Hi everyone It's my distinct honor to serve as your President for the 2022 year. We have a lot of great things in store for the coming months and I really hope you take advantage of all that we have to offer.

Our organization is fun and laid back and full of solid content to help you do your job well within our Association Industry.

I'm especially excited for some of our upcoming social networking events like the one at Kanine Social (you can bring your dog) on March 10, the new member event (for those that join soon) on March 24 watching the IceMen, the Jumbo Shrimp Game on April 7. Of course, you probably want to also save the date for August 26, our EXPO, and December 1, our Gala. Our Committees are hard at work planning all of this.

Speaking of Committees, that's a great way to get involved with NEFLCAI. Please consider joining one.

You'll notice this issue has a noticeable "February" theme of relationships -- well, our tongue-in-cheek take on it, anyway. In all seriousness, though, we want to have a relationship with our members. This is YOUR organization. Do you know what it takes to be a good board member? Chances are you do.

Look for residents that have a mix of some of the following traits and skills and ask them to consider running for a seat on the board. We’d know you'd love to have them.

Respect. If they can give others respect and expect it in return, they can help keep board discussions civil, productive and on point. Look for people who can lead by consensus, not by command.

Good listening. People want to be heard. Can they listen to board members and residents with sincere interest? They may have a few ideas of their own, but everyone benefits by sharing and discussing.

Thick skin. Sometimes, residents—even other board members—can be mean and insulting. Are they good at turning a conversation around and finding out what’s really bothering people?

Egos aside. If they can give others credit, the board will operate better as a team.

Agenda aside. Members who come to the board looking to help only themselves are a problem. A board is more productive when members don’t have a personal punch list. Are they able to look after the community, not just their own interests?

Are they willing to compromise?

Skill. An association is a business. So having board members with accounting, organizational behavior and teambuilding backgrounds can help.

Someone with a financial background, for example, might make for a good treasurer.

The ideal board comprises a mix of management styles, professional skills and temperaments. If you know people with some of these traits or relevant skills, ask them if they’d be interested in joining the board. Some people don’t think about running for a seat unless asked.

They don’t have to know everything when they join, but they should be familiar with the governing documents and the responsibilities of the job.

Fellow board members and managers can help them with the transition and train them on board responsibilities, current work, projects and hot issues.

Leaders can come from different places and backgrounds. There’s no one mode that fits all.

Ask your residents to share their knowledge and passion with the community.

Unattended cooking is the leading cause of home fires in the United States, according to the National Fire Protection Association. When cooking for guests, don’t let yourself be distracted. Keep an eye on those pots.

Smoking is another leading cause of home fire deaths. If you smoke, smoke outside. Keep a small bucket of water outside and drop cigarette butts in directly. If you or your guests smoke indoors, provide plenty of large, deep, sturdy ashtrays and check them frequently. Douse cigarette butts with water before discarding them in the trash where they can smolder and cause a fire. After a party, always check on, between and under upholstery and cushions and inside trash cans for cigarette butts that may be smoldering. Keep matches and lighters up high, out of sight and reach of children (preferably in a locked cabinet). When smokers visit your home, ask them to keep their smoking materials with them so young children do not touch them.

There are often many questions and rules about parking. Below are a few general q&a about the topic.

Please check with your association's own governing documents, however, for specific answers for your neighborhood, as some of the answers below may not apply.

Q: Why don’t we have enough parking?

A: Developers generally want to build the most homes possible to make the most money, so they often allot the fewest parking spaces required by law. Unfortunately, that leaves the association to deal with the shortage.

Q: Why are there so many handicapped parking spaces?

A: It may look like a disproportionate number of spaces are reserved for handicapped parking, but for each space there is a resident in need. The Fair Housing Amendments Act makes it unlawful to “discriminate against any person in the terms, conditions, or privileges of sale or rental of a dwelling, or in the provision of services or facilities in connection with such dwelling, because of a handicap of that person.” The “provision of services or facilities” includes providing reserved parking. When a resident requests a handicapped parking space, the association makes every effort to reserve one. Not only does federal and state law require it, but it’s also the right thing to do.

Q: What gives the association the right to tell me where and how to park?

A: When you purchased your home, you entered into a contractual agreement with the association to abide by its covenants. Those covenants include bylaws that empower the board to adopt and enforce rules they believe are necessary for everyone’s good. The parking policy explains the parking rules and specifies procedures for enforcing them; not only is the board allowed to develop the policy, it’s legally obligated to do so.

It's not quite thunderstorm season yet, but it's never too early to be prepared.

Threatening thunderstorms often loom large for fun days in the sun, so it’s important to be prepared for downpours and accompanying lightning, which can strike outdoors or indoors. Consider the following suggestions when planning both outdoor and indoor events when storm season comes to reduce the risk of a lightning strike.

Watch the weather. Pay attention to your local weather forecast before participating in outdoor activities. If there’s a chance of thunderstorms, consider rescheduling or moving events indoors. If that’s not possible, have an emergency plan in place in case a severe storm rolls in and designate a sufficient nearby structure as an emergency shelter.

Stay inside. If severe thunderstorms are imminent, go indoors and wait until they pass. Safe, enclosed shelters include homes, schools, offices, shopping malls and vehicles with hard tops and closed windows.

Duck and crouch. If you’re caught outside during a severe storm, it’s important to crouch low on the ground, tuck your head and cover your ears to help protect yourself from harm. Do not lie down; lightning strikes

Turn off faucets. During a thunderstorm, lightning can sometimes be conducted through the plumbing. Avoid any type of contact with running water, including bathing, showering, and washing your hands, dishes, or clothes.

Turn off electronics. All electrical appliances—televisions, computers, laptops, gaming systems, stoves, and more —that are plugged into an electrical outlet could carry a current from a lightning strike.

Surge protectors will reduce the risk of damaging electronics.

Stay away from windows. Not only is lightning a threat, but high winds and hail create flying debris that could be harmful during a thunderstorm. Close all windows and doors and keep away from them.

The LAC is our Legislative Action Committee that monitors and addresses legislative issues that affect our industry. We're lucky to have them and the great work they do on our behalf. Below is an article summarizing some new issues.

Legislative Changes Open the Door to New Options for Resolving "Disputes" in Condominium and Cooperative Associations

1. Require any owner to take any action, or not to take any action, involving that owner’s unit or the appurtenances thereto.

Earlier this year, the Florida legislature passed changes to Florida’s Condominium Act (Chapter 718) the Cooperative Act (Chapter 719), and the Homeowners Association Act (Chapter 720), Florida Statute. These amendments went into effect on July 1, 2021 and opened the door to allow condominium and cooperative associations a new option for addressing disputes between unit owners and the association through presuit mediation.

Previously, disputes between condominium associations and unit owners (or cooperatives and unit owners) were required to be submitted to arbitration through the Division of Florida Condominiums, Timeshares, and Mobile Homes of the Department of Business and Professional Regulation (the “Division”) before filing a lawsuit regarding any of the following issues:

Before the 2021 legislative changes, the parties to an arbitration could request a referral to mediation; however, the request for mediation came with a potential “cost.” If the parties attended mediation but were unable to resolve their dispute, unless all parties agreed in writing to continue the arbitration proceeding, the arbitration was dismissed. The parties were then forced decide whether to proceed with filing a lawsuit to resolve their dispute. However,

with the new legislative changes, a party to a dispute in a condominium or cooperative association has the option of either petitioning the Division for nonbinding arbitration or initiating presuit mediation. Now that there are options to consider when it comes to alternative dispute resolution, it is important to know the difference between arbitration and mediation.

Mediation and arbitration are both forms of “alternative dispute resolution” or methods of resolving disputes outside of a courtroom.

Despite what you may see on TV, lawsuits are often extremely time consuming and expensive; not all disputes can be resolved in a sixty-minute time slot like they are in Law & Order. As such, alternative dispute resolution can provide a more expedient and less costly option to formal litigation.

Mediation is a confidential process that is conducted with an independent, trained, neutral third-party mediator. The mediator does not give legal advice and does not make any decisions regarding the dispute. Instead, the mediator acts to facilitate discussion between the parties and assists them in reaching an agreed-upon resolution. In reaching an agreement, the parties have some degree of flexibility and can come up with creative solutions that may not be available remedies in court. In mediation, the parties are in control of their own destiny; they cannot be forced to accept a resolution in mediation. However, if they are able to resolve their dispute, the parties will document their agreement in the form of a written settlement agreement which will be binding in the same manner as a contract.

Unlike mediation, arbitration is more similar to litigation. A case in arbitration begins with the filing of a petition for arbitration. The petition

must cite, among other things, that the petitioner gave the respondent advance written notice of the specific nature of the dispute; a demand for relief, and a reasonable opportunity to comply; and a notice of intention to file an arbitration petition or other legal action in the absence of a resolution of a dispute. Once the petition is reviewed by the Division, a copy of the petition is served to all of the respondents.

The arbitrator is typically required to conduct a hearing within thirty (30) days of the case being assigned unless a continuance is granted for good cause shown. You can call witnesses and present evidence at an arbitration hearing; however, the arbitration hearing typically has a less formal “feeling” than a trial. There will be a ruling where one party “prevails”, as determined by an arbitrator. An arbitration decision is then generally rendered within thirty (30) days after a final hearing. The arbitration decision is only final in those disputes in which the parties have agreed to be bound by the arbitrator’s decision.

However, an arbitration decision can also become final if a complaint for a trial de novo is not filed in court within thirty (30) days of the arbitration decision.

Arbitration does not give parties the flexibility and control over the resolution process that is provided in mediation. However, arbitration does provide a forum for resolving disputes that is typically more efficient and more cost effective than litigation. If you find yourself involved in dispute that is subject to alternative dispute resolution under the Condominium Act (Chapter 718) or the Cooperative Act (Chapter 719), Florida Statutes, you should discuss with your association’s legal counsel whether arbitration or mediation provides a better forum to resolve your particular issue.
