Presidential Ramblings

A fairy tale.

Once upon a time, a long, long time ago (40 years, okay not so long in geologic time) - life was simple. Doing a subsurface investigation was simple. A job came in on a Monday and it could be started and done by Tuesday (sounds like a fairy tale already).

Then, an evil ogre decided that nothing would be simple any more.

The ogre had his minions to do his dirty work. These consisted of lawyers, safety officers, government regulators, insurance companies, permit issuers, utility companies, utility mark out companies, (Ramblings continued on page 12)

and the clients and owners that they work for. The simple became complicated, the complicated, became nearly impossible. There is no Prince Charming in this fairy tale, no one to slay the mighty dragon or wicked witch.

I offer the following with apologies to any of our members that are affiliated with any of the groups mentioned previously. I assume all are needed and fulfill an important function. However, the information that we seek by doing our investigations often seems to take a backseat to all of the stumbling blocks placed in our way by the various entities mentioned above.

When I started as a geologist/ inspector with the City of New York in 1969, investigations were uncomplicated. My boss would receive and hand me a project to inspect in the field on a Monday.

The paperwork would sometimes have a drawing showing some of the utilities and was told that my boss had called the utility companies to meet on site the next morning. A drill rig showed up at 8:00 and representatives of each of the utilities would come to the site with their drawings. The drawings were handed to me and I was expected to relocate the borings based on this information.

Occasionally a worker for the utilities on light duty would stay with us on the job. Remember at this time there was only gas, electric and telephone. Water and sewer lines had to be cleared by looking for manholes. Sounds simple, doesn’t it?

Compare that to a project now. One must call or notify a utility clearing house. This clearing house notifies all the utilities with facilities within a given radius of your location. The number of utilities can be twelve or more in some cases. The utilities in many cases hire companies that mark the utilities for them. One is not allowed to perform any mechanical penetrations of the ground for a minimum of three days, or four as in the case of New Jersey.

The mark out companies, or utilities are allowed to delay the mark out for forty eight hours. This was put in to allow for inclement weather where paint would not stick to the ground. In most cases it is used when the companies are overwhelmed by a large workload.

In addition, in New York City, water and sewer lines are not marked in violation of Industrial Code 753. The City will give you maps of their lines if you care to wait. The rules state that you must receive positive confirmation from each of the utilities listed before work can commence.

Some of the utilities respond promptly, others respond up to 2 months later. Try scheduling jobs when a positive confirmation is required. A positive confirmation often requires chasing down the company and the technician doing the marking. I have often called the utility on the third day, only to be told that it has not yet been assigned to a technician.

We have had crews sitting idle after having assurances that a technician would meet us on site in the morning. New York State DOT for instance, will not let work proceed until proof is offered for each of the listed utilities. I will detail some the problems with utility mark outs in my next article.

The next issue before work can progress is access to a site. How often have you been told that someone will be on site with a key for the gate at 8:00 AM, only to have the crew idly standing by for several hours. If you are not dealing directly with the owner or property manager there may be miscommunication between the consultant (your client) and the owner. Often times, access is restricted to smaller equipment even though the owner says that the larger gates can be opened. Sites are often encumbered with debris, dumpsters, stairs and other impediments. Many consultants do not visit their sites prior to requesting proposals to do work (you know who you are). Requests for proposals come in that need an answer by the end of the day. No time is available to check the site, but we are told that the owner says that the site is truck accessible. The consultant can give no further information since they have not actually been on site. Ten foot gates become three foot, twelve foot ceilings become seven foot, solid concrete floors become wooden with gaping holes.

These are just a few of the access issues that occur, usually through miscommunication. If this isn’t enough, the owner and his lawyers request insurance that covers the immediate world. Certificates of insurance can go back and forth several times before all agree that spelling and every comma and period are correct. Fi(Ramblings continued on page 16) -15-

nally it is often hard to make owners understand the need for correspondence that is necessary to obtain permits. In order to work in front of private property on the sidewalk, the New York City Department of Transportation requires a letter from the owner stating that we are working for him. The letter must be in a specific format with certain prerequisite information such as dates of work, etc. Even with a sample letter, it is hard to imagine how many of these letters have wrong or missing information. Keep in mind, we are not talking about major projects here. Some of these are one or two borings. More time is spent on all of the above than on actually doing the investigation. No more getting a job on Monday and finishing on Tuesday (remember the original fairy tale?).

the City, as I am sure is the case with most cities, a permit must be obtained giving permission to make a hole or cut in the right of way. The permit stipulates work hours, location, traffic and pedestrian control and other stipulations. After work is performed, the DOT sends inspectors to the field to make sure that repairs have been made to the street or sidewalk. The contractor is liable for up to five years for any defect found and is liable to lawsuits for that time if someone is injured due to not repairing the same.

These inspections are necessary if we want to have streets that are walkable and driveable. The City seems to use these inspections as a revenue producer. If a contractor is cited, they must pay a small fine and fix the defect if it is theirs. If it is not repaired, the fines can be quite excessive. The contractor must always pay to visit the site to see if it is fact their defect. This leads to the problem of lawsuits.

In my next and final Ramblings I will finish with lawsuits, Health and Safety Plans (HASPS) and my biggest gripe, utility companies -The End and their mark out representatives.

Northeast Section AIPG Fall Meeting Wednesday, October 24th We are still working out the details, but we are looking at setting up a tour of the LaFarge quarry and processing facilities in Ravena, NY. The tour would take approximately three hours. Following the tour, we are planning on having the dinner at the New York State Museum. The tentative dinner speaker is Andy Kozlowski with news about the recent landslides in the Adirondacks.

Fall Meeting: Pre-registration for the Fall Meeting - Dinosaur State Park visit is currently at 25 members/guests. A total of 20 members/guests are pre-registered for the dinner.

cers. One suggestion was for the sections to hold monthly dinner meetings.

Scholarship: Two suggestions to increase knowledge of the Angelo Tagliacozzo scholarship and potentially increase number of applicants are to distribute the announcement to regional professional geology associations, and other AIPG sections.

New Business:

Short Course: Bob Blauvelt reported that he has spoken with Lee Slater about conducting a downhole geophysics short course. Bob has received mostly positive feedback on the previous short course taught by Lee Slater. The only negative feedback pertained to the venue. It was discussed that a short course would need both CT and MA accreditation.

Spring Meeting: Venues discussed for the Spring 2012 meeting included: Berry’s Creek Superfund Site (Hackensack River tributary together with NJDEP landfill; geology tour of Central Park; American Museum of Natural History; and Lamont Doherty Earth Observatory. Bob Blauvelt and Craig Werle would follow up on Berry’s Creek; Mike Greenman on the Central Park tour; and Dennis McGrath on Lamont Doherty.

NYSCPG: Sam Gowan reported that the NYSCPG Annual Meeting is scheduled for October 22, 2011. The by-laws have been changed. The current plan is for the geologist registration bill to be re-introduced in January 2012.

Scholarship Fund Drive: Suggestions for a scholarship fund drive included distribution of an email notice to all members and advertisers, and possibly holding a raffle with the prize being an iPhone, free corporate advertising, or a matching contribution.

Treasurer’s Report: The Section and ATMGTF (Angelo Tagliacozzo Memorial Geologic Trust Fund) treasurer’s reports were reviewed and discussed. Bob Blauvelt indicated that he had recently received notice from the Internal Revenue Service (IRS) that the Section would need to renew its charitable status for the Scholarship fund and that the cost of renewal was approximately $500 or less. A motion was made, seconded, and the Executive Committee authorized Bob to take the necessary steps to renew the scholarship’s charitable status; payment for this work was authorized up to $500.

Berry’s Creek/Meadowlands on one of the Hackensack Riverkeeper’s pontoon boats. Mike Greenman has been attempting to contact the Passaic River Institute to line up a dinner speaker; but has not had much luck with call backs from the Institute. As a result, Bob Blauvelt agreed to see if the Hudson Riverkeeper could provide a dinner speaker. A tentative hold the date announcement was issued in the last Newsletter, but because we had not (as of the March meeting) firmed the date up, the meeting date was still tentatively listed as May 7th.

Finally, the location for the dinner has not yet been finalized, and Bob Blauvelt indicated that he would ask the Hudson Riverkeeper for a recommendation (note the dinner will be held at Redd’s Restaurant in Carlstadt, New Jersey).

• Short Course: Bob Blauvelt has followed up with Dr. Lee Slater of Rutgers University regarding holding a second short course. According to Bob, the New Jersey Licensed Site Remediation Professional (NJ LSRP) has approved the requirements of continuing education (36 CEUs) and therefore, the short course on geophysics could be held in New Jersey to provide credits for NJ LSRPs. In addition, Rutgers has offered to provide the course accommodations at no cost; although the course would need to be held in late May to avoid conflict with the current Spring curriculum. As part of this offer, the Section would be responsible for all advertising expenses and would be required to share the profits derived from the course with the University. As a result of this offer, a discussion was held regarding the sharing arrangements from the course and Bob agreed to negotiate with the University to determine if they would be willing to allow the Section to recoup advertising expenses and share the net profits 50/50.

• Newsletter Advertising - Dick Young reported that advertiser revenue is on track and similar to prior years. • ATMGTF Scholarship Committee Recommendations: Dennis McGrath, chair of the scholarship committee provided an update and summary of the evaluation of this year’s Angelo Tagliacozzo Memorial Geologic Scholarship applicants and the deliberations of the Scholarship committee. This year, there were 11 applicants from seven colleges across the northeast. Based on the five evaluation criteria, the Scholarship committee recommended that six student applicants be considered for scholarship awards in the amount of $2,000.

The Scholarship committee’s recommendation was presented to the Board of Trustees for the scholarship and a motion was made, seconded and the committee’s recommendations accepted. The six students selected from this year’s applicants included: Phoebe Azucena – Salem State College Jennifer Delaney – CUNY Brooklyn Diana Flores—Montclair State University Tyler Hall – Hartwick College Shiela Niedziela – Hartwick College Lauren Patricia Redmond – University of Southern Maine Congratulations to this year’s ATMG Scholarship recipients!

ologists provided a broad overview of where the licensure effort stood in New York. According to Sam, after two years of little activity due to the New York budget concerns, the NYSCPG has reviewed its effort to pass the geologist licensing bill. The Council has retained a new lobbyist and is preparing to start a new fundraising effort to support the lobbyist expenses during the 2012-2013 legislative session. The bill has been consistently passed by the NYS Senate and has been transferred for action in the higher education committee in the assembly. The higher education chair is Ms. Deborah Glick, and according to Sam, recent discussions with Assemblyperson Glick have been very positive. In addition, the licensure effort has the backing and support of both the NYS Regents and the NYS Department of Environmental Conservation. As part of the fundraising effort, Sam indicated that Lenny Rexrode, the current NYSCPG fundraising leader will likely be making a pitch for additional contributions from the NE Section of AIPG. In preparation for the funding request, Dick Young suggested that Bob Blauvelt review the treasurer’s reports to determine what degree of support the Section has historically contributed.

• Request for Support from Queens College: Mike Greenman noted that Queens College had recently announced that it would be cutting back core science courses and the Geology Department at the college had been especially hard hit. As a result, Mike agreed to put together a letter on behalf of the Section against the proposed cut-backs and core course cancellations. Mike indicated that he would circulate the letter to the Section before submitting it to Queens College and would also alert National of the academic problems and the Section’s planned response.

The course will be operated by a concessionaire, providing ample spectating and corporate hospitality areas. Construction began in October 2009 and is expected to be substantially completed in Fall 2012 with the maintenance building, comfort station/snack bar, and rain shelter completed in Spring 2013.

The site is one of the largest landfills in New York and at 413.8 acres, it is one of the largest pieces of undeveloped parkland in New York City. Landfill areas such as Ferry Point Park tend to generate landfill gasses, especially methane; therefore in accordance with the New York State Department of Environmental Conservation (NYSDEC) Part 360 Solid Waste Management Permit, a series of soil gas monitoring wells were installed-primarily along the eastern boundary of the site. Large amounts of material are currently being imported to the site to cover the landfill material and provide for the changes in grade needed for a golf course. The NYSDEC Part 360 Solid Waste Management Permit provides the requirements for importing this fill material, which generally consist of concrete, brick, soil, sand, gravel, and rock. With the Golf Course, Community Park and Waterfront Park, this former landfill will be remediated into a premier parks attraction.

EAI, Inc. was awarded the remediation portion of the Maintenance Building, the Comfort Station and Rain Shelter at Ferry Point Golf Course. EAI will be performing the installation of the Liquid Boot Gas Vapor Mitigation System, Sub-slab Depressurization System (SSDS), Venting and Monitoring System, and Gas Monitoring System. EAI will be performing these services over the next few months to help transform this landfill area into a beautiful park!

Dr. Gary A. Robbins, CPG–06715, says we should be "Getting the Most Out of Your Low Flow Sampling Data" and reports the

following: Low flow sampling at contamination sites is commonly required. In addition to obtaining contaminant information by low flow sampling, the stabilized indicator parameters (e.g., dissolved oxygen, pH, electrical conductance, temperature and oxidationreduction potential) can also be very useful in helping to assess contaminant conditions and to evaluate remediation progress. Often overlooked as useful to site assessment, beyond just indicating when to sample, are the steady state drawdown and flow rate.

In 2009, Dr. Robbins, along with his students, published a paper in Ground Water on determining hydraulic conductivity using the steady state drawdown and flow rate (Robbins et al., 2009). The method provides equivalent hydraulic conductivity values to that of slug tests. As such, by using the low flow data one can avoid a slug test phase of investigation. useful in monitoring whether the formation hydraulic conductivity is changing between sampling rounds owing to remediation (e.g., clogging pores by particulate migration or precipitation of reaction products). Another advantage of the method is avoiding have to analyze complex unsteady state oscillatory response in wells in permeable formations. In 2011, Dr. Robbins and his graduate student published findings indicating the method avoids the problem of backfill zone drainage that plagues slug tests conducted in wells screened across the water table (Aragon and Robbins, 2011). This year, Dr. Robbins published an interactive, online short course of the method that uses simulations for "hands-on" practice and spreadsheets for analyses. The course has been approved for continuing education credits in New York, Connecticut, Massachusetts and Delaware. the environmental concerns versus the potential energy windfall for this country are hammered out. We have enjoyed working this arena and hope the environmental professionals and regulations can stay a step or two ahead of the industry as it grows.

How would you describe the current business climate?

Cautiously optimistic. The economic problems of recent years hit so deep that people and firms are taking longer to get past the fear of executing business plans that they would normally do.

Many firms have returned to strong profitability and the fear is gradually subsiding. They are starting to grow again or top grade their current talent to be ready for the future.

What are the primary issues currently affecting your business?

The issues are client concerns about the future of the economy and how it affects the environmental arena and the availability of talent. Many firms have mistakenly believed that finding the talent needed in this economic climate would be easy for them. As we have tried to educate them, and they have found out through their own efforts as well, that unemployment for educated professionals has been typically around 3.5- 4.0 %, which is basically full employment. Many HR and hiring authorities are surprised when through their internal efforts they see the volume they were expecting, but not the talent. Many firms have mistakenly believed this would be an employer driven market and have been slow to react. Barring a global crisis of epic proportions, it will be a candidate driven market for many years to come. Talented environmental professionals are often receiving multiple job offers and firms need to act quickly to land top talent. Including the first interview, successful firms will usually have completed the interview process and extended a job offer in 3-4 weeks. These are the firms that have continued to stay ahead in this marketplace.

What part do local/ state/ federal regulations play in your business?

We need to stay abreast of changes as it affects the knowledge base of our candidates. Having people who are newly certified or licensed in a particular discipline is very important to their career tracks and the firms in need of those credentials. gram is a recent example of when regulations change and how the candidates and clients react to that change. Some clients find the LSRP valuable, others have much less need for it.

Do you frequently/ occasionally work with Professional Geologists?

We frequently work with Professional Geologists since the beginning of our firm and many in the NEAIPG. We help them with their career tracks, market information, resume help and when applicable, we can help them with a career change. These professional geologists have also been helpful in assisting with our searches as well. We regularly share information about the industry and our networks. We take our network very seriously, that is why we only work the environmental arena. We have long standing relationships with our P.G. friends for many years and will continue to work with them in the years to come.

An update on the NJDEP Site Remediation Reform Act

On May 7, 2012 the New Jersey Department of Environmental Protection (NJDEP) completed full implementation of the Site Remediation Reform Act (SRRA), N.J.S.A. 58:10C-1 et seq. with the adoption of a package of SRP’s final rules that support the Licensed Site Remediation Professional (LSRP) program. After three years of phased implementation, it may be worthwhile to comment on the LSRP Program and review the status of its various components.

The Department has useful information about the LSRP program on its web site at http://www.nj.gov/dep/srp/. Anyone interested in the LSRP program specifically or the remediation of contaminated sites generally, can sign up on the SRP web site, to receive the program’s frequent listserv messages.

they would sit without NJDEP review for 5 years. This New Jersey LSRP program is much better for our industry and for the clients who want to comply and close their sites. In most instances their mediating party need not wait for DEP direction and pre-approvals to commence and continue cleanups. Instead they proceed with the cleanup under the direction of an LSRP. The SRRA established the Site Remediation Professional Licensing Board (Board) and the LSRP program, http://www.nj.gov/lsrpboard.

The first of the LSRP exams for permanent LSRP status were recently held by the NJDEP. It was a difficult examination, in part because many Regulations were being adopted and Guidance documents and Forms were being issued by the NJDEP immediately before the exam. This was the first of such exams and nobody knew what the exam would be like. The verdict is tough – particularly for people who do not work in NJ and who address only part of the regulations (such as the underground tank program) on a regular basis. I personally took two weeks off work to study.

Every one of my colleagues thought they had failed because the questions were so specific and focused on a myriad of regulations and guidance including SRRA, the Technical Regulations, the Technical Guidance and many other regulations that were recently adopted. New Regulations: In the last six months new regulations were published in the New Jersey Register. The regulations included: N.J.A.C. 7:26C. Admin. The Guidance documents are indeed valuable as a statement of technical knowledge and worth reviewing no matter what State you work in. These documents referenced below were developed by 16 committees that had worked feverishly over the previous 2 years to provide Technical Guidance to the LSRPs, http://www.nj.gov/dep/ srp/guidance/index.html.

A lot of thought has been put into the structure of the SRRA and associated regulations. The Guidance Documents, though very helpful, do not have the force of law and many of the prescriptive regulations have been transferred into the Guidance documents allowing the LSRPs to apply Professional Judgment. The regulations indicate the LSRP should document when the LSRP varies from the regulations. “When do you stop justifying your judgment?� is an interesting conundrum: varying from specific soil and groundwater Standards and Criteria is an obvious example but the Synthetic Precipitation Leaching Procedure regulations that derive a different impact to groundwater standard are a nightmare.

A series of Seminars and Webinars were organized by Tessie Fields and her colleagues in Trenton to introduce these Guidance documents. The Webinars were most helpful, worth reviewing and most convenient in that you could join the webinar and avoid the commute to Trenton, http://www.nj.gov/dep/srp/srra/training/. Wayne Howitz and his colleague such as Bill Hose, Myrna Campion, Linda Grayson, Kevin Schick, Ken Kloo, John Boyer and Donald Kakas were helpful in providing advice and direction.

The LSRP program is based upon the standard deliverables: an initial Risk Assessment, a Preliminary Assessment and Site Investigation, Remedial Investigation and Work Plan and Remedial Cleanup if necessary. A specific Form has to accompany these deliverables that test if the appropriate effort was expended in preparing the deliverable and gleans the site status and conclusions drawn about the site. These forms underwent a number of improvement and for a while the Temporary LSRPs were presented with a moving target, http://www.nj.gov/dep/srp/srra/forms/.

The SRRA program is under a Compliance Assistance mode at present is focused upon: Free Product on site; Vapor Intrusion and Areas of Immediate Concern. Many of the NJDEP case managers have been transferred into Enforcement. Compliance Assistance Alert letters were sent to remind potentially responsible parties of their obligation to investigate and clean up sites and they were required to provide reports to NJDEP by March 1, 2012. This Compliance Assistance program from my perspective is refreshing and helpful in resolving the long-standing backlog. The NJDEP issued a list of experts in the various sub-disciplines and the staff is most helpful and responsive to technical questions and concerns: http:// www.state.nj.us/dep/srp/srra/srra_contacts.htm. I do hope this program is extended: http://www.nj.gov/dep/srp/enforcement/.

What drives the bus are the Regulatory and Mandatory Deadlines.

Interpreting these regulations is difficult but the initial response to the Receptor Evaluation on March 1, 2012 flooded the NJDEP with risk assessment information about many sites - including longneglected sites that were a source of irritation in the business world. In summary, an effective partnership has been developed between NJDEP, the clients and the LSRPs that has moved remediation forward at long-neglected sites.

Angelo Tagliacozzo Memorial Geological Scholarship Update By: Dennis G. McGrath, CPG-08578 Chair, Scholarship Committee

As in past years, the announcement and application form are planned for distribution between late August and early September.

A package consisting of a cover letter, two color announcements suitable for posting on a department bulletin board or circulating to students (8.5 x 11-inch and 11 x 17-inch formats), and an application form will be sent to faculty at colleges and universities in the seven states that comprise the Northeast Section (CT, MA, ME, NH, NJ, NY, RI, and VT). Last year approximately 130 announcement packages were sent out via either snail mail or email. The announcement and application form will be posted on and can be downloaded from our web site (www.ne-aipg.org). The Angelo Tagliacozzo Memorial Geological Scholarship announcement will also be listed on www.scholarships.com, a free college scholarship search web site.

The deadline for submitting applications this year will probably be on or around December 6, 2012. The Scholarship Committee will begin their evaluations shortly thereafter. By the time the Winter 2013 Newsletter is published, I should be able to report on the number of applications received.

Our success in growing the Angelo Tagliacozzo Memorial Geological Scholarship Trust Fund is largely attributed to your generosity – the members of the Northeast Section - AIPG. Because of the ongoing turmoil in the financial markets, financial need is expected to rise, so continued growth of the fund is even more important. The long-standing goal of the scholarship program has been and still is to get 100% participation from the membership. The size of your contribution is not as important as making a contribution. Give what you can afford, but give something. If your contribution is received before the end of 2012, you will receive a tax-deduction for this year. Remember: the Angelo Tagliacozzo Memorial Geological Scholarship is a scholarship for geologists, awarded by geologists. Be a part of our success, give something back to your profession, and help us continue to aid undergraduate geology students in need of financial support!
