Dear Lynn, Thanks so much for your column. It is so easy to understand as you answer in layman’s language! We are planning on selling our house so we contacted a Realtor. When she came over, we talked about the house and told her things we had done to it and some problems that we have had with our boiler and drainage in the spring in our yard. We did not hire her; we listed with someone else. The Realtor that came first ended up showing the house and we were told that she told her buyer about the things we had told her in private. We do not think she had a right to do that. What should we do? Carl and Johanna Dear Carl and Johanna, Your question is one I get often and has a simple answer. At your first meeting with any real estate agent, you are presented with a form that is required by law called. The form is called MASSACHUSETTS MANDATORY REAL ESTATE LICENSEECONSUMER RELATIONSHIP DISCLOSURE. I’ve included a section of the form for you to look at. I’ve added a star at the paragraph that answers your question. THE TIME WHEN THE REAL ESTATE LICENSEE MUST PROVIDE THIS NOTICE TO THE CONSUMER: All real estate licensees must present this form to you at the first personal meeting with you to discuss a specific property. In the event

a house and asked his real estate agent if he could do the same. He was hoping the seller would like that he was not going to have the home inspected. He’s lost other houses that he submitted offers on and doesn’t want to lose this one. His buyer agent said he couldn’t do that. Would you be able to explain this to me please? Thanks, Klevie Janis Dear Klevie, There was a time when this was a popular strategy. However, a new law went into effect in 2025 that does not allow the subject of waiving a home inspection to come up when writting and submitting an offer. Once an offer is accepted by the seller then the buyer can choose to not have the home inspected. Here’s information from Mass.gov: In Massachusetts, a buyer cannot waive a home inspection in an offer to purchase. The new law, part of the Affordable Homes Act, prohibits sellers and their agents from requiring or encouraging buyers to waive their right to a home inspection as a condition for having their offer accepted. This regulation applies to the sale of residential buildings of 1–4 units, including single-family homes, condominium units, and residential co-op sales. Home inspections must be completed by a licensed home inspector, and the results must be included in a written evaluation. Sellers must provide a separate written disclosure affirming the buyer’s right to a home inspection before or at the signing of the first purchase contract.
