Presidential Ramblings Mike Greenman, CPG-10442 President, NEAIPG Before I start my final rant as President of the Northeast Section, I would like to take some time to thank the rest of the Executive Board for all their work during the past 3 ½ years of my tenure. I’d also like to thank Bill Prehoda, editor of this newsletter who will be stepping down after this issue. He has brought the newsletter into the digital age from its former paper format. thank Dick Young the publisher of the newsletter for his tireless continuing efforts on its behalf.

In September I was fortunate to attend the AIPG National meeting which was held in Rapid City, South Dakota. At business meetings, each of the sections presented their achievements, problems and issues that affect the individual sections. The Northeast Section remains the largest and one of the most active in the country. Our financial standing is excellent. We have many of the same problems of other sections, such as recruiting new members to the Executive Board and keeping members active in the section. We continue to award numerous scholarships from our Angelo Tagliacozzo Scholarship Fund and hope to continue well into the future.

One of the days at the meeting was spent on one of the excellent field trips that were offered. My trip was to Devils Tower and the Bear Lodge Mountains. The trip included a stop at the facilities of Rare Earth Resources in Sundance Wyoming, who are conducting exploratory drilling in the Bear Lodge Mountains. We received a lecture and tour of their core shed as well as a overview of the area to be mined for rare earth elements much of which are currently imported from China. The trip culminated in a tour of Devil’s Tower in Wyoming.

And now to my final rant. As I said in the last newsletter, projects are now at the mercy of forces outside the scope of the job. I included regulatory agencies, lawyers, insurance companies, utility companies, safety professionals. Some of these side issues have taken on more meaning than the projects themselves. At this point I would like to take on the utilities and utility mark out companies that are increasingly risking the health and life of our workers.

Before any tool can be put into the ground, local utilities must be notified. This process must be started, depending on the state, three or four days prior to the commencement of work.

This is usually accomplished through notification to the local “one call center�. The center notifies all the utilities and mu(Ramblings continued on page 19)

nicipalities that have facilities in the area where work is to be performed. The utilities and the municipalities have three business days to mark out or give an all clear on any facilities that may be affected by your work. Some of the facility owners have companies under contract that actually do the marking of their lines. More about this later.

Anyone working in New York City can attest, New York City does not mark out their lines. Water, sewers, traffic signals, lighting, etc., go unmarked. Water and sewer lines are routinely hit by contractors working on the City Streets. Some of these damaged mains cause millions of dollars in damages.

Even when the contractor is not at fault it can lead to years of legal and financial problems.

Utilities are often marked incorrectly or not marked at all.

Mark outs are very often not completed in the required time.

Notifications are not always sent in a timely manner. The law states that you must have a positive response from all of the affected facility operators. New York State DOT for instance will not let a job start without all of these positive responses on site. Much time is often spent at having operators respond while crews are standing by.

One project recently for New York State Department of Transportation (DOT) along the Hutchinson River Parkway in Mount Vernon nearly had catastrophic consequences. New York State is currently erecting camera poles along all the parkways and expressways in Westchester County. A contractor comes in and prepares a site for the pole. This usually entails a call to the “one call center�. When the site is prepared our drilling company comes in to sample the soil and rock on the site to determine the foundation type needed. A separate call is made since each contractor is responsible for its own utility mark out. The call was made and (Ramblings continued on page 21) -19-

positive responses were received. The outside contractor for Con Ed sent a response indicating that electric lines were marked.

When the crew arrived at the site, the DOT inspector noted that, indeed, the electric line was marked along the curb.

This was well away from where our boring was to be made.

The boring was started and we hit an obstruction at about nine feet. The area had a lot of fill that included concrete, so an obstruction was no surprise. It was decided to move the boring a few feet away rather than go through the obstruction. The second attempt proceeded to rock at about 25 feet below grade.

As the driller was preparing to core the rock, a state trooper stopped and urgently told us to stop drilling. He had received a call from Con Edison telling him to stop us. When Con Ed arrived they asked why we were drilling with a 138kv electric line nearby. We showed the required paperwork and responses. The technician for the mark out company was asked to return to the site. When questioned on why he missed marking the line, he responded that it was his third time at the site and that the only line was the one he marked near the curb. When he opened his computer with the maps showing all the lines, the 138kv line was shown clearly. He had missed it. Our first attempt was right on the concrete encased line. If we had drilled the obstruction there would have been a good chance that one or more people would have been dead or severely injured. The State held a meeting with all parties to investigate this near miss and to determine any corrective actions. Outcome: The technician was fired. The mark out company has been replaced with another.

Shortly after the first incident, we had another incident at a bridge along I-84 near Brewster. With all the usual formalities we had been drilling borings for a bridge replacement for (Ramblings continued on page 25)

several days. We were working on a road below an I-84 overpass. A design meeting was held with members of the utility companies so that they could re-route lines during construction. The representative of the electric and gas company questioned why we were drilling so close to their lines as did the representative from the telephone company. The telephone mark out was done in-house, and the electric was done by an outside contractor. Both indicated that all the lines were overhead. One problem, the lines came down poles on either side of the highway to pass through the ground. Another near miss and another State investigation.

Another disaster narrowly averted.

Several years ago we were drilling for a new water line in Dutchess County, NY. We were working along a country road. Gas was marked eight feet into the road. While drilling on the shoulder, we went through a gas main and luckily there was no explosion. The contractor had marked the line eight feet into the road instead of eight feet off the road. To add insult to near injury, the contractor asked if we were going to pay half of the repair. I don’t think so. Result: $10,000 fine to the mark out contractor.

One of the many problems with mark outs is that as roads are widened and/or narrowed, the utility drawings are not updated. Water mains that use to be 8 feet off the curb are now under the sidewalk as the road is narrowed or further into the street if the road is widened. We have had several instances of this during the past few years.

I can go on forever with stories of poor utility clearances but they only give me so much room. In the next issue, your new President, Jeff Fredericks, will be rambling on. He promises to be cranky. Stay tuned.

Treasurer’s Report: The Section and ATMGTF (Angelo Tagliacozzo Memorial Geologic Trust Fund) treasurer’s reports were reviewed and discussed. A motion was made, seconded, and the Executive Committee authorized Bob Blauvelt to take the steps necessary to renew the scholarship’s charitable status; payment for this work was authorized up to $500.

• Short Course: Bob Blauvelt has followed up with Dr. Lee Slater of Rutgers University regarding holding both a Geophysics and a GIS short course later this fall. Bob has successfully negotiated with Rutgers to hold the courses at the Rutgers campus and that the profits (after covering expenses) would be shared 50/50 between the Section and University; advertising costs along with any sponsorship costs would be the responsibility of the Section.

• Newsletter Advertising - Dick Young reported that advertiser revenue is on track and similar to prior years; as of the Spring meeting, Dick has received 52 advertising renewals and there are 25 additional advertiser responses pending.

With the change in the Newsletter format, Dick has been receiving great feedback from advertisers who really appreciate the color ads and hotlinks. Finally, Dick expressed tremendous gratitude to Bill Prehoda for all of his hard work in upgrading the Newsletter. Lenny Rexrode brought up the fact that with the change in the Newsletter from print to electronic copy, that this has also affected the Directory of Members; the Directory is currently only available in electronic format. Dick Young indicated it was possible to provide hard copy print versions of the Directory on a as-needed individual basis. The cost of providing the hard copy of the Directory would depend on whether it was produced in color or black and white.

• NYSCPG Update: John Nadeau (President of NYSCPG) and Len Rexrode attended the Ex Com meeting and provided an overview of the current progress that the New York State (Meeting Minutes continued on page 31) -28-

Council of Professional Geologists (NYSCPG) have made with the licensure effort in New York. According to John, the licensure bill is currently in the Senate and will likely be approved (it has been endorsed by the Senate the past several times it came up for a vote), and that the Council had a very good meeting with Debra Glick, chair of the higher education committee in the Assembly. The council recognizes that many practicing geologists in the state are unfamiliar with NYSCPG and their goal is to foster outreach and education to build momentum and support among the profession for the (Meeting Minutes continued on page 33)

licensing effort. In addition, the NYSCPG has retained a new lobbyist for the 2012 legislative session. While the Council’s treasury is currently sufficient to cover operating expenses and the lobbyist for this year, additional fundraising is necessary to increase the Council’s outreach activities and to retain the lobbyist beyond 2012. The current licensing effort has three potential factors that favor passage of the bill this time around, including: 1.

The political make-up of the NYS Assembly may be changing and a resolution of the higher education Master’s requirement could be addressed through a grandfathering period; 2.

The recent growth of the natural gas exploration/ production in the Marcellus Shale; and 3.

The NYSDEC has started to write regulations requiring “professional geologists”; DER-10 is an example of these regulatory changes.

• NYSCPG request for continued support: In addition to providing a great overview of what the NYSCPG has been doing, John and Len also made a funding request for continued financial support from the NE AIPG Section. After a spirited discussion, a motion was made to contribute an additional $3,000 to the NYSCPG, the provisions for additional contributions later this year. The motion was seconded, briefly discussed and then approved by an unanimous vote of the Ex Com. 7. Adjournment (15:10).

News From Members William D. Lilley, CPG-3619, PI, published his article "New York's Gaslight Era and Its Legacy" in the Fall 2012 issue New York Archives.

Don Richardson, CPG-10682 has been selected to be inducted into the Hall of Fame at the 2012 President’s Awards Dinner of the National Association of Industrial Office Properties (NAIOP) of New Jersey. You Could Go To Jail I always like a catchy title, but unfortunately the statement might be true if you are an Italian seismologist. I don't know if you were following this story, but I was and found it fascinating, unbelievable and bordering on the ridiculous. It appears that in 2009 scientists and seismologists with the Major Risks Committee that advises the Italian Civil Protection Agency were evaluating earthquake risk potential near L'Aquila, in central Italy, northeast of Rome (Abruzzo region).

The region is located in an active fault zone.

A week after the protection agency met, on April 6, 2009, a 6.3 magnitude earthquake occurred. Just over 300 people were killed and 1,600 people were injured. Buildings in the region were essentially destroyed.

In October, a court found the members of the protection agency guilty of multiple manslaughter. The court reportedly indicated the verdict that the protection agency was

“providing an assessment of the risks that was incomplete, inept, unsuitable, and criminally mistaken.” The members were sentenced to six years in prison and fined $10 million each in damages, plus and the cost of the trial. Reportedly, they must each pay $2.6 million immediately. One of the group, Enzo Boschi was quoted as saying “I am devastated,

I thought I was acquitted. To be honest, I still don’t even understand what I was accused of.” Based on the appeal process, it is unlikely that they will actually spend any jail time.

At a press conference after the committee meeting prior to the quake, one of the committee indicated that there was an "ongoing discharge of energy" and thus implied a large quake was unlikely. The public reportedly took this statement as saying its OK to stay, and thus many did, which eventually spawned the investigation, trial and conviction. In reviewing (Jail continued on page 40) -39-

the minutes of the meeting, no one actually ruled out the possibility of the earthquake, as most prudent seismologists would do. Thus, the communication of the risks seems to be what was on trial here.

As expected, the trial brought outrage within the scientific community and over 5,000 scientists signed onto a letter from Alan I. Leshner the American Association for the Advancement of Science to the Italian president condemning the outcome. The letter is as follows:

“Dear Mr. President: I am writing on behalf of the American Association for the Advancement of Science (AAAS), the world's largest multidisciplinary society, to express concern over the recent indictments of six scientists and a government official by the local prosecutor in L'Aquila. The charges against these scientists are both unfair and naive. The basis for those indictments appears to be that the scientists failed to alert the population of L'Aquila of an impending earthquake. However, there is no way they could have done that credibly.

Years of research, much of it conducted by distinguished seismologists in your own country, have demonstrated that there is no accepted scientific method for earthquake prediction that can be reliably used to warn citizens of an impending disaster. To expect more of science at this time is unreasonable. It is manifestly unfair for scientists to be criminally charged for failing to act on information that the international scientific community would consider inadequate as a basis for issuing a warning. Moreover, we worry that subjecting scientists to criminal charges for adhering to accepted scientific practices may have a chilling effect on researchers, thereby impeding the free exchange of ideas necessary for progress (Jail continued on page 42) -40-

in science and discouraging them from participating in matters of great public importance.

Scientists, engineers, and architects can and should play an important role in mitigating the damage from earthquakes and other natural disasters. These experts can identify areas of risk and inform government preparedness plans and policies for safe development, including enacting and enforcing building codes for buildings, roads, utilities and reservoirs.

The execution of such plans by the government, along with the provision of adequate resources, has great potential to mitigate harm to life and damage to property. We hope that you will exercise the powers of your office to implement such a plan and to involve some of Italy' s best scientists in its design.

News from the Northeast Connecticut Brownstone The New York Times reported on October 22, 2012 that the last of the quarries supplying material for New York City's famous "brownstones" was closing down.

The Portland (Connecticut) Brownstone Quarries reportedly closed last year and the remaining inventory should soon be gone. Mike Meehan re-opened the quarry in the 1990's and has removed most of the readily-available material. Significant investment in the quarry would be required to continue mining.

The location of the quarries along the Connecticut River made transportation of the material to New York City relatively easy. Some brownstone was also quarried in Massachusetts, New Jersey and Pennsylvania, although the quality was not the same as the Portland, CT stone.

The Portland Brownstone is an Early Jurassic feldspathic arenite that is relatively soft and easy to work (thus, favored by builders). That softness, however, is also it downfall due to its propensity to weather rather quickly in certain applications. Anyone who has seen the older brownstones in the city can readily see worn steps and sills and flaking facades.

The bedding face was often parallel to the surface (providing a more uniform color), thus sheets of the material would flake (spall) off due to natural weathering processes. This process was enhanced when groundwater saturated stone was not allowed to dry prior to application.

New York Marcellus Shale In New York's seemingly never ending saga over the Marcellus shale, Governor Cuomo has indicated that the New York State Department of Health will be conducting a review of the potential health effects of drilling the Marcellus shale with the process of high volume hydraulic fracturing. The timeline and specifics of the review have not been released, however if the review is not completed by November 29, 2012, the NYSDEC would be required to reopen the public comment period and a decision on the issue will be pushed to 2013. The NYSDOH is reportedly assembling a panel of experts (external and internal) to review the issue.

The New York State Department of Environmental Conservation's press release of Thursday, September 20, 2012, sums up the current state of the controversy where Commissioner Martens rejected a call for an "Independent" health study of high volume hydraulic fracturing and announces State Health Commissioner will assess the health impacts of drilling:

"DEC has been reviewing approximately 80,000 comments submitted concerning the Department's review of high volume hydraulic fracturing (hydrofracking). While a wide variety of issues are addressed by the comments, many focus on the potential public health impacts of high volume hydrofracking.

I have had numerous conversations with many of the parties on all sides of this issue. I have recently met with several of the groups who have raised public health concerns and it is clear they are not satisfied with the Department's effort to address potential public health impacts. The groups would require that DEC conduct an outside health study that would determine the outcome of the final decision. I reject that demand. I believe it is highly likely that some of these groups will pursue litigation following the conclusion of the Departmental process if they do not agree with the outcome.

I believe deferring to an outside group or entity would be an inappropriate delegation of a governmental responsibility.

Government is the public's independent reviewer: that is the essence of the current process. To suggest private interests or academic experts bring more independence to the process than government is exactly wrong. Many experts in this field have an opinion - pro or con- which could influence the process. Nor could one ever be sure that there weren't potential conflicts of interest with outside consultants if they were to actually direct the outcome. bility to ensure objectivity and a review directed by DEC and the Department of Health is without bias.

The Governor's instructions have been clear from the outset let the science determine the outcome.

Fundamentally, I want to make sure that we have done the most thorough review possible, especially when it comes to public health concerns. In addition, I want to ensure that the Department has the most legally defensible review so that when the Department issues its final determination on this matter, protracted litigation is avoided, whatever the outcome. Accordingly, I have asked and NYS Health Commissioner Nirav Shah has agreed to assess the Department's health impact analysis. I have also asked Dr. Shah to identify the most qualified outside experts to advise him in his review.

While the review will be informed by outside perspectives on the science of hydrofracking, the decision-making will remain a governmental responsibility.

Only after this evaluation is completed will a decision be made about whether to permit high volume hydraulic fracturing in New York. Obviously if there was a public health concern that could not be addressed we would not proceed. The process to date has been designed to maintain public trust in the integrity of DEC's review, and Dr. Shah's assessment will assure New Yorkers that we have thoroughly examined all the issues before making a final decision. The review will also ensure the strongest possible legal position for the Department given the near certainty of litigation, whether the Department permits hydrofracking or not.

I believe this action addresses any legitimate request for additional due diligence and study as well as ensuring DEC's ultimate decision on hydraulic fracturing is beyond reproach (News From the Northeast continued on page 53) -50-

NEAIPG/NYSCPG Fall Meeting Roundup On October 24th 2012, the Northeast Section of AIPG (NEAIPG) and New York State Council for Professional Geologists (NYSCPG) participated in a joint field trip to the Lafarge North America Inc. cement plant and quarry at Ravena, NY. The quarry, which is one of the largest in New York State, has been in continuous operation for 50 years. Quarrying operations primarily target the Coeymans and Manlius Limestones (Devonion; 75 ft. combined thickness in the quarry), whose low Mg content makes them ideal for cement production. These units are overlain by the Kalkberg Limestone (75 ft. thick), the New Scotland Limestone (89 ft. thick), the Becraft Limestone (42 ft. thick), and the Esopus shale (125 ft thick). emitted. Roughly half of the CO2 emissions are released during calcination and half are produced by coal combustion.

3) Clinker zone (>1350째F) where the calcium in the lime bonds with the additives to form the calcium silicates and calcium aluminates that give the finished product its cementing properties when water is added.

Discharge end of kiln

After cooling, the clinker is ground into a fine powder that is ready for transport to the customer. Most of the 1.8 million pounds of cement produced at the plant each year is Type II Portland cement. Portland cement has modest sulfate resistance (sea water, soil, etc) and the addition of gypsum moderates the temperature generated during hardening which lessens cracking. This cement is ideal for housing, roads, and was used in the foundations of the World Trade Center complex.

The dry process kiln is nearly twice as energy efficient as the wet kiln because the ingredients are mixed while they are dry (the trick is evenly mixing dry, clay-sized particles!) and there is no need for the dewatering phase in the kiln.

Angelo Tagliacozzo Memorial Geological 2012-2013 Academic Year Scholarship Update By: Dennis G. McGrath, CPG-08578 Chair, Scholarship Committee

The announcement and application form for the 2012 â&#x20AC;&#x201C; 2013 academic year scholarships was distributed between late August and early October. Following last yearâ&#x20AC;&#x2122;s successful practice, an eco-friendly approach was taken in the distribution of the announcement and application forms. A package consisting of a cover letter, two color announcements suitable for posting on a department bulletin board or circulating to students (8.5 x 11-inch and 11 x 17-inch formats), and an updated application form were sent to 83 faculty members that have sponsored one or more students since 2000. We try never to forget a faculty sponsor, so emails with the announcement and application form were sent to another 22 faculty members that sponsored a student applicant before 2000. Lastly, emails with the announcement and application form were sent to another 24 faculty members at colleges or universities where we have never received a student application.

In total, a paper or electronic copy of the announcement and application form were sent to 129 faculty members at 75 different colleges and universities in the seven states that comprise the Northeast Section (CT, MA, ME, NH, NJ, NY, RI, and VT). The announcement and application form are also posted on and can be downloaded from our web site (www.ne-aipg.org). Information on the Angelo Tagliacozzo Memorial Geological Scholarship was also listed on a free college scholarship search web site (www.scholarships.com).

Sid Horenstein gave a lively and informative tour of building stones at the museum, and because it was such a nice day, he included a stroll in Central Park to discuss the latest interpretation of the bedrock geology of Manhattan. The evening discussion on ethics was led by Dick Dana of the NYSDEC and environmental attorney John Hanna of Whiteman, Osterman & Hanna of Albany, NY. ● The Long Island Pollution Strippers of Smithtown, NY advertised as "Manufacturers of Air Stripping Towers for the Removal of Volatile Organics". ● Fred Fox is still doing his thing! Very upset by this “professional “hubris”. Still not certain that many of us even know just what it means. “Registration is not the answer, but it is a means to an

answer, I guess. Registration is necessary in design work (legal accountability). Investigations are not design. Meaningful certification ideal, not easily put into practice. Too bad our opponents (?) are engineers, who operate from a time-honored (?) bastion of security bequeathed by law back in the bad old days. Guess I’ll begin writing an article/editorial on professionalism”. ● John Jens has been reassigned from Mapping and Charting Establishment, Royal Engineers to the Pentagon, Washington, D.C. as U.S. Army Topographic Programs Officer with the HQDA StaffOffice of the Deputy Chief of Staff for Intelligence. ● Richard M. Troise has been made a VP of G&M and Director of Marketing of Water Information Center, Inc. Mr. Troise is a ground -water geologist and publisher, and has developed and published many textbooks, reference books and periodicals in the water field.

hydrogeologic field supervision during numerous exploratory testdrilling programs, including design and installation of production wells, deep-injection wells, salt-water monitor wells, pumping tests and aquifer evaluations. ● LBG will be opening a new office in Fishkill, New York on January 2 with David Scott recently named an Associate of the firm, as Office Manager. ● Richard M. “Pete” Foose has had an extremely busy spring and summer in 1987! In March-April he joined with Russ Slayback and Ken Weaver in evaluating the Department of Geology at West Chester College for the AIPG. In the late spring, he was a consultant for two projects—one dealing with loss of slope stabliilty, the other with ground-water pollution. In June, he was a staff member for the YBRA-Princeton Geology Field Course in Red Lodge, Montana. In August, he organized and led an Amherst Alumni College in the Middle Rockies.
