A worthy ministry Chico is without a doubt seeing an unprecedented level of

homelessness and there are most certainly problems associated with it. For starters, people are sleeping in doorways downtown. What’s worse, some are using those areas—as drunken college students have been for years— as places to urinate (or worse). Local business owners are understandably fed up (See “Clearing a path,” Newslines, by Melissa Daugherty, page 10).

Unfortunately, however, there’s talk going around town that some of the organizations providing services to the down-and-out are simply enablers.

Chico’s Orchard Church was a victim of that knee-jerk reaction during the last regular City Council meeting (see “Much ado about meals,” Newslines, by Melissa Daugherty, Oct. 17).

Its “Church on the Street” ministry has been providing meals and fellowship to the homeless at City Plaza for more than five years. But it took only days to dismantle the church’s operation, thanks in part to freshman Councilman Sean Morgan. After finding out about the gatherings, Morgan actually attempted to personally file an appeal of the Bidwell Park and Playground Commission’s vote to approve the church’s permit.

If he’d instead reached out to church leaders or visited the weekly gettogethers, he might have seen that the outreach is, as one park commissioner put it, “[T]he most peaceful event I’ve seen at City Plaza.” He also would have learned that the nonprofit has successfully helped to pull numerous locals out of homelessness. In other words, while city leaders continue to wring their hands, this small nonprofit has made progress in doing exactly what the citizens of Chico want: to find solutions to solve the local homeless crisis. And it hasn’t cost the city a dime.

Morgan did meet with church leaders after an appeal was filed, but if he gained any understanding of the mission of the City Plaza gatherings, he didn’t share any of it from the dais. Moving forward, we hope the full council will have more of an open mind. If anything, city leaders should be asking Orchard Church what they can do help with the cause. Ω

With a schedule of events that includes speaker panels, whole-group educational lectures, and workshops on specific topics, Uniting Generations for Action will focus on community building; multi-generational wisdom exchange; the intersections of water, health, fracking and food; as well as leadership empowerment. We will be discussing how we as a community can work together to advance our personal and universal calls to action. We would like representation from as many organizations as possible to create an event that highlights and empowers our diverse needs and interests.

Principal sponsors include the California Student Sustainability Coalition, the Butte County Health Care Education Coalition and the Butte Environmental Council. LaMalfa the extremist The Oct. 17 Los Angeles Times headline reads, “Rep. Doug

LaMalfa stands up for principle!” The exclamation point suggests the author is being facetious, and indeed he is. That’s because Michael Hiltzik, a veteran business reporter and columnist for the Times, believes LaMalfa is the epitome of hypocrisy in Washington.

In a July column, he noted, as the CN&R has done repeatedly, that LaMalfa and his family—wealthy rice farmers from Richvale—had received $5.1 million in federal farm handouts over the years. But when it comes to assistance to the poor, LaMalfa declaimed on the House floor, “We should be doing this as individuals, helping the poor, helping these individuals. Or through the church, if we can’t do it ourselves.”

Hiltzik then pointed out, “The number of recipients of food stamps in Butte County, where LaMalfa resides, is 27,457. That’s 11 percent of his neighbors who would go without, thanks to LaMalfa’s vote to eliminate benefits. Hope he eats well at dinnertime.”

More recently, as Hiltzik describes in his Oct. 17 column, LaMalfa was one of 144 House Republicans who voted against the compromise bill to end the government shutdown—an act of political extortion that LaMalfa also supported—and temporarily lift the debt ceiling.

By voting to continue the shutdown, LaMalfa was again standing on “principle,” Hiltzik states—the principle that government shouldn’t help the poor, that charity should be left to churches and individuals. Except when it comes to wealthy rice farmers, apparently.

Even more concerning is his willingness to allow the U.S. government to default on its debts, ignoring the fact that this country is the cornerstone of the world economy, and other nations rely on its financial stability. It’s frightening to imagine what might have happened had LaMalfa and his fellow House extremists succeeded. Ω

No good deed …

A few things stood out during the last regular City Council meeting (on Oct. 15). First, the most interesting item on the agenda turned out to be the controversy over a church whose leadership has quietly been ministering— and providing dinner to—the needy at City Plaza each Sunday for years.

Five years. Literally across the street from the City Council chambers. And now, suddenly, this is a problem.

In July, a park ranger busted Orchard Church for not having the proper permit to give out food. To be able to continue breaking bread with folks at the plaza as part of its “Church on the Street” ministry, Pastor Jim Culp had to pay $731 in city fees and get certification through the Butte County Health Department.

When the permit application came before the Bidwell Park and Playground Commission, it received approval for three months’ time, rather than the 52 weeks the church had been seeking.

As it stands, now that a formal appeal has been filed by a downtown business owner, the City Council holds the authority to allow or deny the meal-providing fellowship.

A decision is going to happen sometime in November. In the meantime, Culp and company are continuing Orchard Church’s ministry at the plaza, as they have a right to do in this public space.

The local pastor told me he’s complied with a letter from the city ordering the church to stop feeding people. However, it didn’t stop others from showing up independent of the church to pass out sack lunches this past Sunday.

Also notable: Some heavy hitters—including former Chico Police Chief Mike Maloney and his wife, Laurie—are standing up for the church. The Maloneys have long volunteered at the Jesus Center and with the local homeless and transient population the organization serves. As they point out in a letter of support, in the last year alone, the church has successfully helped transition three people out of homelessness, helped three addicts into rehabilitation, and helped three others reunite with their loved ones. “Chico hasn’t heard about any of this because the church is not doing it to get attention or credit,” reads part of the letter.

The problem for Orchard Church is timing. Its ministry came to light during the peak in talks about the problems associated with homelessness. But that doesn’t mean they’re part of the problem (see Editorial, page 4).

Another interesting point: Councilman Sean Morgan seemed shocked by the permitting process at the commission level and implied that its members had done something wrong by not informing the City Council about the church’s application. I thought that odd considering the commission is subject to the provisions of the Ralph M. Brown Act, the state open-meeting law, and thus its agendas must be posted prior to meetings.

I asked Commissioner Mark Herrera about that during Tuesday’s meeting, and he said all of the documentation was indeed posted on the city website. I checked. It was. Just a few links above that of the City Council agendas. Morgan, a council newbie, ought to familiarize himself with the Brown Act.

A few bad apples Re “Downtown” (Second & Flume, by Melissa Daugherty, Oct. 17): Ironically, Oct. 22 [the day of the City Council’s study session on downtown issues] is also the National Day of Protest Against Police Brutality. Perhaps you’re thinking, “How dare anyone question our beleaguered, beloved and overworked police force? Clearly, it’s just a few bad apples. Most police officers are just like you and me—good, decent and honorable people.”

The same applies to our community members experiencing homelessness. The biggest difference in the discussion is that it’s cool, acceptable and great fodder to pick on those facing horrific experiences every day. The other, not so much. Which one is which to whom?

On homeless youth Advocating for homeless youth is a risky venture in the current sociopolitical/economic climate of Chico. Some consider this population a nuisance, others see [advocating efforts as] charity, and still others see a wildness to control.

I personally think it is important to realize that this is a diverse population within itself.

Young homeless people are diverse in personality, as well as in levels of vulnerability.

Both of these aspects—personality/culture and vulnerability/personal history—are susceptible to public opinion. I would like to take the opportunity to present a positive picture of Chico’s homeless youth, while emphasizing the power of personal choice and the impact of personal history.

Chico’s youth services’ attempts to keep this population safe often go unnoticed. Specific agencies aside, Behavioral Health youth services and youth drop-in centers are collaborating in a positive way. Behavioral Health provides a connection to local homeless youth through the local youth drop-in center.

Drop-in centers provide safety, food, counseling and positive role-modeling. With respect to choice and freedom, I think those who access these services deserve recognition. Despite the difficulty of sharing personal history, these youths are choosing to access a system that is invaluable.

Never has Thomas been rude or disrespectful to me or anyone else.

Patrons of the bakery would buy him soup, coffee and pastries, and from time to time a gift certificate, so he could choose his own likes.

Never did I see him use the bathroom to “clean up.” He speaks softly. And if you take the time [to speak with him], he can carry on an intelligent conversation. And he has a quick wit. Thomas is far from aggressive, which isn’t always the case [with homeless citizens].

I applaud the Shalom Free Clinic for caring for Spot and for caring for Thomas. If all the panhandlers were like Thomas, I do not think there would be so much fear surrounding this topic. I wish him well. I do not see him as much anymore. I hope when I do it’s not in the paper about being arrested for “peaceful panhandling”—or for something worse.

Changes needed at Chico PD Re “Outside review needed” (Editorial, Oct. 17): I see two distinct questions regarding the use of lethal force against Breanne Sharpe. First, if she had been a college student with no record whatsoever, might the outcome have been different in the eyes of the Butte County District Attorney? Second, if a citizen had shot this young woman as she was stealing his or her vehicle, would the citizen be brought to trial for use of lethal force for what amounts to a property crime?

There isn’t much equal justice under the law these days, unless you are a cop. That is the bottom line here. Law enforcement officers are “itchy” to use all those tools they carry around, and this situation was what they considered a good excuse to do just that.

Male, female—it just didn’t matter. It is time for an outside review of this shooting and some changes in protocol for Chico police.

Opinions from retired judges and DAs after the fact won’t bring back the dead. Their opinions serve only to justify, distort or condemn the killing. There’s a big problem, and it’s not the public’s perception of facts that needs fixing. Police who brutalize and kill unnecessarily should be punished like regular people. Otherwise,

police become exceptions to the laws. Unfortunately, they’re held to the lowest standards conceivable.

Since Rodney King was brutally beaten to a pulp, things have gotten worse; the media just learned to ignore it. At least King survived his high-speed chase— barely. Now police play judge, jury and executioner, mirroring U.S. foreign policy. Power has corrupted America into a fascist police state.

Media outrage? It’s been replaced by opinions from warmongers seeking to explain away, with abstractions and warped ideologies, the inherent fascism driving our inhuman wars against entire races of people. Iraq, Afghanistan, etc., might have a weapon, so we wage war against them—killing millions. An American may have a weapon, so police kill him. However, neither had weapons. Rather than apologizing, the character assassination of the victims continues.

COP SUITS

The city of Chico is facing two lawsuits filed in federal court involving the Chico Police Department.

Former Police Sgt. Dan Fonseca claims he was terminated in violation of the Americans with Disabilities Act. The suit says Fonseca, who joined the department in 1985, suffered from the disability of alcoholism, of which he informed the city on May 14, 2012.

The city did not properly respond, the suit says. He was fired six months later after an off-duty auto accident.

A separate lawsuit filed by Joseph DeVincenzi, who was arrested in 2009 on an alcohol-related charge, claims that during transport to the police station, DeVincenzi attempted to light a cigarette with a lighter and “either accidentally set his clothing on fire or actually attempted suicide by fire.”

He suffered third-degree burns to 32 percent of his body. The suit says the responding officers knew the plaintiff had a history of mental illness and failed to locate his lighter during the arrest.

TOXICOLOGY TEST REVEALS METH USE

Breanne Michelle Sharpe, the 19-year-old who was shot to death by Chico Police Department officers last month, had drugs in her system at the time of her death, according to a Tuesday (Oct. 22) CPD press release.

Toxicology tests performed by the Butte County Coroner’s Office revealed Sharpe had methamphetamine and amphetamine in her blood at the time of the incident, the release states.

Sharpe led officers on a short vehicle chase in the early morning hours of Sept. 22 that ended in a hail of gunfire near the intersection of East Eighth Street and Vista Verde Avenue. An interagency investigation led by Butte County District Attorney Mike Ramsey ruled that the shooting was justified, Ramsey announced on Oct. 3.

FIXING DOGS AND CATS

The Butte Humane Society hit a milestone Oct. 17 with the 10,000th fix of a Butte County cat or dog. Its spay-and-neuter clinic opened in 2010 to provide a service aimed at reducing the number of local homeless felines and canines.

One cat can produce as many as 376 kittens in just three years, said Dina Soza, the BHS clinic manager, in a press release.

The low-cost service also reduces the number of cats and dogs housed in local shelters, the press release said. The surgeries are done during the weekdays at the clinic, which is located at 587 Country Drive in Chico. More information is available at 343-7917 or online at buttehumane.org/clinic.

The 10,000th surgery was performed on a dog, but because of privacy concerns associated with health issues, the name and sex of the patient was not released.

Remembering a fallen cyclist Chico’s first ghost-bike memorial will commemorate Kristina Chesterman

He later was found passed out on the floor in his apartment.

He’s since been charged with felony vehicular manslaughter, among other offenses.

“She did everything right,” Dean said of Chesterman, her voice filled with emotion. “She was wearing a helmet, she was riding in a bike lane, her bike had lights—and still she died.”

Not everyone who runs into a cyclist is drunk, of course. Last November, 61-year-old Rick Magee died after being struck in the daytime by an SUV on the

Midway, just north of Durham. The driver of the vehicle, a 71-year-old farm manager from Gridley named Tony Mardesich, later confessed to hitting Magee and, panicked, running from the scene. He was sober at the time.

Bicyclists love being outdoors,

enjoying the sights, sounds and smells of the world around them and feeling their bodies working to move them forward.

But there’s always a nagging worry as well, a faint taste of dread that comes from feeling so vulnerable to the drivers with whom they share the road.

Nationwide, more than 700 cyclists are killed each year, including about 100 in California, according to the National Highway Traffic Safety Administration.

The ghost-bike movement reportedly began in St. Louis in 2003, when volunteers began installing ashy-white bikes to remember fallen cyclists. It quickly spread, and now there are nearly 600 ghost bikes that have appeared in more than 180 locations throughout the world, from Austria to Australia by way of Belarus and Brazil, including more than 100 in New York City and a similar number in California, according to ghost bikes.org. Many of them are lavishly decorated with flowers, candles, photos and other remembrances.

The ghost-bike memorial for Chesterman will be the first in Chico.

Dean, who’s 53 years old, is a

Chico native, as is Miller, her boyfriend, who is the former owner of Miller Buick-Oldsmobile, which he sold several years ago. Both are now real-estate agents, operating as a team out of the Century 21 office on Highway 32 at El Monte Avenue.

About a year ago, they became aware that the local chapter of Soroptimist International was sponsoring a free mammogram clinic. Miller asked Dean when she’d last had a mammogram.

“About 10 years ago,” she replied. He insisted she get another. She didn’t think she needed one and didn’t want the hassle, but he was adamant.

Turned out she had a lump. A biopsy revealed it was cancerous, but it had been caught so early that she needed only a lumpectomy to be cured. She’s convinced Miller saved her life.

Since then she’s become something of a crusader for mammograms—a walking, talking example of the good they can do. She’s a runner as well as a bicyclist, and she’s set a goal of running 14 races next year—“14 in 2014,” she calls it—that benefit breast-cancer research.

This desire to give back also extends to preparing a ghost bike for the site where Chesterman was struck and mortally injured.

Sports LTD donated an old bike nobody was using, and Miller painted it white. Dean is in the process of making a placard for it that will include Chesterman’s name and date of death.

Dean’s not saying whether she will be directly involved in setting up the memorial. Local authorities don’t always welcome the bikes, so traditionally they’re installed anonymously, usually at night.

Dean says several people have volunteered to place the bike, and in fact it may be up by the time this story appears.

One person who is excited about the memorial is Janine Rood, executive director of Chico Velo Cycling Club. The more motorists are aware of the dangers cyclists face, the better, she believes, and “when you see a bike that’s 100 percent white, it really stands out.” Ω

“Cozy Diner? Get some coffee?” suggested another man, as a third chimed in, “Maybe we can all get arrested there.”

There was still a fair bit of courtroom drama that morning when Bird, charged with the infraction of fishing without a license, faced Judge Jonathan Skillman.

Bird is a longtime political provocateur from the small community of Rancho Tehama whose campaigns include attempts to place state Sen. Jim Nielsen (who was a state assemblyman at the time) under citizen’s arrest for living outside the district he represents. Bird was cited for fishing without a license on Aug. 14, after casting his line into the Sacramento River below the Red Bluff Diversion Dam. He contends that the state requirement for a fishing license is unconstitutional, citing Article I, Section 25, of the California Constitution, which states: “The people shall have the right to fish upon and from the public lands of the State and in the waters thereof, excepting upon lands set aside for fish hatcheries, and no land owned by the State shall ever be sold or transferred without reserving in the people the absolute right to fish thereupon …”

Shortly after the citation, the California Department of Fish and Wildlife sent Bird a letter explaining that the constitutional passage also entitles the department to regulate fishing to maintain healthy fisheries, Wildlife Officer Mitch Carlson—who issued Bird’s

citation—told the court.

Bird pleaded “innocent” to the fishing charge at a Sept. 23 arraignment and was informed he would be granted a court trial— ruled upon by a judge—rather than a jury trial. Bird said this is a further assault upon his rights, particularly those guaranteed by the Sixth Amendment of the U.S. Constitution. He said this is indicative of a systemic problem in California courts in which people charged with infractions aren’t entitled to a jury trial, a right reserved for those charged with misdemeanors and felonies.

This set the stage for the Oct. 16

proceeding where Bird—who opted, as in past legal confrontations, to represent himself—arrived hoping to shake up the system.

The proceedings began with Carlson’s narrative of the events of Aug. 13, detailing how Bird informed him earlier that he had a constitutional right to fish without a license, and that he wanted to be cited so he could take it to court.

“He told me he would contact me in the future to let me know when he was fishing without a license so I could issue him a citation,” Carlson said. “I informed Bird that this energy would best be spent on something else, because a judge would find him guilty if he decided to fish without a license. I then left the area.”

Carlson encountered Bird in the same spot the next day; the officer said Bird informed him of his intention to be cited, walked to the waterside and, in the officer’s plain sight, cast his line into the water.

When it was his turn to speak in court, Bird said, “I want to file an objection with this court for denying my constitutional right to have a jury trial.”

“Overruled,” Judge Skillman responded without hesitation, explaining that California Penal Code Section 19.6 says that since infractions are not punishable by jail time, the defendant is not entitled to a jury trial.

Skillman said the fine would be $460, reduced to $181 if Bird gets a fishing license.

“Will you be getting a license sometime soon?” Skillman asked.

“No, sir.”

“Then the fine is $460. How much time do you need to pay it?”

“I’m not going to pay.”

With that, Skillman warned Bird that nonpayment would go to collections, resulting in an additional $300 civil-assessment fee, and the case was concluded. Outside the courtroom, the disappointed-but-still-smiling Bird said, “Well, I guess it’s time for me to go fishing again. I’ll try Glenn County next time.”

Perhaps he won’t have to. In a follow-up phone interview on Monday (Oct. 21), Bird’s ire was again at full boil, and he said he’d just spoken with a Sacramento lawyer who told him his fight may not be at an end, but just beginning.

“The lawyer said there’s a good chance we can have a constitutional case in federal court on this,” he said, adding that he couldn’t go into details yet and has a pending meeting with the unnamed attorney.

“In my opinion, Tehama County violated my rights numerous times on this jury situation,” he said. “After discussing it with this lawyer, I think Mr. Skillman might regret finding me guilty down the road.”

past three years, delivered an insightful and at times humorous talk to a nearly full house in Chico State’s Laxson Auditorium on Tuesday (Oct. 22).

“I am Ari Shapiro, and you all look nothing like I thought you would,” he began, reversing the role of what radio audiences often think of the faceless reporters they listen to on air.

After that ice-breaker, Shapiro localized himself by announcing he has an aunt who lives in Willows and his uncle was once the principal of Gridley High School.

Early on in his career, he covered the Justice Department, he said, and “with the excitement of being a kid, I called my mom and told her I’d just talked with [Supreme Court] Justice Anthony Kennedy. And she said, ‘Couldn’t you talk to a liberal justice?’”

Shapiro expressed the importance of maintaining a politically neutral posture as a reporter, particularly one covering the White House. When asked later in the evening if NPR is “liberal,” he said he didn’t think so.

“Of course, if you listen to Rush Limbaugh all day, NPR will come across as liberal,” he said.

“But then there’s the very idea that there could be a nonpartisan media. We are human after all, and therefore not perfect.”

Shapiro, who is transferring to London to serve as an overseas reporter, said that early on in his White House coverage he was approached by President Obama.

“He said, ‘You’re pretty new.

What do you think so far?’ I said, ‘My mind has never been so focused on a person as I am with you. Frankly, I’m a little obsessed with you.’ He said, ‘I’m sorry to hear that.’”

Once while flying with the president on Air Force One, Shapiro said, he was in the back of the aircraft eating a plate of pasta covered with marinara sauce.

“The president comes to the back of the plane, which was unusual, and I have a plate of red sauce on my lap and I can’t get to my microphone. So I’m in a position where I can either soak the leader of the free world with red sauce or not do my job.”

He said the current political divide in Washington, which led to a government shutdown, is due in part to changing demographics— namely the shrinking influence of white America, which by 2043 no longer will be in the majority. Congressional districts, as redrawn, he said, are dominated by either a hardcore conservative voter base, or a more progressive-leaning demographic. As such, he said, the art of political compromise, the willingness to reach across the aisle, is disappearing.

“In February, the debt-ceiling debate is coming again,” he reminded his audience. “Of course, by that time I’ll be in London.”

He said he recently spoke with a political reporter in Britain who told him that Scotland is looking to secede from the UK. He said the reporter told him that politics in Britain “are crazy.”

“Then he looked at me, paused, and said, ‘Well, not that crazy.’”

sions on curbing transiency and crime—at the City Council’s next regular meeting on the first Tuesday of November.

That was one of the main results of a special study session Tuesday evening (Oct. 22) at the Council chambers, a meeting during which the hundreds of citizens in attendance insisted that the public—and especially businesspeople—needed the council to take quick and decisive action to put an end to issues plaguing the city, and downtown in particular. Loitering, trespassing, aggressive panhandling and camping were among the problems they say are blighting the area and driving away potential visitors.

“The message is loud and clear,” said Mayor Scott Gruendl near the conclusion of the meeting.

Much earlier, he had implied that work on solutions could continue into March. “As winter bears down, we have an opportunity to focus on … everyone’s input, and having it in place and operative before spring comes.”

Minutes earlier, Gruendl and five of his council colleagues (Councilwoman Ann Schwab recused herself because the meeting focused on downtown and she co-owns a business in the area) listened as members of the community, as well as some members of the city staff, read off the priorities that the public had come up with to curb crime and transiency. The ideas surfaced during exercises that divided the nearly 300 people present into six groups tasked with creating lists of what services the city should provide and how enforcement should be handled.

Initial answers from citizens ranged from costly requests such as bringing back the Chico Police Department’s TARGET team and placing infrared lights at all four corners of City Plaza, to prohibiting the distribution of food to the homeless at the plaza and outlawing shopping carts in downtown.

When distilled, the top priority among the five groups focused on enforcement was to fund the Police Department at a full staffing level. Next, a majority of the groups said the city needed to begin enforcing existing ordinances, laws such as the one prohibiting camping in public places and another on loitering. The civil-sidewalks ordinance (or “sit/lie” law) was another popular choice. The top priorities among those focused on services included the city establishing a daytime resource center, setting up a housing camp, and improving outreach and education.

After hearing from the groups’ leaders,

Councilman Sean Morgan wasted no time in throwing out a motion that the city attorney draft another civil-sidewalks law to deal with the transients who regularly sit and lie in pedestrian paths of travel.

Many of the council members sounded receptive to the idea after hashing out concerns that led to the panel nixing the idea back in August.

Councilwoman Mary Goloff, for example, explained that she’d voted against the first version of the proposed ordinance because she believed it didn’t “have teeth.” Councilman Randall Stone was

concerned that Chico Police officers would be pulled away from their duties to deal with court proceedings resulting from citations issued to lawbreakers.

Councilwoman Tami Ritter—who, along with Goloff, Stone and Gruendl, voted down the ordinance when it first came before the panel—urged caution on the law. She pointed out, as many citizens had, that the city wasn’t using laws already on the books.

“What would the community look like if we were enforcing the no-camping ordinance, if we were enforcing the loitering ordinance, and if we were prosecuting for nuisance?” she asked. “Let’s give it a try.”

Assistant City Manager Mark Orme and Assistant City Clerk Dani Brinkley come up with a condensed list of priorities based on feedback the public had submitted on Post-it notes.

Ritter also sought information regarding the vagrancy on off-sidewalk areas, including the grassy regions in front of the City Council chambers and at City Plaza, where transients congregate and, in some cases, set up encampments. She learned that the civil-sidewalks ordinance would not be applicable to those areas.

District Attorney Mike Ramsey said the concern about officers going to court assumes those cited would challenge a citation. He said that would be difficult to do and urged the council to pass the ordinance.

“What you need to understand is that right now, if [Police Chief Kirk Trostle] or any of his officers went out, and there was someone lying on the sidewalk, they can do absolutely nothing about that,” he said. “If what you’re interested in is clearing your sidewalks, you need to give your police the tools to move people along.”

His answer for the grassy areas: “Sprinklers.”

The Butte Environmental Council celebrated its 38th anniversary this year by throwing a gala fundraiser on Oct. 19 at the Arc Pavilion, featuring an awards ceremony honoring three prominent local environmentalists.

Octogenarian Wes Dempsey, a retired Chico State professor of biology and one of the original members of BEC’s board of directors, was honored with the inaugural Michael McGinnis Lifetime Achievement Award, according to a BEC press release. Dave Garcia, a local anti-fracking activist and retired California State Park ranger, received the Colleen Jarvis Environmentalist of the Year Award, and the Barris Farms Service Award was given to Susan and Stephen Tchudi, cohosts of Ecotopia, a weekly eco-focused show on KZFR 90.1 FM. “I am continually amazed that so many people have been engaged in such good work for the betterment of our community,” said Mark Stemen, chairman of the BEC board.

WARMER WATERS, MORE MERCURY?

Warming water temperatures due to climate change have been fingered by scientists as a cause of rising levels of mercury in fish.

In an experiment involving killifish—a small forage fish living off the coast of Maine— researchers discovered that raising water temperature resulted in a rise in the species’ metabolism and appetite, according to an article in The Washington Post. Their increased appetite corresponded with a higher-thanusual storage of methylmercury from their food sources in their body tissue. “[K]illifish at the bottom of the food chain will probably absorb higher levels of methylmercury in an era of global warming and pass it on to larger predator fish, such as the tuna stacked in shiny little cans in the cupboards of Americans and other people the world over,” the article said.

Methylmercury has been linked to heart attacks, high blood pressure and kidney disease in adults, and neurobehavioral delays in children.

MOOSE IN TROUBLE

North American moose populations are in alarming decline, and the causes are still unclear, though climate change has been identified as one likely culprit.

In Minnesota, for instance, one population of moose has declined from 4,000 to fewer than 100 since the 1990s, according to The New York Times. A second group of moose, in the northeastern part of the state—currently down to fewer than 3,000— has of late been reducing in numbers by 25 percent per year.

New Hampshire and Montana, and the Canadian province of British Columbia, have been experiencing similar declines.

Heat stress and an increase in ticks due to shorter winters are a couple of the major factors implicated in the die-off.

‘Climate shifts’ Prominent local environmentalists weigh in on IPCC’s latest climate-change report by

mental issues, and along with their responsibilities as Chico State faculty members, both have assumed leadership roles in ecological organizations. Pushnik is director of the university’s Institute for Sustainable Development; Stemen is president of the Butte Environmental Council’s board of directors.

So, it’s not surprising that both are deeply interested in the latest update from the Intergovernmental Panel on Climate Change. The IPCC recently released its fifth assessment report titled “Climate Change 2013: The Physical Science Basis”—comprising research and analysis of more than 250 experts from 39 countries. It follows up on the previous assessment, which came out in 2007.

After digesting the latest findings, Stemen and Pushnik came to the same overarching conclusion: The effects of climate change are so profound that a corresponding degree of human-activity change is not only justified, but also required.

As per usual, though, the friends disagree on how exactly to move forward.

Pushnik, a biological scientist, believes in evolutionary processes. He says making incremental adjustments is the best way to ensure lasting change.

Stemen, a professor of geography and planning, tends to favor bold strokes. From

his vantage point, the environment has already sustained so much damage by our own actions that we shouldn’t get bogged down by what his colleague referred to as “argumentation paralysis.”

The two have spirited debates. In the end, however, they head in the same general direction, now further emboldened by the IPCC assessment.

“All fingers point to human activity,” Stemen said, “that we are changing the climate, and it’s not going to be good, and it’s going to last a long time. They [authors of the IPCC report] talk about how ‘a large fraction of anthropogenic climate change ... is irreversible on a multicentury to millennial time scale’—basically, we may have already done so much harm to the Earth that it can’t even be undone in our lifetimes or the lifetimes of future generations. Yet we’re still doing it and we’re not even talking about stopping. That hit me in the gut.”

Pushnik didn’t have such a visceral reaction: “I don’t think that there is any real major message change from the fourth assessment.” He is eager, too, to see what the IPCC has to say about the social impacts of climate change and how to mitigate the effects, which will be covered in subsequent reports released over the next year.

Nonetheless, he agrees with Stemen that change—as far as a response from

humankind to the rapidly changing climate—is going to come. Indeed, he indicated, it must come, and more quickly than seems possible amid legislative gridlock.

“The only way this ultimately gets resolved is through engaged, enlightened citizens,” Pushnik said. “I think every community should take personal engagement and leadership, as this town has. …

“My concern is that the process is too slow. We’re going to run up against a catastrophe, and then we will respond, no question. But what are the consequences of action later rather than proactive prevention now?”

The new report highlights a range

of environmental impacts due to carbondioxide emissions—many relating to the waters that cover more than two-thirds of our planet. Fresh studies of receding ice packs in the Arctic and Antarctic regions have prompted the IPCC to double its estimate of how high ocean levels will rise by the end of the century—to 1 meter. Generating less attention, but just as compelling as ice-shelf melts, is the increasing level of acidity in bodies of water around the world.

“The pH of the oceans has dropped by— what to non-chemists will seem like an insignificant amount—about .1 pH,” Pushnik said. “In reality, that is a huge shift, particularly for shell creatures and those kinds of life that depend on the condition of the ocean for existence.”

impact of aerosols and smoke. In short, clouds tend to have a warming effect, and while smoke/ aerosols have a cooling effect, they are counteracting less warmth than was thought before.

The biggest controversy from the report stems from temperature levels. Critics, including climatechange skeptics, cite readings that don’t mesh with the models used by the IPCC report. Some dissenting scientists even postulate a “global-warming pause”: A recent study done at the Scripps Institution of Oceanography in San Diego argues that what some perceive as a recent decrease in global warming is the result of variations in the El Niño/La Niña cycle, not proof that global warming has ceased.

Stemen has a blunt reaction: “To challenge the credibility is just to beg for a different conclusion.”

Pushnik cautions against bestowing equivalency to each side in the argument: The leading group of scientists refuting manmade impacts on climate has a number of around 50, he says, while more than 1,000 scientists from around the world support the IPCC’s findings.

In addition, he said, “it’s easy to point at anomalous kinds of things.

We see that certain glaciers are actually growing, which sounds counter to the whole argument. But that’s really a function of shifting climate conditions: Some areas are going to see differing precipitation than they’ve seen in the past.”

Both Pushnik and Stemen are pleased with local responses, particularly the Climate Action Plan developed by the city of Chico.

Stemen, an appointee to the city’s Sustainability Task Force, says specific emissions goals in the CAP may warrant re-examination in light of the IPCC update, though this process—and the role the STF might play in it—remains uncertain in light of budget cuts, layoffs and reorganization at City Hall.

“The question isn’t necessarily if it’s happening or not—it’s ‘What are we going to do in response to it?’” Stemen said. Ω

VETERANS’ PRIVACY BREACHED

The Department of Veterans Affairs is responsible for thousands of privacy breaches under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) since 2010, an investigative report has revealed.

A two-month Pittsburgh Tribune-Review investigation found that VA employees or contractors were responsible for 14,215 breaches, such as stealing veterans’ identities or prescriptions, and posting Facebook pictures of veterans’ body parts, according to California Healthline. The investigation concluded that the VA lacks accountability, has poor safeguards in place, and fails to encrypt computer data.

“It’s hard to argue against the notion that [the] VA holds the dubious distinction of being the largest violator of the nation’s health privacy laws,” said Deven McGraw, director of the Center for Democracy & Technology’s Health Privacy Project.

COVERED CA GOING STRONG

Nearly 95,000 applications for health-care coverage were started through Covered California after the first two weeks of open enrollment.

Though the website for the state’s healthinsurance exchange under the federal Affordable Care Act, or Obamacare, was marred by technical difficulties in its opening week, consumer interest has been strong, particularly considering that each application could represent a household of more than one person, according to the Los Angeles Times. Compared to the first week, Web traffic decreased from 987,000 unique visits to 603,000, while calls decreased from 59,000 to 46,000.

Covered California won’t release figures regarding how many people have opted for private insurance or coverage through the expansion of Medi-Cal until November.

The deadline for consumers who want health coverage starting Jan. 1 through Covered California is Dec. 15, though enrollment will remain open through the end of March.

NO NURSE FOR YOU

Less than half of the Golden State’s school districts have a full-time school nurse.

A report compiled by researchers at Sacramento State University found that 57 percent of school districts are without a full-time nurse, according to California Healthline. The report also found wide variation in the number of students an individual school nurse is responsible for, from 180 to more than 20,000.

Dian Baker, a CSU researcher involved in the report, said the capacity of schools in some areas to provide health services to students “is so low that the safety of these children might be at risk.” The National Association of School Nurses ranked California 45th in the nation for access to school nurses.

School districts have cut back on school nursing staff to reduce costs, opting rather to hire health aides and train school staff to administer students’ medications.

Chronic pain at age 12 A local athlete’s successful search to relieve her long-term lower-back pain

Utore has no recollection of her first experience on water skis—she was 2 years nderstandably, Genna Pinga-

old—but clearly remembers the 2006 injury that prevented her from defending her national water-skiing title and the recurring pain that sidelined her for years.

The bubbly 18-year-old Butte College student plays lacrosse competitively, has a love for hiking and distance running, and is “just getting into rock climbing,” she said during a recent interview in downtown Chico. Last year, she gave up competitive water skiing for good, though she’s still open to doing it recreationally.

“It takes away your summer. I would fly back to Florida and Louisiana for professional coaching, which is very expensive,” Pingatore said, also describing the unforgiving nature of the competitions themselves: “You only get one shot—if you fall, you’re done.”

At 10 years old, she was ranked the top water skier in the nation for her age group by the USA Water Ski association, setting a regional record during an out-of-state tournament. “I was very good,” she admitted bashfully.

The following year, when she was 11—only a day before she was scheduled to leave for a regional water-skiing competition in Washington—Pingatore was horseback riding with a friend. Her horse came into contact with an electric fence and began to buck.

“I got ejected off the horse and hit my

back on a telephone pole,” she recalled. “It was incredibly painful. My mother picked me up and set me down on this counter, and I just started screaming; I could feel these shots [of pain] going down my back.”

An emergency room visit revealed that the impact had fractured parts of her sacrum (the large, triangular bone at the base of the spine that connects to the tailbone) and her ischial tuberosity (part of the hip bone). For the following six months, she used crutches to walk, and sitting upright was excruciating.

Though it was a “miserable” setback, as she described it, Pingatore was able to resume training the year after her accident and reclaim her top spot in the nation, but the injury became a source of long-term discomfort.

“Any time I would run or do any sort of endurance activity, my back would flare up,” she said. “In lacrosse [at Chico High School], I could only play half the game—

in the second half, I would be in too much pain and would have to ice.”

And so Pingatore lived with chronic lower-back pain for four years, starting at age 12.

Enter Dr. Holly Kelly of Marin

Orthopedics and Sports Medicine in Novato. During a recent phone interview, Kelly said she first met Pingatore in 2011, when she was 16.

“Her mom and brother were patients of another doctor in our office,” she recalled.

“Her mother had mentioned to the physician a little bit about Genna’s story. She ended up coming into the office and I diagnosed her with sacroiliac joint invariant dysfunction.”

Kelly’s original suspicions about Pingatore’s condition were confirmed after injecting the problem area with cortisone, after which Pingatore was provided only a couple weeks of pain relief. “We needed a longer-term solution,” Kelly said.

Americans are becoming more physically inactive, due to factors such as an increase in sedentary jobs—which have risen 83 percent since 1950—and increased availability of mass transportation, according to the American Heart Association. The results are disturbing: More people are overweight (68 percent of adults are overweight or obese), it has become more difficult to live an active lifestyle (Americans work at their increasingly sedentary jobs 164 more hours per year than they did 20 years ago), and people’s excess weight is costing businesses $225.8 billion annually in health-related productivity loss.

competition of her childhood, it’s perhaps unsurprising Pingatore would be drawn to a team sport like lacrosse as an adult. She said the team aspect is what she likes most, though the travel has also been a perk.

Last year, Pingatore traveled to Japan with a women’s lacrosse team assembled by a coach at UC Santa Barbara. Her squad played six games against teams from colleges in the Tokyo area, winning three of them. It was a “fantastic experience,” she said, recognizing that such an adventure wouldn’t have been possible if she hadn’t undergone the procedure with Kelly.

Since Pingatore is young, the nerves in her sacroiliac joint regenerated within two years of the initial procedure. This past February, she went back to Marin Orthopedics and Sports Medicine for a second round of treatment. She has been completely pain-free since, and this past summer (with competitive water-skiing out of the picture) she was able to visit Zion National Park in Utah with her family, where she tried her hand at rock climbing.

Knowing Pingatore has been able to fully pursue her interests has been tremendously rewarding for Kelly.

“Having chronic pain starting at age 12 is unacceptable,” Kelly said. “It’s been a joy to watch her after she’s been treated. That’s the best thing about being a doctor— watching your patients get back to the sports and hobbies they enjoy.” Ω

RECYCLE THIS PAPER.

The sacroiliac joint isn’t designed to move like an elbow or a knee joint, Kelly explained. It’s held in place by ligaments on either side of the joint, and serves to stabilize the pelvic area.

“When you have a trauma to the pelvis, what you can end up doing is stretching those ligaments that hold the joint in place and the joint becomes more mobile,” Kelly said. “Then, any time you walk or bend or twist, that joint will shift a little bit, and that becomes very painful. You have bones moving that aren’t really meant to move that way.”

The procedure subsequently performed on Pingatore—called “cooled radiofrequency denervation”—uses a long needle heated with an electric current to cauterize the nerves that provide the pain signals to the sacroiliac joint.

While radiofrequency treatment has been used since the 1990s, Kelly said it was deficient in that it was unable to reach the full “spiderweb” of nerve endings running in and out of the sacroiliac joint. The water-cooling system, introduced about four years ago, “keeps the tip of the needle cooler so you can add more power, and spread that area of heat so it doesn’t just stay in one position. You’re able to make a more three-dimensional lesion.”

While Pingatore admitted the needle involved was frightening, and the procedure itself was painful, she said it was ultimately worth it. Within two weeks of the procedure, she was fully back into her athletic routine and found she was “able to run longer and farther without any of the pain.”

nless you know what you’re looking for, Dashmesh Darbar, Northern California’s newest gurdwara, or Sikh place of worship, isn’t easy to find. The only outward sign of its existence is a white board with the word “GURDWARA” penned in black ink and an arrow directing the faithful to an office space tucked behind the Italian Cottage off of Dominic Drive in Chico.

On Sunday mornings, while the restaurant’s patrons sip champagne and eat omelets served on red-and-white-checkered tablecloths by costumed waitresses, local Sikhs engage in a more austere and veritable cultural tradition—the diwan, or religious service—just steps away.

Behind the gurdwara’s tinted glass door, an elderly, turbaned man named Jasbir Singh sits cross-legged on a raised platform covered in bright-blue material behind the Guru Granth Sahib, the main holy scripture of Sikhdom, which adherents revere as more than just a book—they see it as a sovereign, active and living Guru. Worshippers remove their shoes and cover their heads before entering the temple, and once inside, place an offering (usually a few dollar bills) before the Guru, push their hands together to pray, then drop to their knees and bow until their foreheads touch the carpeted floor. They then join the rest of the sangat, or congregation, at either side of the room.

On a recent Sunday, the diwan’s attendance numbered about a dozen, predominantly made up of women in traditional Indian garb, with long scarves covering their heads. Also present were a few men, most dressed in slacks and button-up shirts, and a pair of young boys who fidgeted— as boys of any faith might do—throughout the diwan, their actions intermittently corrected by

stern glances from nearby adults.

For two hours, those present shared in the duty of leading sacred chants in Punjabi, taking turns singing out alone as the rest sang responses in chorus. At one point, two of the women in attendance produced a harmonium (small pump organ) and a tabla (drum), to accompany the group in the singing of devotional hymns. At the end, Singh circled the room, smiling as he handed out the karah parshad, a sweet sacramental food that tastes something like cookie dough.

Though the diwan may seem exotic and strange to those unfamiliar with Sikhism or Indian customs, it’s actually something that’s been happening regularly in the North State for more than 100 years. Beginning in 1903, thousands of Indian immigrants—mostly Sikh, but also some Hindu and Muslim—came to Northern California to work. Some helped build railroads, while many worked on farms as their ancestors in the Punjab region of India had done for centuries.

Many stayed in the fertile Sacramento Valley, and today, Yuba City—where all three area high

schools teach Punjabi as a second language, and fresh samosas are as readily available as cheeseburgers or burritos—is home to one of the largest Sikh populations outside of India.

More continue to arrive, joining American Sikhs of Punjabi ancestry who can trace their local heritage back further than many WASPS (White Anglo-Saxon Protestants) and adding to the racial and spiritual diversity of Northern California.

Sikhism’s most sacred traditions is the langar, a communal meal which anyone, of any faith, is welcome to attend. Vegetarian meals are cooked by gurdwara members and provided to anyone who cares to sit in, free of charge.

“There is only one God,” Singh, the gurdwara’s granthi—or caretaker—offered in a thick Punjabi accent, holding up his index finger for emphasis, when asked about the basics of Sikhism. He paused, smiled behind his long and immaculately maintained facial hair and shook the finger as he added, “Too many names,” indicating the Sikh belief that all of the world’s deities are one. To illustrate further, he took a poster from the wall with symbols from many of the world’s religions arranged in a wheel, all radiating from a central point representing enlightenment.

Sikhism is the fifth largest religion in the world, with about 30 million adherents. It is monotheistic and, despite some perceived similarities to Christianity and Islam, as well as an open and accepting attitude toward other religions, is entirely its own philosophy.

The religion was founded by Guru Nanak—the first of 10 Gurus—in the 15th century. Sikhs believe that secular and spiritual life are intertwined, and the best way to know God in one’s heart is by living a good life. Guru Nanak taught that Sikhs should work hard to make a living, without begging or being deceitful, and also to share the fruits of these labors with the less fortunate. Sikhs are encouraged to participate in acts of selfless service, called seva. Sikhism’s guiding principles are truth, equality, freedom and justice.

Sikhs believe all people—regardless of race, sex or creed—are equal. Since Guru Nanak’s day, they have denounced the caste system, with many Sikhs disregarding their family names and the ranks they imply, instead adopting the last names Singh (meaning lion) for men or Kaur (princess) for women.

As Chico Sikh Surinder Bhandal explained, the langar embodies many Sikh ideals. “It shows that we are all one,” she explained as everyone present shared a vegetarian meal of spicy chickpeas, long-grain rice, sweet yogurt, cheese curds and delicious homemade naan. “There are no classes or castes, no differences between men and women, and different religions do not matter.

We are all equal.”

In urban areas, Sikhs often take the langar out of the temple and into the streets to help the homeless and other underserved communities. working under the name SEVA: Selfless Service, for example, organizes weekly free meals, primarily in downtown Sacramento and San Francisco. They serve everything from traditional Indian dishes to vegetarian pizzas and, on one recent outing in Yuba City, peanut-butter-and-jelly sandwiches made by elementary-school-age Sikhs who raised $80 to buy all of the ingredients.

Singh came to Yuba City from the Indian state of Punjab in 2005, but stayed there only two days before moving to Chico to work in a Sikh-owned gas station. Feeling it was too much of a strain—especially for elderly Sikhs—to travel to Yuba City once or more weekly, he saved money and obtained the necessary permits to open Chico’s first gurdwara last January.

Singh estimates that 50 Sikh families live in Chico, and listed numerous Sikh-owned businesses, including several gas stations, some 7-Elevens, Little Caesars Pizza and Gogi’s Café.

In addition to the Sunday diwan, other services are held throughout the week at the gurdwara. Singh also hosts Punjabi classes for young Sikhs to help them connect with their heritage.

Singh, with his distinctive facial coiffure,

is what is known as a baptized Sikh, one who has “taken amrit,” or undergone a special ceremony involving anointment with holy water. In order for Sikhs to be baptized, they must dedicate themselves to living life as laid out by the Gurus, remain vegetarian, and always carry five articles of faith, known as the “five K’s.”

The five K’s are Kesh (long, uncut hair), Kangha (a small wooden comb for maintaining the Kesh), Kara (a metal bracelet), Kacherra (an undergarment) and Kirpan (a small sword or dagger).

The majority of modern Sikhs are not baptized and thus do not maintain the five K’s.

The most common “K” maintained by many Sikhs, even those who are not practicing or actively engaged in their religion and are Sikh only by heritage, is the Kara. Also, Kirpans have evolved from the original long, curved sword to take forms that make it easier to get

The history of Sikhs in America, like that

of many minorities, has not always been one of openness and acceptance. Beginning in the 1920s and for much of the next four decades, Sikhs were subject to anti-Asian immigration laws that for many years stemmed the migration of Sikhs to the United States altogether, and naturalized Sikhs were barred from owning land or exercising some rights enjoyed by other American citizens. As these laws were loosened or abolished in the 1950s and ’60s, the United States saw large influxes of Sikhs.

They have also been persecuted in other countries, including India, where Sikhism was born in the Punjab region. Throughout their 500-year history, Sikhs have been forced

to fight to protect their way of life.

Throughout the 1970s, efforts by Punjabi Sikhs to obtain autonomy were met with armed responses and arrests by the Indian government, then led by Indira Gandhi. This escalated until 1984, when Indian forces surrounded one of Sikhdom’s most holy sites, the Harmandir Sahib (or Golden Temple) in the city of Amritsar, India, killing hundreds.

In response, two of Gandhi’s Sikh bodyguards assassinated her on Oct. 31, 1984.

This led to anti-Sikh riots and attacks that killed an estimated 8,000 Sikhs and displaced a great deal more.

Sikhs have also had a rough time in post9/11 America, the victims of Islamophobia because of their perceived resemblance to Muslims, largely incited by the fact that many Sikhs wear turbans; in fact, more than 95 percent of turban-wearers in the U.S. are Sikh.

Last year, Wade Michael Page, a white supremacist and U.S. Army veteran, entered a Sikh gurdwara in Oak Creek, Wis., and opened fire with a 9 mm handgun. He killed six Sikhs—five men and one woman, ages 39 to 84.

Just last month, two high-profile examples of Sikh persecution made headlines.

Prabhjot Singh, a doctor and Columbia University professor, was beaten near New York City’s Central Park on Sept. 21 by 25 to 30 men who yelled, “Get him! Osama!” The professor underwent surgery to his jaw as a result of the attack.

Also in September, the American Civil Liberties Union announced it was representing Jagjeet Singh, a California truck driver who was pulled over for a flat tire last January in Mississippi, and arrested by officers from the state’s Department of Transportation for refusing to turn over his three-inch Kirpan. During the arrest, the officers allegedly remarked that “all Sikhs” are “despicable” and “terrorists.” When he appeared in court two months later, a judge demanded he “remove that rag” from his head.

The victim of the New York attack responded in a way that shocked many; in an op-ed piece penned for the New York Daily News and published by other news outlets, he forgave his attackers, inviting them to come to the temple he attends and learn about the Sikh faith, and expressed hope that his attack would open up conversations about prejudice and what it means to be an American.

Every year, during the first weekend of

November, between 60,000 and 100,000 people—the overwhelming majority of them Sikh—converge in Yuba City for a three-day festival celebrating the 1699 inauguration of the Guru Granth Sahib. They come from all over the United States—some even from overseas—to celebrate and participate in Sunday’s Nagar Kirtan, a parade that arguably qualifies as the largest religious procession in the United States, and definitely as the city’s largest civic event. This upcoming event marks the festival’s 34th year.

onion-shaped top of which rises above the surrounding orchards.

There are fireworks on Friday evening, and a weekend-long openair marketplace at which vendors sell everything from kirpans to Bollywood DVDs and novelty T-shirts reading “Proud to be Punjabi” or “Supersikh” written like the Superman logo. The parade is the largest event, complete with floats, music, dancing, religious chants, and a helicopter dropping rose petals on the crowd.

One thing not for sale is food or drink of any sort. It is provided—in fantastic abundance—for free. An estimated 400,000 meals are given away over the course of the weekend. During a recent visit to the temple on a weekday afternoon nearly a month before the festival, the interior was abuzz with preparation. As a group of men and women engaged in 48 straight hours of reading holy scripture, broadcast throughout the building, more than a dozen men and women worked in the kitchen, doing early preparation of the festival’s food.

Kashmir Gill, the once and future

mayor of Yuba City, said the festival’s benefit to the area—culturally and economically—cannot be overstated.

In 2009, Gill was sworn in as mayor, giving him the distinction of being the United States’ first Sikh mayor, first mayor of Punjabi descent, and among the first people of Indian origin to hold such a position nationwide. He is currently a City Council member and will assume the mayoral position again in December (in Yuba City, the top

two vote-getters in City Council elections both take a one-year turn as mayor). There is currently another Sikh serving on the council, as well—Tej Maan.

“It was interesting, and very humbling,” Gill, who goes by the nickname Kash, said of becoming mayor during a recent interview in his office at Mechanics Bank, where he serves as vice president and senior relationship manager. He also graduated from Chico State University with a degree in agricultural science, and owns a farm in the area.

“We had reporters from Canada, India, London, all the major U.S. networks,” he said, referring to his 2009 inauguration.

Gill has lived in Yuba City most of his life, having arrived with his

parents from Lakhsina village in the Hoshiarpur district of Punjab in 1967, at age 2. His family’s history in the area dates back even further, to the first wave of Punjabi immigrants in the early 1900s. His parents were sponsored by his uncle, Didar Singh Bains, a locally famous farmer who at one time produced more peaches than anyone else in the world (“He owned orchards from Chico all the way to Bakersfield,” Gill said).

Gill offered plenty of perspective on his faith, the history of Sikhs in the region, and the community he serves.

“Yuba City was an early hub [of Punjabi migration],” he explained, saying other large enclaves of Sikhs include the Bay Area and New York City. “Everyone has gone out, but

it’s like a tree, and all of the roots of the tree are here. You can talk to Sikhs around the United States and ask them who they’re related to, and it all comes back here, because it pretty much originated with 10 families that came here.

“And of course it’s known as a very important agricultural area,” he continued. “Many Sikhs here are doctors and lawyers and professionals, but agriculture is still very important.”

Gill said that, like many immigrants, his parents first worked in fields and orchards owned by more established family members, work that he and his siblings joined in on when they were “old enough to climb a ladder to pick prunes, peaches and almonds.”

Remembering more of his childhood, Gill continued: “Before the local temple got built in 1969, the closest one was in Stockton, so we’d all go on the weekends; two families would pile into one car and we’d drive for what seemed like all day.

Sometimes we’d spend the whole weekend there, basically camping out at the temple. As a kid, it was great to go to temple and worship, but it also had a railroad line right out back and we’d go play with all the other children by the tracks.”

Still, Gill’s childhood memories aren’t all as halcyon.

“Back then, people called us all ‘Hindus,’ and they didn’t mean it in any sort of positive way,” he said. “Then, after the Golden Temple attack in 1984, people started recognizing that we were Sikhs, and understanding a bit more about East Indians, and Indian Americans, in general.”

Gill keeps his hair cut short and he wears only one of the five K’s, a silver kara on his right wrist, though

he explained this doesn’t mean he’s not devout.

“I go to the temple all the time, and recite the prayers,” he explained. “In my eyes, I’m worshiping God. If people want to be fully baptized, that’s the commitment they make at that point in their lives. Maybe someday I’ll be there as well, but right now I’m not quite there.”

Gill said his impetus to get involved in politics was an underrepresentation not only of Sikhs, but also of the entire Indian-American community. He emphasized the importance of education in helping younger Sikhs remember their heritage, as well as educating other cultures about who Sikhs are and what they believe, in order to lessen prejudice.

“There are people who will embrace not just Sikhism, but any culture and anyone,” Gill said. “But there are also always those people who don’t care to learn, don’t care to listen; they don’t care about anything else. It’s not just Sikhism, or any other specific issue that they have a problem with—it’s how they feel about everything.

“People need the education to understand, and what they need to realize is, what it all comes down to is we’re all Americans.” Ω Guru Nanak, born in 1469, founded Sikhism, and is the first of the religion’s 10 gurus.

Kill Devil Hill is a supergroup from North Carolina featuring a couple of heavy-metal heavyweights in its rhythm section: bassist Rex Brown and drummer Vinnie Appice. Brown laid down the bass lines for ’90s metal gods Pantera, while Appice kept the beat for ’80s-era, Ronnie James Dio-fronted Black Sabbath, as well as much of that singer’s epic solo career. Two of the most beloved metal icons ever, Pantera’s guitarist Dimebag Darrel was gunned down by a crazed fan in 2004, and Dio succumbed to stomach cancer in 2010. But each word in the title of the Chico by Jason Cassidy brewery’s first on-site beer fest jasonc@ describes something far more seanewsreview.com sonally appropriate—though no less fun—than a typical springbreak event. The inaugural festival was a celebration of the fall hop harvest, and the 47 breweries that joined Sierra Nevada—alongside the sheep eating up the weeds in the brewery’s now-bare hop field—are among the most celebrated craft brewers in the country, and they were there to show off styles of beers that highlighted hops (aka Humulus lupulus) in various ways, including: “Single”-hop beers, or those featuring only one variety of hop; “fresh”-hop beers, which utilize hops that have been dried and added to the brew within a couple weeks of harvest; “wet”-hop beers, using hops that are picked, but not dried, and added to the beer within days of harvest; and “wild”-hop beers made with uncultivated varieties of hops foraged from nature.

It was almost ridiculous how perfect of a scene it was. Picture it: A perfect sunny autumn day, and 1,500 men (many bearded) and women—most between 21 and 40—on the beautiful Sierra Nevada property. Outside the big tent: sausages and sauerkraut, gourmet tacos, soft pretzels (with beer cheese) and cupcakes; inside the tent: music from a hip indie band from Seattle, Wash. (The Cave Singers), and unlimited beer provided by the best breweries in the country.

I felt like a kid at an amusement park. I decided to take it slow and keep my strategy pretty loose as I looked over my “beer menu.” I wanted to taste my faves—Russian River Brewing Company and the home team, of course—and try some of the far-away luminaries in the craft-beer world that we don’t often get to experience out west, such as Founders Brewing Co., of Grand Rapids, Mich., and Cigar City Brewing, of Tampa, Fla. And, I also did my best to honor the theme by sampling a variety of single, fresh, wet and wild selections.

Nearly every beer of the 21 I tried was excellent;

most are ones I would seek out again. Just some of the high points included Founders’ sweet and floral wet-hopped Harvest Ale (with five hop varieties); the piney, fresh-tasting fresh-hopped (with citra hops?) Raceway IPA from Pizza Port Brewing Company (Carlsbad, and other SoCal locations); the complex fruity/floral/spicy fresh- and wet-hopped Freshie IPA (with simcoe, mosaic and citra hops) from Berryessa Brewing Co. (Winters); and both the Nellie single-hopped ale (with very tropical-flavored nelson hops from New Zealand) and the brandy/raisin/chocolate goodness of the amazing, dark, barrel-aged Eclipse Imperial Stout from FiftyFifty Brewing Co. in Truckee.

The discovery of the day though was probably Solemn Oath Brewery, of Naperville, Ill. The new-tome brewery’s friendly, bearded tap-jockeys poured two of the most unique beers I had: an amazingly balanced Belgo-American double red ale called Man vs. Internet vs. Mothra, and the odd-but-alluring Salty Beard, a Belgian IPA whose funky yeast and experimental single hop (#05256) combined into a fairly indescribable fruity muskiness that I’d never experienced.

It was also a kick to get the chance to be one of the few to enjoy a sample poured from Russian River’s one giant bottle of Toronado 25th Anniversary, a blend of six disparate styles into one sour beer that was one of the most funky, sour and complex beers I’ve ever tasted.

There were only four wild-hop varieties on the menu—IPA 395 by Mammoth Brewing Company (Mammoth Lakes), Experience IPA from SweetWater Brewing Company (Atlanta, Ga.), and a couple from Sierra Nevada—and I tasted only one, the home brewery’s Neomexicanus Wild Hop IPA, which might’ve been my favorite beer of the day. The neomexicanus sub-species is an unusual-looking multi-headed hop that grows wild throughout the Western United States, and was harvested by Sierra Nevada in the foothills of the mountain range that the brewery is named after. The flavors that the hop imparted to the special release were hard to pin down: sweet citrus, and sort of earthy, but not in a musty or vegetative way, more like freshly picked fruit—a really sunny brew! It was so new and delicious, and captured the fresh, fun and adventurous spirit of the day in one tiny glass. Ω

Equal Vision/Rory Records A dozen years after Saves the Day frontman Chris Conley opened 2001’s Stay What You Are with the accurate prediction that “this song will become the anthem of your underground,” Saves the Day has come full circle with their selftitled eighth album, both by returning to their original record label, Equal Vision and, to a lesser extent, returning to the unabashedly melodic, musically uplifting sound that once earned them the dubious honor of being yesteryear’s “next big thing.” Instead of cashing in on that potential, Saves the Day spent the next 10 years writing and releasing deeply cathartic, and commercially middling records, including most recently a conceptual trilogy completed by 2011’s Daybreak. Though Saves the Day recalls the band’s pop-punk-y past, their sound has matured. The album features plenty of driving tempos and bombastic choruses—not to mention Conley’s instantly recognizable high-register vocals—but the guitars are dialed back and the production tastefully spare, bringing to the fore the frontman’s meticulous melodies and trademark lyrical imagery on standout tracks like “Xenophobic Blind Left Hook” and “In the In Between.” In roughly 33 minutes, Saves the Day successfully exorcises the ghosts that have been haunting the band over the last decade.

Burger King “I need to wear fishnets and a negligee on Saturday,” I reminded myself as a friend and I pondered Burger King’s digital menu. The woman behind the counter pretended not to have heard my self-admonition as I ordered Satisfries and a gigantic Diet Coke. The Satisfries—Burger King’s new lower-calorie, lower-fat fries—arrived, and in their thick, crinkle-cut valleys of golden goodness, I saw my chance of fitting into Saturday’s Rocky Horror Picture Show costume fade away. I resolved to work it off in the gym, and dunked the first fry into some ketchup, the hot ridges capturing small pools of the cool condiment. Crispy, though not crunchy. Chewy, though not mealy. I immediately thought of baked steak fries, without the sogginess, and then devoured the rest.

Satisfries’ 40 percent less fat and 30 percent less calories (than McDonald’s regular fries, it says in the fine print) is thanks to a batter coating the potatoes that keeps it from absorbing as much oil during frying.

When you compare Satisfries to BK’s own fries, the differences are only 20 percent less fat and 20 percent less calories. Still, Satisfries are a slightly less guilty pleasure, one that you can enjoy in moderation and still look good while doing “The Time Warp.”

CBS How to wrap a sitcom around Robin Williams? That’s a question television producers have been asking for 31 years, ever since Mork & Mindy ended. Efforts to create a similarly good fit for him have failed—until now. In The Crazy Ones, created and produced by David E. Kelley, Williams plays Simon Roberts, a wacky genius given to rapid-fire joking and banter who heads up a major Chicago advertising company. He’s the kind of guy who, as Williams has said, “could sell clouds to God.” He’s paired with Sarah Michelle Gellar, who plays his daughter and business partner, Sydney. She’s the one person who can rope him in when he becomes unmoored, and Gellar, much to her credit, keeps right up with Williams— no easy task. There’s also a good cast of supporting players, including James Wolk, Amanda Setton and Hamish Linklater, all of whom treat Simon with the respect and fearful disbelief that come from working for a mad genius. Plot is secondary here to raillery and repartee, at which Williams excels. I’ve watched three episodes since the show debuted on Sept. 26, and all had me laughing out loud, over and over.

It’s government versus the people in two new dramas

T

he Fifth Estate is being promoted as a

dramatic portrait of Julian Assange and the WikiLeaks phenomenon but also as a kind of lowkey political thriller. It delivers on both counts, but not to any really impressive or revealing extent.

Benedict Cumberbatch’s edgily by Juan-Carlos cautious impersonation of Assange is Selznick striking in appearance and mannerism, but the overall portrayal is sketchy at best. In a way, the film’s true central character is Daniel Domscheit-Berg, whose book about his loose-limbed partnership with Assange in WikiLeaks is one of the sources for the film’s screenplay.

writer/adapter Josh Singer have framed their portrait in the trappings of respectable docudrama, but they’re hard-pressed to come up with anything in the way of fresh revelations. That is, at least in part, a byproduct of dealing with ongoing current events and legal and political dramas that remain unresolved at best, and shrouded in disinformation and secrecy at worst.

There’s a fleeting sense of urgency and commitment in the sequences where Assange and Domscheit-Berg are making “Courage is contagious” their watchword. But in the end, there’s nothing left to do but acknowledge all the fraught loose ends—which The Fifth Estate accomplishes via a fictional “interview” in which Cumberbatch/Assange addresses the camera directly and makes pronouncements which are provocative, evasive and inconclusive.

(who is also excellent as a very different kind of character in this year’s Rush), and much of what is best in the film is mostly a matter of scenes in which Cumberbatch and Brühl are both involved.

There’s an excellent supporting cast on hand as well—David Thewlis and Peter Capaldi as journalists involved in publishing the leaks, and Stanley Tucci and Laura Linney as government figures in charge of national-security matters. Alicia Vikander plays Domscheit-Berg’s girlfriend and comrade in a part of the movie that brings the political and the personal into charged contact.

Linney’s performance, in a small but well-written part, is probably the best of the lot.

Government secrets are at the heart of

another release to make it to Chico this week. Closed Circuit takes on surveillance systems, whistleblowers, and the quagmire of “national security” issues from another angle. The setting is Great Britain, WikiLeaks revelations are not an issue, and the secrets uncovered will remain hidden from the public. Instead, judicial tyranny and the malfeasance of spy agencies have the foreground, and the plight of potential whistleblowers is the central drama.

Eric Bana and Rebecca Hall play defense lawyers who uncover an elaborate judicial sham in a terrorist bombing case to which they’ve been assigned. Compromised by shared personal secrets, and seriously menaced by government officials operating behind a veil of secrecy, the two of them must take flight and bargain for their own survival via the few remnants of legal and moral redress left to them.

The spirit of social protest, which seems cautious but not unhopeful in The Fifth Estate, looks to be nearly extinct in Closed Circuit. Ω

Director Paul Greengrass and screenwriter Billy Ray keep the central focus on Capt. Phillips (Tom Hanks), but never lose sight of what’s going on with the Maersk Alabama’s 20-man crew or with the scrawny quartet of Somali youths who first try to take over the ship and then later try to take flight with Phillips as hostage. A key drama within the larger one comes from the keenly nuanced battle of wits, male pride and allround know-how that develops between Phillips and the gaunt, rail-thin pirate called Muse (a haunting Barkhad Abdi). The film rises to its most impressive levels when we begin to see that the simplistic good guys/bad guys outlook that usually prevails in such stories gets deflected here in some very interesting and even moving ways. The screenplay and direction combine with Hanks’ quietly multifaceted performance to portray Phillips as a genuine hero, but also as one deeply marked by the devastating cost of victory.

Gravity

The new film by Alfonso Cuarón is a dazzling piece of artful entertainment. It’s a sci-fi adventure, with a pair of stranded astronauts played by George Clooney and Sandra Bullock trying to survive a spacestation calamity, and it packs a great deal of unexpected interest into what might sound like a relatively simple story. Scarcity of oxygen, suspension of the law of gravity, extreme physical isolation—they all heighten the stakes in the characters’ efforts to improvise self-rescue via the increasingly disabled remnants of their elaborate spacetravel technology. Cuarón and company make wonderfully expressive use of the 3D format on behalf of all of its main concerns.

Both visually and dramatically, Gravity is about human beings struggling to get their bearings, in several senses of that word.

Spatial and psychological disorientation recurs, but the screenplay by Alfonso and his brother Jonás Cuarón also nudges us toward perspectives on the dimensions of human identity, of purpose and self, and locale. Cinemark 14, Feather River Cinemas and Paradise Cinema 7. Rated PG-13 —J.C.S.

In the wake of an abduction of two little girls, tensions mount between a brash detective (Jake Gyllenhaal) and the desperately frustrated father (Hugh Jackman) of one of the missing kids. Cinemark 14. Rated R.

Pantelion Films, the new Hollywood studio putting out features aimed at Latino audiences, is capitalizing on its summer hit Instructions Not Included, by releasing this romantic-comedy about a young woman working as a diplomatic consul for the U.S. embassy in Mexico City who begins falling for a mariachi singer whose visa she denied.

Runner Runner

Brad Furman (The Lincoln Lawyer) directs this story of an Ivy Leaguer (Justin Timberlake) who, after being cheated out of his tuition money in an online poker game, heads to an offshore island to confront the company and winds up drawn into a dangerous game between a criminal entrepreneur (Ben Affleck) and the FBI. Cinemark 14. Rated R.

Rush

Screenwriter Peter Morgan turns his talents to the politics of celebrity and the psychology of high-speed risk-takers, via the storied rivalry of world-class Formula One auto racers Niki Lauda from Austria and James Hunt from Great Britain on the 197677 Grand Prix circuit. Both men are extraordinarily gifted auto racers, both are from wealthy backgrounds, and both seem obsessed with defeating the other. Beyond that, they are two entirely different types of competitive males. Lauda (played by Daniel Brühl) is cold, intense, socially withdrawn, brilliantly analytical, mathematically precise; Hunt (played by Chris Hemsworth) is handsome, energetic, charming, relentlessly outgoing, and reckless in appetite and impulse. These contrasts are a little bit too pat, but director Ron Howard and his actors bring them out with an attractive zest that is made all the more interesting by hints of rueful regret and half-hidden desperation.

The end result is brisk, smart, fast-moving entertainment. Cinemark 14. Rated R —J.C.S.

“I want to break that down a bit,” Tellesen said.

Tellesen and company’s Habitat Lab

show is one of two unique, participatory art experiments happening in Chico on Saturday. Earlier the same day, across town in the Idea Fabrication Labs “maker space,” Brazilian installation artist and performer Daniel Devas will be taking visitors on a “sensorial journey though physics” through his Scientia Truncatis (Latin for “Science Jungle”) exhibition.

Devas has created large-scale installations all over the world—from Burning Man to the Boom Festival in Portugal—and while in Chico he’ll be taking advantage of IFL’s cool toys (laser cutter, 3-D printer, etc.) to fabricate a series of trees using everything from magnets and bubbles to lasers and electronics. The trees are being designed and arranged in a way that will allow the audience to interact with the respective scientific concepts at play in each piece, “showing the beauty of the laws that rule our dimension,” Devas said.

You’ll have to wait until opening night to see what exactly he has in store, but if his previous works are any indication, it’s going to be a unique experience. His installations have included everything from “Água E Fogo,” featuring a clear tube filled with water that spins into a whirlpool, creating a vortex that allows flames to shoot up through the water, to the huge “Torres Dancantes” (“Dancing Towers”), a series of reflective bands strung together to make a massive ribbon-like curtain hung from bridges or rafters inside concert halls, which, when twisted, sent wave-like ripples up and down its surface that flickered to a dance beat. Riding to the end of the world Though Halloween is still a week away, there are plenty of opportunities to get some thrills nearly every day in the next week—haunted houses, nearby corn mazes, and parties galore. One of the most interesting of these is a Post-Apocalyptic Ride held by the group Chico Bike Party this Saturday, Oct. 26. Bicyclists—in costume, if you prefer—are asked to meet at 7:30 p.m. at City Plaza, where organizers will lead the EDITOR’S PICK group on a secret route filled with End Days-themed eye candy and the occasional scare. The organizers provide a mobile sound system with the spooky tunes, and riders are encouraged to bring their own drinking water, lights and a patch kit.

For many on a budget—like college students— ramen noodles are a food staple. They’re cheap, reasonably tasty and are easy to prepare. Now, thanks in part to the work of Chico State manufacturing professor Daren Otten and some of his students, cooking them is even easier with the Rapid Ramen Cooker. It’s basically just a simplelooking BPA-free, microwavable plastic bowl that is in the same rectangular shape as the familiar bricks of dehydrated noodles. Sacramento entrepreneur Chris Johnson thought up the product and hired Otten to bring his idea to fruition. Otten—vice chair of the Mechanical and Mechatronic Engineering and Sustainable Manufacturing department at Chico State—and his students took 100 hours to complete the project.

Johnson then presented the product on the reality show Shark Tank, and after securing $300,000 in financing from billionaire Mark Cuban, went on to sell, so far, more than 200,000 units in stores like Walmart and Safeway.

How’s it feel to have made such a popular product?

It’s exciting to see someone we’ve worked with succeed, and my sustainable-manufacturing students got real-world experience that you can’t beat. But it’s not about the widget, it’s about the guys who can push it. I don’t want to discount what my students did, but Chris Johnson is 100 percent absolutely the reason for its success. Those who can get their products to those who use them will succeed, and those who can’t won’t.

What was the process for creating the cooker?

It was an extensive process where we measured various ramen noodle pack sizes and created the BPA-free plastic container to with-

stand 212 degrees of microwave heat. The walls were designed tall enough to prevent water from boiling over and the side handles had to be convex, or rounded on top to prevent any splashed water from puddling up. It took many hours to design the dimensions using Excel spreadsheets, going back to the drawing board, etc.

Is this the most successful product you’ve worked on?

It’s not the biggest success; I call it a success when the client succeeds and wants more work from me, which has happened a lot. I’ve developed products privately for companies like Hewlett-Packard and Dell computers, and in Asia for GM and Hamilton Beach. The big guys have a lot more resources and the smaller guys have a lot more passion.

Any advice for prospective inventors?

Ask yourself: Is there a market for it? Are you willing to work harder than you’ve ever worked in your life for it? Are you willing to sell everything you own to fund it? If the answer to any of these is “no,” don’t do it. In any case, it’s always really hard. You’re better off playing the lottery. But if you’re willing to try it, call me! Birthday I’m writing this on Janice’s birthday. It’s beautiful—blue sky, light haze, no wind. A great day like this is hard to enjoy; she’s not here to enjoy it, and I know she would have. It sounds goofy to me, too, but there it is. We each had a life, and a lot of what we did and enjoyed had nothing to do with each other, and now every situation I run across in which we had ever found ourselves makes me cry—in homage, I think.

When I go to sit outside in the morning and I see the chaise longue set to catch the early light, I think of all the mornings she and I sat there, drinking tea and waking up the day. She may have been giving me shit, but at least she was here.

Now and then, I retry going through some of her stuff, but I don’t get far and I don’t try often anymore.

And her stuff is everywhere—art on the walls, bottles in the medicine cabinet, books on the shelves, photos in boxes, journals in stacks, paint on the walls. I’m immersed in her stuff—for Janice pretty much everything had value as art supplies or art—without the

pleasure of her company, and her company gave plenty of pleasure.

There’s still an element of cosmic something or other about all this grief, a component that’s not specific to Janice or our bond, and for which I’m grateful without understanding. Every time one of those waves picks me up and turns me over, I feel softer somehow, maybe less resistant, and more able—willing?—to accept whatever happens along, not to judge it or decide anything about it, just appreciate it for itself. Odd. I think it’s a chance to surrender, which I’m finding is nearly always a good idea.

Grief is exhausting, crying especially so. It seems like I ought to be burning a lot more calories, but I’m not losing any weight, and it does nothing for abs.

That recurring lump in my throat sometimes aches; maybe it’s getting stronger.

I’ve been crying a river for the last couple of months and blaming it on the movement of the ecliptic and subsequent change in season, and I see no reason to revise the results of my entirely unscientific study.

The goddamn autumn light makes me cry.
