South Dakota Corporate Farming:

The Real Story

From the beginning of the corporate farming debate, proponents of the law change have argued that exemptions for dairy and swine operations have been good for other states – specifically South Dakota. When looking at the raw data, it’s easy to see that the volume of animals has increased.

But taking a closer look at the numbers reveals a different story.

Behind South Dakota Law

South Dakota’s corporate farming law has a long and arduous history since its passage in 1974.

In 1988, changes were made to strengthen that original law to prohibit breeding, farrowing and raising of swine by corporations, but those changes led to a loophole that allowed for corporations to set up contracts with farms to raise feeder pigs as long as they were farrowed in a different location.

That growing trend continued until Amendment E was proposed to stop the further growth of corporate-controlled agriculture.

The effort was led by South Dakota Farmers Union who, despite being outspent, was able to help pass the measure in 1998 despite significant funding on the other side by large corporations.

In an effort to seek compromise in the agriculture community on this issue, the Legislature passed Amendment A on to the people of South Dakota in 2002 and was largely supported by farm groups.

This measure would have repealed the original Family Farm Act and replaced it with language that did little to restrict farmland ownership.

While proponents believed it would have given farmers access to capital for expansion, opponents believed it was not stringent enough to keep corporate farming from growing within the state. The measure was ultimately defeated.

Later that year, the issue was taken to the courts and the law was ruled unconstitutional by the Eighth Circuit Court of Appeals. The state of South Dakota appealed that decision but the Supreme Court refused to hear the case and the corporate ban on dairy operations was lifted in 2008.

What Happened Next?

Since the law was ruled unconstitutional, South Dakota has seen its livestock industry transition from that of the family farm model to a largely corporate structure. USDA National Agricultural Statistics Service data reveals that since 2004, the state lost 73 percent of its small and medium farms. For example, operations ranging in size from 100 to 1,999 head went from 695 farms to 185 farms in a 10 year span. The only size operations to see an increase were those operations with more than 5,000 head.

The ban on corporate ownership of dairy was lifted in 2008 by the state’s legislature.

That year alone, the state lost 34 operations.

According to the Rapid City

Journal, there were 1,800 dairy operations in the state and only 10 were home to more than 500 cows.

This changed dramatically when looking at the numbers in 2007 that showed the number of dairies decreased to 660 and 35 operations containing more than 500 cows.

Today, the decrease in dairy operations continues to decrease at a rate higher than North Dakota.

South Dakota’s Agricultural Future

South Dakota’s tumultuous journey to corporate agriculture is not over. Recently, the South Dakota Legislative Assembly introduced a bill that would do away with all exemptions on swine, and allow corporations to own a facility other than simply contracting with a producer. At the time of this publication, no action had been made on the bill.

North Dakota and South Dakota are not the only states going through the fight to save family farm agriculture. Nebraska recently passed a bill to allow corporate ownership of swine, allowing packers to own even more of the food chain.

A movement through the Midwest seems to be afoot. In June, North Dakotans will have the opportunity to reverse the trend and continue to defend the backbone of North Dakota’s economy: family farming. Armed with accurate information in regard to what’s happening in other states, the majority of North Dakotans will do just that. s March 2016

around the state Grant, Morton and Sioux County Farmers Union members gathered in Mandan on Saturday, Feb. 6, to host another year of “Casino Night” where members enjoyed a taco bar, played various games and won prizes.

Kim and Emily McKay sampled coffee at Sabu Chocolate Farm and Britt Coffee Plantation near San Jose, Costa Rica. Participants learned about the history of chocolate and the process of fermenting, grinding and turning the yellow and green fruit into a treat.

Grow to Lead participants traveled to Costa Rica in February where they learned about native animals, plants, trees and insects in Arenal Volcano National Park. The Grow to Lead program is made up of newer NDFU county board members who receive a year of training in leadership skills.

Farm loan meetings held

North Dakota Farmers Union partnered with USDA North Dakota Farm Service Agency (FSA) to host a series of informational meetings in February to discuss financing options for farms and ranches.

The free informational meetings explained opportunities available for loan financing, including the Bank of North Dakota’s Farm Financial Stability Loan Program. Meetings were held in Jamestown, Devils Lake, Minot and Dickinson.

Pat Schmitz from the North Dakota Farm Service Agency State Office gave an overview of farm loan programs. He explained the options for beginning farmers and outlined the requirements of each program.

Norman Thoreson from Garrison State Bank & Trust explained the Farm Financial Stability Loan Program. He also elaborated on guaranteed loans and the process for securing such a loan, including a checklist of required documentation. s

Producers approach income tax time

Agricultural producers had until March 1 to file their 2015 income tax returns without penalty if they did not pay estimates. Producers who paid their estimated tax by Jan. 15 have until April 18 to file without penalty.

Items to note for 2015 income tax preparation: • The 179 expense election for 2015 is $500,000. Generally, the 179 expense election allows producers to deduct up to $500,000 of machinery or equipment purchases for the year of the purchase. There is a dollar-fordollar phase-out for purchases of more than $2 million. The 179 expense election of $500,000 is now in permeant tax legislation.

• The additional 50 percent first-year bonus depreciation provision is in effect for 2015. It is equal to 50 percent of the adjusted basis after 179 expensing. It only applies to new property that has a recovery period of 20 years or less.

This provision is scheduled to be phased out.

• The standard deduction is $12,600 for those who are married

and filing jointly. The deduction is $6,300 for singles.

• The personal exemption amount is $4,000.

• Long-term capital gains and qualified dividend income is taxed at a 0 percent rate for individuals in the 10 or 15 percent tax brackets and at 15 percent for those in the 25 to 35 percent brackets and 20 percent for those in the top income bracket.

• The annual individual retirement account contribution is $5,500 for 2015 or $6,500 for individuals 50 or older.

• The annual gift tax exclusion for 2015 remains at $14,000.

• The 2015 Social Security wage base is $118,500.

• The business mileage rate for 2015 is 57.5 cents per mile.

• Crop insurance proceeds, if received in 2015, may be deferred to 2016 if you qualify. You must use

cash accounting and show that, under normal business practices, the sale of damaged crops would occur in a future tax year.

• A livestock deferral can be made by those who had a forced sale of livestock because of a weather-related disaster.

Remember that qualifying farmers can elect to compute their current tax liability by averaging, during a three-year period, all or part of the current year’s elected farm income. This is done on Schedule J. North Dakota farmers who elect to use income averaging for federal purposes also may use Form ND-1FA, which is income averaging for North Dakota income tax calculations.

Free trade! Free lunch!

We in agriculture talk about free trade agreements as if they are the international equivalent of a free lunch. All we need is a trade deal, we preach, and a full belly—easy profit—is an almost certainty.

This lovely belief, of course, overlooks the absolute certainty that there is no such thing as a free lunch. Someone somewhere always pays.

More often than not, that someone over the last 25 years has been the United States and its farmers, claims new research from the Agricultural Policy Analysis Center (APAC) at the University of Tennessee.

In the lead-up to the Obama Administration bringing the TransPacific Partnership (the oceanspanning trade deal between the U.S., Canada, Mexico, Australia, Chile, New Zealand, Brunei, Vietnam, Peru, Singapore, Malaysia, and Japan) to Congress, APAC’s Daryll E. Ray and Harwood D. Schaffer penned a series of columns that examined the effects of seven recent American “free” trade deals on U.S. farm and food exports and imports before and after implementation.

For example, when Ray and Schaffer squared the books on U.S. farm and food exports and imports to and from Canada under the North American Free Trade Agreement, they found that the “cumulative balance of trade” for the U.S. goods from 1997 to 2014 “was -$30.4 billion.”

That means Canada sent $30.4 billion more in ag goods—grains, meat, animals, fish, wood, and fur—south than America sent north under NAFTA once the 1994 deal was fully implemented.

Likewise, Mexico sold the U.S. $9.6 billion more in food and farm goods over the same 18-year period than the U.S. sold Mexico.

In total, they noted, NAFTA brought nearly $40 billion more Canadian and Mexican farm and food goods into the U.S. between 1997 and 2014 than the U.S. shipped to Canada and Mexico.

This isn’t breaking news; anyone who can read knows that NAFTA has been far more beneficial to international agbiz that works both sides of the border than farmers and ranchers who work on either side. What continues to be news, however, is that American farm and commodity groups stubbornly refuse to accept that NAFTA—like all trade deals—is a two-way street.

Ray and Schaffer explain this paved, nearly-flat roadway in and out of the U.S. this way: “As the NAFTA results suggest, high expectations that trade deals will accelerate growth in the value of total U.S. agricultural exports don’t always materialize.”

Now there’s a phrase U.S trade negotiators might tattoo on their, well, persons because when Ray and Schaffer examined other trade pacts signed by the U.S. since NAFTA what they found wasn’t that “high expectations” for trade “don’t always materialize” but rather that

any expectations, high, low or in between, almost never materialize.

For example, overall the 2001 U.S.-Jordan pact is $224 million under water, the 2004 U.S.Australia deal has netted U.S. farmers a piddling $175 million over 10 years, and the 2006 trade pacts with Bahrain and Morocco collectively are about $90 million in the hole.

The big loser, though, is the 2004 U.S.-Chile pact. In 10 years, Chile has sent the U.S. $24.7 billion in farm goods more than the U.S. sent there.

Overall, these post-NAFTA trade deals have, cumulatively, brought $1.6 billion more of imported food and farm goods here than we exported there.

“While that number is relatively small,” suggest the Tennessee co-authors, “it is likely not the size or direction of the net change that trade agreement proponents would have had farmers believe at the time these agreements were put into place.”

Shorn of its academic niceties, what Ray and Schaffer mean is that American farmers and ranchers resemble sheep running toward often-promised greener pastures every time politicians and farm leaders ring the free trade bell.

National women’s conference wraps up

In January, eight women from North Dakota flew to the Sunshine State for the National Farmers Union Women’s Conference. The conference was held Jan. 23-27 in Clearwater Beach, Fla. Activities included a scavenger hunt on the beach, a sunset cruise on a pirate ship, dynamic speakers and networking with women from around the country.

North Dakota Farmers Union sponsored the participants from North Dakota to attend the conference, including Arlene Walch of Hettinger, Tina Lefor of Gladstone, Debra Dressler of Richardton, Kari Tews of Fargo, Patti Shelkey of Ryder, Rhonda Knutson of Hettinger and Darcy Meier of Venturia.

According to NDFU Education Development Specialist Jennifer Sundeen, the conference was a great opportunity to meet other women from around the nation.

The conference covered topics ranging from transitioning talks, social media, and tools for dealing with arthritis on the farm and ways to prevent it. As part of the conference, the delegation toured a goat farm, a winery and an organic farm.

Sundeen said, “The weather wasn’t as warm as we would have liked it to be, but we still had an opportunity to walk on the beach and take a boat ride on the ocean. Many of the women collected seashells to bring back home as a memento of their amazing time in Florida.” s

A special training session will be held for new co-op directors on Thursday, March 24, from 11 a.m. to 3 p.m. at the North Dakota Association of Rural Electric Cooperatives office located at 3201 Nygren Dr. NW in Mandan.

The training is free for members of the North Dakota Cooperative Directors’ Association (NDCDA) or $50 for non-member co-ops.

Lunch will be provided by Land O Lakes. The training is sponsored by NDCDA and North Dakota Farmers Union.

Topics to be covered include: North Dakota co-op history; roles of members, directors and employees; director duties; financial analysis; and parliamentary procedure.

College students travel to Duluth

North Dakota Farmers Union sponsored a trip for all students in state collegiate chapters Jan. 20-31, to Duluth, Minn.

Twenty-three students from North Dakota State University, University of North Dakota, Northland Community and

Lucas Brown worked on a co-op exercise during training.

Technical College, and Bismarck State College participated in the weekend.

The group had fun skiing and snowboarding at Spirit Mountain but there was also time for education.

The Traveling Cooperative Institute (TCI) from Minneapolis

led a seminar designed to develop leadership skills in the true spirit of cooperation. Students also toured the Whole Foods Cooperative, a consumer-owned cooperative that supports a healthy regional food system. s

Trans-Pacific Partnership Signed

The Trans-Pacific Partnership, a trade and investment deal among 12 Pacific Rim countries including the United States, was signed by all member countries in early February.

The deal, modeled after many failed trade agreements of the past, threatens to increase the enormous U.S. trade deficit, and it does nothing to stop our foreign competitors from cheating the system. It also gives multinational companies the opportunity to sue the U.S. government over our laws.

Before the deal can take effect, it will have to be approved by Congress – a tough task ahead of this presidential election. President Obama will push for passage before he leaves office.

ChemChina To Purchase Syngenta

China National Chemical Corporation, or ChemChina, announced in February that it will be acquiring Syngenta AG for $43 billion. The deal, if approved, would make ChemChina the world’s largest supplier of pesticides and agrochemicals.

National Farmers Union expressed concern over the deal, saying that everyone in agriculture, especially farmers, should be wary of this type of transaction. “NFU will pay particularly close attention to the alarming trend of Chinese governmentowned entities purchasing U.S. and other agricultural companies,” said NFU President Roger Johnson.

NFU is urging the Committee on Foreign Investment in the United States (CFIUS) to review the

transaction to the fullest capacity of its jurisdiction.

President Proposes Budget for FY 2017

President Obama submitted his final annual budget proposal to Congress in February, calling for a major cut to crop insurance, and a boost to funds for agricultural and clean energy research and development.

The administration proposed an $18 billion cut to crop insurance over 10 years. The budget also proposed several beneficial investments to agriculture and rural America’s future.

National Farmers Union was pleased with many of the initiatives rolled out in the budget, but strongly urged Congress to reject cuts to crop insurance, especially considering the lagging farm economy, low commodity prices and weather challenges.

Budget Proposal for Clean Energy R&D

Shortly before the president sent his budget proposal to Congress, he announced that he planned to double research and development (R&D) funding for clean energy initiatives from $6.8 billion to $12.8 billion by 2021.

This proposed increase comes just months after more than 190 nations agreed to a climate change

agreement in Paris. If approved by Congress, the plan would set an example for the 20 countries that committed to the Mission Innovation Initiative, an agreement that these nations would double their governments’ clean energy R&D investments over five years.

The budget also calls for a $106 million investment from the U.S. Department of Agriculture for the development of bio-based energy sources that range from forest systems and farm products to increased biofuels production.

Microloan Program Expanded

The U.S. Department of Agriculture (USDA) in January expanded a federal microloan program designed to assist underserved farmers. The improvements to the program include expanding the eligibility requirements, simplifying the application process and expediting approval of real estate loans.

NDFU focuses on cooperation and education Cooperation and education are two primary focuses of our organization. In fact, North Dakota Farmers Union’s chartered name is Farmers Educational and Cooperative Union of America, North Dakota Division.

Understanding the role your organization plays in education on the cooperative business model is essential to the success cooperatives have across North Dakota and many other states.

Nearly every citizen in North Dakota is touched by or does business with a cooperative every day. We have electric, farm supply, farm marketing, telephone, grocery store, insurance, credit union and other types of cooperatives. We believe cooperative development continues to be one of the primary tools to assist rural people in creating prosperity and improving quality of life.

As members of cooperatives, it is your responsibility to ensure that the governance issues that guide

the cooperative organization remain true to the fundamental principles that have created the success of these organizations.

Participating in annual meetings and elections is very important.

At North Dakota Farmers Union, we provide a number of cooperative services and education programs. These programs and services provide the tools necessary to take our cooperative system into the future, as one of the most successful and opportunistic business structures for individuals to help themselves.

We now are planning our summer camping and youth class programs. These programs are an effective tool in educating our youth about cooperatives and their impact on North Dakota.

Each year, 1,000 kids attend Farmers Union camp learning about leadership, operating a cooperative store, playing at the beach or pool, scaling a climbing wall, and developing lifelong

friends and relationships. Many have told me that watching Farmers Union camp kids run the cooperative annual meeting is amazing. The ability and talent they demonstrate is a great step in their future as leaders.

In fact, Farmers Union kids that become Torchbearers in our program many times go on to lead organizations. They find having Farmers Union Torchbearer on their resume to be a great asset.

We have room to grow our camp. I hope if you or your kids read this column, you will understand the need to develop leaders for our future and for our cooperatives. Our camps are a place to have fun and develop the skills necessary to begin a successful adult life.

Nelson retires from CHS Foundation William Nelson retired March 1 as vice president of Corporate Citizenship and president of the CHS Foundation.

“During William’s more than two decades with CHS, he has led the growth of our stewardship activities, focusing on opportunities that positively impact CHS and its owners,” said Linda Tank, senior vice president, CHS Communications and Public Affairs. “He has helped put CHS at the forefront of agriculture safety and the development of next generation agricultural and

rural leaders through partnerships with universities and colleges, our unique cooperative education grants designed to help tell the cooperative story, and FFA’s National Teach Ag initiative.”

Nelson helped develop the company’s New Leader Forum and also contributed to the growth and development of successful CHS employee volunteerism programs. He also served numerous roles with external CHS partners, building strong relationships with universities, associations and the cooperative community. Among his current positions are the National Council of Farmer Cooperatives’ Executive Education Committee,

the National Cooperative Business Association Board of Directors, and the Agricultural Safety and Health Council of America Board.

Nelson joined CHS in 1992 after serving 13 years as a University of Minnesota faculty member and administrator.

He has been awarded FFA’s Honorary American Farmer Degree and in 2015 was inducted into the Cooperative Hall of Fame.

Tank said CHS will conduct a search for a successor in the coming months with a commitment to continuing to add value for their employees, owners and rural communities through CHS stewardship programs. s
