Attorney’s General’s Notice Pursuant to G.L. c. 40, § 32

Town of Monterey -- Case No. 11959 Annual Town Meeting of May 3, 2025 Articles # 16 and 17 Attorney General's Limited Authority to Waive Procedural Defects in the Notice of the Planning Board Hearing Pursuant to the provisions of G.L. c. 40, § 32, if the Attorney General finds there to be any defect in the procedure of adoption or amendment of any zoning by-law relating to the form or content of the notice of the Planning Board Hearing prescribed by G.L. c. 40A, § 5, or to the manner or dates on which said notice is mailed, posted or published as required by that section, then instead of disapproving the by-law or amendment by reason of any such defect, the Attorney General may elect to proceed under the defect waiver provisions of G.L. c. 40, § 32. Under those provisions, the Attorney General is conditionally authorized to waive any such defect.

Defect Determined in Notice of Planning Board Hearing The Attorney General has determined that the Planning Board Hearing Notice relating to the above Article failed to comply with the notice requirements for such hearing established by G.L. c. 40A, § 5. Section 5 provides in part (with emphasis added): No zoning…by-law or amendment thereto shall be adopted until after the planning board in a…town has…held a public hearing thereon…at which interested persons shall be given an opportunity to be heard…. Notice of the time and place of such hearing, of the subject matter, sufficient for identification, and of the place where texts and maps thereof may be inspected shall be published in a newspaper of general circulation in the…town once in each of two successive weeks, the first publication to be not less than fourteen days before the day of said hearing, and by posting such notice in a conspicuous place in the…town hall for a period of not less than fourteen days before the day of said hearing. Notice of said hearing shall also be sent by mail, postage prepaid to the executive office of housing and livable communities, the regional planning agency, if any, and to the planning board of each abutting city and town.…In cases involving boundary, density or use changes within a district, notice shall be sent to any such nonresident property owner who has filed such a request with the city or town clerk and whose property lies in the district where the change is sought.

Based on the materials submitted to this Office, we have identified the following defect: The planning board hearing notice was not sent to the Executive Office of Housing and Livable Communities (formerly known as the Department of Housing and Community Development), the Regional Planning Agency, nor the planning boards of the abutting cities and towns, as required by G.L. c. 40A, § 5. For this reason, the 90-day period prescribed for the Attorney General’s review of Articles 16 and 17 is suspended in accordance with G.L. c. 40, § 32.

Town Clerk's Certification of Compliance with This Notice After the expiration of the 21-day period, the Town Clerk shall submit to the Attorney General a true copy of this Notice with a certification of compliance with the publishing and posting requirements of the preceding paragraph, and a certification that either (a) no claim was filed within the 21-day period, or (b) one or more claims were filed within the 21-day period. The Town Clerk shall submit to the Attorney General true copies of any such claim(s).

Resumption of Attorney General's Review Upon receipt of one original copy of this Notice with the Clerk's certification, the 90-day period provided for the Attorney General's review under G.L. c. 40, § 32, shall resume. If no claim is made, the Attorney General has the discretion to waive any such defect; if any claim is made, however, the Attorney General may not waive any such defect.

Note: By not filing a claim under this provision, a person shall not be deprived of the right to assert a claim of invalidity arising out of any possible defect in the procedure of adoption or amendment, as provided in G.L. c. 40, § 32, and in G.L. c. 40A, § 5.

Tips for a safe and fun spring break road trip Arriving months after the holiday season and right around the end of winter, spring break comes at the perfect time for families and students. A winter spent largely indoors can excite anyone about the prospect of soaking up some sun from the comforts of a sandy beach, and millions will do whatever it takes to make such a trip possible.

Many spring breakers may fly to their destination, but that can be costly for families paying for multiple flights. Indeed, spring break can be one of the more costly times to travel by air, as it's considered a peak travel period. Families who want to get away but don't want to spend thousands of dollars on flights alone can take to the road and drive to

their destinations. If a road trip is in the cards, families can consider these strategies to ensure a safe and fun excursion.

Have your vehicle fully serviced before your trip Winter can be hard on a vehicle, particularly when a car is parked outside in locations where harsh weather is the standard between December and March. A full checkup that tops off fluids, tests the brakes (and replaces them, if necessary), inflates the tires (and again, replaces them, if necessary), tests the battery, and checks headlights and wiper blades to ensure they're operating at peak capacity can prepare a vehicle for the journey to your spring break destination.

Make some pit stops along the way If it's an especially long trip to your destination, extend your travels by a day or two and make an extra stop along your way to your destination and on your return home.

Find a fun activity along the way, such as a trip to a local indoor water park or a must-see hiking spot, so everyone can spend a day moving around before getting back in the car.

Don't be a motorized martyr When your ultimate destination is a warm,

sun-soaked beach, it can be tempting to make the trip in a single day. But fatigued drivers are dangerous drivers, so it's best to build in some time to take a break and even share driving duty with another licensed driver. Moms and dads can switch halfway through the trip. If you already know the trip will take multiple days on the road, then stop driving no later than sundown to ensure you and your fellow drivers get a good night's rest.

Line up some in-vehicle entertainment A long road trip with young children will require some in-vehicle entertainment. Load up a tablet with movies to keep the kids occupied during the drive but also arrange for some non-device game play as well. A book of puzzles, a family sing-along, a round or two of I spy, the license plate game, and even some kid-friendly trivia can provide some fun distractions on the way to your destination.

The cost of air travel can be prohibitive for families looking to get away this spring break. Some simple strategies can make road trips a safe, fun and cost-effective means to getting away when school lets out this spring.

Heartworm is a serious health risk for your pets

Between 100 and 150. That is the estimated number of kittens an unspayed cat can have in her lifetime. ABC Clinic Pet Refuge Animal Birth Control Clinic says in just one year, an unspayed cat who is allowed to roam outdoors can have three litters resulting in 12 kittens. One year later, those 12 kittens if kept unspayed, can have 144 offspring of their own. Such figures illustrate that the potential for feral cat overpopulation is high.

According to Shelter Animals Counts, nearly 2.9 million felines entered rescues and shelters across the country in the United States in 2024. About 275,000 of them were euthanized. Cat overpopulation can be controlled if people learn more about how to keep cats safe and happy, which starts with spaying.

What is spaying? Spaying is a surgical procedure that removes the ovaries and sometimes uterus of a female cat with the intention of preventing reproduction. VCA Animal Hospitals characterize spaying as a major surgical procedure that requires placing the cat under general anesthesia.

Most cats are able to return home within 12 to 24 hours of surgery. Even though spaying is considered a major operation,

the risk of complications is very low.

Spaying is a routine procedure.

What are the advantages to spaying?

Small Door Veterinary says there are many advantages to spaying a cat, which can help with population control, reduce risk of reproductive disease, eliminate heat cycles, and help head off unwanted behaviors like roaming to find a mate.

Spaying eliminates the risk of ovarian and uterine cancers and the risk of breast cancer. VCA says cats spayed before their first heat cycle have a less than 1 percent chance of developing breast cancer.

At what age should a cat be spayed?

Today’s Veterinary Practice says for owned cats, the optimal age to spay is four to five months of age to catch the cat before its first estrus cycle. For cats in shelters, the optimal age could be as early as eight weeks of age. An older cat also can be spayed if it is adopted and hasn’t been altered. It’s always best to speak with a veterinarian about spay choices to protect the health of the animal.

Spaying felines at an early age can reduce the large numbers of cats entering shelters and even prevent an assortment of health issues. TF262630

Wonderful and easy to work with!

We needed to transform our 100 year old basement from crumbling concrete and dirt to a functional laundry room and exercise room. Morrisons helped us to transform it. They solved several problems which are common to old houses, replaced plumbing, built a new bathroom, updated electric, installed a finished floor, and turned it into a beautiful useful space.

They also replaced a steep outside staircase with a lovely modern staircase. All Morrison’s employees were wonderful, easy to work.
