We were trying to sell our house. While it was for sale, we started having problems with our septic system. We called a pro to come and look. The news was not great. We needed to replace the entire system and the cost was steep. As a matter of fact, we paid more than a neighbor of ours who just had a new septic installed. After the new septic has been completed, we will try again to sell our house. Here is my question: My spouse wants to add the cost of the new septic system to the asking price. I’m not sure that’s a good idea You have been in the real estate business a long time. Have you run into this before?

Water, heat , sewer, and sept ic are several of t hese t hings. Of course, t here are except ion s such a s a proper t y t hat i s a teardow n proper t y or in need of ex ten sive repair and may be of fered for sale, “ a s i s. ” Wit h t hat said, t he cost of a sept ic system or well i s not a cost t he buyer should incur. It’s impor t ant for sellers to remember, t here are cost s to br ing water to a house and to allow wa ste to ex it .

We recent ly bought a fi xer-upper house and it had a lot of t ra sh around t he proper t y. T he t ra sh cont ained a k itchen garbage can in addit ion to lot s of ot her st uf f. T he cont ract st ated t hat all t ra sh wa s to be removed. We went to t he house t he mor ning of t he closing to do t he f inal wal kt hrough and all t he “ junk ” wa s st ill t here. We said we wouldn’t sig n unt il t hey removed all of t he t ra sh per t he cont ract T he seller said t hey would not do it and to sue t hem if I had a problem w it h t hat . W ho k new t hat a sk ing for t he rot ten garbage to be removed wa s unrea sonable!

Most real est ate cont ract s w ill have lang uage t hat st ates t hat t he seller w ill leave t he proper t y in “ broom clean condit ion,” which mean s t hat all t ra sh should be removed. In addit ion, it sounds like you may have added your ow n lang uage st at ing you wanted it removed I don’t k now how t hi s t ur ned out for you but I can say f rom my ow n ex per ience t hat t he at tor ney ’ s usually get involved to have t he t ra sh removed. Somet imes, t he sellers money w ill be held in escrow (t y pically 1.5 t imes t he amount it would cost for removal)

A nd if t he seller does not remove t he t ra sh by an ag reed upon t ime, t he escrow i s t hen awarded to t he buyer.
