption, a number of local contractors objected. The board then voted for staff to engage in discussions with contractors to gather their input.

The issue came back to the board in May and then again on July 29. It was continued for further discussion both times.

Concerns about pot growers’ grading activity triggered the revisions. In a number of cases, the dirt-moving caused erosion to land and subsequent damage to streams.

The work often violated state law, but the state has been less than proactive in enforcement, citing the potential danger of confronting pot growers.

While contractors say the regulations may be too restrictive, envi-

ronmentalists say they may not be restrictive enough.

The current county grading code calls for permitting and detailed reports for the excavation and fill of 10,000 cubic yards or more that also include cuts or fills of more than 15 vertical feet or an existing slope of 20 percent or more. The changes proposed in March would have changed the permitting to include the excavation of just 50 cubic yards, as well as the grading of driveways that are longer than 150 feet. After discussion with contractors, the supervisors agreed to increase those numbers, to 250 cubic yards and 350 feet, respectively.

Local contractor Ted Bigelow said

the process of grading property is already too oppressive and bureaucratic. He said he has a project in which he’s trying to eliminate a “hump in the road” on a client’s property. The client has already spent $16,000 to try to get the matter resolved legally, he said.

“I still haven’t done the work,” he told the board. “This is killing my business and tearing my heart up.”

Bigelow said he’d been talking to others in the county, whom he called “old timers and old vets,” who said the county was waging an “absolute war” on land owners.

“There are too high of penalties,” he said. “This is the United

States of America, where somebody should be able to do some things on their own property. Go after the pot growers.”

Woody Elliott, conservation chair at the Mount Lassen Chapter of the California Native Plant Society, questioned the leniency of allowing driveways up to 150 feet to be exempted from permit requirements. He said the driveways should be reviewed by a state-certified engineer to make sure they are stable and not causing drainage problems, which would not be done under the proposed code changes.

“Large parcels could have large entrance roads that need to be looked at by more than just the [California Department of Forestry and Fire Protection],” he said.

“They look at access for their equipment and staff safety, not whether the road is going to fail in the long run.”

In the end, the board voted 4-1, with Supervisor Maureen Kirk the lone dissenter, to have staff continue to work on a draft of amendments to the grading code with consideration of the contractors’ concerns.

Mike Crump, county director of public works, said his office would have something in place for the supervisors to consider within four to six months. Supervisor Larry Wahl suggested there be a twoyear sunset clause, which would mean the supervisors would automatically revisit the issue after that timeframe to see if it’s working.

Chico police, community discuss changes to law to reduce the number of false alarms here was heated discussion Wednesday TInternal morning (Aug. 13) at a meeting of Chico’s Affairs Committee, where police Lt.

Mike O’Brien presented proposed changes to the city’s alarm ordinance. For his part, he said, it shouldn’t be up to the Chico Police Department to subsidize the alarm industry.

In 2012, he explained, officers responded to more than 3,200 false alarms.

The issue stems from a seemingly abrupt decision by Police Chief Kirk Trostle to change the department’s policy for responsding to electronic alarms. On June 15, the department switched to a “verified alarm response” model—meaning, it requires either video or human verification of a crime before dispatching officers. The change caused an uproar in the community, with some arguing that it signaled open season for burglars. A committee of stakeholders was formed and further changes were offered—it was those changes that O’Brien presented to Internal Affairs, made up of City Council members Sean Morgan, Ann Schwab and Tami Ritter.

“The current system, which has not been functioning, has been to fine the alarm user,” O’Brien said. What he heard from alarm companies was that they’d prefer to be the ones fined, “and they will deal with those false alarms as an industry. I welcome that— I think it’s an excellent idea.”

His report included recommendations that alarm companies be fined $100 for the first false alarm requiring officer dispatch, $200 for the second and $300 for each subsequent report. A collection agency would handle the fines, and all the money would go directly to the Chico Police Department. If a company became delinquent in paying those fines, the department would cease to respond to any alarms from its customers.

About a dozen people spoke during the public comment period of the meeting, the vast majority of them representing the alarm industry. The consensus among them was that yes, something should be done to reduce the number of false alarms requiring police response. Most argued that they already do a good job of managing their customers and encouraging responsible use of alarms. Some even said they regularly “fire” customers who repeatedly set off false alarms. Others argued that despite their best efforts, it is impossible to ensure accidents—an open window, or a spider crawling across a motion detector, for example—won’t happen.

“I’m concerned about being fined from the get-go. Nothing is perfect. There are going to be mistakes,” one alarm-company representative said.

“The problem is, sir, that I can’t send my officers to respond to 3,000 mistakes of yours,” O’Brien said.

Jon Sargent, of the Security Industry Alarm Coalition, suggested that fining alarm companies could be unconstitutional based on a recent ruling in the Southern California city of Fontana.

“The judge there said that you cannot fine an alarm company for false alarms that they did not cause through unlawful conduct. It violates the Constitution and due process,” he said.

O’Brien countered that the decision was nonbinding for the city of Chico. Ritter posed the question to City Attorney Vince Ewing, who was present via conference call.

“Can you repeat the question?” he said.

Then, “I would need to read the case before offering an opinion.”

In the two months since the verification policy was enacted (June 15-Aug. 2), the police received 321 alarm calls, of which only 26 were verified and therefore required officers to be dispatched. Of the 26, only four were deemed “criminally attached.”

“That is an almost 90 percent reduction,” O’Brien said. Others agreed that a verification policy should be in place.

Assistant City Manager Chris Constantin suggested the fines go into the general fund rather than directly to the police department to avoid any appearance of response based on getting paid.

In the end, the committee requested Ewing move forward with drafting an amended ordinance including the following: An enhanced verified call system; ascending fines of $100, $200 and $300 to be imposed on alarm companies, which can then pass them on to offending customers; outsourcing to a collection agency; and allocation of collected fines to the general fund.

The matter could come before the City Council as early as September, Ewing said.

The additional accuracy provided by the new apparatus will be particularly helpful in treating cancers of the brain, the release noted.

“This accuracy reduces dose to normal tissues and increases dose to the tumor,” said Dr. Erik Stickney, medical director of radiation oncology. “This means [fewer] side-effects and a better chance for a cancer cure.”

The primary care quandary

TOUGH JOB HUNT FOR NURSES

Despite widespread predictions of a nationwide nursing shortage, many nursing students in California and other states are having difficulty finding jobs after graduation.

According to the National Student Nurses Association, 25 percent of new nurses are unemployed four months after graduating, while 13 percent are unemployed after six months. David Auerbach, a researcher at think-tank nonprofit RAND, offered two explanations for why nurses are having trouble landing jobs—the economic downturn has caused many older nurses to delay retirement, and, ironically, nursing schools have accepted more students in anticipation of a nursing shortage.

A RAND study found that the number of nurses still working at age 69 has doubled over the last 20 years, according to California Healthline.

Wendy Sutherland, a recruitment manager at Kaiser Permanente, said the number of applicants for nursing positions has “doubled to tripled” in recent years. “Unfortunately, without a lot of people leaving or retiring, it has created not enough openings for as many graduates [as] we have coming out,” she said.

SKEETERS ARE KILLER

Two North State residents have died this year after contracting West Nile virus, the California Department of Public Health announced last week.

The individuals’ identities have not been disclosed, but officials said one was from Sacramento County and the other lived in Shasta County, according to California Healthline.

Statewide, 35 cases of humans contracting the mosquito-borne virus have been reported this year. Last year, 15 Californians died from WNV, according to the Los Angeles Times.

Shortage of doctors prompts local physician to open new clinic in Chico story and photo by

Care has noticeably increased.

“We’ve had heart attacks, dropped lungs, gunshot wounds, seizures, meningitis,” said Dr. Brad Smith, owner of the clinic for nearly 30 years, during a recent interview. And while he acknowledged that his clinic is designed for exactly that—quickly addressing urgent health problems—he said many of those patients would have benefited from preventative medicine, but simply didn’t have access to it.

Also, those in dire need of attention are usually mixed in with others seeking treatment that falls distinctly within the realm of primary care.

“It’s become ridiculous—50 percent of the people who come into our clinic are there for something they should go to a primary care doctor for,” he said. “You have someone with a cut on his arm waiting to get sewn up behind three other people who are there to get their blood pressure medication refilled.

“That’s the result of the primary care shortage.”

A lack of primary care practitioners is a national issue—a study conducted by the Association of American Medical Colleges projected there will be a shortage of 45,000 primary care doctors by 2020, accounting for the millions of people newly insured under the Affordable Care Act—and the trend is very much a problem here in

Chico. About 20 years ago, there were about 30 private primary care physicians in Chico, Smith said. Since then, there has been natural attrition due to doctors dying, retiring, moving elsewhere, or transitioning to hospital-based care.

The problem is they haven’t been replaced. By his latest count, there are about half as many primary care providers in town these days.

As a result, Chico Immediate Care has increasingly served as a safety net for those who can’t find a regular doctor.

Smith said it’s common for patients at the clinic to say, “I don’t have a doctor. I’ve called every practice within 30 miles, and not one of them can take me.”

And so Smith decided to take things into his own hands. Just last week he opened a new clinic in Chico—Premiere Primary Care.

said Dr. Roy Bishop, CEO of Argyll Medical Group in Chico, which he founded in 2001.

“We don’t have any large, integrated health care systems that can put in the necessary capital to build clinics, recruit doctors and get decent contracts with insurers,” he said.

Both Bishop and Smith identified low insurance reimbursement rates as the biggest obstacle for attracting new primary care providers.

“We need more primary care doctors in the community,” Bishop said, “but the current business model is not going to bring them here.”

For instance, Bishop’s current contract with a private insurer reimburses him at 90 percent of Medicare’s rate, which is already so low that many physicians won’t accept it as payment. “And that’s after a huge fight,” he said. “If I was a solo practi-

tioner, rather than part of Chico’s biggest primary care group, they would try and pay me 60 or 70 percent [of the Medicare rate]. It’s truly awful.

“Most young doctors want a salary and benefits and they don’t want to take any business risks,” he continued. “The old model, where doctors were self-employed, is dying simply because the reimbursements controlled by the government and insurers are so low it’s no longer a viable business.”

Smith agreed, adding that there’s little incentive for medical school graduates to open their own practices, given that entering a specialty field is often far more lucrative—no small consideration given the massive student loan debts most med students accrue. Further, the logistical aspects of running a primary care office such as meeting federal and state mandates, tracking paperwork and managing an office can be daunting.

Bishop is doing his part. In an effort to address the issue, he and other area physicians have formed the California North State Independent Practice Association (IPA), which aims to bargain collectively with insurers for better rates. Successfully doing so might allow the IPA to attract more primary care physicians to Chico.

In a perfect world, providing primary care wouldn’t be such a hard sell, Bishop said. After all, it can be a rewarding field.

“I enjoy the contact with patients and entire families, looking after them for many years and doing my best for them,” he said. “But sometimes I feel like I spend half my

Based on the number of appointments in the first week, he believes it will be operating at max capacity within two months—despite not having advertised at all.

Further, Smith is already planning on opening two similar clinics, another in Chico and one in the Paradise area. He said he’ll open the second Chico clinic as soon as he’s able to staff it.

Indeed, now that he’s established an infrastructure—including an electronic health record system on a cloud server that allows doctors at any of Smith’s clinics to access patient files—opening new clinics is purely a matter of recruiting primary care physicians. He knows as well as anyone that it won’t be easy.

“But I got very frustrated and tired of seeing nobody do anything about primary care in Chico,” he said. “We can’t just sit here and watch this train run off the end of the track, because that’s where it’s going.” Ω

“It’s kind of a can of worms, in my opinion, if you’re not asking all the right questions,” she said.

For example: What if she and her husband sell their home? They may well do that in a few years, because they’d like a place with more space for their hobbies and ventures now that they are semi-retired.

Even if they don’t sell, what happens if they need to re-roof?

These are a few of the things she asked the salespeople.

“You’ve got these issues that are popping up that I don’t think people are thinking about ahead of time,” Widlund said. “Some people, especially young people, they’re naïve, and until you’ve lived a little bit of life, how do you know what questions to ask

Homeowners who want a solar-power system

for their home either can purchase (typically for between $9,000 and $30,000) or lease.

Leases run $50 to $200 a month, and may come with two options: a flat fee that’s the same every month over the term of contract, or a power purchase agreement (PPA) under which the customer pays for the electricity consumed each month.

“The value of a solar system is the power it produces,” said Jonathan Bass, vice president of communications for SolarCity, a solar system provider with an operation center in Chico.

Leases/PPAs typically run 20 years, Bass said, with SolarCity owning the equipment and providing maintenance, repairs and insurance to the lessee. Most customers opt to lease “predominantly to eliminate upfront costs but also for the services we provide.

People don’t necessarily want to own and maintain a power plant on their roof.”

That contract remains in effect even if the lessee sells the home. In that case, either the new owner takes over the lease, or the old

owner buys it out. Bass said SolarCity handles one or two contract transfers a day, calling it “a simple and straightforward process.”

There is a caveat, though: The solar company must approve the homebuyer for the lease.

Bass says it’s no big deal, that “if you qualify for a mortgage, you’re going to qualify for a lease or PPA”—and that a buyer would need to apply with a utility company to get electrical service anyway. “We don’t hold up a home sale.”

Alice Zeissler, president of the Chico Association of Realtors, says it’s not always that easy. Payments for a solar system lease count as debt, not expenses (like a utility bill does), so adding that amount on top of the mortgage has the potential to push a buyer out of the price range. “[A solar lease] can make it so they don’t have as much purchasing power,” Zeissler explained. “I do have a lot of clients where their debt-to-income ratio is kind of a fine line, and they don’t have a lot of room there to add more debt like the solar panels.”

Bass said SolarCity has found 69 percent of its lessees who sold their homes determined the solar system actually increased the sale price. Zeissler says she does see solar as a positive selling point, when it’s been bought outright. “[But] a lease, I don’t know if I would say that,” she continued, comparing a leased solar system to a car in the garage—having

Once the panels are up, Bass says they provide protection for the roof materials underneath.

Should a re-roof become necessary, SolarCity will take down its equipment and put it back up for a fee of $499, which the company says it spells out in its contract.

Finally, when the lease or PPA expires, the customer can renew it in five-year increments, purchase the system at depreciated value or have SolarCity remove the system at no cost.

These details are good to know—and are why Widlund is such a stickler for specifics.

For now, she hasn’t opted for a solar system, but neighbors have, and a house on her block with a leased solar system recently went up for sale.

“You’ve got to ask questions,” Widlund advised. Ω

A few years ago, I caught a wild hair, bought a sewing machine and some fabric and started to make things, mostly purses and totes. The satisfaction of turning a stretch of cotton into something else—something pretty and useful, even—was a little intoxicating. I started with store-bought patterns and then, after getting a feel for it, began to create my own.

When a half-dozen projects turned into more than 20, I began to wonder what I was going to do with my creations. Everyone said Etsy was the way to go if I wanted sell them, so I labored over photos, descriptions, price points. After a month of no sales at my online shop, however, I became discouraged. Were my handmade bags not cute enough? Were they unfashionable? What was wrong with them that nobody wanted to buy them?

Determined not to fail, I decided to look a little closer to home. I ended up at Konjo, the funky little retail/consignment shop on Second Street near Naked Lounge. I walked all my bags over and presented them to one of the owners, Kirk Johnson. And a bit to my surprise, he liked what he saw. We set up a consignment deal and my purses were hung on racks inside his store. Most of them even sold.

Browsing the shelves, I noticed I wasn’t the only one around town with a creative bug—I spied everything from funky hair clips to feather earrings to full-on gowns.

Konjo isn’t the only shop that’s fostering that creativity. Most obviously, there’s Made in Chico (between Main and Broadway on Third Street), whose name says it all. And a few blocks south on Main Street there’s Three Sixty Ecotique, which sells cool fashions by Chico designers.

I stopped in recently to check out the offerings and, as usual, found a great selection of fun clothing and jewelry.

One of the local designers whose stuff I’ve seen around town—most recently at Three Sixty Ecotique—and love is Chicoan Amy Waltz (www.amywaltz.com). Her hammered metals and use of stones (I’m a sucker for turquoise, which she uses a lot) are stylish and a bit bohemian. There’s nothing quite like wearing a one-of-a-kind piece, and the fact that these are all made by hand contribute to their unique charm.

There’s also Hobo Chic Designs, created by Orovillian Samira Morrar.

Her bold use of metals like copper and wire-wrapped stones and crystals is enough to make me want to go home, break out my craft box and try to make something beautiful.

These fun shops are integral to Chico’s charm and are part of the funky allure of our downtown. And the fact that someone like me—who hadn’t sewn a thing since a summer sewing class when I was 14—could get my bags in a local shop window was pretty neat. All it really took was a desire to create and the motivation to get my stuff out there.

It’s been a while since I’ve sewn anything to sell, so these days I just browse the racks and shelves at local stores to see what has inspired my fellow Chicoans. I’m so thankful that this town’s shop owners—and customers, of course—appreciate locally made fashions and can only hope the trend continues.

The alternate bike universe Greg de Gouveia, 37, is a kind of bicycle mad scientist. In July he finished a grueling 2,900-mile bike ride from Canada to Mexico in 29 days, averaging 95 miles per day. But his specialty is building elaborate, oneof-a-kind bikes and bike art, from the practical to the absurd. He’s built a 6-foot-tall tricycle, a full kitchen-equipped bike, and even a 20-foot-long, four-person, pedalpowered “lizard” with swiveling head and tail. You’ve probably seen (and maybe ridden) his aweinspiring creations at Burning Man or in Chico at the Parade of Lights, the Seersucker Ride or the Tweed Ride. Why do you build your wild, “fun” bikes?

Mostly for artistic sake and the joy of seeing others ride them. I also like the challenge of doing different things. I’ve seen lots of bikes, but never ones with car tires, or three-wheelers that can go 30 miles per hour.

What are some of your more notable ones?

“The Kitten” is a yellow bike with two car tires that really turns heads. The “Peackock” is a tricycle that’s 6 feet tall with a two-person platform on the back. I get a kick

riding it and seeing the shocked looks from drivers of jacked-up trucks when I pull up higher than them at stop lights. Another of my tricycles is only 10 inches tall and is like a Big Wheel but with rubber tires that can fly down the road.

Which businesses have you built bikes for?

I built the pedal-powered generator that amplifies the music at the annual Chico Bicycle Music Festival, and the bike cart for Chico Chai, which sells teas at the Thursday Night and Saturday farmers’ markets. I also built a bike kegerator for Chico Natural Foods, and the soup bike for Cycle City Soup Co. One of my biggest projects was the original Bike Kitchen that does cooking demonstrations at the Saturday farmers’ markets. My original had a canopy, propane stove, refrigerator and water pump, but they now use a second, newer version.

Why do you think you get so much business?

I’m the only one who can take their vague, basic concept, fill in the blanks and actually build it.

What’s your main job?

I’m a fabricator or artist who does custom metal work. Before this I owned Chico Pedi Cab for 10 years, but it got old dealing with drunks all the time, plus I do my art more effectively at night.

Did you take more than one bike to Burning Man? Oh, yes. I’ve taken a dozen of them to Burning Man over 12 years. People really have a blast with them there.

What’s that big, circular structure outside made of bikes?

That’s a giant clock I built using 12 old bikes that actually keeps real time by spinning the pedals on one of the bikes. It’s called “Time to Change” and was featured in Popular Mechanics in 2013. It’s 13 feet in diameter and uses 27 bike chains to turn the bikes, as well as the 5-foot-long hour, minute and second hands. I built it to display at the 2011 Wildflower bike ride.

hat’s happened to downtown Chico? Hordes of homeless people wander the streets, their faces reflected in the windows of vacant storefronts. They hang out at City Plaza, in some cases scaring away shoppers.

Check out the vacancies on the south side of Third Street, between Wall and Main, where only one of the five storefronts houses a business.

On the corner of Third and Main, the Jimmy Jack’s Rib Shack sign still hangs on the building, but the restaurant has long been gone, as has the neighboring Gina Marie’s Italian restaurant. Stroll down the sidewalk toward Fourth Street, and see how the building that once housed the Towne Lounge and The Underground sits vacant behind a black chainlink fence designed to keep the transients from bedding down there.

A few steps away, the furniture and home décor store that occupied the first floor of the Grand View building at Third and Main is gone, as is the Fashion Lounge near Second and Main.

And as for the downtown parking situation …

Welcome to the Chico News & Review’s semi-regular look at the constantly changing face of downtown. The description above certainly sounds alarmist, but the fact is, while a number of prominent spaces are empty, the region remains a vibrant business sector. According to numbers released in April by the Downtown Chico Business Association, the estimated first-floor retail vacancy rate for downtown Chico is 7 percent, less than the estimate for city as a whole (9 percent) as well as that of the nation (11 percent).

Sales tax receipts are up 1.5 percent from the last quarter of the fiscal year and up 29 percent since they bottomed out in 2009. The city’s transient occupancy taxes—those charged by hotels and motels—are up 2.8 percent over a year ago. Two stores that vacated downtown last year, Betty’s on Broadway and Katie’s Corner, have been replaced with new tenants, a clothing store and consignment shop, respectively.

Other new businesses that have come downtown include Denine’s Cupcakes on Broadway between First and Second streets, the B Street Oyster Co. directly across the street, and Wanderful Media on Broadway between Third and Fourth.

To get a handle on what is going on downtown, we checked in with a number people who have an insider’s view, a vested interest, or both. Here’s what they had to say about downtown Chico, including the issues of homelessness, parking and business in general.

Melanie Bassett became executive

director of the Downtown Chico Business Association in July of last year. The DCBA, as its name would indicate, serves to promote and encourage downtown retail. She formerly worked for Tri-Counties Bank and before that worked with nonprofit organizations.

“I love the downtown and that was the

impetus for applying for this position,” she said in a recent interview. “It seemed like there was an opportunity to elevate this organization and what we are doing, and it was time to revitalize our downtown as well.”

While her job is to promote the area, the articulate Bassett comes across as genuine when expressing her views. She says she believes the downtown is in much better health than most people might think.

“We have what hovers around 450 businesses downtown,” she said. “There is a lot of discussion about what should be the balance. There are those who would like so see more retail, but we have these satellite tech companies calling and making inquiries about being downtown, rather than out at the airport.” (See a breakdown of business type on page 21.)

Those types of businesses include Wanderful Media. “They are there 24 hours a day with a younger population,” she said of the company.

Bassett explained that Wanderful, formerly named Travidia and located at the airport, has an app program called Storefront that guides its users to deals being offered in local stores. Another app called FindnSave encourages people to buy locally rather than online by telling customers in stores what is on sale within that particular business.

“They will also come out and help businesses set those connections up and so we are getting that message to our downtown merchants,” Bassett said.

A new restaurant called Crepeville is coming to town thanks to the owner of Burgers & Brew, she said. The new place will be located in the green wooden box of a building that sits at the southeast corner of Third and Broadway.

“It is such a cool spot and it will have outside dining,” she said. “Outside dining has helped a lot downtown. It’s something the city did by making some [zoning] allowances. Every time I turn the corner Tres Hombres is packed and that makes me happy. There is a lot going on down here.”

Bassett, like a number of others interviewed for this story, said the perceived downtown parking problem is greatly exaggerated.

“People don’t want to walk,” she said. “We are so spoiled here. It’s really going to take some education. But we have a great group working on it. We have good representation.”

Bassett noted the number of spaces will increase with the ongoing project of installing diagonal parking along Flume Street. She said she hopes to get diagonal parking on Broadway and Main as well, a project that would eliminate one of the three lanes that currently run along those streets.

Additionally, the City Council soon will be discussing the installation of so-called smart meters.

As for the homeless, she mentioned the

R-Town Downtown Coalition that created the Downtown Ambassadors and the Jesus Center Cleanup Brigade, programs the DCBA took charge of six months ago.

Those two groups welcome downtown patrons and keep the sidewalks clean.

When first launched last November, there was a third component made up of a private armed-security firm out of Yuba City that patrolled the downtown during the holidays.

“Sometimes when a crisis happens, good things come out of it,” Bassett said, referring to the downtown transient situation. “I think we are doing OK, but obviously there are people in the community who say, ‘I’m not coming downtown anymore.’”

She said she thinks the problem is not as ghastly as it’s been in the past.

“It’s not going to change overnight and we all have to be working together,” she said.

“I think the biggest thing is trying to change

the face of homelessness so that it isn’t a matter of ‘We just need to get rid of these people.’”

Bob Summerville is a senior planner

who’s worked for the city since 1992 and has had an eye on the downtown for a pretty long stretch. Overall, he says, there has been an improvement in downtown storefronts.

“What I think has been a good shot in the arm are the outdoor dining patios, which we are seeing a lot of,” he said. “Our new code in the general plan encourages that. It started with Tres Hombres, Celestino’s [Pizza] was the second, and then Mom’s [Restaurant].

We’re going to see a fourth where Crepeville is going in. While they take away a parking space, they add to the charm.”

Summerville said there’s actually been a net gain in parking spots with the installation of the diagonal spaces along Flume.

As for the businesses downtown, he noted the increase in the number of consignment shops. “The second-hand stores were limited until we redid the zoning code last year,” he said. “Now, second-hand stores that are 2,500 square feet or less are permitted downtown in the north district.”

The north downtown district comprises the area that runs from First Street down to Fifth between Wall and Salem streets. Summerville said the south downtown, the area from Fifth to Ninth streets, is also seeing some resurgence.

“That is what the city wanted to see when we went through the general plan process,” he said. “From Café Coda and Lulu’s up to Nantucket, and over to the Winchester Goose and 1078 Gallery. Our new general plan has a downtown element: a dedicated chapter, which has some wonderful policies.”

Mid-block on the south side of Second

Street, between Main and Broadway, is Brooklyn Bridge Bagel Works, owned by longtime downtown businessman Scott Schulman and partner Peter Horylev. Schulman’s first business in Chico was the Oy Vey Bagel Co., also in downtown. He opened that popular spot in 1979.

younger crowd than the one that had frequented the popular former fern bar for so long.

Problems facing the downtown—transients, homeless and parking—were all well-documented even at that time, he said.

“This is nothing new; it’s just a de-evolution,” he said. “You have better media coverage of it with the Internet and all, but I don’t think that much has changed. We had the same issues in the ’90s with Hey Juan’s across the street. You couldn’t get through on the sidewalks because of what some people would consider unsavory types.

Right now, it’s better than it was last year.”

Parking has always been an issue downtown and probably always will be, he said.

“In years gone by there were concerted efforts to keep employees from parking in front of their place of business. We gave out coins to people to feed the meters. There have been various attempts to change the perception of downtown parking,” he said. “You park farther away at the mall. Parking downtown is not that tough. I do it all the time. It’s all perception and that [$29] ticket doesn’t help.”

What is the secret to success in running a downtown business?

“If I was successful I’d be on a beach in Rio de Janeiro,” he joked. “The secret is to know your clientele, provide good service and good product at a fair price. … I’ve been on this block for 34 years and I never get tired of the downtown. I look forward to my shifts.

That is probably the biggest part of success— love what you are doing.”

Seven years ago, they opened The Banshee on Second Street, in the spot formerly occupied by Stormy’s Off Broadway.

Tamarelle was born in Chico and raised here until he turned 14 and moved to Grass Valley. He received a scholarship to Brandeis University, which is just outside Boston, where he met Brady.

“Will caught wind that I was interested in moving back to my hometown and opening a bar,” Tamarelle said. “He Googled Chico and saw it was a cool spot and said, ‘Let me know if you do that.’ One thing led to another and eventually I brought Will out here.”

He said the two gutted Stormy’s to create a new bar.

“We spent every hour we had doing it,” he said.

Tamarelle said the success comes from filling a niche that was missing in the downtown—a nice bar with good food.

“When we first came to town with our idea, people told us we were crazy because Chico’s got a million bars,” he said. “We just took it to a different level where we do really good food with a bit of thought behind it.

but now we have a good following with loyal, loyal customers.”

He said B Street, which opened in March, also fills a void.

“People are still finding us, and we are growing slowly,” he said.

The issues with the homeless and transient community do affect the bar, he said.

“There are always a couple of people parked out on the sidewalk or digging through the trash or just wandering back and forth and there doesn’t seem to be anything being done about it. We are at the point where we are trying to call the police once in a while to try to get them to scoot people along, but they don’t really care about it,” Tamarelle said.

Parking, he said, is not a problem.

“When I come downtown, I park three blocks away,” he said. “Chico is such a bikefriendly town and you can walk from just about anywhere to get here. So it really is not that bad. It is congested right downtown, but if you are willing to skip driving around the block for five minutes and just park and walk, you are there in the same amount of time.”

Downtown property owner David

Halimi has lived in Chico since 1979 and sat on the DCBA executive board for more than a decade.

Halimi, who came to the U.S. from Iran in 1969 at the age of 16, owns several buildings, including the one that houses his business, Diamond W Western Wear on Second Street.

He owns the old Chevy’s building that houses Burgers & Brew, Crush and Jamba Juice, as well as four other buildings housing Peet’s Coffee & Tea, Lyon Books, Wanderful Media and Pluto’s.

“I don’t have any vacancies right now and in the past when I did, it hasn’t been that difficult to lease them,” he said. “Sometimes you have to do a bit work to get it rentable, just like the whole refurbishment we did at the 325 Broadway for Wanderful.”

Halimi said vacancies often occur not because of a lack of interest but rather due to a failure of the property owner to make the place suitable for a potential renter.

“I think the perfect example is the old Chevy’s building,” he said. “It sat vacant for five years and then, once I got involved, it took a couple of years to get it full. Not because it was a bad location—it was a prime

location in Chico, but it was too big for the type of tenants who tend to come downtown.

They tend to be small mom-and-pop-type businesses and so the solution was to separate the two spaces, the upstairs and downstairs. It took understanding what the problem was and solving it.”

He said working with the city is for the most part positive and fruitful.

“I think the city really does work very hard to get things done with property owners,” he said. “And I understand that they have certain limitations and regulations that they have to abide by. My experience with them in that regard has been great.”

Like others with downtown investments, Halimi also says parking is not a problem. He said, however, that the homeless issue does have a negative affect on business.

“I think that it does discourage and distract some shoppers,” he said. “Particularly the older ones; they feel uncomfortable coming downtown. So having more police presence would be good, but I certainly understand the limitations there.”

Halimi helped start the R-Town Downtown Coalition with the private security force.

He said he’s glad the ambassadors and cleanup components of the program are still active.

“The next step is to bring back the private security,” he said. “I think that will give people a certain comfort level to come downtown. The city police presence downtown would be the first choice, but you don’t always get your first choice. They have their own challenges.”

Budd Schwab, owner of Campus

Bicycles, is just beginning his third term as president of the DCBA’s board of directors.

He’s had a bike shop downtown for the past 32 years, having moved to his current spot at Fourth and Main a dozen years ago.

Schwab, who is married to Chico City Councilwoman Ann Schwab, pulls no punches when talking about downtown’s problems. His shop is just across the street from City Plaza, where many homeless people and transients hang out.

“We have a $4.2 million plaza that we don’t use,” he said in a recent interview at the plaza. “There is a safety issue involved, there’s a cleanliness issue. I’ve been involved in the Clean and Safe movement since it began. We have people from the Torres Shelter, people from the Jesus Center, Behavioral Health, the 6th Street Drop-In Center and the DCBA. I’m proud to be part of that, but we just don’t know what we can really do.”

He said the recently passed sit/lie ordinance is unenforceable because of a short-handed police department. The law says—with the exception of babies in

strollers, those using wheelchairs and those who are having a medical emergency—no one shall sit or lie on a downtown sidewalk.

“We have a liberal City Council, a very wealthy student body and a micro police department,” Schwab said.

He acknowledged that the homeless community includes people with drug-addiction and mental-health issues and even those who’ve lost their mortgage.

“But there is this middle group, and I would guess it’s 50 percent for which it’s a lifestyle choice,” he said. “I don’t get panhandled, but I hear it is still going on. I don’t know if they see it in me and just don’t approach me, but it’s just the general population that’s not good for downtown retail.”

He said the downtown needs to be more vibrant and generate more sales tax revenue to hire more police officers.

so people are putting a lot of energy into it,” he said. “The ingredients are there for a really great downtown, but I don’t know what the solution is with this transient situation.”

The couple first met while working at KCHO public radio, which was then located on the Chico State campus in the basement of Meriam Library.

“Back then there were at least nine or 10 active theater companies in Chico,” Allemann continued, listing some nowdefunct names like C.I.A. (Chico Independent Actors), Plank and a Passion, and the Cosmic Travel Agency, which eventually morphed into the Blue Room Theatre. “It was such an active and supportive community that we wanted to emulate what we’d experienced in Chico in San Francisco.

“The Blue Room’s focus on original works is what inspired us to exclusively do new, original works by local writers,” he continued. “We were basically tired of seeing stuff in San Francisco that just didn’t entertain us.”

inspired by the iconic Thunderbird Lodge sign in downtown Chico. In the early days, the group returned often to share its new shows, but there hasn’t been a Thunderbird Theatre production in Chico in 10 years, since 2004’s Lusty Booty.

This time around, the Bay Area-based players will perform Show Down!, a play written by Allemann, Hicks and two S.F. playwrights, Claire Rice and Christine McClintock. The screwball comedy, which Allemann said is part soap opera and part classic workplace melodrama, takes place in the studios of KRAP, the world’s last live television studio.

The head of the station dies, leaving its two top producers—traditionalist heroine Beth and digital-ageobsessed, steampunk hipster Commodore—to duke it out for control of the station. Along the way, kale, love triangles, cheese theft, and something called the iPlan play a part in the conflict.

Allemann said that, though the play is over-the-top and intentionally ridiculous, it contains a fair amount of commentary on the state of technology and entertainment, a pertinent topic to live theater.

“Here we are doing live theater, which movies were supposed to kill a long time ago,” he said. “Then television was supposed to kill movies; radio is largely a thing of the past; and now everyone’s streaming everything. You can watch or listen to whatever you want on your own schedule, which makes it more difficult than ever to get people to come see live theater.”

Allemann said the Thunderbird Theatre group averages a single production a year: “We’re all unpaid and there’s a lot of work involved and money spent for at least three months straight,” he said of the schedule. “Plus, since we focus on original works, we like to take the time

Allemann and Hicks are the only founders still with the Thunderbird (Chavira has since moved back to Chico and is the Blue Room’s current artistic director, and Gomez lives overseas), but several other Chicoans are still involved, even from younger generations—Show Down! features 21-year-old Chico native Zane Barrett in his first play ever.

When the Thunderbird crew rolls into town (Allemann expects about 20 cast and crew members to make the trip), they’ll take up residence at the motel that serves as their namesake for their twoday engagement.

“We’re excited to give the actors who grew up [in the Bay Area] in the fog an idea of what real heat is, take them swimming in Upper Park, and then everyone usually gets excited when they realize Chico is where Sierra Nevada is from and we’ll head to the brewery,” Allemann said. “Chico is just fantastic, and I can’t express how happy we are to come back after all this time.” Ω

Park pairings Three local parks and wines to pair for the perfect date with nature bottle of wine is uncorked potential, the beginEwinevery ning of a journey. Perhaps that’s why a glass of pairs so nicely with a nature walk. On the trails

into forests and along rivers and canyons, wine will leave its city pretensions behind.

An inexpensive bottle, split among by friends while traversing new paths, Matthew becomes the greatest wine of all.

Craggs Here are three local trails and three suggestions for local bottles to elevate your late-summer adventures.

Upon first glance, the Indian Fishery Day Use Area,

west of Chico in Bidwell-Sacramento River State Park, seems a little plain—a parking lot, a few picnic tables, and a half-mile nature trail. However, on that trail—as with a glass of sweet moscato wine—something special happens halfway through. You start to smile.

The short trail runs parallel to an oxbow lake, created by erosion over time, cutting off a bend of the Sacramento River and isolating the small body of water. Overrun with flora, the lake is a sea of green spread between ivy-covered banks, vines a few feet shy of climbing to the top of waterside oak trees.

Viewed between sips of a silky moscato—such as Moscato Dolce’ from Oroville’s Grey Fox Vineyards—the undisturbed riverbank seems silently spiritual, though playful, as if colossal forest specters may awake from eons of slumber and shrug off the world that’s grown over them.

Then the riparian revenants appear—river otters popping their heads above the isolated water, slick brown bodies rolling in the reeds, wiggling between the foliage. The otters bob in the dark waters as you sink into the indulgence of the syrupy wine.

North of Indian Fishery along the Sacramento River,

Woodson Bridge State Recreation Area calls for a bolder, but still smooth, wine.

Located outside Corning, the spot is popular for fishing, birding and camping, while the nature trails

wind through valley oaks and blackberry patches that would be at home with the fruity flavors of St. James Syrah of the New Clairvaux Vineyard—which is just a stone’s throw away. The towering oaks are overwhelming compared with the frolicking otters but a spicy—though still fruity—syrah is audacious enough to take on the grand scene. Unlike a zin, which may be too full-bodied, a syrah plays nicely with the wild blackberries plucked free of their thorny embrace from the bushes beside the trails.

On a damp day—like those after a surprising summer rain—the red wine’s earthy musk mingles in the air with the sickly sweet smell of decaying detritus rising off the forest floor. Each sip draws the two in, the wine carrying the essence of the forest on crimson waves. And, if those or any other waves carry you to a place where you find yourself in need of an impromptu campout under the stars, a syrah’s drinkability means you can pour into night while sprawled under a sky so full of starlight that it dwarfs the surrounding mighty oaks and outshines the wine.

The 3,670-acre Bidwell Park straddles Big Chico Creek,

is home to a simian outcropping, and was a filming location for Errol Flynn’s The Adventures of Robin Hood (1938)—it’s a big park with a big attitude and a big rule about alcohol not being allowed. If there weren’t such a law, or if you indulged in advance of your hike, a go-anywhere, powerful barbera (even the name sounds worthy of Robin of Locksley)—perhaps one from Bertagna Son Kissed Vineyards—would pack enough umph to get you up the Upper Park ridges, but this everyday wine won’t thumb its nose if you go ape standing atop Monkey Face.

Keep a safe distance from bluff’s edge, and take in the grand views of Big Chico Creek Canyon. Sit and let the barbera grease your mind as it slips into canyon and cup alike. Listen for the repetitious raps of a woodpecker while the shadows of turkey vultures circle the grass-spotted rocky outcropping, and wrap yourself in the natural wonder. Your blood pumping with confidence, declare yourself one with nature and, in doing so, own its grandiose wonder. Ω

t was exciting to stand next to the table full of art on IDirty submission day. The 1078 Gallery’s new exhibit, Laundry, wouldn’t open for a couple of days,

but standing in the gallery and talking to the artists as they dropped off their works turned story and out to be a good way to get a feel for photos by the project.

“That’s a beautiful response to what we’re going for,” said Trevor Lalaguna, a Chico State art instructor and the 1078 Gallery volunteer who organized the show.

The inspiration for Dirty Laundry came about a year ago while Lalaguna was driving on the freeway, he said. Off the side of the road he saw a clothesline in someone’s yard covered in laundry and what looked like an odd white sculpture next to the line. He couldn’t stop at the time, but upon returning down the same stretch of road, he pulled off to satisfy his curiosity and discovered that it was just three white shirts waiting in a pile.

“What I look for in art is something that provokes curiosity,” he said. “I thought it would be cool to format a show based on that one glimpse.”

So, with that three-shirt pile in mind, Lalaguna filled a bunch of “laundry bags” with three items of used clothing each.

Some bags had matching pieces, some had clashing, and none of the artists who paid the $10 entry fee knew what was inside the bag of raw materials until after they had purchased it. Once you paid, you were guaranteed a spot in the show, with the 32

understanding that whatever you created would have to include something from all three items in the bag and your piece had to be able to be hung from a clothesline.

“I always wanted to do something that was a little more community-based at 1078,” Lalaguna said of the setup, which he compared to that of the open-entry shows at the now-defunct Manas Artspace, which also were instigated with prompts—colors, bags of junk, vinyl records, etc.

These open shows tend to attract artists from a variety of backgrounds, and Lalaguna said that many of those who delivered works for this show had never shown their work, and some weren’t even regular artists.

“I think that’s beautiful,” he said, excited that the spark of the show led to artistic creation and brought new artists into the fold. “You start a new community of conversation,” he added.

And the community’s wide range of responses to the prompt (approximately half of the 40 bags purchased were resubmitted as art) will at the very least pique a curiosity as to what the items of clothing were before being transformed.

Some made clothes from the clothes, like Sheryl Cummings, who fashioned a handsome “Voyeur’s Vest” (take free peeks behind the secret doors) out of a bikini top, a Super Mario shirt and a V-neck sweater.

Others went way out there, like ceramicist Patti Lloyd, whose sweet, dark, candy-themed mobile, “Want Some Candy Little Girl,” hides its source material well.

Sharon Nilsson, owner of the Funky Trunk vintage clothing store, augmented her bag with goodies from her own shop (including a pair of knee-high boots with zippers up the side that she made into sleeves) to create a wearable steampunk-looking outfit.

After the initial look through the submissions, my favorite was probably “Feminalia Angus” by ceramicist Charlene Abinante. Using a bag full of men’s trousers, she sewed together a giant gray worm and then stuffed its mouth with a bunch of little ceramic worms. It’s gross, cuddly and wonderful.

The reception won’t happen until Sept. 4 (at 6 p.m.), but there, a panel of judges will give out prizes (including gift certificates donated by local second-hand clothing boutiques—Funky Trunk, Boho and Yard Sale) for the top pieces in fun categories like “dirtiest” work and “most creative Ω use of material.”

The latest from Richard Linklater (Dazed and Confused, Before Sunrise, etc.) has received nearly universal critical praise for its story following the life of a boy from age 6 to 18.

The movie was actually filmed in pieces over a 12-year period, following actor Eller Coltrane as he grew with his character. Also starring Ethan Hawke and Patricia Arquette.

As such, it seems made-to-order for fans of those other films, even though the on-screen results here live up to those promises in only the most cursory ways.

There is some real appeal, however, in the basic setup here. Directed by Maison Mumbai, a grandLasse Hallström. looking Indian restaurant, just across Cinemark 14, the road from a Michelin-rated Feather River Cinemas and French restaurant, Le Saule Pleureur, Paradise Cinema run by the snooty Mme. Mallory 7. Rated PG. (Helen Mirren). A mildly impassioned rivalry develops between the two establishments, and between the two proprietors, the widowed Papa Kadam (an ebullient Om Puri) and Mme. Mallory, herself a widow.

And there are other complications of note. Hassan (Manish Dayal), the eldest of the Kadam sons and a chef of special gifts, gets involved—romantically, professionally and otherwise—with Marguerite

(Charlotte Le Bon), a comely sous chef working for Mme. Mallory. The two of them are, at various times, rivals, lovers and benign co-conspirators, and ultimately they are the key figures in bridging the gaps—cultural, national, professional—between the two restaurants and their respective crews.

That relationship is in some ways the flip side of the Mallory/Papa coin, but Hassan in particular looms as the closest the film comes to having a heroic central protagonist. His journey away from and then back into the Mallory/Papa orbit is the final stage of the hit-and-miss process by which the story’s various dramas are resolved within what might be termed the Hassan/Marguerite orbit.

The political violence that the Kadam family fled in Mumbai recurs briefly in France via a neo-fascist firebombing at Maison Mumbai, but the film is not particularly interested in history, politics, or human psychology, for that matter. The two incidents of violence are matters of narrative convenience: the one to get the Kadam family away from India and the other to provoke an easy moral reawakening in Mme. Mallory.

But The Hundred-Foot Journey means above all to offer up a pleasant array of good feelings. It does that often enough that the presold audience for which it was made is not going to worry too much about the childish simplicity of the characterizations or the dull predictability of emotional scenes. Nevertheless, even with Oprah Winfrey and Steven Spielberg taking the lead among the film’s producers, this is yet another movie in which the spirit of Disney seems both pervasive and reductive. Ω

Jake Johnson and Damon Wayans Jr. (both of New Girl) star in a buddy comedy about two dudes whose lives get out of hand when their bright idea of wearing cop uniforms in public draws them into more dangerous and wacky scenarios than they planned for. Magic in the Moonlight

This year’s offering from writer/director Woody Allen is a comedy set in 1928 Europe and features Colin Firth as a popular magician who performs disguised as an Asian illusionist and who is hired to try and debunk a young woman (Emma Stone) claiming to be a clairvoyant. Cinemark 14. Rated PG-13.

There’s much else on his film’s menu, but writer/director/star John Favreau is unmistakably the presiding spirit at the heart of this rollicking crowd-pleaser.

Favreau plays Carl Casper, a Florida-based chef and gourmand given to robust tastes and adventurous cuisine. He’s also trying to be more of a father to young Percy (Emjay Anthony), who lives mostly with Carl’s exwife, Inez (Sofía Vergara). Renewed attention to family responsibilities becomes even more complicated when Carl has a falling out with the restaurant owner (Dustin Hoffman) who bankrolls his culinary endeavors. With a little help from a friendly assortment of old pals and former associates, Carl rebounds from these setbacks by setting up business in a refurbished food truck and taking it on the road, heading west from Florida, with Percy and longtime sidekick Martin (John Leguizamo) on board as his crew. There’s an amiable sort of predictability to most of this, and it may be only the prevailing spirit of rambunctious camaraderie that holds the story and its characters together. Pageant Theatre. Guardians of the Galaxy

If someone was gonna make a swell comic-book movie despite the aggressively calculating influence of both Disney and Marvel—it would be writer/director James Gunn. And yep, he did it. Gunn was writer of the better-than-the-original remake of Dawn of the Dead and he’s been a filmmaker to keep an eye on since graduating the Troma School of low-budget filmmaking, and wrote, produced and starred in The Specials, one of the first deconstructionist swipes at superheroes. The story here: Charming halfhuman/half-alien rogue Peter Quill (Chris Pratt) steals a MacGuffin and teams up with a band of misfits—including a foul-tempered talking raccoon and a sentient tree (voiced

by Bradley Cooper and Vin Diesel, respectively)—to avert the destruction of the galaxy from some intergalactic dude. It’s kind of shambolic, but in a good way, and easily the most entertaining movie of the year, a delirious romp through the CGI cosmos. Gunn isn’t shy about wearing his influences on his sleeve, evoking the best aspects of the original Star Wars, Joss Whedon’s Firefly and all sorts of other fun stuff. Lucy

One way to watch this film is as the third section of an unofficial but weirdly beguiling Scarlett Johansson trilogy. She was the seductive voice of an operating system in Her and the fatally attractive human body assumed by a homicidal alien in Under the Skin. And now she’s a mind-blowing superpowered warrior woman in Luc Besson’s latest action fantasy. Besson’s script has Johansson’s Lucy as the unwitting recipient of an experimental drug that endows her with unimagined mental powers. She becomes the radically dynamic embodiment of the theories of a scientist (Morgan Freeman) who speculates authoritatively about what would happen should human beings start activating more than 10 percent of their brains’ capacity. In Besson’s hands, this becomes a flamboyantly pulpy mixture of trippy special effects, sub-Asian gunplay farce, and some facetiously cinematic pantheism. Oddball humor, some reflections on the future of human emotion, and Johansson’s vivid deadpan performance help ensure some lively entertainment amid the obvious silliness. Nobody’s Smiling Common Def Jam Recordings Nobody’s Smiling, the 10th album from Chicago MC Common, gives fans a street-level view into the heart of the rapper’s hometown. Immediately vulnerable and poignant, James Fauntleroy’s opening lines of “The Neighborhood”—“Thousand lives ago/ When we were young and we didn’t know/ We were trading our crowns for our souls”—provide the haunting aural cue supporting the entire album. The LP was produced with longtime collaborator No I.D., and a minute in, the scene-setting “The Neighborhood” explodes to life with a cacophonous blast of driving bass, blaring brass, and strings while a sample of Curtis Mayfield’s “The Other Side of Town” flushes images of pot-holed streets drowning MUSIC in an eternal drizzle. And guest Lil Herb focuses on the gritty soul of south side lifers with the heartfelt: “Small crib/ big fam/ Momma working/ granny raised us/ No food in refrigerator/ I was banging/ pulling capers.” The first single, “Speak My Piece,” evokes a Max Headroom-esque Notorious B.I.G. in its effects-heavy chorus (“I just speak my piece”) and robotic beat. On it, Common hints at the city’s hypocritical identity as he vents braggadocious: “I’m iller than most/ sick with it/ Feeling the dose/ in the butter-soft leather/ but I’m still with the toast.” Nobody’s Smiling embodies and embraces the pulse of Chicago and Common is wearing the stethoscope.

Lotus Blossom Jeff Colella and Putter Smith Capri Records This seems to be an extraordinary year for extraordinary pianists, with new releases by veterans and new-to-me pianists nearly every month. Jeff Colella, for example, falls into both categories. He’s recorded three CDs with a trio since 1997, but has worked mostly under the radar, so to speak, with vocalists. Colella spent 16 years with Lou Rawls, until his death in 2006, and also worked with a raft of singers including Kenny Washington, Anita O’Day and Dolly Parton(!). Lotus Blossom finds him in a duet setting with Putter Smith, the superb bassist with whom he’s gigged for most of the past two decades in Los Angeles. Conceived as a compact and cohesive set of music, the album features Colella probing the work of Bill Evans (a major influence) with “Time Remembered” (an Evans original), and a playfully rendered “All Blues” from the landmark Kind of Blue album made when Evans was with Miles Davis. In his liner notes, guitarist Larry Koonse calls Smith the “Thelonious Monk of the bass,” and he’s very much an equal partner in the music whose lyricism matches Colella’s. The duo’s dreamy passion is achingly apparent on “The Very Thought of You,” Smith’s introspective “Desert Passes,” Colella’s lovely “Gone Too Soon” and the title track. Highly recommended.

Stanley Ipkuss & Ewonee Thee Beatnik www.stanleyipkuss.bandcamp.com As early evening shadows grow, moods begin to perk up from underneath the stifling heat, and with indefinite, Stanley Ipkuss and Ewonee Thee Beatnik provide a musical score for your late summer haze.

The aptly titled LP is a 14-track showcase of the beautiful synergy between New York-based beat producer Ewonee, and the Bay Area-based MC. A Chico State alum, Ipkuss impresses with laid back, buttery vocals reminiscent of Q-Tip of A Tribe Called Quest—but with a slight rasp. The album is an ode to summertime activities of skating, toking and (graffiti) bombing.

Standout tracks include the opener, “SskpyInts,” on which Ipkuss bemoans the misspelling of his name by promoters, and Ewonee’s off-kilter beat is reminiscent of Madvillain’s classic Madvillainy. “Letters” features Bay Area-based Bukue One romanticizing graffiti culture; “Dopesick=\” recalls the tragic tale of an Ipkuss comrade lost to drug abuse; while “Presquevu__” features LuzID spitting crazy bars like “… drunk off of a love montage/ faces of mirages/ but you were not like some/ so with you I just saw some façade …” Full of rap and graffiti heavy-hitters, indefinite is a bicoastal celebration of hip-hop culture, and an album to close out your summer with style.

CARPE DAMN! Longtime readers know that, of all of the art subjects Arts DEVO tries to cover in this column, he is most committed to shining a light on local artists bringing something new to the scene. It’s priority No. 1. So, with that in mind, I was stoked to learn recently that Alyssa Larson and Autumn Jay—who quietly put on a much-talkedabout production of the twisted Mr. Marmalade at Lost on Main last year—are returning to the nightclub (and its now much-bigger, better-lighted stage) to put on another bit of theater wildness, Pageant Play (Aug. 14-17 & 21-22, 7 p.m.). Between the two of them, Larson and Jay have likely worked with every theater outlet in the area, and for this comedy they’ve cast a mighty local pair—Erika Soerensen and Samantha Perry—as their leads, two beauty-pageant mothers battling for the tiara.

The Cabaret had just closed, there was no place for us at the Blue Room, and things like Uncle Dad[’s Art Collective] didn’t exist yet. … bringing something fresh into the world …

The third reason we wanted to go it alone, honestly, was that we were pretty sure we could, and a lot of people were telling us we couldn’t. And that made us want to do it. … not waiting for permission to take the stage.

Any young’uns just rolling into Chico with creative thoughts running through your heads, heed those words. Your time spent in college will be better for it. Chico will be better for it. Heck, your life will be richer and more fulfilling and the world more interesting for it.

STILL MAKING THINGS HAPPEN Speaking of local fun makers, the punk-

rock collective that has kept the scene hot at Monstros Pizza for the past decade is changing its name—from Chico Area Pyrate Punx to simply Chico Area Punks. The deletion of the “Pyrate” from the name actually returns the local volunteer group back to its original moniker, as the members have decided to cut formal ties with the loosely connected worldwide network of punk-rock promoters.

In a statement on their new Facebook page—www.facebook.com/ chicoareapunks—the local Punks give props to the efforts of the Pyrate Punx to support music and thanks for the experience and memories during their association. But recently, it’s become hard to reconcile the fact that the behavior of people in some of the Pyrate chapters ran counter to the Chico group’s long-held core values: “Keeping racism, sexism, homophobia or any other form of intolerance out of our scene, while encouraging creativity, cooperation and mutual respect.”

The Punks close their statement by saying, “This will not change what we do or how we do it, and we continue to have love and respect for all our Pyrate brothers and sisters, but this change is necessary for us to continue to be true to ourselves.” Right on!

In the old days, sellers could sit back while their buyers crawled over, under, around and through a property searching for defects.

Sellers had no obligation to offer information about the condition of their property, and they usually didn’t. It wasn’t a matter of dishonesty by sellers; it was simply the rules of the road. For buyers there was no map.

Of course, most people are honest, and many sellers did volunteer well-meaning clues such as, “My wife’s uncle built the family room addition. He knows all the codes and the like”; or, “That crack in the foundation hasn’t given us any problems since we shored it up with bricks.”

Unfortunately, there were the more devious sellers. Buried tanks, looney neighbors, property-line encroachments, and youname-it, litter the landscape of the old world of nondisclosure.

The landmark case that opened up the new territory of disclosure was in 1984:

The Eastons sued the Strassburgers after the home they bought in Diablo, Calif., sank into the landfill portion of their property that they were not told about. It turns out the Strassburgers had twice filled a 10-footdeep sinkhole on the property.

The Eastons won, and legislators started drafting up new rules of the road. In 1987, it became California law for sellers to fill out the Real Estate Transfer Disclosure Statement, answering specific questions about the condition of their properties.

We’ve come a long way since then. Sellers are now on the hot seat for an immense array of disclosure requirements. And it’s not always clear what should or shouldn’t be disclosed. (Just how much of a pain in the neck is that neighbor? Is the water at the side of the house during the rainy season a big deal?)

The usual advice is for sellers to err on the side of over-disclosing. It can be a memory test, but so far, there is no requirement for a lie detector test.
